Most older people and people with disabilities choose to live at home, if possible, with help from services such as home care, day services, equipment and adaptations, respite care and a range of other services designed to support people in their own homes. You can find more information about these services within this Directory. Check the contents page at the beginning for details. If appropriate we will carry out an assessment of your needs, or provide you with information and advice about where you can get the help you need. We can meet your assessed needs by providing or arranging services for you or by providing a Direct Payment for you to make your own arrangements (see page 8). If you are considering long term care for yourself or a member of your family, we know what a big decision this is and we would always advise people to take their time, explore their options and alternatives before making a final decision. We may

be able to offer rehabilitation for a short period to help the person regain their daily living skills and confidence, for example after an illness or spell in hospital. If long term care is the only option, there are still alternatives such as supported and extra care housing (see page 20‑21). Alternatively, we can assess eligibility for a place in a care home for you. This Directory lists all such homes within the Bradford District and we have agreed care specifications and contracts with all of them. We may be able to help with the cost of such care but this depends on your savings and income ‑ we will work out the amount we can pay using a nationally set sliding scale. This may mean some people will be responsible for paying the full cost of their care (see page 26.) If a care home or care home with nursing is the right option, you can use this Directory to help choose the right one for you. It contains important information about all the homes in the District. We can help you work out which home may best suit your needs and tell you about the Care Quality Commission reports for the home, but the final choice is yours. Like other local authorities, Bradford is looking at ways in which we can give service users more choice and control over how they receive the help and support they need, including people having their own budgets, and redesigning services that they can then use their personal budget to pay for. Introduction Personalisation ʻPersonalisationʼ is the term used to describe the ability to tailor a range of support services to meet an individualʼs specific care needs and it is at the heart of the Governmentʼs drive to transform social care. It means that everyone who receives support, whether from the Council or funded by themselves, will be empowered to shape their own lives and the

services they receive in all care settings, including their own homes. Independent living is one of the goals of personalisation. It does not mean living on your own or doing things alone, but rather it means having choice and control over the assistance and/or equipment needed to go about your daily life.

Self‑Directed Support Part of the personalisation agenda, Self‑Directed Support is a totally different way of providing adult social care. As the name suggests, Self‑Directed Support allows you to design and tailor your own

support package to meet your specific needs. This is a major change in the way adult social care services are delivered in Bradford District.

Individual Budgets An important part of personalisation, an Individual Budget is an amount of money the council allocates to help people who due to disability, frailty or vulnerability, receive the support they need. Councils

are now working in a different way, in order to give people who use services more choice and control over how money they are entitled to is spent.

Direct Payments All or part of an Individual Budget could in most cases consist of a Direct Payment should you be assessed as being eligible for services from Adult and Community Services (ACS). A Direct Payment is money paid to you by ACS to enable you to organise your own care to meet specific needs. Examples of which could be: • employing a personal assistant for home support and social inclusion • employing a Independent Domiciliary Care company • employing a live‑in carer subject to certain critera • short stays in a care home for no more than 4 weeks • day care • equipment to meet your care needs that would traditionally be provided by the Council.

Payments option with you when they assess your care needs. Direct Payments can be paid by the following methods: • into a bank account solely for Direct Payments • to an accounting bureau who will manage the money on the clients behalf • on to a debit card with ʻchip and pinʼ technology that is best suited to online or telephone banking methods of making payments.

Direct Payments are intended to support adults in independent living, so you cannot use them to pay for permanent accommodation in a care home or care home with nursing. If you are applying for services for the first time, your social care worker should discuss the Direct

A Direct Payment forms no part of a clientʼs personal income, is not taxable and has no impact on benefits. Any money paid to clients under Direct Payments scheme remains public money until it is used for the clientʼs assessed need and any unsused money can be reclaimed by the Council.

Assessing your needs If you are facing a major change in your life because of an illness or disability, Adult and Community Services (ACS) will talk to you and the people who matter to you so that they can help you decide what you want to do and how they can help. This process is called an assessment and is something everyone is entitled to and is free. An assessment starts with a discussion to understand all your needs and what you want to achieve. Your social worker will ask you about: • what difficulties you have now • what you can do for yourself and what you think you need help with • what you canʼt manage at all • who helps you now • how best to achieve your goals. With your permission, your social worker will also talk to people closely involved with you, for example,

your carer, family and friends. Other professionals, such as an occupational therapist, physiotherapist or district nurse may also be included as part of your assessment. This will make sure you are given the right information to make choices about your future. If you have health problems as well as other difficulties, you may get help from both the NHS (National Health Service) and from ACS. If you are a carer (you provide regular and substantial care to a relative or friend, and are not paid for it), you are entitled to an assessment even if the person you look after doesnʼt have help or funding from ACS. All information given during an assessment and afterwards, will be kept securely. ACS will share relevant information with professionals like a doctor or nurse unless you ask them not to. The assessment will take account of your religious beliefs and cultural practices.

How to get an assessment You or a friend, relative or a health professional like your GP can ask for an assessment by phoning Adult Services Direct on 01274 435400. A social care worker will come to see you. If you are in hospital,

the nursing staff can arrange for a social worker to contact you, either during your stay in hospital, or on your return home.

Helping you stay independent in your own home Re‑ablement Re‑ablement is a method of short term support designed to help you become as independent as possible. Perhaps you require support with personal care or to prepare a meal – the re‑ablement service will work with you to make it as easy as possible to manage these tasks on your own. In traditional home care, someone would visit and do these tasks. Using the re‑ablement service, a social worker/nurse will work with you so that you can learn (or re‑learn) important tasks needed for

everyday life. Many people who participate in a re‑ablement programme find that afterwards they can cope very well on their own, without the need for social care support. The re‑ablement programme will normally last up to six weeks and will be free of charge as long as the person participating in the programme is making progress. This progress will be reviewed every week by the re‑ablement team.

Telecare ‑ ʻSafe & Soundʼ Safe & Sound is Bradford Councilʼs Community Alarm System. Using the latest technology, your home can be connected to Safe & Sound, where calls are monitored 24 hours a day. The alarm unit operates over the telephone network. Equipment supplied by Bradford Council plugs into an electric socket and a telephone point. These need to be reasonably close together. We can check if your existing sockets are suitable, and advise if any alterations are necessary. (We regret we cannot pay for any changes that may be required.) At the Safe & Sound offices, confidential information about you is held on computer, and is instantly available so that effective action can be taken in any emergency. The moment a call is received, the operator will know your name address, GP, next of kin and key holder information. Safe & Sound has mobile staff operating in the Bradford Metropolitan area. They are trained in first aid, and provide a back up to your named contacts

and can help in a simple emergency, but are not able to perform ʻcare tasksʼ. Safe & Sound equipment is simple to use: A press of a button, and you are in touch with us. • We will know who you are at once • Information supplied by you and stored on our system will be highlighted automatically • Operators can speak to you through the Safe & Sound unit • All calls are monitored and recorded for your safety and security. Adapting your home A Disabled Facilities Grant can help towards the cost of adapting your home to help you to be more independent or assist your carer to manage more easily. This may be getting about your home, doing everyday tasks such as bathing, going up and down stairs, or getting in and out of the house. Adaptations can only be considered after your situation has been assessed ‑ they are usually a last resort after such options as rehabilitation have been considered. Adaptations costing less than £1000 are usually arranged by Adult and Community Services (ACS) through an occupational therapist. Anyone living in (or caring for someone in) the Bradford Metropolitan District, who has a ʻpermanent and substantialʼ disability, and who has significant difficulties managing everyday tasks within their home can apply. The grant is provided for essential adaptations to give you better freedom of movement into and around your house so that you can use the essential facilities in it, for example: • taking a bath out and installing a shower • installing a stairlift or providing a downstairs bathroom • widening doorways and putting in ramps • improved access to enable the disabled person to care for a child or spouse etc. • ensuring the safety of the disabled person by, for example, fitting gates to stairs or safety glass in doors and windows • changing the heating system, or adding more heaters where this is necessary for your disability. Sometimes it is not structurally possible or acceptable to make the necessary alterations to a property. If your home canʼt be adapted ACS will put you in touch with the Disabled Personʼs Housing Service. They will assist you with re‑housing if you wish. Your first step must be getting an assessment from the occupational therapy service. They accept

referrals by telephone from service users directly. Please telephone 01274 435252 between 10.00 am and 3.00 pm Monday to Friday for this service. An occupational therapist will then visit you at home to discuss your needs. If it is decided that an adaptation will be suitable for you, a Home Improvement Officer from the Housing Service will also visit to make sure the adaptations can reasonably and practically be done to your home. This may mean that you have to consider adaptations that are not what you expected. If everyone agrees that the adaptations will meet your needs and can practically be done you will be able to apply for a Disabled Facilities Grant to see if you can get help to pay for them. The maximum grant allowed is up to £30,000 and is means tested to establish if you will have to make any contribution yourself. Will I have to pay for the adaptation? ASC will carry out a ʻmeans testʼ to see if you have to make a contribution towards any grant. This means you will have to provide us with details of your income, benefits, savings etc. With this information we will then be able to tell you if you have anything to pay and if so how much it will be. If you are disabled and receive income support or pension credit, or you are a child in most cases there is no contribution. Community meals A hot meal service can deliver a hot main meal and dessert. You can choose from an extensive range of meals which meet a wide range of special dietary requirements. They are delivered at the correct temperature, Monday to Friday between 11.30am and 1.45pm. A frozen meals service is available if you are unable to prepare and cook a meal, but able to

reheat a frozen ready meal. A two course meal is available which can be reheated at your convenience. They are delivered on a fortnightly basis direct to your door. Day care services There are a wide number of day centres within the Bradford district that provide locally based social day care and luncheon clubs for older people, many specialising in care for people from a range of diverse cultural backgrounds. If you or your carer contacts Adult and Community Services, or a day centre directly, arrangements will be made for someone to visit you at home to talk about what you need and give you more information. An interpreter can be

provided if needed. If you require day care within a community/voluntary centre you will be expected to pay a nominal charge. Not all the centres charge the same rate, but the person who initially sees you at home will be able to advise which centre would be most appropriate for your needs and what the charge will be. Independent home care providers In order to enable people to live in their own home for as long as possible a range of home care services are available. A range of help is on offer from day‑to‑day tasks such as cleaning, shopping and food preparation/cooking through to personal care that helps with tasks like dressing, bathing, toileting and prompting the taking of medication. Carers need to be properly trained particularly in moving and handling and the use of hoists for some tasks. Daily care / domestic support Carers can call in on a daily basis to assist with any of the tasks described above. Depending on the level of help required their visits can be just half an hour or up to several hours. Generally, visits are available from 7am until 10pm. Some people will need multiple visits per day. The hourly rate for these types of services typically range from £9 to £15 per hour depending on the services required, the time of day and the location. Night services can also be provided. Rural areas may present particular difficulties and a travel charge will probably be made in addition to the normal hourly rate.

Live‑in care 24 hour live‑in can accommodate people with a very high dependency on a permanent basis. It can also provide respite breaks for regular carers and short‑term support following hospital discharge. In some cases itʼs preferable and more economic to have a carer actually living in the home. This can be for a short period eg a week, or on an ongoing basis. Typical charges for this service range from £520 to £650 per week depending on the amount of care and the particular skills required. Live‑in care is also available to people with permanent physical or mental disabilities who require long‑term ongoing care. All home care providers are regulated and inspected by the Care Quality Commission who publish inspection reports on their website www.cqc.org.uk. When considering a service itʼs always a good idea to check their report. Before you make any decisions regarding the provision of care, be sure to contact several providers and ask for a ʻService Userʼs Guideʼ and their charges and a draft contract between you and the care provider.

Home care agency checklist © 2011 Care Choices Ltd These questions may be useful when considering using the services of a home care (domiciliary) provider to help you build up a picture of how your care needs will be met in your own home. For care packages which have been arranged by Adult and Community Services, contracts and care plans will have been completed by your care

manager and the agencies used will have been accredited to work for Adult and Community Services. People arranging and funding their own care either privately or through a Direct Payment or a Personal Budget are able to choose their own worker or care agency.

Agencies What experience does the agency have in your particular field of need? Can they supply references for you to check? Home care agencies providing personal care, must be registered and inspected by the Care Quality Commission. Ask to see a copy of their registration certificate. How long has the agency been operating? How many carers would the agency assign to care for you and would you see the same one every day? If not, how does the staff rota operate and what happens if your carer goes on holiday or is sick, will you be notified in advance that a different carer will be attending? How can you contact the agency in an emergency or outside office hours? How hard or easy would it be to make a complaint and how are things then put right? If this is a private contract ask for a copy of the agencyʼs contract terms and read these carefully with someone you trust. Get as much help as you can going over it and ask any questions you may have before signing anything. The Citizens Advice Bureau or Age UK could help with this.

Carers You should expect your personal preferences, dignity and privacy to be respected. Discuss this with the agency and ask how the most suitable carers for your particular care are chosen. Can you talk to them before deciding? Carers should be fully trained or be in ongoing training. Ask the agency about their policies on this. You will have a care plan drawn up by the agency which the carers will work to. Ask how often this plan will be reviewed by the agency. Carers must be checked with the Criminal Records Bureau (CRB) and have a criminal records disclosure – make sure this is the case.

Paying If your care needs do not meet Adult and Community Servicesʼ eligibility criteria and have been arranged privately you should check carefully the fee rates charged and exactly what the payment you make covers.

Sheltered housing Sheltered or retirement housing is suitable for people who like living independently but want the reassurance of knowing that assistance is on hand if there is an emergency, or who expect to be away from home for long periods and need to know their home is safe. Often called retirement housing, there are many different types of sheltered schemes, available both to rent and to buy. Schemes usually consist of between 15 and 40 dwellings. These may be bedsitting rooms, self‑contained flats, bungalows or luxury apartments. Some schemes are simply housing designed to meet the needs of older people and linked to a community alarm. The majority of schemes have a scheme manager/warden and community alarm service. There are often communal facilities such as a lounge, laundry, guest flat and garden. Meals are

not normally provided but a few schemes include a restaurant and some can arrange hot meals. The wardenʼs role The duties of the scheme manager/warden vary considerably between schemes. Some sheltered housing schemes have a resident scheme manager/warden and a 24‑hour service; others have visiting or part‑time staff. Most manager/wardens are expected to: manage the scheme; build up relationships with residents and encourage them to ask for additional support from statutory and voluntary organisations when appropriate; and summon help in an emergency. The scheme manager/warden is not expected to provide personal care for residents, or to carry out tasks like shopping or cleaning.

Extra care housing Extra care housing developments are sometimes known as 'very sheltered housing' or 'assisted living apartments'. This is a growing and popular part of the housing with care market for older people. It can offer an environment that is accessible for people who are finding it difficult to get around the house, and which promotes well‑being for people with health conditions. Typically, there is support to access social activities and recreation and some schemes have their own shop, restaurant and other facilities. Generally there is

an on‑site team offering care and support, which can meet high levels of need. People find it attractive because it offers independent living in a home of one's own and we might choose to move to extra‑care when still relatively independent, or as a positive alternative to residential care. The potential advantages include the opportunity for couples to stay together rather than being separated by one partner moving into a care home and some schemes offer the choice to buy as well as rent.

Care homes

Care homes with nursing If you think you may need nursing care in a home, you

will need to be visited by a social worker or a care manager to work out what care you will need. This visit might be in your own home, or in hospital if youʼve been ill, or in a care home. You will be fully involved in planning your care needs. If a care home providing nursing care is the best solution for you, your social worker will give you information to help you find a home which meets your care requirements. The cost of the nursing care part of your fees is paid by the NHS to the home directly: the current amount is £108.70 per week. You can contact the Nurse Care Management Teams for your area at your local Primary Care Trusts (PCTs) listed on page 34. The figures mentioned above may change after April 2012, check with Adult and Community Services after this date. See page 26 for more information on paying for your care.

Specialist care (all ages) Support and care services for people with special needs offer a range of options aimed at maintaining their independence by living in their own homes and communities. Learning disability If you are considering moving out of your family home, there are a number of options that could be explored before considering a care home. You may be able to have your own flat with support. There is also the option of supported living, where you can share a property with other people with support provided for all. Support can include learning independent living skills like cooking, cleaning and money management as well as help with health needs. Either of these options can often give you greater independence and choice than care homes may be able to offer. There are other alternatives too such as Adult Placement or Shared Ownership schemes that could be considered and these can be set up through Adult and Community Services. An important change affecting people with learning disabilities is the introduction of Personal Budgets (explained on page 8), putting people at the centre of how they choose to pay for their support. This may be in their own flat or house, a supported living scheme or a care home or care home with nursing which specialises in this type of care. Many adults with learning disabilities can live in their own homes in their local communities with support but there may be times when an individual has specialist health care needs or behaviour that is particularly challenging when a care home may be more appropriate. Care homes for people with learning disabilities often specialise e.g. homes for people with autism and challenging behaviour or dementia. A good home will provide opportunities to learn and maintain skills and opportunities to take part in enjoyable and stimulating activities. Care managers, social workers and community nurses from Adult and Community Services, who specialise in learning disability, will be able to give you information to enable you to make the right choices. Physical disability Following an assessment of your needs, you may be eligible for help from Adult and Community Services, including a Personal Budget, occupational therapy, adaptations to your home, supported housing or help for the person caring for you. Day support services are available to assist and support people to take part in activities, meet with others and regain their confidence. Day services range from sheltered work to leisure activities, as

well as individual provision. A short break away from home can provide a welcome change for yourself and anyone caring for you. The respite care might also be provided in your own home (through a ʻlive‑inʼcarer). The support you require if you have a physical disability must be tailored to your specific needs and can be provided by the independent and not‑ for‑profit sectors as well as by Adult and Community Services. Dementia As it can be best for the person with dementia to stay in their own home for as long as possible, a range of community care services are available to facilitate this. Specialist care (all ages) continued registered providers to those who do not require financial help from Adult and Community Services, however Adult and Community Services will still be willing to offer an assessment of need. You may have a choice of which agency you receive your care from whether or not Adult and Community Services assist with the funding of your service. If you are considering a specialist care home, remember it should be able to maintain and improve your quality of life. Depending on the degree of the dementia, you should be able to live in a care home that offers quality personal care and person‑centred care. Itʼs important to consider homes that provide nursing care in case your condition deteriorates and you require a higher level of care. Many care homes offer specialist units

with experienced nursing staff and facilities adapted to the needs of residents with dementia. People with dementia can benefit from a range of group or individual therapies involving social interaction and mental stimulation, including reminiscence. Activity co‑ordinators and occupational therapists can provide people with dementia with reality orientation, reminiscence and validation therapy. Music therapy, art therapy approaches and other creative therapies can also be helpful. Behaviour management approaches that promote understanding of the behaviour of the person with dementia can also be beneficial and trained staff can offer this service within many care establishments.

Residents The best indication of a good home is that the residents appear happy and responsive. Are there rummage boxes around the home to stimulate residents?

Access If the person with dementia needs or is likely to need equipment or adaptations you may want to check: There is adequate signage and cues for different parts of the home such as dining room and bathroom. The homeʼs policy about locking external doors.

Bedrooms You may want to find out whether the person with dementia can have a single room and whether: Residents are encouraged to bring in some of their own furniture and possessions to increase familiarity.

Activities Residents should be stimulated without feeling stressed. Are reminiscence activities available? Are residents able to compile memory boxes? Do staff compile life story books including photographs and mementoes?

Staff It is important to note whether staff seem friendly and caring towards residents and whether they treat residents with respect. Do they have any training and experience in dementia care? Will the person with dementia have a member of staff particularly responsible for their care? Is there a member of staff you can talk to about your own worries about the person with dementia?

Manager/head of home A manager who is caring as well as efficient can make all the difference to a home. Does the manager have a knowledge of dementia and can they deal with difficulties that may arise in an understanding way? Is there a full assessment at home before a resident is admitted?

Specialist care (all ages) continued Mental health Your local Community Mental Health Team (CMHT) should be your first point of contact if you have mental health issues. You can ask your GP to refer you or ask someone who knows you to contact the CMHT on your behalf. There is increased demand for home care for people with mental health issues arising from greater use of supported living instead of care home placements. Like other specialist care services, this can be paid for (if you have been

assessed as eligible) with a Personal Budget, discussed on page 8. Alternatively, a good care home can help improve the quality of your life ‑ the structured environment and activities provided can build up your confidence. The care providers should assess you carefully to make sure the placement is right for you. A member of staff may visit you at home, talk to you and look at your assessments of health and social care need.

Paying for care Care funded by the Council Do I qualify for local authority financial assistance? If you have been assessed as needing a care home place and your capital is below £23,250 you should be entitled to financial support from your local authority. If you have capital below £14,250 you will be entitled to maximum support contributing your income less £22.30 retained for your personal expenses. If you have capital between £14,250 and £23,250 you will also pay a capital tariff of £1 per week for each £250 between these two figures. Capital includes the value of your former home unless itʼs occupied by your partner, a relative who is aged over 60 years or incapacitated, a child under 16 years who you maintain or a separated partner who is a lone parent.

What if a home costs more than the local authority is prepared to pay? The local authority will allow a third party to top‑up as long as they are able to do so over the long term. My partner needs care, how does this financially affect me? Your local authority will take into account 50% of any joint savings therefore, to accelerate financial help, it is better to have separate single accounts meeting care costs paid from the account of the person in the care home.

Do I have a choice of care home if the Council is paying? Yes and it can even be in a different county. The home you choose must be suitable for your assessed needs, comply with any terms and conditions set by your local authority and not cost any more than they would usually pay for someone with your needs.

Paying for your own care Self‑funding If you are self‑funding your care because you are not eligible for local authority funding there are other forms of financial assistance you may be entitled to:

Paying for your own care continued financial help will be charged against the value of your former home and recovered from the eventual sale proceeds. Do I have to sell my property? No, your local authority can lend you the money to pay for your care charged against your property value. However, they may limit how much they will pay and it could adversely effect your welfare benefit entitlements. Do I have to pay Council Tax on an empty property? If you move into a care home and your property is left empty then you should receive full exemption from Council Tax until itʼs sold.

What happens if I move into a care home independently and run out of money? Once your capital reduces to £23,250 you should seek local authority assistance. However, if the home costs more than the local authority usually pays and wonʼt reduce its fees you could be in the difficult situation of either finding a source of top‑ up or seeking less expensive accommodation. If there is a likelihood of running out of money itʼs important that you arrange an assessment of your care needs with the local social services department to ensure they will step into help. Also check if the care home owner can continue to accommodate you at social services funding rates or will require a third party top‑up.

Is there any financial help that is not means tested? Attendance Allowance is a non‑means tested, non‑ taxable allowance paid at the lower rate of £49.30 for those needing care by day or night and, at a higher rate of £73.60 for those needing care by day and night. Whether your stay is temporary or permanent if you receive nursing care in a care home you may be entitled to an NHS Registered Nursing Care Contribution (RNCC) towards the cost of your nursing care, paid directly to the home at £108.70 per week. If your needs are primarily health care needs, you may be entitled to full funding from your local PCT following an assessment under their continuing care eligibility criteria. This figure applies to England only. Wales, Northern Ireland and Scotland pay different amounts.

Third party payments If the home you choose costs more that the rate the Council usually pays for someone with your needs, you will have the choice to ask someone else to make an additional payment. If there is no‑one available to supply the extra payment, you can ask the Council to find you another placement at their normal rate. If, however, you do decide to live in the more expensive home and you have someone who is able to make an additional payment for you, they will have to pay the difference between the Councilʼs rate and the amount the home charges. This additional payment is often referred to as a ʻtop‑upʼ or ʻthird party top‑upʼ. The law says that you are not allowed to make this additional payment yourself, except in limited circumstances. Therefore, the additional payment has to be made by someone else, for example, a

family member or charity. Before anyone agrees to make additional payments on your behalf they should be aware that the amount could change, usually increase, once a year and they need to be confident that they can sustain the payments for as long as they are required. If the additional payments stop being paid for any reason, then you should seek help and advice via Adult Services Direct on 01274 435400. Once it has been established that someone is willing and able to make these payments they will be asked to sign an agreement to formalise the arrangement. Because the financing of care is a complex area it is advisable to contact the social worker who is arranging your placement with you or Adult Services Direct on 01274 435400 to ask for advice and individual guidance.

Important information Care home contracts for self‑funding residents If you are self‑funding your care and have a contract with your care provider, it is important to speak to solicitors with experience in this field. Any contract should explain: the cost of care, what services are included in the price and how often this is reviewed; what complaints procedure is in place; what your rights are and the obligations of the care provider under the contract; the procedure for cancelling a contract and the administering of medication.

According to an Office of Fair Trading evaluation of its 2005 market study into care homes for older people, there have been improvements in the provision of information to consumers. 94 per cent of care homes say they provide residents with a contract or statement of terms and conditions, compared to 82 per cent six years ago. How solicitors can help A solicitor can give you impartial advice about wills, making gifts, estate planning and Powers of Attorney. Some can also offer guidance on immediate and long‑term care plans, ensuring (if applicable) the NHS has made the correct contribution to your fees. Lasting Powers of Attorney (LPA) allow you to appoint someone you trust to make decisions about your personal welfare, including healthcare and consent to medical treatment, and/ or your property and financial affairs. An LPA is only valid once registered with the Office of the Public Guardian. It allows for a person of your choice to make decisions on your behalf at a time when you may be unable. The Court of Protection can issue Orders directing the management of a personʼs property and financial affairs if they are incapable of managing their own affairs should they not have a LPA. The Court procedure is presently very slow and the fees are quite expensive so preparing a LPA is always advisable, providing you have somebody sufficiently trustworthy to appoint as your attorney. An ʻadvance directiveʼ allows you to communicate your wishes in respect of future medical treatment but it is not legally binding. You may instead wish to make a living will, properly known as an ʻadvance decisionʼ setting out treatment that you do not want to receive in specified circumstances, which would legally have to be followed, even if you die as a result. Any proposed Gift out of your estate needs careful consideration of the benefits, risks and implications, particularly on any future liability for care costs or tax liability.

Long‑term care: whether you remain in your own home or move into sheltered accommodation or a care home, you may qualify for financial assistance in the form of social care and NHS‑funded care and welfare benefits. If you donʼt have your own solicitor, ask family or friends for their recommendations. Contact several firms, explain your situation and ask for an estimate of cost and an idea of time scales involved. Many firms will make home visits if necessary and will adapt their communications to meet your needs. Itʼs important to find a solicitor who specialises in this area of the law. Comments, compliments and complaints All organisations need to know how they are performing. They are happy to receive your feedback on their service whether they are compliments or complaints. Feel free to tell them what you think and your comments can be used constructively to improve the service. If you do need to make a complaint you should feel able to complain about any aspect of your care which affects your happiness or comfort. This could be about the way you are treated by a staff member or the quality of the food you are served. You can also make comments and suggestions about possible improvements to your surroundings and

the services provided. Providers are required under essential standards of quality and safety to have a simple and easy to use complaints procedure which they will be happy to give you. If you are concerned about the care that you, a friend or a relative is receiving, it makes sense to speak to the manager before you take any further action. The problem may be resolved quite easily once they are made aware of it. However, if you need to make a formal complaint, you should initially contact the registered owners of the service. They have a duty to respond to any complaints made.

Safeguarding vulnerable adults A vulnerable adult is: ʻsomeone over 18 years of age who might be unable to protect themselves from significant harm or serious exploitation because of a physical or mental disability, age or illnessʼ (No Secrets, Department of Health 2000). Abuse is the violation of an individualʼs human or civil rights by another person or people and it can take many different forms, such as: • physical abuse: being hit or restrained, misuse of medication • sexual abuse: being harassed, teased or being forced to have sex without consent • neglect: not getting adequate care, food, medication, heating • psychological abuse: bullying, threats, verbal abuse • discriminatory abuse: ridicule or threats because of race, gender, disability, age, sexual orientation • financial abuse: theft, fraud, exploitation, pressure
