Nine yrs. for deadly invasion Old rules mean they only have three years left

N

icole Amanda Birch, 27, and Robert Hugo Grattan, 25, were sentenced to nine years in jail Friday for their roles in a deadly 2007 Harrison Hot Springs home invasion. But because they will be credited for double time served under old sentencing rules, each will serve two years, nine months in jail. In November, the pair pleaded guilty to manslaughter, aggravated assault and robbery charges in the middle of their trial for first-degree murder and after it had become apparent that neither was directly involved in the shooting of Daniel Robert Lee, 34. A B.C. Supreme Court jury in New Westminster heard during the trial that Birch and a man not yet charged in the case entered a home on Echo Avenue in Harrison Hot Springs on Nov. 23, 2007. Birch carried a Taser-like device while the man wielded a sawed-off shotgun. The intruders were looking for drugs, money and Lee. During the home invasion, Birch bound the victims with packing tape, and Tasered them. The victims also had hydrogen peroxide poured on them, were hit with a gun, and robbed. When one man attempted to escape, he was shot twice but survived. Lee arrived at the house during the home invasion and was shot near the front door. He died. Crown counsel asked for a sentence of 10 to 12 years in jail, before time served was counted. See INVASION, Page 10

hen local photographer Melissa DePape tries to describe what it’s like to have a child with a disability, she relies on a story first told by Sesame Street writer Emily Perl Kingsley, whose child was also born with Down syndrome: It’s like going to Holland. Yo u’v e g o t a f a b u l o u s t r i p planned to Italy. You’ve got the guidebooks, the reservations. Maybe you’ve learned a little Italian, but when your plane lands, you find yourself in Holland. “There’s nothing wrong with Holland,” said DePape, “but you’ve planned for Italy.”

DePape hopes to change all that with The Tiny Light Foundation, an organization that offers free professional photography sessions to families with children who have had a life-altering diagnosis. A Cardiff, Alta. native who has lived in Chilliwack for 10 years, DePape first learned that her own trip into motherhood probably wasn’t going to turn out as planned when she

was 18 weeks pregnant with her first daughter, Nevaeh, and tests revealed signs Down syndrome. Amidst the emotional upheaval of the diagnosis, however, and the health complications that later threatened her new baby’s life, DePape—a self-taught photographer since high school—kept her camera snapping. Looking back, she’s glad she did even though some of the images she captured aren’t pretty, like the See TINY LIGHT, Page 6

he City of Chilliwack has received an increasing number of complaints about scavengers going through recycling bins on collection day. And while most “binning” or scavenging is done by those looking for beverage containers with deposits, the real concern is identity theft. “We have problems in all areas of the city—Promontory, Fairfield Island, Yarrow,” Mayor Sharon Gaetz told the Times. “Some have become so bold they interrupt the services of Emterra and ask them to wait. It’s becoming a bigger and bigger issue.” Last week the city ran an advertisement regarding recycling and discouraging scavengers. In it, the city says that taking containers from recycling is a bylaw offence but that binners need to be caught in the act. Recyclables placed at the curb are the homeowner’s property until picked up by the city’s contractor and the city suggests anyone who witnesses someone going through their recycling should call the RCMP’s non-emergency line. However, Cpl. Lea-Anne Dunlop suggested that while identity theft is a concern of police, binners looking for cans and bottles will not be an RCMP priority. “I would say the ID theft would be our only main concern as far as policing goes,” she told the Times. unch “gay Chilliwack” into Google, and what you get is a list of dating sites and a handful of local news stories. Back in 2000, when local farm boy Andrew Balakshin was still struggling to come to terms with his own sexual orientation, though, he didn’t find even that. “I remember doing an online search for ‘gay Chilliwack’ and finding nothing,” said the 26-year-old who grew up on a dairy farm on Fairfield Island. “For a closeted farm kid, it’s kind of a chilling experience to think that you’re completely alone like that.” It’s not an experience Balakshin thinks other local gay, lesbian, bisexual and transgender (LGBTQ) kids should have to live with, so he recently spent about 100 hours building chilliwackpride.com, a website designed to let them know they’re not alone: “I’m not limiting it to gay youth,” he said, “but I think that’s the most at-risk group.” Looking back over his own experience, Balakshin, who now lives in Vancouver for most of the year, said a lack of local resources made it hard for him to accept he was gay even though he had been attracted to boys instead of girls right from his elementary school days at Strathcona elementary. As a regular kid who played hockey and worked on his parents’ farm, he was able to blend in throughout his years at Chilliwack secondary, and he doubts he would have joined the school’s Gay-Straight Alliance (GSA) if it had had one. “I might have been a little too scared

provide new website resource to,” he said. “Maybe that’s why I feel this website would have been a good thing for me because I could have gone online and found resources.” Vic Gladish, a counsellor at Sardis secondary and sponsor of the school’s GSA, said a local online resource will be a boon to kids who aren’t ready to come out openly in high school. “For a lot of high school kids who are wondering or questioning, they don’t know who they can trust to talk with about it,” he said. “Not that the Internet is completely confidential but at least they can do some reading, some research about their situation that might help them feel more comfortable in who they are.” The problem for LGBT youth looking for resources and a sense of community in Chilliwack, according to Balakshin, is that so many local gays and lesbians (like him) leave for Vancouver and other urban centres as soon as they graduate for high school. “When they leave, they take their voice with them,” he said. So at chilliwackpride.com he has gathered all the local resources he could find, including news stories from local papers, a list of local support services, a section for parents and a list of other recommended websites. Compared to a lot of other things a “gay Chilliwack” Google search will bring up, Balakshin’s site is pretty PG and notably upbeat about Chilliwack despite this bible-belt community’s less than gay-friendly reputation in Vancouver LGBT circles. He chose that approach, he said, because the point of the site is not to shock anyone or wage war but to get information to people who need it. And besides, he has deep roots in

Wet and warm weather

J

anuary so far has been wet and warm in Chilliwack with a record-breaking temperature on Sunday and already more rain than the monthly average. The mercury hit 12.8 C (9.2 C above normal) on Sunday making it the mildest Jan. 16 ever, according to Environment Canada’s volunteer weather observer Roger Pannett. The previous record for the day was 12.2 C, occurring in 1965 and 1974. January precipitation to date was 271.9 mm as of Sunday, with 65.7 mm falling over the previous 36 hours, according to Pannett.

The average precipitation total for January is 263.7 mm. The heavy rains kept City of Chiliwack public works crews busy clearing blocked culverts and monitoring the pump stations, according to director of engineering David Blain. Blain said the pumps were able to keep up with localized flooding in some areas, but that there were some reports of flooded basements around the city. The parking lots along the Rotary Trail have been closed as a precaution due to high water in the Vedder River. Blain said the river peaked Sunday night but was expected to recede over the course of this week.

hilliwack home prices increased slightly on average for 2010, but the December average price was down 14 per cent over December 2009. The average price of a Chilliwack home in 2010 rose 2.5 per cent to $304,081. But for the month of December that average price was down to $264,266, according

to the B.C. Real Estate Association. More new homes should be on the market soon in Chilliwack as 2010 housing starts were up 89 per cent over 2009, according to the Canada Mortgage and Housing Corporation. There were 350 single family homes started in 2010, up 52.8 per cent from 229 in 2009. Townhouse and apartment figures were more dramatic

as there was a 149 per cent increase, from 139 starts in 2009 to 346 last year. Total starts increased from just 368 in 2009 to 696 in 2010 in Chilliwack. Local numbers followed the regional trend as total starts were up 41 per cent in Abbotsford-Mission and 82 per cent for the Vancouver Census Metropolitan Area. The 15,217 starts in the Vancouver CMA was close to the 10-year average.

Realtors pleased with new mortgage change Down payment stays at five per cent, but length of mortgages now capped at 30 years BY PAUL J. HENDERSON phenderson@chilliwacktimes.com

T

here is relief among Chilliwack realtors that federal mor tgage r ule changes announced Monday weren’t as damaging to first-time homebuyers as feared. Finance Minister Jim Flaherty announced the government would reduce the maximum amortization period for government-backed mortgages to 30 years from 35 years. Last week, the Chilliwack and District Real Estate Board (CADREB) issued a press release expressing concern about rumoured mortgage rule changes. Of most concern was a rumour that down payment requirements would be raised from five to 10 per cent. Chilliwack-Fraser Canyon MP Chuck Strahl told the Times he wasn’t sure what the realtors were talking about, and that

while no changes were planned as far as he knew, Flaherty was always monitoring the household debt of Canadians. After the changes were announced Monday CADREB president Kyle Hislop said that in the end it was much ado about nothing. “We in real estate were most concerned about an increase in the minimum down payment structure not so much the other issues,” he said. “Since down payment stayed the same we don’t really have any concern about the three changes.” The other two changes announced were that Canadians will only be able to borrow up to 85 per cent of the value of their homes, down from 90 per cent, and the government is withdrawing backing for lines of credit secured by people’s homes. On these latter two issues, Hislop actually was supportive. “I believe the changes are healthy for real estate and should help the average consumer make better decisions when the time comes to purchase a home,” he said. The changes are also expected to disproportionately affect people who live in B.C., home to the country’s highest housing prices. The Bank of Canada recently warned that debt levels are growing faster than income, adding the risk posed by consumer indebtedness to the domestic economy would continue to escalate without a “significant change” in how consumers borrow and banks lend.

Looking for a way to help other parents who don’t have the benefit of her photography background, DePape launched The Tiny Light Foundation last month after a short stint of volunteering with a similar U.S.-based organization in the fall. “I want other families to have these moments to share,” she said. “Because no matter how big or little, how strong or weak, how sick or healthy, every moment should be remembered. She partnered with fellow photographer and highschool friend Billie Depatie—who still lives just north of Edmonton—and the two are now working to create a Canadawide network of photographers willing to donate their time to cap-

Online stories tell of what families endure ture a few timeless moments in the lives of families who often don’t have the time, money or emotional energy to do it themselves. Understandably, the foundation is pretty choosy about its photographers. It takes a special kind of person behind the lens to capture subjects with a wide range of disabilities and serious medical conditions, according to DePape. “You’re not going to go in there and get the perfect model,” she said. “Some of them won’t be able to sit up on their own. You won’t be able to maneuver them, so you’ve basically got to go in there with an open mind and take the best picture that you can of that child.” Many of the shooters who’ve come on board so far have had their own experiences with children with disabilities, and Tiny Lights hopes to keep its community close-knit even as it expands across the country.

To date the foundation has completed seven photo shoots, and the pictures along with a short story about each “Tiny Light” can be found on The Tiny Light Foundation website. That’s the way the project has evolved: individual families benefit by getting a CD of 10 to 15 fully edited, high-resolution photos free of charge, but the online stories and images also celebrate each child’s story more

publicly. “We want to tell about them,” said DePape. “We want to know what they’re good at, what their likes are, what they’ve had to endure personally.” Take local Tiny Light Kaylie; according to her mom, Chantelle Bisschop, it’s a miracle the two-year-old survived birth, let alone made it to age two. Kaylie was born without a lower pulmonary artery,

a condition that wasn’t discovered until she was eight months old, and while she is happy and active now, one year after her first open-heart surgery, there are more surgeries in her future. “Every time she goes under could be our last time with her,” said Bisschop, “but we know she has to do it to at least keep her for a little bit longer.” For Bisschop, the Tiny Light photos are a celebration of

Kaylie’s life that the family wouldn’t have been able to afford any other way. And through the Tiny Light website, her story can also encourage others, according to DePape. “I’m hoping that parents being able to tell about their child and the things that they’ve gone through will maybe help another parent that’s in the same situation.” ◗ For more information about The Tiny Light Foundation, visit www.thetinylight.com.

put in the blue box.” Dunlop said it’s important that residents never put personal information in the garbage. “ID theft is something that has never gone away,” she said. “It is always a concern so people should make sure anything put out into their recycling is properly shredded.” Dunlop added that if anyone is truly concerned about people going through their recycling, they are more than welcome to take items directly to the recycling depot.

1. Decrease your speed and leave yourself plenty of room to stop. You should allow at least three times more space than usual between you and the car in front of you. 2. Brake gently to avoid skidding. If your wheels start to lock up, ease off the brake. 3. Turn on your lights to increase your visibility to other motorists. 4. Age of wonders inspires present

I

n the past couple of weeks, all the news around here seems to have been about assassinations, politics, violent crime, more politics, and housing construction statistics. Normally I would grab one of those topics and tease out some strange thread or historical fact, then build a column around that. Right now, though, it just all seems too grim. So to heck with the news, let’s talk about dinosaurs! One of the great joys of life is reading a paleontologist’s wordportrait of life in bygone ages. The Mesozoic era, in which the dinosaurs dominated, was quite different from our own. Prairies were covered in ferns instead of grass, flowering plants only evolved towards the tail end. The continents were in different places, the seas were warmer and full of giant swimming reptiles with big gnashy teeth. Even the days were shorter. It’s true: the Earth spun faster in the past. The moon’s slow tug-of-war with our planet is gradually slowing down its rotation. Across this landscape walked, ran, and flew not just an everchanging cast of dinosaurs, but of insects and mammals, pterosaurs, crocodiles, turtles, and lizards. The miracle is that this picture of a vanished world was assembled piece by painstaking piece. Watch a movie like Jurassic Park and you get the theme-park version of

Be Our Guest paleontology: scientists casually brush a layer of sand off a perfectly articulated fossilized skeleton, complete from teeth to tailbone. In reality, fossils are often broken, almost invariably incomplete, sometimes squashed and deformed in weird ways by geological forces, and found in harsh, unforgiving terrain. It’s as if you took the ceiling of the Sistine Chapel, smashed it into fingernailsized fragments, and buried them in a garbage dump. Paleontologists painstakingly dig up piece after piece, and have managed to learn about bits of the painting —a cherub here, an arm there. But most of the marvellous masterpiece of time and evolution remains to be discovered. Just in the past year, there have been several new species named, including the distantly-related-to-Triceratops dino called Kosmoceratops, which had 10 horns sprouting from the frill around its face. It looks like a floral bouquet formed from bone and horn. Then there was Tianyulong, a plant-eating dinosaur which may have had feathers!

Well, proto-feathers. Or maybe just “integumentary structures,” i.e. bits of skin. Or possibly just plants that were fossilized next to the bones. But hey, we’ll be arguing about it for years. Oh yeah, the arguments. It’s not a matter of just digging up a bone, giving it the once-over, and deciding it’s a new species. There are all kinds of fun fights about which fossils belong to new dinos, and which ones don’t. If a million years from now, aliens dig up fossil skeletons of, say, Arnold Schwarzenegger and Wallace Shawn, will they recognize them as members of the same species? Hence papers that say there are actually a dozen different species lumped under the name Iguanodon, or that three kinds of dome-headed dinos are actually just adults, teens, and kids of the same breed. I know that very little of this matters, in the larger sense. Discovering new dinos won’t cure cancer, it won’t erase the federal deficit, and it won’t prevent another season of American Idol. But it gives me a comforting sense that our world is vast, and that it not only contains wonders, it has been making them for ages beyond our comprehension. Certainly, that’s something that news of shootings, political scandals, drugs, gangs, and poverty has yet to do. ◗ Matthew Claxton is a reporter with the Langley Advance.

ural cities like Chilliwack have long been considered tough places for gays, lesbians and others questioning their sexual identities to grow up. A conservative culture has, for a long time, driven out those who feel unwelcome in their own cities. And as Andrew Balakshin notes in today’s Times, “When they leave, they take their voice with them.” Balakshin, who is 26, has launched a new website that aims to give other LGBT youth a way to find resources that will hopefully help them feel at home here in Chilliwack. Meanwhile, Sardis secondary’s gaystraight alliance has done superb work to push the school district reluctantly into the 21st century. This is terrific for youth today, and gays tomorrow. Study after study shows that straight people who know that they know someone who is gay are much less likely to show homophobic tendencies. (We all know someone who is gay. Often, we just don’t know that we know.) That means, we need young Chilliwack gays and lesbians to live here, raise their families, get old and retire. They don’t need to be outspoken, they just need to feel comfortable enough to stay here and not hide their sexuality. The rest will come. In the 15 years since John Les launched his ridiculous crusade to keep a gay newspaper off the shelves of the Chilliwack Library attitudes have progressed considerably. But there is still work to be done and we can’t leave it all to the still tiny Chilliwack LGBT community. Straight citizens must take a stand about homophobic language and slurs. We can’t expect our gay sons and daughters to feel comfortable in our community, and in our families, until we show the nerve to defend those with different sexual orientations.

Solution to a problem begins at the source of the problem. If you cannot, or will not, tackle it at that point, then don’t even talk about it. So to agribusinessmen, developers and your ever-receptive council, I counsel a strategy of wait and see as best. You have as much to fear from the DFO as from a UFO. They would be the first to complain if we have a real disaster and would ask why isn’t the army here to help us. If I may say a bit about our armed forces at this time. Women and men of our forces are presently serving in many countries around the world with the United Nations and other world organizations, mainly as peacekeepers. Who was first to aid Haiti after the earthquake? Two Canadian navy ships, plus our Hercules aircraft delivered countless loads of relief supplies. Our troops got the airport up and running so other countries could use it. In the aid of civil powers, our armed forces are constantly being called out. The one thing Mr. Hartley can see many times right here in Chilliwack, is that when search and rescue or a downed aircraft is involved, the Chilliwack Airport becomes the search centre, with both fixed wing and helicopters working out of here. couldn’t help but think of a mosquito. “If the mosquito were endangered, perhaps we wouldn’t be too upset about it,” Huttema said. “How valuable is the sucker to the environment?” We have become inured to so much appalling ignorance bursting forth from the lips of elected officials that we pay scant heed, but this surpasses inanity. When a naturally occurring species is threatened by man-made pollution, it’s not just the species that matters here, although some compassion would not be inappropriate either. What the lowly sucker is saying through its demise is that something is terribly wrong with the way things are being done. I don’t expect an elected official to understand this, of course, but that is the way of things. And, Mr. Huttema, if the mosquito did indeed disappear, that would probably presage an even greater ecological disaster. You need to go back to grade school and take some courses on food chain cause and effect issues. Nothing too tasking mind you, nothing to give a

Editor: Re: your news article of Jan 14, “No friend to floods and fields.” I received an invitation to attend the DFO Chilliwack sucker issue meeting because I live on Berkeley Avenue in Chilliwack and my property borders on the Hope River, which is part of the limited Salish sucker habitat in question. I won’t shed tears over any impact DFO strategies to save the Salish sucker might have on agribusiness or encroaching urbanization in the valley. Both, with helpful nods from a historically friendly council, have gotten away with murder as far as the ecology of this area is concerned. Neither am I terribly hopeful that DFO or any other government agency will accomplish much, if anything, apart from headline-grabbing, confusing, and instituting programs that have no hope of being self-sustaining. I base that observation on the recent hullabaloo created locally when it was decided to create a highly visible Coho spawning area here on the Hope. That was about three to four years ago. A small area of river bed had some gravel dumped on it, and an ostentatious observation path and railing installed so people could watch the Coho spawning. What a deal! What DFO forgot is that the Hope River, at least during the 40 years I’ve canoed and kayaked it, has inexorably been turning into an open sewer. In the summer, wherever a log gets jammed blocking the scum from flowing downstream the scum and debris accu-

The defence was asking for less time, although a precise figure was not proposed. Neither Birch nor Grattan was aware of the shotgun before the home invasion began. But Justice Grist said “I found the lack of prior knowledge to be of limited mitigating effect.” He pointed to Birch and Grattan’s wearing of body armour as evidence that they knew violence was a possible outcome of the robbery. Bruins claw back for win

ith the Chilliwack Bruins’ power play fizzling, the penalty kill brought the special teams sizzle Saturday as the Bruins downed the Prince George Cougars 3-1. Ryan Howse and Roman Horak both scored on the penalty kill and Lucas Gore made 46 saves Saturday to earn the Bruins a split in back-to-back games with Prince George. Just 24 hours earlier, the Bruins were mauled 7-3 after the Cougars jumped to an early lead thanks to goals on their first two power play chances. On Saturday, Chilliwack again found themselves down a man early, but this time it worked to their advantage. Less than five minutes into the game a long Bruins clearance bounced off the boards behind Cougar netminder Ty Rimmer, over a defenceman’s stick, and right to a forechecking Howse. Finding himself alone in front of goal, Howse made no mistake, backhanding the the puck over Rimmer for his 29th goal of the year. The forecheck again paid dividends in the second as a pressing T.C. Cratsenberg caused a Prince George defender into a horrible turnover that ended up on the stick of Mike Forsyth, who didn’t stop the puck before blasting from the top of the faceoff circle past Rimmer. Down 2-0, the Cougars came out growling to start the third period and scored just 27 seconds in, when Martin Marincin snapped his own rebound past Gore. But despite surrendering 22 shots to Prince George in the final frame, the

More than $90,000 awarded by Chilliwack Foundation

T

he Chilliwack Foundation has splashed some serious cash around the community. The foundation awarded more than $90,000 to 13 local organizations, as part of a twiceyearly distribution program. The cheques were presented Jan. 10 by Foundation Vice Chair Todd Harvey in a ceremony at city council’s Jan. 10 meeting. The 13 award winners were among 34 applicant organizations

Twice-yearly donations make big difference involved in community work and service in Chilliwack. In all, $91,477.91 was awarded. One of the cheques, for $12,500, was presented as part of the Foundation’s continued commitment toward the C h i l l i w a c k G e n e ra l Ho s p i t a l expansion project. The Chilliwack Salvation Army received $12,000 for new kitchen

equipment, and the Chilliwack Academy of Music was awarded $12,250 to go toward the purchase of two pianos. The Foundation also awarded the Chilliwack Centre of Excellence a $4,000 grant for a new timing and score display board for athletic events. T h e C h i l l i w a c k Sy m p h o n y Society received $15,000 for nine portable acoustic shells to enhance

musical presentations at the new Chilliwack Arts and Cultural Centre. The Arts and Cultural Centre’s need for furnishings and equipment for its lobby, office, and backstage area, will be funded by a grant of $3,397. The community grant process takes place twice a year. T h e Fo u n d a t i o n a l s o f u n d s a scholarship program for

Chilliwack students. Money for the awards represent earnings from donations and bequests made by Chilliwack individuals a n d o rg a n i z a t i o n s s i n c e t h e Foundation started in 1985.
