The Act also provides for a business plan for each fiscal year for a period that includes the fiscal year and at least two subsequent fiscal years. Bill 14: RCMP Health Coverage Statutes Amendment Act, S.A. 2013, c. 4 Amends: Alberta Health Care Insurance Act, R.S.A. 2000, c. A-20 Health Insurance Premiums Act, R.S.A. 2000, c. H-6 Summary: The RCMP Health Coverage Statutes Amendment Act was created as a requirement of federal Bill C-38 to ensure that Alberta is in compliance with the Canada Health Act, R.S.C., 1985, c. C-6. The new Act amends the Alberta Health Care Insurance Act and the Alberta Health Insurance Premiums Act so that members of the RCMP who are appointed to rank are eligible for provincial health care coverage and exempt from the requirement to pay health premiums. Summary: The Act introduces an administrative disposition procedure under the Victims Restitution and Compensation Act, S.A. 2001, c. V-3.5. Subject to some exceptions, if the Minister has reason to believe that personal property acquired by illegal means or an instrument of illegal activity, is located in Alberta and in the possession of a public body, the personal property may be disposed by the Minister without commencing a legal action. The Bill introduces timelines and clarifies what is considered “proceeds of illegal activity� (cash or other negotiable instrument with a value greater than $10,000.00 found with, near or in conjunction with drugs or drug paraphernalia and in a bulk quantity or otherwise not associated with the packaging, storage, records, receipts or other evidence typical of legitimate business activity, or in circumstances prescribed by the Regulation). Summary: The Pooled Registered Pension Plans Act provides a legal framework for the establishment, administration and operation of a pension scheme to which employed or self-employed persons could contribute, as an alternative to other retirement income savings schemes. The Act provides for the Minister to enter into bilateral or multilateral agreements and such agreements supersede the Act. The Act contains several time sensitive requirements for providing information to the Superintendent and for appeals to the court from a decision of the Alberta Employment Pension Tribunal. Upon the death of a member of a plan, a surviving pension partner is entitled to the deceased member’s share which may be transferred to a prescribed pension scheme. In the event that a member dies without a surviving pension partner, the plan must pay his or her share as a lump sum to the member’s legal survivor or to a beneficiary designated by the surviving pension plan if the plan allows it. Every plan must provide that shares may not be transferred, surrendered, withdrawn, charged or eliminated in any other manner unless exempt from this requirement by the Act. Certain shares and assets are exempt from executions, seizure and attachment. Where an individual who is entitled to a share is missing, the administrator may (and in some instances, shall) transfer the amount of the share to the Minister responsible for the Unclaimed Personal Property and Vested Property Act. The Act imposes penalties on offenders in the amount not exceeding $100,000.00 in the case of an actual person or to imprisonment for a term not exceeding 12 months or both, and in the case of a corporation, to a fine not exceeding $500,000.00. Summary: The Metis Settlements Amendment Act introduces the requirement for an annual 3 year business plan and an official code of conduct for councillors. The Act also amends the current requirement for an election every three years to one every four years to make it consistent with the recent move to a four year cycle for other local governments. Environmental Protection and Enhancement Act, R.S.A. 2000, c. E-12

Summary: The Environmental Protection and Enhancement Amendment Act creates a funding mechanism between industry and government to support the joint Canada-Alberta implementation plan for oil sands monitoring. The funding arrangement will enable Alberta to collect, hold and disburse funds, and continue to implement the joint plan. Changes to the Act allow Government to move forward on a provincial monitoring system by identifying programs and setting fees to support those programs. In Force:

Bill 22: Aboriginal Consultation Levy Act, S.A. 2013, c. A-1.2 Summary: Under the Aboriginal Consultation Levy Act, a levy would be paid by industry proponents for resource development projects and land management activities when there is a duty to consult with First Nations or other identified aboriginal groups. The levy amounts received from industry proponents would be paid into a Consultation Levy Fund which would be established, managed and administered by the government. The funds would be redistributed to First Nations or other identified aboriginal groups for specific purposes. The Act requires an annual report summarizing the operation of the Consultation Levy Fund, including audited financial statements of the Fund. In Force:

Repeals:

Summary: The Tax Statutes Amendment Act amends Alberta’s Personal Income Tax Act and Corporate Income Tax Act to align provincial tax laws with changes that occurred in the federal tax system, and repeals the Alberta Income Tax Act. In Force:

Subsection 1(13) is deemed to have come into force on January 1, 2001. Subsection 3(5) is deemed to have come into force on July 1, 2011. Subsection 3(7)(b) comes into force on July 1, 2013. Subsection 3(7)(c) is deemed to have come into force on July 1, 2011.

A-44.8 Summary: The Assurance for Students Act modifies the Framework Agreement which was presented by the Government of Alberta to the Alberta Teachers’ Association (the “ATA”) and the Alberta School Boards Association (the “ASBA”) on March 13, 2013, and makes it binding on all school boards, the ATA, the ASBA, the Crown, and the Minister of Education. Summary: The Scrap Metal Dealers and Recyclers Identification Act requires scrap metal dealers and recyclers to request proof of identification from each scrap metal seller, record specific information about each transaction as determined by regulation, make that information available to law enforcement officers upon request, and report suspicious transactions such as purchases above a certain weight or with identifying features. Bill 203: Employment Standards (Compassionate Care Leave) Amendment Act, S.A. 2013, c. 6 Amends:

Employment Standards Code, R.S.A. 2000, c. E-9

Summary: The Employment Standards (Compassionate Care Leave) Amendment Act amends the Employment Standards Code to include a provision which entitles employees up to an eight-week unpaid leave from work in order to provide compassionate care for a terminally ill family member. The employee must obtain a medical certificate from his or her family member’s medical provider certifying that the family member is at serious risk of death within 26 weeks and that the family member requires the care and support of the employee. The individual requesting leave is to be a primary caregiver of the sick family member.

An individual may take the eight weeks of leave consecutively or break the leave into two periods of leave of not more than eight weeks, as long as the second period ends no later than 26 weeks after the first period began. No period of leave may be less than one week in duration. The employee may return to work without any reduction in pay, salary, seniority, or benefits. In Force:
