In a private treaty campaign, your property is advertised as “For Sale” with either a price or a price range. This gives buyers a clear indication of your price expectations. If nominating a price range, the range legally must not exceed 10%, for example $1,500,000 - $1,650,000. Buyers then make their purchase through the agent by forwarding an “offer” indicating their price and the terms of the offer. For example, an offer may be made subject to finance, with a long settlement or subject to a satisfactory building inspection. Once the offer and the terms are acceptable to the vendor, a contract will be completed and signed by all parties. Following the issue of a Form 1 document (Vendor Disclosure statement) a cooling off period of two working days ensues. The property will then be placed “under contract”, however, it is not considered “sold” until all terms of the contract are met.
