INTRODUCTION This document shows, briefly, the final results of research actions carried out inside phase 3 (identification and analysis of excellence practices) in AGIS “RESPIRO” project (REte Sviluppo Prevenzione Inclusione Risorse Opportunità ). The whole method of research has been developed coherently with AGIS RESPIRO aims, that is to say the elaboration of methods to detect and exchange the best practices concerning prevention strategies and their effects, helping to improve professional competences of the operators of interested services and the answer to some forms of criminality; experimentation of innovative management technical strategies about criminality prevention. Particularly, the focus was on social inclusion measures through work, and on services and on support reality to work transition, as instruments for criminality prevention, including the relapsed criminals. Especially, the focus was on analysing services supporting work transition relatively to 19 cases, 13 of which national ones and 6 international ones, developed on reference macro-areas: - information and vocational guidance to work - vocational training - accompaniment to work. Starting from these 3 references macro- areas, excellence practices recommended by project partners have been selected. These excellence practices, notified by partners, were characterized by one or more of these characteristics (excellence practices selection criteria): • Integration between active work policies and formative policies (preferable also the integration or the attention on welfare policies), among services for occupation, between public and private social, between formal and informal • transferability • offer stabilization – already in practice or possible – meant as consolidation of offer level, passage from a project planning to service planning • sustainability between actions, offered services and intervention contest • experimentation or innovation (of process, of professional figures, of knowledge, of methodologies, etc.) in service supply procedures • efficiency in the management of dedicated resources (or potentially to 5
dedicate to the increase of prisoners’ occupation) • link (or actuation ) with territory networks of social support (formal or informal) We must draw the attention to the active involvement of project partners, of institutional actors involved in the project, of the territory social operators in the case studies' research and analysis (“excellence practices”), starting from the utilization of services active on partners’ territory and of the actors who work in the same territories, focusing on significant experiences developed in such contexts. Therefore, the case studies detection has been done by project partners: -

CHAPTER 1 - The research course and the examined cases In this chapter the instruments and the methodology used for research are shown, as well as the research course, with the integrations brought during the national and transnational meetings with project partners. Besides, we show the analyzed cases according to the 3 macro-areas of reference, their strength, weakness and transferability points signalled by project’s partners. 1.1 Research instruments and developed course The relived practices (cfr. summarizing scheme n.1) have been organized through a cases signalization card, investigating the following aspects: •

The relieved practices have been put into system with a signalization cases form, often integrated with interviews made through direct contacts with the referents of the analyzed services/projects, as an interview form to deepen the excellence regional practices has been arranged, according to the following points: o

Besides, through the interviews, we have collected information about the service organization and implementation, about logistic sources, about strength and weakness points (cfr.paragraphe 1.3) and about the possible improvement both for future bettering and for transferability. During the second transnational meeting, that took place in Calais, the partners were asked to deepen the transferability aspects, through the compilation of a board (in which they were asked to specify, for each case, the strength points , weak ones and the assumptions for the project functioning and above all for its transferability) and to work on a glossary, which was created starting from the description of excellence experiences, selecting the most recurrent terms (i.e.: orientation expert). This analysis activity in connection with the pertners has been considered crucial from everybody, since the research beginning, as it was considered fundamental to achieve a “common language” (cfr.chap.4) The signalled excellence practices have been re-elaborated during the research team meetings, going on with the definition of practices “macro typologies” potentially to be reinforced or to be transferred in other territorial contexts, that integrate supporting interventions with social inclusion through work, in order to prevent criminality and recidivism. 9

After collecting excellence practices and their contextualization, we proceeded in analyzing of 19 cases, carried out starting from the point of view of given services, 10
according to a logic of service steps and through a combination (“intersection”) among the different excellence experiences (cfr.Chap.3)
1.2 The analyzed cases: a brief introduction The paragraph shows the signaled cases according to the 3 reference macro areas: -

Please note that most part of the cases have been defined by the same referents for the signalization, as “integrated” (integration among work-vocational trainingaccompanying services..). A sole reference macro area has been seldom indicated in the signalization card. In most of the cases 2 references have been indicated, or all the 3; in some cases even other ones have been added. This makes understand the difficulty in putting in a “box” an excellence practice, not only because of references, but also because of supplied services; for example, the cases referable to “counters” services have also actions linked to work accompanying. Always to give examples. as far as the reference “work accompanying” is concerned, “external” and “internal” working insertion have been distinguished on purpose, but also in this case the “borders” among thematic references are not so defined: the external insertion is very often linked to vocational training Reference Macro-area: INFORMATION AND ORIENTING TO PROFESSION/WORK With reference to the analyzed cases in this reference macro-area, 7 cases have been individuated, which could be brought back to “counters services”. Among these ones, the network of Informative Counters present in Bologna “district prison” (internal), Piemonte Cartesio project (internal and external), Milan Orfeo project (internal and external), Verbania Social Inclusion Agency (internal and external), Tourin LOGOS project (external), Pavia district CO.MI.DI. project (external) and the French case DII- Dispositif d’Information à l’Insertion (external).

These projects are all definable as counters in the widest sense of the term, as physic place of access to an orienting service, with actions aiming to work insertion. Anyway all of them are characterized and linked by a global “take in charge” of the individual person, not only addressing to work insertion, but assuming also interventions, touching a widest area (family, lodging, sanitary, etc.) As far as the financing are concerned, they are for the most coming from FSE (Equal), on regional and provincial notices. The projects managing institutions are on the contrary cooperatives, vocational training centers, Foundations, Consortia, etc. Concerning the methodology and/or the reference approach, 2 aspects are principally put into evidence: the network approach and the approach centered on the person. Actually, we act from the experience of Bologna Informative Counters ( among the basic functioning principles there actually is the network work and the personalized projects), to Cartesio project, in which it is spoken about concerting methodology (with reference to GOL wide network), as well as about Social Inclusion Agency, in which the person “take in charge” process is pointed out. Again in LOGOS network methodology is treated and in CO.MI.DI we refer to the integrated system among services, flexibility and personalization of interventions and proposed courses: Concerning ORFEO project, integrated service and public/private mix are treated. Passing to the analysis of problems survey mode the final beneficiary are bearer of and to which the service wants to give an answer, is a transversal characteristic of counters having interviews with the beneficiaries when arriving for the first time, which is the moment when we verify if the question is coherent or not with the service objectives. This happens to the operators themselves of the counter/service, through data survey instruments. The problems are relived, always through interviews, also by beneficiary’s initial reference services (reference network): prison educators, UEPE social assistants, social services, voluntaries, teachers of CFPP Casa di Carità onlus, who give signalization to the counter (Cartesio). In a case (LOGOS), the Direction itself of Piemonte institutes starts a signalization 3 months before the discharge of potential 12
beneficiary of the project, in order for the operators to have the time to contact and present the service. Many people think it is basic the lasting many years experience to be able to codify in an adequate manner the beneficiaries’ needs. The beneficiaries’ problems, to which the projects/services try to give an answer, are, generally, synthesizable, for all cases of this macro area, in: - access to information concerning working market themes - lack of autonomy and projecting abilities and consequently orienting counseling need - working inclusion. Together with the needs linked to work re-insertion, we often deal with ( as pointed out by LOGOS project) the solution of problems linked to primary sphere, without which the working insertion is verified, besides with social reinsertion support: - re-insertion in his/her own family - re-building of a social and friendly network - lodging needs As far as services/projects finalities are concerned, obviously counters’ principle function is to supply information
to prisoners and ex-prisoners, who cannot go
there. The principle objective is to improve the beneficiaries’ knowledge concerning working market to increase their potential occupability: They want to facilitate, as already remembered, the knowledge of prisoners and exprisoners also with respect to territory services he can refer to after serving the term, promoting in this way social insertion. Some projects have among their specific aims the ones of really finding sourcesworking and lodging- (Cartesio Project), of educative accompanying and access to right (Inclusion Agency) Other projects (LOGOS) have signaled wider purposes, such as to offer support to reach autonomy and to reduce the risk of recidivism. Among the projects’ objectives, not specifically linked with direct actions on the final users, there often is (such as in Co.Mi.Di) the promotion of cooperation among the services (for the employment, socio-assistential, educative), and the reinforcement of synergies between public and private institutions, engaged in taking in charge prisoners

Also concerning the service called “DII”, the basic aim is to increase information for the final beneficiaries in comparison with the market offers and to increase the occupability to facilitate social integration To present synthetically the signaled cases, describing the actions and the activities supplied, Bologna Counters deal with: information about concrete formative and/or working sources existing in the territory (intra and extra moenia), orientative counseling (both individually and in group), support to working and/or educative insertion , realization of illustrative material to be used by the beneficiaries of the service and by the sector operator, orienting and specifically informing foreign prisoners according to the rights of juridical protection and use of courses alternative to prison, functions of social secretary (giving information on bureaucratic proceedings and on the territory social service access), taking in charge who is coming out from prison , creating in this way a conjunction ring between “inside and outside”. Cartesio project, synthetically, foresees: welcome interviews and diagnostic filter, concerted elaboration of the project for intervention and social-working support, finding the enterprise and insertion in a section (employment) or a structure (stage with work-money-grant) of insertion , finding lodging source, support to the payment of rent and/or appliances, coming nearer to the residence place, family rejoining. ORFEO project, has got both internal and external activities: •
Actions inside prisons: meeting of group orientative information, welcome interviews, orientative individual counseling, accompanying to working insertion in social cooperatives and profit sector
•
Actions outside prisons: counter for information and working insertion for ex-prisoners and prisoners in serving a term outside the prison, finding working opportunities, individual orientative counseling, accompanying to working insertion in social cooperatives and in profit sector
•
Actions to system support: counter for counseling and normative and procedure assistance to enterprises, enterprises research for working availabilities. Sensibilization of productive context, eventual assistance for the elaboration of enterprise planning.

The social inclusion agency develops intervention for: access to the right, inside and outside the prison, working orienting and insertion (“courses of work-try”), educative accompanying on the territory (formal/informal). LOGOS project itself is also referable to the following actions: educative support, working orientative course and accompanying to active research of a working source, preparatory course to working insertion, professional course, temporary lodging source, individual psychological support, family mediation. Eventually, CO.MI.DI. project, can be synthesized in different phases: interception (interview and compilation “first analysis card for needs status”, selection ( request of “certification of needs status” at the local Employment Center), orientation, matching and working insertion. DII project, linked to information through informatics devices, sees, besides the arrangement of terminals and informatics instruments, activities such as:Working research laboratories, working orientation, relationships with the actors of the insertions (i:e.: enterprises...), etc. All the projects, of “counters” macro typology of reference macro area “working information and orientation”, have signaled the interview as basic developed instrument for the service realization. Besides they use paper and informatics instruments realized “ad hoc” to point out, during the interviews, the needs of users approaching the service and also to be able to make reports for the referent services. Both Bologna informative Counter and ORFEO project, and social inclusion Agency use registry-professional cards for the interviews and a users’ database to point out the accesses and the activated courses. They also have enterprises data banks to which refer. All the above services, furthermore, have along the years arranged informative leaflets addressed to prisoners, enterprises, other operators. Cartesio project uses a filter card diagnostic, material, made in a concerted way. LOGOS project besides the signaling card and the informatics data base, fill in PEI (Personalized Educative Planning) to individuate the needs relative to finding a new stable lodging source. CO.MI.DI. project uses more structured cards: - First analyses card for needs and finding criticalities about previous experiences - Survey card for the enterprise characteristics 15
- Evaluation card about the enterprise edited by the inserted person - Monitoring card Obviously, all projects expect reports (monthly, three-monthly...) and/or équipe verify meetings addressed to financing institutions and to beneficiaries referents’ services. As far as DII project is concerned the instruments is really the informatics device arranged for the access to information Another common aspect to all mentioned services is the type of involved professionalisms , which is principally indicated as “counter’s operator”, who is recognized competences such as: - education and experience in support activities for working insertion of particularly “weak”users in the work market or “disadvantaged” ones; - competences of relationship and of facing individual and collective problems; - great ability of listening to and observing ( to comprehend the question and interpret the kind of user’s need) and of projecting (to evaluate constraints and specific sources for the single situation in compliance with the possibility to solve the user’s matter); - knowledge about working rules and employment procedures referred to different workers’ target. Another basic figure, who in some projects corresponds to the counter operator figure, is the professional orienting person , who works directly in contact with people to build with them the working profile, to individuate strategies to find an employment and to elaborate disposable instruments for research. In the end, for the projects expecting working insertion actions, it is signaled the work accompanying tutor, who keeps the contacts with the enterprise and with the referent services. Some projects ( such as Cartesio and Co.Mi.Di) signal, besides the accompanying tutor, the tutor of the host enterprise. Furthermore, for some specific projects (Cartesio, ORFEO, CO.MI.DI.), there are professional research operators of enterprises/promoters. In some services (Counters of Bologna district prison, social inclusion Agency) there are also the social cultural/intercultural mediator and the social assistant or the professional educator.

The social inclusion Agency has inside its structure a figure not present in the other projects and even signalizes as not-present in the whole Italian panorama, that is to say the agent to right access, that represents the reference about juridical matters of the people addressing to the service. He/she arranges administrative and/or jurisdictional petitions, free counseling, control of courses feasibility, analysis of the person legal situation, connection with police services and with competent jurisdictional authorities. LOGOS project has inside its structure educators and psychologists Cartesio project involves also the figure of the fund raiser, with the specific task to activate public and private channels to find the financing sources necessary for the project realization. As far as DII project is concerned, it assumes the presence of an animator with the function of explaining the use of informatics device. Basic aspect, pointed out more than once in all projects, is the one of reference network and of connections with territory services. For most of the projects the network is quite wide and consolidate in the years. Bologna Counter is controlled by a project Technical Committee formed by, besides managing institution CEFAL, by Province, Municipality, District prison, UEPE and territory associacionism. it is tightly connected both with working system (as it is direct output of Employment Center) and social services , in their widest meaning. Cartesio project has connections which realize themselves inside GOL (Local Operative Groups), parts of which are Prison Administration, UEPE, Municipalities, Provinces, Employment Centers, social assistance services, social cooperatives, social private organizations, vocational training institutes, voluntary associations, through suitable conventions. Also for the inclusion Agency, the referent network is the one inside local GOL. It is a network of a formal/institutional nature. More “operative� connections are with the Ser.T, the territory social services, the Order Forces, Caritas listening centers, the trade-unions, the social cooperatives. The direction of Orfeo project attends several territories Coordinating Tables. The inside network is composed by all the cooperatives adhering to partner Consortia and all founder members of AgeSol, as well as the Employment Services of Milano Province and the territory enterprises system. 17
Also LOGOS project équipe works in connection with GOL of Torino Province and, with territory social Services, the Adults in Difficulty’s service of Torino Municipality, the Ser.T,City Register Office, the Employment Centers, the treatment Area of Prison Institutes, UEPE, profit Enterprises and social Cooperatives. Co.Mi.Di. project has been inserted, since its constitution, inside the Area social Plans of Pavia Province: The project can rely on a wide provincial territory network of public subjects (Employment Centers, Ser.T, Municipalities), private ones (Vocational Training Centers) and the social private (Voluntary People Associations, social cooperatives)) developing the role of “sending services”.
Reference Macro-area: VOCATIONAL TRAINING Vocational training macro-area collects signalizing of training activities directly developed in enterprises or aiming to enterprise’s constitution. 2 cases have actually been signaled : one of them uses the training stage instrument and, that is to say, the case of Emilia Romagna called Courses of training stages for the promotion of prisoners working insertion (training stages L.196/97 so called “Treu”). The other one refers to training course aiming to auto-enterprises (VIRGILIO project), bound to the constitution of some cooperatives inside Bollate prison. We would like to point out that in both cases we deal with signalizing of realized experiences inside the vocational training world, but they do not result structured in the “classic” mean (i.e. professional courses intra-moenia)In the first case we actually have the description ofapplicative interventions by a vocational training institution of training instrument L.196/97 (training courses with source of coordination, tutoring, beneficiary attending indemnity, covering of insurance and Inail costs) for prisoners, people serving a term outside the prison and ex-prisoners. In the second case we deal with the arrangement of training models in order to train participants/members of social enterprises and to support them in the phase of cooperatives constitution. The “training courses L.196/97” have a financing coming from the Province (ForlìCesena) and from Emilia-Romagna region through the European Social Found, 18
managed by a public institution of vocational training (Techne S.C.p.A). VIRGILIO project is promoted by the Milano Province, together with consortia and associations, with regional financing. In “Training courses L.196/97” it is pointed out the used methodology, that is to say the immediate approach , centered on the inter institutional coordination, on the sharing of sources/opportunities and on trans-disciplinarity of operative équipe. It is considered the host enterprise’s research, found also on the basis of its availability to follow the insertion with an employment (this determines a higher difficulty in finding the initial enterprise, but a higher guarantee of a follow-up insertion after training). VIRGILIO project methodology is based on auto-starting of prisoner subject, in view of a growth both individual and professional, of acquisition and valorization of competences and knowledge. The problems survey of final beneficiaries, such as, synthetically: individuation of a working context and adequate economical sources, acquisition of a role and a working identity, reinforcing also the social one, the acquisition of information and knowledge about territory services, the individuation of references points on the territory when leaving the prison, mediation with working destination, etc., takes place through: - individual interviews with the users - comparison and analysis of the cases with social, sanitary, prison operators - examination and weekly verification moments during the accompanying to work - periodical meetings with the operators involved in the refence area For VIRGILIO project it is said in general to answer the need to predispose to working world insertion, to better everyone’ professionalism, to face productive rhythms and working modes similar to the outside’s ones. The purposes that the projects intend to pursue are: - to contribute to the development of occupability and the beniciaries occupation through the realization of training stages, - to form the person to work, to strengthen their professional competences and the knowledge of working world services,

- to form the person for the working place relational context, for the interpersonal relation management, to be aware of his/her role consciousness and for ability in solving conflicts, - to promote and realize an effective, stable and possibly satisfactory working insertion. In Virgilio project, besides, there is the will to promote and develop the culture of work inside the Penitentiary Institution. Considering the purposes, the given activities are therefore referable to: •

In comparison with “classic” stages established by “Treu” law, the stages project, enabled in Emilia-Romagna territory, is different , or better is personalized, in respect to: - duration: they usually are very short, about 2 months; - insertion typology, which is pretty always effected in a non-profit enterprises, - the finality established with the enterprise, to which it is immediately prospected an employment interest after the stage’s end . Virgilio activity is composed by three modules: - Motivational laboratory for social enterprise (theoretical educative actions, seminaries of in-depth analyses, testimonies). - Constitution and starting up of social mingled cooperatives with prisoners and nonprisoners' cooperators2. -

For the project realization, also in this case, suitable instruments are set up, which are, concerning “training courses L.196/97”, besides
conventional instruments
established by the law 196/97: a relieving data card, an individual curriculum card and a monitoring training card. As far as the “Integrated interventions” are concerned, it is used, as previously said, a needs relief card, besides the professional database card. VIRGILIO project uses instead interview evaluating selecting cards, apprehending auto evaluation cards, teacher evaluation cards, pupils monitoring cards. The professionalisms involved in the projects are educational tutor and enterprises research operators. In the inside insertion project (Virgilio) there is the signaling of educational coordinators, social operators (orienting people, class tutors and experts of working active
policies)
and
counseling
of
company,
commercial
and
marketing
development. Concerning the reference network , the trainings activated in Emilia-Romagna, besides institutional network components such as Province, Penitentiary Institution, UEPE, etc., have seen the involvement, for enterprises individuation, of Employment Centers and trade unions. With concern to Virgilio, premises to education and to cooperatives’ constitution, has been the creation of a Direction Cabin (formed by project referents, Prison Direction and a Sodalitas expert) with the function of monitoring , analyzing and counseling in all project phases and of connection with the outside network, and the institution of an Operative Table composed by the Direction and by all the cooperatives and the enterprise running working activities in Bollate prison.
Reference macro-area: WORKING ACCOMPANYING Inside of this macro-area, it has been considered possible to make a distinction among projects referable to outside prison working insertion (5 cases). other ones referable to laboratories constitution (2 cases) and other ones that can be brought back to activities of coordination and connection with integrated services (3

cases), in the logic of prisoners’ accompanying to work, with a global taking in charge by several services As far as the accompanying towards the outside, there has been signalizations about a social cooperative of working transition (Cooperative IT2 of Bologna), a French project of taking in charge of young people for a socializing course (PJJ – Parcours d’insertion
pour jeunes sous Protection
Judiciaire de
la Jeunesse) and
eventually the 3 Spanish projects (Arin 8, T1 BC – Trabajos en benficios de la comunidad and INCORPORA) for assistance to people at risk of social exclusion , through the insertion in activities laboratories. The inside insertion cases are on the contrary linked to specific laboratories. In the first case they deal with recovery laboratories of electric and electronic devices RAEE) of Emilia-Romagna (Laboratories HERA RAEE); the second one involves only prisoner women, in taylor’s workshops and inside call center, with insertion perspectives in outside laboratories (STRA.LI project of Lombardia). We must point out that, concerning RAEE laboratory, the excellence practice is linked more to the construction of inter institutional networks to realize activities (therefore to start up) than the realization/management of the laboratory itself. Eventually, in this macro-area, we have included some projects having as intervention focus the activities coordination and the services concertation, in an integrated way: the personal projects cases of TESI (Tutoring and Integrated Services), realized inside Bollate prison, a French project (GOAL – Groupement Opérationnel des Acteurs Locaux) and Piemonte case called Integrated Intervention for the social and working reinsertion). As far as Italian cases financing are concerned, they are for the most coming from communitarian projects, or coming from Foundations. In the project Integrated Interventions it is pointed out the attempt to harmonize interventions and available sources, through institutional institutes. Then, the projects are promoted by vocational training institutions ( with concern to cooperative IT2), and run by Support Agency for work AgeSol, with concern to TESI. Also French cases are financed by FSE, together with Ministries (Justice and Work) and managed by ACEP. Spanish projects are financed and managed by Agiantza Association, together with the penitentiary services.

The “Integrated Intervention” project is financed and run by Piemonte Region (Department of Occupation Politics and by Torino Province, which has the coordination on GOL territory, formed by an institutional component (Province, Municipality and prison seats) and one of social private Voluntary peoples, social cooperation). At last, concerning STRA.LI project, the head institution of ATS (Temporary Purpose Association) is a consortium of Social Cooperatives. As far as the reference methodology is concerned, in any case the individualized approach is used, with the definition of a plan of personalized intervention ( i.e. for Spanish cases and for STRA.LI and IT2 projects) which is declined in different ways. In the case of It2 Cooperatives for any person, in tight connection with the services, an individual project is elaborated for a professional and personal improvement, that combines work and education, defining times, methods and supports necessary to the beneficiary. TESI project and Integrated Intervention project are the cases more characterized by a global approach on the individual ( with intervention on single criticisms, with a sort of a “social tutoring” used in a flexible way) and by an integrated approach (centered on : inter institutional coordination, sharing of sources/opportunities and trans-disciplinarity) The methodologies of GOAL and PJJ cases refer to concertation among the territory actors At last the specificity of STRA.LI Project is in the fact of stressing the valorization of type dimension. All the work accompanying projects have the purpose to answer the problem of working and social reinsertion of people, in a situation of exclusion, through the support of a referent figure (tutor, transition responsible...) able to orienting, facilitate the access to the services and to support in links recovering. TESI project needs’ areas are widest and are divided in : documents and legal practices, sanity and dependences, family and parenting, work and education, lodging. At the beginning problems are relived through the signalization of referent’s penitentiary services and, afterwards, through interview aiming to build a “personalized project” (Integrated Intervention project, particularly).

Spanish projects have as a reference a specific district in Bilbao, so that the problems’ survey comes from the uneasiness direct knowledge. Also concerning RAEE laboratory constitution we stress on the direct knowledge and the experience of penitentiary matters to relive the problems ( project’s promoters have decades of experience in running educational activities inside penitentiary institutes). With STRA.LI there is the purpose to reach an occupation increase both inside the Institute and the outside work as foreseen by art.21 O.P. and in general from penitentiary treatment, giving an answer to a double disadvantage: the female condition and the executive term condition. The final aim that projects pursue is, as already pointed out, to favor prisoners working insertion. Specifically, as far IT2 cooperative is concerned, the aim is to make possible for the users of the transition enterprise to be able to be inserted rightly in the work market, after an experience in a protected working context inside which they have to achieve professional and transversal competences. TESI has wider finalities, of social re-insertion and autonomy acquisition by the user through the starting up of personalized courses
of social and working tutoring-
accompanying. “Integrated interventions” project underlines above all the need to avoid interventions’ overlaps, giving suitable and efficient answers to the needs final beneficiaries are bearers, for a global taking in charge of the person through the involvement of all public and private social actors who, for specific competences and relatively to the expressed needs, are involved every now and then; to encourage the qualification of public and private services for social and working inclusion of prisoner and ex-prisoner people; to promote the territory work policies starting up combined actions of active working policies, income supporting policies, local development policies. Both French cases (PJJ, GOAL) and Spanish ones (Arin 8, T1 BC, Incorpora) have as the aim to offer efficient personalized insertion courses. The project “Trabajos en beneficios de la Comunidad” has the purpose that people, involved in this program, achieve the “redencion de la pena” which has been imposed to them, without passing through the stigmatization caused by the prison entrance, and to reach in this way a suitable social insertion. 24
It deals with people who have had a term to make a work in the benefit of the community, as alternative measure to prison: every day of work has a discount value for the term. As already said, in RAEE project inside Bologna prison, it is considered transferable practice, more than the laboratory itself, the project of planning the same: therefore the purpose was to conduct the involved actors in experimenting an active cooperation to organize and manage the productive laboratories inside the Penitentiary Institutes. STRA.LI project’s goal is to bring out, consolidate and diffuse a device of active working policy for the working integration of women in term execution, for which the alternative training is enriched by an individualized “taking in charge” If we want to make a description of the actions , even synthetic, of the signalled projects for this macro-area, we can point out as excellence practice above all the way of transition characterizing It2 cooperative, which offers working and educational integrated courses to support its workers-users in the insertion in profit and not-profit companies: •
The first phase of courses in cooperatives is characterized by a series of interviews with the operators involved in the project, aiming to define together with the user the individualized project characteristics

developed by “transition responsible”) •
The second phase is principally
characterized by training activities
(insertion in vocational training courses, or brief educational modules, preparatory to the real insertion, directly in “situation”, using specific projects or work-grants); •
The third phases characterized by the working-educational experience. Through drawing up a work contract, the users begin to experiment working situations, as member-workers;

At the end of the contract the real transition phase begins. In this case the cooperative, in the figure of the transition responsible, attends to get in touch with enterprises available to user’s insertion and supports and accompanies the user in the phase of the new insertion.
The cooperative activity is composed by the most by enterprises branches in restaurant sector, (among which banqueting and catering) and cleaning.

Also PJJ project, as well as It2, deals with taking in charge users (signalled, or better, directly granted to judicial authorities), through insertions in action enterprises partners. In case of employment in the company where the beneficiary made his/her stage, the coordinator follows the insertion course. The actions of Agiantza signalled projects are activities developed inside the association itself: bicycles repairing, outside furniture’s creation, setting up and cleaning of the association premises and garden. In the specific, besides, the participation to the project Arin 8 gives the possibility to be able to access to “social wage” and to the other supporting measures startable through different services. STRA.LI activities have developed through training-work alternation developed both inside and outside the institutes. Besides inside and outside laboratories (telework, tailors shop) are foreseen also orientative counselling, basic education (linguistic and informatics areas), technical education (telework and Taylor’ shop), motivational laboratories, support to auto promotion. TESI project’s actions , instead, are synthesizable in this way: - before discharge: cognitive interviews inside the prison between the prisoner and the tutor, in order to collect information to be used for the analysis of social, family, sanitary and professional condition of the prisoner and to elaborate a hypothesis of personalized and bearable course on the basis of signalled needs; - at the moment of release from prison: the tutor is present when releasing from the prison and he is the preferred interlocutor in this phase of strong emotional/relational im pact with the “outside” realities; - after discharge: realization of the agreed project, network with territory realities (contacts, cooperation and passage of taking in charge), monitoring in itinere. Integrated interventions develop activities of: preparing and distribution
of
informative material; welcome/information released prisoners; compilation of needs survey card and registry-professional card and their transmission to outside transdisciplinary équipe, with individuation of case referent; periodical reports’ draft for the trans-disciplinary équipe and for U.E.P.E. As far as GOAL project is concerned, the stress is on local actors’ network. It is structured in: census-taking of local insertions actors, of their functions and their possibilities; meetings organisation to put in touch the censed actors; collective work on the concrete cases; study of results and activities coordination. 26
Also in this case, as in information and work orienting heading, the instrument signalled by most of the cases is the interview. Paper instruments are contemplated in TESI project (welcome cards for defining a project hypothesis, updating reports), in GOAL project (descriptive cards of the activated course) and in Integrated Interventions(needs survey card). Arin 8 and T1 BC projects show as instruments, besides interviews, the laboratories where the activities are realized. Eventually, RAEE project, having the specificity linked to enterprise start up, as instruments shows organizing meetings, technical reports. A pointed out instrument that opens the road to laboratories is the territory agreement, where the partners’ engagements are made official concerning the total sharing of the project and objectives. It is necessary to lay stress on some involved operators signalled in these cases, being innovative and specific: It2 Cooperative, actually, has inside (besides production’s responsible, educators and technical experts) the work transition responsible, basic figure of the cooperative, referent for the project constituted together with the disadvantaged person (develops a constant activities’ monitoring), link between the user and the territory services, makes eventual signalization, takes care of the transition phase to outside enterprises, getting in touch with the companies, accompanying the user in the first interviews and supporting him in the first days of his insertion). As well as TESI project and STRA.LI one (both from Lombardia Region) use the figure of the social accompanying tutor who develops the role of support social network’s activator, giving help in practical logistic and relational
difficulties,
identifying
and
setting the
support network and
accompanying the disadvantaged person in the realization of a professional and life project. In the other signalled cases, instead, it is more generally spoken about a projects’ coordinator, who works relating with the users and with the other present figures, who can be . for example concerning Arin 8 project, social educators, “instructors”, who realize the laboratory activities (carpenter’s works, bicycles repairing...) and make a monitoring the socio-professional abilities. In the inside insertion projects (RAEE and STRA.LI projects) it is spoken about coordinators, responsibles, technicians, teachers and educators, tutors.

In STRA-LI project, furthermore, it is signalled the figure of training planner with competences of “category”, figure that analysis the educational needs, finds the meeting places between demand and supply of work, describes the intervention purposes and monitors, in general, the whole project. The key figure of Piemonte project Integrated Interventions, instead, is not a single professional figure (if we do not consider the territory coordinator of Italia Work and GOL coordinator), but the trans-disciplinary équipe itself, composed by operators coming from different disciplinary places, chosen on the basis of courses’ construction and the management of the same, that constitutes, obviously, also the reference network. In the équipe are involved also employment Centres competent for the territory, inside treatment Direction, UEPE with SPIN counter, Social Services, Sanitary Services (particularly Ser-T operators), educational, orienting and working insertion agencies, social cooperatives, enterprises, cultural and sport associations, Parity Counsellor of Torino Province. The reference network and relative connections with territory services are put into evidence in all the signalled projects, defining them a basic assumption for the service maintenance and for a possible transferability. It2 cooperative network is very wide, as it can be deduced also from supporting institutions:

The association is also linked with Basque Government, with working and enterprises’ world. These projects network is composed not only by Bilbao territory services (the city of Spanish Basque countries, seat of the association and the signalled projects), but also at provincial level. Wider networks, at European level are composed also by: EAPN: fight network against poverty, REAS: network of

Incorpora Project reference network, on the contrary, is composed by 3 institutions: Agiantza Association, Penascal Foundation and Bilbao Caritas Diocesana. RAEE laboratory planning initiative is actually characterized by the integration among penitentiary policies, working and formative active policies, socio-sanitary policies.. Particularly, the network among
educational Institutes, Penitentiary
Institutes and Administration, Social and sanitary services (through the involvement of “Local Committees adults terms execution), Involved Provinces Territory Assessor, permitted to act sharing competences and sources. Among all subjects involved in the network, a Territory Cadre Agreement has been stipulated. On the basis of planned good practices and on the basis of concrete engagements taken by the parts to guarantee the entire activity sustainability. For Project STRA.LI an ATS (Purpose temporary Association) has been constituted, with a strong network both inside and outside. The partnership
comprehends,
besides Cooperative Consortia, also the Assessor Right and Defence of citizens and for the integration of restricted liberty people of Milano Province and Lombardia CGIL. TESI project considers the connections with the territory a basic aspect for the management of the project itself, having the need to “hook” users to services network. Therefore it has been shared ,with all territory significant referents, everything has been developed with beneficiaries. The agreement and sharing with people works inside the penitentiary Institute has been formalized with the constitution of a Coordinating Table. For “Integrated Interventions” project, we have to point out the tight relation among active counters on the territory: SP.IN Counter, Listening Counters for prisoners of social consortium Abele Lavoro; Listening Counter of Sinapsi consortium of Eta Beta cooperative; Listening counter of Self consortium. Finally, GOAL has strengthened the relation with all the actors involved in beneficiaries intervention, particularly about 20 public and private actors, meeting once a month for a coordinating committee of territory actions

1.3 Strength and weakness points, transferability of analyzed experiences As far as reference macro-areas “Working/professional information and orientation” and “Working accompanying” are concerned, it is possible to individuate common transversal elements. Actually there was the occasion to observe that in pretty all the analyzed cases, a wide network is present (formed by public/private), thanks also to GOL concerning Piemonte, or at the presence of project/committee tables. There are always connection forms, formal or informal, with territory services. This connection with services allows to realize interventions, using a global approach on the user: this vision can be found transversally in pretty all the cases (sometimes effective, sometimes expected) and it can be reconduced to a “take in charge” of the beneficiary not focused only on “working problem”, but it can be realized through a shared elaboration of interventions. Another consideration about the “take in charge” is kinked to interventions personalization, that is to say the starting of insertion courses ad hoc on people, where the person centrality becomes the necessary condition to favour their working re-insertion. As far as “vocational training” axe is concerned, we must signalize the role played by enterprises and the connection between education and work insertion, strongly addressed to outside, characterized by the experience of company’s stage. Through interviews projects’ referents have been asked to put into evidence the strength and weakness points of signalled service/project, in order to make a hypothesis, among other things, about a possible transferability. With concern to strength points signalled for the “counters”, it comes out to be central the connection with services: in a case it comes from the Employment Centre,
with
social services integration (Informative counters of
Bologna
Penitentiary), in another one it is spoken about a connection with the Region for the creation of transition enterprises (Cartesio), on the model of Soc.Coop.It2. In ORFEO and Co.Mi.Di. cases, the connection is between active working policies for prisoners and services concerning the person in general, in a point of view of global taking in charge. for LOGOS, finally, the exchange with Institutions is central. Therefore there is the prevalence of network working methodology (formal and informal network) and the global taking in charge of beneficiary. 30
On this purpose, the Iclusion Agency signalizes among strength points the need of take care of single needs, to avoid interventions’ scattering, through an integrated service which is able to synthesize working insertion, welcome and accompanying interventions on the territory. Another positive aspect is the consolidation of signalized cases, which passes from a project logic to a service one, having also financing security, such as for exemplum in LOGOS project. Among Cartesio points of strength there is, with no doubt, to have created “insertion sections” (cfr. chapter 4) a model addressed to profit enterprises so that inside them laces for prisoners employment are reserved. Also for educational axe, we have to signalize above all the network aspect, which, for example, in the case of training course of Emilia-Romagna is developed above all with trade unions, while for VIRGILIO project is composed by different realities, meeting monthly through a Direction Cabin, with functions of monitoring, analyses and consulting in all the phases of the project and an Operative Table, composed by all the Cooperatives and companies managing working activities inside the prison. As far as the working accompanying axe is concerned , the partnership importance is pointed out (French practices), together with the reasons of people working in it, able to create a strong emphatic relation with beneficiaries (TESI). The strength point of T1BC project is, of course, the one of giving an opportunity to “avoid prison”, serving the term in an alternative way, working for the community and to be a referent point for many people present in Bilbao district where the activities are carried out. Also RAEE laboratory project stresses the informal and formal
relations (cadre
agreement, meeting tables), monitored by continuous follow up. Stra.Li, eventually, has among its strength points to have stressed the category and to have undertaken two dimensions of analysis, the prison and female condition. Considering weakness points, a lot of projects point out above all financings indefiniteness, which do not offer continuity to projects or do not guarantee adequate course, as well as the difficulty in getting in relation with the “penitentiary world”. Spanish projects put into evidence the shortage of means and financings. The weakness points linked to financings are referable also to a shortage of
lodging
sources
(Integrated
Intervention),
to
difficulties
of
economic
sustainability of the figure dealing with transition (It2, TESI), to the taking in charge possible only for few beneficiaries (Stra.Li, INCORPORA). ORFEO project, besides, 31
points out the lack of a figure of a “professional” social tutor, possible only for few cases. VIRGILIO project,on the contrary, put into evidence the difficulty of interacting with penitentiary system with regards to transfers, disciplinary measures affecting cooperative balance and functioning. In the end, we give here below the signalizations referable to transferability of signalized experiences. It is necessary, above all, to stress the territory referent: some signalization are actually concerned with territory contexts not metropolitan, with the presence of penitentiary institutes relatively small, or based on a strong treatment logic. In a very schematic way, we give here below, the principal signalled assumptions: •
For the counters of Bologna Penitentiary Institute, one of the assumptions for transferability is the connection with the Employment Centre

Cartesio project sees as transferable (to different kinds of disadvantage) the insertion sections addressed to profit enterprises.

ORFEO project is considered transferable, being already experimented in more than one prisons: for a complete transferability it is to be stress also that it is necessary to strengthen companies research and always foreseen the social tutor figure

The Inclusive Agency is a flexible project, which needs very few operators, but it has also experimented in a not metropolitan context (Verbania)

LOGOS subordinates its transferability to the forecast of dedicated founds and Co.Mi.Di. to the constitution of a public/private network

STRA.LI project is characterized as an experimental one finished in November 2007 with transferability objectives, through the promotion and development of interventions on the other Provinces of the Region, seats of female prison sections. The assumptions to realize of similar projects in different contexts are linked to political will of financing public institutions, to the cooperation with outside productive realities and to the relations of trust and cooperation with penitentiary Directions, as well as, in the specific project, obviously, a knowledge and attention to the problems and category specifities.
In TESI project, finally, it is pointed out the possibility to transfer the tutoring and social accompanying models.

CHAPTER 2 Normative frameworks of reference contests of notified excellence practices In this chapter, the normative frameworks of reference contests, sent by AGIS RESPIRO referents, are quoted and briefly described. This research activity, which permitted to individuate the national and local laws present in the territories in which the detected excellence practices are inserted, is useful both to insert the project partners signalled practices in their own contest and to detect the contests with a similar normative framework and where, therefore, an intervention to experiment successful experiences transfer, without legislative changes, could be possible. Here below are reported initially the “European reference framework”, the” national” ones (Italy and Spain) and subsequently the” regional and local” ones, briefly describing every law/decree/ agreement.
2.1 European
Recommendation n. 87(3) of Ministers Committee of European Community 12th February 1987 – European penitentiary rules Penitentiary work should be considered as a positive element of the treatment, of prisoner’s education and of the institute’s management. If possible, the work should be able to preserve and improve the prisoner ability to earn normally his living after dismissing. It should be offered a vocational training for jobs useful to prisoners who are in a condition to profit of then and, particularly, the young ones. Within the limits compatible with a rational professional selection, with administration possibilities and the institute disciplinary exigencies, the prisoners must be able to choose the kind of work they wish to do. Recommendation n. 12 of Ministers Committee of European Community 31st October 1989, about “Education in prison” This Recommendation has been realized with the contribution of a selected Committee of experts and it is inserted on the contents of “European Penitentiary Rules”. In the same it is confirmed the fundamental role that education has, both for individual growth and for the community one, but the brought true innovation 44
is to have put into relation, for the first time in European context, the tight link between prisoners and their previous problematic school experiences, being this last aspect object of strong quarrels in the analysed years. Recommendation n. 16 of
Ministers Committee of European Community to
Member States, relative to European Rules about Terms and Alternative Measures to prison, adopted by Minister Committee on 19th October 1992, in the 482° meeting of Ministers Delegates They have the goal of: a. to establish a set of rules allowing national legislators and the involved operators, the Authorities put in charge to decisions or the organizations charged of execution, to assure a right and efficient appliance of treatments and alternative measures to prison. Such an application must aim to preserve a necessary and hopeful balance between, on one side, the exigencies of society defence, in its double aspect of public order’s protection and application of rules, aiming to repair the damage caused to the victim, and, on the other side, to take into great account the necessities of the guilty person in terms of social reinsertion. b. to supply Member States with basic criteria addressed to integrate the creation and the recourse to treatments and alternative measures to prison, with the guarantee against the risk to damage the basic rights of people committing crimes, to whom the same ones are applied. c. the execution of alternative measures must be realized with a constant attention to individuate, that is to say in an adequate way to committed facts, to penal answer, to the personality and inclination of the subject. And the possibility to refer to a regulation established at international level should improve the experiences’ exchange, particularly in working methods area. Meant parallel to Penitentiary Rules of 1987, the present rules can not be considered as type-rules. They rather represent a set of exigencies, susceptible to be normally accepted and respected

Regulation (CE) n. 2204/2002 of the commission Article 2: “disadvataged worker� means any person belonging from category having difficulties to insert, without assistance, in the work market, that is to say any person satisfying one of the following criteria at least: i) any young person less than 25 or who has completed the full time education not more than two years before and has not obtained

employment yet; ii)any migrant worker moving or who has moved inside the Community or becoming resident in the Community to have a job; iii) any person belonging from an ethnic minority of a Member State, having to improve his linguistic knowledge, his vocational training or his working experience to increase his possibilities to obtain a stable occupation; iv) any person wishing to undertake or to take up again a working activity and who has not worked, nor followed training courses, for at least two years, particularly any person who has left the work for the difficulty to reconcile working life and family life; v) any adult person living alone with one or more children at charge; vi) any person without a school title of secondary level or equivalent, without a work place or going to lose it; vii) any person more than 50 without a working place or going to lose it; viii) any person unemployed for a long time, that is to say a person without work for 12 of the previous 16 months, or for 6 of the 8 month before in case of people less than 25; ix) any person recognized as affected by , at the moment or in the past, a dependence according to national legislation; x) any person who has not obtained the first employment regularly paid since he was submitted to a prison term or other penal term; xi) any woman from a geographic area at level NUTS II in which the middle unemployment rate is more than 100% of communitarian average since at least two civil years and in which the female unemployment has overcome the 150% of male unemployment rate of the considered area for at least two out of the three previous civil years.

Treaty of Lisbona (13th December 2007), signed by all European Union leaders. The treaty of Lisbona modify the treaty about European Union and the one establishing the European Community, in force at the moment, without however substituting them. The new treaty gives the Union the juridical
cadre and
instruments necessary to face the challenge of future and answer the citizens’ expectation. The Treaty of Lisbon improves the action cleverness of EU in different priority sectors for today’s Union and for its citizens. It is particularly diffused in “ freedom, security and justice”, to face problems such as fight against terrorism and criminality. It also completes The Chart of basic rights in European primary right, foresees new mechanisms of solidarity and guarantees a better protection of European citizens.
2.2 National Italy Constitution of Italian Republic Art.27:The penal responsibility is personal. The accused is not considered guilty up to the final conviction: the convictions can not consist in treatment contrary to human sense and must aim to re-educate the accused. Death’s sanction is not allowed. Law n.354/1975 – Regulation on Penitentiary Organization This law articles are concerned with: penitentiary treatment, execution of prisoners and internees’ rights, local penitentiary buildings’ characteristics, clothes, eating, ways of penitentiary treatment, groups and categories of prisoners and of internees. The participation of external community to re-educative action, education, work, work outside the structure. The prisoners and the internees can be entrusted to outside work in conditions suitable to guarantee a positive carrying out. However, if we deal with a person condemned to prison terms because of one of the crimes included in comma 1 of art. 4-bis, the possibility to outside work can be given after at least the suffering the third of a punishment and, anyway, of not more than five years 47
Concerning to people sentenced to life imprisonment , the entrustments can take place after the suffering of at least 10 years. In half-liberty regime the prisoner can pass part of the day outside the institute to participate to working activities, educational or, in any case, useful to social re-insertion. Law n.663/1986 (so-called Gozzini Law)
Changement to penitentiary
organization Laws Gozzini law of 1986 has been promulgated after penitentiary reform of 1975 and successive pronunciations of Constitutional Court,
to abolish all dangerous
presumptions foreseen by penal code, both the ones of qualified dangerousness, and the ones connected to some kind of crimes, and the presumptions against bearer of mental total and partial vice, solving the problem of the dual concept of social dangerousness- mind infirmity. In order to entrust the subject to work it has to be taken into account their wishes and aptitudes as well as the economic conditions of the family. Penitentiary institutes Directions, Departing from general account rules of the State and the ones of special account, can, provided that the authorization of the Grace and Justice Minister, send products coming from penitentiary works at the same price or also lower than their cost, taking into consideration ,as much as possible, the prices applied for correspondent products in the wholesale market of the district where the institute is situated. The prisoners can be entrusted to outside work in conditions suitable to guarantee the positive carrying out of foreseen goals of art.15. They are on the way to give their help without escort,
except it is thought necessary for security reasons.
When it is about private enterprises, the work should be developed under the direct control of institute direction, to which the prisoner is entrusted, which can use the inside staff and the social service. For each condemned person the decision to be entrusted to outside work becomes executive after the approval of supervision magistrate Law 56/1987 Art. 19 It foresees that prisoners have the possibility to enrol in the lists of employment and, until the state of prisoners is on , they are exempted from the confirmation of unemployment state. 48
Law n.407/1990 – Long lasting unemployment and CIG The workers beneficiary of this law are long lasting jobless people or workers in Extraordinary Integration Cash Earnings, with regular inscription to employment office since 24 months at least. The beneficiary companies, allowed to the drawn up of vocational training Contracts, for the employment at undetermined time of these categories of workers, are the ones that, at the moment of employing, have not working suspension in act, or they have not proceeded to staff reductions in the previous 12 months from the request itself. The incentive to employment consists in a reduction or in the total exemption from contribution on charge for employer for the following
36 months after the
recruiting and, particularly: - 50% reduction of socio-sanitary and welfare contribution due by enterprises, enterprises consortia, economic public institutions and free professions working on the national territory; - total exemption from duty to the payment of socio-sanitary and welfare contributions in the case of artisan enterprises and of enterprises operating in the South of Italy. Law n.381/1991 – Social Cooperatives Regulation Social cooperatives have the aim to pursue the general interest of the community to human promotion and to social integration of citizens through: a) the management of socio-sanitary and educative services; b) the development of different activities – agricultural, industrial, commercial or services-with the purpose to work insertion of disadvantaged people. In the cooperative developing the activities mentioned in art.1, comma 1, letter b), disadvantaged people are considered: physic, psychic and sensorial invalidity, the ex-in-patients of psychiatric institutes, the subjects under psychiatric treatment, drug-addicts, alcoholic addicts, the underage able to work and in difficulty family situations, the condemned people admitted to alternative measures to prison according to art.47, 47-bis, 47-ter and 48 of law 26th July 1975, n.354, as amended by law 10th October 1986, n.663. Besides disadvantaged people are considered the subject indicated with the decree of the Ministers Council’s President, after proposal of Work and Social Security Ministry , together with the Health Service Minister, with Inside Minister and Social Affair Minister, heard the central commission for cooperatives established by 49
art.18 of above mentioned legislative decree of the temporary Chief of State 14th December 1947, n.1577 and following modification. The disadvantaged people mentioned at comma 1 must constitute at least the 30% of the cooperative workers and, compatibly
with their subjective state, be
member of the cooperative itself. The condition of disadvantaged person must results from the documents coming from public administration , excepted for the right of privacy. The total rates of contribution for the compulsory socio sanitary and welfare insurance due by social cooperatives, in accordance with the paid salary to disadvantaged people of this article, are reduced to zero. Regions adopt type-conventions for the relations between social cooperatives and public administrations operating inside the region, considering requirements of operators professions
and the application of contract rules on force. They also issue rules
addressed to promotion, to support and to social cooperation development. Law n.196/1997 . Rules concerning employment promotion Art. 1 : Contract of services supply of temporary work Art.18 Educative and orientative trainings In order to realize moments of alternance between study and work and to facilitate the professional choices through the direct knowledge of work world, there is the promotion of practical trainings and stages initiatives for the subjects who have already performed the school’s duty. The forecast of relations lasting, not being working relations, is not more than 12 months or 24 months in case of people with handicap, to be modulated according to the specificity of different kinds of users. Law n.165/1998 (so-called Law Simeoni-Saraceni) – Condition to be admitted to alternative measures It concerns the amendment to law 26th July 1975, n.354, and particularly the prerequisites to be entrusted in trial to social service. In general, it allows the condemned people to be able to have access to alternative measures to terms (entrustment in trial and half-liberty) immediately after the judgement. Law n.193/2000 – (Law Smuraglia) – Rules to favour prisoners working activity. It foresees contribution facilities and fiscal incentives to the enterprises employing prisoners allowed to work outside the Penitentiary Institute (art.21 L 374/75, or to 50
those enterprises that, engaged in the organization of working activities directly inside the Penitentiary Institutes, employ prisoners. The facilities become concrete in a monthly tax of 516, 46 euro for the enterprises employing prisoners admitted to art.21. It is applied in the same way also in case of work prosecution with exprisoners, employed during the detention, in the 6 following months after dismissing. Besides it is foreseen the same credit measure, for each formed worker, through vocational training activity, aiming to prisoners’ employment. On the contrary, the companies that want to start productive or service activities inside Penitentiary Institutes are given an 80% reduction of contribution for the compulsory socio-sanitary and welfare insurance for any employed prisoner. The enterprises employing prisoners for inside work are granted with both the benefits, until 6 months after dismision; contribution relieves and monthly tax facilitation (516,46 euro). Penitentiary administrations, central or peripheric, draw up suitable conventions with public or private subjects or social cooperatives interested in supplying prisoners working opportunities. Conventions regulate the object and the conditions of work activity development, the education and the salary treatment, without charges to public financing. In the conventions with penitentiary administration should be defined also the salary treatment, in a measure not lower to what foreseen by rules on force concerning prison work. D.L.n.181/2000 –Regulation to facilitate the match between demand and supply of work The decree determines the potential subjects usufructuary of promotion measures to work market insertion and defines the unemployment conditions, giving addressed criteria about it also to adequate the system of matching between demand and supply of work to the community addresses meant to promote preventive strategies of young people unemployment and long lasting one. For the purpose of the decree it is meant for: - “long lasting unemployed people”, those people who, after missing a work place or having stopped an autonomous activity, have been looking for a new occupation for more than 12 months;

- “never-working people since a long time”, those people who, without having developed previously any working activity, have been looking for an occupation for more than 12 months; - “unemployment state”, the condition of the unemployed person or never working one who is available immediately to the development of a working activity: - “competent services”, the employment centres of article 4 of legislative decree 23rd December 1997, n.469 (decree regulating the awarding to regions and local institutions of functions and tasks relative to placing and to work active policies, inside a general role of addressed, promotion and State coordination. To fight against long lasting unemployment, the competent services the subject are called for periodic interviews, giving at least the following interventions: a) orientative interview within 6 months from unemployment state b) proposal of adhesion to initiative of working insertion or education and/or professional ri-qualification: concerning women looking for working re-insertion, not later than 6 months from the beginning of unemployment state; concerning long lasting unemployed, not more than 12 months from unemployed state beginning. Law Cadre n. 328/2000- Law cadre to realize the integrated system of interventions and social services It assure to people and families an integrated system of interventions and social services, it promotes interventions to guarantee life quality, equal opportunities, no discrimination, citizenship rights; it prevents, cancels or reduces the conditions of disability, need and individual and family inconvenience, coming from an inadequate earning, social difficulties non-autonomous conditions, according to the principle of subsidiary, cooperation, effectiveness, Efficiency and economy, homogeneity, financial and patrimonial covering, responsibility and oneness of administration, autonomy of organization and regulation of local institutions. DPR n. 230/2000- Regulation about rules of Penitentiary Organization and about privative and restrictive liberty measures This regulation is concerned with penitentiary treatment and dispositions relative to penitentiary organization.

D.L. n.274/2000 – Proceedings in the presence of pace judge Art.54 Public utility work. The pace judge can apply the term of public utility work only on charged request. It can be neither less than 10 days nor more than 6 months and it consists in the performance of not paid activity in favour to the community to develop for the State, Regions, Provinces, Municipalities or for institutions or organizations of social and voluntary assistance. For term’s estimation, a work day of public utility consists in the performance, even not continuous, of two hours of work. D.M. 9.11.2001 – Contribution relieves in favour of social cooperatives, relatively to the salary given to prisoners or committed people in penitentiary Institutes, to the ex-in-patient of psychiatric judiciary hospital and to people condemned allowed to outside work The total amount of rates for the compulsory socio-sanitary and welfare insurance due by social cooperatives, in accordance with the paid retribution to people inside penitentiary institutes, to ex-in-patient of psychiatric judicial hospitals and to people condemned admitted to outside work (art.21) are reduced of about 80%, both concerning the rate at employer’s charge and concerning the rate at workers’ charge. D.M. n.87 of 25th February 2002 - Regulation with tax relieves to enterprises assuming prisoner’s workers The decree quotes the new operative instructions from the Minister and I.N.P.S., for the application of law n.193/2000 with regards to penitentiary work. They decide the disadvantaged subjects for whom the employer can request tax relieves or a tax credit. D.L. n. 297/2002- Amended dispositions to facilitate the match between work demand and supply It introduces same amendments to legislative decree 21st April 2000, n.181 The basic principle of this decree (to improve the matching between work demand and supply and to optimize the informatics instruments) have been established to individuate the potential subjects addressees of promotion measures for the insertion in the work market, defining the unemployment conditions, according to

communitarian addresses, meant to promote preventive strategies for young people unemployment and long lasting one. They define the communication model, the transmission format and the model of classement for the data inside the database card and in the professional one of the workers, constituing the base of the data of work informative system. The ordinary and special employment lists are abolished, excepted for the ones relative to art.1 of Legislative Decree of Republic President 24th September1963, n.2053 (re-organization of employment service for show business workers), from the article 6 of law 23rd July 1991, n.223 (Rules concerning wages integration and staff exceeding- mobilities lists), from the article 8 of law 12th March 1999, n.68 (rules concerning disable work right) The private work employer and public economic institutions proceed in the direct employment of all workers for any kind of work relation, excepted for the duty of employing through competition eventually foreseen from the statue of economic public institutions. Law n. 30/3003 – Law on the work market The purpose is to realize a coherent and efficient system of instruments meant to guarantee transparency and efficiency to work market and improve the abilities of professional employment of unemployed people and everybody who is in search of the first occupation, particularly for women, for young people and for disadvantaged subjects. Managing principles and criteria: a)simplification and rationalization of procedures of matching work demand and supply b) modernisation and rationalisms of public employment system, in order to make it more efficient and competitive, according to a discipline centred on: respect of competences requested by constitutional law 18th October 2001, n.3; support and development of female and juvenile working activity, as well as support to the old workers reinsertion; promotion of coordinating forms and link between private and public operators, for a better running of work market, with respect to regions and provinces respect; coordination of dispositions on the match between work demand and supply with the discipline on work subject of non-communitarian citizens, with respect to regulation in force, so to prevent the adoption of irregular form of

work, also juvenile and hidden ones and in order to simplify the procedures of work authorizations issues. Dlgs n. 276/2003 – Implementation of power of attorneys concerning occupation and work market as per law 14th February 2003, n.30 The dispositions of present legislative decree are ranked in the area of community orientations concerning occupation and permanent learning and they have the purpose of increasing the worker’s freedom and dignity, the parity between men and women, and the same opportunities for both the sexes, the rate of unemployment and to promote the quality and stability of work, also through contracts with educative contents and contracts with modulated hours according to companies hours and the workers’ aspirations. Besides they have the purpose to realize an efficient and coherent system of instruments meant to guarantee transparency and efficiency to work market and better the ability of professional insertion of unemployed people and everybody who is looking for the first occupation, with particular references to weak sectors of market work Law n. 241/2006 – Indult’s grant This law establish the indult’s grant for all the crimes committed until the 2nd May 2006, with a term of not more than 3 years for prison and not more 10.000 € for money term alone or together with prison judgements. No application of exemptions as per last comma of art.151 of penal code. It reports , then, all the committed crimes which benefit of the indult. It has also excluded the crimes for terrorism (sub service association comprehended), slaughter, armed band, slavery, underage
prostitution,
pedo-pornography,
people
trade,
sexual
violence,
kidnapping, recycling, production, traffic and detention of drugs, usury and the ones concerning mafia.
The law has established also that indult could not be
applied to temporary accessory terms, as the interdiction from public offices. It is also foreseen the revocation of the benefice in case of perpetration, within 5 years from the date of putting in force of the law, of a crime not-culpable for which it is given a prison term of not less than 2 years.

Law n,125/2008 – Security package The law introduces the expulsion for foreign people imposed with a penalty of more than 2 years, (the previous rule foresaw the expulsion for penalty of more than 10 years); it increases the time of prison for the crime of false statement or a declaration to a public official about the identity or about personal or anybody else ‘s qualities; it considers aggravating for the crime the irregular presence on Italian territory; it calls the Temporary Permanence Centres (CPT) as Identifying and Expelling Centres. The art.100 of Penitentiary Regulation said that prisoners are to be classified in”treatment degrees”. This comes from a modern postulate of treatment individualization, on the contrary of the classic idea of “unique prison”. The classement, in a grade or another, will determine the kind of penitentiary Institute to which the prisoner will be destinated. There three kinds: closed, ordinary, open regime, corresponding respectively to 1°, 2° and 3°degree of treatment. To have classement a prisoner is to be defined. Starting from his entering the institute, the treatment équipe has two months time to prepare the classement proposal, which will be discussed and decided in the committee of Treatment Council. The criteria determining the prisoner’s classement in a grade or another one of the treatment are, synthetically: the term duration, the relevance of criminal facts and social alarm impact of the same, the recidivism, the lasting and intensity of criminal career, the effective time of the served prison and the remaining to serve to reach the three quarters of the term, the change reasons, the professional qualification and the elements of outside support, the possibility of employment in outside working activities, the behaviour inside the institute, the supposed behaviour, the subject personality.

Art.87: Drug addiction The Judge or the Tribunal can allow the suspension of term’s execution fro crimes of not more than 5 years if the crime has been perpetrated because of drug addiction, if the is certified the condemned person is detoxifying or is undergoing a treatment. If the condemned person is a recidivist, the Judge and the Tribunal will evaluate the opportunity allow or not the suspension. The term execution suspension will be always conditioned by the fact that the guilty does not perpetrates the crime in the signalled period, from 3 to 5 years. The suspension periods elapsed without committing a crime, the Judge or the Tribunal will concede the term’s remission if it is proved the detoxication or the continuity of treatment. On the contrary he will order the term’s accomplishment, or an extension of the suspension for a period of not more than 2 years. Art.89 Foreign people The terms privative of freedom of less than 6 years given to a foreign person legally non-resident in Spain will be substituted in sentence with the expulsion from Spanish territory, except that The Judge or the Tribunal, exceptionally and with adducing reasons, decides the nature of the crime justifies the suffering of the punishment in a Spanish penitentiary. In the same way, he will allow the expulsion for terms of 6 years or more, in the case of acceding to third degree of treatment or after the ¾ of the termArt.49 – Work for community benefit The work for community benefit, that must not be imposed without the prisoner’s agreement, is an unpaid service in particular public utility activities, which can be works for caused damages’ reparation or as assistance to the victims. The term can not be more than 8 hours per day. The execution will take place under the control of Penitentiary Security’s Judge, who will report information about work development to the Administration, to public institution or association where the services are performed. Social Penitentiary Services, necessary controls made, will communicate to Penitentiary Security’s Judge the relevant facts ( he is absent at work, his efficiency is very poor, etc.) Penitentiary General Law n.1/1979 The penitentiary institutes ruled in this law have as final purpose the re-education and the social re-insertion of people condemned for terms and privative freedom’s 57
measures, such as prison and the custody of prisoners and condemned people- They have also in charge the assistance and help of prisoners and people going to be dismissed. Royal Decree n,190/1996 concerning penitentiary rules Art. 83: Purposes and principles of open system: open system penitentiary activity aims to improve the abilities for social inclusion of prisoners classified with the third degreeThe exercise of these functions is based on the following principles: mitigation of control measures, except for the creation of programmes for monitoring and evaluating the realized activities inside and outside the institute; autoresponsibility, through the incentive for participation of prisoners in activities’ organization; social integration through social services of the community to facilitate the full participation in the life of the family, social and working: prevention to avoid the family and social destructuring; coordination with public organisations and institutions or private ones, operating to the prisoners reinsertion, promoting common action criteria for the integration in the society. Art.86.4 : In general, the minimum time period of staying in the outside Centre will be of 8 hours per day, sleeping inside the institute, except when, the prisoner accepts the control of his presence outside the centre through informatics devices supplied by Penitentiary Administration, in which case he will stay in the centre for the fixed time in his treatment programme Art. 100.2: In order to make the system more flexible, The Technical Equipe can propose to Council Treatment that for each condemned person is to be adopted a model for the term’s execution in which it can be combined the characteristics aspects of each degree of treatment. Art.182: It can be authorized the assistance in extra-penitentiary institutes, public or private, for the prisoners of third degree, who need a specific treatment, like drug addicts, accounting to the Security Judge. The authorization undergoes some conditions: the detoxifying programme must be approved by the holding institutes; there is also the need of permission to the engagement to respect the life regulation of the holding institute; the monitoring programme must comprehend the established controls; Penitentiary Administration prepares the conventions with the other public administration or with institutions cooperating for the execution of security measures, according to Penal Code. 58
Art.192 : The third degree classment’s prisoners satisfying the requirements established by Penal Code will complete the term's remaining in a situation of conditioned freedom, according to what said in the Code. Royal Decree n.515/2005 It establishes the term’s execution conditions through the work for community benefit, security measures, term’s execution suspensionArt.4: The work for community benefit will be facilitated by Penitentiary Administration that could establish the conventions with other Penitentiary Administration or Public or private institutions, developing activities of public utilities. These administrations can assume the functions of work management, counselling, monitoring and assistance for condemned people, under the supervision of penitentiary Administration. can propose a
work, sending a report to Security Tribunal Law n.44/2007 about regulation of insertion enterprise It has the purpose to regulate the juridical system of insertion enterprises and to stabilize a structure promoting the work insertion of people in social exclusion state.
2.3 Regional and local Basques Countries Law n. 5/1996 on social services Object of this law is to promote and guarantee in the Autonomous Community of Basques Countries, through the management of a social services integrated system of public responsibility, the right for all citizens for these services so to prevent and eliminate the causes of social exclusion and of disparities, to promote individual social integration, to encourage the complete and free development of individual people, adapting it to the actual model of society. Agreement Protocol of Region Piemonte- Justice Minister of 4.12.1992 It gives the address lines in the sector of deviancy, criminality and penal execution, the common engagements and the mutual competences are defined. Regional Law n. 28/1993, amended and integrated by Regional Law n. 22/1997 (Title II)-Exceptional measures to incentivize the occupation through promotion and support of new entrepreneurial initiatives and for the insertion in new work places addressed to disadvantaged subjects The purpose of this law consists in the incentive to create new work places drawn up with contract recruiting at undetermined time in favour of subjects weak on the work market, such as unemployed, peoples aged more than 50, ex.prisoners for whom the last custody is not preceding more than 5 years, prisoners in alternative 60
measure or admitted to outside work o in conditioned freedom, prisoners waiting for judgement, drug addicts, alcohol addicts. Regional Law n.18/1994 – Rule to put into action law 8th November 1991, m.381- Discipline of social cooperative It answers to the convincement about difficulty in working insertion of disadvantaged people, because besides frailness of personal specific motivations, pretty always they are very poor of professional qualifications and very often they are bearer of a second or third diagnosis (prisoner or ex-prisoners and at the same time drug addicts, illegal immigrants, with sanitary pathology pointing out a significant degree of invalidity, with psychic trouble,…). The insertions of disadvantaged people must make use of the support of tutors prepared, socially motivated, efficient and must at the same time make use of insertion places able to welcome, take care, offer listening, confront, discover, detect, canalize personal sources to let him express and experiment up to make autonomous and fully responsible the disadvantaged person. Regional Law n. 45/1995 – Employment of semi-liberty prisoners, admitted to outside work, entrusted in trial to social service or in house detention for socially useful works (already term law 1/1990) Sources are guaranteed to activate and realize some projects noteworthy for the quality of interventions, for the professional task performed, for the process of resocialization activated through the set up relations and the predisposed net work. The law states that the realization of works and services of local interest as a protection for the environment must be accomplished through the prisoners’ employment, favouring in this way their social and working reinsertion. The responsibility of projects management is on charge at proposing local public Institutions, which therefore engage themselves to take care of and in charge the prisoners admitted to the realization of the project. Every year, since 1995, Piemonte Region has assured the availability of economic sources to guarantee the offer of working opportunities for 70/80 prisoners to realize on the average 20/25 projects.

D.G.R. n. 52-11390/2003 – Guide lines for the functioning of Local Operative Groups Groups composed by operators of Penitentiary Administration, of Local Institutions, of social and sanitary Services, of working and voluntary people world coordinating and planning interventions in the sector of contrast against deviancy and criminality and in favour of people on penal treatment and ex-prisoners and coordinated by Local Institutions (Provinces/Municipalities). Task of GOL is the one of preparing a project in the sector through an annual work plan considering the strategies of intervention individuated by different components, of emerging needs and available sources. With this Region and Provinces want to promote the access to work for disabled people through: - initiatives of education, training, orientation, transition to work, as well as requalification; - an integrated services system for work, socio-rehabilitative, training and educative, also of tutorial accompanying to the work place; - ways of support and accompanying for employer. Law disposals, aiming to support the working insertion of disable people, are extended also to “disadvantaged people” , as per law 381/1991 Cadre Agreement 3.3.2003 between Lombardia Region and Justice Ministry To make human prisons, to allow the recovery of prisoners and guarantee more safety to citizens. Three main points are the object of the agreement: wealth, reinsertion and prison building. Resolution of Province Council of 14.12.2004 – Establishment of rights warrantor for people limited in their personal freedom The first purpose qualifying the rights warrantor is represented from the protection of person inviolable rights, particularly for subjects deprived or limited in their personal freedom.The Warrantor, who in the present regulation cadre has not specific and formalized powers, must get in touch with all the entities subjective and collective, institutional and social operating in the varied world of freedom restrictions, prison first of all. In this way, house and work have become basic subjects around which, in the near future , there will be the development of new forms of cooperation with Municipalities social services and Third Area organizations. The follow-up of Prison project – managed by Monza Municipality, through the contribute of sources of all the seven areas- will constitute another relevant intervention plan in this area.

PRAP, Region and Conference recognize local Committee for Penal execution grown-up as the organism inside which it will be presented the projects and the initiatives concerning Voluntary work. PRAP, Emilia-Romagna Region and regional Conference engage themselves to favour the drawn-up of operative protocols and conventions among Penitentiary Institutes, Direction of Centres of Social Service for Grown-up (now UEPE) and Associations of Voluntary work , following guide lines indicated. Regional Law 17/2005 – Rules for promoting occupation, quality, work safety and regularity, substituting Regional Law 45/1996 – Measures of Work Regional Policies Region supports the acquisition of stable working conditions through instruments such as
the allowance of individual formative cheques, the construction of
competences balance, the incentive to enterprises for the transformation of work relations at high risks of precariousness in relations of subordinated work at undetermined time, stimulations to employment of weak brackets. The law 72

Bologna Municipality and Province Protocol between Emilia-Romagna Region and Justice Ministry - Committee Provision n.943 of 16/6/1998 The Local Committee for the area of grown-up penal execution of Bologna Municipality is established, consolidated reality (the first experience dates back to the 80’s, with the establishment of Prison-city Committee headed by the Province). D.G.municipal 94263/1998 – Nomination of the Committee for the area of grown-up penal execution D.G. municipal 18/1999 – Establishment of Permanent Council for the fight against social exclusion and poverty It was born in order to realize a common table that, besides comparison’s function, has an impulse role on municipal policies and is an institutional reference point also for other city’s administrations. The Council functions are: to favour relations and comparison among different experiences and competences engaged in the fight of social exclusions; to develop the observation of socio-economic dynamics, through the comparison and the information analysis and organising permanent monitoring systems; to promote programmes and projects that are also a stimulus for institutions’ politics and particularly for the Municipality; to promote public comparison chances, in order to build an active culture of welcome orienting the community behaviours. The Council is composed by voluntary organizations, associations without aims of earning, social cooperatives and a municipal administration’s representative. Tasks: it plans and coordinates the intervention aiming to promote education and introduction to work of prisoners, to facilitate working course intra and extra moenia with the purpose of social and work insertion, the projects aiming to the insertion of prisoners in working activities socially useful or insertion of the same in the market of public or private work, the initiatives educative, cultural, sports, recreative, socializing inside the Institute, post-prison assistance, the initiative of cultural mediation for foreign prisoner people, the programmes of information and sensitization of public opinion through actions intended to favour the knowledge of penitentiary troubles; the projects educative, cultural and training inside the activities of coordining the so called social private voluntary service, the survey of needs, the experimentation of innovative projects, the formulation of operative intentions also with the private sector. Decree of Province President n. 90968 of 03/12/2004 Appointment of Three-party Province Commission : assembly of consultation of social parties on work policies, where also problems linked to prison area are discussed. It is composed by: the President of Province Administration or his 76
representatives, the Equal Councillor or one of his representatives; referents for principal associations of trade unions and of employers present on the territory. CHAPTER 3 – Activities cards for the 3 macro-areas of reference This chapter shows the outcome of the complete course of re-analyses of 19 cases ( made in research équipe and validated by partners), effected starting from the point of vue of supplied activities , according to a logic of progressivity of the same. Actually, every signalled case proposes and realizes different types of activities , reconductable on their turn to different “minimum” unities of actions (action’s unity). The research course has therefore allowed to re-build
a sort of “ideal-typical
course” for socio-working insertion of a prisoner, working out from any signalled case all the unities of foreseen actions, with, in any case, the attention for the “typicalness” of any experience. In this chapter is therefore presented the “product” of re-analysis, organized in activities cards for the 3 macro-areas of research reference. The different action unities foreseen by the 19 signalled cases, “combined” together, propose some activities types (for ex.”Welcome/Information”, “Cultural Mediation”, “Education in situation”…), comprehended on their turn in 5 service macro-types ( “Information-orienting Counter, inside and outside” “Education activities in enterprise/addressed to enterprise’s constitution”, “Outside working Insertion”, “Laboratories”, “ Coordination and concertation of integrated systems”) Such macro-types make reference to 3 macro-areas of research: “Professional/work

“Accompanying to work”(cfr. Scheme n. 4) Just to make an example we gives , here below, an exemplum for the building of cards “Welcome/Information”: inside the macro-area “Professional and work information and orienting”, it has been indivuated the macro-typology of service “Information/orienting counters, inside and outside”. The cases comprehended in this macro-typology and more precisely “Informative counters of Bologna Territory Prison”, “Cartesio”, “ORFEO”, “LOGOS”,Social inclusion Agency”, “CO.MI.DI.”, and, for any of them, we have been proceeding to the definition of supplied activities typologies (in this case we have found 10). Afterwards, for each activity typology, we have found and specified the action unities which could be comprehended in any activity type. For each actions unity, we have indicated the reference operators and the used instruments. 78
Besides To any activity type has been given a “label”: any label represents a step of the ideal-typical course. With respect to these labels, some could be considered constant (“basic” activities), finding them in several projects and some of them have been found only in one project (“additional “ activities). Furthermore, we want to stress that some labels , such as for ex.”Education operators”, “coordining tables creation”, “evaluation” are kind of activities which can be considered transversal to all service macro-typologies and therefore they are not referable to only one step of a personal insertion course. For this reason, notwithstanding these labels’ importance, they do not constitute object of activities cards. Accompanying
The accompanying is that interventions’ set carried out by one or more operators in the phase previous and concomitant of social inclusion process. Accompanying actions have a basic characteristic: they use a contextual approach, that is to say they take into account the person situated in his context (family, social of relation) And aim to make protagonist the beneficiary soliciting the activation of his sources, even if only residual. Help relation at several levels, implying a deep knowledge of the user and foreseeing the continuous assistance – but defined in time – by a tutor. The way towards the object’s achievement, where sharing and participation are basic elements, is agreed with the user. The contractual element is essential and distinguishes the tutoring (or accompanying) from a welfare support only. The word Accompanying is used as a synonymous of individualized or personalized The beneficiary’s accompanying consists in leading him in his insertion course without substituting him. The accompanying person consults the beneficiary to help him in completing and maturing his reflexion; he suggests him solutions, roads to try, other ones to avoid; he explains him how to find help in case of need (lodging, psychologist, doctor,…); he helps him in his administrative files (request for economic contributions, of lodging..);he takes back the beneficiary to the principle of reality when he goes far from it, sometimes he reminds him also the law; he controls the work done, evaluates the progresses and validates the terms of the contract existing between him and the beneficiary. The work grant is basic for those subjects who are defined “not employable” (in its two applications this approach has been assumed by some POR). 1. With concern to work market Only recently private structures have the function of employing agencies. Before this function was exercised by the State through the National Agency for the Employment (ANPE). Since 2004, it is possible the starting up in enterprise and the insertion of own beneficiaries. The insertion structures have equally obtained the right to make work their beneficiaries in sub-contract for some commercial enterprises. This exchange between the private commercial sector, on one side, and, on the other part, the no-profit insertion structures, in which the beneficiaries in insertion are the more subsidized hired workers, have allowed to facilitate the recruitment of beneficiaries, who hadn’t any possibility to be involved following the normal paths. The set-off is that this way of supplying subsidized manpower to private commercial sector make weaker the status of workers with an ordinary work contract.

Orienting
The orienting can be considered as a “global” action able to activate and facilitate the subject knowledge’s process. In this sense orienting means put the subject in condition to take consciousness of himself, reality of employment, social and economics to be able to carry out choices aware, autonomous, efficacy and congruent with the context. It is an action with maturing finality, which must facilitate the ability of selforienting through a process counselling addressed to facilitate the selfknowledge, of personal representations on the context of employment, social, cultural and economic of reference, on the strategies activated to relate and intervene with these realities in order to favour the maturing and development of competences necessary to be able to define autonomously personal and professional targets suitable to the context, as well as to elaborate or rielaborate a life project and to bear the relative choices. It is a course starting with the drawing of competences balance and of owned abilities, with the help of a professionist; it follows with the person insertion in the work preparatory course. This course is structured in modules with a total lasting of 8 weeks. In the modules different subjects are treated such as informatics notions , working market reform, work collective contracts, trade unions, patronages, knowledge of different productive organizations, documents production, conflicts management, etc…At the end of the preparatory course the people remake their curriculum pointing out also the acquired competences or the ones of which they have acquired consciousness.

Set of activities (information, education and counselling) aiming to favour educative and professional choices of the individual, in the recurring transition moments presenting during our life. Orienting, as a continuous process, therefore is concerned with a wide range of users, young and adults people, interested in individuating and in achieving tasks of education, personal and professional development to better insert or re-insert in the working world. It consists in a set of developed activities addressed to help people taking decisions (on educational, professional and personal sector) and working them out, in an accompanying process along all life. Orienting shows the direction to follow to reach a purpose. In our case the purpose is social insertion: orienting gives the definition of the work to do, the actions to undertake to make the beneficiary insert himself. This orienting proceeds for laps: A. To know the beneficiary 1. to evaluate the socio-cultural situation of the subject (to know from where we start) 2. To define the subject’s vocation (to know where the subject wants to go) 3. To evaluate the subject’s abilities of evaluating (to know how to reach there) This lap of orienting is done through “competences balance” and “orienting interview”. To all this it must be added some trial periods in enterprises of beneficiary’s interest B. To construct a realistic insertion plan in accordance with the beneficiary: This plan includes targets (for ex. To obtain a qualification for a job offering prospects ( bricklayer, domestic help,…) and ways (education, apprenticeship, stages,…). Once decided this plan becomes object of a contract between the insertion charged structure and the beneficiary, The breakage of this contract can mean the missing of social helps for the beneficiary. C.To accompany the beneficiary so that the orienting doesn’t stop after the project has started. As all the projects , also this one can need of adjustments, of ri-orienting that can take back to laps A and B. Actually the orienting operator is often the person charged of monitoring (to accompany and to control) the beneficiary. Besides the problem of (ex)prisoner social re-insertion and not, it exists a device “of permanent education” which allows everybody to be ri-oriented along working life

It is the result of some actions developed by counter’s operators, by teachers of vocational training courses, and by host enterprises. The filter diagnostic cards, prepared by counter operators who photograph the single user’s situation, drawn up together with the interested person, matched with the professional profiles drawn up by educators, if the beneficiary uses vocational training, show a personal and professional situation that in comparison with the problem of working insertion can put him into three macro-categories: Immediately employable, not immediately employable, unemployable. The host company’s individuation takes into account these characteristics (that obviously can improve or regress in time) and their crossing allows to define a walk personal/professional/working “ad personam”. The individualized portfolio is nothing else than the making explicit an insertion project, with the relative documents of walk in progress.

Information and support service in the realization of course devoted to working insertion through the definition of professional profile, of work accompanying. It is particularly addressed to prisoners at the end of terms or in alternative measure to prison. It carries out, through operators, counselling to institutional figures of penal institutes (educators…) relatively to working market and a service of counselling-information- support to companies interested to prisoners’ insertion. The activity becomes concrete through individualized interviews with prisoners who liberally ask to have access to the service or after direct indication of treatment équipe, The service is tightly integrated with the procedural ways of Employment Centre. Foreseen phase inside a vocational training course, it consists in passing a certain period of time inside a working reality, in order to exercise directly a specific professional role. It is a research process with precise scientific rules, based on the collection, elaboration and interpretation of data and information, finalized to formulate a judgement about the quality and efficacy of a service and/or project. Evaluation is necessary to define and improve services, projects and social policies, as evaluating means learning from what has been done, learn from mistakes and from success, worm a balance, make it know, eventually repeat the experience somewhere else. The Employment Centres offer a wide range of services for people and enterprises, among which: • Pre-selection service to make meet who looks for work and who looks for workers • Information about services and interventions of vocational training • Information and consuellingl about work regulation and policies • Functions of link for other province structures or having an arrangement of giving specialist orienting services and individual counselling • Administrative tasks of registration (receipt communications of employment , transformation and end of working relations) and certification of working positions • Insertion for disabled people • Promotion for educational training in enterprise They are public structures managed by Provinces, which supplies free support services to the matching between working supply and demand : for this reason, they address both to people looking for work (or who wants to change it) and to enterprises looking for workers. The politic of vocational training is based on the article 150 of the treaty that establishes the European Community, saying: “The community acts a vocational training policy that strengthen and integrates the Member States actions, fully respecting them with concern of the content and the organisation of Vocational Training� Vocational training is an essential element of Lisbona strategy, contributing to employment. Following Bruges initiative of vocational training general directors (October 2001) it was started a process of cooperation reinforced in the field of teaching and vocational training. Copenaghen declaration (2002) and Maastricht communicate (2004) reassert the priorities, consisting in transparency, recognition and quality of vocational training, and establish priorities at national level. Two important initiatives have been elaborated: Europass- Training (1998) attesting the acquired competences during a period of training abroad and Europass (2004) gathers five documents devoted to prove in a clear and easy way the qualifications and competences of citizens everywhere in Europe. The sector programme Leonardo da Vinci (permanent learning programme) is the financial instrument for vocational training actions. It aims to support and integrate the actions started by Member States encouraging trasnational cooperation and mobility, innovation and quality of training but also the European dimension of training system and practices. Since the coming in force of Amsterdam treaty (May 1999), which introduced a new title VIII about “Employment” in the treaty of European Community, the promotion of a high level of employment, has been present among the Community goals. Employment represents a complementary competence of member States, devoted above all to the elaboration of a European strategy for employment (SEO). The strategy in conceived as basic instruments to supply orienting and assure the coordination of employment politic priorities, to which member States adhere at European level. The new title VIII about employment foresees also the creation of a committee of the employment with consultive task. This title intends to facilitate the Union work in the promotion of national politics coordination concerning employment and work market. The European Council of Lisbona (March 2000) considered that the general aim for these measures was to increase the rate of global employment of European Union up to 70% and the female employment rate to more than 60% within 2010, The European Council of Stockholm (March 2001) added two intermediate goals and a supplementary one: - the global employment rate and the female employment rate must reach respectively the 67% and 57% within 2005; - the old workers employment rate must reach 50% within 2010. Barcellona Council (March 2002) asked to strengthen the European strategy for employment as instrument of Lisbona strategy. The financial support to employment policy is effected through several instruments: - the programme PROGRESS 2007-2013, aiming to give a financial help to the realization of Union objectives with concern to employment and social affairs; - the priorities of European Social Found integrated in the purposes of SEO; - the programme for mutual learning, started at the beginning of 2005, in the cadre of measures to favour employment. Its principal objective consists in pointing out the transfer of more effective policies in the key sectors of SEO. The stage does not foresees a work contract, it is finalized to the acquisition of a practical experience, To the trainee professional and personal improvement and it is part of a personalized project of education and work research. Besides, with the reformation of didactic regulation of Italian Universities, based on the system of educative credits, training is considered basic part of the didactic course of students. Through the direct knowledge of working context, training allows mutual socialization between working world and people engaged in educational-training processes or work search ones, it contributes to the acquisition of new competences and favours the working insertion or re-insertion of subjects in difficulty with the work market. Two are his purposes; to accompany a person or a group of people in a specific phase of their iter of learning on work; to monitor this learning a way to make coherent and synergic the Development of knowledge and competences concerning the person, but also his organization
Therefore, since some years, it has appeared officially a tutor function that appoints, in an enterprise, the person charged to accompany an apprentice or a stagiest. FINAL OBSERVATIONS The network experience realizing RESPIRO project, both inside prison and on territory, helped in comprehending the entity of the problem and in focusing the possible solutions of crime prevention, principally with interventions of accompanying and orienting of prisoners in final terms and, after terms’end, of accompanying in the difficult reinsertion in society. Solutions that can be , with suitable adjustments, perfectly repeated and transferred on other territories different from the ones where it has been developed (is developing) the experimentation. The answer to the problems of prison and post-prison, above all in the working field, would be insufficient if it remained isolated: it is necessary to be joined with other links and passages in the re-insertion processes, for this reason in our analysis of “excellent practices” we gave a particular attention to “network”, that is to say how much and how the project/activity is able to join and link to “stitches” and to services offered by the territory. Work, house, health relations and affections: they are starting points, for a criminal policy that wants to take charge of real problems challenging our civil and politic community. “The principle according which the terms execution is not only an arithmetic fact, but the construction of a course towards the coming back to society, was born into the European juridical thought and develops on the basis of a utility criterion. An utility centred, actually, on safety concept : a society is safer if who has committed a crime can come back to it, “knotting” the threads that the crime cut off, after passing not a simple segregated time, but a time characterized both by own affliction of freedom depriving and the construction of consciousness and ability of re-insertion. From here it was born the idea of a prison time to follow by steps, with measures articulating this walk towards coming back: with the observation in prison , the penitentiary benefits, the alternative measures to prison. Because, anyway, people who committed a crime, after a more or less long period, will come back into society, And it is interest of the society, that is to say all of us, that they have had ways and times to live an experience not of annihilation but one of gradual reconstruction of own life” Since too many years now the fundamental quarrel of European prisons is the constant increasing of prisoner people in comparison with national population. 175
Imprisonment statistics show in the facts “ a social detention”: the more penalized are the migrants. The people affected by psychic diseases and by drug addiction, the people little alphabetized, unemployed or occasionally employed. Let’s look at work, then, as a fundamental right for citizens that can constitute shuttlecock of criminal policy, really able to produce prevention and safety. A culture of work able to measure with the reality of “post-Fordian” economy and of global networks, to offer concrete working opportunities – both inside and outsideto a prison population dramatically lacking in social links, for this work must be always thought in a set prospective. Working insertion is- on our opinion- a privileged instrument through which weak subjects, deviant, who has undergone penal terms, can be helped to re-integration in the community “tissue” and within legality processes. To discomfort and emargination, that often constitute the background of illegal behaviours, it ca be answered with inclusive attitudes and assumptions of responsibility, full of human and civil relations: it is necessary to point out as the welcome ability – of which it is able to be the solidal citizen – intersects the rationality of contribuent who knows how to compare the very high costs of prison with the ones socially more productive of good practices of working and social insertion. This is the most efficient instrument to prevent and the stopping wedge of recidivism. Such an approach to the penal matter goes into the direction of a rational and realistic criminal policy, the efficacy of which is based on good social and integration policies and on a culture of legality able to stimulate the consens to regulation precepts. A regulation expressing only in terms of strength and threatening, of neutralization and unabilility, is not able to answer to illegality challenge. To be able to wish in a good result of socio-working insertion we need, at least, to start with solid basis: it is necessary to make grow into the subject a certain predisposal to work and to take to surface those potentialities able to make him “receptor” of positive elements that can be found in a working place and in the social context. On one side we can imagine the work importance, above all for the disadvantaged subjects, who, in their existential problematic condition, see limits for their access 176
to a regular working world. On the other side, the figure of the condemned person towards who the society is pushed to ascribe meanings not always philanthropic. We are frightened to employ a prisoner for “what he has done” and rarely we wonder “what he is available to do now”. In the collective imagination it springs a process of “individuation-judgement” that goes over the person and uses the social stereotypes typical of this particular category. With this research – taking back the introducing notes- we think to have contributed to extrapolate strategies and methods to individuate, let know, exchange and transfer policies and good practices leading to managing innovating techniques about prevention of crime and recidivism, showing also how to look for and improve operators’ professional competences, making in the end also the effort to prepare a glossary that could lead to a common language to comprehend and make comprehend these phenomena. To resume: we have studied the services/projects of support to work transition relatively to 19 signalled cases by the project’s partners, developed on the 3 macroareas of reference: o

In comparison with the not metropolitan territory context → places where there is no problem of private offer for hardships services, social market with poor competition among actors. The Inclusion Agency is the sole system intervention in the Province addressed to people with Justice problems →Verbania Province (160.000 inhabitants) – Prison:110 prisoners

With a very little competition the dedicated funds are recovered, but the limit is not to have a stable financing source

To promote and develop the working culture inside the Penitentiary Institute, through the constitution of social cooperatives which see the prisoners involved as members and entrepreneurs.
Virgilio activity is composed by 3 modules: A.

If the beneficiary is employed, he is followed by the action coordinator for many months .
The network gathers some 15 beneficiaries a year- comprehends 6 structures of partners’ insertion and some 40 enterprises in which beneficiaries go on stage

The Project AGIS “Re.S.P.I.R.O” (Rete Sviluppo Prevenzione Inclusione Risorse Opportunità) JLS/2006/AGIS/240, aims to enlarge and to strengthen co-operation nets among private and public in order to swap best practises concerning new strategies for preventing criminality, supported by interinstitutional partnerships: by building and/or renewing the weak connections of the inclusion processes, by mobilitating actions of connection and benchmarks for operators; by promoting a social approach to the criminality phenomenon. The network has been studying deeply studying new economical or technical strategies, innovative management of criminality prevention included the relapses, throughought social and working inclusion. The project involves 17 partners from 5 UE Member States: Italy; France, Romania, Spain, Denmark.
