Presentation Overview: Batter up! Join us for “What Can I Say?”, a presentation and panel discussion with Carlton Fields Shareholder Dave Cannella and Public Relations Manager Kate Barth on how inhouse counsel can manage matters that draw public attention and media coverage. This program will address the application of the litigation privilege to court filings, and ethical considerations regarding outofcourt statements about pending litigation. It will also offer practical insights and best practices for presenting a consistent company message in highprofile matters. We’ll round the bases with a second presentation on contractual indemnification. Carlton Fields Shareholder Jason Perkins will discuss the different forms of indemnity — common law, limited form, intermediate form, and broad form — and share insights on a 50state summary of statutes barring indemnity clauses in construction contracts. Attendees will also learn the “top 10 pitfalls” when negotiating and drafting settlement agreements The day concludes with Carlton Fields Shareholder Chris Paolini’s home run presentation, “Who You Gonna Call?” Learn how inhouse counsel can mitigate liability under the 1991 Telephone Consumer Protection Act (TCPA). This session will provide an overview of the TCPA, identify the communications it prohibits, and discuss the recent proliferation of TCPA litigation. It will also explore issues regarding consent and revocation, and discuss best practices for ensuring TCPA compliance.
