A LETTER FROM THE DEAN Dear Cardozo Family: Thank you for saying ‘yes’ to Cardozo. It is with great pride and appreciation that I present this 2013–14 Annual Report of Giving. Because of your energetic support of our great law school, you made it possible for us to do what we do best: deepen our commitment to the values and objectives that have inspired us since our founding and lead the way as innovators: develop new programs that prepare our students for practice at the highest levels of the profession. This year in particular, you strengthened our ability to provide a legal education that prepares students for careers of success, meaning and impact. You ensured that our Cardozo education blends rigorous training in legal theory and reasoning with practice skills such as client relations, problem solving, strategic planning, negotiation, and communication. These are skills that will enable our students, when they practice, to make an immediate difference in the lives of the clients and communities they serve. With your help, our achievements have been significant and far-reaching this past year. We have been able to provide singular opportunities to our students—and—we continue to make our mark in areas of the law that are new and ever changing. This year’s report features some, yet not nearly all, of Cardozo’s remarkable people, programs, and significant accomplishments. The pages are filled with stories of innovation and impact: curriculum and clinics in digital and data information law, including our Tech Startup Clinic; The Indie Film Clinic; programming

in Fashion Law; terrific developments in our premier Dispute Resolution Program and Holocaust, Genocide and Human Rights Program; and advances of unquestionable legal significance in immigration justice, including enactment of laws that will provide legal advocacy for thousands of vulnerable individuals and families unrepresented were it not for the efforts of Cardozo faculty and students. From the small screen (mobile apps) to the big screen (documentary films); from the business of fashion (international financial negotiations) to fashionable businesses (high profile corporate firms); and from confinement (detained immigrants) to freedom (not a single Immigration Justice Clinic client has been deported), Cardozo students, alumni, and faculty are changing the law and improving lives. Shoppers, elegant runway models and clothing product buyers may not realize that complex international business transactions drive the fashion industry. “Fashion is fun, but it’s also a sophisticated challenge in terms of the legal intricacies,” says Jeff Goldfarb ’02. Goldfarb is Director of G-III Apparel, a company founded by his grandfather in 1956 which today designs, distributes and markets apparel for many of the world leading brands. Goldfarb, who joined the Cardozo Board of Overseers in 2014, and his wife Stacey Goldfarb ’02, have made a generous gift to support Cardozo’s Fashion Law Program, as well as a significant contribution to the Dean’s Discretionary Fund. Dean Diller is “world class,” a “great leader” who inspires confidence. Cardozo’s Board members understand, he is pleased to say, the need to support innovative programs that differentiate Cardozo from other schools. The Fashion Law Program is a component of FAME, Cardozo’s Center for Fashion Arts Media & Entertainment. Cardozo’s Entertainment & Arts Law Journal is ranked #2 in the nation, and FAME offers externships with some of the most creative and successful fashion leaders in the nation (Calvin Klein, Viacom, Sony Music, Sotheby’s). The Fashion Law Program offers coursework, externships, symposia and workshops on copyright, trademark, patent, privacy, publicity, emerging tech, labor and employment issues, real estate, advertising, finance, branded entertainment, mobile marketing, international trade regulation and related issues. The Program also sponsors the semi-annual Fashion Law Symposium, a highlight of the spring and fall seasons. Cardozo alum Barbara Kolsun ’82, Executive VP and General Counsel at Stuart Weitzman and adjunct professor at Cardozo, works closely with Cardozo students to create distinctive events featuring experts and trend setters, including leaders in fashion and business law from such companies as Tiffany & Co., Kate Spade & Company, Brown Shoe Company, Avon, Davis and Gilbert, Gucci America and Ancora Pop, among others. Fashion is about more than glitz and glamour. Clothes are a basic necessity, but not everyone can afford the attire they need. Goldfarb employs his business and fashion savvy to support a generous philanthropic effort. For many years, he has been an enthusiastic and active board member of K.I.D.S./Fashion Delivers, a non-profit agency that unites retailers, manufacturers, foundations and individuals to provide people impacted by poverty and tragedy with new merchandise, effectively distributed through a network of agency partners to improve the wellbeing, self-esteem and dignity of at-risk families and individuals. Goldfarb urges Cardozo alums to support the Fashion Law Program as an easy and fun way to invest in the school, advance the future of fashion law and grow an alumni community in the field. “I couldn’t have gotten where I am now in my career without Cardozo,” he says, “Best of all… meeting my wife.” In addition to supporting the symposia, Jeff and Stacey helped establish Cardozo’s innovative partnership with The Fashion Institute of Technology (FIT) and are active in Cardozo’s annual Public Service Auction to raise funds for public service summer stipends. Jeff is also a participant in the Dean’s Speaker Series.

Record Setting Results for Public Service Cardozo’s 2014 Public Service Auction raised $620,000 breaking the record for the 11th year in a row and supporting stipends for 254 students. For the summer of 2014, stipend recipients received $4,000–$5,000 to work in the U.S. in all areas of public service law or internationally on human rights projects. “Summer stipends make a huge difference for a student who has the passion and wants to gain experience in public interest law but who cannot afford to take an unpaid internship or a low-paying job without financial assistance,” says Cardozo Board of Overseers member Jennifer Grubman Rothenberg ’99, board liaison for the auction. Rothenberg praises board colleagues and especially the leadership of Board Chair Emerita, Kathryn O. Greenberg, for whom the auction is named, for producing the auction’s ever-growing success year after year. Rothenberg has been committed to public interest law and community service for her entire career, beginning with her experience at Cardozo. “Prospective students choose a school by matching their interests with the school’s strengths. I chose Cardozo because of the clinics and the school’s dedication to preparing students for work in the public sector. I wanted to make an impact on society, especially among those without adequate legal representation,” she says. At Cardozo, Rothenberg worked with the Sanctuary for Families (“which I love”) and for Legal Aid in the Law Guardian Department; she remains passionate about the work of both organizations today. It was “an honor,” after graduating from Cardozo, she says, to serve as an Assistant District Attorney with the Westchester County District Attorney’s Office in the Appeals and Special Litigation Bureau, where she specialized in domestic violence, child abuse, and sex crime cases. Rothenberg is the founder and President of Innovative Philanthropy, a firm that advises non-profit organizations in achieving their philanthropic objectives in a competitive marketplace. “There are many ways to give back to Cardozo,” says Rothenberg, “There’s an opportunity for every alum and every donation is important, no matter the size. You must lead by example.” In addition to her steady support for public interest law programs and stipends, she has made a recent and generous gift to the Dean’s Discretionary Fund. “I believe in Dean Diller and his vision for the school. Cardozo is tuned into what’s happening in the world and we’re filling in critical gaps in the legal profession with our innovative programs, equipping our students for success. ”

Law Firm Challenge Hits New Milestone In 2013–2014, the Law Firm Challenge continued the steady, consistent growth it has demonstrated over its 10-year history with a record 71 firms participating, a 39% increase over last year. The increase in firm participation is a reflection of the ever growing numbers of Cardozo alumni practicing at law firms around the country and the world. The Law Firm Challenge, says David Herman ’00, who led the expanding effort, and a partner at Weil Gotshal & Manges LLP, “is a great motivator to Cardozo alums at firms. It reminds us of the importance of strengthening our connections to Cardozo and the network of relationships that we rely on.” Thank you to the law firm challenge agents who spur their Cardozo colleagues at their individual firms to make an annual gift to Cardozo in friendly competition with their counterparts. “At Cardozo we learned that all challenges are also opportunities,” Herman is quick to point out. “I am confident that increasing numbers of alums at firms will relish the challenge, step up and create expanded opportunities for themselves and for Cardozo.”

Class Agents Cardozo alumni describe the school as unique—a law school that challenged them intellectually as well as one that fostered a lasting sense of community. What the Law Means—Cardozo Scholarship Recipients Choosing Cardozo was the best decision I ever made. From the first graduating class in 1979 to current students, scholarship recipients are effusive in their praise for the Cardozo experience—talented faculty, experiential learning programs, a close and supportive community, an alumni network—and grateful for the opportunities made possible by the critical financial assistance. Cardozo scholarship students are among the school’s superstars. Recent Cardozo, Gates, Dean’s, Monrad Paulsen scholars and need-based grant recipients placed first of 34 teams in the 19th Annual Mardi Gras Sports Law Invitational; won the American Constitution Society’s Richard D. Cudahy Writing Competition on Regulatory and Administrative Law; and received distinction for one of the best law review articles in the fields of entertainment, publishing and the arts. A 2013 scholarship recipient was a winner in the New York State Bar Association’s Phil Cowan Memorial/ BMI Scholarship Writing Competition. A 2014 graduate was awarded a prestigious Peggy Browning Fellowship, which provides stipends to law students who dedicate their summer to advancing the cause of workers’ rights. Scholarship funding means a world of difference for students and supports engagement with work that interprets and challenges the meaning of the law. It is a top funding priority for the law school. The Seventh Annual Alumni Dinner, held in January 2014 at the Pierre Hotel in New York, raised a record breaking $660,000 for scholarships. Hon. Martin Shulman ’81 and Arthur M. Luxenberg ’84 were honored as alumni of the year and over 700 alumni, students, and friends gathered to celebrate Cardozo and Shulman’s and Luxenberg’s contributions to the law school. The community also rallied to support the critical priority of financial assistance to students. Arthur Luxenberg and his partner, Perry Weitz along with their firm, Weitz & Luxenberg contributed graciously and generously in support of scholarships and helped mightily to ensure the success of the evening. Both Shulman and Luxenberg, in their remarks, underscored Cardozo’s impact on their careers and their lives. “Choosing Cardozo was the best decision I ever made,” they agreed.

Clifton Elgarten ’79 “This is what an education is supposed to be. That’s what I thought when I got to Cardozo,” says Cliff Elgarten, Dean’s scholarship recipient in Cardozo’s first graduating class. He had already begun studies for a Master’s in sociology when he decided to go to law school, urged on by an uncle on the Yeshiva University faculty. “I convinced the Dean to give me full tuition. I could not have afforded law school without it.” It was the start of three and a half decades of persuasive and successful arguing. Elgarten, a partner at Crowell & Moring in Washington, served as law clerk, first for the Hon. Louis H. Pollak, District Judge, Eastern District of Pennsylvania, and then for the Hon. William J. Brennan, Associate Justice, United States Supreme Court, before specializing in commercial law. He is a leader in appellate litigation, complex commercial disputes and international arbitration. He represents clients in a broad range of industries: energy and insurance, among others. His practice is not limited to commercial litigation. He pursues claims for victims of international terrorism. Cardozo, he insists, taught him the thinking and core legal skills that enabled an engaging and successful career. “The law continues to interest me every day,” he says. “I am impressed by the skills and success of the Cardozo alumni I meet and by the diversity and range of their experience, expertise and practice, including associates at Crowell Moring,” says Elgarten. “In many ways, my career has simply been an extension of my experience at Cardozo.”

There’s No Dispute—Cardozo Has Set the Bar for Mediation The Kukin Program for Conflict Resolution, ranked 7th in the country and an early leader in Alternative Dispute Resolution (ADR), is poised for innovation in a field that continues to evolve. A gift from Jed Melnick ’99 of $100,000, the largest donation the Cardozo Journal of Conflict Resolution has received from an alumnus, will go towards supporting the Journal’s Annual Symposium which brings together leading scholars to consider pressing issues facing the mediation community. The 2014 Symposium (Mediation—a Sleeping Beauty?) featured national experts on the subjects of bargaining basics, the disappearance of the joint session and party participation in commercial mediation, the role of the courts in mandating mediation and other essential issues in flux. “Professor Lela Love (Professor of Law, director of the Kukin Program for Conflict Resolution) and Cardozo ADR faculty are among the greats in the field,” says Melnick, the founding editor of the journal and an alum of Professor Love’s mediation clinic. “I received the best possible training at Cardozo and I want to support the school’s contributions to the field. Cardozo has created a stream of national leaders with highly specialized skills in alternative dispute resolution.” Melnick began his career in public interest law working in law school for The Neighborhood Defender Service of Harlem and the Center for Court Innovation where he collaborated with the team that established The Crown Heights Community Mediation Project to mediate community related disputes between the Caribbean American, African American and Jewish Orthodox communities. After law school, Melnick never stopped mediating probono mediations and after a five-year stint as a trial lawyer for the Defender Association of Philadelphia, he joined with JAMS, one of the world’s most prestigious arbitration, mediation and ADR firms. Melnick joined with Hon. Daniel Weinstein (ret.), one of the preeminent mediators of complex disputes in the country. His work on what is now the Weinstein Melnick Team led to his selection (three years in a row) as a Pennsylvania Super Lawyers “Rising Star,” the only “Rising Star” in the Alternative Dispute Resolution category in Pennsylvania. Melnick was also selected to the 2010 list of Pennsylvania “Lawyers on the Fast Track,” a recognition given to 30 Pennsylvania lawyers under the age of 40 by Legal Intelligencer and the Pennsylvania Law Weekly.
At JAMS, Melnick has successfully mediated the resolution of thousands of complex commercial disputes with an aggregate value in the billions of dollars. In addition to being on the team that settled most of the securities cases that came out of the Lehman Brothers and Adelphia bankruptcies, Melnick has been involved in numerous mediations arising out of the financial crisis. He is proudest of his pro bono mediation between the Disability Rights Advocates and the New York City Taxi and Limousine Commission, which led to a historic settlement raising the number of taxi cabs that are accessible for people with disabilities from 300 out of 13,000 to 50% of the entire fleet by 2020. Melnick believes the benefits of mediation cannot be overestimated. “We’re working to ensure that the adversarial and emotional components of the traditional legal system do not present barriers to the creation of settlement options that can lead to constructive resolutions.” says Melnick. “There is always an alternative to the fight.” Professor Love is grateful for Melnick’s generous gift and clear about Cardozo’s future needs. “I want to look around in the next few years and see a named professorship, new initiatives named for and supported by Cardozo alums and increased support for our unique Divorce Mediation Clinic.” Melnick and fellow alumni colleagues are planning a gala event on October 8, 2015 to recognize the 30th anniversary of the Cardozo Mediation Clinic, to celebrate the Kukin Program for Conflict Resolution and its successful alumni, and to honor Professor Love’s and Cardozo’s influence on the field of Alternate Dispute Resolution. Champions of Cardozo Kathryn O. ’82 and Alan C. Greenberg
How is it that an academic institution not only keeps current but also stays ahead of the curve, advances and is dynamically innovative? How does an institution hold on to its mission, its heart? How does the school continue to make a difference in its students’ lives and in the larger world? Yes, creative and intellectually forward thinking deans and faculty, talented students and alumni. And, yes, extraordinary and enlightened leadership. And, if a school is very fortunate—and exceedingly lucky (and Cardozo is such a school), it has the leadership, friendship, heart and vision of Kathy and Alan Greenberg. How saddened we were this year by the loss of Alan, whose brilliance, ingenuity and common sense coupled with Kathy’s dedication to providing expanded opportunities for our students and increased access to justice for the underrepresented, literally forged change and growth in every area of our law school. We thank Kathy and Alan for establishing a scholarship that allows students who dream of pursuing a legal education at Cardozo to have one, for supporting the creation of the Kathryn O. and Alan C. Greenberg Center for Student

Life, given in honor of Dean David Rudenstine, and for establishing the remarkable Kathryn O. Greenberg Immigration Justice Clinic and building the Guardianship Clinic that will continue its vital work as a part of our Bet Tzedek Legal Services Clinic. We are deeply appreciative for their spearheading and championing the Public Service Auction, thereby giving opportunities to hundreds upon hundreds of students to launch public interest law careers and for having the vision to organize the Junior Advisory Board. And, we thank them for their gracious and generoushearted spirit to open their home over and over again to our students, our faculty, our alumni and our Board of Overseers for events that deepen the community and ethos of the law school. In 2010, at commencement, the faculty bestowed upon Kathy, who was then stepping down as Chair of Cardozo’s Board of Overseers, a newly established award; created just for her: the Benjamin N. Cardozo School of Law Award for Extraordinary Leadership. The words read, “You have done all of these things in the spirit of warmth and generosity that exemplifies the goal of leading by example. You have moved mountains for Cardozo and built a better working, teaching and learning environment for each individual in our community.” This Annual Report of Giving thanks the thousands in our community who take the time, have the commitment, feel an important connection to Cardozo. It is clear that there is no corner of the law school that has not been touched by Kathy’s and Alan’s grace and magic, that does not bear their imprint and is not stronger. Kathy and Alan, thank you. You make us better.
