Scape names Kier to deliver £1bn framework for public sector projects Scape - the Nottingham based local authority controlled company which brings economy and efficiency to the whole building process through standard designs and strategic procurement arrangements - is delighted to announce Kier as the sole contractor appointed to deliver a range of construction projects throughout the UK. The framework can be accessed by any public body – not just those in the East Midlands. Shortage of quality offices

A LACK of high-quality space in the development pipeline is leading to a supply problem for city centre grade-A offices, according to new research from national commercial property firm Lambert Smith Hampton. Its latest Midlands Office Market Report confirms fears that Nottingham, along with other cities in the Midlands, is starting to face a shortage of grade-A office space as demand outstrips supply.

Debenhams expanding

THE new boss of department store chain Debenhams has announced plans to modernise a further 25 stores and open nine new outlets over the next four years. The expansion drive, which will create 4,050 new jobs, builds on the 20 store refurbishments the retailer announced in June.

Bid to fast-track A453 widening

Rushcliffe Borough Council says it is prepared to pay towards having the A453 widened. Notts County Council has already committed £20 million towards the widening of the road project, which will cost around £164m in total. No decision on national funding is due until 2015. Now, Rushcliffe Borough Council has pledged to put about half a million pounds towards the scheme in order to try to kick-start it.

New bridge planned for canal

A new bridge – which will be made of brick and timber – is part of Notts County Council’s plans to spend £500,000 on Rushcliffe Country Park to attract visitors. The existing concrete bridge doesn’t help wildlife, and it actually restricts the water flow from the Grantham Canal. The canal, which runs through the park, is currently not used by boats, but the new bridge will be arched to allow vessels to pass through in the future.

OFT Consults On Draft Guidance For Estate Agents And Property Developers

The Office of Fair Trading (OFT) has launched a consultation on draft guidance to estate agents and property developers which aims to help them comply with the law when they handle sales of property and land in the UK.

The new guidance focuses on two pieces of law: the Consumer Protection from Unfair Trading Regulations 2008 (CPRs) and the Business Protection from Misleading Marketing Regulations 2008 (BPRs). It follows the OFT’s Home Buying and Selling Study which found that many estate agents said the industry needed more guidance on the law. The guidance seeks to clarify how the regulations apply to estate agency work. It identifies examples of trading practices that could breach the regulations as well as practical steps that businesses can take to comply with the law when they: • advertise for new business, including through flyers and newspaper adverts, • provide advice to new clients and take new instructions, • market properties, including when property details are put on internet portals, • negotiate and make sales, • deal with complaints. Cavendish Elithorn, Senior Director of the OFT’s Goods and Consumer Group, said: ‘Buying and selling a property is one of the biggest purchases people make and can also be one of the most stressful. Unfair business practices can cause substantial consumer harm and this guidance has been designed to help estate agents and property developers understand what they need to do to comply with the law.’ The consultation closes on 9 December 2011.

Architects will help Arnold Leisure Centre look to the future The improvement and modernisation of Arnold Leisure Centre has moved a step closer after Gedling Borough Council appointed architects to explore the best options for the refurbishment of the existing swimming pool and theatre. Watson Batty Architects will carry out an options appraisal of Arnold Leisure Centre. The architects will investigate, in outline, what is possible on the site, what is a priority and what the costs will be and will report their findings towards the end of the year. In July the Council confirmed that it would be keeping both Arnold Leisure Centre and Bonington Theatre on their current sites, but announced that future options could include expanding the current Arnold Leisure Centre to include the fitness facilities from Redhill Leisure Centre along with the possible introduction of a sauna and steam facilities. Discussions have already taken place with Redhill Academy to identify ways of retaining community use of the current sports hall and synthetic turf pitch for group bookings. Cllr Darrell Pulk, Portfolio Holder for Leisure and Culture at Gedling Borough Council said: “Following on from our announcement in July that we are keeping Arnold Leisure Centre and Bonington Theatre on the same sites, it’s great news that we are bringing in Watson Batty Architects to look at the options for any future development. It will bring us one step closer to knowing what the future holds for these two great community facilities. Over the next couple of months the architects will assess the feasibility of the future options for development. The council will then look at this information, taking a number of issues into account, including investment to meet ongoing maintenance, affordability and the need to ensure we meet current and future customer expectations. We are looking to provide an enhanced service that meets the needs of people in the borough, a service that we can all continue to be proud of. A decision on how to progress the development of Arnold Leisure Centre is expected to be made in the New Year.

Stanford Hall purchased Stanford Hall near Rempstone has been bought by the Duke of Westminster as part of a major charitable initiative. The Duke is involved in a project to determine whether a Defence and National Rehabilitation Centre could be established in the Midlands. The Hall has been bought to test its suitability to be such a facility. A full planning application will need to be developed and will involve comprehensive community and stakeholder consultation.

West Bridgford Co-Op to get £225k revamp THE Co-operative is investing £225,000 in its food store in West Bridgford. The money will be spent on giving the Hilton Crescent store a new design and layout. It will also provide a new kiosk and more food ranges which will change on a seasonal basis.

New board member for Nottingham Construction Forum The Board of Nottinghamshire Construction Forum NCF has been strengthened by a new member based in North Notts. Welcoming Teresa Westwood chair of NCF Mervyn Brown commented; “Teresa brings fresh and additional input to NCF in our endeavours to serve the wider Construction Community. She has experience in a wide range of construction offerings ranging from HR through to overall responsibility for business support systems, with FMB member firm Robert Woodhead Ltd she is involved with a company who are regionally active” With multi-million pound contracts for developments - totalling over £1.5 billion - already approved across Nottinghamshire, NCF have ambitious plans to engage with major contractors and developers so that Nottinghamshire specialist sub-contractors share significant value of the work available. New Affordable Housing Scheme in St Ann’s is Officially Opened One of Nottingham’s latest housing developments has not only provided superb new apartments for local people to rent or buy on a shared ownership basis, but the scheme itself has also played a major role in the revitalisation programme of the St Ann’s area of the city. The impressive £3.4m development, named Hibiscus Court, has seen the regeneration of a disused and dilapidated accommodation building to provide 32 two bedroom apartments primarily for the over 55s and is the first project Loughborough-based developer and contractor William Davis Ltd has undertaken in partnership with Tuntum Housing Association. Project partners and residents gathered today (14th October 2011) to celebrate the scheme’s opening and view a show apartment following Cllr. Funding for the scheme has been provided by the Homes and Communities Agency (HCA), Nottingham City Council and Tuntum Housing Association. The scheme achieves a Code for Sustainable Homes Level 3 rating and has been built to Lifetime Homes standards. It utilises Nottingham City’s existing District Heating system, a sustainable heating initiative to provide heating and hot water for the new apartments. This is achieved by burning off domestic and commercial waste to provide green energy to properties across Nottingham. Call for innovative ideas from Grant Shapps Housing minister Grant Shapps has called on businesses, charities and social enterprises to be innovative in their bids to the government’s new empty homes fund. Speaking to Empty Homes at the Conservative party conference he said he would welcome everybody who is able to bring empty homes into use to feel that they can apply to the fund. He said he would like there to be a diverse and wide range of ideas put forward.

Extra Council tax on Long term Empty Homes Andrew Stunell also announced a consultation on Empty Homes Premium. If introduced the proposal would allow councils to charge extra council tax on homes in their area that have been empty for more than two years and possibly keep the extra revenue for for investment into work to bring empty homes into use.

Empty Homes Top Priority Communities Secretary Eric Pickles announced that “Tackling the 700,000 empty homes across the country is a top priority for my Department”. As he reported that English councils received rewards for bringing 16,000 homes into use through the New Homes Bonus this year.

Plant Theft Costing UK Construction Industry Over £1.6 Billion A Year Rogue thieves are draining the life out of the UK construction industry, with crime costing businesses £75 million every year. Research carried out by CCTV security specialist, Netwatch, found that crime, when coupled with costs such as plant replacement fees, hire of replacement equipment, loss of business and increased insurance premiums, is setting the construction industry back a staggering £1.6 billion a year. Niall Kelly, Founder and Technical Director of Netwatch, explained: “This is a major problem for the construction business. It is an absolutely astounding amount of money for the industry to be losing each year because of mindless thieves. “You find a lot of raw metals like copper, aluminium and lead on construction sites, and the value of these materials has seen a huge rise over the past 12 months thanks to the fluctuating economy. “With a lot of valuable plant and equipment like this on site at any given time security is an issue – more thieves are targeting sites across the UK and Ireland, particularly those which are in rural areas and far away from the main road. “Even the best security guards can only be in one place at a time making it very difficult to deter thieves and vandals.” Netwatch’s CCTV system alerts its Communications Hub if any activity is detected on a construction site when there should be no one around. A live audio warning is issued immediately, which often results in the would-be thief being scared off. Mr Kelly added: “When the Communications Hub issues a live audio warning, the intruder is taken unawares and the usual response is to immediately leave the site. “We have seen clients go from losing thousands, or even millions ever year, to almost zero losses through theft or damage since having Netwatch’s cameras installed on their site. “We recently had an incident where criminals arrived outside a Netwatch protected site with a specialist stripping machine in the back of their vehicle. Their intention was clearly to remove the wiring from the unoccupied buildings and strip the copper out to sell it. Luckily our communication hub intervened before they could go any further, and the gang was subsequently apprehended by police.”

Mansfield Council to decide on funding for Queen’s Head redevelopment Mansfield District Council is to consider the funding package for building an exciting and innovative new £2.4m retail and office development on the former Queen’s Head pub site in Mansfield town centre, at its Full Council meeting on Tuesday 1 November. The former Queen’s Head pub was demolished in 2008 and the site is currently in use as a temporary car park. Subject to Council approval on 1 November, construction of the new building could start in spring 2012 and be completed by early 2013, in time for the opening of the new bus station. The proposed new building will be funded by £867,567 of European Regional Development Fund and £1.6m of the Council’s own capital funds. The building will incorporate green technologies, such as solar panels and a green roof, to achieve an “Excellent” BRE Environmental Assessment Method (BREEAM) rating. It will be an iconic gateway to the town centre, enhancing the appearance of the area and complementing the new bus station. The development was granted planning permission in July 2010 and will consist of up to three retail units on the ground floor and up to six office units on the first and second floors. The building would be owned and managed by Mansfield District Council, and would be rented out to commercial and retail businesses. Cllr Kate Allsop, Portfolio Holder for Economic Regeneration, said: “The redevelopment of the former Queen’s Head site is an important part of a bigger plan to revitalise the town centre by bringing business and employment opportunities to Mansfield. This development will compliment the new bus station, due to be completed in spring 2013, by offering visitors an even greater retail experience, as well as bringing more business opportunities.”

Families move into new homes on old Killisick Court site

Have your say on Mansfield’s Bellamy Road estate plans People who live and work in the Bellamy Road estate are invited to have their say on major plans to revitalise the area. Mansfield District Council has been working with architects and planners to draw up plans of how to improve some of the areas of the estate. An exhibition display will be available in the YMCA Community Café, from Friday 14 October to Monday 14 November. The initial proposals put forward include: • Developing parts of the playing field adjacent to Adams Way, to provide new homes and a new retail development, whilst retaining an area of open space to include a new play area. • Redevelopment of the central area of the estate by demolishing the existing shops and replacing them with a new village green, enhanced open space, refurbished community facilities and a new play area. • Demolition of the remaining residential flat blocks fronting Bellamy Road East and replacing them with new family housing. • Improve security and privacy to some of the bungalows on Thorpe Road by building boundary walls to the properties, providing private gardens. • New directional signage. Improvements to lighting, parking and the landscape. • A longer term proposal envisages the demolition of all the residential flat blocks which front Bellamy Road West. Residents were asked what they didn’t like about the area and what they wanted to see improved. Families have already started moving into new homes on the site of the former Killisick Court in Arnold, after the completion of a £1.45m redevelopment. The development includes 12 houses and eight apartments, which have been built on the site by local housing association Derwent Living, who have worked closely with the council to complete the project. The apartment block on the site takes its name, ‘Jacob’s Court’ after the late Dr Brendan Jacobs. He was a very popular doctor whose career as a GP in Arnold ran from 1953 to 1989. It was his listening and genuine interest in patients which endeared him to many local residents. The council provided the land for redevelopment of the site and supported a successful bid for funding to the Homes & Communities Agency. The new homes, which are built to Level 3 of the Code for Sustainable Homes, feature solar thermal panels and other measures to ensure energy efficiency. Killisick Court was previously a scheme for older people which included flats and bedsits. But it had gradually become unpopular mainly due to the size of the accommodation so it was closed down. The new development provides modern energy efficient homes for families in a design that complements its surroundings. The homes will be managed by Derwent Living. Cllr Roy Allan, Portfolio Holder for Economic and Strategic Development at Gedling Borough Council said: “I am delighted to see these new affordable homes for local people. It is a striking development and a dramatic improvement on the previous building which enhances the surrounding area.” Ann Green, Secretary for Arnold and Killisick Residents Association (AKRA) said: “It looks so much better than the previous building. The developers have been mindful of the residents throughout the process and have produced a newsletter to keep residents informed. It looks superb and will be great for families.”

Rogue thieves are draining the life out of the UK construction industry, with crime costing businesses £75 million every year. Research carried out by CCTV security specialist, Netwatch, found that crime, when coupled with costs such as plant replacement fees, hire of replacement equipment, loss of business and increased insurance premiums, is setting the construction industry back a staggering £1.6 billion a year. Niall Kelly, Founder and Technical Director of Netwatch, explained: “This is a major problem for the construction business. It is an absolutely astounding amount of money for the industry to be losing each year because of mindless thieves. “You find a lot of raw metals like copper, aluminium and lead on construction sites, and the value of these materials has seen a huge rise over the past 12 months thanks to the fluctuating economy. “With a lot of valuable plant and equipment like this on site at any given time security is an issue – more thieves are targeting sites across the UK and Ireland, particularly those which are in rural areas and far away from the main road. “Even the best security guards can only be in one place at a time making it very difficult to deter thieves and vandals.” Netwatch’s CCTV system alerts its Communications Hub if any activity is detected on a construction site when there should be no one around. A live audio warning is issued immediately, which often results in the would-be thief being scared off. Mr Kelly added: “When the Communications Hub issues a live audio warning, the intruder is taken unawares and the usual response is to immediately leave the site. “We have seen clients go from losing thousands, or even millions ever year, to almost zero losses through theft or damage since having Netwatch’s cameras installed on their site. “We recently had an incident where criminals arrived outside a Netwatch protected site with a specialist stripping machine in the back of their vehicle. Their intention was clearly to remove the wiring from the unoccupied buildings and strip the copper out to sell it. Luckily our communication hub intervened before they could go any further, and the gang was subsequently apprehended by police.”

CHECKING A TRADESMAN’S ID TrustMark, the Government endorsed quality mark for tradesmen, welcomes NICEIC’s new A.S.K campaign and wholeheartedly supports the initiative urging homeowners to check the ID of any tradesmen entering their home. TrustMark provides a signpost to local firms who are registered and inspected through scheme operators, including NICEIC, which has more than 2,000 TrustMark registered firms to carry out domestic electrical work. NICEIC research suggests that more than a third of UK homeowners do not check for ID when letting tradesmen into their home. The ASK campaign is telling homeowners to check the ID of anyone employed to carry out work in their home and to make sure the person is who they say they are. NICEIC maintains a register of all its approved electricians on its website at www.niceic.com. Many building projects are the subject of claims – the assertion of a right, usually by the contractor, to an extension of the contract period or an additional payment under the terms of the building contract. Many of these claims are unsound or ill-founded, often because the basic principles are misunderstood. To frack or not to frack? With recent news that councillors in the Vale of Glamorgan have rejected an application to test drill for shale gas in the county, does this spell the end for this ‘unconventional’ technology?

Between 24 October and 4 November, Nottingham’s Local Education Partnership (LEP), through its construction delivery partner Carillion Building and Training Services provider, is hosting a Prince’s Trust Get into Construction course at Ellis Guilford School in Old Basford which is currently being refurbished following a £12 million investment. The Prince’s Trust Get into Construction course offers tuition in bricklaying, joinery, paving and other construction operations and the young people will find out more about the construction industry through site tours and presentations. More than three in four young people supported by The Prince’s Trust move into work, training or education. Nottingham’s LEP continues to support the young people after they have completed the course by providing two-week work experience placements on Carillion Building projects in Nottingham and is working hard to identify routes into permanent employment. The Prince’s Trust Get into... programme aims to give people aged 16 to 25, who are unemployed, the chance to train and get work experience in a variety of industries including construction. Mark Harding, General Manager of Nottingham’s LEP, said: “We are delighted to be supporting the The Prince’s Trust by giving Nottingham‟s young people the opportunity to gain knowledge of the construction industry and learn new skills which will hopefully boost their job prospects in these tough times. To date we have hosted seven courses which have benefited 89 young people, giving them the skills and confidence to find work.” The Get into... programme is just one way in which Nottingham’s LEP is supporting training and skill development opportunities for people in the city, with more than 130 apprenticeships and 45 work experience placements, supported to date. Infrastructure Underpins Construction Growth

Latest data from analyst Glenigan shows 4% growth in construction projects starting on site for the three months to September compared to the same period a year ago.

The basis for the decision is believed to have been centred around the potential risk of pollution to ground water supplies, however it is understood that Coast Oil and Gas Limited are likely to appeal. Hydraulic fracture as a technology has been used in the US since the 1940s and is centred on large volumes of predominantly water being pumped into oil and gas bearing formations which leads to the reservoir rock fracturing and releasing oil and gas. The process is assisted by chemicals being added to the water, partly to assist with dissolving rock and then to aid flow of fluid. Concern exists regarding the fracking liquid that remains in the strata, impacting on underground water supplies. Gas drilling in parts of Lancashire was suspended, after two earth tremors in April and May of last year took place near Blackpool, investigations are ongoing but the tremors could possibly be linked to fracking operations. France have banned fracking, whilst the Department of Energy and Climate Control (DECC) remain broadly supportive of gas shale exploration. Advocates remain resilient in advising that the technology is tested and has been used in the oil and gas industry for decades, whilst the counter argument points toward pollution and a possible distraction from the renewable energy drive that has gripped the UK. The discussion is likely to rumble on with an increasing reliance on imported gas, energy security and affordability, however caution would seem the overriding driver until such time as the multiple concerns have been addressed and comfort provided that there are no adverse repercussions. The increase is the result of 34% and 7% growth in the infrastructure and non-residential sectors respectively and a 14% decline in residential project starts. Infrastructure growth was driven by large investments in road and rail station projects in the South West and South East of England. Growth in the value of utilities projects was less pronounced, but the sector still benefitted from projects including the decommissioning of a nuclear power plant and a £75m wind farm in Lancashire. In addition to the growth in the underlying value (under £100m) of infrastructure starts was the start of £160m Woolwich Station development as part of Crossrail. Office and industrial construction increased significantly, with project starts including a £35m Distribution Centre in Lancashire and (above the £100m underlying value threshold) the £150m Trinity Square development in Gateshead. The 14% fall in residential reflects 2% and 25% falls in private housing and social housing project starts respectively. “Whilst further retrenchment in social housing construction is forecast for the near future, private housing starts are expected to stabilise over the coming months” commented James Abraham, economist, Glenigan. London, the South East and South West of England saw most growth in the flow of new work while the East Midlands and Wales saw annual growth of over 10%. By contrast, over the three months to September the underlying value of project starts in Scotland and Northern Ireland fell by more than a fifth together with stagnant performance in Wales, the North East and North West of England.

Consultation Starts On Future Planning Policy

Local people can have their say on how land in Newark and Sherwood should be allocated for housing, employment and retail developments. A six-week consultation period opened on Monday October 3 on the Allocations and Development Management Options report. The report sets out which areas of land throughout Newark and Sherwood can be used for what purpose. Public consultation ends on Monday November 14, 2011. Anyone who wants to have a look at the proposed allocations and their purpose can attend a consultation event, view the documents online, at Kelham Hall or at one of the district’s libraries. Comment forms will be available. Consultation events are being held in various locations across the district: The Allocations and Development Management Options report is part of the Local Development Framework (LDF) which sets out how the district will develop in coming years. The LDF replaces the Local Plan. There needs to be a supply of land for housing, employment and retail development in Newark and Sherwood to meet the anticipated needs of the district and its people. To ensure new planning developments are consistent and properly planned, the district council must also provide a framework, or criteria, against which planning applications are assessed. To do this, the council has created plans of areas where allocations are proposed, highlighted possible alternative sites and set policies about how that land can develop in the future – through the LDF. Once the most appropriate sites have been allocated, communities are provided with a degree of certainty over the location and scale of major development that will take place within their area and developers can approach sites with a degree of certainty of their suitability for particular uses. Allocating sites for major development does not stop development taking place elsewhere; sites will come forward over time. However, a robust set of planning polices, together with national guidance, will help the council decide whether these sites are appropriate for development and if so, the issues that should be taken into account in deciding planning applications on them. The first stage in developing the LDF was completed by the adoption of the Core Strategy Development Plan Document (DPD) in March of this year. Up to four successful candidates will form a small band next year, travelling together throughout the country to learn more about traditional building crafts from masters of the trades. The Fellowship is an advanced training scheme, devised to encourage and nurture young people from any trade employed in the repair of historic buildings. National concern at the lack of people with the skills needed to care for Britain’s historic buildings and structures, both now and into the future, means that this unique training opportunity is becoming increasingly relevant. Since 1986 SPAB has organised and administered the Fellowship to promote and develop the specialised skills required for the repair and maintenance of historic buildings and to promote understanding of the importance of conservative repair. Mr. Paul Martin (48) from the Vale of Belvoir has worked with the firm since 2007 as Contracts Manager then General Manager and in his new role will oversee the company’s continuing expansion in Nottingham, the East Midlands and the Home Counties. His early career included project management in conservation for English Heritage and commercial contracts with blue chip clients such as BT and National Tyres. In September 2010 Rushcliffe Council took the decision to review the Regional Strategy housing target that has been imposed on Rushcliffe. Consequently, over the last year the Council has been working to identify how much new housing will be needed in Rushcliffe over the next 15 years and where it should be located. A great deal of consultation about potential housing sites has been carried out over the last 2-3 years and this is still very relevant. During the summer of this year the council also undertook some in depth consultation in East Leake, Keyworth, Radcliffe on Trent and Ruddington. The results of all this work are now being brought together and in October a working group of Councillors met to help finalise the report that will go to the Cabinet in November. The Cabinet report will be published in the next few weeks and will include a number of recommendations as well as lots of supporting information. If the Cabinet supports the recommendations, they will then be debated by the whole Council in December. If approved, the proposals will then form the basis of the Council’s Local Plan which will be tested at a public inquiry to be held sometime next year.

The makeover of Ellis Guilford School has begun as the steel frame for the new building went up in October. An investment of over £12 million will see Ellis Guilford School and Sports College transformed into a state of the art school for secondary aged children in Old Basford. The existing temporary accommodation at the school will be replaced and a number of other inadequate buildings, including the Guilford building, will be demolished and completely rebuilt. The construction work is being carried out by Nottingham’s Local Education Partnership (LEP) which is a public private partnership between the Council and inspiredspaces. This is the twelfth school that the LEP has rebuilt or remodelled in Nottingham. Through this project, Nottingham’s LEP will continue to boost the city’s economy by creating jobs and training opportunities in the construction industry and supporting local businesses. The aim is for a third of the labour force to be made up of citizens who live in areas with an NG postcode (Nottingham City and Nottinghamshire) and to spend over a third of the total construction budget with companies that have an NG postcode. Over the life of the project, the LEP also hopes to provide placements for up to 15 apprentices and will offer placements for homeless individuals through the Business Action on Homelessness programme. Councillor Jon Collins, Leader of Nottingham City Council, said: “I’m delighted to see work starting on the remodelling of Ellis Guilford School. This investment will enable us to provide 21st century learning environments and an ICT service that engages and inspires young people and their teachers. “This scheme is also another great example of how the Council’s innovative major projects are having a significant positive impact on the city’s economy. Local people are set to benefit directly from real jobs and hands-on training opportunities, a vital tool for energising communities.” Construction work is due to be completed in Autumn 2012.

FMB Backs Government Planning Reforms The Government needs to stick to its guns and carry out its intended reforms to the planning system, says the Federation of Master Builders (FMB) in its response to the Government’s consultation on the draft National Planning Policy Framework (NPPF). Brian Berry, Director of External Affairs at the FMB, said: “The Government’s planning reform proposals strike the right balance between economic growth and environmental protection. The presumption in favour of sustainable development is certainly needed if Britain is to have the homes and infrastructure that it requires. It has been unfortunate that the planning proposals have been subject to scaremongering and misinformation which has not been helpful.” Berry continued: “Environmental protection is essential to everyone’s quality of life, but it must also be accepted that jobs and housing are too, and that the planning system has to deliver the conditions to support all three. We urge the Government not to give into pressure from the anti-development lobby and to continue its reforms of the planning system.” Berry concluded: “Planning may not be the main factor holding back house building at the moment but it certainly was in the decade leading up to the credit crunch and it will be again when credit flows return to normal unless we act now to get reforms in place. More detail is still required to understand how the balance between development and environmental protection will work in practice and this will require constructive input from all sides.”

Builders’ Problems SOLVED

We’ve priced a job but want to pull out Problem: I part-own and manage a very successful bricklaying sub-contractor. The company was established some 40 years ago by my father and during that time we have built up a strong client base. I took the day-to-day running of the company over from my father a few years back and despite the downturn in the construction industry, our order book has not looked better! A couple of months ago we were invited by a client-contractor to price a new build project in Hertfordshire. We submitted the price and a few weeks later a purchase order was issued, which included reference to an additional discount of 2½% and incorporated their standard printed Terms and Conditions of Sub-contract. They are now chasing us to start, but I am reluctant to do so and wish to pull out. The reason for my reluctance is that we have carried out a couple of other projects for this contractor, and each time we have had contractual issues and problems in getting paid. We have plenty of work on and all of our current clients are very good payers, so it is not as if we need work from a client that we know will be problematic. Can my company simply refuse the work having already priced it? Thanks. Chris, Knighton, Leicester

Response: Hello Chris. Before you ‘walk away’ from the project, it is imperative you ensure you

have not entered into a binding contract. That is because if you have entered into a contract but fail to perform your obligations, this will be a fundamental breach of contract which would allow the contractor to claim damages against you. To determine whether a contract exist, you will need to look at the offer you made (the price that you submitted), and the purchase order. If your offer was capable of being accepted, whilst the purchase order simply confirmed acceptance of your offer, then there is a binding contract. If however the purchase order was forwarded with previously unseen or new terms, then this would be deemed a counter-offer, which would ‘destroy’ your initial offer and thus no binding contract would come into existence. Although you will need to check that the accompanying Terms and Conditions of Sub-contract was not included with the initial enquiry

(and notwithstanding previous usage), from the outline you have given, the additional 2½% discount would be enough to render the purchase order as being a counteroffer. If the purchase order was deemed to be a counter-offer, for a contract to come into existence you would have to unconditionally accept the purchase order, and this could be done in a number of ways. You could write back and confirm your acceptance or simply pick up the telephone and verbally confirm acceptance. You could also commence with the work, acceptance of which would be by conduct. © Michael P. NOTTINGHAM-based housebuilder, Barratt East Midlands, has appointed a new sales manager to oversee a selection of the new housing developments within its growing portfolio. Andrew Handslip, 31 from Derby, has been tasked with managing five of the division’s schemes including The Fairways in Chilwell, one of three new developments that the company is launching over the next few months. Andrew joined the division at the start of September and is relishing the new challenges he is facing. Local School Children Enjoy A Lesson In Site Safety With David Wilson SCHOOL children from Leen Mills Primary School in Hucknall have enjoyed a lesson in site safety after visiting David Wilson East Midlands’ Papplewick Green development on Papplewick Lane. 60 pupils took part in the educational tour which aimed to promote staying safe on building sites and contracts manager, Daryl Marshall, along with site managers, David Dearden and Zoe Rawlings, were on hand to lead the tour and to answer any questions the budding brickies had about working building sites. The youngsters, who were aged between nine and 11, also got an insight into the house building process as a whole and were shown how each of the new homes at the development was constructed. Darren Langton, Construction Director at David Wilson, comments “A lot of our developments are located near schools as the majority of our developments are family orientated, so we regularly carry out site safety visits as the safety of the children living in the surrounding area is of utmost importance to us. “As a working building site, children could be forgiven for looking at the machinery and equipment and seeing it as a fun and exciting playground but that is certainly not the case and these visits are a great way of teaching them all about the dangers of playing on building sites, whilst promoting the importance of staying safe at all times. “Whilst we endeavour to keep these visits as informative as possible, we do like the children to have some fun too so we gave them their very own David Wilson high-viz waist coats and hard hats, so they could feel a part of the team.” John White, Head Teacher at Leen Mills Primary School, comments “The children who visited Papplewick Green thoroughly enjoyed the tour and it appears to have been a very valuable learning experience, especially as they were given the chance to look around and witness a working building site first. “I’d like to thank David Wilson for inviting the school to take part and hopefully the children will keep what they have learnt in mind if they are ever playing near working building sites.” The school children who took part in the tour have now been invited to put their learning into practise by designing a poster promoting site safety. David Wilson will chose one winner from the entries and that design will be made into an actual poster and displayed all around the development promoting safety to others. The winner is due to be announced within the next few weeks. ‘No Room At The Inn’ For East Midlands Pet Owners Who Rent How far would you go to find somewhere to rent with your pet? Would you move to a different town away from friends and family or live in a caravan for up to a year? Research conducted by Dogs Trust for its ‘Lets with Pets’ campaign shows that this is the dilemma facing many people who struggle to find pet friendly rented accommodation, as 1 in 3 East Midlands pet owners could not find a suitable property. And while non pet owners spend an average of 50 days looking for a rental property, half of people with pets in the region searched for two months to over a year. Lets with Pets was set up by Dogs Trust in 2009 to help owners find rented accommodation with their pets, working with lettings agents and private landlords to encourage them to consider pets in their properties. This research was conducted to gauge how people go about finding pet friendly rental properties and discover more about their experiences of doing so. In the past five years Dogs Trust, has seen a 56% rise in the number of people handing in dogs to its 17 rehoming centres across the UK due to housing problems. With steep property prices forcing more people into rented accommodation, and prospective tenants facing stiff competition for pet friendly properties, Dogs Trust is concerned that more people may be forced to face the agonising decision to give up their pet altogether, or even have them put to sleep. Clare Kivlehan, who runs the Lets with Pets campaign at Dogs Trust, explains: “Since we launched Lets with Pets we’ve seen a marked increase in the number of people contacting us for advice. We have signed up over 100 lettings agencies across the UK as campaign supporters, but our research shows that the majority are still not giving pet owners the chance they deserve. We’re campaigning for lettings agents and landlords to take a ‘Pets Considered’ approach rather than rejecting all pets. We’d like people to be able to search easily on property websites for suitable options rather than having to make individual enquiries and we’re keen to hear from any agencies interested in becoming campaign supporters.” It seems owners are often forced to keep pets secret, go to extreme lengths to stay living with their pets or compromise on the property they rent. Most face a huge struggle to find somewhere suitable where they can keep their pet. Almost half of UK households own a pet, but this Lets with Pets research indicates that 44% of East Midlands pet owners who searched for a suitable property through a lettings agency found them to be unhelpful. Of those who chose not to use a lettings agency, 30% said that this was because they felt that they would be unable to help due to their pets. www.letswithpets.org.uk

Could you be a SPAB Scholar in 2012? The search is on for four young professionals from the world of architecture and building to benefit from the SPAB (Society for the Protection of Ancient Buildings) Scholarship 2012. This is a training opportunity that has no equivalent. Former SPAB scholars are today among the UK’s leading conservation experts, caring for many of the most significant buildings in Britain – some are cathedral architects, some look after palaces, National Trust houses and English Heritage sites. Successful applicants will set off together next early year on a journey of architectural discovery. The group will travel the length and breadth of Britain via some of the country’s most fascinating built heritage projects to deepen their knowledge of historic buildings and the issues and challenges surrounding their conservation. The Scholarship, which is organised and administered by SPAB, is open to young architects, building surveyors or structural engineers who have some post-qualification experience and who can demonstrate their enthusiasm for historic building conservation. The aim is to give outstanding young building professionals first-hand experience of conservation, visiting and working on site and in craftsmen workshops and studios throughout the UK. During the nine-month programme they travel together as a group, living, learning and working in a range of locations from stately homes to building sites. After spending the first six months as a close-knit band, the scholars take individual paths for the last three months of the scheme, developing and exploring their own specific areas of interest in a project related to the English country house Former scholars include Marianne Suhr and Ptolemy Dean, who co-present the BBC’s popular Restoration series, and Nick Cox who has just been appointed as architect at Winchester Cathedral. He has similar roles at Blenheim Palace, Wells Cathedral, Woburn Abbey and many National Trust properties. Building surveyor, Marianne says: “Quite simply the Scholarship is very special and inspirational. I would urge anyone who is serious about developing a career in conservation to apply.” The Scholarship is open to young architects, building surveyors and structural engineers who have completed the college-based part of their courses (eg RIBA Parts I & II for architects), ideally with two or three years work experience. If shortlisted, all candidates must be willing to attend an interview in London at their own expense. Commitment to the Scholarship is full time, including some weekends, and it is impossible to combine it with any other form of study or employment. Candidates should to be aware that there will be long periods when they are away from home. The programme runs from mid-March to Christmas. There are no course fees as training and administrative costs are borne by the SPAB. Successful candidates will each receive a bursary toward their basic travel and living costs.

Multi-tasking construction firm owners taking on too many roles in the office

usiness owners in the UK construction industry are spreading themselves too thin by taking on so many different roles within their own company, according to new research* by invoice finance specialist Bibby Financial Services.

Construction owners and managers are well aware that wearing a range of different hats is par for the course, but according to the research by invoice finance specialist Bibby Financial Services, many are regularly being forced into taking on other duties in addition to traditional roles such as recruitment, securing finance and marketing. The survey found almost seven in ten (69 per cent) are being drawn into purchasing office supplies, almost a half (48 per cent) are regularly collecting and making deliveries and 57 per cent are undertaking the marketing and PR of their firm. And, while 60 per cent continue in the pursuit of new business opportunities and 87 per cent deal with their clients, the amount of time devoted to these so-called ‘day-to-day’ business functions is being eaten in to due to having to chase payments from customers (60 per cent) and deal with recruitment and HR issues (63 per cent). At a time when owners and managers should be focused on identifying areas for growth as well as maintaining a healthy cash flow, increasing orders and boosting sales figures, the findings by Bibby Financial Services suggest the owner of today’s construction firm is actually an extreme multitasker. But is their willingness to take on extra roles putting their business at risk, due to being too immersed in other necessary, but time consuming matters? Jason Heath, construction finance specialist at Bibby Financial Services says: “The research really highlights just how demanding running a business is and that some MDs may be taking on too much. It is a particular concern that many business owners in the construction sector are spending so much time chasing customer payments, dealing with suppliers and securing funding, in addition to their many duties. “We have supported construction firms before, during and after the recession and understand the pressures facing many businesses in the industry as work has decreased and budgets have become tighter.” But while business owners cannot always avoid the many roles they must play within the firm, Jason believes there are some simple steps they can take to manage pressures. He adds: “For many small and medium-sized enterprises cash really is king and ensuring finances and cash flow are in order has to be a priority. Outsourcing tasks to specialist organisations such as invoice financiers, which can offer comprehensive credit control services and flexible funding solutions, can really help free up business owners time, allowing them to get on with the important job of running of their business.”

The latest figures from Halifax show that the average age of the first time buyer in the East Midlands is 27 but Rippon is hoping to help those who want to get on the ladder earlier on in life by offering a selection of its homes with a new Government-backed scheme. At The Hawthorns on Eakring Road in the rural village of Bilsthorpe, the housebuilder has received an allocation of the Government’s FirstBuy funding which was introduced in a bid to make home ownership more affordable.
