As recorded in Hindustan Times, the government framed a policy to protect the data imprints on WhatsApp, Facebook and other similar kind of applications. The circular was as received from Supreme Court. The report further reveals that a petition was filed and supported by Attorney General Mukul Rohatgi in the top court questioning the privacy policy of WhatsApp that allows the social media platform to share the data commercially left behind by its users. He said the comprehensive data protection framework would ban sharing of data by service providers or app owners. The stand was further challenged by two students at Delhi high court that WhatsApp privacy policy, which changed after Facebook took over the popular messaging service, did not violate the fundamental rights of a user by sharing confidential data. It was further added that Telecom Regulatory Authority of India was in the process of evolving the data protection framework. It was also confirmed by the center and Telecom Regulatory Authority of India on the plea that privacy of over 157 million Indians has been infringed by social networking sites – WhatsApp and Facebook -for alleged commercial use of personal communication. The final verdict at High court has directed WhatsApp to delete the information of those who had opted out of the service before September 25, 2016 and not to share them with social networking site Facebook or its group companies. The privacy and confidentiality of the information were appealed to be protected and hence end-to-end encryption method was introduced. It was also argued that whether service providers, particularly monopolies and quasi monopolies, who operate services incidental and ancillary to telecommunications are responsible to protect and preserve the privacy of the users.
