DI]CI,ARATI ON OF COVENANT.$; The undersigned owner of the following described real property ("Declarant") hereby adopls the follorving covenanls, conditions and restrictions for the PIat of: That parl of the Norlhsast quarter of the Northeast quarter, Section 24, Township 40 North, Rangc I West, W.M., described as Lots 2, 3 and 4 of Harbor Mew Short Plat, Situatc in Whalcom County, Washington. I)eclarant reserves the right to add adjacent properties to the said development ruder sirnilar, though not necessarily identical restrictive covenant provisions. Declarant shall mean 365145 l].C. Lld. and its assigns or designated nrccessor of rccord.

GENIIRAI, PROVISIONS: These restrictive covenants and conditions shall run with fte land and shall be binding upon all parties taking title under thern, for a period ofthirty (30) years from the date of recording of this instrument, at which time these covenanls, conditions and resuictions shall be automatically extended for successive periods often (10) years unless seventy percent (70o/o) or more of the owners and contact purchasers, by an instmment or instrurnents in rvriting duly signed and acknowledged by them, terminate or otherwise alter the provisions. Any altcration of change to these covenants, conditions and resnidions shall be made only rflcr a rwittcn approval of seveily (7OVr) percent of the owners of record and contract purchascrs. as wcll as the written consent of Declarant. Each lot shatl be entitled to one (l ) votc and owners of several lots shall have a number of votes equal to the number of lots owned. 2. Landscaping shall be completed within six (6) months of completion construction, or occupancy, whichever occurs first.

At the time of commencement of a house on any lot the owners or builder shall first import and spread sufficient clean rock, gravel or other suitable material to provide a propcr driveway and construction access onto the lot so as to avoid mud from being tracked on thc public street. Additional similar material must be added as required. The owner and builder are responsible for promptly cleaning up any mud, soil or other material thal is tracked onto the public road form their lot. Permanent driveways shall be concrete or asphalt and shall be adequate for the parking of a minimum of tulo (2) cars in order to provide off strcet parking.

4. Fences slrall not be permitted to extend nearer to any street than the minimum huilding code and zoning ordinance setback line for structures. In no ev'ent strall any fence or plarrting bc placcd in a manner to cause sight obstruction for traffic at any interseclion or strccl corner. Provided, developer may, at his sole discretion, allow a plat entrance sign, illunrinated if appropriate, mail boxes, parking sign and/or fence and is not restricted by this provision. 5.

No signs of any kind shall be displayed within lhe plal except for one (l) sign :,ulvcrtising the property for sale or rent, which sign shall not exceed six (6) square feet. The original developer and/or builder may erect and maintain necessary signage to advertisc and market the property during the construclion and sales period.

6. No noxious or offensive activity shall be carried on upon any lot nor shall anything be done thereon which may be or may become an annoyance or nuisance to the neighborhood. No illegal activity may be caried on upon any lot or wirhin any dwelling thcreon and all residents shall comply at all times with applicable byJaws, rules and ordinances of Whatcom County and other authorities having jwisdiction over the property 7.

No livestock, poultry or animals strall be permitted on said property other than songbirds, and not morc than two (2) dogs and trro (2) cats per household as household pets. No animals shall be permifted for commercial purposes. AII household pets must be kept on the owners property and may not be allowed to be a nuisance. Dog runs must be kept from public view and screened from view from other lots within the plat.

Trash, garbage, or other waste shall not be kepl except in saniury containers. containcrs must be screened so as not to be visible from lhe strcet or adjoining lots. Trosh and gmbage must be disposed of in a regular and timely manner. No lot shall be used for tlrc disposal or storage of rubbish, including yard trimmings! grass clippings, construction tlchris. or any othcr discardcd items.
