Riverbay Board Approves FY 2023/24 & 2024/25 Budgets

The Riverbay Board of Directors approved Management’s proposed 2-year budget for Fiscal Year 2023/2024 and 2024/2025 at the Wednesday, March 29, 2023 business meeting to maintain the current level of services to shareholders while also providing funding for the community’s mandatory Five-Year Capital Plan for necessary infrastructure repairs to the development.

According to Resolution 23-19, the “proposed budget requires a 2.1% increase in carrying charges effective April 1, 2024 in order to maintain a balanced budget through March 31, 2025, all subject to review, analysis and discussion with the NYS HCR.”

In addition to the proposed 2.1% carrying charge increase, transient parking and parking pass rates will also be increased 30%, effective April 1, 2023, should HCR grant approval. Amazon Lockers Pilot Program Begins With Triple-Core Buildings

Shareholders in Triple-Core buildings can now have their packages delivered safely to a designated Amazon Hub locker.

The lockers are part of a pilot program organized by Amazon and designed to address package thefts and further improve service reliability for Amazon customers in Co-op City.

Bronx Safe Disposal Set for April 29

NYC Department of Sanitation will present a Safe Disposal event this Spring at the Orchard Beach parking lot on Saturday, April 29, 10 a.m.-4 p.m., rain or shine.

Forever In Our Heart

LeVar Oliver Jackson was welcomed into the world to Jessie and Gladys Jackson on July 28, 1999, in New Rochelle, NY. As a baby, LeVar craved his favorite meal, blended broccoli, while watching his favorite show, Barney & Friends. Anytime he became fussy or irritated, his sister, Azania, would lay with him and rub on his ears. Worked like a charm!

LeVar attended New York City public schools and participated in swimming, racing with his bicycle and scooter, and Taekwondo. While attending Truman High School in the Bronx, NY, he learned about military life through their JROTC program. LeVar spent his weekends games were his priority and he loved competing with his siblings and cousins. LeVar enjoyed cooking and doing laundry for his family and trips to Martha’s Vineyard every summer.

After graduating high school, LeVar set his sights on The New England Institute of Technology in East Greenwich, RI. There, he found a passion in cars, obtaining an Associate in Science degree in Advanced Automotive Technology. After graduation, LeVar returned home to pursue a career in the autoTrucking Company, Home Depot, and Citarella.

All was well until the last nine months, as LeVar began to exhibit signs of depression. He completed an

intensive out-patient program March 3, and progressed toward a brighter future. There were less mood swings, he regained his appetite, went for walks with his mother, spent time with his father getting haircuts and going out to eat. He became a member of the Fountain House, an emotional-support clubhouse in Manhattan. Unfortunately, LeVar did not get to experience all that life has to offer. On March 17, he was found unresponsive by his younger sister, Sojourner. She, alongside paramedics, performed CPR. After their tireless efforts, LeVar Oliver Jackson was called by God to join the ancestors at 3:32 p.m. that day. His mother’s last words to him were, “See you in a bit. You can have the last taco,” giving him a hug and a kiss before heading back to work.

To mourn LeVar’s untimely passing, he has left behind parents, Gladys and Jessie Jackson; sisters, Azania Jackson and Sojourner Jackson; grandfather, Oliver “Dip” Welch; uncles, Oliver Welch, Arthur Welch, and Kaeron David; aunts, Sojourner David and Michelle Welch; cousins, Candyce, Ayana, Davane, Aneke, Daryl, Kaden, Mekhi, and Sydney; constant companions, Biscuit, Snowball and Aaron (R.I.P.); and a host of aunts, uncles, cousins, relatives, and friends of the family. Thank you to Daisy Holmes, Earlene Cody and Billy Nelson for their continued support with LeVar until the end.

JASA’s Creative Arts & Painting

Artist Ron Cruz led the seniors in JASA’s weekly Creative Arts & Painting class on Tuesday, March 28. He discussed how to create different gradients and darker shades of black, as well as explained how some colors have different behaviors. He also demonstrated the scratch technique which is the practice of using a tool to scrape away a layer of color to reveal the layer underneath. Cruz shared the effect of watching Bob Ross’s painting show everyday as a kid. “If you do something over and over on a consistent basis [you improve]. Experience is one of the best teachers,” he said.

Students in the class varied in experience, with some starting at four-years old. They are all dedicated to their craft however, and they come to class every Tuesday excited to learn.

It’s HAPPENING in Co-op City!

Jaison Bonner is an uprising young scholar and basketball star who resides in Co-op City. He attends Equality Charter School, and is currently on the Honor Roll. He was recently accepted to Salesian High School where he received a scholarship.

Jaison’s pressure dehis team to their third consecutive win last weekend, helping them remain undefeated. He scored 22 points, pulled down two rebounds, handed out three assists, and had four incredible steals in his team’s winning game. Way to go, Jaison!

CCPD Offers Tips to Prevent Identity Theft during Income Tax Season

Public Safety Report

As taxpayers are rushing to file their tax returns before the deadline, they should be aware of the potential for scams to take place. Co-op City Department of Public Safety (CCPD) offers useful precautions residents should take to avoid becoming a victim of identity theft. Unscrupulous criminals have even found a way to use Americans’ eagerness to receive their tax refund as a means to attempt identity theft. The following information will help prevent you from becoming the victim of identity theft in all situations.

Federal, state and local agencies are constantly investigating incidents where another person’s Social Security number may be used to file fraudulent tax returns. There have been instances where an active tax filer’s Social Security number was used, a dependent child’s Social Security number was used and even a deceased person’s Social Security was utilized to file a fraudulent tax return. Thieves may buy and sell these Social Security numbers from individuals, employers, hospitals, nursing homes, schools or other sources. All of these instances are serious crimes and can result in severe penalties.

The Internal Revenue Service (IRS) recommends filing your tax return early to beat the scammers to your refund. After filing, check the status of your refund at www.irs.gov/Refunds. Make sure you know and trust your tax preparer. Never give out personal information unless you are 100% sure of who you are speaking with. Always shred any documents or mail which contains personal information.

With many American households anxiously awaiting a Federal and State tax refund, criminals have attempted to gain access to people’s bank accounts. E-mails and phone calls have been received requesting bank account information. The caller promises that payment will be deposited right into your bank account. We are receiving reports this year that scammers have found a way to have fraudulent information appear on the caller identification on your telephone. This is a new technique, but it is the same old scam with a new face. The scam artist will not deposit money into your account but rather will make a hefty withdrawal. No United States government agency will call you to request your bank account number. The Internal Revenue states that they make initial contact by mail in all cases.

It is very important for everyone to remember to never give out bank account numbers, Personal Identification Numbers (P.I.N.), Social Security numbers or other confidential numbers which can provide access to financial records, unless you initiate the contact. Legitimate bank employees should never call up customers requesting this information. Bank employees should be aware that cus-

A Riverbay employee reported his work locker was damaged. The investigation is ongoing.

CCPD responded to a call of youths loitering on the stairwell. Upon arrival, officers encountered six (6) youths loitering on the stairwell. Further investigation disclosed all six students were absent from the Bronx Health Sciences High School. All six youths were returned under escort to their high school where they were remanded to school officials.

Upon returning to his parked vehicle in Garage 5, a cooperator observed that the catalytic converter was removed from his vehicle. The shareholder was referred to the NYPD for additional investigation and follow-up.

victim of a telephone swindle where a large sum of money was given to an unknown individual as a result of the scam. The shareholder was referred to the NYPD for additional investigation and follow-up.

2047 Bartow Avenue

CCPD responded to the Dollar Tree store for a male leaving the store after removing numerous items from the store without paying and leaving the establishment. CCPD supervisor and officers canvassed the area and discovered a suspect meeting the description on Bartow Avenue. The suspect was subsequently positively identified. The male was found to be in possession of the stolen items removed from the Dollar Tree store and placed under arrest.

A Riverbay supervisor reported seeing an unknown male pushing the garage exit barrier arm up and exiting the garage without paying. The investigation is ongoing.

Misspelling and grammatical errors are often indicators that the e-mail is a fraud. Contact www.OnGuardOnline.gov if you suspect e-mail fraud. Be wary if you receive a check from a financial institution that you are not expecting. Reports have been received of persons receiving an unsolicited check in an express mail envelope. If this check is deposited into your account, the funds will not be available and you will be responsible for money. Never wire money with the anticipation of receiving more money in the future. This scam pops up in a variety of different ways – apartment rentals on Craigslist, merchandise being sold on eBay, winning a sweepstakes, long lost relative in another country, job as a Mystery Shopper, etc. When in doubt, contact the police.

We only hear about the high profile cases of breach of credit card information such as in the Equifax and Uber incidents or the infamous past Target, eBay and Home Depot incidents. Anytime you swipe your credit card, it can be at risk. Carefully check your credit card statements to insure there are no unauthorized charges. If something about a merchant does not seem right, utilize a different form of payment. In most cases, credit card companies do not hold you accountable for unauthorized charges. Debit cards do not always carry the same level of protection.

AARP also offers informative material about fraud protection at www.aarp. org/money/scams-fraud/. The information is geared for persons 50 or older, but all ages can benefit from the information provided. There is also a quiz to see how knowledgeable you are about fraud prevention. You can even sign up for fraud alert newsletters.

Board Meeting in Section 5, 3/22/2023

A lot of cooperators showed up for our board meeting in section 5 on March 22, 2023. So, let’s go over a few things that happened during this meeting.

In-kind Donations

Financial Issues

Despite what you may have read, we have a lot of financial issues here. Therefore, we just had a 7.5 percent increase on January 1, 2023. And, now, can you believe that our board is reviewing our budgets to perhaps lessen or avert another increase? But, think, why is this happening when we will make over $260 million within this fiscal year?

Lawsuits

Riverbay is currently defending 115 lawsuits. And, 78 percent of these lawsuits are by cooperators that are suing their own corporation. Regardless, all of our cooperators will ultimately pay for these lawsuits with increased insurance premiums and legal fees.

Doggie Bags

Recently, I received some photos about how some cooperators are using the grassy areas near building 24 (on Co-op City Blvd., near the baseball fields.) to let their dog do their business. Furthermore, statements were made during our section 5 meeting that our workers are filling the doggie stations with bags. Thereafter, some cooperators are taking out all of the garbage bags.

Look, this type of foolishness is wrong. You do not take out all of the bags for your personal use.

Bottom line: Talking and writing lots of articles will not get some of our cooperators to clean up after their dog. Therefore, we need for some of our officers to video the cooperators that are not cleaning up after their dogs. Then, they need to issue community complaints to them.

Killer Curb Garbage

As you’re going into section 5, near that bridge, there is a winding section of the road that has been described as “killer curb.” And, during the meeting, a lot of complaints were made about the garbage that is piled up near killer curb. So, management needs to have a discussion with NYC officials about cleaning up that area.

A former director along with other cooperators discussed the process of Riverbay limiting their in-kind donations to some of our community groups. However, let’s see if we can look at this matter in a better way.

As cited above, Riverbay is going to make more than $260 million this year. Therefore, in my opinion, we need to look out for the children, the teens, and everyone else here. So, can Riverbay do a few nice things for everyone? Educational activities? Big, inflatable toys? Sports, games, and other activities? Dances? Concerts? Fireworks shows? Movies?

If yes, then, our community groups should develop some plans with Riverbay to put on these activities. Riverbay should then fund these activities and provide everything that’s needed. No nonsense! Thereafter, our community groups can make everything happen. And, everyone can have a wonderful time.

Bottom line: We make a lot of money here. However, in my opinion, we need to drastically reduce our budgets so that we can thrive. Summertime? We can have nice summer events here. After-school programs? Riverbay can work with good community groups and offer after-school programs in our huge community rooms. We can also have programs for everyone. I want everyone to enjoy Co-op City.

Convector Problems

There were a lot of complaints about convector leaks. So, we need to consider that the laws in NYS are going to eventually prevent us from using natural gas to operate our power plant, our stoves, and our convectors.

Therefore, we need to start having discussions with our politicians about obtaining grants to update the electrical systems in our buildings. Thereafter, we can have systems developed to provide heat and cool air in our apartments. Leaks? Riverbay can help you with convector leaks. Also, you can go on your electronic device and type in ‘universal absorbent socks.’ Thereafter, you’ll see that lots of people place them around leaky devices to absorb and contain gallons of water from flowing throughout a floor.

Brown Water

There were complaints about brown water in some

apartments. So, Riverbay is going to have our water systems tested.

Lobby

Doors Not Staying Closed

Our lobby doors are ADA compliant. However, our lobby doors will not stay closed on windy days. So, my suggestion is that we should talk to a manufacturer about this problem. Thereafter, they can design a device that will exert pressure on the doors so that they will close at a reasonable pace. Then, that exerted pressure will help our doors to stay in a closed position.

Verizon

Verizon should start installing their wires in section 5 in June 2023. They will probably finish their work in Co-op City in December 2024. New Restaurant – Bartow Westside Wings Corp, LLC. will be taking over that Arby’s spot.

Resolution #23-16 Controversy

Riverbay presented a bid for $276,800 to replace 8 transformers. However, Riverbay placed a 15% contingency fee of $41,520 on top of this bid. Why? Well, the reasoning was that management would not have to return to the board if the overall price exceeded the original bid price.

Anyway, a vote was taken, and the contingency fee was removed from the resolution. Fine? No!!! Look, the bidder knows that he can probably still get $41,520 extra. So, do you think that he is going to leave $41,520 on the table? What about a future change order? Anyway, I voted no. But, the majority of the board voted yes after the contingency fee was removed.

I want to thank the many shareholders and cooperators who attended the Open Board Meeting last Wednesday evening at the Einstein Center’s Room 45, especially those who stepped up to the microphone to voice their concerns and opinions.

Although the meeting was scheduled to begin at 7:30 p.m., the actual start time was 7:55 p.m. In offering my apologies for our tardiness, it is important that everyone attending the Open Board meeting know that your Board members and upper Management were meeting outlook (carrying charges), therefore, the extended participation was absolutely essential.

Brown Water

In taking a moment to address two of our shareholders who came to speak before the Board, I want to thank them for bringing the “brown water” back into the discussion. Back in August of 2021, I contacted the

WHEREAS, Riverbay’s Non-Power Plant Property Insurance Policy expires 3/31/23; and

WHEREAS, the expiring Property Insurance Policy was a three (3) layered program with multiple insurance carriers totaling $621.5 Million of coverage for the Non-Power Plant properties for an annual premium of $5,145,137 including broker fee, TRIA and taxes; and

WHEREAS, the Director of Risk Management, after an extensive marketing program through USI Insurance Services, Inc., Riverbay’s Property Insurance broker, because of a continued hardening market due to limited capacity, adverse property losses throughout the country and a 20% increase in Riverbay’s Total Insured Value (TIV), recommends placing the Non-Power Plant Property Insurance policy in a four (4) layered program for an annual premium, including broker fee, TRIA and taxes, not to exceed $7,815,185, a 51.89% increase, for the policy period 3/31/23 – 3/31/24.

NOW, THEREFORE, BE IT RESOLVED, that the Board approves placing the Non-Power Plant Property Insurance Policy program in the same format and coverage amounts as noted above for an annual premium, including broker fee, TRIA and taxes, not to exceed $7,815,185 for the policy period 3/31/23–3/31/24.

WHEREAS, the average carrying charge per room, per month is $255.87 and this amount includes utilities, that became effective January 1, 2023 based on authorization by the NYS HCR; and

WHEREAS, the 2.1% carrying charge increase effective April 1, 2024 will raise the current average carrying charges from $255.87 per room, per month to $261.24 per room, per month; This increase will enable Riverbay Corporation to meet its obligations; and

WHEREAS, the Transient Parking and Parking Pass rates were last increased in July 2021, effective April 1, 2023 those rates will be increased 30%; and

NOW THEREFORE, LET IT BE, RESOLVED: that the proposed is approved and Management and the Board President are authorized to process the necessary application with the NYS HCR for the above stated carrying charge increase. Equal Rights Amendment

To the Editor:

This is written in response to a letter supporting the “Equal Rights Amendment” in last week’s Co-op Times. It should be recognized that there were also many women who opposed the E.R.A. because no one could predict what changes the passage of this law might lead to.

Critics who studied the E.R.A. feared that the bill, if passed, might have led to the possibility of women being drafted into the military, should the draft be re-instituted. Other concerns were the housing of female jail inmates with males, and women being forced to use toilets or changing rooms occupied by men. Since the bill failed twice, none of these concerns needed to be addressed.

I recall that the spokeswoman for a Black civil-rights organization called the ‘Equal Rights Amendment’ the ‘liftin’ and totin’ bill, because passage of the act might make it impossible for employers in the manual labor and service industries to allow female workers to carry disparate weights, when compared to men, and have certain accommodations.

For these reasons, among others, some of the American people have turned down the ERA repeatedly.

Including Directors Coleman and Marbury, others voting in favor of the resolution included Directors Cylich, Feliciano, Leslie, Richardson, Rosario, Sampson, Saunders, Green-Watson and Wright. Directors Johnson, Lambright and Marbury voted no, Director Smith abstained and Director Peterson was absent.

Good day, fellow shareholders.

Firstly, I was pleased to meet Ms. Rozaan Boone, Editor-in-Chief of the Co-op City Times, at the Open Board meeting. I was delighted to make her acquaintance had the chance to have a quick conversation with Bob Klehammer, Executive General Manager of Co-op City. I was surprised at how approachable he was, mainly because I needed to discuss with him how the climate of the meeting had become a little tense for a minute. It does not matter where I lived; we fought if there was a board. Nothing should be taken personally; it is business. And

Spring is in the air! We will soon start seeing the leaves growing on the trees, venturing outside and enjoying the beautiful weather, we are sure their pets will accompany them. We request that shareholders with pets be more attentive when cleaning up behind their animals. It makes the space more enjoyable for your fellow cooperators and creates a safer environment for our pets (multiple infectious diseases are transmitted through animal waste). If your children walk the pets, please ensure they do the right thing. No one enjoys having to duck and dodge animal waste on their walking paths.

Shareholders, elections for Board members will be happening soon. Co-op are imminent! For one, our convectors need to be replaced, and Riverbay is At the meeting, there were many complaints. The easy things will be resolved. The big-ticket items will understandably take longer. We need additional Board members with the knowledge and skill to help us with expensive capital projects. If you are a shareholder with the intelligence and skills necessary to assist, please run for a position! We are supposed to be an affordable community. At the rate we are going, affordability will go right out the window!

In addition to our other issues, we have a shareholder in the building no one has seen for some time, and neighbors are concerned. Riverbay will not disclose information about you to anyone not a family member. If you live alone, it would be wise to give a neighbor the number of a close friend or relative if anything happens to you. It would surprise you to know how many neighbors are concerned about you. So please, give a few people an emergency contact number. lost loved ones, you are all in our prayers.

Emergency Food Pantry (Free)

920 Baychester Ave., Bldg. 1A (entrance faces basketball court). The pantry opens Tuesday, Thursday and Friday from 11:00 a.m.-12:45 p.m. for grocery distribution. Guests are eligible to pick up food once a month. Look at the last date on your pantry card. The next pick up would be one month from the last pick up or after. It is a 30/31 day rotation, on average. Black Forum will text registered guests if items outside of regular distribution become available. All guests must present a pantry card to receive food. Remember to bring at least black shopping bags because black ink can transfer to the food, posing a health hazard. We require masks and physical distancing.

Sections 1-4 guests will register or recertify at the 920 Baychester location, while Section 5 guests go to the Co-op City United Methodist Church. Required documentation is as follows: NY State Driver’s license, NY State -

required for all 2022 registered guests wanting to continue visiting the pantry in 2023. These guests must also show the required documentation listed above. Guests should apply by the end of April 2023 even if they do not plan to pick up food until later in the year.

Black Forum has used orange bags to pack monthly packages for distribution. The cost of the bags has tripled, so the pantry will pack the canned goods directly in bags you provide. Thus, four to six sturdy and clean (non-black) bags reserve the right to not provide certain items if we believe cross contamination

2023 Riverbay Board Election Rules and Regulations

GENERAL RULES AND REGULATIONS RELATIVE TO THE RIVERBAY CORPORATION’S 2023 BOARD OF DIRECTORS ELECTION Adopted March 8, 2023

A. GENERAL RULES

1. The Election Committee of the Board of Directors of the Riverbay Corporation (hereinafter, the “Election Committee” or “Committee”) shall be established during the month of January of each calendar year, or as soon thereafter as feasible.

2. The election of Directors of Riverbay Corporation will commence on Monday, May 1, 2023 at 6:00 a.m. and continue through 9:00 p.m. on Friday, May 26, 2023, (hereafter “Election Day”). If an of-

(a) The Chairperson of the Committee, (hereinafter “Chairperson”) shall be a member of the Board of Directors of the Riverbay Corporation (hereinafter “Board”), who is not a candidate in the election. The Chairperson shall be appointed by the President of the Board (the “President”), and approved by the Board.

(b) The Chairperson shall recommend to the President the appointment of such additional residents as the Chair deems prudent for membership on the Election Committee. All members shall be resident shareholders, appointed by the President and approved by the Board.

(c) The Committee shall be assisted by Riverbay’s General Counsel.

(d) No member of the Committee or their immediate family shall in any way engage in any campaigning either for or against a candidate or slate of candidates. Committee members shall, to the extent reasonably possible, refrain from publicly commenting upon any issue in the campaign and shall not engage in any activity that may create the appearance of partiality.

The Chairperson of the Committee shall refrain from writing viewpoints during the period comtion and continuing through the date of the election, including any extended period.

(e) A member of the Committee who violates the provisions of Paragraph A (4) (d) or whose family member violates the provisions of Paragraph A (4) (d) shall immediately be removed from the Committee.

(f) Nothing contained herein shall be construed as limiting a member of the Committee or a member of his/her immediate family from voting.

5. There will be one vote per occupied unit by residents who were shareholders of record on March 22, 2023. Quorum shall be determined based upon one share per occupied unit and not based upon a percentage of dwelling units.

6. Voting, by mail or electronically, shall be deemed to be “in-person” and will commence at 6:00 AM on Monday, May 1, 2023 and conclude at 9:00 PM on Friday, May 26, 2023, unless extended in ballot issued by Riverbay is received before 6:00 AM on Monday, May 1, 2023 it shall not be disif otherwise valid

B. RULES FOR ELIGIBILITY OF CANDIDATES

1. A candidate must be a resident shareholder aspancy agreement and the current Occupants Annualtinue to reside in Co-op City for the entire term of

2. No more than one resident shareholder of a single unit may be a candidate for the Board; and no more than one resident shareholder from a single unit may concurrently serve as a Director.

3. No candidate may be indebted to Riverbay on are counted. If a candidate is indebted to Riverbay on any of those days, the candidate will be disqualithroughout the election period for unpaid carrying charges or other debts to Riverbay until the candidate is sworn in, if elected. A candidate shall not be indebted to Riverbay for purposes of this rule if their monthly carrying charges and maintenance are fully paid by the 10th day of the month in which it is due. At the close of business one day prior to the Riverbay’s Finance Director will provide a written list to the Chair of the Election Committee of all candidates’ indebtedness to Riverbay, if any.

4. Prospective candidates may, after signing the required authorizations for background checks and -

for election to the Board if they:

• are shareholders of record;

• maintain their primary residence at Riverbay, Corporation,

• do not hold a political party position or public

• have not been convicted of a crime against the Corporation,

• have not been removed from the Corporation’s Board of Directors, or from employment with the Corporation for cause; and

• are otherwise in compliance with the requirelaws, governing documents and their occupancy agreement.

(a) Prospective candidates shall sign and complete a Statement of Intent in the form annexed hereto as Exhibit A, and submit the executed Statement of Intent to the Election Committee by email, addressed to Riverbay2023Election@riverbaycorp.com, on or before midnight on March 24, 2023. In the event that the prospective candidate lacks access to email, then the prospective candidate shall return the completed Statement of Intent to the Public Safety Department, attention Riverbay 2023 Election Committee. On the prospective candidate will be checked and a background check shall be initiated.

(b) A candidate who is current on a written arrearage agreement shall be considered current on charges to Riverbay if such candidate is not otherwise indebted to Riverbay.

(c) In addition to the Statement of Intent, prospective candidates must also execute and return with the Statement a document acknowledging the candidate’s receipt of the Rules, the candidate’s agreement to abide by the Rules, and an authorization to perform a background check of the candidate

C. RULES FOR CERTIFICATION OF CANDIDATES

1. The Committee will verify a prospective canby 12:00 noon on Friday, March 31, 2023. Notice in the Co-op City Times on Saturday, April 1, 2023.

2. on the Rules for all candidates or their designees on Monday, April 3, 2023 at 8:00 PM.

3. A random drawing will be made to determine the order of placement of candidate statements and free campaign ads in each of the three election issues of the Co-op City Times and the order of speakers at the Candidates’ Forums. The drawing for order of

speakers will also determine the relative position of each candidate’s name on a ballot. Candidate names on the ballot will automatically rotate. The name of each candidate on the ballot must correspond to the name of the candidate as it appears on his/her occupancy agreement and signature card, or the name by which each candidate is commonly known.

D. CAMPAIGNING STANDARDS OF CONDUCT

1. Except as provided in Rule E (3), no audio and/ or video equipment, other than personal electronic devices, may be used at Election Forums, outdoors in Co-op City, or in building lobbies, elevators, or common areas, by candidates or by those campaigning for candidates in connection with the election.

2. The posting of all campaign signs, literature and other material (posters, gummed stickers, etc.) in Co-op City is prohibited except on personal property, or within a shareholder’s premises, with the is not limited to, lobbies, elevators, bulletin boards, walls, doors, garages, vehicles, commercial stores located on Riverbay property, and common areas. Candidates and their supporters are prohibited fromerty if said posting violates any City, State or Federal law.

(a) Residents, employees, candidates and their supporters may remove any improperly posted non-electronic campaign material, as a service to Co-op City, and the Committee will cause a notice to this effect to be published in the Co-op City Times.

(b) Candidates shall, if requested by the Committee, remove or modify any electronic campaign material or data posted to any website, Facebook page, Twitter account, Instagram account, or similar electronic forum, under the Candidate’s control, if the Committee, in its opinion, believes that said material is false, defamatory, deceptive, or constitutes a personal attack on another candidate. Examples of a personal attack include, but are not limited to, comments upon a candidate’s physical appearance, disability, religious beliefs, gender, race, mental state, mental capacity, or false assertions of criminal acts. In addition, Candidates shall, if requested by the Committee, disassociate themselves from, and request that any third-party or third-party website, Facebook page, Twitter account, Instagram account, or similar electronic forum, cease and desist from the publication of any emails, materials or posting relating to the election or any candidate for election, if the Committee, in its opinion, believes that said material is false, defamatory, deceptive or constitutes a personal attack on a candidate.

(c) Candidates shall not (i) use social media or email anonymously or under an assumed name, (ii) engage in personal attacks on fellow candidates or shareholders, or (iii) make defamatory statements. Any such conduct shall be a violation of these rules Committee.

(d) Candidates and/or their supporters, shall not use robo-calling or similar systems to contact shareholders for campaigning or election related purposes.

3. Except for the material prepared and published by Riverbay as described herein, all campaign material used, posted, transmitted or distributed by or for a candidate must include the name, address, or issued such email or campaign material, and in the case of an organization, the name of the chairperson or treasurer.

4. Campaign literature may be slipped under apartment doors between the hours of 8:00 AM and 10:00 PM, and campaign handouts are permitted.

5. The unauthorized use of the Riverbay logo in any form is prohibited for use in or on campaign materials, including electronic forms such as social media and e-mail. (Continued on page 25)

6. No member of the Election Committee, the Board, or any of Riverbay’s employees, management staff, or contractors, can participate in any prize(s) approved by the Board during the election period.

7. Riverbay shall not be liable for any defamatory statements made by any candidate, or by any person or entity in the course of the election campaign, nor shall Riverbay be required to insure, defend or indemnify any such candidate or conduct. Candidates agree to indemnify Riverbay for any and all costs and expense incurred by Riverbay, including attorney’s fees, incurred by Riverbay in the defense of any defamation claim arising out of any statement or publication of any kind made by said candidate, or by any person or entity acting on their behalf, during the election.

8. It is inappropriate for any person or entity doing business, or soliciting business with Riverbay, including present or prospective managing agents, contractors, vendors, professionals, unions, their employees, commercial tenants, or persons having a direct or indirect interest in such companies, to make campaign contributions or pay campaign expenses, whether in cash or in-kind, of persons running for the Board. Directors of a corporation acttion and are required to place the corporation’s interest above their personal interests. 2. The use of any outdoor space owned by Riverbay for public gatherings of three (3) or more people related to the election is prohibited.

No candidate or organization may use the facilities or public meeting areas, community rooms, lobbies, hallways, mail rooms, building association rooms, or similar areas of the Riverbay Corporation for gatherings of more than ten (10) individuals at one time, or for campaign rallies or activities, except as provided herein.

4. At no cost, Riverbay will publish pictures of each candidate and up to three (3) different narrative statements or articles by each candidate in successive print and electronic issues of the Co-op City Times beginning with the Saturday, April 15, 2023 issue. The Editor shall set the deadlines and technical standards for these submissions. All candidates’ articles will be reviewed by the Committee prior to publication. The Committee reserves the right to delete any material which in its exclusive opinion contains libelous statements, personal attacks, or material misstatement of fact.

(a) In conjunction with the statements described herein, Riverbay will also publish at no charge a ¼-page campaign ad by each candidate in successive print and electronic issues of the Co-op City Times beginning with the Saturday, April 15, 2023 issue. The same ad will be used in each of the issues and will appear opposite each candidate’s article for that week. The Editor shall set the deadlines and technical standards for these submissions. All ad copy will be reviewed by the Committee prior to publication. The Committee reserves the right not to publish, or to delete any material, which, in its opinion, constitutes a libelous statement, personal attack, or material misstatement of fact.

It shall not be deemed to be “political” for a non-candidate Board member to describe the activities and achievements of the Board as a whole, including the activities of any incumbent candidates. In the event Board members wish to publish a joint Viewpoint, they may do so, but only if the Viewpoint has been unanimously approved by the full Board.

(c) Management shall not endorse any candidate or slate of candidates. However, information of a non-political nature, for example, relating to the opproperty, or to an emergency may be published by Management during this period of time.

(d) In the event that an article appears in a print or electronic publication other than the Riverbay sponsored publication, which is currently titled the “ Co-op City Times, ” in which the actions of the Board as a whole, or of an individual Board member are challenged, the Board, or the individual Board member who is challenged, shall have the right to respond in the Co-op City Times to such challenge, without regard to whether the Board member is a candidate in the election and without regard to the political nature of the comment. Any such response

shall be limited to the subject matter of the challenge.

(e) Similarly, a candidate who is not a Board member may respond to a challenge directed at the conduct or action(s) of that individual candidate.

5. Campaign ads other than those provided by Riverbay may be placed in the Co-op City Times, subject to Paragraph D(3), but must be paid in full at least 48 hours before the normal deadline of an issue. The Committee will review all paid campaign ads prior to publication and reserves the right to reject any copy which, in its sole judgment, contains libelous statements, personal attacks or a material misstatement of fact.

6. (a) The election of directors to the Board is a right of residents of Co-op City. Employees living in Co-op City are encouraged to exercise their rights as residents of the community during the election within the scope of this policy. All Riverbay employees are reminded that as employees they have a duty of loyalty to Riverbay and should not engage in any activity that raises the appearance of impropriety. Participation in the electoral process must not interfere with employees’ work duties. All employees shall refrain from engaging in any activity that may be construed as an attempt to abuse their posielection. Examples of acts that may be an abuse of an employee position include soliciting donations for candidate(s), distributing campaign material for or against particular candidate(s), or engaging in any other activity that may reasonably be viewed as an abuse of position.

(b) Candidates who encourage, accept, or know-

F. BALLOTING AND CERTIFICATION

Coalition of African American Churches and Community Organizations

General Meeting – At the regularly scheduled general meeting of the Coalition that was held on March 14, the Coalition president opined that so many registered organizations in Co-op City needed to be part of the group. This is to make sure that issues that are facing several cooperators in the community could be addressed collectively through various organizations that they are part of. Thus, he called on the present member organizations to come together and speak with one voice on the issue of the in-kind service.

Community Involvement – President Toba observed that the community needs to be more involved in the issues that affect every family. First, he noticed that attendance in Community Board meetings are nothing to write home about. With the population of residents in Co-op City, it is appalling that whenever Community Board #10 meets, members from this community are not in the room. In the same vein, he charged that members of the community need to dominate the attendance in 45th Precinct Community Council meetings where crimes statistics are always presented. He voiced his disappointment on his experience at the last precinct Community Council meeting that was held here in Room 31 of the Bartow Community Center, and how there were not even 20 members from this community present at that meeting. He pointed out the fact that every cooperator needs to know the limitations of the Co-op City Public Safety Department and what the New York City Police Department is capable of doing.

Washington, DC Outreach – The Coalition has unanimously approved the idea of taking a bus trip to Washington, D.C. to tour the National Museum of the African American History and Culture between June 17 and 18. The tour will transportation, all-you-can-eat dinner and breakfast, premium open bar, DJ dance party, comedy show, Maryland Live Casino/Arun del Mills Mall and National Museum of African American History and Culture Pass.

Fliers for the free African American History and Culture Museum Weekend Getaway are available and will be posted at the right time. For now, we are asking that our member organizations share via email or any social media platforms they operate on to promote the trip for proper organization and planning. At this juncture, anyone who needs hard copies to share and give out in the community should call the president at 347-327-6288. In order to facilitate the smooth planning of this tour, the following members volunteered to help, so, do not hesitate to reach Ms. Brenda Brown and Ms. Daisy Young for questions and concerns. Once again, our event will include everything your group needs including the Motor Coach transportation, meals, open bar, hotel accommodations, entertainment, and passes to the African American History and Culture Museum.
