Dear Members, As the vaccination rollout programme continues apace, we can see some light at the end of the tunnel after the unprecedented upheaval of the past months. By mid-June, the vast majority of social restrictions

may be lifted with the hope that work and personal life will resume to something more akin to normal. Fingers crossed that we will be able to meet up with many of you at one of our re-scheduled events.

A key issue that we will be focusing on in the coming months is that of sustainability. Following talks with one of the leading paint manufacturers, we were shocked to learn that 22% of the environmental impact of their business is dependent on how Painters and Decorators deal with empty cans and waste paint. Despite the fact that some manufacturers will take back empty paint cans free of charge, there has only been a 1.6% take up. As the only trade association for our sector, we need to take a position on sustainability and the environmental impact of our industry. With this in mind we will be constituting a working group with major manufacturers and the British Coatings Federation (BCF) to develop a cross-industry approach to address this. In the UK alone, the estimated 50 million litres of leftover paint generated by the consumer DIY market each year would fill 20 Olympic sized swimming pools. Nor does this worrying amount include trade paint waste. Organisations such as Community Repaint collect leftover paint and redistribute it to benefit individuals, families, communities and charities in need of paint at an affordable cost. It would be a major step forward if we could work together on these initiatives and do ‘our bit’ for the environment. In the past week, you will have received a survey from us via our e-newsletter relating to our concerns around the current Level 2 Apprenticeship qualification. This was launched back in 2018 and is due to be reviewed in June. Currently, apprentices in England can only enrol on a Level 2 Standard in Painting and Decorating. However, we believe that this does not fully address the needs of the industry. It is the Association’s opinion that there is a need for an additional pathway at Level 3 which will allow apprentices to acquire a broader set of skills. The reasoning behind the survey is to gather your views in order to support our contention that we should increase the standard to include an advanced Level 3 qualification. I have always held the belief that we are the finishing trade of the construction sector and as such, should be respected and valued. To do this, we require a workforce of fully skilled operatives who can carry out the many types of work that they undertake in the course of their working day. So please, take five minutes of your time to complete the survey and submit it by 12 April. It’s for the long term good of our trade, and hopefully, for future Members of the PDA.

This year the PDA is hoping to see the return of events such as the Premier Trophy Awards after the COVID-19 pandemic put a halt to things in 2020. Plans are underway for the competitions, awards and events that the PDA hosts each year, but dates are being kept flexible as restrictions are subject to change. The flagship Premier Trophy Awards ceremony is currently scheduled to take place at Plaisterer’s Hall in London on 16 September.

On 1 June, the PDA’s Apprentice Paperhanger of the Year competition will see trainees tackle a six-hour wallpapering challenge in a test of nerve and skill at Doncaster Hub. The Premier Trophy Award Apprentice of the Year competition is also set to go ahead. If COVID-19 restrictions allow, competitors will meet at Accrington and Rossendale College on 4 June, Bournemouth and Poole College on 11 June and Coventry College on 18 June. Provisional bookings have also been made for an Activity Day on 2 September at the Abbey Hotel and Golf Club in Redditch, and for the National Networking Event at the Liverpool Hilton Hotel on 19 and 20 November.

When the written contract does not reflect reality WHAT WE LEARNT ABOUT EMPLOYMENT STATUS FROM THE UBER LEGAL DISPUTE THE RANGE OF statutory employment rights that a person enjoys depends on their employment status. There are currently three types recognised in the UK: • employee (with full employment rights) • worker (with some employment rights, such as the right to paid statutory holiday and to receive the National Minimum Wage) • self-employed (who are largely outside the scope of employment law and do not have these rights). While basic definitions of ‘employee’ and ‘worker’ are contained in legislation, detailed tests of an individual’s employment status are set out in case law as developed by the tribunals and courts. In contrast, tax law for the purposes of determining who is responsible for assessing and paying income tax and NICs only distinguishes between employees and the self-employed, the latter being someone working for their own business as a self-employed sole trader or a partnership. Unlike employment law, it does not use the intermediary ‘worker’ status to determine tax liabilities. Many recent court and tribunal cases have been concerned with whether people working in the ‘gig economy’ are workers or self-employed for employment law purposes. As widely reported in the media last year, the Supreme Court has ruled unanimously that the original tribunal was correct in finding that the Uber drivers at the centre of the dispute were workers, with worker rights, rather than self-employed contractors, due to the relationship of subordination between Uber and its drivers. Uber had sought to categorise their drivers as being self-employed, arguing that they serve their own clients.

However, the Supreme Court ruled that the employment tribunal, who described the written contracts Uber relied on as a ‘fiction’, was correct to find that the drivers were in fact workers. The Court focused on five key reasons for finding that the drivers were workers for the duration of time they were logged onto the app and available to accept work in the area they were licensed to work: • the drivers had no say over their fares which were set by Uber; • a standardised written agreement (described as a ‘service agreement’), which they are not able to renegotiate, is essentially imposed on drivers; • Uber exercises a significant amount of control over drivers, including penalising those who decline or fail to accept a certain number of trip requests; • Uber dictates the way in which drivers should deliver their service and uses a rating system which if the driver falls below leads to a series of warnings which may ultimately result in termination of the contract. Complaints from passengers aren't handled by the driver, but by Uber, who will often decide them without even referring to the driver. This sometimes leads to a reduction in a driver's pay; • communication between passengers and drivers is restricted by Uber (preventing the formation of any future relationship between the driver and the passenger outside their journey). Whilst this case does not change the law on employment status, it is a reminder that the tribunals in the UK will apply the relevant statutory tests of employment status, as

further developed in caselaw to the detailed facts of the cases that come before them, and attempt to identify the true reality of the relationship, regardless of how carefully drafted contractual documents seek to represent that relationship. Where the individual meets the statutory ‘worker’ definition, the protective statutory provisions relating to workers all prohibit the parties contracting out of its provisions in order to disapply them. The Supreme Court ruling is clear that even where the individual providing their services under a purportedly self-employed contract (such as a ‘contract for services’) has the possibility of rejecting jobs, of deciding if and when to work, if they are subject to control and managerial powers they are likely to be considered a worker, with worker entitlements.

HOW START AHEAD IN THE NEW TAX YEAR THE UK TAX year starts on 6 April and runs to 5 April the following year. It’s the perfect opportunity to reflect on the previous tax year, wise up on any new legislation that might affect your tax return, and look for opportunities to simplify the process and even reduce your tax bill where possible. Not sure where to start? Not a problem. Mike Parkes from GoSimpleTax to give his best tips on preparing for a new tax year... Digitalise the tax return process If you’re still working with paper, let 2021/22 be the tax year you move online. After all, paper tax returns need to be filed three months before the online one, and they’ll be phased out in a few years as part of Making Tax Digital (MTD) anyway. So, why not make the change now? MTD is an initiative launched by HMRC to make it easier for the self-employed to keep on top of their tax affairs. From April 2023, they want all sole traders to submit their self-employed income and expenses online and on a quarterly basis. What’s more, moving online can often remove some of the time, stress and mistakes that usually come with a paper tax return. There’s even dedicated tax return software, like GoSimpleTax, that’s designed to make it much easier to log income and expenditure throughout the year, and then submit this information straight to HMRC.

Record income through invoicing software Once you’ve moved your tax return online, whether that’s through software or HMRC’s Government Gateway, start requesting payment digitally with invoicing technology. Invoicing tech formalises your payment process. Instead of sending over Word or Excel invoices, this software can send fully branded requests to your clients. They can also

integrate with things like your Gmail account or your preferred payment solution, such as PayPal or SumUp.

Plan ahead to reduce your tax bill The moment that the new tax year starts, you're free to file last year's tax return. My advice is not to wait, as tempting as it might be! This is the point where all your income and expenditure is fresh in your mind, so it’s far easier to collect up all the evidence and use it to submit an accurate tax return. Filing a tax return early doesn’t mean you’ll have to pay your tax bill early, remember. It just means that you’ll get your bill almost a year in advance of its due date so that you can better manage your cash flow. Even starting to complete one early has its benefits. It gives you time to review your expenses and find opportunities to make tax savings. You can save a fortune by identifying purchases that are classed as allowable expenditure, so why not give yourself time to check? If you take these three key steps, you’ll be in a great position to file your tax return as soon as the new tax year starts – and then you can get back to doing what you do best.

Here’s a few reminders on mixing paint safely...

SIMPLE STEPS FOR PAINTING SAFELY Put a lid on it Once you have opened a tin or can of paint, it can release vapours into the air which can be harmful to you, a member of your team or even the general public. By making sure that you put a lid on your paint, you can prevent harmful fumes from contaminating the air, but this also saves money as it stops paint or coating from evaporating.

Wear the appropriate PPE Stopping harmful fumes from getting into the air is one way of preventing illness, but when you are mixing paint, consider wearing a respirator. Where men are using respirators, for further protection they could consider having a clean shave so that a respirator can attach to the face properly. The cartridges for a respirator should also be changed regularly. Read

Painting isn’t necessarily seen as a dangerous profession, but there are some potentially serious risks when it comes to working with paints and solvents. One of the unseen risks of painting is the dangers of working with the chemicals that are contained within the paints that you use, which can be especially dangerous when mixing.

Skin can also absorb these harmful chemicals leading to complications later in life. Good clothing for mixing paint includes chemical resistant gloves, such as nitrile or butyl rubber gloves, and paint suits that offer adequate protection for your skin. You should also follow the recommendations of the manufacturers, and if you notice tears or other damage to your safety equipment, remove them and discard them immediately.

Vapours are more harmful when used indoors because there is nowhere for the fumes to escape. When mixing paints, you should do so outdoors to prevent the build-up of these harmful vapours. You should also put protection on the floor when mixing the paint to catch any spillages or leaks. You could use an old sheet to catch these spillages, which you can reuse, or some plastic wrap that is easier to dispose of, but more harmful to the environment.

It’s not just humans that paints and solvents can be harmful to. Reduce your waste by only using the amount of paint that you need, and consider safely storing leftover paints and primers so that you can reuse them in the future.

FOR MANY YEARS Worksafe have provided innovative safety related accessories to the working at height industry. Best known for the Worksafe Anchor, a unique reusable anchoring device originally designed to tie in ladders and towers, it is now used in a wide variety of applications. The Anchor has sold thousands across a wide variety of industries for tying in ladders and towers, but this unique product can also be used as a security enhancement by adding a simple bracket and a padlock (sold separately), to create a secure anchoring point to attach small items of plant, trailers, bicycles, motorcylces, ladders and other items related to working at height equipment. Worksafe also produce the Ladder Leveller & Stabiliser, currently the only ladder levelling system that also complies with the BS EN 131 Working at Height Regulations, the Leveller will adjust to 30 degrees in each direction allowing safe and stable working on uneven or sloping ground. The unit has infinitesimal adjustment which allows pinpoint accuracy, particularly important on very tall ladders where a quarter of an inch out at the bottom could translate into several feet at the top! A built-in spirit level is incorporated to take the guess work out of positioning the ladder absolutely straight. The solid rubber feet mean that no matter what angle they meet the ground, maximum ground contact is made, and as weight is applied the rubber balls compress and spread a little creating extra grip. The unit can be fitted, or removed from a ladder in seconds, but the unit may also be permanently fitted to a ladder as it is exceptionally light.

ASSOCIATION NEWS Key points from the BCF Brexit impact survey • BCF members are experienced exporters (75% already trade with the EU and beyond to the rest of the world, so are used to dealing with customs paperwork and procedures) • 85% of BCF members spent significant time and money preparing for Brexit

EXPORT RED TAPE AND DELAYS IT’S BEEN A very disruptive start to 2021 for BCF members. We commented on the UK/EU trade deal (welcomed at the final hour to avoid tariffs, as a thin deal that was the hardest form of Brexit, with significant ‘friction’) which has turned out even worse than we expected in the first few weeks of the new year. Since Christmas Eve, we’ve had meetings with Cabinet ministers, Ministers of State, senior government officials and lobby groups to discuss the impact of the trade deal on the chemical industry and its supply chain, and our experience to date. Unfortunately, this is just the beginning. Whilst some issues are teething problems, and industry understanding the new operating relationship, other problems are simply negative impacts of leaving the EU’s customs union and single market that cannot be resolved.

To add to the gloomy picture, we have the prospect of UK REACH, which will dramatically reduce the competitiveness of UK manufactured paints, coatings and printing inks. FRESH LOOK FOR CENTRE WHILST CARRYING OUT cyclical decoration work for Liberty Group in the Stockbridge area, the Ian Williams team decided that the local Craigs Community Centre, managed by ForHousing (part of Liberty Group) deserved a bit of love and attention. So Ian Williams volunteered their services and undertook a full repainting and decorating project that has dramatically transformed the space into a fresh, bright environment that’s ready to welcome people back after lockdown. As part of a collaborative commitment to the local community, in addition to the painting and with materials’ investment from Liberty Group and Manhattan Kitchens, Ian Williams also installed a new kitchen and accessible French doors with a Equality Act 2010 compliant ramp that vastly improves wheelchair access.

LIVERPOOL TEAM DELIVERS FULL RENOVATION TO RETIREMENT HOME ON BEHALF OF Ian Williams’ customer Housing 21, the Liverpool team has recently completed the full renovation of their Retirement Living property, George Moore Court. The works included the remodelling of the Kitchen, Laundry Room, Hair Salon and day areas, as well as replastering all the internal walls and internal and external repainting. SANDTEX BRINGS COLOUR TO HULL MURALS CROWN PAINTS PLAYED its part in the addition of four murals across Hull in 2020 by donating paint to local artist Andy Pea. The company, which manufactures some of its most popular products at its facility in Hull, has previously donated paint to numerous deserving local community causes through its Crown Decorating Centre located on Stoneferry Road. Crown was keen to work with Hull-based street artist Andy Pea having already worked with him several times since the company supported the Hull City of Culture campaign in 2017, and so donated Sandtex Trade products in various colours in order to complete the four murals located across the city last year. As part of a wider social action project, Andy was commissioned by cultural development organisation Absolutely Cultured and its funder Nesta to create a mural on an old factory wall in Hull’s The Shires area (above left). Local residents were involved in the design of the mural which spans a total of three streets and 120 metres. The design is centred on the environment, and over 200 volunteers helped bring it to life over the course of eight weeks by assisting with painting in line with Covid-19 safety measures. Sandtex Trade High Cover Smooth masonry paint was also selected by Andy to complete his Chanterlands Avenue project (below right) in April and May 2020. For this project, Andy was tasked with reinstating some of the old hand painted signs, known as ‘ghost signs’, around the area using historic photographs of Chanterlands Avenue. The transformation has proved popular among residents, sparking conversations about the area’s past. Community organisation Tigers Trust benefitted from an indoor mural (top right), which was created using Sandtex specially mixed in a variety of bold colours in order to transform a breakout area to be used by young people. Andy consulted with the Tigers Trust team before finalising the colour scheme and design, and eventually brought their ideas to life by creating a vibrant space for users to enjoy. FOUNDATION DOUBLES FUNDRAISING TOTAL JOHN HENRY, A Sales Advisor at Brewers Decorator Centre in Dereham, has recently joined back up with his old bandmates to raise money for Mental Health UK. When John found out that a friend of his was experiencing mental health problems, he decided he wanted to bring attention to the services available at Mental Health UK and fundraise for the fantastic charity. John said, “The whole thing came from hearing about a friend of ours who is normally a rock solid, confident personality, having some mental health problems. “We realised at this time it could be any of us, and people often don't talk about it, they suffer in silence. We decided to try and help bring some attention to this great charity and raise some cash in some way.

The Grand View Research report suggests growing concern regarding cleanliness in various industries has led to increased demand, and it is a significant market for us. Our sales have been rising over several years, and as you might expect, there has been a dramatic surge in enquiries since March 2020. To help meet the current customer demands for antimicrobial additives, we increased our headcount by 30% in 2020, delivering further skills and enhancing service levels across sales,

The unpainted woodwork, which included the dado, hand rails and large newels at the bottom of the staircase, was all waxed with Briwax in an Antique Pine finish. Doors and skirtings were coated with Benjamin Moore Scuff-X, and the walls below the dado were painted using Farrow & Ball Estate emulsion. Most of the paper hanging was straightforward enough, although quite extensive! We began by lining with Wallrock Thermal paper before finishing with Cole and Son wallpaper, all using Albany ready mixed paste. The upper part of the staircase was quite awkward to access, we had to use a combination of a mobile tower and a ladder with a Stairmate, plus the very tight access behind the metal balusters made things even more awkward. We didn’t originally agree a timescale, as we were unsure exactly how much damage may need to be repaired, but the job was completed within budget and overall the client was very happy with the final outcome. Margaret Morris, owner of the property said, “I am very pleased with the welcoming effect the wallpaper has given my hallway. There is no natural light in the hall, but the artificial light reflects on pattern giving it a light and airy appearance. Nic has made a stunning job of the decorating, there isn’t anywhere you can see a join. He was also very careful how he did the pattern match, which saved me at least five rolls, as the manufacturer suggested. I am extremely pleased with the outcome.

It works well with Yellow 01, a sunny and spirited shade that works wonderfully as an accent colour, or Yellow 02 as they also have warm tones. Add splashes of the Pantone colours by painting smaller surfaces. Want to bring in the two trending colours without a full-blown home makeover? Paint smaller items such as furniture pieces or even blinds and you can be on-trend with just a few licks. If painting furniture, opt for yellow to add an unexpected bright boost around your home. If you want to keep it really subtle, you could simply paint your kitchen table legs yellow, get some cool yellow cupboard door knobs, or invest in some soft yellow furnishings such as cushions or throws.

When you reposition or close it for storage, be sure to listen to it ‘click’ back into the lock mode. A wall pad provides a soft material to protect the surface you lean it on, but press two small buttons simultaneously and the pad will rotate to allow the ladder to lean into internal and external corners or timber studs. There’s even two handy trays on top. This fantastic lightweight ladder has a working load of 150kg, boasting tough heavy-duty feet with deep tread to keep it almost glued to the floor when in use. When in extension mode the feet, which touch the wall surface, also benefit from specially angled pads to make better contact with the surface it is lent against – this makes it feels really secure. I like the flared legs on the front end as this increases sideways stability, whilst the straight legs on the rear can slide into tighter spaces when in step ladder position. The black top has a wide grip pattern, useful when standing on in extension mode, along with tool ports for screwdrivers and a scraper, plus a large round hole that is good for a small cordless drill or claw hammer. On a recent Art Deco apartment renovation project in Norwich, I ordered 75m x 100mm Gyproc FibaTape Xtreme joint tape from Selco Builders Warehouse, as they have the exclusivity on them. This bright orange joint tape has an incredible fine thin mesh, made with a high fibreglass density. It is extra-sticky and avoids blisters and bubbles, working well in temperatures from 5 to 35ºC. The 100mm width also allows the fast application to more extensive areas saving time and money, but it’s also available as 90m x 48mm.

New formulations offer the

ultimate in performance

Dulux Trade has enhanced decorators ability to provide long-lasting, smooth exterior finishes for clients, with the introduction of new and improved formulations across its Weathershield range. The upgraded Weathershield Smooth and Weathershield Maximum Exposure masonry paints are perfect to combine with the Weathershield Exterior Gloss System products for trim to ensure a beautifully smooth and shiny finish to exterior doors and windows that will also stay looking good for many years. The improved formulation of Weathershield Smooth Masonry is shower resistant after just 30 minutes, and is now three times more effective than the previous formulation at protecting against mould and algae. This is because it contains a fungicide to inhibit the growth of mould and algae within the paint film, helping it stay looking cleaner for longer. All coloured paints will show signs of fading over time due to UV and pollutant exposure, but the new Weathershield masonry formulation also contains innovative anti-fade technology, which slows down the effects of this exposure, prolonging the colour’s lifespan. An increased resistance to alkali means salt crystals are less likely to form on the paint film, further helping to combat colour fade, and with higher levels of white pigment than other masonry paints, it offers better opacity for excellent two-coat coverage. In addition, Dulux Trade Weathershield Maximum Exposure provides better protection against the effects of weathering as a result of its new formulation, as its dried paint film is now five times more flexible than Smooth Masonry making it significantly less prone to cracking or flaking in harsh weather conditions. Shower resistant after only 15 minutes, its superior adhesion means that paint will take to the substrate even when preparation can’t be first class, while its increased water resistance sees it better protect the substrate from the effects of water damage and driving rain. Both paints also come in three new ready mixed colours – Jasmine White, Goosewing and Frosted Grey. Work platforms are a great low-level access solution and with a wide variety available on the market, there are plenty of options for tradesmen to choose from that suit different types of jobs. Both the Adjustable and Linking PRO Work Platform are made from a lightweight aluminium and feature an Easy-Grab handle in the middle of the platform, making them comfortable to carry in one hand, leaving the other hand free to carry tools and materials. The new work platforms also feature slim-fold legs and can fold completely flat to a compact size when closed, which is great for storage.
