Second phase of Loughborough’s Waterside Village ready for residents

Rise in construction output masks falling optimism, says FMB

THE RISE IN construction output, the highest since August 2021, masks falling optimism and a drop in residential construction activity, warns the Federation of Master Builders (FMB) in response to the latest construction PMI data. Brian Berry, Chief Executive of the FMB said: “Construction output has been sustained during March through the buoyancy of commercial projects, but the latest PMI data makes clear that growth in the repair, maintenance, and improvement (RMI) and house building sectors has stalled. For smaller construction firms, these projects represent the bread and butter for their businesses. Faced with rampant inflationary pressures and significant uncertainty regarding the economic impact of the war in Ukraine, it’s clear that these smaller building firms look set to suffer at a time when consumers are tightening their belts.” Berry continued: “After a testing period during the pandemic and with business optimism now at a 17-month low, the Government should take a proactive approach to reduce the difficulties. A measure that would act as a boost for builders and reduce long terms costs for consumers would be the introduction of a National Retrofit Strategy. This would create demand for retrofit projects, that local builders will then deliver and cut energy bills for customers. Additionally, with the pace of job creation easing to its weakest level so far this year, attention must be given to encouraging greater numbers of employers to train young people into construction careers.”

NEW HOMES are set to be built in a Leicestershire village after a property consultancy secured planning permission for 70 dwellings and went on to sell the site. Fisher German secured outline planning permission for the 6.8-acre site off Hinckley Road, in Stoke Golding, in just 12 months, which it has now sold to Miller Homes. The firm acted on behalf of the landowner to secure development partner Richborough Estates which subsequently instructed Fisher German’s planning team to work on the planning application. The complex process involved the team arguing that the site should be allocated for housing in the Stoke Golding Neighbourhood Plan, which only included part of the site as a reserved allocation for 25 units, due to housing calculations being outdated and an increased amount being required. Despite these arguments being dismissed by the Neighbourhood Development Plan Advisory Committee, members of the team prepared pre-application submission

and undertook a consultation exercise ahead of submitting an outline planning application in May 2021. Further representations were then made to the Stoke Golding Neighbourhood Development Plan following the publication of an updated version of the neighbourhood plan which had removed the site altogether as a result of the approval of an alternative site in the village. The firm also made representations to Hinckley and Bosworth Borough Council which had produced its draft local plan that highlighted the need for more

housing in the area, demonstrating that the development could support with this. After receiving a resolution to grant consent from Hinckley and Bosworth Borough Council’s planning committee in October, a third-party call-in request was made to the Secretary of State who later determined not to intervene in the decision-making process. During this delay, a S106 agreement was prepared and completed within three months of the committee’s resolution, following collaboration with the borough council and Leicestershire County Council.

Women in Construction Top 100 Influencers NATIONAL FEDERATION of Builders (NFB) launched its Women in Construction Top 100 Influencers at their Construction Summit on Thursday 7th April 2022. The Top 100 Influencers aims to showcase the most influential women and non-binary role models in construction as well as those ally’s affecting change. In construction, only a small proportion of roles are held by women (15%) and even fewer have on tool jobs. Whilst it’s important to appreciate that the industry has changed a lot and has begun to challenge stereotypes and shift perceptions to become more inclusive, it is also important to recognise that there is a lot more work still to be done. This year marks the start of real change for the industry. The Top 100 Influential list is industry wide and part of the NFB’s Women in Construction Programme, aimed at showcasing female and non-binary role models at all levels within the industry, from apprentices and rising stars to Directors. The categories include those unsung heroes by region, the influential list, one to watch, allies, advocates and many more. Housebuilder boosts local area as part of new Fleckney homes development LEICESTERSHIRE-BASED Davidsons Homes is set to invest over £1.6million in Fleckney and the local area, as part of its new development off Arnesby Road. Improvements will be made to enhance local amenities like schools and health services, in line with the housebuilder’s S106 agreement with the county council for its development called Davidsons at Fleckney. Davidsons Homes will also be creating new areas of green open space for the whole community to enjoy, as well as building 40 affordable homes, including five bungalows. As part of the S106 agreement, current plans show that Davidsons Homes will be boosting local education by providing £176,000 towards Fleckney Church of England Primary School, £447,000 for Kibworth School and £95,000 towards Beauchamp College. First new homes completed in major Waterside regeneration

THE FIRST new homes built as part of a multi-million regeneration of Leicester’s Waterside area have been completed. Redevelopment work began back in 2015 to bring the Waterside’s extensive former industrial areas back into use by creating new Peter Soulsby (third from left) meets residents housing, office space, hotels and public open space. As part of that, the city council is working with national housebuilder Keepmoat Homes on a 17.2-acre development, located on Frog Island. City Mayor Peter Soulsby visited the site to see Keepmoat’s new showhome, and met with some of the the first residents who have already moved into their new homes at the development. Overlooking the Grand Union Canal, the Waterside development includes a mix of over 350 new one and two bedroom apartments and two, three and four-bedroom homes, as well as including at least 55 affordable units. In addition to the new homes, there are public green spaces and a new canalside path opening up the waterfront, along with 60,000 sq ft of Grade A office space.

News from Blaby District Council

Concerns highlighted over proposed Hinckley National Rail Freight Interchange A COMPREHENSIVE consultation response from Blaby District Council to the developers of the proposed Hinckley National Rail Freight Interchange has stated that the plans cannot be supported. In a wide-ranging response to the promoter, Tritax Symmetry, Technical Officers from the Council’s Planning team have laid out their concerns in a 36-page consultation response. Scrutinising the proposals against both local and national planning policies, the Council’s technical response from Officers has concluded that the Rail Freight Interchange does not appear to provide the ability for most planned units to be rail connected. According to the Council, this brings into question the whole principle of the proposal. Other concerns include major issues with the amount of development proposed and a significant shortfall in any biodiversity value, minimising landscape harm and poor consideration to the planned rerouted foot and cycle paths. Blaby District Council says it is also disappointed at missing and inaccurate information in the plans. Transport modelling information, including highways mitigation and the impact on the level crossing at Narborough Railway Station have been poorly assessed in the proposals, according to the Council. In addition, the claimed business rate benefit for the Council from the development is inaccurate, as well as a potential miscalculation of the total number of employees by up to 20%. Seven of the twenty-one sections in consultation response have received a ‘Strongly Negative’ conclusion, with six others receiving a ‘Negative’ conclusion. No sections received a positive summary following the Officer’s scrutiny. Councillor Terry Richardson, leader of Blaby District Council, said: “We have to be clear; this proposal is simply not acceptable to myself, my fellow Councillors or Officers in its current state. This has been a deeply flawed consultation from the very outset, and our thorough response has laid bare the failings of these proposals. “I want to commend the work of our Officers on this consultation response. Their efforts have shown that as it stands this is development has no place in the district, and at the very least another formal consultation must be run by Tritax Symmetry when they change their proposals. “There is a lot of work for us left to do in our role as a consultee, to assess the local impacts and to represent the views of residents to get the best possible outcome for local people.” Blaby District Council is a statutory consultee with a crucial role to play in the examination process but will not be deciding the application. Due to the size of the proposed development it is classed as a “Nationally Significant Infrastructure Project” and any decision will be made by the Secretary of State for Transport.

Mitigation of loss Problem WE HAVE a client who wanted some flats renovated but on a budget. We agreed the quote and went ahead with the work with a written contract in place. During the works, the client carried out weekly inspections of our works and made no complaints. Any questions the client had, we responded. We also carried out additional works for the client. The properties were subsequently completed, and we had a final walk around. There were a few snagging items, and these were attended to within a matter of days. All properties were then rented out successfully. Four months later, the client is saying he is not happy with the works and wants money back and has had to get other contractors in to address issues regarding so-called poor standards of work. We were in contact with all the tenants as we had a maintenance contract to the externals – there were no reports of any issues. – if it is a standard form of contract (for example), then it will have conditions which will explain the procedure for recording when a project is considered as having achieved completion, and whether there is a defects rectification period. Even if the written contract is silent on such procedures, where there are latent defects, although the client is not under a duty to give the contractor an opportunity to return to site and make good, the client will usually be under a duty to mitigate the cost. This means that if a third party has been employed to make good any defects without in the first instance giving the original contractor the opportunity to make good, the damages will be assessed as what it would have cost the original contractor if it had made good, and this cost is nearly always less than what the cost is to employ a third party. My advice therefore is to refuse to make any payment to your client, and just wait to see what happens. If your client makes a claim against you, then part of your defence will be that the claiming party failed to mitigate the cost. The new bunker is located at the university’s Edgbaston Campus, on the site of the Physics East Building which forms part of The School of Physics and Astronomy. The Office for Budget Responsibility (OBR) is forecasting an inflation peak of 9% this year which is driving material costs up along the length of the construction supply chain. Whilst able to accept reasonable cost pressure, National Buying Group (NBG) is increasingly concerned that price changes must be justified and be proportionate with transparent detail to support any changes. Nick Oates, Managing Director at National Buying Group says the market is difficult for everyone: “We understand this is a very challenging market and that is being reflected in our negotiations. However, there is a real danger that if prices increase too much, we will impact demand from the end consumer, which could ultimately kill the market. We need to spread the inflationary impact

across the supply chain.”

Nick says suppliers to the merchant sector can help in two ways – by looking at their stock levels and asking for “realistic” price increases. “We’re asking Suppliers to be reasonable about when they ask for price increases. If a Supplier is sitting on many months of stock, there is no need to ask for a price

Market Harborough land sold for £1.4m LAND OWNED by Harborough District Council at Naseby Square in Market Harborough has now been sold for £1.4m to Platform Housing Group to amalgamate with their adjoining land and build 38 affordable homes. The new development will consist of 1-3 bed homes which will be a mix of rented and shared ownership. The scheme will include 8 bungalows for rent which may be attractive to older people or those with a physical disability. Delivering affordable housing is a key priority for the Council and 2021/22 was another record year with over 200 new affordable homes built. However, demand is also rising fast with over 450 applications to join the Council’s housing register in the last three months, with over 600 applications in total. After considering options for the land the Council agreed not to pursue the proposed housing project itself as it has had to refocus its priorities in the wake of the COVID-19 pandemic. The capital raised from the sale will be used to support the Council’s various capital projects across the Harborough district. Platform Housing Group worked with customers of Naseby Square who would be affected by the proposed redevelopment and has relocated all those customers to other Platform Housing accommodation of their choosing.

Marshalls swoops for Burton pitched roof systems manufacturer in £535m deal WEST YORKSHIRE-BASED Marshalls, a supplier of concrete and natural stone products for external landscaping, has entered into a conditional agreement to acquire Marley Group in a £535 million deal. Burton-headquartered Marley is a leader in the manufacture and supply of pitched roof systems to the British construction market. The acquisition is conditional, amongst other things, on the approval of Marshalls shareholders, and completion of the acquisition is expected to occur in late April / early May. Marley’s management team, led by David Speakman (Chief Executive Officer), Dominic Heaton (Chief Financial Officer), and Paul Reed (Chief Operating Officer), will continue to lead Marley following the acquisition and Marley will operate initially as a standalone division within the Marshalls group.

Planning secured for 1,600 new homes and commercial development in Northampton OUTLINE PLANNING permission (subject to Section 106 agreement) has been approved for up to 1,600 new homes, along with major commercial development at Overstone Green, an area of land located to the north east of Northampton. Pegasus Group secured the outline permission from West Northamptonshire Council on behalf of Davidsons Developments Ltd and L&Q Estates. The scheme, on land east of Kettering Road, Overstone, is set to secure and deliver the balance of the Northampton North Sustainable Urban Extension (SUE) as allocated in the adopted West Northamptonshire Joint Core Strategy. The plans, which were recommended for approval by planning officers and unanimously approved by Councillors, also include works to accommodate a new section of A43 dual carriageway along with the development of 5.73ha of commercial land to include an employment area, local centre, new primary school and an assisted living/residential care home. Planning application submitted for council office move OADBY & Wigston Borough Council (OWBC) has submitted a planning application for its innovative plans to move its primary offices to Brocks Hill Country Park. The council announced in November that Bushloe House, the borough council’s current home, is to be sold with the intention of investing the proceeds from the sale into renovating the main building at Brocks Hill Country Park. Local people can now have their say on the planning application on the council’s planning portal – with the planning committee currently expected to make a decision in line with planning law and regulations at the next meeting on 28 April 2022. The COVID-19 pandemic has led to a re-assessment of the council’s office accommodation and its new agile working policies mean far less space is needed for its day-to-day operations. It is expected that a move from the dated, expensive to heat, costly to maintain Bushloe House to the far more modern, eco-friendly Brocks Hill will allow savings to be made every year long into the future. The cost-saving element is a major factor in the decision to move, as funding reductions continue to put pressure on council services across the country.

ONSTRUCTION companies and contractors are still hoping for some good news from the Government to ease the growing cost pressures affecting the industry – but all the signs suggest there will be little to cheer about. Rishi Sunak’s recent spring statement offered a few crumbs of comfort in the form of a cut in VAT on energy-saving products like solar panels and home insulation and support for retrofitting work. It was a welcome step in reducing the up-front costs of energy efficiency projects and, but many in the industry are hoping that, later in the year, he may go further by incentivising retrofitting and other projects through further public support and investment. A 5% cut in fuel duty will also be of some consolation to the industry, facing rising transport and fabrication costs. But a hoped-for pause in the pending rise in National Insurance contributions failed to materialise leaving some construction firms – hoping to invest more to recover from the pandemic and increase staff wages to help cover inflationary pressures – disappointed. Some companies had also held out hope that the Government would offer some support for training schemes to address the skills shortage in the industry, caused by an ageing workforce and the exodus of EU workers following Brexit. Latest figures show the UK construction industry had 48,000

vacancies: a two-decade long high. The industry was also looking for ministers to tackle the cost-of-living crisis, as inflation is threatening to reduce the affordability of mortgages and rents, that will ultimately hit construction companies. As financial pressures hit homeowners, they will inevitably impact on those looking to join and scale the property ladder. And while the Chancellor did introduce some measures to ease the burden of the hardest hit families – including raising the national insurance threshold to £12,570 meaning 30million people can now earn more before they pay any tax – there was a general feeling that the measures didn’t go far enough. Growing energy price rises will hit those on the lowest incomes hardest and spiralling household debt threatens to impact demand for affordable housing, one of the main drivers of the move to decarbonise UK housing. There was no mention at all during Sunak’s speech of the UK Government’s target of achieve net zero emissions by 2050. UK homes are responsible for 35% of energy use and t 20% of carbon dioxide emissions. He has signalled that in his Autumn statement he will cut tax on capital investment by businesses to help them deliver on those targets and many industry figures hope this commitment will be framed in a targeted and coherent green investment policy. It is hoped there will be tax incentives for investors and building owners to reclaim tax on green investment in commercial

Another hoped-for measure that failed to materialise in the Chancellor’s statement was a pause in the removal of the red diesel entitlement for the construction industry, despite a concerted call by industry bodies and a 16,000-signature petition. The red diesel rebate was worth £1.28billion to the industry and that loss has only been exacerbated by the recent hike in fuel prices following the Russian invasion of Ukraine. With continuing disruptions to global supply chains and a predicted rise in inflation to 7.4% this year – and further increases to come – construction companies, contractors, and the wider industry, including building materials manufacturers, were looking for more support but were left disappointed.
