Welcome from North Yorkshire County Council Welcome to the second edition of North Yorkshire’s Care Services Directory. This 2013/14 edition will provide you with information on the care and support choices available across the County. North Yorkshire County Council are pleased to be working with the Independent Care Group on this Care Services Directory. We know that making decisions about social care can be daunting for you, particularly if you have had no involvement with social care before. This Directory provides clear, easy to understand guidance so that you can be confident you are making the right decisions for yourself or your loved ones. Through our services, we provide social care to vulnerable adults, those with physical and / or learning disabilities and older people. Everyone at North Yorkshire County Council is committed to providing trusted, high-quality, and personalised social care support to the adults who have been assessed as needing this support. We are passionate about making a real difference to the well-being of everyone who needs social care support. In our experience, most people want to remain independent for as long as they can. We will give you the ability to choose to stay in your own home if that is what you wish to do and maintain your independence for as long as possible. We will work closely with you and your family / carer, as we recognise the value of their input into what support will make a difference to you. This way of working is supported by the national strategy of Self-Directed Support and is sometimes called ‘personalisation’. One of the aims of Self-Directed Support is to give people responsibility for their own personal budget. This is a sum of money which is allocated following an assessment, and which you can use to buy your own care from the person or provider of your choice. This gives you a real opportunity to decide for yourself the kind of support that will best meet your needs. We explain more about SelfDirected Support on page 10. We work closely with the Care Quality Commission’s (CQC) inspectors and care providers to make sure we maintain high-quality standards in the care provided to people in North Yorkshire. New

regulations for registered residential, nursing and domiciliary services focus very much on improving the outcomes for adults who need support. They have a particular impact on how we involve people and communicate with them and on how we deliver personalised care and treatment as well as safety and safeguarding. We are all aware of the financial pressures that face local authorities such as ours. However, it remains our highest priority to make sure that the most vulnerable members of our communities continue to receive high-quality and appropriate care. Whatever your circumstances, whether you can pay for your own care or not, you can contact North Yorkshire County Council for advice and support. Sub Independent heading The Care Group (ICG) Welcome to this Care Services Directory. We hope you find it useful. The ICG takes great pride in supporting and representing a whole host of care providers who strive to offer the best possible quality of care to older and vulnerable people. In this region around 80% of social care is provided through the independent sector and those providers work hard to ensure that care is of the highest standard. These are private and voluntary providers who offer both care at home and residential and nursing care services. They work, in many cases, around the clock, all year round to help people retain their independence, dignity and happiness. It is a challenging environment and the ICG works closely with providers to give as much support as we can. We work with a wide variety of public bodies

including North Yorkshire County Council, City of York Council, the NHS (North Yorkshire PCT moving to Clinical Commissioning Groups from April 2013) and the regulator, the Care Quality Commission. We pass on the views and concerns of providers and the requirements of commissioners in a two-way process. Introduction The articles in this Care Services Directory have been compiled by the Health & Adult Services directorate of North Yorkshire County Council. We used to be known as ‘social services’. When the words ‘we’ and ‘us’ are used in the Directory it means Health & Adult Services. Lots of people will pick up this Care Services Directory looking for advice and information about adult social care. The Directory aims to give an overview of all aspects of adult social care to

everyone who is looking for support. Thinking about the care or support either yourself or a loved one will need is daunting and making any change in your life will require major decisions. We try and provide the basic information and guidance you will need about adult social care in this Directory, and give you the details of other organisations that can help. In the first instance you can always call North Yorkshire County Council’s Customer Service Centre for advice on 0845 8 72 73 74.

How to use this Care Services Directory There is a lot of information in this Directory, and, depending on your circumstances, some parts will be of interest to you and some parts won’t. We have tried to think about the groups of people who will use this Directory and have set out below the parts we think will be of most interest. We start this Care Services Directory with a section called ‘You’re in charge’. You are the person who is in the best position to know what you or the person you care for needs. We start from this position and ensure that you are in charge right from the beginning of your contact with adult social care. We then move on to a lengthy section called ‘What care is available?’ which is aimed at people who want to stay at home but may need a little or a lot of support in order to do so. This is followed by a short section on looking for a care home for people who cannot, or do not want to stay at home. The subject of paying for care is usually unwelcome, and we acknowledge this, but it is an area that is not very well understood and therefore we have provided a section to guide you through what can be a complex aspect of care. Finally, we have provided sections on essential information and useful contacts for anyone who has any involvement with adult social care. Here you can find the details of many organisations that can help you. Further assistance in your search for care Finding appropriate care or support for an older person can seem difficult and daunting. This publication has been designed to help you to identify relevant care providers in your preferred region and to give you a starting point in your search. This Directory’s free advice line run in association with the charity FirstStop Advice provides a comprehensive advice and information service encompassing care, accommodation, funding and rights. A personalised report can be generated for

customers providing details of all care homes or housing with care schemes that meet their criteria with supplementary information about choosing and funding. One call to the freephone number 0800 38 92 077 will enable the service to build a profile of exactly what type of care you’re looking for while taking into account your personal needs and interests. This service is completely free so let the advice line take some of the strain and help you to find the appropriate care and support for you.

Fair Access to Care Services (FACS) Before we move on to talk about the way adult social care works, it is important to describe how we decide who will be eligible to receive social care support from us. The Government provides criteria to help councils decide who is eligible for support. This is to ensure that councils reach decisions in a fair, consistent and open way about who is in most need of our help and to use the available budget to support them. This helps to make sure that adults across North Yorkshire are treated fairly. These criteria are called ‘fair access to care services’ and look at four main areas: • any risk to health and safety for yourself or others; • your ability to control and make choices about your life; • y our ability to manage your personal care and domestic routines; and • your involvement in your family and wider community including leisure, social activities, work, volunteering and education.

If you are eligible for social care support, we will discuss with you whether you will need to pay towards some, or all of the cost of the support. This will depend on your income and any savings you may have. If you are not eligible If your level of need means you are not eligible for support from us, we will offer free advice and information instead and put you in touch with other organisations and services in your community that may be able to help you. Many people find that seeking advice from us is helpful in finding their own solutions because it provides an opportunity to discuss their situation with a social care professional. If your needs change If your needs change, then you can always ask us for a reassessment. Simply speak to your social care worker or contact our Customer Service Centre on 0845 8 72 73 74.

For each of these areas your level of need will be identified as either: • ‘critical’; • ‘substantial’; or • ‘moderate’. We will identify your level of need at your assessment. At the time of going to press (April 2013) in North Yorkshire, people with needs in the ‘critical’, ‘substantial’ and ‘moderate’ bands will be offered a range of support by Health and Adult Services. You’re in charge We have started this Directory with a section called ‘You’re in charge’ because this philosophy guides all our social care guidance, information and support. Whatever your level of involvement with us we

want you to be assured that your needs and wishes will be paramount throughout the process. The following section describes ‘Your Support, Your Way’ which is the system we use to put you in charge.

Personalised care and support North Yorkshire County Council and other local authorities have made changes to the provision of care and support to older people and people with learning and/or physical disabilities. This is a national requirement that sets out the way people and those who care for them should be supported. In the traditional system of social care, professionals made many of the decisions about the support people could have and who would provide it. As a result, people often had limited

choice about the services they might receive. A system called Self-Directed Support seeks to replace this old approach of prescribed care, by putting people in control of the support they need to live the life they choose. It recognises that some people can manage their support on their own whilst others need help – from family or friends or people who are paid to help. In North Yorkshire we call this new process ‘Your Support, Your Way’.

Self-Directed Support – ‘Your Support, Your Way’ ‘Your Support, Your Way’ aims to improve the way we work in Health & Adult Services, to provide better services for people who need social care and improve how we work with organisations that provide support. It gives us an opportunity to think more innovatively about how social care services are delivered without increasing the costs. How does it work? ‘Your Support, Your Way’ is for adults who are eligible for social care (see page 13). It allows people to have more choice and control over their life because it lets them make decisions about the support that they need. It asks how they want to live their life, what they want to achieve in life

and what support they need to do this. Support to carers can also be given to help them continue to carry out their caring role and to maintain a life outside caring. If you or the person you care for are eligible for social care support, Self-Directed Support gives you a Personal Budget based on an assessment of your eligible social care needs. You may need support or help to manage day-to-day activities and everyday tasks such as washing and dressing, help with eating and drinking or getting out into the community. You can then choose what social care and support services this money is spent on. You can be as creative as you want, as long as the money is spent to meet your needs.

Personal Budgets We have now introduced Personal Budgets across the whole of North Yorkshire for all eligible users of social care services. They bring flexibility and transparency of funding to the provision of social care services. A Personal Budget is an amount of money that is allocated according to your needs, to be spent on services of your choice. At the time of going

to press (April 2013) in North Yorkshire, you can choose to receive parts of your Personal Budget, or your entire Personal Budget, in various ways: • a Direct Payment (DP) – North Yorkshire County Council pays you an amount of money. The money can then be spent on solutions and services of your choice to meet your eligible social care needs, and you are in control of this money;

Personal Budgets continued • an Indirect Payment (IP) – this is made available if a person is not able to consent to a Direct Payment, but where a Direct Payment is deemed to be in their best interest. It can be paid to a person who is ‘suitable’ on the person’s behalf. There are rules and guidance to help the council decide who is a ‘suitable person’;

• individual service funds – your Personal Budget, or some of it, can be lodged with a service provider for you to draw from to get support as and when you need it; or • managed Personal Budget – North Yorkshire County Council arranges and pays for your support.

Direct Payments Direct Payments are financial payments made to people who have been assessed as eligible to receive support from North Yorkshire County Council. We can make a Direct Payment to most people who need our support, including: • people who have been assessed as needing community care services (including those with Mental Health needs) aged 16 and over, incorporating short as well as longer term needs; • carers over 16 for carer’s services; and • parents of disabled children, for children’s services. Instead of us arranging or providing services directly, you could use these payments, either by yourself or with assistance, to purchase support that you consider most appropriate to meet your assessed social care needs. Also, if you are looking after someone else as a carer, you could also receive Direct Payments to help you in your caring role or to have some time for yourself. You can choose to have some of your budget as a Direct Payment and we would manage the rest of your budget. Why would I want Direct Payments? Direct Payments allow more control over the decisions that affect your life. They provide more flexibility and choice, as you can buy appropriate support tailored to your individual needs.

What can Direct Payments be used for? If you receive a Direct Payment, the money is used to arrange support to meet eligible needs. You may choose to employ someone directly, to buy services from an independent or voluntary sector provider or purchase equipment to help you live more independently. With Direct Payments, people or agencies employed are accountable to you and not to North Yorkshire County Council. Therefore, Direct Payments enable more control, choice and flexibility over how you plan your support to fit with your life. It is important that your plans meet your assessed needs. Therefore, provided the money is used lawfully, and eligible needs are met, the flexibility that these payments allow means it is impracticable to outline what the money can be spent on. However, there are certain items on which these payments cannot be spent, for instance: • on services that should be provided by Health; and • on routine living expenditures: utility and household bills for instance. Most Direct Payments are made to meet regular ongoing support needs, however they can also be made as a single payment, for example, to purchase equipment or a short respite break. What do I do next? If you are interested in Direct Payments and are currently receiving social care support from North Yorkshire County Council, please contact your local social care team for more information. If you don’t already have services provided by us there is a lot of support available to advise and assist you with Direct Payments. What care is available? This section is about the guidance, support and care that we can provide. It describes all parts of the social care process, from someone who might be leaving hospital, worried about how they are going to cope at home, to advice about specialist care for someone who might have very complex needs

but wants to stay at home. Some of these sections may not be relevant to you, others may be of more interest. Feel free to go straight to the section that interests you, or browse through the whole section to give yourself a full flavour of the support available.

Leaving hospital Health & Adult Services and the NHS in North Yorkshire work very closely together to ensure that hospital patients are discharged safely and are able to return to home life as quickly as possible. Our social care staff are available to help with information and advice when you are ready to leave hospital. No matter what hospital you are in, you can request an assessment of your needs to help you stay independent and confident when you return home. A social care worker will come and speak to you to arrange an assessment which can either be done whilst you are still in hospital, or once you return home, or in interim/temporary facilities if you are not able to return home immediately on discharge from hospital. The assessment involves asking you about your needs and what is required to help you live safely

and independently at home. There will also be an explanation of any charges that may be made. A relative, carer, or a member of the hospital staff may also approach the hospital social care team and ask them to carry out an assessment, but this will not go ahead unless you agree. If you already have a social care service in place we will make an assessment of any other needs you may have after your stay in hospital. If you have a carer they can also be offered an assessment and may also need advice and support. A social care worker can be made available to discuss any issues with them and also give them details of carers’ support groups. We can also introduce you to local voluntary organisations who can help, with a variety of services such as laundry and domestic cleaning, or sitting services.

Short term reablement team (START) A service to help you become more independent START is a method of short term support in your own home that is designed to help you become as independent as possible. It does not replace any needs you may have for medical treatment and may not be suitable for everyone. Perhaps you require support to gain or regain your ability to independently manage your personal care or to prepare a meal – the START service will encourage and enable you as much as possible. A START worker will work with you so that you can learn (or re-learn) important tasks needed for everyday life. They will assist and encourage rather than do things for you. Many people who receive support with START find that afterwards they can cope very well on

their own, without the need for social care support. If they do need ongoing support, they may find that they need less help.

Short term reablement team (START) continued How does an individual get START? START may be discussed with you when you first have contact with us. This may be if you are living at home but finding that you are no longer managing as well as you did, or you might access START if you are returning home from treatment in hospital. The START programme will not normally last longer than 6 weeks, and can be significantly less; even days. Progress will be reviewed every week by members of START along with yourself. How do I find out what skills are needed that will help me? A member of the START team will talk through what you would like to achieve and how the START service can support this by working with you to complete a START assessment. Your goals are then agreed and ways in which the service can support these goals are identified with you. This information will be written down in the form of an Intervention Plan which START workers follow. How will START work for me? The START Intervention Plan is tailored to meet your assessed needs and to meet the outcomes that have been agreed with you. As you make progress your visits or duration of visits may reduce over the period and this will be reflected in the Intervention Plan.

Will I need any special equipment? START workers may suggest to you that you carry out some tasks in a slightly different way to make them easier for you to do on your own and if assistive technology is identified as a potential aid to independence, this will be explored. You may have to purchase small pieces of equipment to make certain tasks easier. START workers will be able to show you a catalogue of equipment available and will also provide you or your carer with information about where to find specialist shops in the area. We may also provide some equipment but this would be fully discussed with you. We encourage everyone to take up the use of Telecare and Lifelines (see page 14 for more information on Telecare and Lifelines). What happens when START is finished? Once you have reached your optimum independence and if you require ongoing support, the service becomes chargeable and a financial assessment will be conducted. You will be advised of the date that the charges will commence. A social care worker will discuss with you how to meet any ongoing needs, and the budget that will be available to support and manage this as we will be encouraging you to use Personal Budgets (see pages 10 and 11 for more information on Personal Budgets and Direct Payments).

Assessment If you have been through a period of START and require ongoing support, we will work with you to assess your needs. Even if you haven’t been through the START process we can provide you with an assessment. We aim to direct help to people with the highest level of need and risk. In assessing your needs, we consider carefully the factors that affect your independence and wellbeing. In discussion with you and your carers, we jointly agree the likely effect on your independence or how likely it is that your home life will break down or become unsafe if you don’t have appropriate social care support, within specified timescales. Increasingly assessments are completed through a supported assessment process with you leading the process, as you are the best judge of your needs and how they would be best met. Your carer, or a

member of your family or a friend can also take part in the assessment as well as your social care worker. When the assessment has been completed an eligibility decision will be made based on the level of risk to your independence or of your care or living arrangements breaking down or becoming unsafe if appropriate support were not provided. No local authority ever has enough resources to meet all potential social care needs. As the demand for social care increases, so it becomes more important to allocate resources according to priority needs. We do this by setting ‘eligibility criteria’ to decide who has the greatest immediate or longer term needs. All local authorities use the same eligibility framework issued by the Department of Health called ‘Fair Access to Care Services’ or FACS. You can find further information about our eligibility criteria on page 9 of this Directory.

Assessment continued To find out if we can provide social care services to you, you will need to have an assessment. You can start this process by contacting the Customer Service Centre for social care enquiries. Their telephone number is 0845 8 72 73 74. You can contact the Customer Service Centre for all social care services enquiries for adults, young people and children. A more comprehensive or specialist assessment may then follow, depending on the nature of your particular needs and circumstances. Will there be a charge for services provided? There may be a charge for services; the amount will depend upon your capital and income. However, we will always give you full information before services are provided. Carers are not charged for services they receive directly and disabled people are not charged for equipment or minor adaptations to their property. We provide a full description about charging for services starting on page 38 of this Care Services Directory.

Staying at home Given the choice, many people prefer to stay in their own homes surrounded by their possessions and near to their family and friends. This, of course, applies to anyone whether they are elderly and frail, convalescing, have a physical or learning disability, or are suffering from dementia. â&#x20AC;&#x2DC;Your Support, Your Wayâ&#x20AC;&#x2122; (explained on page 10) can help you manage

independently at home with a little, or a lot of help. If you are not eligible for social care support you might wish to pay for some help so that you can stay at home. The following section gives you some information about the types of support available should you wish to stay at home.

Telecare Telecare uses a range of simple sensors matched to your personal needs which can help you to continue to live as independently and safely as possible. These are usually linked to a lifeline (a kind of telephone). Telecare can help you and your family in a number of ways, all of which are designed to support your health and wellbeing. One example is a bed sensor. This can be used in a range of situations, i.e. for people at risk of falling, or to alert a carer to assist. It detects a change in pressure, so if you have got up but are unable to get back to bed, perhaps after a fall, the sensor

can raise an alert. However, if you get up at night and usually sit in a chair for a while or have a drink, then the system can delay the alert. If you have not returned after a period of time agreed with you, i.e. half an hour, it can then raise an alert. This avoids the risk of someone falling and being left on the floor all night, cold and in pain. Following an assessment of your needs, telecare could be part of a support plan to assist with things you might find difficult. It can support you or the person you care for by alerting you to certain situations, such as incontinence, or where

Telecare continued a vulnerable person leaves the property at an inappropriate time, for example, the early hours of the morning. One lady said ‘I don’t feel alone when I am alone. The telecare can let someone know if I have a problem’;

If a problem is detected then the system sends a signal via the lifeline to a call centre where an alarm can be raised 24 hours a day. The call centre uses trained operators, who can speak to you over a speaker on the lifeline, will have your details and know who to call in an emergency. This could be family, friends, carers or the emergency services. Alternatively, you could choose to have calls made directly to your chosen emergency contact. The Telecare alert process 1. You press the lifeline button or the sensor raises an alert.

2. The lifeline unit is activated and alerts the call centre via the telephone line.

3. T he call centre answers your call and talks to you through the lifeline.

4. A response is arranged appropriate to your agreed needs.

• t elecare can provide early warning of a sink or bath overflowing; • t elecare can raise a call to a monitoring centre who can keep a phone line open to you in an emergency; • t elecare can give people space and time on their own, instead of being checked up on just in case something has happened. One lady said ‘I love my family but I just want to have some time to myself’.

There is a small weekly charge for using telecare, depending on your circumstances. However, you may be able to apply for a subsidy to help with this. Your circumstances will be established by our adult social care staff through a financial assessment. Other equipment available We and our partners help people to manage everyday living more safely and independently. Occupational therapists and other specially trained staff can give you advice, assess your needs, and those of your carer or the person you care for. Some tasks at home can be difficult if you have problems moving around. Fortunately, there is help available. There are many types of equipment that can help you to live independently at home. It may be as simple as fitting a grab rail in the right place to help you get up and down steps safely and easily, or you may need equipment to help you with daily living tasks, such as getting in/out of bed, on/off the toilet or turning taps.

Depending on your individual circumstances, our occupational therapy service can loan or recommend equipment that enables you to more easily manage daily living activities such as bathing, washing, dressing and getting around your home. You can contact our customer service centre and request an assessment which will be completed by trained staff or from an occupational therapist. Alternatively you could find your own qualified occupational therapist (explained below). Older people in particular are often persuaded to buy costly equipment. It is important to get the right advice before you do this so that your money is well spent.

Adapting your home If you have a permanent disability and need an adaptation to your home to help you stay independent, you may qualify for a grant from your borough or district council (called a Disabled Facilities Grant). The grants are made according to need. You can qualify whether you are a homeowner or rent privately. However, even if eligible,

you may have to pay a contribution towards the cost as a financial assessment is completed. Our occupational therapy service will be able to provide you with more information. For more information about occupational therapy please see the section below.

Occupational therapy Occupational therapists can help you lead a more productive, active and independent life using a variety of methods, including the use of adaptive equipment. They can assess your home for hazards and point out things that contribute to falls. The reason you need occupational therapy can determine how you access the service. Shortterm conditions, for example, if you need support following an operation, will mean you will access services through the NHS. Speak to one of the healthcare professionals treating you. They will discuss your needs with you and decide if you would benefit from occupational therapy and

can arrange an assessment with an occupational therapist as part of your care. For long-term conditions, such as a permanent physical disability, occupational therapy is usually accessed through your local council. You should contact us via the Customer Service Centre on 0845 8 72 73 74 to arrange an assessment with an occupational therapist, or you can be referred for an assessment by: • your GP or consultant (specialist doctor); • a nurse; • another healthcare professional; or • a social care professional.

Occupational therapy continued If you do not want to access occupational therapy through the NHS or North Yorkshire County Council, you could contact an occupational therapist directly. If you decide to see a private occupational therapist, make sure they are fully qualified and are a member of a recognised body, such as the British Association of Occupational Therapists. Only healthcare professionals who are registered with the Health Professions Council are allowed

to use the title of ‘occupational therapist’. You can check that your occupational therapist is registered by checking the Health Professions Council online register at: www.hpcheck.org. An occupational therapist can carry out a health and social assessment to identify what areas of your everyday life are causing problems. They will discuss your needs with you and explain what help is available. An assessment and any advice or information they give you should be free.

Health occupational therapy The health occupational therapy service covers stays in hospital and returning home. It provides a specialist therapeutic service, including assessment, treatment and ensuring a safe discharge back home after hospital admission. If you are not already in contact with us, please

contact the Customer Service Centre on 0845 8 72 73 74. They will take the relevant details from you and arrange for an assessment if it is necessary. A care manager or occupational therapist will then come out and talk to you further about the issues you are facing.

Getting help in your home Help in your home is also known as ‘domiciliary care’ and is usually arranged in a manner dependent upon needs: Low level domiciliary care – This may be to assist with household chores such as shopping, cleaning and assistance with food preparation. Calls from carers can be flexible and assistance can be given for as little as 15 minutes or when you need it. Medium level domiciliary care – In addition to low level care this will normally involve personal care (assistance with washing, dressing etc), and/or one carer to assist with mobility. You may wish to have a carer sleep in your home overnight for security and reassurance. High level care – This usually consists of visits by two or more carers who assist clients with high dependency needs such as being transferred from a bed to a chair etc. Carers may require specific training depending on your health needs. Live-in care – A carer lives in your home, is allowed time off each day and must have a night’s sleep. Live-in care can be arranged as a

short respite for your main carer or a permanent arrangement to suit your needs. 24 hour care – This is required when you need assistance or monitoring through the day and night and differs from live-in care in that carers work on an roster to ensure that a carer is on duty and awake both day and night. Day care – Day care offers people another solution to their care needs. It can provide older people and others with a range of activities, social and leisure time helping them to continue to live in their own home or with their family or carer or indeed as a occasional addition to a care home placement. All service providers must be registered by the Care Quality Commission (CQC) who publish reports on providers, following an inspection. It is important to be assured that all carers have Criminal Records Disclosures, have received necessary training, are properly referenced, and are eligible to work in the UK prior to them visiting your home. Agencies • What experience does the agency have in your particular field of need? Can they supply references for you to check? • How long has the agency been operating? • How many carers would the agency assign to care for you and would you see the same one every day? If not, how does the staff rota operate and what happens if your carer goes on holiday or is sick? Will you be notified in advance that a different carer will be attending?

• How can you contact the agency in an emergency or outside office hours? • How hard or easy would it be to make a complaint and how are things then put right? • Home care agencies providing personal care, must be registered and inspected by the Care Quality Commission. Ask to see a copy of their registration certificate. • If this is a private contract ask for a copy of the agency’s contract terms and read these carefully with someone you trust. Get as much help as you can going over it and ask any questions you may have before signing anything. The Citizens Advice Bureau or Age UK (sometimes called Age Concern in some areas) can help with this.

Carers • You should expect your personal preferences, dignity and privacy to be respected. Discuss this with the agency and ask how the most suitable carers for your particular care are chosen. Can you talk to them before deciding?

• Carers should be fully trained or be in ongoing training. Ask the agency about their policies on this. • You will have a care plan drawn up by the agency which the carers will work to. Ask how often this plan will be reviewed by the agency. • Carers must be checked with the Criminal Records Bureau (CRB) and have a criminal records disclosure – make sure this is the case.

Paying • If your care needs do not meet Health & Adult Services’ eligibility criteria and have been arranged privately you should check carefully the fee rates charged and exactly what the payment you make covers.

Support for carers Adult carers are people aged 18 or over who offer substantial help on a regular basis for a relative, neighbour or friend who has problems relating to ageing, illness, disability or substance misuse; and are not employed to provide such care. We can provide advice and support for adult carers, both for the person cared for and direct to the carer. Trained staff in our Customer Services Centre will help carers decide what they may require and who to contact. They can put carers in touch with specialist social care staff. These specialists can visit the carer, or the person who is being cared for, to look at what extra help may be needed. We can also support carers directly. This might include: • a carer assessment, this can help us to ensure that carers get the support they need; • access to the North Yorkshire Carers’ Forum, ensuring carers’ views are heard; • a direct carer’s support grant; • advice for looking after carers’ own health; • help for carers who may need support to continue working and caring from our supported employment service which can also provide support with accessing training and employment; and • the carer’s emergency card which will identify a person as a carer if they have an accident or are unable to identify themself, so that the person being cared for will receive support in an emergency. Carers’ Centres in North Yorkshire Carers’ Centres and Carers’ Resources are organisations whose purpose is to give practical and emotional support to carers locally. Some of the services offered include: • confidential information, advice, emotional support and representation; • a carers assessment on behalf of North Yorkshire County Council; • benefits advice; • regular information by way of circulars, bulletins or newsletters; • referrals to other specialist support organisations; • information sessions, courses and other related activities;

• advice on employment; and • young carers’ services for young people who care for a relative, offering one-to-one support, clubs and new opportunities (provided by Action for Children in Scarborough, Whitby and Ryedale). Support for carers continued Respite care and short breaks for carers You may have a carer living with you, or perhaps living nearby who helps you on a regular basis. Caring for someone can be a huge undertaking and carers sometimes need a break. This may be provided in a number of ways. You may wish to go into a care home for a week or two or a specialist short term break facility. You could have homebased respite care, where another carer moves into your home to care for you, or you could have family-based respite care where you move into another family’s home for a period. We can also refer carers to carers ‘sitting services’. These are short breaks for carers where the cared for person is supported in their own home or out doing something they enjoy, allowing the carer to go out or just take a rest for a couple of hours. These services can be accessed following a carers’ assessment and are designed to be on the day and time that is most suitable for the carer and cared for person. The best option will depend on your needs, the urgency of the situation and personal choice and cost. If you are thinking about long term care but have no experience of a care home, you could book in for a short stay to see what it is like. This will give you some experience of residential care to make

an informed decision. If you have nursing needs, ask for a nursing determination as a contribution to your fees – see ‘Care homes with nursing’ on page 35 for more information. We offer respite care to those people meeting our eligibility criteria. To access this, the carer and the person being cared for will need to have an assessment. The assessment will take the needs of the carer into account as well as the wishes of the person being cared for. It is still worth having a carer assessment even if the carer thinks that they would not benefit from a respite service. The assessment could result in the carer or the person being cared for receiving different types of support. The amount of respite available will depend on the individual assessment, but it is important to note that resources are limited. In an assessment of the carer we try to establish: • the impact that the caring role has on the carer as an individual; • the impact that the caring role has on their health; • the carer’s ability to see friends and have a life of their own; and • the carer’s need to maintain employment or training.

Meals-on-wheels service North Yorkshire County Council no longer has a direct involvement in arranging, delivering or subsidising meal-on-wheels services. However we have identified a number of organisations across the county who, typically operating as social enterprises, can provide meals to people in their own homes. The organisations include WRVS in various areas of the county, Age UK in Craven and the Sherburn Visiting Service in Sherburn and district. You will be able to discuss directly with providers

the service you wish to receive in terms of the type of meal and the number of meals per week. Payment is agreed directly with the meal providers.

Housing with care Extra care housing Extra care housing offers a way of supporting you to live independently for as long as possible. It provides the security and privacy of a home of your own, a range of facilities on the premises, combined with access to 24-hour care/support services if required. Extra care housing is sometimes called ‘very sheltered housing’ or ‘assisted living’. The look of the accommodation varies enormously: some are new purpose built schemes or retirement villages, others are modernised sheltered housing schemes with extra services on site. Many offer a choice of accommodation such as flats or bungalows, for sale or rent. What all residents of extra care housing have in common is the security of owning or renting their own home, control over their finances and the peace of mind that goes with having access to 24-hour care/support available on site. Sheltered housing Sheltered, retirement or warden-assisted housing are all terms used to describe accommodation provided specifically for older people. Schemes usually have

the services of a warden, support worker or scheme manager, though increasingly this person lives off site, or the service is provided as ‘floating support’, with regular visits from a member of staff. Each property has an alarm system so that residents can summon help in an emergency. You can get information about sheltered housing in your area from your local council housing department (see ‘Local useful contacts’ section on page 47). Private Retirement/Sheltered Housing Most leasehold sheltered/retirement housing is purchased at full price on the open market. However, some organisations operate arrangements for people to purchase their housing. Typically these are: Shared ownership A small number of housing associations offer the option of buying a proportion of the value of a property and paying rent on the balance. The proportion you can pay may vary. A service charge may have to be paid in addition to the

Housing with care continued rent. The rent element may be eligible for Housing Benefit. Sometimes, people can purchase a higher proportion and then not have to pay any rent. All schemes are different but basically when you leave, the apartment would be sold on the open market (subject to the purchaser being an older person with a need to live at the scheme). Some housing associations do offer a buy back option, but not all. Leasehold Schemes for the Elderly (LSE) These are run by a small number of housing associations and usually require you to buy 70% of the equity, the remaining portion being owned by the housing association. When you sell, you receive 70% of the current market value of the property. Lifetime lease This product offers an arrangement where you buy the right to live in a retirement property for the rest of your life (or lives in the case of a couple). The price is well below the normal purchase price but once you leave the property it reverts back to the company. Lifetime leases are available to people aged 60 and over. Lifetime leases may also be available for non-retirement properties. Interest-only mortgage Interest-only mortgages are when you borrow a lump sum against the value of property and pay the interest only on monthly basis. When the home is sold, the original lump sum is repaid; interest may be variable or fixed. There are reputable financial organisations that can help you with this type of product. When considering using this type of organisation, you should ensure the company is regulated by the Financial Services Authority (FSA). See useful contact section for financial organisations who can offer advice on these and other financial products.

Housing options for younger adults with additional needs Are you happy living at home? Would you like a little more independence with help when you need it? What are your housing options? You could: • Continue living with your family – If your home is specially adapted and you receive the practical and emotional support needed, you may prefer to stay at home. It’s also convenient if your college or job is nearby. • Move into supported living accommodation – This offers a level of independence and the chance to meet other people in similar situations. Help from a visiting care assistant is available and usually nursing care is provided nearby. Further information is on page 32. • Rent a place – You can apply for council housing which is usually cheaper than renting privately. There could be a waiting list and you must fully explain your housing needs. Local housing associations may also be able to help. Ask your council housing department for a list. If you want to rent privately, look in your local newspaper for ‘To Let’ advertisements. Housing Benefit, if you’re entitled to it, might reduce your rent. Direct Payments can also help, ask your local authority for details and see page 11. • Buy your own home – Can you afford it? Are you able to live on your own? You could think about ‘part buying’ and ‘part renting’ a place from a housing association. • Move into a care home – If you want to leave home but are not ready to live alone, care homes can meet your personal needs and offer appropriate support. We can contribute if you are eligible and if we agree that the chosen care home meets your needs. If your chosen home costs more than usual, you may get some help but you must pay the rest.

Close care housing Close care is a term used to describe various models of older people’s housing where there is sheltered/ retirement accommodation linked to, or on the same site, as a care home. For information on close care housing you can contact your local council housing department or the Elderly Accommodation Counsel (EAC), now part of FirstStop Advice. Specialist care Support and care services for adults of all ages with special needs offer a range of options aimed at maintaining independence by living in your own home and community. Learning disability If you are a young adult considering moving out of your family home, there are a number of options that you could explore. You may be able to have your own flat with support. There is also the option of supported living, where you can share a property with other people with support provided for all. This can include learning independent living skills like cooking, cleaning and money management as well as help with health needs. Either of these options can often give you greater independence and choice than care homes may be able to offer. There are other alternatives too such as Adult Placement or Shared Ownership schemes that could be considered and we can help to set these up with you. An important change affecting people with learning disabilities is the introduction of Personal Budgets (explained on page 10), putting you at the centre of how you choose to pay for your support. This may be in your own flat or house, a supported living scheme or a care home or care home with nursing which specialises in this type of care. Many adults with learning disabilities can live in their own homes in their local communities with support but there may be times when someone has specialist health care needs or behaviour that is particularly challenging and a care home may be more appropriate. Care homes for people with learning disabilities often specialise e.g. homes for people with autism and challenging behaviour or dementia. A good

home will provide opportunities to learn and maintain skills and opportunities to take part in enjoyable and stimulating activities. Our care managers, social care workers and NHS community nurses who specialise in learning disability will be able to give you information to enable you to make the right choices. Physical disability Following an assessment of your needs, you may be eligible for help from us, including a Personal Budget, occupational therapy, adaptations to your home, supported housing or help for the person caring for you. Day support services are available to assist and support people to take part in activities, meet with others and regain their confidence. Day services range from sheltered work to leisure activities, as well as individual provision. A short break away from home can provide a welcome change for yourself and anyone caring for you. The respite care might also be provided in your own home (through a â&#x20AC;&#x2DC;live-inâ&#x20AC;&#x2122; carer). The support you require if you have a physical disability must be tailored to your specific needs and can be provided by the independent and notfor-profit sectors as well as by us. Help at home with personal care is available during the day and night, seven days a week. There are also private agencies offering help at home with personal care and housework. Specialist care continued organisations throughout the county to provide specialist mental health services to support people affected by mental health problems. Mental health problems can affect anyone at any time and one in four people will experience some form of mental illness during their lifetime. There are many different types of mental health issues, from mild problems to more severe and enduring problems. Some examples include: abuse and neglect; addictions; Alzheimerâ&#x20AC;&#x2122;s disease; anxiety; dementia; depression; eating disorders; grief and loss; stress and trauma. Your local Community Mental Health Team (CMHT) should be your first point of contact if you have mental health issues. You can ask your GP to refer you or ask someone who knows you to contact the CMHT on your behalf. Contact details for the CMHT are provided on page 47 of this Directory. There is increased demand for home care for people with mental health issues arising from greater use of supported living instead of care home placements. Like other specialist care services, this can be paid for (if you have been assessed as eligible) with a Personal Budget, discussed on page 10. Alternatively, a good care home can help improve the quality of your life - the structured environment and activities provided can build up your confidence. The care providers should assess you carefully to make sure the placement is right for you. A member of staff may visit you at home, talk to you and look at your assessments of health and social care need. Depending on the degree of the dementia, you should be able to live in a care home that offers quality personal care and person-centred care. Itâ&#x20AC;&#x2122;s important to consider homes that provide nursing care in case your condition deteriorates and you require a higher level of care. Many care homes offer specialist units with experienced nursing staff and facilities adapted to the needs of residents with dementia. People with dementia can benefit from a range of group or individual therapies involving social interaction and mental stimulation, including reminiscence. Activity co-ordinators and occupational therapists can provide people with dementia with reality orientation, reminiscence and validation therapy. Music therapy, art therapy approaches and other creative therapies can also be helpful. Behaviour management approaches that promote understanding of the behaviour of the person with dementia can also be beneficial and trained staff can offer this service within many care establishments. Dementia As it can be best for a person with dementia to stay in their own home for as long as possible, a range of community care services are available to facilitate this. Help can be provided to access home care; meals in the home; sitting services (which provide a break for carers); advice on equipment and adaptations; day care centres and respite care. These services can be provided directly by registered providers to those who are not eligible for financial help from us, however we will still be willing to offer an assessment of need. Care homes Care homes and care homes with nursing There are two types of residential care home: Care homes (personal care only) If you are reasonably active, but would like greater security and care, subject to a needs assessment, a care home offering only personal care may be the best option. Personal care includes bathing, feeding, dressing and help with moving but you must pay for it if your capital/savings exceed £23,250. This figure may change after April 2013, check with us after this date. See page 38 for more information on paying for your care.

Care homes with nursing If you think you may need nursing care in a home, you will need to be visited by a social worker or a care manager to work out what care you will need. This visit might be in your own home, or in hospital if you’ve been ill, or in a home. You will be fully involved in planning your care needs. If a care home providing nursing care is the best solution for you, your social care worker will give you information to help you find a home which meets your care requirements. The cost of the nursing care part of your fees is paid by the NHS to

Out of county care Did you know you can choose a care home outside your home county? You may want to be closer to friends, family members or you may want to relocate to another part of the country. If you qualify for funding of a care home place, your home county local authority is still responsible for your care fees, even if you choose a care home in another region. The home you choose must be suitable for your assessed needs and comply with

the terms and conditions set by the authority. The fees that your local authority will pay may vary. They may offer you the fees you would receive if you remained within the county, or they may offer you the fees that the local authority would pay in your chosen region. You must seek further advice before making your decision. If you’re paying for your own care, obviously you have freedom of choice.

Things to look for in care homes specialising in dementia. Please use in conjunction with the care homes checklist on page 37. Residents

Staff

The best indication of a good home is that the residents appear happy and responsive.

It is important to note whether staff seem friendly and caring towards residents and whether they treat residents with respect.

 Are there rummage boxes around the home to stimulate residents? Access If the person with dementia needs or is likely to need equipment or adaptations you may want to check:

 Do they have any training and experience in dementia care?  Will the person with dementia have a member of staff particularly responsible for their care?  Is there a member of staff you can talk to about your own worries about the person with dementia?

 There is adequate signage and cues for different parts of the home such as dining room and bathroom.

Manager/head of home

 The home’s policy about locking external doors.

A manager who is caring as well as efficient can make all the difference to a home.

Bedrooms

 Does the manager have a knowledge of dementia and can they deal with difficulties that may arise in an understanding way?

You may want to find out whether the person with dementia can have a single room and whether:

 Is there a full assessment at home before a resident is admitted?

 Residents are encouraged to bring in some of their own furniture and possessions to increase familiarity. Activities Residents should be stimulated without feeling stressed.  Are reminiscence activities available?  Are residents able to compile memory boxes?  Do staff compile life story books including photographs and mementoes?

Paying for care Paying for care is a difficult issue for many people. This section will give you some information so that you can feel more confident when you are thinking about the care options that are right for you or the person you care for. The section is split into two parts. The first part is about ‘non-residential’ care

and support. This means all the different sorts of care and support except for paying to live in a care home or a care home with nursing. The second part of this section is about ‘residential’ care and support and refers to paying for living in a care home or a care home with nursing.

Paying for non-residential care and support In most cases, and if you are eligible, we will provide you with a short period of intense care and support in your own home first and this initial service will be free of charge. This is the START service which is discussed in more detail on page 12 of this Directory. During this period of time we will also consider providing you with specialist equipment, for example, a Lifeline service, if you do not already have one and this will be free of charge initially. We have been able to provide this short period of intense care and support as a free service since April 2012 as we are working more closely with our Health Service colleagues to help people to recover more quickly, for example after a period in hospital or after suffering a serious illness. This revised service offers far greater support towards health needs in addition to our social care services supporting independence and it is without charge to reflect the community’s entitlement to free healthcare. How do we work out how much we will contribute? To work out how much you will need to contribute to the cost of your care we will carry out a financial assessment which entails a specialist benefits and assessments officer visiting you at your home, or another agreed location. You can arrange for someone to be with you when the assessment is completed if you want to. The officer will ask you to give details of your financial circumstances including details of your income, outgoings and capital. Examples of these are given below. Income This could be your: • state retirement pension; • private pensions; • disability and some other benefits; or • interest from investments It does not include any earned income such as wages. Outgoings This is money that you spend regularly, for example, your rent, mortgage, council tax and utility bills. When we carry out your financial assessment the benefits and assessments officer will need to see evidence of your outgoings. Capital The capital we look at is the money that you have.

This could be: • in the bank; • in the building society; • shares; or • investments It does not include the value of your home. Our benefits and assessments officer will then use these details to work out your assessable income, and the amount of money that you may have to pay for services. The assessable income is the amount you have left after taking away your outgoings and any disability related costs. We will only take account of 90 per cent of that amount as being available to pay towards services. Does everyone have to pay for their services? As a general guide, you will not have to pay anything for your care or housing support costs if you have an income that is less than the appropriate level of income set by central government each year, plus an additional 25 per cent. What if I have savings? If you have savings below £14,250, they are not taken into account when working out your charge for services. If you have savings over £14,250, these will be taken into account when working out your charge for services. These figures may change in April every year. What else do you look at when working out my charges? Disability related costs When the financial assessment is completed, we will also talk to you about any additional expenses that you may have as a direct result of your illness or disability. We will ask you to provide evidence of the additional expenses, for example receipts. These expenses will then be taken into account when we work out how much you have available to pay towards your services. How much will I pay? Everyone will be asked to pay for some of the services we provide. Meals taken at a day centre or luncheon club will be charged at £2.90 for a set meal (£2.20 >>

Paying for non-residential care and support continued >> for the main course and 70p for the dessert). Transport to and from a day centre will cost £2.20 per day. The personal laundry service, where available, will cost £4 per load. The amount you pay for other support services will be calculated from your financial assessment. The assessment will take account of the actual cost for providing the service. You will be asked to pay the full cost of providing the service if: • your capital is over £23,250; • you decide not to tell us about your financial circumstances; or • you refuse to sign the financial assessment form. If your capital is less than £23,250 we will look at: • your assessable income; • the level of service you receive; • any capital that you have over £14,250; and • any disability related costs.

If you are a couple we will assess you jointly, using both you and your partner’s income and savings, and as an individual, using only your income and savings. We will look at the results for both of these assessments. The amount you will be asked to pay for your services will be based on the assessment that suits your household the best. If you have any questions about this or disagree with the amount we ask you to pay, please ask the benefits and assessments officer who completes the financial assessment. Contact details can be found on page 49 of this Directory. Whatever your circumstances, we will not ask you to pay more than the cost of actually providing the services. We will tell you how much your service charge is when we arrange it for you, based on the type of services being received. What happens if my financial circumstances or care needs change? Paying for non-residential care and support continued you pay. If there is a change to your charges, our benefits, assessments and charging team will tell you. If your financial circumstances change and you don’t tell us, we may backdate your charges to the date of that change. A change in financial circumstances could mean a sudden increase in capital, sale of a property or a welfare benefits award that you have not told us about. In the case of Supporting People services (housing related support services) your landlord or service provider will tell you. What if I don’t receive services for a while? You will only pay for services you receive. If you do not receive any services for a while, for example, if you are in hospital, then you do not pay. What if I cannot afford to pay? If you think that you cannot afford to pay, please contact your social care assessor/coordinator straight away. They will talk with you to come up with a solution that works for everyone. How do I pay for my care? We will send you an invoice every four weeks for the services you receive. Charges are usually six weeks behind. This is because we need to wait for information from your provider regarding the services you have received and then work out your charge. We

will print the dates of the care you are being charged for on your invoice. Supporting People services If you receive long-term housing related support services under Supporting People, we will only carry out a financial assessment if you do not receive housing benefit, council tax benefit or pension credit (guarantee credit). If you receive housing benefit on your rent you will not have to pay for your services. If you get Supporting People services, you will have agreed to pay a fixed weekly charge when you moved in or signed up to the service. If the financial assessment says that you must pay part or all of this charge, you will have to pay it from the time you started getting the service. If your financial circumstances or housing support needs change, please contact your social care worker so that we can reassess how much you pay. If there is a change to your charge, your landlord or service provider will tell you. If you don’t receive services for a period of time you will normally continue to pay until you give up your tenancy, or end the service. If you think that you cannot afford to pay, please contact your service provider or your social care worker if you have one, straightaway.

Paying for residential care and support Will I qualify for assistance with funding my care? Do you have capital or savings in excess of £23,250? The value of your home is included when assessing capital unless: • Your partner or • A relative who is over 60 or incapacitated or • A child under 16 who you or a former partner maintain still lives there. Yes... Arrange for an assessment with us to define your care needs. If, apart from your property, your savings are less than £23,250, we can help with your care costs for the first twelve weeks. After this time, any money from us will be regarded as a loan and will need to be repaid once your house is sold. No... Health & Adult Services will share the costs with you.

How much? To work out how much we will pay and how much you will pay, a meeting will be arranged following your initial assessment with a benefits and assessments officer. The benefits and assessments officer will review your care needs as laid out in your initial assessment and will assess your financial situation. With capital between £14,250 and £23,250 you will be expected to contribute £1 per week for every £250 you have above £14,250 in addition to your income. Whatever your circumstances... Remember: • If your partner still lives at home, they will not be means-tested. If you have a private pension, only half will be considered when you are assessed if you are passing this on to your partner. Remember to claim: • Income support (if you are under pension age). • Pension Credit (if you are over pension age). • Savings Credit (if you are over 65). • A ttendance Allowance (if you are over 65), worth either £53.00 or £79.15 per week depending on your care needs. • Disability Living Allowance (if you are under 65).

Moving into a nursing home? • You may be eligible for the NHS Nursing Care Contribution – currently £108.70 per week. Always seek advice: • Independent help is available to guide you through your financial options. There may be a number of solutions to retaining your capital whilst paying for care. Self-funding advice If you have capital or savings of more than £23,250 you will have to pay for any residential care services you require but you are still entitled to an assessment of your needs by Health & Adult Services. If you have assets of less than £14,250, your contribution will be assessed only on your income and we meet the shortfall, subject to local funding limits. If you have savings between £14,250 and £23,250, a sliding scale operates whereby you must pay £1 per week for each £250 you have between these amounts in addition to making a contribution from your income. Assuming you will be moving into care, you may be entitled to some of the following financial assistance and support, subject to an assessment of need. Twelve-week property disregard If your former home is included in your financial assessment but your other capital is less than £23,250, and your income is not enough to meet your care home fees, we will help with the cost during the first twelve weeks of permanent care provided we agree that care is needed. Deferred Payment Agreements After the twelve-week property disregard period, any financial help from us will be charged against the value of your home and recovered once your house has been sold or from your estate. However, we may limit how much we will pay and it may affect your entitlement to Pension Credit or Income Support if your property is not seen to be on the market and becomes treated as capital by the Department of Work and Pensions (DWP).

Attendance Allowance and Disability Living Allowance These benefits are non-means tested, non-taxable benefits from the DWP paid at the lower rate of £53.00 per week for those needing care by day or night, and at the higher rate of £79.15 per week for those needing care both during the day and night. Everyone who needs care can, and should, claim these benefits but they will only remain in payment if you are funding your own care. If we are making a contribution towards your care then Attendance Allowance will stop being paid. Disability Living Allowance (DLA) is the equivalent benefit for people under 65. If you are entitled to DLA Mobility payments for help with getting around, these payments do not stop once you are in a care home and are not included in your financial assessment. NHS Nursing Care Contribution Whether you are a temporary or permanent resident, if you live in a care home that provides nursing care you may be entitled to a non-means-tested NHS Nursing Care Contribution (currently £108.70 per week for the standard rate) towards the cost of your nursing care. This is paid directly to the home. NHS Continuing Care Funding You can receive continuing healthcare services in any setting, including your own home or in a care home. The NHS will pay if you need healthcare from a community nurse or a therapist as well as personal care to help you at home for example having a bath or dressing. If you live in a care home with nursing (traditionally called a ‘nursing home’), you may qualify for the full cost of your care home fees, including board and

Self-funding advice continued accommodation, under the National Framework for NHS Continuing Healthcare. If you live in a care home providing only personal care and need help from a registered nurse, this will be free, covered by the NHS again. Running out of money If your capital is likely to reduce to £23,250 through payment of care home fees, you must let us know well

in advance as we may step in to help with your care fees. We must conduct an assessment of your situation and will make a contribution. Understanding your rights before moving into care is essential. There are a number of financial products and specialist companies who may be able to help. It is important to seek advice before committing yourself. There are details of some organisations that can help you with financial matters on page 50 of this Directory.

Local authority contribution towards care in private sector care homes We appreciate that the current financial climate in the care sector is challenging. We recognise that considerable pressure exists for both those who purchase and those who provide care home placements. Complex or variable needs are assessed individually and can attract additional funding. Fees charged by some homes may be higher than the maximum rates that we can pay for reasons other than complex or variable needs. Please see the section

on Third Party Payments below. If you are meeting your full fees without funding from us, the level of fee you will pay will be subject to the agreement you reach with the care provider. People who are liable to pay the full cost of their care are also entitled to a social care assessment of their care needs. Funding arrangements can be complex so potential residents are advised to seek advice in the first instance from our Customer Service Centre on 0845 8 72 73 74.

Third Party Payments If the home you choose costs more that the rate we can pay for someone with your needs, you will have the choice to ask someone else to make an additional payment. This means that they will have to pay the difference between the Health & Adult Services’ rate and the amount the home charges. This additional payment is often referred to as a ‘topup’ or ‘third party top-up’. The law says that you, or your spouse, are not allowed to make this additional payment yourself, except in limited circumstances, such as when you have a Deferred Payment Agreement (explained on page 42). Therefore, the additional payment

normally has to be made by someone else, for example, a family member or charity. Before anyone agrees to make additional payments on your behalf they should be aware that the amount could increase and they need to be confident that they can sustain the payments for as long as they are required. If the additional payments stop being paid, for any reason, then you should seek help and advice from us via our Customer Service Centre on 0845 8 72 73 74. Once it has been established that someone is willing and able to make these payments they will be asked to sign an agreement to formalise the arrangement.

Essential information Disclosure and Barring Service In December 2012, the Criminal Records Bureau (CRB) and the Independent Safeguarding Authority (ISA) merged into the Disclosure and Barring Service (DBS). CRB checks are now called DBS checks. This new organisation will provide a joined up,

Safeguarding vulnerable adults Safeguarding and protecting vulnerable adults from abuse or neglect has traditionally been seen as a major role of those working in the social care sector. Now, more than ever given recent cases that have made national news, it is becoming an issue for everyone in society, not just for those people who have a professional responsibility to safeguard. Far too many vulnerable adults suffer abuse, neglect and worse, often at the hands of relatives and carers, those who you would least expect to treat them in that way. A vulnerable adult is a person over the age of 18 who needs some support to stay independent and live in a safe environment and who may be unable to take care of themselves, or protect themselves from harm or from being exploited.

This includes adults who: Are more vulnerable than others because they are old and frail, or have a sensory impairment, a disability, a mental health problem, or have some form of illness. This means they may have difficulty in making their wishes and feelings known and this may make them vulnerable to abuse. It may also mean that they are not able to make their own decisions or choices. A person may also be vulnerable because of a temporary illness or difficulty.

What should you do if you suspect abuse or are worried about abuse? Doing nothing is not an option. North Yorkshire County Council operates a zero tolerance of all forms of abuse. All adults should be able to live their lives free from fear and harm. Your course of action will depend on the situation. If you or the person you are concerned about is in danger and immediate action is required you should ring the emergency services on 999. If you or the person you are concerned about is not in immediate danger, you should ring our Customer Services Centre on 0845 8 72 73 74. You will be able to speak to a sympathetic adviser who will listen to your concerns and take them seriously. They will offer support and direct your concerns to a specialist worker who will arrange to meet with you. You may have a relative, friend or independent advocate present if you wish. Together you will discuss the issues and together you will agree a plan to keep you as safe and independent as possible. You will be able to have a copy of this plan. We will agree further contact as is needed. We may involve other agencies to help support you safely, but we will agree this together. Where the abuse is a crime, the police need to be involved to prevent other people from suffering as well. We will jointly help to support you. We will listen to your concerns and take them seriously. We will treat you with dignity and respect at all times. Our main aim will be to help you to live safely whilst maintaining the maximum possible level of independence, choice and control.

What is adult abuse? Abuse is when somebody or some people do or say things to you or somebody else that makes you or them feel upset or frightened. It is mistreatment by somebody or some people that violates a person’s human and civil rights. It may be neglecting a person’s needs, treating somebody disrespectfully or causing physical harm. It may be an isolated incident or it may be repeated incidents. It may be that the abuse is deliberate or it may be unintentional and due to ignorance or lack of training or understanding. It may be that a person is at risk of abuse or being abused in several ways. It can happen anywhere – in a care home or a care home with nursing, a hospital, in the workplace, at a day centre or educational establishment, in supported housing or in the street. Forms of abuse could be physical, sexual, emotional or financial or discriminatory. It could also cover the issues of neglect and institutional abuse – where the abuse affects more than one person within an organisation or a service and is not

Who might be causing the abuse? Anyone may be an abuser. It may be somebody you know well or it may be a stranger. It may be more than one person. It might be a family member, a friend, a neighbour, a paid or voluntary carer, a nurse, a social worker, a GP, a visitor to your home, or somebody who you don’t know. If you live in a residential setting or visit a day centre, it may be another user of that service, a visitor, or a carer.

Safeguarding vulnerable adults continued If the abuse is also a crime such as assault, racial harassment, rape or theft you should involve the police to prevent someone else from being abused. If the police are involved we will work with them and with you to support you. If you are worried about contacting the police you can contact us to talk things over first. Advocacy Sometimes, you may need an independent advocate to help and support you through a difficult time in your life, or to support you if you feel you are not getting the services or help you need. Advocacy services help people to speak for themselves and could provide you with support. They offer a confidential, free and independent service provided by trained advocates. There are several differences in the advocacy service you may receive, depending on your needs and circumstances. Your care co-ordinator as an advocate If you have a person from social care services or a health team as your care co-ordinator, he or she will liaise on your behalf with other agencies to ensure you receive the most appropriate care. In other words, they act as your advocate. Anything you discuss with them will be treated in confidence. You may meet with an advocate at your home or if you’d prefer, at a neutral place. The advocate will work with you until the issue is resolved. This

could be weeks, months, or even years when there are ongoing issues. Independent advocate services for adults If you are an adult and need an independent advocate to help and support you through a difficult time in your life or you feel you are not getting the services or help you need, there are advocacy services which may be able to help. Making a complaint about care services If you use a home care agency or move into a care home you should feel able to complain about any aspect of your life which affects your happiness or comfort. This might be anything from the way you are treated by staff to the quality of the food you are served. You should also feel free to make comments and suggestions about possible improvements to your surroundings and the

services provided. Making a complaint should not be made difficult for you and should not affect the standard of care that you receive whether in your own home or in a care home or care home with nursing. Care services are required under national Essential Standards of Quality and Safety to have a simple and easy to use complaints procedure. A friend or relative can >>

Making a complaint about care services continued >> make a complaint on your behalf if we have your agreement to the complaint being made and you give consent for us to share your information with them. Or, you can ask someone, e.g. an independent advocate, to support you to make the complaint yourself. If you are concerned about the care that you, a friend or a relative are receiving, you should contact the registered manager/owner of the service about your concerns in the first instance as they have a duty to respond to any complaints made about their service. The problem may be resolved quite easily once they are made aware of it. If you are unhappy with the response to your complaint by the service provider and your care has been arranged and funded by the Local Authority, you should discuss your concerns with your social care worker or our Complaints Manager on 0800 515875 (freephone) or 01609 532638 as we may be able to look into your complaint further. We

aim to resolve complaints as quickly and informally as possible. If you are able to talk to the managers who deliver your service, this is often the quickest and best way to get a problem resolved. If you are unhappy with our response to your complaint you can contact the Local Government Ombudsman for advice. If you have arranged and funded your care without our involvement and you are unhappy with the response to your complaint by the service provider, you can contact the Local Government Ombudsman for advice. If you have concerns about a breach of regulations by a registered provider, you can contact your local office of the Care Quality Commission who can use the information when looking at individual services to ensure quality and safety standards are being met (see page 47 for contact details and page 47 for more information about the CQC).

How solicitors can help A solicitor can give you impartial advice about wills, making gifts, estate planning and Powers of Attorney. Some can also offer guidance on immediate and long-term care plans, ensuring (if applicable) the NHS has made the correct contribution to your fees. Lasting Powers of Attorney (LPA) allow you to appoint someone you trust to make decisions about your personal welfare, including healthcare and consent to medical treatment, and/or your property and financial affairs. An LPA is only valid once registered with the Office of the Public Guardian. It allows for a person of your choice to make decisions on your behalf at a time when you may be unable. The Court of Protection can issue Orders directing the management of a person’s property and financial affairs if they are incapable of managing their own affairs should they not have a LPA. The Court procedure is presently very slow and the fees are quite expensive so preparing a LPA is always advisable, providing you have somebody sufficiently trustworthy to appoint as your attorney. An ‘advance directive’ allows you to communicate your wishes in respect of future medical treatment but it is not legally binding. You may instead wish to make a living will, properly known as an ‘advance

decision’ setting out treatment that you do not want to receive in specified circumstances, which would legally have to be followed, even if you die as a result. Any proposed Gift out of your estate needs careful consideration of the benefits, risks and implications, particularly on any future liability for care costs or tax liability. Long-term care: whether you remain in your own home or move into sheltered or residential care, you may qualify for financial assistance in the form of social care and NHS-funded care and welfare benefits. If you don’t have your own solicitor, ask family or friends for their recommendations. Contact several firms, explain your situation and ask for an estimate of cost and an idea of time scales involved. Many firms will make home visits if necessary and will adapt their communications to meet your needs. It’s important to find a solicitor who specialises in this area of the law. The Citizen’s Advice Bureau offer an advice service and will be able to recommend solicitors in your area. Inspection and registration of care services All care providers must be registered under a system introduced by the Health and Social Care Act 2008, which brings adult social care, independent healthcare and the NHS under a single set of essential standards of quality and safety for the first time. The Care Quality Commission (CQC) is the independent regulator of health and social care in England. They regulate care provided through a range of methods including: • registering providers to ensure they are meeting the essential standards of quality and safety; • monitoring how providers comply with the standards; • promoting improvement in services; • using enforcement powers where necessary; and • publishing up to date information about the compliance of adult social care providers with essential standards of safety and quality.

Following an inspection, each service is given a report of how it rates against national essential standards of quality and safety.
