Fleet Manifesto can guide government The BVRLA has wasted no time in contacting policymakers following the recent general election and the appointment of Prime Minister Theresa May’s new team of Cabinet ministers. Key appointments of interest are Chris Grayling, who has been reappointed Transport Secretary, and Michael Gove, who rejoins the Cabinet as Environment Secretary. “We look forward to working with ministers on the specific issues facing our industry and the need for a smooth and successful Brexit,” said BVRLA Chief Executive Gerry Keaney. “We will continue to make our voice heard in Whitehall to achieve a positive legislative and regulatory environment that supports commercial growth across our industry.”
The BVRLA set out its key priorities in its recent Fleet and Mobility Services Manifesto, which covered emissions, air quality, road safety, Brexit, red tape and connected vehicles. Keaney said: “It is essential that the new government understands the vital role our members play in delivering safer, sustainable and more cost-efficient road transport. Policymakers face a real challenge, not just in terms of Brexit, but also in how the UK embraces the move towards data-driven mobility services. Brexit: it really isn’t the only game in town With the Brexit countdown clock ticking ominously and a fragile minority government to manage, it is going to be difficult getting the attention of Theresa May and her colleagues in the coming months. But try we must. It is absolutely essential that the new government understands the vital role our members play in delivering safer, sustainable and more cost-efficient road transport. Beyond Brexit our country faces some massive challenges in terms of improving air quality, sustaining economic growth and ensuring that the UK embraces the move towards a digital, data-driven economy. Ministers have a lot on their plate, which is why the BVRLA will be presenting them with solutions rather than problems. Our recently published Fleet and Mobility Services Manifesto gives a good overview of the key issues at stake.
That was our agenda – now we have to implement our action plan. This will involve a carefully coordinated mixture of political and member engagement, targeted research and powerful messages. We made a start this month by responding to the government’s Air Quality Plan, launching our Fleet Air Quality Factsheet and publishing our fleet emissions videos. This is just the start. There will be much more to come in the near future. As usual, I know that we can depend on your support. Our industry now has to acknowledge yet another issue: that our vehicles can be used as a terrorist weapon. Fleet sector leads the way on air quality
Treasury and FCA lobbied on insurance
The BVRLA has outlined its strategy for tackling road transport’s impact on air quality.
The BVRLA has responded to consultations by HM Treasury and the Financial Conduct Authority (FCA) on the sale of insurance products by vehicle rental companies.

In response to the government’s recent UK Air Quality Plan, the association has urged policymakers to move from consultation to action as soon as possible. It wants a blend of incentives and restrictions that encourage more sustainable travel behaviour but don’t punish people for decisions based on previous government policy. “BVRLA members fully appreciate the urgent need to address air pollution in the UK, which requires a change in the way we travel and the vehicles we use,” said the association’s Chief Executive, Gerry Keaney. “Our sector has enormous buying power and provides advice to thousands and thousands of drivers and fleet operators. If the government can deliver the right tax regime, incentives and guidance, we can have a huge impact in improving air quality across the country. The BVRLA wants the government to: › Provide comprehensive Clean Air
Zone guidance to ensure consistency in terms of standards, enforcement, timescales, and charges.
› Work with the BVRLA in developing
an engagement campaign to promote vehicle rental, leasing, car clubs and other potential solutions for
businesses and individuals affected by the new Clean Air Zones. › Give a clear guarantee that it will not
introduce any new motoring taxes that punish businesses or individuals for vehicle purchasing decisions based on previous government policy.
› Ensure that any diesel scrappage
scheme is both flexible and targeted. This should include providing support for companies looking to replace or retrofit older, more polluting commercial vehicles. In addition, it should encourage owners of older, more polluting cars to give them up, by offering ‘mobility vouchers’ that could be used for car rental, car clubs and other shared or public transport.
› Continue to fund and support the
Plug-in Car and Plug-in Van Grants, gradually adjusting the CO2 and zero-emission range requirements to ensure that the incentive keeps pace with advances in technology
› Ensure a consistent tax policy to
support the uptake of ultra-low emission vehicles. u

Vehicle rental companies, and other businesses whose principle business is not the sale of insurance, are exempt from an EU Directive governing such sales. Now, a new Insurance Distribution Directive (IDD) threatens to remove that exemption. The BVRLA is lobbying for the exemption to remain so that members do not face increased costs. Before responding to the consultations, the association met with the Treasury and FCA and highlighted what it considers the excellent value for money its members offer their customers. It emphasised high sales of Personal Accident Insurance products, their affordability, and the fact that just 0.1% of sales lead to a customer complaint. The BVRLA believes that ending the exemption could lead to considerable costs being passed on to the customer – or the withdrawal of insurance services by members. u For further information, contact Senior Policy Advisor Patrick Cusworth. The BVRLA published a new Fleet Air Quality Factsheet to coincide with the launch of National Clean Air Day on 15 June. This provides an at-a-glance guide to the emissions credentials of BVRLA member fleets, as well as offering some guidance on current Clean Air Zone plans for the UK. The association also released two video guides to provide a fleet perspective on road transport emissions and regulations, with contributions from Nick Molden of Emissions Analytics, Dale Eynon of Defra Group Fleet Services and Karl Anders of Nissan. 4

BVRLA Code improves leasing broker pricing The BVRLA’s governance programme for leasing brokers continues to go from strength to strength. So far this year, the association and its inspection partners, CCAS, have carried out more than 50 inspections on new and existing members.
As the association approaches the stage where it has inspected all existing members, it is now considering the introduction of a ‘Deep Dive’ audit. This would involve a more in-depth inspection of brokers who received a high number of ‘advisories’.
Existing members were assessed against a 34-point checklist. The most frequently encountered faults were:
New members were assessed against the 10 key principles of the BVRLA Code of Conduct. The main concern is the ability to evidence clear pricing for products and services; the BVRLA provides support on how to do this through its Guide on Standard Quotations and Contracts. u

› Member did not have a sufficient Financial Promotions Process in place.

All of the inspected members received a report outlining any issues and how to address them. They were also supplied with a list of relevant training courses. Only one leasing broker failed inspection and this company has since stopped trading.
To offer further support for leasing brokers the BVRLA is preparing a webinar giving an introduction to financial promotions. It is also conducting a wholesale review of its Financial Conduct Authority (FCA) guidance and templates.
DVSA may cut inspections The BVRLA is working with its inspection agents, the AA and the Driver & Vehicle Standards Agency (DVSA), to evaluate how the association’s compliance programme can help members’ customers as part of the DVSA’s Earned Recognition Scheme. The scheme is designed to help commercial vehicle fleets with good compliance track records cut the number of inspections they undergo. Initially, the DVSA is running a pilot scheme to allow testing and refinement of the concept. If that’s successful, the full scheme will be rolled out to all operators who want to apply. | May/June 2017
The BVRLA believes that its compliance programme will help commercial vehicle fleets that use its members to demonstrate their own compliance with the standards in the Earned Recognition Scheme. To facilitate, the BVRLA is exploring the feasibility of the AA becoming DVSA-approved auditors for its compliance programme and has conducted a gap analysis of the DVSA audit standards against its own. u
Media puts spotlight on motor finance Media coverage of the vehicle leasing sector has spiked in recent weeks following news that both the Financial Conduct Authority (FCA) and Bank of England are looking into motor finance. The Bank of England is concerned about the sector’s growth and consequent vulnerability to financial shocks. The FCA is undertaking a review into a “potential lack of transparency, conflicts of interest and irresponsible lending”. “There has been a lot of ill-informed coverage around personal car finance in the consumer press,” said BVRLA Communications Director, Toby Poston. “We have contacted many of the journalists involved, but unfortunately they are more interested in scaremongering and speculation than hearing about the great work the sector is doing in raising standards and giving more people access to safer, cleaner and more affordable new cars.” The BVRLA’s Leasing Broker Committee has decided to take a proactive approach to both reviews, so that the sector is ready to respond in a positive way should either of them point to particular issues involving its activities. The committee has formed a task force to undertake its own assessment of the sector to identify potential ‘vulnerabilities’ that could be addressed with further member guidance or a more detailed focus within the association’s inspection regime. u

London’s Dartford Crossing: an all-too-often inconvenient issuer of penalty charge notices to BVRLA members
Progress continues on easing Dartford Crossing procedures The BVRLA’s proactive working relationship with the Highways England Dart Charge team – the body that oversees the Dartford Crossing of the River Thames – is delivering real benefits for members. Two significant changes are due shortly. From the end of July, the customers of vehicle rental companies will be able to
pay for a specific day’s crossing rather than have their payment allocated to a previous crossing (as can happen at present). In addition, the Dart Charge team has agreed to review its procedure for sending warning letters for unpaid crossings, which has led to confusion for some BVRLA members’ customers. From September, these letters will no
longer be sent, and BVRLA members will be able to set payments against particular crossing times so that Dart Charge doesn’t allocate them to earlier outstanding fees incurred by previous users of the same rental car. u Further information on the Dart Charge is available on the BVRLA website: www.bvrla.co.uk
Coming soon: online training to aid brokers’ FCA compliance The BVRLA is collaborating with the leading vehicle funders to launch a new e-learning platform for brokers later this Summer. The platform will initially host 10 ‘Core Competence’ e-learning modules that will help staff fulfil their compliance obligations to both the Financial Conduct Authority (FCA) regulations and the BVRLA’s Code of Conduct. They include: › Complaints handing › Treating customers fairly

› Data protection › Safeguarding the vulnerable › Consumer credit standards › Money laundering › Personal conflicts of interest › Fraud prevention › Whistleblowing
Access to the platform costs £49.95 a year for each member of staff, the equivalent of just under £5 per module. One of the key advantages of the platform is that it will provide a single source of
compliance training, avoiding duplication of courses with a number of different funders. GDPR pushes data up the agenda BVRLA members should be working now to ensure that their business complies with the new General Data Protection Regulation (GDPR) coming into effect on 25 May 2018. Compliance requires a detailed assessment of what data is held, why it is held and what is done with it. This was one of the key messages given to more than 70 members who attended the association’s recent seminar on the GDPR, which will usher in a much tighter regime for data protection across the EU. The BVRLA assembled a panel of experts to outline the implications for the vehicle rental and leasing sector. Delegates heard from Kirsten Whitfield of Field Fisher, Kevin Parle from the Data Protection Forum, Jan Hagen from Regulatory
Finance Solutions and Kate Hutt from Arval. Some of the key points included: › Potential fines will be far higher
and further reaching within a firm’s supply chain.
› Individual accountability for controlling
and processing data within a supply chain needs to be defined in contracts.
› It is vital for members to be clear
about the data controls of their partners in a supply chain and whether these expose them to risk.
› Members need to consider how to
address a data subject’s right to be forgotten or to obtain and reuse any data held about them.
› Members should use the Information
Commissioner’s Office (ICO) GDPRreadiness assessment tool as a starting point.

Synergy sets Code of Conduct quiz The buzz was palpable as Synergy Automotive’s team battled it out to be crowned the BVRLA Leasing Broker Code of Conduct Pub Quiz Champion! Synergy Automotive, a fast-growing business that has seen its staff swell by 40% in the past year, decided to hold the quiz to raise awareness of the BVRLA Leasing Broker Code of Conduct. The compliance-based competition was incorporated into their daily team meeting. The answers were discussed as a group and the team also looked at how they could integrate what they’d learned in the day-to-day running of the business. Fleet Technology Congress 2017 will focus on connected vehicles The BVRLA will use this year’s Fleet Technology Congress on 5 July to publish the results of a groundbreaking survey of fleet views on connected vehicles and data. The association is currently canvassing drivers, fleet managers and BVRLA members on their attitudes towards the collection, storage and use of data from connected vehicles. “Data is becoming a new currency and is already driving lots of new business models in our sector,” said the BVRLA’s Director of Communications & External Relations, Toby Poston. “As we prepare for this new, data-driven economy, it is more important than ever to get the views of members, customers and other industry stakeholders.” More than 150 members are expected to attend this year’s event to see a hand-picked panel of experts share their insights on new technology and how it can enable vehicle rental and leasing companies to offer smarter, safer and more efficient road transport. Quarterly Leasing Survey shows growth in cleaner vehicles The BVRLA’s leasing survey results for the first quarter of 2017 (‘Q1’) show that the total business leasing market for cars and vans has grown to 1.345 million, representing annual growth of 6.5%. Breaking this figure down, we find that the car fleet grew 3.6% to 987,000, while the light commercial vehicle fleet grew 15.3% to 358,000 LCVs. Total car leasing (all leasing types) grew by 11% year on year with personal contract hire (PCH) contributing over half of the growth (55%). Business fleet leasing contributed just under a quarter of the growth (24%).
The BVRLA lease car fleet continues to lead the way on average emissions, which fell by 4.6g/km CO2 year-on-year to 113.1g/km. The average emissions for new BVRLA member registrations was 110.8g/km CO2 compared with the national new registrations average of 120.5g/km.
In Q1 the BVRLA conducted some additional CO2 emissions analysis of cars on contract hire and those on personal contract hire. The average personal contract car on the BVRLA member fleet had emissions of 118g/km CO2, compared to the 112g/km of those on a business contract.
The average emissions for both BVRLA and national new registrations stopped falling in 2016, suggesting that government tax policy is not providing adequate support or incentive for the ultra-low emission vehicle market.
The proportion of diesel cars on fleet continues to decline. Less than threequarters of the BVRLA total fleet is now diesel (74.9%) and just over two-thirds of new registrations (67%). The substitution appears to be from diesel to petrol rather than electric vehicles. u

In perspective: van market growth New analysis from the BVRLA puts the growth in its members’ total light commercial vehicle (LCV) fleet over the last ten years in a wider perspective by comparing it to overall growth in the van market. The BVRLA LCV fleet has more than doubled over the past ten years, although most of this growth took place between 2010 and 2015. Growth in the total UK van market has also been significant, at around 20% over ten years, with the rate of increase accelerating from 2013 onwards. | May/June 2017
This analysis of the BVRLA LCV fleet includes all members operating vans, regardless of their membership category. Ooh la la! Take care if driving in France Drivers on French roads will be under extra scrutiny this holiday season after traffic police demonstrated a new 36-megapixel speed camera that can survey eight lanes of traffic at a time. The camera aims to identify drivers who are speeding, tailgating, jumping red lights, using a phone or not wearing a seat belt. The French authorities have also announced that they have outsourced an additional 450 mobile speed traps. It is estimated that up to 500,000 British motorists get caught on French speed cameras every year, so it is important for drivers to have all relevant documentation, such as a Vehicle on Hire Certificate (VE103), in case they are questioned by the police.
Drivers travelling to Paris, Lyons or Grenoble will also need a Crit’Air sticker on their windscreen to display the vehicle’s emission rating. The fine for not having one is between £59 and £117. Some BVRLA members are actively contacting lease customers whom they know usually drive to France in the summer, and others are applying for stickers for their entire fleet to ensure that all their vehicles are ‘ready for European travel’. The stickers don’t expire so can remain in vehicles throughout their fleet life. u BVRLA members can buy a Crit’Air sticker online for £4 (3.70 euros) plus postage, at www.certificat-air.gouv.fr Please note that delivery can take up to 30 days.

The event is a wonderful opportunity for networking, with corporate hospitality and friendly rivalry. This year we have introduced a new Golf Academy for novice golfers and improvers who may not feel ready to face the challenges of a full 18 holes. After the main competition has started, 10
the Oxfordshire’s club professional will oversee group and individual tuition covering all elements of the game: driving, pitching and putting. Golf clubs provided or bring your own. The cost is £150 + VAT per person.
