never had a problem before,” Singh said. “It’s probably been done by someone who was waiting on a bus and just got bored or something. I haven’t reported it to the police.” Singh said he was going to see the advertising agency about getting the ad cleaned up this week. Cpl. Sherrdean Turley, of Richmond RCMP, said police have no record of a complaint being made, but added that it was difficult for the police to follow through, not knowing what the intentions of the offender are. “In incidents like this, it’s not known what the motive is, which makes it impossible to say whether or not it’s a concern,” Turley said in an email. “For all we know, this could simply be poor judgement on the part of whoever placed the stickers. A lot of assumptions can be made.” White Pride is a slogan indicating pride in being white. However, the slogan has been adopted over the years by neoNazi and white supremacist organizations. White Pride advocates claim that there is a cultural double standard in which only certain ethnic groups are permitted to openly express pride in their heritage, and that white pride is not inherently racist, being roughly analogous to positions such as black pride or gay pride.

Stickers plastered on bus stop benches that depict the Nazi insignia are causing concern among Richmond residents. The stickers — which carry the name ‘White Pride’ above the infamous Nazi swastika — were spotted last week by Steve Jones and his wife on bus stops on Steveston Highway. On one bus stop bench near Ironwood, the offensive item was slapped onto an advert, over the eyes of what appears to be an Indo-Canadian businessman. Jones and his wife — who is Jewish — were disgusted by the stickers and can’t believe someone in Richmond would do such a thing. “We discovered it as we walked passed (the bus stop) last week,” Jones said. “My wife is Jewish and she was quite upset by this, it’s not the kind of thing you expect to see walking around in Richmond.” The couple was so angry that they went straight to the RCMP’s Richmond detachment in the city centre to report the discovery. But they said they were told that, unless someone was spotted placing the stickers on, there wasn’t much the police could do. “We called in at the police headquarters, but they said it wasn’t really something they could look into unless we saw someone in the act,” Jones said. “I don’t think it’s acceptable to see that anywhere, especially at a bus stop. I hope something can be done about it.” Billa Singh, who owns Richmondbased King Of Lights — and whose face was on one of the adverts — became aware of the vandalism after a call from a member of the public last week. However, Singh, who has 10 similar adverts posted around the city, doesn’t believe he’s deliberately being targeted because of his cultural background. “I guess it’s not great to see, but I’ve

The City of Richmond plans to spend $50,000 on decorative public art-style benches in Terra Nova Rural Park. Six Vancouver area artists have been commissioned to come up with innovative ideas for the benches, costing $7,500 each. One, by architect Mark Ashby, will be the shape of a raft and will reflect the ebb and flow of the tides and moon cycles. Another, by the ideale Artists Team, will be an interpretation of agricultural tools, integrating art with everyday life. Coun. Harold Steves — chair of city council’s planning committee, which unanimously endorsed the bench plan this week — said he had no problems with this project, as opposed to the suggestion to spend up to $600,000 on retaining one of the controversial Biennale installations. “This one is local artists, there will be no enormous price tag and (the benches) will be fun and whimsical,” Steves said.

It is meant to reflect tree branches and provide a place for plants to grow and for birds to roost. “I think we do have a policy on spending some money on public art and we’ve been trying to get it spent locally. “It meets my requirements and I think it’s good for the community. I’m not happy about spending huge amounts of money on ‘name’ artists.” Steves added that the cost for the benches was justified in the context of them being created by local artists and that they will be useful. Should the plan be approved by

city council next month, $7,500 will be spent on each bench, with another $5,000 set aside for contingency and administration costs. The other four benches include a stone one, carved with traditional Coast Salish art by Thomas Cannell and a bench made out of old farm implements, by sculptor Norm Williams, to reflect the agricultural heritage of the area. The artists were chosen by a public art project panel out of 39 possible designs.

The city will launch it’s inaugural festival of the arts Tuesday when the Richmond Reelers Scottish and English Country Dance group opens its doors to anyone ready to kick up their heels. This is just one of the many community groups highlighted throughout the six-week festival that will feature a range of artistic expressions between Feb. 1 and March 15. Festival highlights will include Vancouver Opera at the historic Minoru Chapel, a Charles Dickens classic at the Gateway Theatre and a piano concert by Eugene Skovorodikov, in honour of the 200th anniversary of Franz Liszt’s birthday. On the visual arts front, a number of local artist will open their studios to the public. Lansdowne Centre will also feature artists who have been invited to exhibit their work in some of the empty store fronts throughout the centre. Meanwhile, city hall features the photographs of Daryl Spencer and his Great Bear Rain Forest Collection. The exhibit depicts the wonders of the Great Bear Rainforest and its many inhabitants, including grizzly bears, eagles, whales, and the rare Kermode or spirit bear. The biggest event of the festival will be the Winterfest Weekend. Taking place at the Richmond Olympic Oval on Feb. 12-13, Winterfest is a free, family weekend event showcasing activities and entertainment to celebrate the first anniversary of the 2010 Olympic Winter Games. Winter Festival of the Arts is presented with the support of the Richmond News. City switches focus to Short Ships Festival The plans for the Tall Ships Festival 2011 are still warm in its watery grave, but City of Richmond staff are already working hard on producing an offspring. While not being as grandiose as its big sister, the summer-long “Short Ships Festival,” as it’s being dubbed, will still, according to the city, boast an array of public attractions and deliver a party atmosphere throughout the season. City spokesman Ted Townsend told the News this week that some of the original sponsors — initially engaged in the failed Tall Ships Festival bid — are still interested in getting involved in the smaller event. And while Richmond struggled to attract the big 200-plus-footer sail ships, the Lady Washington and the Hawaiian Chieftain are still scheduled for a mock gun battle in the waters off Garry Point after they arrive on June 3. “We are now planning a smaller festival for a series of events throughout the summer,” said city spokesman Ted Townsend. “We will still have the gun battles and boarding when the ships arrive in June, as originally planned. “And some of our sponsors are still planning to put something on and still create a kind of festival atmosphere.”

Steveston Community Society and other local organizations have also pledged to lend their support to the event, which will kick off June 3 and is hoped to continue through to the rebirth of the Maritime Festival in August. “The hope is that not all the ships that planned to come from June 3-7 will come then. “We hope they might stagger their arrivals throughout the summer and come for a weekend,” Townsend added. “We have events such as the Salmon Festival and it would be great to have some of those ships sail into Steveston that weekend. “Staff are piecing together all the parts right now for a series of smaller events throughout the summer season.” Townsend said the city knows there are still ships coming, “it’s just a matter of when.” “Either for or five coming in June, but we’re in discussions right now to have them spread out through the summer. “The details will be finalized as soon as possible and staff will come back to council with their proposals.” City council unanimously vote Monday night to kill off the 2011 Tall Ships, with an eye on bidding to host it again in 2014, when the Tall Ships Pacific Coast Challenge comes back to the west coast

The News reported two weeks ago how, despite already being committed to spending almost $2 million on the 2011 Tall Ships, via marketing and infrastructure, city staff announced Richmond had to pull out of the event due to “matters it couldn’t control.” Only one class A tall ship had been secured for the Tall Ships Festival and that anticipated corporate sponsorship and government grants had either dried up or were unconfirmed, rendering the event at risk of flopping and incurring a huge $816,000 deficit. Contracts have already been signed and building materials ordered for the $1.6 million construction of new floats at Garry Point Park, which were intended to service the tall ships this summer. However, it was pointed out that the floats can be used for the smaller maritime festival and for harbouring larger vessels in Steveston and that the marketing tools in place can also be used for promoting this year’s maritime festival.

Richmond’s Advanced Cyclotron Systems Inc. on Alderbridge Way, was awarded $11 million for the development of technetium-99m, the most widely used isotope for medical imaging, which accounts for approximately 80 per cent of the world’s nuclear medicine diagnostic procedures. Natural Resources Canada has offered up a total of $35 million to various research teams. The objective of the federal program is to find a new way to create the isotope without using isotopes from nuclear power plants, like the Chalk River reactor in

Ontario, which has been a major source of the isotope. The only other B.C. team is led by UBC’s TRIUMF and the BC Cancer Agency received $8 million. Both teams are developing their own alternative technology using existing particle accelerators. All the teams have until March 2012 to present a commercially viable technology to create some of the most needed medical isotopes in the world. The opportunity for any of the successful teams could be in the millions.

The largest Canadian seizure of ketamine has been traced to two locations in Richmond. Five people — including three Chinese nationals — have been arrested after Canadian authorities made a record seizure of the date-rape drug, smuggled in a shipment of coffee mugs at the Port of Vancouver. In total, almost 1,004 kilograms, which makes up about one million doses, were seized, the largest seizure of the drug in Canadian history. The confiscated drugs would have translated to more than $15 million in profits for drug dealers, said officials. The illicit drugs were found aboard a container vessel from Hong Kong that arrived at the Port of Vancouver on Dec. 7. The shipment was identified as 402 cartons of coffee mugs. When border officials boarded and exam-

ined the vessel, they found 318 cartons of coffee mugs, along with 84 boxes that contained coffee mugs and vacuum-sealed bags of ketamine, known on the street as “Special K” or “K.” Veterinarians use commercial ketamine as an anesthetic, but its qualities as a tranquillizer enable it to be used as a date-rape drug. Following the seizure, the RCMP launched an investigation. Four days later, five men were arrested in Richmond. The RCMP clandestine laboratory team searched two locations in Richmond and found a pill press, binding agents, and other materials used in synthetic drug labs, said police. The three Chinese nationals face charges of importing a controlled substance and possession for the purpose of trafficking. Also arrested were Hoi Sing Lai, 54 and Hin Cheung Lau, 42, both from Vancouver. They are both charged with possession for the purpose of trafficking.

An idea is being floated in Steveston to rename a small section of a street Veterans’ Park Way. The suggestion — to change the 4000-block of Chatham Street, east of No. 1 Road — was first aired by the ANAF club a few years ago, without the plan gaining any traction with the City of Richmond. But now ANAF’s housing society, which was set up to oversee a seniors housing and new club premises project currently being constructed on Chatham Street, is holding talks with local residents to bring the street renaming idea back to life. “We’re holding an information meeting with our neighbours at Rigby Hall Manor,” said ANAF’s Ted Lorenz. “We will be asking them for their support before we go to city council

to change the 4000-block to Veterans’ Park Way. “We do understand, though, that there will be a few ramifications of that and not everyone will be in favour.” Lorenz said he was “optimistic” of garnering some support for the renaming, in honour of the country’s armed forces veterans. Alan Mearns, one of Rigby Hall’s senior citizens, doesn’t share Lorenz’s optimism. “I’m totally against it,” he said. “The people here are all seniors and we like things the way they are. Mearns added that he doesn’t feel it’s appropriate that the street should be named after veterans anyway. “I grew up in Steveston and I’m a retired commercial fisherman and (Rigby Hall) was built out of union dues,” he said. “I’d rather see them leave it alone. But if they have to change it, name it after a fisherman.”

Cinema space to turn into a food court

The cinema at Richmond Centre is expected to close some time this year, after city council this week approved a development permit. The permit — submitted by the Famous Players cinema’s landlord, Richmond Centre — requested for the mall to convert its second-floor movie theatres into a new food court. Richmond Centre then

intends to use the freed-up food court space to bring in more retail outlets. According to a Richmond Centre spokesperson, the mall is making the change because the cinema owner, Cineplex Entertainment, decided to close at the location. Cineplex told the News last week that it had no plans to close.

Hockey, night and day

In celebration of Hockey Day in Canada and in support of Canuck Place Children’s Hospice, the South Arm Community Centre’s youth group, MOSIAC, will be hosting its fourth annual 24-hour Hockey-thon. From noon on Friday, Feb. 11 until midnight, Saturday, Feb. 12, Lower Mainland residents of all ages will be participating in a

non-stop game of floor hockey in the South Arm gymnasium. Registration for the event is by donation with each participant securing pledges for their efforts in the 24-hour game. Proceeds from the pledges will be donated to Canuck Place, to assist children in recovery. Over the past three events, participants have helped raise over $7,500 and this year MOSIAC has

The Richmond Youth Dance Company will present their first public performance, First Wings, on Friday, Jan. 28 and Saturday, Jan. 29. Twenty-one young dancers, from ages nine to 17, will perform for two nights at the Richmond Cultural Centre. First Wings is the first of several opportunities for the youth in this newly formed company to display their talent and creativity. Asked why she dances, 14-year-old Lana said, “because I feel like I’m on top of the world.” First Wings presents a variety of dance styles from contemporary to ballet

school students. There are two categories, ages 13–15 and 16–18. Work will be accepted in 2 and 3D mediums and photography. Art teachers are asked to encourage their students to offer submissions, which will then be juried before being accepted. The exhibition provides the opportunity for emerging youth artists to show their work in a gallery setting and gain exposure. This event is being held in conjunction with Richmond’s Winter Festival of the arts. Stirred up about the shake You can’t blame people. After all, who really wants to think that they’ll have to deal with a cataclysmic earthquake? But pretending that the big one won’t happen in our lifetime is not a good plan. Every time there is a quake nearby, or a tremor in the area, folks are jolted into action. Flashlights, water containers, shovels, hand-crank radios — we run out and buy them, put them in a container in the garage and forget about it until the next time there is a scare. We suspect there’s a lot of old rubber bins stuffed with earthquake gear buried underneath camping gear, sports gear and the summer tires in local garages. If the big one hits, chances are the earthquake kits would be impossible to find. How many readers have a 16-inch wrench on hand to turn off the gas? Or, how many have enough bottled water for their family to survive a week without fresh water? And pet food for the critters? Not to mention cash. Is your hot water tank strapped to the wall, and is that new four-foot square mirror going to stay put when the whole house shakes? Does your family have a plan that includes where everyone should meet up if the big one hits when everyone is at school, or at work? Cellphones will probably not work as everyone is trying to call everyone else, so forget that approach. If we’ve added to your anxiety a bit, well, that’s not a bad thing. This week the province had the Great British Columbian ShakeOut, and if it includes getting shaken up figuratively to do something — better now than getting shaken up literally later and having no plan to fall back on. Hello my friend, how are you? Only the good die young, right? It certainly seemed that way on Saturday afternoon as hundreds of people filled McNair gym to celebrate the life of popular and caring Richmond vice-principal, Lorne Bodin, who died from stomach cancer earlier this month. Mr. Bodin, as he was affectionately known by students at McNair secondary, taught thousands of Richmond students at several secondary schools over the years. The 50year-old was also a longterm Richmond Girls Softball coach and a friend of mine. Speakers at the event included co-workers, students, co-coaches, friends, family members and even Rick Hansen. Over and over the same adjectives were used: sincere, compassionate, honest, inspirational, friendly. Bodin was simply a great guy and his smile and friendly ways will definitely be missed. Several people remembered his standard greeting, “Hello my friend, how are you?” after which he would focus and truly listen to whoever he happened to be talking to. Along with Bodin, the list of the number of friends I’ve lost to cancer in the last few years is nearing the double digits and growing. I’ve known far too many people lost in the primes of their lives to a devastating disease that

strikes too often. I don’t have the scientific statistics to back this up, but it appears to me that this scourge is striking my generation particularly hard, and particularly early. There is a Facebook page set up in Bodin’s honour, called Mr. Bodin, get well soon. Last spring, the page had more than 1,100 fans in the week it has been posted, and today it has nearly 2,000 fans. Heather Gray wrote earlier this year, “You are such a lovely man and such a loved man. Absorb all the love, well wishes and positive vibes and kick the C’s ass.” Kick the C’s ass. I couldn’t have said it better myself. Kick the C’s ass. We need to do whatever we can to kick the C’s ass and determine what is causing this horrible disease, how we can prevent it and how to cure it when it happens. Cancer is the leading cause of death in Canada — in 2005 (the most recent data available), 29 per cent of all deaths in this country were from cancer, according to the Canadian Cancer Society. Due to our aging and growing population, the number of deaths from

cancer will increase. Long before he was diagnosed with cancer himself, Bodin had planned to ride in the 2010 Ride to Conquer Cancer between Vancouver and Seattle, which takes place in June, but this year he wasn’t feeling well enough. In 2009, he did the ride, and said he wanted to do it again because he felt it was an opportunity to make a small contribution to cancer research. This year, Team Bodin has been formed and Lorne’s daughter Kerri is going to volunteer, along with her mother Jan. Last year the tournament was renamed in memory of Bob/dad/ grandpa ... to us, a very special legacy and one of which he would have been so very proud. Our dad would have absolutely loved the event that took place Jan. 13-15. The tournament totally exemplified our dad’s philosophy of when you do something, whatever that

may be; you need to do it well. That is exactly what a special person named Les Hamaguchi did when he put together this well organized tournament. Dad always had so much respect for Les for his hard work within the schools and the community but Les’s integrity as a person and his level of competence in all his endeavours impressed dad the most. Richmond is so fortunate to have people like Les Hamaguchi donating endless amounts of their time coaching and encouraging our kids! The tournament weekend was so well received by basketball fans and again this year, the Senior Boys’ Final was between

The Editor, Re: “Election Financing Fair As Is,” Opinion, Jan. 19. I support your editorial that financing political parties from the public purse is preferable to private funding. Parties perform an essential democratic service, but they need to be much better regulated. It is unacceptable that the premier or prime minister is chosen by party members. In addition, the nomination process prior to a general election is often a mockery. Party membership grows at nomination and leadership contests through mobilizing large, cohesive groups. Participation is not widespread but focussed on special groups. Such members are instant, and loyalty to party is shallow and short. Nomination and leadership contests

It’s a historic automotive landmark; the first mass production zero-emission car sold in North America will be ... the Nissan Leaf! Unlike a hybrid, the Leaf relies solely on its electric power source for propulsion. It can seat up to five adults and can be driven on a highway as well as in the city — just like a normal car. “Like many companies today, Nissan is seeking a more balanced relationship between people, vehicles and nature,” said Allen Childs, president of Nissan Canada. “The Nissan Leaf is a very strong step in that direction.” While Nissan sees its primary role as bringing new product to the market, in order for the electric vehicle (EV) to succeed and for production volumes to grow, key partnerships (governments, utility companies and other stakeholders) will be vital in the building of a viable charging station network, in order to move to a zero-emission society. The Leaf goes on sale through selected Nissan dealers in the U.S. later this year. The Canadian edition of Leaf, which will come with a special winter package that includes heated seats and steering wheel, is scheduled to arrive next fall, as a 2012 model. Nissan already has presale orders for the entire first-year production run of 20,000 units. It will be able to ramp up production to 300,000 annually, if demand for Leaf continues to grow. If that level of production is achieved, the economies of scale will really start to kick in and the price should start to drop. Leaf’s list price in the U.S. is a hefty $32,780 US, but that’s offset buy a $7,500 federal environmen-

tal tax credit for anyone who buys a zero-emissions car; some states offer additional tax rebates. When you then factor in the fuel savings, the car starts to look even more attractive. Nissan estimates U.S. electrical costs will be about $2.64/100 miles on average, at a rate of 11 cents/24 kWh. The Leaf is based on a stretched version of the Nissan B-platform (used by Versa) and it was designed specifically for its Lithiumion battery pack, which is in the centre of the vehicle, under the floor. The battery is a unique flat design with four cells and 48 laminated modules. It weighs about 250 kg (600 lbs.) and comes with an eightyear/160,000 km warranty. The electric motor that drives the Leaf’s front wheels is a high-response 80kW AC synchronous motor that can generate 107 horsepower and 207 lb.-ft. of torque. This combination gives the Leaf a rated driving range of 160 kilometres (based on the U.S. LA4 cycle) on a single charge. According to Nissan, 90 per cent of Canadians commute less than 90 km a day. The actual real-world driving range of the Leaf depends on a multitude of factors, including where, when and how it’s driven. Use of its Econ mode extends the driving range considerably and travel distances way beyond its rated range are certainly possible. Leaf’s battery can be charged up to 80 per cent of its full capacity in 30 minutes when connected to a dedicated DC fast charger. Charging at home with a 240V (dryer or stove type) outlet takes about eight hours. Using the standard 120V wall connection takes 20 hours to recharge a completely depleted battery pack. hidden under a small door located in the front of the Leaf and the plug connects to an on-board charger. A regenerative braking system also helps increase driving range. Leaf’s electric motor acts as a generator, converting energy lost during braking or deceleration into battery energy. Leaf is the most carlike electric vehicle I’ve driven to date and I would put it on par with a Toyota Prius in terms of handling. At low speeds (below 26

km/h) it makes a humming sound from a speaker at the front of the vehicle to alert pedestrians, which automatically turns off when the vehicle’s speed reaches 31 km/h. It’s a bold move by Nissan, and by getting in early, it can take advantage of pent-up demand for a fully roadworthy and affordable electric car. Beyond the so-called “early adopters and greenintenders” it’s going to be interesting to see how many “everyday” car buyers are prepared to also open their wallet to buy a Leaf.

Richmond’s Karen Wong is vying for the coveted title of B.C.’s Best Young Designer in the Morgan Crossing up-and-coming interior designer competition. Wong is competing against the cream of the crop from across the Lower Mainland. Her design vision, along with the other five interior designers, can be seen in a brand-new suite at South Surrey’s Morgan Crossing. The six finalists were each given a budget of between $10 and $12,000 and five weeks to fully decorate and furnish a suite. A panel of judges will select the grand prize winner on Feb. 20. If Wong should win, she will walk away with the title of best young designer. On top of that, the winner receives an allexpenses paid trip to New York City. There, the Richmond rising star will get a pass to attend the prestigious Architectural Digest Home Design Show.

The re-opening of the Lakeside Grill at Mayfair Lakes Golf and Country Club last November was a resounding success. The invite-only affair celebrated the rebuilding of the restaurant, which was damaged by fire back in March 2010. I have always been fascinated by the First Nations history — it might have something to do with the fact that my first crush in high school was Aboriginal on his mother’s side. During that summer, he would head up north to visit his relatives on the reserve and write me letters, which sparked an interest in the history and culture. But I digress. If you are like me and want to explore the rich heritage of the Okanagan’s Aboriginal population and their cultural impact, a visit to The Nk’Mip Desert & Heritage Centre is a must. We meander through the interpretive centre for a few hours, checking out First Nations artifacts, the traditional pit house and sweat lodge and an 1892 log building. We are driving up a winding road through vineyards. The first thing we notice atop the ridge is a sculpture of a First Nations warrior in full regalia sitting astride a magnificent horse. As we pass the chief, we enter into the home of the first Aboriginal winery and resort in Osoyoos, in the Okanagan Valley. Framed by lush vineyards, desert mountains and Lake Osoyoos’ blue waters, the sprawling Spirit Ridge Vineyard Resort & Spa includes 130 villas and condos, the Sonora Desert Spa, the Nk’Mip Wine Cellars and Passa Tempo Restaurant. Spirit Ridge is built on land owned by the NK’ Mip, one of the Osoyoos First Nation’s five tribes. The architecture is an eclectic mix of haciendastyle abodes coloured in warm earthy clay tones. For us, this weekend getaway was a chance to unwind, relax and indulge. It’s already getting dark when we arrive. We head into the reception area to check in and we are imme-

diately welcomed out of the cold by friendly staff offering us a hot cup of apple cider. After settling into our condo, we venture outside for a walk of the property. The air is pungent with the scent of damp leaves and of freshly tilled earth. We stand for a moment to breathe it in. You feel so alive in this cool desert landscape. Most visitors think of the Okanagan as a summer destination. For those like me, who prefer the fall and winter — when it’s not as crowded and the temperatures cool down considerably — it offers endless opportunities. The following day, we head over to the Spirit Ridge Market Café to plan our day over a fresh-baked muffin and cup of java. Then, ready for some exercise, we discover there are a number of hiking paths that wind into the Great Basin Desert, leading visitors to a realistic mock-up of a traditional Okanagan village, and to the Chief ’s Lookout. My partner Dennis heads off with a good book to the outdoor hot tub as I head to the Sonora Desert Spa. I am about to enjoy of few hours of pampering. My hedonistic journey starts with a Monticelli Mud Wrap. My aching, tired muscles benefit from the vigorous massage, which follows my soothing herbal body wrap. It was just what I needed to feel reenergized. But it isn’t over. I am about to indulge in a Desert Glow facial. Sixty minutes of blissful rehydration of the skin, complemented by a hand and head massage, left me on cloud nine for the rest of the day. After a late afternoon leisurely stroll through the rows upon rows of vineyards, we get ready for dinner. A few minutes walk and we are back in the main building of the Spirit Ridge Resort. This is where you will find the Passa Tempo Restaurant (Passa Tempo is Latin for passing the time). Passa Tempo is inviting and there’s a real nice, warm rustic feel to it. SUBSEQUENT MARRIAGES, MUTUAL WILLS AND ESTATE PLANNING

Second, third or other subsequent marriages, and common law relationships are now common in our society. From a legal and Estate planning perspective, these relationships can be complex, depending what assets the parties have, and how they want them distributed on their deaths. Where one or both of the parties have children from prior relationships, extra consideration has to be given and planning done, if asset disputes are to be avoided. Recent case law suggests that Courts, in resolving such disputes, will look for agreements the parties may have made, regardless what kind of title arrangements the couple had with respect to their assets. An inference from the cases may be that couples in subsequent relationships should consider written agreements (aside from Wills) in their Estate planning. We’ll look at some of the issues.

Recent case law

Last October, reasons for judgment were released in the case of Brewster v. Lenzi. This Victoria case was about a couple who were married (each for the second time) for nine years before Mr. Lenzi died in 1997. They purchased a home of their own in 1992, taking title in joint tenancy, having each contributed half the purchase price. At the same time, they made new Wills. In the Wills, they both agreed that on the death of the first member of the couple, the survivor would transfer the interest of their late spouse to a designated person. Mr. Lenzi stated that his half interest (if he died first) was to go to his daughter, Ms. Brewster (the Plaintiff). Mrs. Lenzi stated that her half interest (if she died first) was to go to her nephew and niece. Mr. Lenzi died first. Mrs. Lenzi then got legal title given it was registered in joint tenancy. After Mrs. Lenzi obtained legal advice and even settled a potential Wills Variation claim for $15,000, she then made a new Will, in which she directed the transfer of the property on her death to her nephew and niece. This ran contrary to the agreement she had made with Mr. Lenzi. When Mr. Lenzi’s daughter Ms. Brewster heard the news, she sued Mrs. Lenzi. It should be emphasized that the property had been owned by Mr. and Mrs. Lenzi as joint tenants and when Mr. Lenzi died, legal title moved by right of survivorship to Mrs. Lenzi. You might think that this should have ended the matter. Mrs. Lenzi, now sole registered owner, should have been able to do what she wanted with the property. But in these situations, the Court considers far more than just who is the registered owner of the property. In this case, the Court examined in great depth the agreement the parties made and concluded that in fact Mrs. Lenzi, though she survived her late husband, and took title, had made an agreement with him, as expressed in her Will, and so she held the half interest Mr. Lenzi had in the condominium in Trust for his daughter Ms. Brewster.

In the Lenzi case, when the couple purchased their condominium, they could have registered their title as Tenants in Common rather than as Joint Tenants. The case might have been easier to litigate for Ms. Brewster had the title been a Tenancy in Common rather than a Joint Tenancy. But the Court demonstrated that in these cases, it will consider not only how the title is registered, but more importantly, what the couple actually agreed to with respect to the asset. The complexity that can arise from Estate planning by a couple in a subsequent relationship, with assets and children can be alleviated to a degree with well drawn Wills, and a Mutual Will agreement. With these documents, the parties clarify not only how their assets are to be distributed on death, but also that the survivor of them won’t make any changes. Does this seem fair? I suggest the result is indeed fair. The reason is that Mrs. Lenzi made the agreement with her late husband, and that was held by the Court to be binding on her, and so the Trust arose. What is unfortunate, is that Mr. Lenzi’s Estate was not large, but it had to be litigated which is expensive. What was missing perhaps was some careful planning by the couple at the time they made their Wills. What is available to couples in these situations is the Mutual Will Agreement. This agreement, over and above the Wills, is a form of confirmation of what the couple agreed to with respect to their assets in their Wills. Under the Mutual Will agreement, each member of the couple agrees that if he or she survives the other, he or she won’t change the Wills they made. This adds an element of certainty for the couple and other Estate beneficiaries (including children) and probably reduces the likelihood of litigation after one (or both) member of the couple passes.

Method

Cut lobster into big pieces; blot dry. Marinate with seasoning. Add two tablespoons of oil into heated wok. Stir-fry water chestnut, celery, green peas and carrot. Season with half a teaspoon of salt, stir-fry well and dish up. Add another three tablespoons of oil into heated wok and sauté minced garlic and ginger. Stir fry lobster until it turns red and add a dash of wine. Add water, chestnut, celery, green peas and carrot, stir-fry well. Add sauce, bring to boil, add green onion. Young fencer ready to take on the world

It wouldn’t be a stretch to say Shaul Gordon captures fencing gold medals like Zorro captures bad guys. The 16 year-old fencing prodigy is set to slash Zs in his opponents’ body armour this weekend at the National Fencing Championship at the Richmond Oval. “It’s something special. The championship usually doesn’t happen here in Vancouver because the national fencing centre is in Montreal. It’s nice my family can come and watch,” Gordon said. While the national tournament is important for Gordon to try to move up from his No.2 ranking in the cadet (under-17) and junior (under21) sabre divisions, he has

already secured a spot on the national team after coming off an impressive win in the cadet sabre division at the North America Cup in Dallas, TX, last week. After besting 98 of the continent’s best fencers in the division, he is scheduled to compete at the World Junior and Cadet Championship in Jordan this April. Gordon, who trains at the Dynamo Fencing Club in Richmond, is on a hot streak, having won both the cadet and junior categories at a national tournament in Ottawa in October. Travelling to elite competitions is not new for Gordon. He’s competed in many places, including Germany, Montreal, Milwaukee, St. Louis, and Dallas. His ultimate goal is to reach Rio de Janeiro for the 2016 Summer

in his abilities. “I think I’m a pretty intelligent fencer. Some people tend to be very fast and

physically strong but I tend to do more tricks. A big part of fencing is a little bit like chess. You have to make your

opponent think one way, to trick them,” Gordon said. There are three categories of fencing, based on the type of sword the athlete chooses: The foil sword is used in a slower poking match (scores can only be made with the tip of the sword and only to the torso and back). The epee is another poking sword but can be used anywhere on the body. The sabre can be used to poke or slash the opponent anywhere on the body (this would presumably be Zorro’s category). Gordon said he competes in the sabre division because he likes the speed. “You have to be very aggressive because it’s very fast. I liked it more. You move more and it’s more like real combat,” he said. The Canadian championship runs Jan. 28 to 30.

Her regimen is impressive for an athlete at any age and she keeps a log for every run. “I will do, for example, a 10-km run on Monday, track on Tuesday — track is always four km — Wednesday another 10-km, Thursday track again, Friday I go to a ball class and Saturday I do a long run, which can be anywhere from 20 to 42 km. The distances may vary depending on where I run in Richmond,” she explained. “I know how old I am and I know how old I feel. I certainly don’t feel my age.” Last October in Victoria McFarlan set the world-record marathon time for a 76 year-old woman with a time of four hours and one minute. Continued on page 35

The accolades continue to be bestowed upon Richmond’s Gwen McFarlan as she continues to defy time. McFarlan, 76, a marathon world-record holder, was one of three Richmond athletes nominated last week for the Sport B.C. Athlete of the Year awards, which recognize the province’s most outstanding amateur athletes, coaches and officials. At the awards ceremony, to be held at the River Rock Show Theatre on Feb.24, she will be up against two other seniors — diver Lois Wood of White Rock and triathlete Carol Peters of Delta — in the Master Athlete of the Year category. “It was such a surprise. It’s something I never thought would happen. I’m honoured and grateful, astonished, excited,” McFarlan said of her nomination. Of her accomplishments, which include several marathon or half-marathon world records in her age category, McFarlan said there really isn’t anything special about what she does. Kind of like Forrest Gump, she just likes to run. “I’m addicted to it…. I like to socialize and after our weekly runs we’ll go out together. It’s just my way of life now. It doesn’t matter the weather,” she said. McFarlan, a retired teacher, only started running at age 60 with her students at Tomsett Elementary school. She now trains

year-old woman. She also holds several Canadian records for five and 10-km races. Born in Moose Jaw, SK, McFarlan attended the University of Saskatchewan and briefly taught in northern Ontario before coming to B.C. in 1957.

She raised one daughter and one son with her husband Chuck and it wasn’t until 1995 that her health came into question with a breast cancer diagnosis and other health complications. “It changed my life in that I changed my diet and started running,” she said.
