The Development of the Rule of Law in the Multilateral Trading System
Edited by Uri Dadush, Carnegie Endowment for International Peace, Washington DC
Edited by Gabrielle Marceau, World Trade Organization
and Chiedu Osakwe, World Trade Organization
How did a treaty that emerged in the aftermath of the Second World War, and barely survived its early years, evolve into one of the most influential organisations in international law?
What have WTO accessions contributed to the rules-based multilateral trading system? What demands have been made by original WTO members on acceding governments? How have the acceding governments fared? This volume of essays offers critical readings on how WTO accession negotiations have expanded the reach of the multilateral trading system not only geographically but also conceptually, clarifying disciplines and pointing the way to their further strengthening in future negotiations. Members who have acceded since the WTO was established now account for twenty per cent of total WTO membership. In the age of globalization there is an increased need for a universal system of trade rules. Accession negotiations have been used by governments as an instrument for domestic reforms, and one lesson from the accession process is that there are contexts which lead multilateral trade negotiations to successful outcomes even in the complex and multi-polar twentyfirst century economic environment.
This unique book brings together original contributions from an unprecedented number of eminent current and former GATT and WTO staff members, including many current and former Appellate Body members, to trace the history of law and lawyers in the GATT/WTO and explore how the nature of legal work has evolved over the institution’s sixty-year history. In doing so, it paints a fascinating portrait of the development of the rule of law in the multilateral trading system, and allows some of the most important personalities in GATT and WTO history to share their stories and reflect on the WTO’s remarkable journey from a ‘provisionally applied treaty’ to an international organisation defined by its commitment to the rule of law. 2015, 228 x 152 mm, 632pp, 31 colour illus. 3 tables 978-1-107-08523-7, CHF 130.00 Hardback

WORLD TRADE REVIEW journals.cambridge.org/wtr
The World Trade Review was established at the initiative of the Secretariat of the World Trade Organization (WTO) in close cooperation with Cambridge University Press. It is an independent journal – the Editor and all but one member of the Editorial Board are drawn from university faculties – that includes articles written from economic, legal, political and inter-disciplinary perspectives on issues of relevance to the multilateral trading system. Priority is given to papers that, along with being academically rigorous, are also accessible to government policy officials and the wider public. The journal also includes shorter articles seeking to rebut or challenge published papers.
