For beƩer or for worse, for richer or for poorer… the Įnancial consequences of divorcing When we marry, many of us make the vow "unƟl death do us part" but unfortunately life is not always straight forward and someƟmes marriages break down. Working out who should pay for what on divorce is oŌen hotly contested. A recent case illustrates the type of expectaƟons the Courts will have about each party and how this can alter over Ɵme.

The millionaire racehorse surgeon and his wife Mr Wright was a millionaire racehorse surgeon with an annual income over £150,000. His wife of 11 years did not work but cared for the couple's two children, aged 16 and 10. Before their marriage, Mrs Wright had worked as a legal secretary. Sadly, the couple divorced in 2008 and the Court ordered Mr Wright to make maintenance payments of £75,000 each year for his wife and their two children. The Court's order was based on the Judge's expectaƟon that Mrs Wright would "use her best endeavours to develop an

earning capacity" ie get a job, within two years of the divorce, so that she could also contribute towards her own maintenance costs.

A lesser millionaire AŌer four years, Mr Wright's Įnancial circumstances had worsened and Mrs Wright had sƟll not got a job. Mr Wright was in his ĮŌies and was unable to make suĸcient pension contribuƟons because of the level of maintenance he was paying for his wife, so he applied again to Court to reduce these payments. Mrs Wright was evasive when quesƟoned about her earning capacity and the Judge said that "there is a general expectaƟon in these courts that once a child is in year two, most mothers can consider part Ɵme work". The Court ordered that Mr Wright could reduce his maintenance payments for his wife on a sliding scale over the next six years. Mrs Wright tried to appeal the decision but was unsuccessful. The Court had imposed an expectaƟon, on divorce, that Mrs Wright would Įnd a job and aŌer seven years she had failed to do so. The onus was now on her to improve her

Crest Tree Services Ltd “Job of the Month� We had a decision to make on a line of regrowth elm trees, approximately seventy stems that ran alongside a lane in Long Ashton. This was once hedgerow and had become thirty foot tall specimens. Dutch elm disease was amongst the row affecting a small number of them. Instead of complete removal we decided to coppice the trees with a view to infill with native hedgerow saplings. This will prolong the onset of diseases by creating young healthy shoots,

and in time become an ideal home for song birds amongst other wild life. The root structure to this old hedge line is vital for preventing subsidence to the road side. Retaining the hedge will prevent the need for a retaining wall in place of the trees saving resources and the purse strings. My client also needed a fence to keep the grand children safe from falling down the bank through the old hedge. So as we felled the trees the timber was processed into lengths and we created the fence from the elm. The end goal will arrive when the hedgerow is full with new shoots and the sound of bird song.
