Leicester City Mayor Declares New Show Home Officially Open A brand new show home on the site of one of the city’s oldest buildings was revealed for the first time on Friday 10th February when Leicester’s city mayor declared the first phase of the new Wheatsheaf Works officially open. HMRC turns the screw on builders Builders could see their bank balances subside as they have moved to the top of the taxman’s targeted campaign list. HMRC has announced that it will this year target tradespeople working in the home improvement market giving them an opportunity to come forward and declare unpaid tax. The campaign builds on previous initiatives aimed at plumbers and electricians, and will include hundreds of thousands of tradespeople in construction and building work such as roofing, window fitting, bricklaying, carpentry and joinery. Mark Herson, Private Client Tax Directorat James Cowper comments: “HMRC’s similar campaign to secure payments from plumbers has so far generated close to £4 million, so it is no surprise they are utilising similar tactics with builders. “HM Revenue and Customs are using increasingly sophisticated software to identify those who are not paying sufficient tax and the chances of going undetected are therefore diminishing.” Mark adds: “Tradespeople who suspect their tax affairs are not completely up-to-date would be welladvised to take the disclosure opportunity. This could be the underdeclaration of income, overclaim of expenses or something unrelated to their business. We recommend that those who believe they might owe tax seek advice from an accountant or tax adviser before making a declaration. This way the bill for tax, interest and penalties can be kept to a minimum.”

Location of new special school revealed The location of a new state-of-the-art £9million special school in Charnwood has been agreed. Leicestershire County Council is planning to create the ultramodern building at the Thorpe Hill campus in Loughborough after receiving agreement from the site trustees. The area special school will provide a new home for Ashmount School and offer places for 125 children and young people aged between four and 19. This will be the fifth area special school to be developed in Leicestershire and has been funded by the County Council. The total cost of the project is £9.35million. Work is set to start this autumn and the school is due to open in autumn 2014.

Surprising drop in Construction Administrations Mark Wilson, Head of Construction at Baker Tilly Restructuring and Recovery LLP, reflects on the insolvency statistics for the construction sector taken from Q4 2011 data released by the Insolvency Service. “These numbers show that administrations have fallen from 94 in Q3 to 71 Q4 2011 a reduction of nearly 25%. “Across all insolvencies, the sector saw a reduction of 30% in failure over the previous quarter. The overall failure figure of 650 is the

lowest experienced in the last four years which peaked at almost double (1209) in Q1 2009. But is this a false dawn? • There are concerns that government cuts in new build projects have yet to fully bite whilst the industry continues to complete projects already committed to, • There may be opportunities for those who refurbish properties as clients make do with their existing stock of buildings • There is likely to be a shift in the favour of Civil engineering as government spending increases

Now, the site that holds the Grade II listed building is undergoing redevelopment, while the former factory itself will be refurbished into apartments. Tom Hazelton adds: “Time has stood still on the Wheatsheaf Works site for far too long, so we’re really looking forward to revealing much more of this redevelopment project in the very near future.” The official opening is followed by a Valentine-themed open weekend, from the 11th to 12th February, where the public are expected to fall head over heels for the new properties and can enjoy romantic refreshments and the chance to win a luxury spa break. Help identify land suitable for housing and employment development RESIDENTS are being asked to suggest land or buildings they think could be suitable for housing and employment development. Charnwood Borough Council has launched a six-week consultation asking people to tell it about the location of potential housing and employment sites. The initiative is part of a review of its Strategic Housing Land Availability Assessment (SHLAA). This year’s review is including employment land. National planning policies require all local planning authorities to carry out an assessment of land and buildings within their administrative areas and their potential for housing and employment development. This ensures they have taken into account all possible sources of housing and employment land when planning the future development of their local area. Councillor Mathew Blain, the Council’s Cabinet member for Planning, said: “We are encouraging local people to tell us about land or buildings they own, or feel might be better used, in the borough to ensure that all potential sources of future housing land are considered. “The exercise provides an opportunity for land and property owners to tell the council about their sites. However, you do not have to own a site to submit it to the council - so if you are aware of any land which you feel is not serving any useful purpose and might benefit from redevelopment for housing, please let us know.” The assessment is an important part of the Council’s evidence base for the Local Development Framework - a set of documents that guide planning and development in the area. The submission of a site does not guarantee that it will be allocated for development or receive favourable consideration if an application for planning permission is submitted. Respondents are reminded that applications for planning permission are determined against the adopted development plan and any other material considerations. Thousands of companies received a letter in February from the Deputy Prime Minister Nick Clegg and Minister for Employment Chris Grayling, calling on them to play their part in getting young people earning or learning. The Deputy Prime Minister is announcing details of how employers can access cash to help cover the cost of taking on fresh talent through a ‘wage subsidy’. The subsidy will be paid to companies for taking on young unemployed people and is designed to cover costs like National Insurance contributions. The wage subsidy will: Pay £2,275 to employers for every 18 – 24 year old unemployed • person they employ from the Work Programme. It is open to all businesses, voluntary organisations and • charities. Payments for the majority of business will be made after the • young person has been employed for 26 weeks. For smaller enterprises these payments will be staggered, • with the first payment after 8 weeks and the rest after 26. This recognises that smaller businesses need a boost to their cashflow to make the jobs viable. The wage incentive will also be available for part time • positions, with a rate of £1,137.50 if someone is employed between 16 and 29 hours. Deputy Prime Minister Nick Clegg said: “Getting young people earning or learning is my top priority, and that’s what the Youth Contract is going to do. This is a long-term boost to help business get young people into jobs before long-term damage is done. “Employers have a huge part to play in this and the subsidy we’re announcing today benefits business and young people. “Today I’m writing out to thousands of employers of all sizes – from global corporations to small local firms – calling on them to look at what we’re offering through the Youth Contract and sign up to offer jobs from April. This is a significant moment and a call to arms for businesses to offer longterm opportunities to young people who are out of work.” Minister for Employment Chris Grayling said: “Our primary goal is to get young people into employment. It will also support at least 20,000 extra incentive payments worth £1500 each for employers to take on young people as apprentices, taking the total number of payments available to 40,000. 250,000 additional work experience places will be created through the Department for Work and Pension’s work experience and sector-based work academies programmes. Extra support will be given through Jobcentre Plus in the form of weekly, rather than fortnightly, signing-on meetings, more time to talk to an adviser and a National Careers Service interview. Worrying Situation!

Problem:

I hope that you can assist me in what has become a really worrying situation. I own and manage a painting and decorating business and employ around 20 tradesmen. In late 2010 I was successful in picking up a large commercial contract in Birmingham. The project was the refurbishment of a city centre office block. The programme was progressive, starting from the top floor and working down the building, the idea being that the landlord would rent out the finished floors as work progressed. However, part way through the project, with 4 floors completed, the project was put on hold by the client. I later learnt from the main contractor that this was because the client was finding it difficult to get tenants and the floors that had been completed remained vacant. Some months later, I spoke to the main contractor’s contracts manager who said that they had agreed with their client that the other floors could be completed although the client would be allowed to employ quite a few of his own trades directly, including a painting contractor. Although I agreed to initially suspend operations for a few months, my company was banking on this work and I have now had to lay off about half of my work force. Can I do anything about this? The order I received states a lump sum price for the whole of the job (as per my quotation) and refers to

its enclosed Terms and Conditions. I have looked through these Terms and Conditions and nowhere can I see anything about removing work from my price or bringing in others to complete my work.

Response: Hi Paul. Please look at your sub-contract again and see what the terms say are under Variations. A contract will usually allow work to be omitted and you will have to consider how to deal with such an omission against the facts such as why it has been omitted and how has the character of the work changed. However, usually work cannot be omitted and given to another sub-contractor otherwise this will be a breach of contract and you will be entitled to claim damages,

Therefore, if your sub-contract Terms and Conditions are indeed silent on this matter, then you should record this in writing to the main contractor and assert that you shall be making a claim for loss of profit on the work removed from your sub-contract. If the main contractor has naively agreed with the employer to omit work from its contract without reference to the sub-contractors it will effect, then that is matter for the main contractor, not you. End of stamp duty holiday encourages first time buyers House sales edged up slightly during January as an increased number of first time buyers looked to beat the stamp duty holiday, which expires in March, says the latest RICS UK Housing Market survey. Twelve per cent more surveyors across the UK reported rises rather than falls in newly agreed sales since the beginning of the year. From 24th March, first time buyers will no longer be exempt from stamp duty on properties under £250,000 and some surveyors note this has produced an increase in activity at the lower end of the market. In light of this, respondents were optimistic about prospects in the near term, as a net balance of 19 per cent of surveyors predicted transaction levels to pick up over the coming three months. This represents the strongest reading since May 2010.

January sales top £5 million for new homes developer DESPITE reported slumps in house sales nationally, regional developer Linden Homes is celebrating its best January for five years – selling a home a day for the entire month! The HM Revenue & Customers has recently announced that the number of house sales in the UK fell by one per cent during 2011. Harborough extends Section 106 charges to individual plots ACCORDING to a recent article in the Leicester Mercury, Harborough District Council have extended the Section 106 community obligations to developers on every new home built. Charges ranging from £22,113 to £40,500 for each home have now been published by the council. Harborough District is divided into five zones with the following average charges: • Blaby border: £22,113 Lutterworth: £22,497 • • Market Harborough: £24,485 • Rural south west: £34,800 • Rural north & central: £40,500. Several Mercury readers had complained to the council about the high level of the charges and requested details of how the figures have been arrived at. A council spokesman told the Mercury that, previously, small developments of less than five properties have not had to contribute to any form of Section 106 funding, and that this change aims to benefit the community by helping provide affordable housing. Harborough District Councils website includes the following definition: Section 106 Planning Obligations, or planning agreements, are legal agreements negotiated between local planning authorities and developers in the context of a grant of planning permission. They are intended to make development proposals acceptable, which might otherwise be unacceptable, and provide a means to ensure that a proposed development contributes to the creation of sustainable communities, particularly by securing contributions towards the provision of infrastructure and facilities, for example Affordable Housing and Education.

Council to invest £60m in housing

COUNCILLORS have approved an ambitious plan to invest £60 million to improve Charnwood Borough Council’s housing stock over the next five years. The Council’s Cabinet approved the proposal on Thursday, February 16, to invest the cash as part of the Council’s 30-year housing business plan. Properties in greatest need of refurbishment will take priority under the improvement plan which will see insulation work completed on all Precast Reinforced Concrete (PRC) properties by 2015 and all Decent Homes work complete by 2021. Also high on the list will be improved heating systems. The investment has been made possible thanks to changes in Government rules about the way council housing is financed. Councillor Jane Hunt, Charnwood Borough Council’s Cabinet member for Housing, said: “Under the new rules, the Council is allowed to keep all the rent it collects rather than pay it in to a national pot. This gives us more control over the money, and most importantly means we can increase how much we spend on improving our housing stock. “Over the next five years we plan to spend around £60 million on a programme of improvements which will include works to Precast Reinforced Concrete (PRC) homes and the ongoing Decent Homes programme. “This is fantastic news for tenants, especially those whose homes are in greatest need of investment as they will be the first to benefit from this investment scheme.” Because of the rule change, the Council will first have to pay £79.2 million to the Government, which it will borrow and pay back over the thirty years. This means that all the investment can be paid for out of the Council’s own housing account, which will be made up of loans, government grants and around £18 million a year income from rents. The proposals have to be ratified by Full Council on February 27, 2012. Charnwood Borough Council has 5,847 rented, 287 leasehold dwellings, 18 leasehold shops and 824 garages. These are managed on behalf of the Council by Charnwood Neighbourhood Housing.

In February, one of our readers phoned to ask if a new planning policy had been - or was being - introduced which affected small villages. Apparently, the reader had been informed that if a settlement had less than two of the common village amenities (namely, shop, church, school, doctor, pub, etc.) then the planning authority was within its rights to refuse to consider applications for any additional housing. This seemed a bit odd to us, and so we checked with the planning department at one of the district councils in Leicestershire. The planning officer we spoke to was unaware of any such policy. High profile speakers from the world of architecture and sustainable building technology will point the way forward to a low carbon UK at a conference to launch the findings of new research into refurbishing the UK’s ageing housing stock. CoRE, the UK’s newly built Centre of Refurbishment Excellence, which is supported through the European Regional Development Fund, is to host a conference to debate how best to refurbish UK homes to meet the needs of people living in a low carbon, energy efficient economy. New research into how the UK should meet this challenge has been commissioned by CoRE. The report, A Fabric First Approach to Retrofit and Refurbishment Excellence, will be launched at the conference on 17 May, 2012. CoRE, the UK Centre of Refurbishment Excellence, has been developed to help the country’s construction industry workforce develop the necessary skills to match the scale of Britain’s refurbishment challenge. CoRE is an independent national centre of learning and skills development for the construction industry working for a low carbon UK. Partners in the project are BRE, Stoke-on-Trent City Council and Stoke on Trent College. Young Builder of the Year 2012 Awards launched The national awards to celebrate the achievements of young people who have overcome personal barriers to work and train for the construction industry has been launched.

The Young Builder of the Year awards has successfully run for 13 Last year’s winner, Shane Dean Evans with years and each year Nick Raynsford (left) and Tommy Walsh has attracted a growing number of entries from the future talent of the UK building industry. There are two categories of awards; - those in employment aged between 16 and 25 years old and those still in education aged between 14 and 16 years old. The awards ceremony will be held at the House of Commons on 18th October. John Montague, Chair of Youthbuild said “We are delighted that NHBC, Skanska, Places for People and Northern Tool + Equipment are sponsoring the awards again this year and we would like to welcome Orbit Homes and Land Securities as new sponsors for 2012”. The Rt Hon Nick Raynsford MP, President of Youthbuild UK, said “Unemployment among young people is one of the most serious challenges facing our society. That is why I am such a keen supporter of the Young Builder of the Year Awards which celebrate the achievements of young people who, even faced with poor prospects, have had to overcome huge barriers to train and work in the construction industry”. Last year’s overall winner, Shane Dean Evans (pictured above), who was the winner in the 16 to 24 year-old category, suffers from Cystic Fibrosis. Despite having this serious medical condition, he has excelled in his vocational education and has demonstrated sheer determination to succeed as a qualified joiner and have a real impact in his workplace. The 2011 winner in the 14 to 16 year old category was Giovanni Damiani. He was bullied at school fell into the wrong crowd, and then left before gaining any qualifications however his training manager at Windermere Construction Skills Centre reflects that Giovanni has shown the greatest shift change of any of the hundreds of young people who have attended the centre; he is a dedicated and motivated trainee. Applications will open in late April for both categories of the Young Builder of the Year 2012. As well as the accolade of ‘Young Builder of the Year’ winners will receive a range of cash prizes and tools. Further details can be found on the website at www.ybuk.org
