Minister RuairĂ Quinn In the last five years ten major school building projects encountered difficulties which resulted in a tender competition for a replacement contractor. The difficulties encountered on nine of these projects related to contractor insolvencies. The termination of the contractor's obligation to complete the works on the tenth project was due to the contractor's default.
There is a bond in place for each of the ten projects. The bond is used to cover costs that would otherwise accrue to the Employer (i.e. the Department, School, VEC etc.) on foot of a contractor's failure to complete the works. As such the Employer's financial exposure is generally minimal. Negotiations are ongoing with regard to a number of these projects and in some cases the full cost of re-tendering and completion of the works is not yet known. The Deputy will appreciate that it is not possible to release commercially sensitive cost information which is currently the subject of negotiations. To do so would
undermine the Department's position with regard to such negotiations. For the Deputy's convenience I have attached details of the ten projects.

Minister RuairĂ Quinn The Deputy will be aware that the Department of Education and Skills recently terminated the contractor's obligation to complete the works at St Anne's National School in Ardclough, Co Kildare. The Department is liaising with the school authorities and has instructed the Design Team to commence work on procuring a completion contractor to complete the works. Subject to no issues arising, it is anticipated that the project will be completed in the coming months.

Minister Ruairí Quinn The project to which the deputy refers is close to completion. However, there are a number of technical issues which need to be resolved before the building can be handed over to the school authority. It is anticipated that these issues will be resolved in the coming weeks. There is currently only one small prefab leased by the school and the rent is €2,878.20 (VAT incl) per annum. The staffing levels at the school will remain the same for the 2012/2013 academic year.

Ardclough School Works Must Commence Minister’s Commitment must be Honoured Independent TD for North Kildare, Catherine Murphy has continued to highlight the situation facing both the parents and children in Ardclough and the continuing delay in opening the new school building. “This situation has been allowed to continue for far too long. Here we are in the midst of winter and these children are still sitting in cold, damp prefabs, while the new building is allowed to sit unfinished. Parents are telling me about children with colds and other ailments that could be alleviated by taking them out of these unsuitable prefabs and outing them into a purpose built school fit for their needs.” “I have consistently lobbied on this issue and the Minister has now given a commitment that the new school will be completed in the second quarter of this year. I will continue to press this issue to ensure that the Minister meets this deadline without any undue delay because this is not the first time this type of commitment has been given and this time it must mean what it says”.
