A
storm is brewing over Bur wood’s prestigious and heritage-listed eight-hectare Appian Way, which has the potential to pit neighbour against neighbour as council and residents wrangle over how to solve dangerous flooding on the northern low-lying area of the historically significant precinct. Following heavy rains late last year, major flooding has occurred in a number of homes, cut residents off from their driveways and necessitated lines of sand bags in front of Federation fences. Months ago, Burwood Council hired a generator and installed a pump outside 13 Appian Way, owned by Elisa Lorenzato who bought her dream home for $3 million in August 2010, with a Section 149 certificate stating that the property is not subject to flood-related development controls.

P
ainting a villain is a quick trip to garner a larger readership. Exploring a story, as presented by both sides, can easily suck the journalist in to take sides to sway public opinion and drive agendas. Breaking the story first and fast with juicy details and follow up in this day and age - at a speed beyond the physical capability of typing - has become the norm. I’m going back to 1903 when a wealthy industrialist George J. Hoskins purchased eight hectares of land in Burwood and

BURWOOD Pride, heritage, then progress
conceived a model housing estate – Appian Way. During the height of Federation and by 1911, 36 houses were built not to sell but, as described in the vernacular of the day, ‘to be occupied by selected tenants
of appropriate social standing’ as a long-term investment. Living in Appian Way was aspirational 110 years ago and it still is. Owners in the estate are the custodians of Australian heritage and that comes at
a price and not just the sale price. Preserving a unique precinct warrants (and has) a separate, distinct set of strict regulations, none more so than that which words on formal documents cannot adequately describe. Pride. There are other magnificent homes and enclaves in Burwood and Croydon, but no other precinct than Appian Way better fulfils two of Burwood’s three monikers; Heritage, Progress, Pride. Painting a villain, legally or otherwise, is not in the best interest of the preservation and maintenance of Appian
Way for the future. The wrenching dilemma of recurrent floods in the low-lying northern area of Appian Way currently before Burwood Council and residents is a problem not of their making, but which will be theirs to solve. We can all see the up and downsides of progress. We can all value heritage. So what does pride mean and what value do we attribute to that pride – or is it just a word that fits in nicely with heritage and progress? After reading the full 2002 Appian Way report prepared for Burwood Council, I was
struck by recurring overtones. Access, money and legalities. The current fracas, over the same issues, is eerily the same. Access, money and legalities. The responsible course of action, as it appears to me, is to do what is best for Appian Way in the name of heritage and pride and to do it right. That solution is probably more expensive, but let’s remember that the precinct has an ability to help fund its own survival via the centre oval, which has proved to be in demand by film crews for its preserved heritage. Sandbags and conflict on beautiful Appian Way ›› Continued from page 1 Before Council diverted the pipe to Burwood Road, excess stormwater was pumped down the Lorenzato’s driveway, flooding their garage, parts of the rear of their home, pool and backyard. Their neighbours in 15 and 17 also suffered flooding and damage during the heavy rains. “My husband Robert and I were trying to fulfil a life-long dream buying into this street but it’s been a year of hell,” Elisa Lorenzato said. “The first flooding occurred late last year. We thought there was a blockage and council came out to meet us saying that they thought there was a pipe running under our

house, then changed their mind saying the pipe was running down our driveway.” There are no records or diagrams from Sydney Water, or being supplied by Burwood Council that confirm the existence or location of the pipe at the centre of the growing dispute. During a closed session last week, it was unanimously resolved to inform the Lorenzatos that Burwood Council is lawfully entitled to enter their property to make the necessary repairs to the pipeline and to seek quotes. Ten years ago, after similar flooding and complaints going back to 1984 from the owners of numbers, 13, 15 and 17, Burwood Council sought to negotiate an easement on 13 Appian Way but were unable to reach an agreement with
the previous owner regarding compensation (for $200,000) and future development of the property. The cost of the works at that time was estimated to be approximately $320,000. A comprehensive Council report tabled in June 2002 states that a, “detailed investigation revealed an existing pipeline, which was thought to have been located along the side boundary was in fact located beneath the existing house and swimming pool at number 13 Appian Way. Sidelines were found to run through the front yards of this and a number of adjacent properties. A small section of pipeline appeared to be missing at the junction of the sideline with the main line in the front yard of No. 13 Appian Way.” The report also says that Council (at that time) investigated the interior of the pipe using CCTV, which showed that the pipe under the house has extensive longitudinal cracking, tree root infestation and a lost section under the front lawn of the property. “Should there be a lot of leakage it could lead to structural damage of the house,” the 2002 report states. Four ‘Future Options’ were laid out to Burwood Council in the report. To maintain the status quo, apply for compulsory acquisition, repair the pipeline and abandon the realignment, and the fourth and most surprising, “Do Nothing”. Another alternative considered was to reconstruct the street drainage system clear of private property. Other than referring to this possibility, the report provides no further detail. For the Lorenzatos and their neighbours, the situation is a nightmare, having led residents and Burwood Council to resort to communicating through solicitors. “Our property has flooded seven times since December 2011.We sought legal advice because that is what Burwood Council advised us to do and since then we think we’ve been treated poorly,” Mrs Lorenzato said. “Council thinks they own the pipe even though they don’t have diagrams or waterboard records. They want a 2.8metre wide easement all along our side fence and across our backyard. That’s a total 280square metres of easement and would mean that we can’t develop how we wanted to.” “The best outcome for us is for Burwood Council to plug the
entire distance of the pipe and divert the water under Appian Way to Burwood Road,” she said. A Bur wood Council spokesperson was unable to comment, citing legal reasons. Three resolutions relating to the flooding on Appian Way were passed by council at the closed session on Tuesday September 25.

MAKING BURWOOD A SAFER, CLEANER PLACE
S
iNCE being re-elected as Mayor of Burwood, i went straight back to work to continue delivering a better community for residents, concentrating in particular on making our area a safe, clean and accessible place to live, work and visit. Thanks to careful financial planning and a long term property strategy, in the last financial year Burwood Council achieved an operating result of $23.6 million. This means that Council is in a strong position to continue rolling out the Burwood2030 Community Strategic Plan, with more investment in capital works and ongoing maintenance. The improvements are
already underway, with upgrades to footpaths and kerbs at a number of locations within the area as part of our Walk Safe Footpath Program. The works include the installation of new pram ramps at locations identified as high pedestrian traffic zones, such as in the vicinity of schools and aged care facilities, or the widening of footpaths near the CBD, to improve the safety of pedestrians who access our local restaurants, offices and shops. i have always taken great pride in our community, ever since i was a child growing up in the area, and that is why i remain passionate about making Burwood a safe, ac-
cessible and clean place. As part of our Green Action Plan, Council offers services to keep our area clean such as the illegal dumping and dob in a dumper services and graffiti removal program but it doesn’t end there. At the recent Council Meeting on Tuesday, 25 September i tabled three mayoral minutes to help raise awareness and educate residents on proper waste management. i have requested that Council investigate ways to educate dog owners on cleaning up after their dogs so that our parks and streets remain clean for residents to enjoy.
Closer to the CBD, i suggested to take action on waste management in strata buildings, recommending against the installation of garbage chutes which i believe present health hazards. Finally, i have requested a review of policies regarding the location of post boxes sitting over the footpaths, which very often not only create a hazard but create pollution from discarded junk mail. i want to make sure that our children will experience the same Burwood i saw as a child, a place that is clean, safe and accessible to all its residents, and i encourage the community to continue to support Council in ensuring that our vision becomes a reality.

ouNCiL is making it easier to access restaurants, offices and shops in the Burwood CBD. Council is extending the footpath on the corner of Victoria Street and Johns Street, a major thoroughfare between the business centre and Burwood road, to improve the safety of residents and workers trying to access the main strip. Safety and accessibility remain priorities for Council, over the coming months there will be further upgrades to footpaths and kerbs.

Hub opens doors for migrants Migrants living in the inner west now have greater access to resources with the opening of a new Community Hub in Ashfield. The Community Hub, managed by the Metro Migrant Resource Centre, is located in the forecourt of the new Ashfield Council Civic Centre on Liverpool Road, next to Ashfield Mall. Launching the Community Hu b , S e n a t o r L u n d y congratulated Metro MRC for its new one-stop-shop offering information and referral, direct casework and a program of information sessions on life skills, employment, financial management, education and training, the law and family relationships. “ T h e Fe d e r a l L a b o r Government is providing funding through the settlement services program to assist Metro MRC and Ashfield Council to provide expanded services for the
growing number of migrants in the area, who can face isolation and hardship,” Senator Lundy said. “This Community Hub is a model for migrant and humanitarian settlement services that will support new arrivals not just in the immediate area of Ashfield, but also through outreach services across inner Sydney and the inner west.” Local Federal Member, Anthony Albanese, acknowledged the contribution from Ashfield Council, in providing a prominent space for the Community Hub in its new Civic Centre. “The Hub is well positioned in the community to encourage the use of popular local facilities such as the new library, study spaces and the soon-to-be completed refurbishment of the Town Hall and youth facility,” Mr Albanese said.

Don’t bank on cheque in the mail Eighty-three per cent of small and medium sized enterprise (SME) decisionmakers experienced cash flow issues in the past year, most commonly because customers made excuses for slow payments, according to the recent Bibby Barometer Small Business Survey. As a result, in the last year 23 per cent of SMEs wrote off a bad debt, 32 per cent had customers negotiate to pay in monthly instalments, and 21 per cent had difficulty meeting tax payments on time. We would like to see all SMEs using forecasts or cash flow checks to warn of danger ahead,” he said. When an SME discovers a gap in its projected cash flow, the range of potential solutions can be somewhat limited in these difficult times. Twenty-seven per cent say they would get an overdraft, or increase their existing overdraft (21 per cent), but 27 per cent would have to resort to dipping into their personal finances or access deposits (20 per cent). “Another potential solution is debtor finance, and 11 per cent have been researching its use,” Green added. Nick Griener’s eagerly awaited Infrastructure NSW report, announced last week by Premier Barry O’Farrell, has recommended a 33-kilometre WestConnex tollway to link Sydney’s west with the airport and the Port Botany precinct, and will include the M4 extension and duplication of the M5 East to King Georges Road. Mr O’Farrell said that the government will proceed with Infrastructure NSW’s recommendation to deliver the motorway project in three to five stages with a forecast budget of $10 billion, but which has also been reported as costing $13 billion, which will be funded by tolls. “Even though times are tough, we recognise the need to invest in economic infrastructure to help boost productivity and create jobs,” Mr O’Farrell said. Burwood Mayor, John Faker welcomed the announcement but queried the time-frame for the project’s completion. “This is a major project which shouldn’t be used as a political football and what we are seeing from the NSW government is more spin,” says Mayor Faker. “While we welcome the project I remain disappointed that the government is committing only $2.5 billion in a $10 billion dollar project.” NSW Opposition Leader, John Robertson called for no new tolls. “Even the West Connex project is not fully funded – with the Premier announcing less than 20 per cent of the funding needed to get the project completed,” Mr Robertson said. “The Government must guarantee today that no motorists will be forced to pay new tolls on roads they’ve already paid for – to fill the Premier’s funding black hole.” The Sydney Motorways Project Office under Roads and Maritime Services will be responsible for the detailed work required.

s I touched down at Venice airport I was filled with excitement and a healthy dose of nostalgia. I was once again, returning to my home town on the east coast of northern Italy. Familiar sounds, smells and faces would surely greet me as they had so many times before. But nothing could prepare me for the news that I was about to receive. Once smiling and carefree faces, were instead contorted into masks of fear and uncertainty. Indeed, my quiet town had been rocked by a recent double homocide, the things you only hear about on tv and watch in movies. The northern Italian beach town of Lignano was in the midst of enjoying its Ferragosto splendour, with tourists from all over Europe flocking there to enjoy

on Lignano’s main corso. The couple often ate dinner at a pizzeria across the road from their store before coming home. But this night was shockingly different. When the couple returned they were attacked and beaten by two masked intruders yielding two 20cm knives. The couple was then bound to a chair and placed facing each other, the intruders then tortured the victims for some three hours in a horrific clock-work orange-esque style execution. Despite being a heavily populated area, particularly during Ferragosto, no one heard the victims screams for help and it is puzzling that no one saw anything. The presumed robbers did not

fear of a repeat attack. Locals were too afraid to speak to journalists, myself included in fear of retribution though the general consensus was that the crime was executed by foreigners, perhaps Russian mafia, gypsies, certainly not Lignano locals. Police conducted DNA tests on some 500 locals, even though they firmly believed that the culprits had long escaped Lignano. A month later, 21 year old Lisandra Aguila Rico was arrested in Salerno and taken to Udine for interrogation. After nine hours, she finally confessed to the murder. “I didn’t want to kill them, I only wanted money but then I panicked and everything went wrong,” Lisandra Rico confessed. But she had not acted alone, her accomplice was her 24 year old brother, who had fled to Cuba shortly after the incident. The public was shocked that a young woman would be capable of such cruelties but what was even more shocking was that the two were indeed, locals. “I didn’t expect it, I didn’t want it

The very place where the Sostero’s drank their daily coffee. News of her arrest sent shock waves across Italy, how could a young woman be capable of such a vicious attack? And why? Lisandra claims that they entered the house with the intention not of killing, but of robbing. However not a single item was taken from the home. Furthermore, Rosetta was beheaded after death. Lisandra is being detained at Trieste Women’s Penitentiary whilst police try to locate her brother in Cuba. Locals described Lisandra as a friendly and bubbly young girl who was always smiling, so what brought her to this point? Police were commended for their efforts in finding the killers as many had become resigned to the fact that they would never be found. A single hair found on Rosetta’s watch is what led police to make the arrest. The question remains, what brought two young individuals to commit such a heinous crime? A robbery gone wrong, or a merciless vendetta?

The state of demountable classrooms in the inner west has come under criticism from the NSW opposition in the latest instalment of the ongoing education saga. Changes to the demountable classroom replacement program comes after NSW Premier Barry O’Farrell announced funding cuts to Catholic and independent schools. All of this has made the Labor party see red. Labor Duty MLC for Strathfield, Amanda Fazio lashed out at Strathfield Liberal leader, Charles Casuscelli. “Students in Strathfield deserve a world-class education, but with the O’Farrell Government cutting $1.7 billion from the schools budget – I’m worried the next generation of children will miss out,” she said. “It is sad that Charles Casuscelli has refused to stand up against the cuts and support our students.” According to a statement from Cr Fazio, Homebush West Public School has the highest number of demountables (12) in the Burwood-Strathfield area, followed by Burwood Public School with nine. Cr Casuscelli rejected these criticisms. “The suggestion that we have cut the demountable replacement program is wrong. In ten years it replaced only 216 demountables,” he told Burwood Scene. “Money made available just this year will lead to nearly 100 demountables being replaced with permanent facilities … The focus of demountable replacement this year will be on schools for special purposes (SSPs), which cater to some of our most disadvantaged students.” Cr Casuscelli also dismissed Opposition leader John Robertson’s claim that “children in Strathfield will bake through summer in hot tin cans and shiver through winter in demountable classrooms that will never be replaced.” “All demountable classrooms are air-conditioned,” Cr Casuscelli added.

A case of mistaken identity The arrest of two people in Ryde in late September over a credit card scam, worth $37 million, highlighted the importance of keeping your identity safe. Personal details of the victims in the fraud syndicate were stolen from websites or by skimming devices and then used on fake credit cards. Other cards contained fictitious names. Luxury items were then purchased using the cards, which were then sold for cash. During National Identity Fraud Awareness Week, from October 8, security experts are urging Australians to take better care of their most important asset, their identity. The week also aims to educate consumers and businesses on how to best protect their personal or business identity from the world’s fastest growing crime. According to a Bureau of Statistics Personal fraud survey, Australians lost an alarming $1.4 billion in a 12-month period between 2010 and 2011. NIDFAW spokesperson and Fellowes Australian Marketing Manager, Peter Campbell, said that while identity fraud is a prevalent issue in Australia, many people are unaware of the risks. “A lot of people don’t understand

Local performers on show at Concord Carnival This year’s Concord Carnival on Sunday October 14 will feature local performers on stage between 10am and 4pm along Majors Bay Road, providing a great opportunity for groups to showcase their musical and performing arts talents to crowds of around 20,000 “Concord Carnival celebrates everything that is great about Concord and the surrounding suburbs. The community really gets behind this great event – both in performing and attending,” Mayor Tsirekas said. This year’s local performers include Domremy School Band, Dancing Heart Studio, Ed5
International, Belinda’s Art of Dance, My Guitar School, Ceroc Modern Jive Dance Company, Inner Dance Studios and Concord High School Band. This year’s theme, Fairytales and Fables, will see the cast of Wizard of Oz Stage Show dancing and singing along the yellow brick road. The secluded, peaceful Battersea Park, tucked in beside Sydney Rowers Club, is a haven for locals who begin their bay walks, bring their dogs or have lunch away from the madding crowds. Above the park is a steep incline with a heritage-listed retaining wall, leading to higher ground with thick vegetation including Moreton Bay Fig trees, which over the years have gradually obscured the magnificent water views across the bay. One group of local residents, who meet each Thursday to walk their dogs, were dismayed a few weeks ago to see a developer’s contractor cutting a swathe through the trees and shrubs directly in front of a new development of eleven luxury villas in Battersea Street. “I walk dogs with friends in Battersea Park every Thursday morning, and last week we witnessed approximately six workers from a landscaping company cutting tree roots and using cutting implements and chainsaws in Battersea Park,” said Susan Moxam. “The Moreton Bay Fig is now less than half its size and its roots have been cut in many places. It will probably not survive given the severe cutting and removal of undergrowth around its base and the vegetation in the immediate area is now almost non-existent,” she added. A neighbouring resident is in favour of the cut-back saying, “Fourteen years ago we had a water view and now it’s only a tree view. Canada Bay Council informed us about two months ago that work would be undertaken on the rest of the vegetation, we just don’t know when.”

A council spokesperson said that there had been complaints regarding the overgrowth. “There have been a number of complaints over a long period regarding this strip as it was infested with weeds and uncontrolled growth, which was starting to affect the heritage classified retaining wall,” the council spokesperson said. “The owners of the development approached us with an arborist’s report and also prepared a Vegetation Management Plan about the trees in front of their development. This report was reviewed by our Planning Department and our Heritage Planning Officer and it was agreed these trees could be

removed to protect the amenity and heritage of the area given the potential damage to the heritage retaining wall. The developers paid entirely for the removal.”

Playing against their greatest rivals, there were a few nerves for the Raiders and coaching staff in the first half, with the Leichhardt Wanderers putting up a good fight.
Nothing that a positive pep talk at half time couldn’t fix and the boys re-entered the field with an added energy, and team-work supporting each other physically and mentally to come away with a 12-10 win. The victory solidifies the Raider’s record for winning at least one premiership in each of the six seasons since the club’s inception. The Under 9 Whites, who were crowned Minor Premiers, having won their first five games, went down gallantly to Holy Cross.
