By CONNOR ASHLOCK Jersey County Journal Last week, the Dow Southern Baptist Congregation suffered a devastating fire that destroyed much of the edifice of their beloved church. Even still, the church banded together and powerfully demonstrated that indeed, the church is the people, not the bricks under the steeple. This past Sunday, the congregation was able to gather for Sabbath morning worship on the lawn and parking lot of the church grounds.

“It was sad. There were some sad memories, yet there was also looking forward to the future. People see that this isn’t the end, but a new chapter.” Submitted Photo

“About 120 members of the congregation were in attendance,” Reverend David Brown said. “We read Scripture, we sang and shared memories and testimonies about what God has done through the building we lost.” Although the church is remaining strong, there is certainly no masking of the truth of what they’re feeling amid their positive perspective. “It was sad. There were some sad memories, yet there was also looking forward to the future. People see that this isn’t the end, but a new chapter,” Brown shared. “One person commented that 50 years ago, we were doing the same thing: Looking at an empty base dreaming about what God will do next. This is the 50th anniversary of the church. It began in the

middle of May 1971, and so COVID-19 made it so we couldn’t have that 50 year celebration.” Through this experience, the church has been able to witness the outpouring of love and support from businesses and other congregations in the area in a time when the game plan is still expected to evolve. “So many churches and local businesses have offered a place for us to worship. We have a couple meetings this week where we’ll make those decisions to either go online or to go to a facility,” Brown explained. The rest of their plan is a matter of learning what all it will take to clean the building and get it usable again, as not all of the structure was lost in the fire.

“Our insurance company is just doing what they normally do. They are working through the process and have been very expeditious,” Brown said. “They’re working with a restoration crew now.” The Dow Southern Baptist Church has a long way to go, but they’ve gotten off on the right foot and plan to see themselves through this trying time. Though this wasn’t how they hoped to celebrate their 50th anniversary, it will certainly be a year worth remembering for how the congregation demonstrated such resilience amid this season of trial. In light of the response from fellow Christians and community members in the area, Brown added, “I just can’t say thank you enough. Everyone has been wonderful.”

‘Well, we made it’ JCHS graduates get their ceremony By JARAD JARMON Jersey County Journal Students, parents and staff alike were unsure if they would get to walk across the stage, officially closing out this chapter of their life. But, the clouds parted Saturday evening, and Jersey Community High School graduates got their graduation ceremony. Spread out across the high school football field, these graduates, adorned with masks as well as gowns, got to take part in the final hallmark in their high school careers. For months and even days leading up to the ceremony, it was unclear if these graduates were going to get the more traditional graduation they and their parents hoped for. Earlier this year, the high school created a virtual graduation for the graduates, but the goal was always to eventual host an official ceremony. However, COVID-19 and subsequent guidelines related to the virus prevented the school from organizing the event as they normally would inside. So, just as many are getting ready to jump off into college, technical school or a career, school leaders decided to host a ceremony outside on the football field. Even then though, it was touch and go whether that would be possible. Last week, Jerseyville and the rest of the surrounding area was getting frequent rainfall, and it appeared the same was set to happen Saturday. Much to everyone’s relief, the clouds parted and Saturday’s ceremony was given a pic-

turesque scene and cool temperatures. JCHS Principal Cory Breden may have best encapsulated the feeling of relief among those in attendance at the beginning of the ceremony. “Well — we made it,” he said. “A lot of emotions are going through right now. I guess the first one I feel is blessed to be able to share this moment that they earned — that they deserved.” Breden said later. “…My favorite thing in a year’s time that I get to do is to share graduation with our seniors.” Breden kicked off the ceremony with a tradition of his own. Former floral shop demolished By JARAD JARMON Jersey County Journal The former bright blue floral shop, Lammer’s Floral, located prominently on Jerseyville’s main drag, has been demolished. Lammer’s Floral was once housed in the Jerseyville structure between Paul Hardin Financial LLC and Wells Norris Tire and Auto, but several years ago the tire and auto facility purchased the property. Pat Norris, Wells Norris Tire and Auto owner, said the space will be used for more parking for Wells Norris. Although it was purchased years ago, snags including clearing out asbestos slowed the project. “It took a little longer than anticipated,” Norris said. But, progress on the project was finally made this week. The newly cleared out space will offer 8-10 more spaces of

parking for the tire and auto business. Norris noted that, especially when Wells Norris is busy, there is no parking to come by. Their location at 300 S State St.

was boxed in on the corner. “We needed some place to go,” she said. Norris is hopeful this space will mitigate those issues.

Jersey District’s reopening plan sets stage for year By MEAGAN MCGLASSON Jersey County Journal On Wednesday, July 29, Jersey Community Unit School District 100 made their reopening plan for the 2020-2021 school year available to the public. The plan, which in total spans 73 pages of general guidelines, explanations, school-specific information and considerations for various scenarios, is a comprehensive packet of information that goes well beyond the anticipated details of how social distancing and hygiene will be incorporated in the district so long as we are in Phase 4 of the Restore Illinois Plan. Should the area or the state revert to Phase 3, all students will return to remote learning, according to the district’s reopening plan, which can be viewed in its entirety at https://5il. co/isgk. Parents’ choice The choice of whether to go remote or in-person is one being left up to individual families at this time, and that decision needs to be communicated to the district via Skyward Family Access by Aug. 7. In-person learners will be attending physical classes four days a week with Friday being remote for all learners. Remote learners will have remote lessons all five days of the week, with Friday and time before and after in-person classes to contact their teachers with questions or for clarification. At the school board meeting, several members of the board and district officials warned that

remote learning this fall would look very different from what it did last spring. With time and money invested in training teachers to make the most of their remote platforms, grading will be more rigorous, expectations will be higher, and more effort will need to go into completing classwork. Unlike last year, new information will be taught and figured into students’ GPAs. At the end of each quarter, parents will be able to reassess their decision, choosing to either make the transition to remote or in-person learning if they feel it may better serve their family. In the event of symptomatic individuals in a building Any in-person learner or staff member in the district who comes down with symptoms will be sent to a quarantine area where a school nurse will assess them. Should the symptoms present in a similar way to COVID19 symptoms, the school will contact the health department immediately, and they will take over the response including quarantining, sanitization recommendations and other health and safety measures. Potential responses to such cases include partial or total building dismissal, meaning the classroom, grade or entire building will be let out from the area while it is cleaned and health department officials to get a better understanding of the situation. During this time, all affected students will be moved to entirely remote learning. (See, REOPENING, A3)

This is not something I am willing to miss so if you bear with me for just a second,â€? Breden said. Despite the beautiful day, it was more different kind of scene than the many other graduations that came before. During the ceremony, each student was seated separately from one another, and during the ceremony they and their families wore masks. Breden said. “It has been a long time coming. They, both earned it, and they deserve it.â€? Robert ‘Bob’ Schell

Robert “Bob Schell, 67, was called into Heaven by our Lord and Savior, Jesus Christ, on Good Friday, April 10, 2020, following a long period of declining health. Bob was born in Carrollton, Ill. on Oct. 31, 1952 to Robert and Mary (Gaddy) Schell. It was fitting that Bob was born on Oct. 31 as anyone who knew him can attest, he loved to pull ‘tricks’ on people and he loved his sweet treats! Bob attended St. Francis grade school and Jersey Community High School. During his senior year in high school he enlisted with the United States Army where he completed his basic training at Ft. Leonard Wood. He served as a paratrooper and was stationed in Germany in 1970 during the Vietnam conflict. Bob loved motorcycles and enjoyed the time he was able to ride his Harley Davidson with his many friends. Bob also loved to travel the country with his dear companion, Peggy (Critchfield) Brown, who preceded him in death. He was also a proud member of the American Legion. Bob loved spending time with family and friends; he simply didn’t miss family gatherings for any reason. In addition to spending time with family and friends, Bob greatly enjoyed his beloved dog of 13 years, Sadie. Bob’s wish after three long months in the hospital and the rehab facility was to be home with his family and with Sadie. Bob’s wish was granted and he passed away peacefully at home with his family and his Sadie girl at his side.

Bob was a very giving man who will be missed by many. He was preceded in death by his mother and father, Bob and Mary Schell; two sisters, Roberta Edwards and Mary Ann Snider and his long time companion, Peggy (Hildred) Crisswell Brown. He is survived by a brother and sister in-law, Ken and Mary Schell of Jerseyville and a brother in-law, Dale Edwards of Carrollton; as well as many nieces, nephews and cousins. Bob will also be missed by many dear friends, who he considered family. A Memorial Mass was celebrated at 10 a.m. Tuesday, Aug. 11, 2020 at the St. Francis Xavier Catholic Church in Jerseyville. Father Martin Smith officiated. Inurnment was in the St. Francis Xavier Catholic Cemetery in Jerseyville, with the Jerseyville American Legion Post 492 conducting military graveside rites. In lieu of flowers or plants, memorials may be given to St. Francis/Holy Ghost Catholic Schools in Jerseyville, in care of Crawford Funeral Home, 1308 State Highway 109, Jerseyville, IL 62052, who is assisting the family with arrangements.

Reopening (Continued from A1) All buildings All district buildings will be subject to more stringent sanitization and social distancing practices than ever before. In addition to water fountains being off-limits (students are instead encouraged to bring clear water bottles) and not offering shared items such as library books or technology, the district is requiring daily health screenings that will ask parents and staff to verify that they or their child is not running a fever or presenting other COVID-19 symptoms. Perfect attendance will no longer be awarded at any of the buildings, and absences will not be penalized in order to discourage ill students and staff from coming to school. All individuals in all buildings must wear masks, unless they have a doctor’s note certifying that they are unable to wear one because of a medical condition. Students who are medically verified as unable to wear a mask are asked to wear a face shield, if possible. At all buildings which serve meals, areas will be assigned and supervised to ensure social distancing is maintained. The same is true for students waiting for classes to begin before school or to be picked up after school. Jersey Community High School (JCHS) In-person learning will resume for JCHS students Thursday, Aug. 20. Unlike the lower grades’ buildings, students at the high school will be dismissed every day at 12:30 p.m. but will have remote learning obligations later in the afternoon to comply with the five-clock hours of learning mandated by the state. Letting the high schoolers out early helps facilitate the Herculean task of finding places to put the roughly 1,000 JCHS students as they eat lunch. With rooms limited to 50 occupants and six feet of social distancing needing to be maintained, the space and time required to facilitate meals would be massive. Students who remain until 2 p.m. for tutoring, extracurricular activities, etc. will be assigned areas to eat lunch. Under this system, students will be able to go home or to local businesses to grab lunch before completing their school day. They will also be able to pick up breakfast for the next morning at the same time. While the JCHS lobby will open to students at 7:45

Jersey Community Middle School (JCMS) JCMS students will return to classes on Thursday, Aug. 20. Unlike the high school, in-person learners at the middle schools will be attending class from 8:30 a.m. to 2 p.m. Monday through Thursday. Friday will be a remote learning day. While students will be able to arrive as early as 7:45 a.m., parents and students are asked to try and time arrival as close to 8:30 a.m. as possible in order to minimize students gathering before classes start. Parents picking up students via carline are asked to display students’ last name on the window to expedite pickup. Elementary schools (East, West and Grafton) For the district’s younger students, classes will not

begin until Monday, Aug. 24 because the Thursday and Friday (Aug. 20 and 21) will be used for individual meeting with parents, students and teachers. All elementary bus riders must have a parent present at both pick up and drop off. For car riders, parents are asked to display students’ names (first and last) in their windows to help the individual schools expedite the pick up process. Like the middle school, elementary in-person learners will have class from 8:30 a.m. to 2 p.m. Monday through Thursday with Friday being entirely remote. Pre-K/Early Childhood Pre-K/Early childhood learners will begin classes Aug. 25 and attend either morning sessions, 8:15 to 10:45 a.m. or afternoon sessions 11:30 a.m. to 2 p.m. The program will serve snacks, not meals, to both sessions. In-person learners will attend Monday through

Thursday. There is a remote option for these students, which will be communicated by the teachers. Like the elementary students, a parent or guardian must be present at bus pick up or drop off for these students, and car pick up parents are asked to display students’ names in their windows to facilitate pick up.

ccording to the old saying, necessity is the mother of invention. Benjamin Franklin developed the lightning rod after accidentally shocking himself and bifocals when he tired of switching between two pairs of glasses. Necessity – and a healthy dose of curiosity and creativity – have led several Jersey County residents to create a number of interesting inventions. Napoleon Bonaparte Lucas was one such man. N.B., as he was known, settled in Jersey County in 1833. He and his wife, Lydia, lived between Otterville and McClusky. N.B., who farmed for a living, found threshing machines seriously lacking. He envisioned a machine that could thresh and clean the grain and took that plan from concept to working model. He received a patent for his invention in June 1853. Unfortunately, the machine never gained popularity, most likely because similar machines existed. N.B. is also credited with inventing a very effective rat trap. When the rodents reached for bait, they fell through a false bottom into a container from which they could not escape. One man claimed he had once seen half a dozen rats caught in one of N.B.’s traps. According to a local newspaper, N.B. was offered $10,000 for the rights to sell the trap. He refused for reasons unknown and never made a cent from the invention. Apparently, the only thing N.B. ever received for his efforts was a rat bite, which laid him up for several weeks. Another pair of Jersey County inventors were brothers Robert and William McNair of Elsah. Throughout their lives, the brothers held a variety of jobs, including carpentry, millwright work and operating grist and saw mills. Their skill set and their fondness of “tinkering led to a number of inventions. In 1879, the duo invented an attachment for a corn planter designed to improve a farmer’s knowledge of where he had already planted. The tool would enable farmers to

should schools have Q: What done for fall season?

Let everyone have access to your business! plant corn more evenly and, thus, save money. Although newspaper articles claimed the brothers had been offered $50,000 for the rights to manufacture the attachment, the apparatus didn’t easily attach to current machinery. The McNairs continued to improve the apparatus into the early 1900s but never secured a deal for the manufacture of the check rower. Another idea hatched by the brothers was much loftier than N.B.’s. In 1892, the men began developing a flying machine. They eventually attempted to fly the contraption from the roof of their house with mixed success. The machine didn’t fly, but neither of the brothers were seriously injured while trying to do so. The following year, the McNairs built “an adding and subtracting machine that works to perfection in every respect. The machine included 81 keys (nine sets of the numbers one through nine) and a hand crank, which operated the machine. A printed tape showed tabulations. The patent description included nearly 20 pages of text and 12 pages of drawings. The McNair’s most successful invention was a folding market basket, patent 671,270, filed in February 1897. The brothers had several offers to manufacture the basket but decided to make them themselves. It appears they never got around to doing so in great numbers. By the time Robert passed away in 1914, the brothers had patented at least seven inventions and had envisioned many more. Jersey County’s most

successful inventor was Frederick S. Davenport, who at age 20 began serving as a machinist and draftsman for a successful English shipbuilding firm. Frederick came to America at the age of 28 and settled in Jerseyville where his brother lived. Here, Frederick found work installing engines, grinding stones and machinery in local mills. In 1864, a seemingly insignificant incident dramatically changed Frederick’s future. A farmer took a gang plow (a frame that included two plows) to Frederick for repair. Frederick soon set his sights on improving the plow, and in 1864 patented the world’s first successful riding plow. (The photo that accompanies this article shows Ed Breitweiser of Delhi on a sulky plow.) As the name implies, the farmer could ride on this plow rather than walk behind it. Other inventions followed, including a device to indicate low water in steam boilers, a diamond mill-stone dresser and a conduit system for electric railways. In all, Frederick patented 13 items, many aimed at improving plows, like the one that that allowed a plow to be raised and lowered. The most profitable of his inventions was the F. S. Davenport new model plow, which he sold to Newton Agricultural Works in Jerseyville for $8,000. ––––––––––––––––––––– Q Beth McGlasson is a history buff and vice president of the Jersey County Historical Society. Ever since I can remember deer hunting, I have dreaded July and August — not because deer season is not here yet but because it will soon be. And, if I am going to be ready for the cooler mornings of September and the colder days of October and November, I have to force myself into the heat of summer in order to shoot my bow, put out my cameras and hang tree stands. For the past several weeks the temperatures around here have been scorching with humidity hovering around insanity. I mow my grass 30 minutes before dark and weed eat the next morning at daylight. Every other hour is sweltering. If I do have to work outside during the day, I usually do so in short increments in order to keep from dying of heat stroke! Have I made my point? Yet, I know if I am going to be able to make an accurate shot, I need to be shooting my

bow every day no matter what weather I’m faced with. I’ll do it, but I don’t have to like it. It really is amazing to me that just about everything in life points to one unchangeable principle – you hardly every reap in the same season as you sow. In fact, the term itself has been hijacked from the farmer. He knows, like none other, that truth. I imagine it has given him not only wisdom in other areas but patience in them as well. It also has given him a deep awareness of the uncontrollable period between those two seasons where he neither reaps nor sows, but simply trusts. This is the longest season. It is the one that seems to have the most inactivity. It is definitely the one that moves the work of reaping from the hand to the heart, and from an aching back to a bended knee. The lesson to be learned in the principle of reaping and sowing is

not only that we need to be careful as to what we sow, but it is to remember that none of our work or our harvest, or our successes, can come without a season where God waters the seeds we have planted. It is and always has been His way of saying that our life’s work is a partnership with Him and that sometimes our job is to put our hand on the plow of trust and let God do the work only He can do. ––––––––––––––––––– Q Gary has three books that are compilations of the articles he has written for nearly 15 years. AWARDEES NAMED

More than 5,300 Baylor University students have been named to the Dean’s Academic Honor List for the spring 2020 semester, and on that list is a Jerseyville local. Faith N. Franke in the Hankamer School of Business was named to the Dean’s List. Students honored on the

Dean’s List are Baylor undergraduates with a minimum semester grade-point average of 3.7 with no grade lower than a “C” while enrolled in a minimum of 12 graded semester hours. Baylor University is a private Christian university and a nationally ranked research institution in Waco, Texas.

Several Jersey County seniors have been awarded the Jimmy Fosha Scholarship. Each year, a golf tournament, the proceeds of which go to these scholarships, is held in Jimmy’s name, who died in 1999. This year’s tournament, which took place July 22, marks the 22nd year for the tournament that benefits JCHS seniors to help further their education. From left to right, the scholarship winners are Katie Wittman, Tyler Cox, Zach Schaefer, Collin Fraley and Hailey Tonsor.

Sheriff recognizes Grafton officer’s life-saving actions By JARAD JARMON Jersey County Journal A Grafton officer was recognized for his life-saving actions at a scene involving a suicidal subject in June. The Jersey County Sheriff Mike Ringhausen presented a letter of recognition to Patrolman Jim Scroggins for his efforts in averting a potentially disastrous situation, where a man was professing to officers that he would blow himself up. Ringhausen set the scene of the incident before presenting the award at a Grafton City Council meeting. The man, who was not named, was someone that law enforcement deals with on a regular basis, according to Ringhausen, but on June 20, tensions were high. On this day, Jersey County Sheriff’s Office deputies were responding to a report of a suicidal subject. The subject was attempting to to commit suicide by hanging himself and filling

up his house with propane in an attempt to blow it up. “He fled to a shed behind the house, and in doing so, said he had a gas line running behind that shed and that he would blow himself up, and would have been endangering all of us law enforcement officers that were there,” Ringhausen said. The letter said the subject indicated he would set off a gas explosion if offi-

and the loss of life was prevented.” Grafton Police Chief Eric Spanton commended Scroggins on his actions that day. “He did good police work, and he did what he should’ve done,” Spanton said. “…and it turned out for the good.” Spanton said his actions also speak to the work he does every day on duty. “It speaks well of him as well the sheriff’s department and our department working together,” Spanton said.

cers approached. Scroggins responded to assist deputies at the scene. According to the letter, Scroggins had had previous encounters with the individual and had established “a rapport.” “Scroggins was able to speak with the subject, and convince him to exit the residence,” the letter reads. “Due to Patrolman Scroggins’ actions, a peaceful resolution was achieved,

Sheriff commends locals for helping capture fugitive By JARAD JARMON Jersey County Journal The actions by two citizens in helping capture an armed fugitive were recognized in Grafton. The Jersey County Sheriff Mike Ringhausen presented letters of commendation to Kyle Edwards and Gregory Boucher at a recent Grafton meeting. They were commended for their actions on May 16. On Saturday, May 16, the Grafton Police Department attempted to stop a 2008 Nissan Maxima for a speeding violation. The vehicle fled from Grafton Police Department. The vehicle was later located by Jersey County Sheriffs Office deputies on Bradfisch Drive in Grafton. Deputies located three occupants of the vehicle. A female passenger and juvenile passenger were located, but the driver, later identified as Cory Johnson, reportedly fled into the woods. Jerseyville Police Department K9 was contacted to locate Johnson. The Jersey County Sheriffs Office, Grafton Police Department, Illinois State Police and Jerseyville Police Department conducted a search of the area. Cory was later spotted in the area of W Clinton Street. Cory proceeded to and entered the Mississippi River in an attempt to flee from authorities, and this is when Edwards and Boucher came in. “The fugitive entered the Mississippi River to elude law enforcement officers,” Ringhausen read the letter aloud. “Kyle, along with Gregory Boucher, were in a boat near the location and observed the fugitive. Kyle and Gregory attempted to convince the fugitive to return to shore. The fugitive refused and offered money to them for a ride. “Kyle and Gregory refused aid to the fugitive in his escape. Instead, Kyle and Gregory took the boat and retrieved deputies from the shoreline. With the assistance of Kyle and Gregory, deputies were able to apprehend the fugitive. If not for the quick actions of Kyle and Gregory, the fugitive may have escaped, or even worse, perished in the waters of the Mississippi River. Their assistance to law enforcement and

fellow citizens of Jersey County will not soon be forgotten.” Jersey County Sheriff’s Office officials later reported the arrest of Cory Johnson, 27, of St. Louis, Mo., for aggravated fleeing and eluding, speeding 105 mph in a 55 mph zone, aggravated assault, resisting a peace officer, driving while license suspended and aggravated unlawful use of a weapon. The actions by these two men were something the law enforcement have hoped for in regard to the relation with community. “I’ve said it before that the community has to get involved with assisting law enforcement in upholding the law,” Ringhausen said. “We don’t have the manpower to get it all done, and the best way the community can help is looking out for one another and reporting to us when they observe situations that seem awry.” “When members of the community go above and beyond like these members did to bring the man to justice, they have to be commended for that. For me, it’s a way to say thank you to the community for assisting us and supporting us.”

DONATES BENCH

The Class of 1969 celebrated their 50-year reunion last June. Most classmates will celebrate their 69th birthday during 2020. The class opted to give back to the community rather than the planned “69 Candles birthday party. A bench was donated to the playground at city park honoring the class. This JCHS class has, as of this date, 69 deceased classmates. Attending the dedication were the following classmates: front row, left to right, Kathy Daniels Wock, Linda Robeen Freer, Carol Willis Woelfel and Janice Peuterbaugh Kadell. Second row, left to right: Connie Whitlock Lewis, Dennise Chaplin Crotchett, Barbara Crotchett Ketchum, Marcia Schmieder Roentz, Kathy Madson Malloy, Anita Hagen Kraut and Cindy Groves honoring deceased classmate, Linda Dawdy Gildersleeve. The JCHS Class of 1969 hopes their bench provides seating as future children play. Not pictured is Trish Randolph standing in for Preston Randolph.

Court deems Illinois Alluvial Water in violation of law Groups involved looking to appeal By JARAD JARMON Jersey County Journal A seventh circuit court judge has ruled against Illinois Alluvial Rural Water Company and the City of Carlinville in regard to a lawsuit a Carlinville couple made against the city. Illinois Alluvial is a private non-profit corporation, that was formed in association between Carlinville, the Village of Dorchester and Jersey County Rural Water Company, according to court records, in an effort to supply potable water to them and surrounding residents. Some residents in Jerseyville also hoped to see the City of Jerseyville participate in the private non-profit corporation. Jerseyville had been seeking a solution for what was becoming a big issue in the city — their water systems were in need of costly repairs. The Jerseyville City Council opted instead to sell their water systems to the Illinois American Water Company, which drew controversy among some arguing the move relinquished control from the city. It appears, though, that Illinois Alluvial may not be a viable option in the end. Judge April Troemper ruled on the private nonprofit corporation and its associated entities including Carlinville earlier this month. In her decision on the matter, Troemper wrote that Illinois Alluvial was created in violation of the law and is a “void corporation. “[The City of Carlinville] has failed to provide any constitutional or statutory authority for the actions it undertook in the formation and operation of Illinois Alluvial, Troemper wrote. The plaintiffs in this case, Camille Mayfield Cooper Brotze and Wayne Brotze, argued in their lawsuit that Carlinville’s involvement in Illinois Alluvial was unlawful. According to court records, they argued that they and other citizens have a right to expect their elect-

ed officials will not exceed or abuse their statutory and constitutional authority, that their elected officials will ensure their water is lawfully supplied to them, and had the city attempted to solve the water supply issue by creating or partnering with an public water district, water commission or municipal joint water agency, the citizens would have a right to know what decisions were being made regarding potable water, and lack of transparency would no longer be an issue. Their complaint contended this was not done, and the judge saw the city’s defense as insufficient. The defense argued the city had the right to “associateâ€? with private corporations per the Illinois Constitution, pointing to one section that states “units of local government‌ may contract or otherwise associate among themselvesâ€? and “[they] may contract and otherwise associate with individuals, associations and corporations.â€? Troemper said, however, the defense’s focus on “mayâ€? was misplaced. She saw the “orâ€? and the “andâ€? as key, when interpreting the law. “The Constitution uses the conjunction “andâ€? when describing the ability of a unit of local government to contract and associate with a private corporation, meaning that there must be both a contract and a type of association for the constitutional requirements to be fulfilled,â€? Troemper wrote. Regarding the association with Alluvial, all parties admit no written contract exists between the entities regarding the formation of the non-profit. Troemper also pushed back on the Defendant’s argument that the city’s actions were permitted because they were not specifically prohibited by law and ordinance, writing that municipalities’ powers are limited to those that are granted to them by law and the powers. “The General Assembly provided entities such as

(the City of Carlinville) with five different methods by which (the city) could enter into agreements and otherwise associate with others to solve its water problem. Creating a brand-new private entity that is not subject to transparency and public input was not one of them. Troemper went on to write that if the court adopted the Defense’s reasoning that the city could merely do what it did, “then why hasn’t any other non-homerule municipality done this in almost 50 years since the 1970 Constitutional Convention? “If it is not prohibited by any law or regulation, then why is this the first nonhome-rule municipality to

ever conduct itself in this manner, she wrote. In her decision, the judge ruled that there is no just reason for delay of either enforcement of appeal of this order. Dan O’Brien, city attorney for the City of Carlinville, expressed disappointment in the decision, and said the city plans to appeal the ruling. Since the ruling was made, Carlinville has made a motion to stay enforcement of the decision pending appeal. And, Jacob Smallhorn representing Brotze and Broze, has asked the court to deny that motion. The motion to stay pending appeal was denied.

SANDERS COVERS COST OF K9 DEPUTY

Meagan McGlasson/Jersey County Journal

From left to right: Mark Marshall, Bob Sanders, of Sanders Waste Systems, Justin Decker, Deputy Jax and Sheriff Mike Ringhausen pose for a picture following a $4,000 donation from Sanders to the sheriff’s office. The donation covers the cost of the department’s new K9 deputy, Jax. Sanders, along with Toni Brown said they routinely support area police departments. This is the third K9 deputy in the area that Sanders has funded, with the first two being Madison County deputies. “We just feel you guys don’t get enough appreciation,” Sanders said. “Hopefully this sets off a chain of donations that helps you guys out.” Brown added, “My father was a police officer. We have enormous appreciation and respect for law enforcement.”

Burglary investigated at AT&T near Dow church Local law enforcement are investigating a burglary at the AT&T building, just down the road from a fire at the Dow Southern Baptist Church, according to the Jersey County Sheriff’s Office. On Wednesday, July 29, the Jersey County Sheriff’s Office was contacted in reference to a smoke alarm, which was set off at 25218 Dow Rd, officials say. While responding to this call for service, a Jersey County deputy observed flames coming from the Dow Southern Baptist Church. QEM Fire Department was contacted, and they quickly responded to the scene. Brighton Fire Department, Jerseyville Fire Department, Fieldon Fire Department, Godfrey Fire Department and Carrollton Fire Department responded to the scene for mutual aid in fighting the fire.

During this same time, deputies also noticed the AT&T building had been burglarized. It appears the person or persons involved broke into the building and attempted to start a fire, but were unsuccessful. This possibly caused the smoke alarm to activate, according to a law enforcement report. The Jersey County Sheriff’s Office, along with the Office of the Illinois Fire Marshal and the Bureau of Alcohol, Tobacco and Firearms are investigating both the burglary and the fire incidents. Those with information about these two incidents or about the person or persons involved are asked to contact the Jersey County Sheriff’s Office (618-498-6881), or to remain anonymous, contact Two Rivers Crime Stoppers (1-800-300-2590).

August 5, 2015 Nearly 900 local residents went to Busch Stadium to show support for Jonny and Jacky Wade as the 7-year-old Jerseyville twins threw out ceremonial first pitches prior to the Cardinals game against the Colorado Rockies. Jonny and Jacky Day aimed to support the twins as Jonny battles stage IV brain cancer, and it ended as an emotional experience for the family and those in attendance. Grafton Mayor Tom Thompson has approved a business license for American Meixi Fishing Industry, Inc. The California based company will lease the facility formerly occupied by American Heartland Fish Products, LLC. AHFP vacated the facility following ordinance violations and complaints surrounding odor coming from the plant. Jersey County has a rich past full of old one-room schools, but nothing is currently compiled to preserve the history. The Jersey County Historical Society is looking to change the issue. Members of the society are asking the community for information concerning all of the old one-room schools in Jersey County. They want to put a book

together to commemorate the historic memories throughout the county.

August 4, 2010 Even though there are less than 15 days before the first day of school begins for students, the local teachers’ union and its school board both remain optimistic a new contract can be hammered out in time. The one-year contract which the Jersey County Education Association (JCEA) signed last year included a total salary freeze; it ran out June 30. After hearing a presentation on the importance of a pre-K program and the costs needed to fund it, Jersey school district board members voted to continue the program during a special meeting Monday. A former 5,400 square foot house on eight acres of land in Dow has been full of activity the past few weeks as it has been transitioning into the full-time home of the TreeHouse Wildlife Center (TWC). The not-for-profit wild-life center is currently located on the east side of Brighton in Macoupin County, but through luck, the leaders of the center were able to find the property in Jersey County that could be converted into a new site.

American Legion Post 492 celebrates 100 years The American Legion Post 492 will be hitting a century come Monday. The American Legion Worthey Post 492 was chartered by the National Commander, Illinois State Commander and State Adjutant on Aug. 10, 1920. “We are proud that Post 492 has been serving veterans throughout the years,” Legion Commander Vernon Timcke said. Post 492 was named after two cousins who served in World War I. Sergeant Fred Worthey was the first person from Jersey County to make the ultimate sacrifice in a battle on Sept. 26,1918. His cousin, Harold Worthey, was fatally wounded and died five days later. They both signed up and vowed to stay together. They did their training in Oklahoma and then were sent to France in

May 1918. They were assigned to K Co., 138th Infantry fighting on Vosges Front, and were cited for special courage and daring bravery. The Post 492 Legion setup on 50 acres of land at the corner of Highway 67 and West Fairgrounds Avenue. This land was incorporated by the American Legion Memorial Association in September 1937. Most people refer to it as the Jersey County fairgrounds, but in reality, it is the American Legion Memorial Park. Legion Commander Vernon Timcke said it is confusing to people because the big event of the fair takes place at the park. The park contains the Legion building, pavilion, house, three ball diamonds and a dirt race track. Post 492 has approximately 170 members. Their membership is aging as the years go

by, though, as well as other veterans organizations. The Post also has a Sons of American Legion and Auxiliary who do a lot of work supporting it. The Post has an Honor Guard that serves the area providing military funerals and special events throughout the year that require their services. The Post also awards scholarships to graduating students. The Post leaders were hoping to organize a 100-year anniversary community celebration, but because of the COVID-19 pandemic, they are unable to do it at this time. “On behalf of Post 492, we would like to say a big thank you to the community for all you support throughout the years,” Timcke said. “God bless America; all our troops and veterans. Y’all come out and visit us sometime.”
