You have made the decision to sell your property and have decided to first try and do so without hiring a real estate agent. There are quite a few challenges that you might face travelling down this path. Ready? Here we go. Home Value. Pricing a home to the market is an important first step in the home selling process. You want to make sure your home is priced either to the market or not too far above. If you price your property too high, then you will not attract the buyer’s that would have come forward had the property been properly priced. Your pricing research is generally limited to what you see in advertisements or to hiring an appraiser. A real estate agent has access to recent sales as well as other information that help develop a pricing strategy.
Sales & Marketing. In order to attract the right buyers for your home you need to properly stage your property to a buyer’s taste, then take good quality photos and video and post these to the various social media sites, real estate publications and other websites where buyer’s look when considering a home purchase. Once you have started to receive calls from your yard sign and your advertising you will need to arrange your schedule to accommodate property showings at times convenient to a buyer. It’s important that you screen potential buyers for safety reasons and to eliminate unqualified buyers before you head out on showings. When you are showing the property to your buyer expect criticism. Years ago I was showing a property had insisted that he be present for all showings. During our showing the buyer made comments about the ‘ugly’ purple paint color. The seller threw everyone out of the house. Purple was his wife’s favorite color. You will need to learn to bite your tongue. It’s important to note that most buyers start their search on the internet by searching the websites of REALTORS® – the information on these websites is derived from the Guam Multiple Listing Service (MLS). Only a REALTOR® can post properties for sale to the 460 member MLS so your property will not display in these searches. Negotiate With Buyers. Once you have found a buyer you will need to determine if they are ready, willing and able to purchase your home. You will need negotiation skills and understand the various financing programs. Though you believe you may have found a buyer, he/she may not have the credit worthiness or funds needed to purchase your home. 4 CasaGuam

Working with Buyer’s Agents. Oftentimes you will receive calls from agents representing buyers that may be interested in purchasing your home. If you elect to entertain these agents, you will need to make sure you have the skills necessary to work with an agent that is representing the interests of a buyer. If you elect not to work with buyer’s agents, then you may be missing a pool of potential buyers for your home. Escrow/Inspections/Closing. Once you are in contract with a buyer you will need to open an escrow account, order a title report, track the buyer’s obligations, schedule inspections with the buyer’s contactors and satisfy contingencies. The bank will order an appraisal of the property that will then need to be accepted by the buyer’s lender. You will need to check the title report to ensure that you will be able to convey clear title to the buyer at closing. Along the way you will probably need to negotiate the price further if issues arise based on the reports produced by inspectors and the appraisal. Clouds on Title (aka Title Defects)
A
A property with a “cloud on the title” refers to an irregularity in the chain of title that raises the question of a potential risk or threat to the buyer. A cloud on the title is generally less threatening than a defect in the title, however both may have the effect of reducing the value and marketability of a property because a prospective buyer knows they are acquiring a possible problem with the property. Examples of clouds and defects in the chain of title include: • Missing Documents, also called a “break in the chain of title”. Not only refers to deeds, but powers of attorney granting authority for someone to sell property. Another example of a missing document would be if an owner dies and there is no probate (and no spouse with community rights interests). Lack of a decree of distribution from the probate court would constitute a title defect. • A variance or misspelling to the names of previous buyers and sellers. A woman who acquires title in one name but sells under a different name. • All parties executing deeds. A brother and sister purchase the property, but only the sister signs the deed to sell it. The brother’s interest would remain in his name. • A mortgage lien that has not been released.

• Unpaid property taxes. • Conveyance by a minor, or an incompetent person without the benefit of court approval. • Conveyance into a trust could be a defect, in that in most jurisdictions, title is properly vested in the Trustee of a Trust, not the Trust itself. So, how do you fix a cloud or title defect? Each situation is unique, but many issues can be resolved by relying on a statute, filing of an affidavit or by placing a corrective document into the public record to correct the defect. For example: • Locating the mortgagee under an unreleased mortgage and having them sign a release. • A woman who acquired the property when single can correct her name on the chain of title by recording an Affidavit of Identity. • Missing deeds are often located in home records when parties did not realize that recording was necessary. Question: “Hafa Adai Duane, I'm a little embarrassed writing this question, but I'd like to ask your thoughts on ways to help rebuild my credit since my foreclosure.” - Anonymous reader Response: Hello Anonymous, tough question, but, sometimes life throws us rotten coconuts and we need to strive forward. These questions are best to be answered by lawyers, but, let's see if I can provide a little help. Foreclosure can have a significant negative impact on your credit scores, limit your ability to obtain new credit and remain on your credit report for seven years. However, with patience and a plan, you can successfully rebuild your credit so that you are in a position to take advantage of all that a healthy credit rating has to offer. Here are some key steps to take on the road to credit repair. 1. Find out the true impact on your credit. First, be sure you know exactly how your credit was affected. The terms and conditions of foreclosure and short sale agreements can vary in how they impact your credit scores (how they are reported to the credit bureaus and how long they stay on your credit report)

2. Get smart about your credit ratings. Educating yourself is your best line of defense when it comes to your credit, and a great place to start is with your credit report. Your credit report can give you insight into why your foreclosure happened so that you can take steps to prevent a re-occurrence. It’s also a good idea to review your report to ensure it has no errors and that there are not any old debts still on record after being paid off. 3. Pay your debts on time. Your goal is to create a positive payment history to show lenders you are being financially responsible. Additionally, paying down high balances can positively impact your credit score. 4. Know what not to do. It may seem smart to close open credit accounts. That’s not necessarily the case and could even hurt your score. Closing credit accounts, even those you have not used for some time, can suggest to lenders that you are closer to being “maxed out” on your credit than you truly are. 5. Use credit cards to rebuild your credit. That may sound counter-productive, but consistently paying off a balance each month has a positive impact on your score. If you’re unable to obtain a regular credit card, you may want to consider a secured card, offered by many banks and credit unions. In simple terms, you’ll be required to deposit a certain amount of funds with the creditor – and in return, you’ll receive a card for a line of credit in that amount. Using these secured credit cards responsibly over time can also accrue to your benefit and help rebuild your credit worthiness. While repairing your credit can take time, it is an achievable goal. Be patient, develop a concrete plan and stick to it. The more disciplined you are, the more progress you can make. Now! Throw those rotten coconuts back!

How to Use Wine Corks to Make Monogram Letters

The key to creating a random yet balanced look on the letters is to slice each cork in different widths and sizes. Use a heavy-duty craft knife to slice each cork into wedges, cylinders and triangles.

Repurpose discarded wine corks into chic sculptures, like the ever popular Varsity Letter, with basic wooden letters and hot glue. This project will talk about half a day to do. TOOLS • hot-glue gun and glue sticks • heavy-duty craft knife
SUPPLIES: • wood letters • detail paintbrush • black acrylic paint • discarded wine corks
Step 1, Paint Letter
In order for the sliced portions of cork to create a seamless look, the wood letters must first be painted black so there will be a shadow effect between each cork. Apply black acrylic paint to each letter using a small detail brush. Allow at least three hours to dry.
Step 2, With an X-acto knife, slice the corks
Similar to assembling a jigsaw puzzle, attach each slice of cork to the face of the letter. After all pieces are laid out and completely cover the black-painted face of the letter, attach in place using hot glue.
Let Dry Allow one hour for drying, and you're ready to place or hang your letters.

Gifts That Keep Giving By Eric M. Palacios

By the time you read this article, Christmas will have come and gone and you will likely be working on New Year’s resolutions and the sort. Or maybe you will still be enjoying the last moments of the holidays, like my family will be. Whatever the scenario, now is a good time to start eco-planning for Christmas 2018. Did you buy a live tree last month? If you did and it is still sitting in your garage or backyard, start right here. The reuse options of a live tree are almost limitless. From the different color choices to straight up staining, to the wide range of recyclable products that you can adorn the tree with, you will be able to let your creativity run wild. First things first: prepping the tree. Once all of the needles have fallen off, give it a good, thorough rinse down. Once dry, it’s important to keep it in an area where there is a good amount of sunlight so as to push the drying process along. Once it has reached a good degree of drying out, you can add a quick coat of spray paint to help preserve it. At this point, you may shear off any imperfections in its shape or simply shape it to your creative desire.
It is very important to note that dead Christmas trees are extremely flammable, so do not store your tree near a constant source of fire or spark, like your barbecue area. If you prefer to buy a new tree every year, you may still put your old tree to good use by dropping it off at the Department of Agriculture. The team there will chip it down for mulching, which is still a good way to dispose of dead trees. Another good option to cause for the reuse of your old tree is to post it on any number of free online sites. You might be surprised by how many people would gladly take it off your hands. Personally, I know several people who have anywhere from five to 10 trees that they use as yard art during the holidays. Beautiful, indeed!
Create your tree Another option that you have as far as putting a tree up during the holidays is to create one out of just about any tree. In my experience, I have come to learn that lemon trees are the best. Now I do not mean one whole lemon tree, just a good sized branch. Once you have cut the perfect branch, leave it in the sun to dry out. After it has dried, shear off any thorns and scrape off the bark to reveal its smooth texture. At this point: • Sand it down with 800- to 1,000-grit sandpaper • Rinse it down and let it dry • Once dried, take a torch to it to darken portions of the tree to give it a “weathered” look • Brush on your favorite shade of stain The wonderful thing about creating a tree like this is that it can be used year-round. You may decorate it with hearts and red ribbons during Valentine’s Day, or with eggs and bunnies during Easter. Mother’s Day. Father’s Day. A child’s birthday. And then during Christmas. Or, you may simply set it off in a corner in your house to hang just about anything. Whichever option you choose, adding ornaments made from recyclable material will give it that “oomph.” In addition to saving some money, you will also be helping to sustain our environment by reducing the waste stream. For us in the Marianas, it’s the dry/windy season: more sun, less rain. However, strong winds and hazardous seas can somemes lurk below those sunny skies. Strong winter storms over the north Paci c can generate large swell that could eventually reach the Marianas; or a strong trade wind surge here in the tropics can produce strong winds, choppy and hazardous seas locally. We keep watch for these hazards and other weather condi ons 24/7 at the Na onal Weather Service O ce here on Guam. In order to protect life and property, we issue weather advisories and/or warnings detailing the natural hazards. We issue Small Cra Advisories for hazardous seas and / or winds, and Gale Warnings for strong winds not associated with a tropical cyclone (see more about the various hazards for seas and surf below). We will likely issue a number of Small Cra Advisories in the coming months as trade winds surge and seas build this me of year. A small cra advisory a ects anyone involved in marine ac vi es, especially operators of small to medium sized motor and sail
boats, shermen, para-sailors, windsurfers, canoe/kayak paddlers and paddle boarders. Boa ng ac vity during a small cra advisory can be hazardous to both the boat crew and passengers. If you will be boa ng, make informed decisions: If you are caught o shore when the wind picks up and seas become rough, put on your life vest and head for port; avoid boa ng above your skill level in open waters—especially when a Small Cra Advisory is in e ect; and if you are on the coastal waters, exercise cau on and be aware of how unpredictable the seas can be. Remember: Prior to enjoying water ac vi es, stay tuned to NOAA Weather Radio broadcasts, dial 211 for the latest forecast, and ensure you use the proper safety equipment when enjoying water ac vi es.

Hi, I am Christopher Felix the incoming president for the Guam Association of Realtors for 2018. I am looking forward to an exciting year in the real estate market for 2018. I believe the military buildup will actually start happening this year and I believe this will cause a lot of changes and shifts in our real estate market. I have already seen increases in lower rental rates and the value of lower to mid level apartment complexes last year and I expect these to continue. I also think the mid to upper rentals will start to fill up again and hopefully increase by 2019. The theme for this issue deals with home improvements and design trends for this year. Upgrading your homes is a good thing to do if you can find a contractor available at a reasonable price. I do believe costs will go up and continue to rise so this year is a good time to look at improving your home if you have plans to do so. Good luck to all of us this year and I wish you all a Happy and Prosperous 2018!
The sale and purchase of a home is one of the most significant events that any person will experience in his or her lifetime. It is more that the simple purchase of housing, for it includes the hopes, dreams, aspirations, and economic destiny of those involved. Americans with Disabilities Act: Title III of the Americans with Disabilities Act prohibits discrimination against persons with disabilities in places of public accommodations and commercial facilities. Equal Credit Opportunity Act: The Equal Credit Opportunity Act makes discrimination unlawful with respect to any aspect of a credit application on the basis of race, color, religion, national origin, sex, marital status, age or because all or part of the applicant's income derives from any public assistance program. State and Local Laws: State and local laws often provide broader coverage and prohibit discrimination based on additional classes not covered by federal law. Responsibilities The home seller, the home seeker, and the real estate professional all have rights and responsibilities under the law. Call the Guam Association of REALTORS®: We will accept complaints alleging violations of the Code of Ethics filed by a home seeker who alleges discriminatory treatment in the availability, purchase or rental of housing. Local Boards of REALTORS® have a responsibility to enforce the Code of Ethics through professional standards procedures and corrective action in cases where a violation of the Code of Ethics is proven to have occurred.
