Welcome from Worcestershire County Council Welcome to the 2013/2014 Worcestershire Care Services Directory which provides information for adults about the range of social care services that are available across the county. Some are provided directly by the County Council but many are provided by private, voluntary and charitable organisations who support thousands of adults with social care needs. The way adult social care is organised and provided will have to change due to the financial challenges the County Council is facing up to 2017 and beyond. The directorate of Adult Services and Health will need to make savings of at least £27 million. We are addressing this challenge proactively with the ‘Future Lives: Pathways to Independence’ programme which will review all aspects of adult social care. It will ensure that we can continue to meet the needs of service users with the money we will have available in the future, and also the requirements of the Care Bill and other national legislation. We will work with service users, the voluntary sector, our partners and the wider public to understand how our resources can best be used and to redesign services. ‘Future Lives’ aims to: • Keep people healthy and independent for as long as possible and reduce the need for adult social care. • Give service users greater choice over the services they use and greater control over their lives. • Make sure that services are safe and effective. • Achieve the savings the Council needs to make. • Make sure the Council complies with its legal duties.

Recovery: This project will review recovery services for older people – these are services that help people stay out of hospital when they get ill and keep them safe until their long term needs can be assessed. New models of care: This project will review the adult social care pathway and all of our other services for each of the main user groups. It will look at different ways of meeting the needs of service users and carers and of meeting the Council’s legal duties. ‘Future Lives’ is part of a wider programme, ‘Well Connected’, which is being run with the three Worcestershire Clinical Commissioning Groups (CCGs), Worcestershire Health and Care Trust and Worcestershire Acute Hospitals Trust. Together the partners are aiming to integrate adult social care and health services and improve the experience of service users and patients whilst addressing the growing financial challenge across both the Council and the NHS. The programme includes four main projects - these are: Ageing Well: This project will review prevention and early help activities for older people, including information and advice, to ensure that they are working well and reduce people’s need for social care. Assistive Technology: This project will introduce Telehealth and Telecare as an option for meeting people’s social care and health needs.

Where do I start? Self-Directed Support Self-Directed Support is designed to help people take control of their own social care budgets, manage their own support and choose the services that suit them best (using the money in different areas of need more flexibly.) The person is at the centre of the planning process as they are best placed to understand their own needs. As the name suggests, Self-Directed Support allows an individual to design and tailor their own support package to meet unique requirements. In Adult Services and Health we are proud to be leading the way in providing targeted and personalised services that will really help to improve quality of life for our citizens. Gone are the days of a ‘one size fits all’ approach, where standard packages were the norm, and people had to choose from a set number of available options. Self-Directed Support means, as the name suggests, that individuals can control their own care. Self-Directed Support recognises that individuals, who use our services, are the experts on their own needs and Self-Directed Support will give more choice and control over their lives. When eligible for a Personal Budget (see below), a person will be able to choose the support that best meets their outcomes as identified in their Personal Support Plan.

Whereas previously a person may have been limited to traditional options such as visits to a day care centre, or home help, Self-Directed Support offers a wider range of options. Perhaps an individual would like to keep their independence by funding transport to attend a social group every week or to visit a relative who they may have lost touch with otherwise? Or maybe a person would have a better quality of life if a course at a local college could be attended to learn a new skill, or even have some help in getting out and about to keep active? Supported from the start People opting for Self-Directed Support receive help and support with every stage of the process – from filling out an assessment form, to completing a financial assessment, writing the support plan to meet their identified outcomes, finding the services or activities and, if needed, help with the management of a Personal Budget. A Personal Assessment will identify if you meet the eligibility criteria for a Personal Budget. The Personal Support Plan will be written with the individual, confirming what the Personal Budget will be used for and how it will meet your identified social and care outcomes.

Self-Directed Support continued A Personal Budget can be managed in three ways: As a Direct Payment This is when a person manages their own Personal Budget receiving it as a Direct Payment, and choosing where, when and how to purchase their support and services as identified in their Support Plan. The individual will need to shop around and make comparisons between the different goods and services available, or they may ask a family member, friend or third party to do this for or with them, possibly using web information resources like Carewise.

Fully-Supported The individual requests that we purchase all their support and services on their behalf using their Personal Budget. Combined - ‘a bit of both’ This is when an individual has a mixture of fully supported services and a Direct Payment. We and the individual agree and share the responsibility of purchasing the support and services that have been agreed using the Personal Budget that has been allocated to them for their support.

Entitlement to services We have guidelines (eligibility criteria) for deciding who is able to receive community care services. The eligibility criteria are based on Government guidance called ‘Fair Access to Care Services’ (FACS). The aim of this guidance is to make sure that we make decisions about who gets help in a consistent way. The FACS guidance expects us to talk with you and family carers to assess the risks to your autonomy, freedom to make choices, health and safety, ability to manage personal and other daily routines, involvement in family life and the wider community. In Worcestershire, this means that if the risk to your

independence is ‘critical’ or ‘substantial’ you will be entitled to a community care service if required. We are required, under FACS, to offer services to meet care needs that fall into these two assessment categories. It is allowed to offer services that may not be the preferred option of the person receiving them if it can demonstrate that the services meet identified eligible needs in the most cost-effective way. If you want to know more about FACS or the eligibility criteria used, the guidance is available on the internet at: www.dh.gov.uk.

The assessment process You can contact us for information and advice by calling the Worcestershire Health and Social Care Access Service (WHASCAS) on 0845 607 2000 (8:30am to 8:30pm Mon to Fri and 8:30 am to 5pm on Saturdays) all calls are charged at local rates. Alternatively you could write to WHASCAS, PO Box 585, Worcester WR4 4AD or visit any of the Worcestershire Hub Customer Service Centres. If you are unable to do this you can send emails to socialcare@worcestershire.gov.uk, a fax to 01905 768056 or a text message to 07939 572850. If you find this difficult you can ask a friend, relative or your doctor to do this on your behalf. Following a discussion with one of the Access Service team you may be given information and advice, or a referral made on your behalf to an appropriate team. If a referral is made then a social worker or health

care worker will contact you, either at home or in hospital to discuss your situation and determine your care needs. This process should only happen once, as your personal details will (with your permission) be shared with health and housing services. There is no charge for this assessment. The assessment will consider personal circumstances such as: • how you can best be supported to live as independently as possible; • your home and how you are coping in it; • your emotional well-being; • your diet; • any health and medical treatments you need; and • your financial status and any benefits you may be claiming.

The assessment process continued Once we have an understanding of your needs, the next stage is to determine what services you are eligible for and who will pay for them. If you have been admitted to hospital and either you, your family, your carers or the ward staff think you need care on discharge they may refer you to the discharge team for an assessment. The team is multi – professional, made up of social workers, carers’ officers, mental health workers and housing officers. Your assessment will take place on the ward and a plan of care developed with you and your family or carer to facilitate your discharge. Whatever services you need on discharge we will work with you your family and carers to either restart services already in place prior to admission or provide the appropriate service for discharge. Sometimes interim care packages are set up to facilitate your discharge home and will be reassessed by the community social worker within 4 to 6 weeks. We do not normally arrange for people to go into residential care straight from hospital as this needs to be a considered option and arrangements planned, but if

you need a care home we will ask our brokerage team to identify appropriate homes for you and your family to view. If your home of choice has no vacancies then sometimes an interim placement may be appropriate until you can move to your permanent home. A financial assessment will be requested. What care is available? Care in your own home If you are frail, have been ill, or have just come out of hospital, the short-term support of a home care assistant could be welcome. Known as ‘domiciliary care’, it is available to those who are elderly as well as people of any age with a physical or learning disability or with a significant mental health issue. These services also give valuable help and support to parents of children with disabilities and carers should they need it. Domiciliary care services are provided by: • Worcestershire County Council; • independent agencies; • the voluntary and community sector; and • personal assistants (using Direct Payments). All domiciliary care organisations and agencies that provide personal care must be registered with and inspected by the Care Quality Commission (CQC) who inspect performance against essential standards of quality and safety and that staff are appropriately trained to do the job. Domiciliary care staff will work with you to help you regain and retain your

independence. Some of the tasks they will do include: helping you get in and out of bed, dressing and toileting. For those who need it, they will help you regain confidence in tasks such as food preparation. All staff have received specific training in areas such as moving and handling, first aid and food hygiene. All staff also have a background check with the Criminal Records Bureau. The amount of care you receive each week will be dependent on your assessed needs. We will work with you to find out how much support you need. This is called a ‘Community Care Assessment’. Depending on the level of help required, care assistants’ visits can be as short as fifteen minutes or up to several hours throughout the day. Generally, visits are available between the hours of 7am and 10pm. Night services can also be provided. The hourly rate for these types of services typically range from ÂŁ13 to ÂŁ17 per hour depending on the required tasks, whether the call is on a weekday or weekend, the time of day and the location of the visit. Additional information can be accessed on the Carewise website at www.whub.org.uk/carewise Paying for domiciliary care You won’t have to pay for any assessment or any visits or advice from your social care worker. However any personal care that you receive will need to be paid for. The exact cost will depend on your personal finances. This will need a confidential discussion with a Benefits and Contributions Officer who will look at your income and expenditure. Currently, a capital threshold of ÂŁ23,250 applies (this may change after April 2014). If you have less than this, a detailed calculation will determine what you pay. If you have more than ÂŁ23,250 you will have to pay the full costs. You may also be offered the choice of Direct Payments (also discussed on page 38) if you are considered eligible as an alternative to receiving part or all of these services. If you think this service will help you to remain in your own home and keep your independence, then please telephone 0845 607 2000 and they will refer you to the appropriate team.

Home care agency checklist

These questions may be useful when considering using the services of a home care (domiciliary) provider to help you build up a picture of how your care needs will be met in your own home.

People arranging and funding their own care either privately or through Direct Payments or a Personal Budget are able to choose their own worker or care agency.

For care packages which have been arranged by us, contracts and care plans will have been completed by your care manager and the agencies used will have been accredited to work for us.

Agencies • What experience does the agency have in your particular field of need? Can they supply references for you to check? • How can you contact the agency in an emergency or outside office hours? • Home care agencies providing personal care, must be registered and inspected by the Care Quality Commission. Ask to see a copy of their registration certificate.

• How hard or easy would it be to make a complaint and how are things then put right?

• How long has the agency been operating?

• How many carers would the agency assign to care for you and would you see the same one every day? If not, how does the staff rota operate and what happens if your carer goes on holiday or is sick, will you be notified in advance that a different carer will be attending?

• If this is a private contract ask for a copy of the agency’s contract terms and read these carefully with someone you trust. Get as much help as you can going over it and ask any questions you may have before signing anything. The Citizens Advice Bureau or Age UK could help with this.

Carers • You should expect your personal preferences, dignity and privacy to be respected. Discuss this with the agency and ask how the most suitable carers for your particular care are chosen. Can you talk to them before deciding?

• Carers should be fully trained or be in ongoing training. Ask the agency about their policies on this. • You will have a care plan drawn up by the agency which the carers will work to. Ask how often this plan will be reviewed by the agency. • Carers must be checked with the Disclosure and Barring Service and have a criminal records disclosure – make sure this is the case.

Paying • If your care needs do not meet our eligibility criteria and have been arranged privately you should check carefully the fee rates charged and exactly what the payment you make covers.

Assistive Technology (Telecare) The range and diversity of equipment is growing and ‘Telecare’ no longer describes what is available to health and social care staff in supporting service users, carers and patients. Assistive Technology is the new term that covers a wide range of technical equipment that supports service users/patients/carers. You have probably heard of Telecare which is a generic name for products and services that can: • alert a monitoring centre that something has gone wrong and ensure appropriate action is taken – for instance alerting a family member or the ambulance service – this is based on the call/pendant alarms and has been used traditionally to alert someone when the person wearing the pendant has fallen. However, there are now other things that can be monitored with bed or chair leaving sensors; • prompt, remind and inform people and their carers about things in daily life which need to be done such as taking their medication on time. Automatic Pill dispensers are being used very successfully in Worcestershire; and

• support someone or their carer living with dementia – simple things like calendar clocks or GPS technology to facilitate ‘safe walking’ and enable the carer to know where someone is. In Worcestershire, the range of equipment available would be subject to an assessment of need under the ‘Fair Access to Care Services’ (FACS) guidelines (discussed on page 6). If you do not meet the eligibility criteria for free issue of equipment, or if you choose to fund the equipment yourself, many of the items can be purchased directly from a supplier. In the case of a Telecare alarm and additional items of equipment, these can be purchased directly from the Call Centres that operate through the county. Access to Telecare services in Worcestershire can be made directly through our Access Centre on 0845 607 2000 or through a social worker.

Respite care and short stays Many people have an informal carer living with them, or perhaps living nearby, who provides care on a regular basis. Carers often need a break and this may be provided in several ways: it might be possible to arrange homebased respite care where another carer comes to your home or family-based respite care where you move into another family’s home or you may need to go into a care home for a week or two. See ‘Supporting carers’ below.

The best option for you will depend on your needs, the urgency of the situation, personal choice and cost. If you are thinking about long-term care, but have had no experience of living in a care home, you might be able book in for a short stay to see what it’s like. This will help you make an informed decision. For more information on respite care, contact your social worker or the Access Centre on 0845 607 2000.

Supporting carers Looking after someone whether they are family, friend or a neighbour can be very satisfying but it can also leave you feeling isolated, stressed, exhausted, resentful or angry. It can also affect your personal life, your health, relationships, employment, leisure time or finances. Carers need to be acknowledged and all can benefit from information and advice. In Worcestershire there is help and support available from a number of sources. ‘Carers Action Worcestershire’ is a countywide information, advice and support service for carers. This service offers a telephone helpline where questions can be answered and information given on services and support available to carers. Importantly ‘Carers Action Worcestershire’ also provides an independent voice for carers. For further information and support please contact 0300 012 4272. The Directorate of Adult Services and Health Carers’ Unit organises training/information sessions for carers. It also provides a range of services aimed at supporting

carers. These services are focused on giving carers a break from their caring role. Carers might also like to consider requesting a Carers’ Assessment* which allows carers to discuss their needs and feelings as a carer. It is an opportunity to talk about all the things carers do in their caring role and discuss services that could be provided to make life easier. It also gives carers the opportunity to consider what would need to be arranged should a personal emergency occur. There is a ‘Carer Back Me Up Service*’ which can provide up to 72 hours substitute care to the cared-for person in the home if the carer has a personal emergency. To access this service please contact the Access Centre on 0845 607 2000. The two organisations work jointly to support carers in Worcestershire. *Eligibility criteria apply.

Intermediate care This is provided by a range of services to promote faster recovery from illness, prevent unnecessary acute hospital admissions and support timely discharge from hospital. It is a programme of therapy and treatment,

usually lasting no more than 2 weeks, designed to make you as independent as possible. The structured programme of support may mean that you do not have to go into hospital at all, or

Intermediate care continued may enable you to get home faster after you finish hospital treatment, but cannot manage independently at home. Intermediate care is designed to rehabilitate you and to help you manage by yourself. Community Intermediate care provided by the NHS is free and is provided in your own home. The Directorate of Adult Services and Health

and Worcestershire NHS also work together to support service users to recover from illness rather than being admitted into hospital providing a service in nursing/ care homes when 24 hour care is necessary to be able to be monitored effectively and usually lasts for no more than 2 weeks to allow for recovery and return home.

Promoting Independence Service (PI) The Promoting Independence Service provides up to six weeks of assessment and reablement to enable adults to live as safely and independently as possible within their own homes and to reduce the need for ongoing care. The service is available between 7am and 10pm, 7 days per week, covers all geographical areas within Worcestershire and is free of charge to service users. The team supports independence with activities such as washing, dressing, managing medication, preparing drinks and meals and getting around your home safely.

The PI Service may support you to return home from hospital or from a temporary residential/nursing home placement or, for example, after a key event such as a fall. The team consists of team leaders, occupational therapists, physiotherapists, coordinators and PI assistants who work closely together to help service users achieve their desired outcomes. If it is identified during your time with the PI service that you need some continuing support, the PI team will liaise with Health and Social Care services on your behalf, as appropriate.

Continuing care Continuing care is care provided over an extended period of time to a person aged 18 or over to meet physical or mental health needs which have arisen as the result of disability, accident or illness. If you need continuing care, your care needs will be complex, substantial and ongoing, caused by a disability or chronic illness, or following hospital treatment. Continuing care is also commonly known as ‘long-term care’. Continuing care is provided by: • healthcare services from the NHS, and/or • social and community care services from your local authority. Health services are provided through NHS organisations such as Clinical Commissioning Groups, and the Health and Care Trust. Continuing care services may be provided by the NHS or your local authority in various places, for example, in hospital, in a care home or care home with nursing, in a hospice, or in your own home. What is NHS continuing healthcare? NHS continuing healthcare is the name given to a package of care which is arranged and funded solely by the NHS for individuals outside hospital who have ongoing health care needs. You can receive NHS continuing healthcare in any setting, including

your own home or in a care home. NHS continuing healthcare is free, unlike support provided by local authorities for which a financial charge may be made depending on your income and savings. If you are found to be eligible for NHS continuing healthcare in your own home, this means that the NHS will pay for healthcare (e.g. services from a community nurse or specialist therapist) and associated social care needs (e.g. personal care and domestic tasks, help with bathing, dressing, food preparation and shopping). In a care home, the NHS also pays for your care home fees, including board and accommodation. Who is eligible for NHS continuing healthcare? Anyone over 18 years of age assessed as having a certain level of care needs may be entitled to NHS continuing healthcare. It is not dependent on a particular disease, diagnosis or condition, or on who provides the care or where that care is provided. If your overall assessment of care needs shows that you have a ‘primary health need’ you should be eligible for NHS continuing healthcare. Once eligible for NHS continuing healthcare, your care will be funded by the NHS, this is however, subject to regular reviews, and should your care needs change, the funding arrangements may also change. Whether someone has a ‘primary health need’ is assessed by looking at all of their care needs and relating them to four key indicators.

Continuing care continued NHS-funded Nursing Care If you qualify for NHS-funded Nursing Care, the NHS is responsible for arranging and funding nursing from a registered nurse in a care home which is registered to provide nursing care. This nursing care cannot be provided by local authorities. The NHS funds this

nursing care through a payment called the Registered Nursing Care Contribution (RNCC). Currently this amount is £109.79 per week and is paid directly to the home. Your needs will be assessed to decide if you’re eligible for NHS-funded Nursing Care.

Sheltered (or retirement) housing This is a practical step if you would like more security and companionship but don’t need to move into a care home. In a sheltered (or retirement) housing scheme you would live independently in a flat or bungalow built especially for older people within a larger complex, sometimes around a garden or communal facility and

linked to a central control centre for security. Some schemes have access to a resident or nonresident manager who provides support, advice and a link to services for older people. After your needs have been assessed, you will still be able to receive care in the home if required.

Extra Care This type of housing offers older people who need a higher level of support the chance to continue living independently within their own self-contained properties. Unlike ordinary sheltered housing, Extra Care schemes offer 24-hour care and support from social and health care teams, provided in safe

surroundings managed by professional staff. Each older person is assessed first to work out how much care they need. Extra Care schemes offer domestic support, personal care where necessary, meals and recreation facilities.

Types of care homes All care providers must be registered with the Care Quality Commission (CQC). Care home listings start on page 42 in this Directory. All services are inspected by the CQC, who report on their findings. These inspection reports are available from the service or from the CQC. There are two types of care home: Care homes (personal care only) If you are reasonably active but would like greater security and care, a care home offering only personal care may be the best option. Personal care includes bathing, help with eating, dressing and support with mobility, but it must be paid for if your capital/ savings exceed £23,250. See pages 37 – 41 for more information on paying for care. Care homes with nursing If you think you may need nursing care in a home, you will need to be visited by a social worker or a registered nurse to work out what care you will need. This visit might be in your own home, or in hospital if you’ve been ill, or in a home. You will be fully involved in planning your care needs. If a care home providing nursing care is the best solution for you, the social worker will give you

information to help you find a home that meets your care requirements. A specially trained nurse will assess your nursing needs to determine what level of nursing care the NHS will fund. The cost of the nursing care part of your fees is paid by the NHS to the home (see page 22 for further information). The Care Services Quality Team (CSQT) The CSQT has been set up to improve care home services in Worcestershire by providing support and guidance where required. The team work alongside managers and staff to identify areas which need improvement and to formulate action plans to make changes. The CSQT works closely with: • Adult Protection to help safeguard residents in care; • Worcestershire NHS Clinical Commissioning Groups to improve services and support to care homes to enable them to provide appropriate care for residents; and • the Care Quality Commission (CQC) to improve the quality of care provision. The CSQT actively promotes ‘Dignity in Care’ principles throughout all of its work and training.

Out of county care homes You may wish to choose a care home outside Worcestershire, for example to be closer to family or friends. If you are eligible for state funding from us towards the cost of your care home place, we will contract with the care home you choose. We must be satisfied that the care home is suitable for your assessed needs, so it is important to seek its advice before making a final decision. Subject to this we will normally contribute an amount equivalent to the amount which the local authority in which the care home is located would normally contribute.

Specialist care services Support and care services for people with special needs offer a range of options aimed at maintaining their independence by living in their own homes and communities. Connect ‘Connect’ services provide short term support to adults in the community who have a disability, or who are an older adult. The services, which are free of charge, aim to identify leisure, education and/or employment opportunities within the local community, and increase each individual’s confidence to attend these independently. ‘Connect’ also provide ‘travel development’ which aims to increase an individual’s ability to travel independently, and weekly drop-ins offering opportunities to meet with the others. Referrals can be taken from social and health care professionals, private and voluntary agencies and individuals can refer themselves via the Access Centre (telephone 0845 607 2000). CSS The Community Support Services provide time limited support to adults who have a physical or learning difficulty, or who are an older adult or vulnerable person. The services provide a range of practical support which focuses on enabling individuals to secure and maintain accommodation. This can include registering with private and social landlords, setting up a new home, obtaining furniture, applying for adaptations, accessing correct benefits budgeting/managing debt and health and hygiene within the home. The service is free of charge and aims to encourage as much independence as possible, support the learning or re-learning of skills, and to use local resources to increase self-sufficiency. Referrals can be taken from social and health care professionals, private and voluntary agencies, and individuals can refer themselves via the Access Centre (telephone 0845 607 2000). Learning disability If you are considering moving out of your family home, there are a number of options that could be explored before considering a care home. You may be able to have your own flat with support. There is also the option of supported living, where you can share a property with other people with support provided for all. Either of these options can often give you greater independence and choice than care homes may be able to offer. There are other alternatives too such as Adult Placement or Shared Ownership schemes that could be considered

and these can be set up through a social worker from the Directorate of Adult Services and Health. Many adults with learning disabilities can live in their own homes in their local communities with support but there may be times when an individual has specialist health care needs or behaviour that is particularly challenging when a care home may be more appropriate. Care homes for people with learning disabilities often specialise eg homes for people with autism and challenging behaviour or dementia. A good home will provide opportunities to learn and maintain skills and opportunities to take part in enjoyable and stimulating activities. Care managers, social workers and community nurses from the Directorate of Adult Services and Health, who specialise in learning disability will be able to give you information to enable you to make the right choices. Physical disability Following an assessment of your needs, you may be eligible for help from us, including occupational therapy, adaptations to your home, supported housing or help for the person caring for you. The support you require if you have a physical disability must be tailored to your specific needs and can be provided by the independent and not-for-profit sectors as well as by us. Help at home with personal care is available during the day and night, seven days a week. There are also private agencies offering help at home with personal care and housework. See page 8 for more information. Adult mental health Your local Community Mental Health Team (CMHT) should be your first point of contact if you have mental health issues that require specialist secondary services. Your GP will be able to refer you to this service. These teams are multidisciplinary and can offer both health and social care interventions and support, focusing on the needs of people experiencing a severe and/or enduring mental illness. The services are recovery focused and work alongside individuals (and their carers) to enable them to manage their mental health and assist in building a meaningful and satisfying life. There is an increased need for a range of community support for people with mental health issues. The Reablement team within the secondary service is able to help people achieve a wide range of goals and

You may require other forms of community support and if you are assessed as eligible for a funded social care service this can be paid for via a Personal Budget and people can opt to take this as a Direct Payment as discussed on page 38. Dementia People with dementia can expect to have the quality of their lives improved by person-centred care provided in care homes. Person-centred care ensures that people are recognised and treated as an individual, taking into account their own unique history and life story. Care should then be tailored to meet each person’s needs with an emphasis on their interests, likes and choices. Care homes offering person-centred dementia care should also provide a range of activities which promote a sense of well-being and purpose for the residents on a day to day basis. The home should provide a homely and comfortable environment which allows residents

freedom of movement within a safe garden. Residents and carers should be involved in the planning of care, with relatives still able to continue to be part of the care process as they wish. Residents should have a wide choice of food which promotes and maintains their continued good health. We have initiated a program of quality improvement and training to support homes in providing personcentred care. The Care Services Quality Team (CSQT) is supporting care homes to specifically improve the standard of person-centred dementia care, and has been involved with developing an observational framework for measuring the ‘lived experience’ in a care home. See page 23 for further information on CSQT. We have commissioned specialist dementia training which can be accessed by all care homes and the CSQT provide support for them to make any changes. Residents The best indication of a good home is that the residents appear happy and responsive.

• Are residents able to compile memory boxes? • Do staff compile life story books including photographs and mementoes?

• Are there rummage boxes around the home to stimulate residents?

Staff It is important to note whether staff seem friendly and caring towards residents and whether they treat residents with respect.

Access If the person with dementia needs or is likely to need equipment or adaptations you may want to check: • There is adequate signage and cues for different parts of the home such as dining room and bathroom. • The home’s policy about locking external doors. Bedrooms You may want to find out whether the person with dementia can have a single room and whether: • Residents are encouraged to bring in some of their own furniture and possessions to increase familiarity. Activities Residents should be stimulated without feeling stressed. • Are reminiscence activities available?

• Do they have any training and experience in dementia care? • Will the person with dementia have a member of staff particularly responsible for their care? • Is there a member of staff you can talk to about your own worries about the person with dementia? Manager/head of home A manager who is caring as well as efficient can make all the difference to a home. • Does the manager have a knowledge of dementia and can they deal with difficulties that may arise in an understanding way? • Is there a full assessment at home before a resident is admitted?

Essential Information Inspection and registration of care services All care providers must be registered under a system introduced by the Health and Social Care Act 2008, which brings adult social care, independent healthcare and the NHS under a single set of essential standards of quality and safety for the first time. The Care Quality Commission (CQC) is the independent regulator of health and social care in England. They regulate care provided through a range of methods including: • registering providers to ensure they are meeting the essential standards of quality and safety; • monitoring how providers comply with the standards; • promoting improvement in services; • using enforcement powers where necessary; and • publishing up to date information about the compliance of adult social care providers with essential standards of safety and quality.

Following an inspection, each service is given a report of how it rates against national essential standards of quality and safety. Each service’s report can be seen on the CQC website: www.cqc.org.uk. All homes will be inspected on an unannounced and yearly basis. Comments, compliments and complaints All organisations need to know how they are performing. They are happy to receive your feedback on their service whether they are compliments or complaints. Feel free to tell them what you think and your comments can be used constructively to improve the service. If you or your relative’s care is being funded or part funded by us then you can complain directly to us about aspects of the care provision that you are unhappy with. It is expected that you would initially have complained to the manager of the service first, however, if you do not feel that they have fully dealt with your concerns then you can contact our

If you do need to make a complaint you should feel able to complain about any aspect of your care which affects your happiness or comfort. This could be about the way you are treated by a staff member or the quality of the food you are served. You can also make comments and suggestions about possible improvements to your surroundings and the services provided. Providers are required under essential standards of quality and safety to have a simple and easy to use complaints procedure which they will be happy to give you. If you are concerned about the care that you, a friend or a relative is receiving, it makes sense to speak to the manager before you take any further action. The problem may be resolved quite easily once they are made aware of it. However, if you need to make a formal complaint, you should initially contact the registered owners of the service. They have a duty to respond to any complaints made. If your complaint is about a breach of regulations, contact your local office of the Care Quality Commission, see above for contact details.

Safeguarding vulnerable adults A vulnerable adult is: ‘someone over 18 years of age who might be unable to protect themselves from significant harm or serious exploitation because of a physical or mental disability, age or illness’ (No Secrets, Department of Health 2000). Abuse is the violation of an individual’s human or civil rights by another person or people. It can take many different forms, such as: • physical abuse: being hit or restrained, misuse of medication; • sexual abuse: being harassed, teased or being forced to have sex without consent; • neglect: not getting adequate care, food, medication, heating;

• psychological abuse: bullying, threats, verbal abuse; • discriminatory abuse: ridicule or threats because of race, gender, disability, age, sexual orientation; • financial abuse: theft, fraud, exploitation, pressure to change a will, misappropriation of property and possessions; or • institutional abuse: mistreatment by an organisation or individual where care is provided. Abuse can happen anywhere and by anyone, including relatives, friends, neighbours, paid care workers, volunteers, professional staff and strangers. Who can you report abuse to? We can answer your query in a number of languages and our Community Social Work Teams will respond and can investigate adult abuse. Our Adult Protection Team can provide advice if people wish to discuss any concerns.

How solicitors can help A solicitor can give you impartial advice about wills, making gifts, estate planning and Powers of Attorney. Some can also offer guidance on immediate and longterm care plans, ensuring (if applicable) the NHS has made the correct contribution to your fees. Lasting Power of Attorney (LPA) allows you to appoint someone you trust to make decisions about your personal welfare, including healthcare and consent to medical treatment, and/or your property and financial affairs. An LPA is only valid once registered with the Office of the Public Guardian. It allows for a person of your choice to make decisions on your behalf at a time when you may be unable. The Court of Protection can issue Orders directing the management of a person’s property and financial affairs if they are incapable of managing their own

affairs should they not have a LPA. The Court procedure is presently very slow and the fees are quite expensive so preparing a LPA is always advisable, providing you have somebody sufficiently trustworthy to appoint as your attorney. An ‘advance directive’ allows you to communicate your wishes in respect of future medical treatment but it is not legally binding. You may instead wish to make a living will, properly known as an ‘advance decision’ setting out treatment that you do not want to receive in specified circumstances, which would legally have to be followed, even if you die as a result. Any proposed Gift out of your estate needs careful consideration of the benefits, risks and implications, particularly on any future liability for care costs or tax liability.

How solicitors can help continued Long-term care: whether you remain in your own home or move into sheltered accommodation or a care home, you may qualify for financial assistance in the form of social care and NHS-funded care and welfare benefits. If you don’t have your own solicitor, ask family or friends for their recommendations. Contact several firms, explain your situation and ask for an estimate of cost and an idea of time scales involved. Many firms will make home visits if necessary and will adapt their communications to meet your needs. It’s important to

find a solicitor who specialises in this area of the law. The Citizen’s Advice Bureau offers an advice service and will be able to recommend solicitors in your area. Steps to consider Here are some other important steps that you should consider making when looking at your care options: • contact your local Access Service for a needs assessment; • ask a relative or a friend to help with decision making; • seek advice from your solicitor before making any final decisions; • speak to an independent financial adviser about your financial situation and care costs; • look into state benefits you can claim, irrespective of your personal wealth; • find out about the costs of each type of care: - phone home care agencies to find out about the range and costs of services, - obtain brochures and terms and conditions from potential care providers; • make a checklist before visiting possible care homes. • ensure that your visit is not rushed and take time to talk to the other residents; and • ensure that you fully understand the rights and responsibilities of any formal contract with a care provider. Care home contracts for self-funding residents If you are self-funding your care and have a contract with your care provider, it is important to speak to solicitors with experience in this field. Any contract should explain: the cost of care, what services are included in the price and how often this is reviewed; what complaints procedure is in place; what your rights are and the obligations of the care provider under the contract; the procedure for cancelling a contract and the administering of medication.

Paying for care Personal Budgets A Personal Budget is the weekly amount of funding following an assessment and identification of eligible social care needs. The amount of the Personal Budget depends on the eligible needs identified in the assessment. This is the way in which an adult social care service is offered. The assessment looks at what is working well and what isn’t working so well in a person’s life and then allocates funding where more support is required to meet the eligible needs. A Personal Budget will only be finally agreed once we have worked with the person to ensure they have achieved as much independence in their life as possible. Once the amount of the Personal Budget is agreed the aim is that the person will have greater choice and control and flexibility in the way they receive services and are supported. There are three main ways in which the Personal Budget can be taken; each individual has a choice to: • Take a Direct Payment – take the money allocated and purchase services directly • Have the budget fully supported – ask the Local Authority to manage the budget and purchase services • Combined – A bit of both.

The advantages and disadvantages of each option will be discussed with them (or the person representing them). If a person needs support to manage the Personal Budget they can get this from: • family members; • trust/financial services; • a Deputy/Appointee; • a suitable person; • a provider who can provide an individual service fund–hold the money, which can be drawn on when required; or • the local authority. A person may be eligible for a Personal Budget if they have a learning or physical disability, mental health needs, are an older person, or are a carer. The amount identified will depend on the results of the Personal Assessment or Carer Assessment.

Direct Payments If a person chooses to take the Personal Budget as a Direct Payment this means that they have the money paid directly to them into a separate bank account enabling them to arrange and pay for their own services that meet the outcomes identified through the assessment and support planning process. Direct Payments should be offered to everyone who is eligible to receive them, as the preferred way in which the Personal Budget can be taken. The Government is really keen that Personal Budgets should be managed by the individual through a Direct Payment. Why? This is because they offer the most flexibility and independence to manage support needs. This means a person can choose who provides support; when support is delivered and how the support is delivered. A person may want to employ their own personal assistants or they can go directly to a provider which means the contract is between the individuals concerned. This gives far more control over how support is delivered. When taking a Personal Budget as a Direct Payment, you will be given money to meet your outcomes however services you buy should not cost more than they would if they were provided directly by us.

A financial assessment will be required and you may be asked to contribute towards the cost of your services. Direct Payments are paid directly into a bank account that you must open specifically for this purpose. You will be asked to sign an agreement, a bit like signing to agree to the rules of having a Direct Payment. You will also be asked to keep records and receipts to show that the Direct Payments have been spent on care to meet your needs as agreed. The finances will be looked at as part of the annual review of the Personal Support plan. One of the key elements in encouraging people to use Direct Payments is to have good support and advice available. We have a support organisation that provides information and advice services to people thinking about or using Direct Payments. This includes advice on how to recruit and employ personal assistants and support workers. Penderels Trust can be contacted on 01299 253225. Third party payments If the home you choose costs more that the rate we usually pay for someone with your needs, you will have the choice to ask someone else to make an additional payment. If there is no-one available to supply the extra payment, you can ask us to find you another placement at the rate we would normally expect to pay. If, however, you do decide to live in the more expensive home and you have someone who is able to make an additional payment for you, they will have to pay the difference between our rate and the amount the home charges. This additional payment is often referred to as a ‘top-up’ or ‘third party contribution’. The law says that you are not allowed to make this additional payment yourself, except in limited circumstances. Therefore, the additional payment has to be made by someone else, for example, a family

member or charity. Before anyone agrees to make additional payments on your behalf they should be aware that the amount could change, usually increase, once a year and they need to be confident that they can sustain the payments for as long as they are required. If the additional payments stop being paid for any reason, then you should seek help and advice via the Access Centre on 0845 607 2000. Once it has been established that someone is willing and able to make these payments they will be asked to sign an agreement to formalise the arrangement. Because the financing of care is a complex area it is advisable to contact the social worker who is arranging your placement with you or the Access Centre to ask for advice and individual guidance.

Care funded by the council Do I qualify for local authority financial assistance? If you have been assessed as needing a care home place and your capital is below £23,250 you should be entitled to financial support from your local authority. If you have capital below £14,250 you will be entitled to maximum support contributing your income less £23.50 per week retained for personal expenses. If you have capital between £14,250 and £23,250 you must pay a capital tariff of £1 per week for each £250 between these two figures. Capital includes the value of your former home unless it’s occupied by your partner, or a relative who is aged over 60 years or incapacitated, or a child under 16 years who you maintain or a separated partner who is a lone parent. Do I have a choice of care home if the council is paying? Yes and it can even be in a different county. The home

you choose must be suitable for your assessed needs, comply with any terms and conditions set by your local authority and not cost any more than they would usually pay for someone with your needs. What if a home costs more than the local authority is prepared to pay? The local authority will allow a third party to top-up as long as they are able to do so over the long term. You are not allowed to top up the fees yourself from capital below £23,250. My partner needs care, how does this financially affect me? Your local authority will take into account 50% of any joint savings therefore, to accelerate financial help, it is better to have separate single accounts meeting care costs paid from the account of the person in the care home.

Paying for your own residential care Self-funding If you are self-funding your care because you are not eligible for local authority funding there are other forms of financial assistance you may be entitled to: Will the local authority pay my fees whilst I am selling my former home? If, apart from your property, your other capital is below £23,250 the local authority will help with the costs during the first twelve weeks of permanent care. Beyond that period any financial help will be charged against the value of your former home and recovered from the eventual sale proceeds.

Do I have to sell my property? No, your local authority can lend you the money to pay for your care charged against your property value. However, they may limit how much they will pay and it could adversely affect your welfare benefit entitlements. Do I have to pay Council Tax on an empty property? If you move into a care home and your property is left empty then you should receive full exemption from Council Tax until it’s sold.

Paying for your own residential care continued Is there any financial help that is not means tested? Attendance Allowance is a non-means tested, nontaxable allowance paid at the lower rate of £53.00 for those needing care by day or night and, at a higher rate of £79.15 for those needing care by day and night. Whether your stay is temporary or permanent if you receive nursing care in a care home you may be entitled to an NHS Registered Nursing Care Contribution (RNCC) towards the cost of your nursing care, paid directly to the home at £109.79 per week. If your needs are primarily health care needs, you may be entitled to full funding from your local PCT following an assessment under their continuing care eligibility criteria. This figure applies to England only. What happens if I move into a care home independently and run out of money? Once your capital reduces to £23,250 you should seek local authority assistance. However, if the home costs more than the local authority usually pays and won’t

reduce its fees you could be in the difficult situation of either finding a source of top-up or seeking less expensive accommodation. If there is a likelihood of running out of money it’s important that you arrange an assessment of your care needs with us to ensure we will step into help. Also check if the care home owner can continue to accommodate you at our funding rates or will require a third party top-up. What can I do to avoid this situation? There are ways of meeting care costs for as long as you need care whilst using up only part of your capital. For example, the use of Immediate Need Care Fee Payment Plans can contribute towards capping the cost and, as so many older people wish, enabling an inheritance to be left for the family. The important thing is not to try to do it alone, always seek professional advice. Figures mentioned here may change over the lifetime of this Directory.
