Adult Care has developed a range of universal services that are available to all adults living in Derbyshire. Where do I start? Initial contact We have made it as easy as we can for you to contact Derbyshire County Council for information, advice and support. You can Call Derbyshire the contact centre from 8.00am ‒ 5.00pm on 08456 058 058 or 01629 533190 or out of hours in an emergency on 01629 532600. Our service is provided by sta who are specially trained to deal with Adult Care issues. This includes preventative services that oer advice, support and practical help to enable you to continue to live your life as independently as possible. Call Derbyshire sta can also refer you through to the Brokerage team and / or the Welfare BeneďŹ ts team.
Assessing your needs If required we will assess your needs, and if you meet the eligibility criteria we will work with you to help you develop a plan for your support which will describe how your needs will be met. Eligibility Eligibility for Adult Care Services is determined via local application of the Government s national Fair Access to Care Services Framework. You can get more information about the level of eligibility is in Derbyshire on our website at www.derbyshire.gov.uk If you are eligible you will also be given an indication of the budget available to spend on your support and you will be able to decide what services you wish to receive. This is what we call Self- Directed Support .
Self-Directed Support Self-Directed Support is a way of providing Adult Care services to vulnerable people living in Derbyshire who are eligible for Adult Care support. It involves carrying out an assessment and identifying a Personal Budget which is an upfront allocation of funding designed to help you take control over your life, and if you wish, to manage your own support arrangements. Your Personal Budget can be paid either directly to you or managed by the Council on your behalf to purchase the services and support you choose. There are few constraints on how you use your Personal Budget but it must be legal, keep you healthy, meet your support needs and enable you
to achieve your personal goals. There will be help available if you need it. Our experienced sta will be on hand to help you plan and manage your budget to get the care and support that is right for you. You can also involve your family, friends or an advocate. Co-funding of services Co-funding is the term that Derbyshire County Council uses to describe the partnership approach we adopt to the funding of services to help you to remain at home. The services covered by co-funding arrangements are: • Home care • Day opportunities • Frozen meals • Laundry

• Assistive Technology (Telecare) • Non- residential services provided via a Direct Payment. Most people will make a contribution towards the cost of the services they receive from Adult Care in Derbyshire. This amount will apply if you are receiving either Attendance Allowance or the care component of Disability Living Allowance. The most

Co-funding of services continued anyone will be asked to pay is £210 per week, but that contribution may only apply if an individual has savings of more than £50,000.00. There are a number of circumstances under which you may not be asked to make a contribution and you should read the leaflet Co-Funding Arrangements for Non-Residential
Services available on the Derbyshire County Council website. However, before you are asked to contribute towards the services you receive at home you will be offered a free welfare benefit check to ensure you are getting all the money you are entitled to.
Direct Payments A Direct Payment is money from Adult Care to provide for specific identified eligible needs. Direct Payments can t be used to pay for permanent residential accommodation - but you may be able to use them to pay for occasional short periods in residential accommodation, if we agree
that is what you need. More detail is available about Direct Payments in our factsheet Your Guide to Direct Payments available on the Derbyshire County Council website (www.derbyshire.gov.uk) or via Call Derbyshire (08456 058 058 or 01629 533190).
The Re-ablement Service Re-ablement is a period of short term, intensive, support that is designed to help you become as independent as possible. It is different to traditional home care in that one of our trained staff will work with you to help you learn, or re-learn, important tasks needed for everyday life. How can you get a re-ablement service? All new people assessed as needing personal and practical assistance and who are likely to benefit from reablement will be offered an initial short term package of support. The re-ablement service is also available to people already receiving a home care service but whose needs have changed, and their review identifies that re-ablement would be beneficial.
What happens when a re-ablement programme finishes? Following re-ablement many people return to full independence with no further need for ongoing services. Those people who do require ongoing support following re-ablement will receive help to identify what kind of assistance they need, and if requested help to arrange any services that may be required to meet their needs. How long will a re-ablement programme last? Re-ablement normally lasts for up to six weeks, but a programme may finish sooner if good progress is made or, if the individual, together with the reablement team, agree to stop it earlier. In exceptional circumstances, where benefits are identified, staff may extend a re-ablement programme by one or two weeks.

Service choice Your support plan could include some of the following services to help you stay independent.
Brokerage service The Adult Care Brokerage service ďŹ nds information about service providers and other resources. It has information about agencies that provide help with personal care and activities of daily living, and care home vacancies. Brokers match service providers with your choices and preferences. How to contact Brokerage If you would like some help in ďŹ nding providers and other resources, you can contact Brokerage by calling Call Derbyshire on 08456 058 058 or 01629 533190. You do not need to have an Adult Care Assessment to be able to contact Brokerage. If you have an Adult Care Assessment your social worker can refer to Brokerage on your behalf or you can contact the team directly yourself, on
01629 537754 or 01629 537768. What do brokers do? • Find service providers who can meet your outcomes and choices • Give information about service providers (for example cost of service, registration details and whether the provider can meet your speciďŹ c preferences) • Help you to arrange your services • Give information about dierent types of support available from the statutory, independent and voluntary sectors • Give information about a range of dierent services- day services: homecare: residential and nursing care homes: social activities: luncheon clubs and more.
Home care Home care services are in place to enable people who have support needs to continue living in their own environment by oering support with daily activities which promote independence and improve quality of life. The assistance oered is dependent on individual situations and could range from personal care to support with social activities. Derbyshire County Council Adult Care services can oer a re-ablement service free of charge where this is deemed to be appropriate to help you achieve your optimum level of independence. If longer term support is required you will be oered the choice of services available within your area which will be ďŹ nancially supported if you meet the eligibility criteria. You may choose to purchase your service from the range of home care agencies available including those provided by Derbyshire County Council or employ a personal assistant / private carer (family / friend) if this is your choice. All home care organisations that provide personal care must register with the Care Quality Commission (CQC) who assess to ensure essential standards of quality and safety are met which

includes sta training, involvement of people who use the service, safety and client satisfaction. Compliance assessments are available on the CQC website. Contained within this publication is a list of private and voluntary agencies which have a contract with the Council to provide home care and can also provide privately purchased care. (See page 12). Home care agency checklist

These questions may be useful when considering using the services of a home care (domiciliary) provider to help you build up a picture of how your support needs will be met in your own home. For support packages which have been arranged by Adult Care, contracts and support plans will have been completed with your social worker and the agencies used will have been accredited to work for Adult Care. People arranging and funding their own support either privately or through a Direct Payment or a Personal Budget are able to choose their own worker or care agency. Agencies • What experience does the agency have in your particular field of need? Can they supply references for you to check? • Home care agencies providing personal care, must be registered and inspected by the Care Quality Commission. Ask to see a copy of their registration certificate. • How long has the agency been operating? • How many carers would the agency assign to care for you and would you see the same one every day? If not, how does the staff rota operate and what happens if your carer goes on holiday or is sick, will you be notified in advance that a different carer will be attending? • How can you contact the agency in an emergency or outside office hours? • How hard or easy would it be to make a complaint and how are things then put right?
• If this is a private contract ask for a copy of the agency s contract terms and read these carefully with someone you trust. Get as much help as you can going over it and ask any questions you may have before signing anything. The Citizens Advice Bureau or Age Concern (now called Age UK in some areas) could help with this. Paid carers • You should expect your personal preferences, dignity and privacy to be respected. Discuss this with the agency and ask how the most suitable carers for your particular care are chosen. Can you talk to them before deciding? • Carers should be fully trained or be having ongoing training. Ask the agency about their policies on this. • You will have a care plan drawn up by the agency which the carers will work to. Ask how often this plan will be reviewed by the agency. • Carers must be checked with the Criminal Records Bureau (CRB) and have a criminal records disclosure ‒ make sure this is the case. Paying • If your care needs do not meet Adult Care s eligibility criteria and have been arranged privately you should check carefully the fee rates charged and exactly what the payment you make covers.

Support for carers A carer is someone who spends a signiďŹ cant amount of their life providing unpaid support to a family member or potentially a friend who is ill, frail, disabled or has mental health or substance misuse problems. We have a number of ways to support carers including oďŹ&#x20AC;ering an assessment to look at your needs and the services we can oďŹ&#x20AC;er to support your caring role. In addition the following are also available: The Carers Emergency card gives carers peace of
mind if they are suddenly not able to care, knowing that the emergency services will be able to alert someone via details on the card. Derbyshire Carers Association (DCA) is a leading organisation providing support for carers in Derbyshire. They run a number of support groups and have local coordinators who can provide one to one support. Details are available on their website at www.derbyshirecarers.co.uk.
NHS fully funded continuing health care NHS continuing health care is the name given to a package of services which are arranged and funded by the NHS for people outside hospital with ongoing heath needs. You can get continuing healthcare in any place, including your own home or in care home however your choice may need to
be made from a designated NHS care home list. An assessment will be made by a multi-disciplinary team involving health and Adult Care professionals. Further information is available on the Department of Health website at: www.dh.gov.uk/ SocialCare.
Intermediate Care (NHS) Intermediate care describes enhanced health care services provided by multi-disciplinary teams including the NHS. The aim is to oďŹ&#x20AC;er services to prevent you having to go into hospital unnecessarily, or if in hospital, to rehabilitate you so you can be discharged earlier. Another aim of intermediate care is to prevent early or
unnecessary admission into long-term residential care. You can be oďŹ&#x20AC;ered intermediate care in your own home or in other designated care settings. It is provided free if you are eligible for the service. Intermediate care is usually limited to a maximum of six weeks.
Short term and respite care in a care home This is a service for people who require assistance with personal care because of disability, frailty, mental ill health or who are recovering from a period of ill health or family diďŹ&#x192;culty. In addition, the service gives carers, who provide a substantial amount of support to a cared for person, the chance to take a break. Short term and respite care is available in a wide range of local authority, private and voluntary homes
across the County. A social worker or health worker will come to an agreement about whether you need a nursing home or residential care home. You will then be given freedom to choose the right home for you. There is a set charge for this type of care. If your stay exceeds three weeks or you wish to extend your stay for over three weeks while in your placement, you will normally need to have a ďŹ nancial assessment.
Telecare Telecare is the name given to a range of sensors, detectors and equipment that remotely monitor your daily life to help you remain living independently. Automatic alerts are created when you have a

problem. A suitable response makes sure that a minor problem does not become a crisis for you and your relative/carers.

Telecare continued Telecare can help if you are worried about: • Feeling safe at home. • The consequences of falling. • Becoming forgetful. The Telecare service provides peace of mind and is able to provide assistance, whenever required, 24 hours a day.

Residential Community Care Centres Community Care Centres have an essential role in the delivery of person-centred services for older people. Services within our centres help to maintain independence through rehabilitation and preventative services, but also substantially reduce the risk of admission or re-admission to acute hospitals and inappropriate use of residential care. Our centres are dementia-friendly and inclusive, with Stirling University a key partner in the building design. Older people, their carers and
local voluntary organisations have all contributed in developing the centre s service model which will provide centre-based residential and outreach services as part of the integrated network of support to the local area. Our first Community Care Centre in Staveley Centre opened in March 2010 and a second centre is opening in late Autumn 2012 in Swadlincote. Further centres are planned for other areas of the county in 2013-14.
Housing options Extra Care housing Extra Care housing gives you the security and privacy of a home of your own, but with 24 hour care and support services available if you need them. There are one and two bedroom flats available as well as a range of communal facilities on-site such as a restaurant, IT suite and an activity room. The schemes generally offer the choice of properties for rent, sale or shared ownership. Choosing Extra Care housing means that you are living in your own home and can usually remain there if your care or support needs change. The schemes aim to house people with differing needs so that the community is balanced. Residents being considered for the accommodation are assessed to determine what support they need. Unless someone requires long term nursing care, it could offer you a home for life. Extra Care housing is normally available to people aged 55 years or over, although it may house younger people with disabilities where appropriate. Extra Care differs from care homes in the following ways:
• You are living at home - not in a home. • Accommodation is accessible and provides level access showers. • You have your own front door so you can decide who comes in. • Couples and friends can stay together. • Residents have a mixture of support needs. • It offers a safe and secure home for people who need support, including people with learning disabilities. • 24 hour care and support services are available ‒ if needed. • You can join in social activities if you wish. Derbyshire Adult Care is currently working with housing associations and other partners to develop a range of Extra Care housing schemes throughout Derbyshire. Sheltered housing Sheltered housing is suitable for older people who wish to live independently but want the reassurance of knowing that assistance is available if there is an emergency. There are many diďŹ&#x20AC;erent types of sheltered schemes, available both to rent and to buy. Schemes usually consist of between 15 and 40 dwellings. These may be bedsitting rooms, selfcontained ďŹ&#x201A;ats, or bungalows. Some schemes are simply housing designed to meet the needs of older people and linked to a community alarm. The majority of schemes have access to a support worker for those who need it and a community alarm service. There are often communal facilities such as a lounge, laundry, guest ďŹ&#x201A;at and garden. Meals are not normally provided.
AďŹ&#x20AC;ordable sheltered housing for rent is provided by local district/borough councils or housing associations. People who are interested in being considered for accommodation of this kind need to register with their local district / borough council who have information about all the social housing vacancies in their area. Specialist care services Support and care services for people with special needs oďŹ&#x20AC;er a range of options aimed at maintaining
their independence by living in their own homes and communities.
Learning disability If you are considering moving out of your family home, there are a number of options that could be explored before considering a care home. You may be able to have your own ďŹ&#x201A;at with support. There is also the option of supported living, where you can share a property with other people with support provided for all. Support can include learning independent living skills like cooking, cleaning and money management as well as help with health needs. Either of these options can often give you greater independence and choice than care homes may be able to oďŹ&#x20AC;er. There are other alternatives too such as Shared Lives where you can live with others (usually a family) who will provide support and help you to become more independent. These can be arranged through Adult Social Care. An important change aďŹ&#x20AC;ecting people with learning disabilities is the introduction of Personal
Budgets (explained on page 8), putting people at the centre of how they choose to arrange and pay for their support. This may be in their own ďŹ&#x201A;at or house or a supported living scheme. Many adults with learning disabilities can live in their own homes in their local communities with support but there may be times when an individual has specialist health care needs or behaviour that is particularly challenging when a care home may be more appropriate. Care homes for people with learning disabilities often specialise e.g. homes for people with autism and behaviour support needs or dementia. A good home will provide opportunities to learn and maintain skills and opportunities to take part in enjoyable and stimulating activities. Social workers will be able to give you information to enable you to make the right choices.
Physical disability Following an assessment of your needs, you may be eligible for help from Adult Care, including a Personal Budget, occupational therapy, adaptations to your home, supported housing or help for

the person caring for you. Day opportunities are available to assist and support people to take part in activities, meet with others and regain their conďŹ dence. Day services range from sheltered work

Physical disability continued to leisure activities, as well as individual provision. A short break away from home can provide a welcome change for yourself and anyone caring for you. The respite care might also be provided in your own home (through a live-in carer). The support you require if you have a physical disability must be tailored to your specific needs
and can be provided by the independent and notfor-profit sectors as well as by Adult Care. Help at home with personal care is available during the day and night, 7 days a week. There are also private agencies offering help at home with personal care and housework. See page 10 for more information.
Mental health There is increased demand for home care for people with mental health issues arising from greater use of supported living instead of care home placements. Like other specialist care services, this can be paid for (if you have been assessed as eligible) with a Personal Budget, discussed on page 8. When care at home is no longer an option either temporarily or permanently, consideration of residential care needs to be made. Discuss
the options with family and friends as well as professionals involved in your care. A good care home can help improve the quality of your life - the structured environment and activities provided can build up your confidence. The care providers should assess you carefully to make sure the placement is right for you. A member of staff may visit you at home, talk to you and look at your assessments of health and social care need.
Dementia As it can be best for the person with dementia to stay in their own home for as long as possible, a range of community care services is available to facilitate this. Adult Care can provide access to: home care; sitting services (which provide a break for carers); advice on equipment and adaptations; day opportunities and respite care. Services can also be provided directly by registered providers to those who do not require financial help from Derbyshire County Council, however Adult Care will still be willing to offer an assessment of need. You may have a choice of which agency you receive your care from whether or not Adult Care assist with the funding of your service. If you are considering a specialist care home, remember it should be able to maintain and improve your quality of life. Whatever the degree of the dementia, you should be able to live in a care home that offers quality personal care and person-centred care. It s important to consider homes that provide nursing care in case your condition deteriorates and you require a higher level of care. Many care homes offer specialist units with experienced nursing staff and facilities adapted to the needs of residents with dementia. Some homes will offer an environment which has been designed specifically for people with dementia to aid orientation.
People with dementia can benefit from a range of group or individual therapies involving social interaction and mental stimulation, including reminiscence. Activity co-ordinators and occupational therapists can provide people with dementia with reality orientation, reminiscence and validation therapy. Music therapy, art therapy approaches and other creative therapies can also be helpful. Behaviour management approaches that promote understanding of the behaviour of the person with dementia can also be beneficial in reducing the use of anti-psychotic medication and trained staff can offer this service within many care establishments. Residents The best indication of a good home is that the residents appear happy and responsive. â&#x20AC;˘ Are there rummage boxes around the home to stimulate residents?
Access If the person with dementia needs or is likely to need equipment or adaptations you may want to check: â&#x20AC;˘ There is adequate signage and cues for diďŹ&#x20AC;erent parts of the home such as dining room and bathroom. â&#x20AC;˘ The home s policy about locking external doors.

Specialist housing options for younger adults Are you happy living at home? Would you like a little more independence with help when you need it? What are your housing options? You could: • Continue living with your family ‒ If your home is specially adapted and you receive the practical and emotional support needed, you may prefer to stay at home. It s also convenient if your college or job is nearby. • Move into supported living accommodation ‒ This offers a level of independence and the chance to meet other people in similar situations. Help from a visiting support worker is available and usually nursing care is provided nearby. • Rent a place ‒ You can apply for council housing which is usually cheaper than renting privately. There could be a waiting list and you must fully explain your housing needs. Local housing associations may also be able to help. Ask your council housing department for a list. If you want to rent privately, look in your local newspaper
for To Let advertisements. Housing Benefit, if you re entitled to it, might reduce your rent. Direct Payments can also help, ask your local authority for details and see page 8. • Buy your own home ‒ Can you afford it? Are you able to live on your own? You could think about part buying and part renting a place from a housing association. • Move into a care home ‒ If you want to leave home but are not ready to live alone, care homes can meet your personal needs and offer appropriate support. Adult Care and Health will contribute if you are eligible and if they agree the care home meets your needs. If your chosen home costs more than usual, you may get some help but you must pay the rest. Good quality end of life care How we care for the dying is an indicator of how we care for all sick and vulnerable people. It is a measure of society as a whole and it is a litmus test for health and social care services. 1 Although the subject of dying is often painful to contemplate and as a society we do not discuss death and dying openly, the way care professionals approach the process is incredibly important for the client, their family and carers. The Department of Health has published a strategy for every organisation involved in providing end of life care. Each will be expected to adopt an overall coordination process, such as the Gold Standards Framework, whilst developing the best possible outcome for clients.
Care homes are increasingly at the forefront of good practice in providing care for those who are approaching or reaching the end of their life. 2 Enabling residents to die in comfort and with dignity is a core function of care homes. When choosing a care home you should consider their end of life care philosophy and policies. It is essential
that you and your relatives discuss and plan for your wishes as you near the end of your life. Care homes should have an open approach to end of life care and should initiate conversation with you and your family to ensure your needs and wishes are discussed and planned for. An end of life care plan including a full assessment of your needs and wishes as you approach the end of life is vital to establish your preferences and choices. Many homes will include your end of life wishes as part of your care plan as this will help ensure your needs and wishes are effectively co-ordinated. Without proper assessment and care planning your needs may not be met and your end of life care preferences may not be achieved. Care homes should work with your General Practitioner to ensure your medical needs are met as you approach the end of your life. Good planning for all your needs should mean that you can (if that is your choice) remain in your care home in your last days and not have to be admitted to hospital. All health and social care staff must be trained in communication regarding end of life care and will be trained accordingly in assessing the needs of clients and carers. Continued on page 24 >>

Care homes You may feel that going into a care home is the way forward for you. The homes featured in this Directory are either owned by Derbyshire County Council, private sector proprietors, or voluntary sector organisations. All care homes are regulated by the Care Quality Commission (CQC) and are inspected to ensure they reach an approved standard. Care homes providing residential care A residential care home is a home of any size which provides residential accommodation with full board and personal care. Normally a resident would have their own bedroom which may or may not be ensuite and staff would be available on site on a 24
hour a day basis. A sheltered or warden assisted housing scheme would not be considered as a residential care home as the option of full board and personal care are not provided for an all-in charge. Some homes are able to provide specialist services to people with learning disabilities, dementia, mental ill health or for younger disabled people. Care homes providing nursing care The difference between a home providing residential care and a home providing nursing care is that a care home with nursing provides care where there is a need for involvement of a qualified nurse. Care homes with nursing have to be staffed 24 hours a day by trained nurses.

Essential information Inspection and registration of care services The Care Quality Commission (CQC) registers, inspects and reviews all adult social care and healthcare services in England in the public, private and voluntary sectors. This includes care homes, care homes with nursing, home care agencies and NHS services, amongst others. Changes to the regulatory system Since October 2010, all care providers must be registered under a new system, introduced by the Health and Social Care Act 2008, which will bring adult social care, independent healthcare and the NHS under a single set of essential standards of
quality and safety for the ďŹ rst time. Safeguarding adults Ensuring vulnerable adults who use services are protected from abuse and neglect is our top priority. All providers of services to vulnerable adults have a zero tolerance towards abuse and neglect. Derbyshire Adults at risk Policy and Procedures aims to ensure that help is provided to those where age, illness or disability aďŹ&#x20AC;ects their ability to protect themselves against serious harm or exploitation. Help is available for all adults at risk
of abuse including those who arrange and pay for their own care such as self-funders. The provider should be able to assist you with any safeguarding concerns you have regarding a user of services. Legal protection The Deprivation of Liberty Safeguards (DOLS) came into force in April 2009 as an amendment to the 2005 Mental Capacity Act. This new law came into force to safeguard the most vulnerable people who lack capacity to consent to the care or treatment they receive and who are being cared for in hospitals, care homes or nursing homes registered under the Care Standards Act 2000, whether placed under public or private arrangements, but who are not detained under the Mental Health Act. Under DOLS, there is a legal requirement for the Managing Authority (care home or hospital)

to apply to the Supervisory Body (local authority or Primary Care Trust) to have someone assessed where it is believed that it is in their best interests that they should be deprived of their liberty to prevent them from harm. Within Derbyshire the supervisory bodies are Derbyshire County Council and Derbyshire County Primary Care Trust . The Supervisory Body arranges assessments and either grants or declines the Managing Authority s request for authorisation to deprive the person of their liberty.

Legal protection continued Who does the legislation apply to? The MCA DOL safeguards apply to anyone: - aged 18 and over - who suffers from a mental disorder or disability of the mind ‒ such as dementia or a profound learning disability - who lacks the capacity to give informed consent to the arrangements made for their care and / or treatment and - for whom deprivation of liberty (within the meaning of Article 5 of the ECHR) is considered after an independent assessment to be necessary in their best interests to protect them from harm.
The safeguards are designed to ensure that a person s loss of liberty is lawful. There are three elements to the safeguards: • to provide the person with a representative • to allow a right of challenge to the Court of Protection against the unlawful deprivation of liberty • to provide a right for deprivation of liberty to be reviewed and monitored regularly. Comments, compliments and complaints All organisations need to know how they are performing. They are happy to receive your feedback on their service whether they are compliments or complaints. Feel free to tell them what you think and your comments can be used constructively to improve the service. If you do need to make a complaint you should feel able to complain about any aspect of your care that affects your happiness or comfort. This could be about the way you are treated by a staff member or the quality of the food you are served. You can also make comments and suggestions about possible improvements to your surroundings and the services provided. Making a complaint should not be difficult for you. Providers are required under national standards to have a simple and easy to use complaints procedure that they will be happy to give you. If you are concerned about the care that you, a friend or a relative is receiving, it makes sense to speak to the Manager before you take any further action. The problem may be resolved quite easily once they are made aware of it.
However, if you need to make a formal complaint, you should initially contact the registered owners of the service. They have a duty to respond to any complaints made. If your complaint is about a breach of regulations you can contact the Care Quality Commission. The Derbyshire Care Homes Association The purpose of the Derbyshire Care Homes Association (DCHA) is to represent the independent care sector and exchange ideas on how to improve the quality of life for people resident in care homes. We meet regularly with the local authorities, the Primary Care Trust and the Care Quality Commission to lobby and consult on behalf of our residents and care providers. At the DCHA we know from experience that a good care home can help transform people s lives, give them new friendships and opportunities, help them realise independence and provide personal care with dignity and understanding. We want to ensure that all those in care are provided with the highest standard of service at the best value for money. In recent years the media, which have very little understanding of social care, prefer to highlight poor practice and sometimes care homes are sucked into debates which are really about hospitals. However, to be in a care home is not like being in hospital. People are free to go out with
friends and relatives and will be encouraged and helped to continue with their interests and hobbies. Regular activities and outings are also organised. As well as having rights within the home, there is also a legal right to choose which care home you wish to live in. We want all those resident in care homes to feel happy and positive with the choice they have made. If you receive funding support from the local authority to pay for care home fees you may need a relative or friend to pay a top-up charge to the care home on top of what the local authority contributes. It is common for people moving into a care home to re-discover what life has to oďŹ&#x20AC;er, make new friends, learn new skills and to start enjoying life again. The help that a person receives in a care home will be planned to meet their speciďŹ c needs in such a way that privacy, dignity and independence are maintained at the highest level. The Derbyshire Home Care Association continued and with the elected cabinet member for Adult Services, we keep abreast of the County Council s thinking and planning and we have an active role in discussing and influencing the policies which affect the future of home care provision in Derbyshire. The Association has a committee of four officers elected from the membership who represent the DHCA at consultative meetings with the County Council. The main business of the Association takes place at meetings held every three months, which are open to all members. From time to time, guest speakers are invited to present topics of interest. These include areas such as Training Provision, Quality Standards, CQC, Changes in Registration, Inspection and Legislation.
The home care sector is undergoing massive changes and the DHCA is still active in working in partnership with the County Council in assisting in the implementation and development of these key changes to the provision of personal and social care. Because of the importance of the role that the DHCA plays, we feel that it is important that all agencies share our voice and are keen to encourage membership from all home care agencies in Derbyshire. Paying for care Self-funding advice If you have capital or savings of more than £23,250 you will have to pay for any long term residential care services you require but you are still entitled to an assessment of your needs by the Adult Care Department. If you have assets of less than £14,250, your contribution will be assessed only on your income and the local authority meets the shortfall subject to local funding limits (see chart on page 34). If you have savings between £14,250 and £23,250, a sliding scale operates whereby you must pay £1 per week for each £250 you have between these amounts in addition to making a contribution from your income. Assuming you will be moving into care, you may be entitled to some of the following financial assistance and support, subject to an assessment of need. Twelve-week property disregard If your former home is included in your financial assessment but your other capital is less than £23,250, and your income is not enough to meet your care home fees, the Council will help with the cost during the first twelve weeks of permanent care provided they agree that care is needed. Deferred Payment Agreements After the twelve-week property disregard period, any financial help from the Council will be charged against the value of your home and recovered once your house has been sold or from your estate. However, the Council may limit how much they will pay and it may affect your entitlement to Pension Credit or Income Support if your property is not seen to be on the market and becomes treated as capital by the Department of Work and Pensions (DWP). Attendance Allowance and Disability Living Allowance These benefits are non-means tested, nontaxable benefits from the DWP paid at the lower rate of £51.85 per week for those needing care by day or night, and at a higher rate of £77.45 for those needing care both during the day and night. Everyone who needs care can, and should, claim these benefits but they will only remain in payment if you are funding your own care. If the Council is making a contribution towards your care then Attendance Allowance may stop being paid whilst you are waiting to sell your property. Continued on page 32 >>

Self-funding advice continued NHS Nursing Care Contribution Whether you are a temporary or permanent resident, if you live in a care home that provides nursing care you may be entitled to a non-means-tested NHS Nursing Care Contribution (currently ÂŁ108.70 per week for the standard rate) towards the cost of your nursing care. This is paid directly to the home. NHS Continuing Care Funding You can receive continuing healthcare services in any setting, including your own home or in a designated care home. The NHS will pay if you need healthcare from a community nurse or a therapist as well as personal care to help you at home like having a bath or dressing. If you live in a care home with nursing (traditionally called a nursing home ), you may qualify for the full cost of your care home fees, including board and accommodation, under the National Framework for NHS Continuing Healthcare. If you live in a care home providing only personal care and need help from a registered nurse, this will be free, covered by the NHS again.
Running out of money If your capital is likely to reduce to ÂŁ23,250 through payment of care home fees, you must let the Council know well in advance as they may step in to help with your care fees. They must conduct an assessment of your situation and will make a contribution - described on page 6. If the home you have chosen charges more than Derbyshire s fee levels, as shown in the table on page 34, you must ďŹ nd someone to help pay the diďŹ&#x20AC;erence â&#x20AC;&#x2019; a top-up payment. Whoever does this, whether family or a benevolent charity, they should realise that they may have to pay this for the duration of your time in care and the cost could rise. Alternatively, you would have to ďŹ nd a cheaper home or room. Understanding your rights before moving into care is essential. There are a number of ďŹ nancial products and specialist companies who may be able to help. It is important to seek advice before committing yourself.
What will you have to pay for your care? Do you have capital or savings in excess of ÂŁ23,250?
No... Your local authority will share the costs with you.
The value of your home is included when assessing capital unless: â&#x20AC;˘ Your partner or â&#x20AC;˘ A relative who is over 60 or incapacitated or â&#x20AC;˘ A child under 16 who you or a former partner maintain still lives there.
How much? To work out how much they will pay, you must arrange a Community Care assessment. This will deďŹ ne your care needs and how they will be best met and also assess your ďŹ nancial situation. Whichever homes you consider must be able to meet your needs. Your choice of care home will be limited to those that accept your local authority s funding level. More expensive homes will expect you to arrange a third party to top-up the diďŹ&#x20AC;erence. You are not allowed to do this yourself if your capital is below ÂŁ23,250. If your capital is less than ÂŁ14,250, and the home you choose charges fees that are within your local authority s funding rate, your contribution will be assessed only on your income.
Yes... Arrange for a Community Care assessment with your local authority to deďŹ ne your care needs. Whichever homes you consider must be able to meet your assessed care needs. If, apart from your property, your savings are less than ÂŁ23,250, your local authority can help with your care costs for the ďŹ rst twelve weeks. After this time, any money from them will be regarded as a loan and will need to be repaid once your house is sold.

Remember: • If your partner still lives at home, they will not be means-tested. If you have a private pension, only half will be considered when you are assessed if you are passing this on to your partner. Local authority contribution towards care in private sector care homes We appreciate that the current financial climate in the care sector is challenging. It is recognised that considerable pressure exists for both those who purchase and those who provide care home placements. Where we can assist with funding support for an individual, the fee rates payable to care homes throughout the County are listed on page 34. Complex or variable needs are assessed individually and can attract additional funding. Fees charged by some homes may be higher than the maximum rates that we can pay for reasons other than complex or variable needs. Please see the section on Third Party Payments on page 34. Where individuals are meeting their full fees without funding from the local authority, the level of fee they will pay will be subject to the agreement they reach with the care provider. People who are
liable to pay the full cost of their care are also entitled to a Social Care assessment of their care needs. It is important to appreciate that care homes not owned or managed by the council are run as private business and as such they are able to decide how much they want to charge for accommodation and care. Funding arrangements can be complex so potential residents are advised to seek advice from Derbyshire County Council. See page 35 for contact details. Whilst we can offer help in negotiating a fee on your behalf, the care home can decide to change their charges from time to time, such as if you decide to move rooms or when you sell your house and become a self ‒funding resident. If you are concerned about any potential future changes in the amount you may have to pay you should discuss this with your social worker at the earliest opportunity.

Quality Premium payments Derbyshire Adult Care currently operates a local scheme to reinforce quality standards in care homes and home care agencies. Each organisation has been given the opportunity to apply to become a Quality Premium Provider and those who have qualiďŹ ed have demonstrated that they have met standards in staďŹ&#x20AC; training and competence, for which an additional payment is then made by the Council. People choosing a home are advised to ask if the
home is a Quality Premium provider. Third party payments If the home you choose costs more that the rate we can pay for someone with your needs, you will have the choice to ask someone else to make an additional payment. This means that they will have to pay the diďŹ&#x20AC;erence between the Council s rate and the amount the home charges. This additional payment is often referred to as a top-up or third party top-up . The law says that you are not allowed to make this additional payment yourself, except in limited circumstances, such as when you have a Deferred Payment Agreement (explained on page 31). Therefore, the additional payment normally has to be made by someone else, for example, a family member or charity.

Before anyone agrees to make additional payments on your behalf they should be aware that the amount could increase and they need to be conďŹ dent that they can sustain the payments for as long as they are required. If the additional payments stop being paid, for any reason, then you should seek help and advice from the local authority. Once it has been established that someone is willing and able to make these payments they will be asked to sign an agreement to formalise the arrangement. Springbank House Care Home is situated near the centre of the beautiful market town of Chesterfield, most famous for its crooked spire. It is within walking distance of the town centre, bus station, shops and many other attractions. Springbank House provides 24 hour care for people requiring both residential and nursing care. Burton Closes Hall is situated on the southern boundary of Bakewell, close to some of DerbyshireĘźs finest open countryside.This elegant mansion was designed by Joseph Paxton and the interior can be attributed to Augustus Pugin, famed for the interior of the Houses of Parliament. The house still retains its decorated ceilings, oak screen work and a beautiful minstrelĘźs gallery. In the grounds we also have the tallest Ash tree in the Peak District National Park. At Burton Closes Hall we have 3 distinct units; Nursing, Residential incorporating Residential Dementia, and Young Physically Disabled Unit. Each unit has its own qualified and dedicated team of staff. Many rooms have superb views, all have en-suite facilities, TV and nurse call system. The Manor
The Manor Care Home consists of two purpose built homes Barnfield Manor and Holmewood Manor standing side by side on one site and sharing the same grounds.
