he Township Council adopted an ordinance which amended the municipal code, adding restrictions for property owners of short-term rentals. The council seeks to regulate transient accommodation or short-term rental use of certain legally permitted dwelling units throughout the township in order to facilitate the booking of reservations for such uses through internet-based booking platforms, and promote tourism and economic vitality in the township, according to the council. A short-term rental will mean the accessory use of a dwelling unit for occupancy by someone other than the unit’s owner or permanent resident for a period of no less than 30 and no more than 180 consecutive days; the dwelling unit is regularly used and kept open as such for the lodging of guests and which is advertised or held out to the public as a place regularly rented to transient occupants, according to the council. “What we’ve done here and what other communities are doing is requiring registration contact information and not only on the owner but also on the tenants. If there are problems and the police are called and there is not a resident there, or if we find when we contact the resident at the information that number they give us that is a location in another town, that would allow (Continued on page 15)

This genteel lady never complained. She was never angry with me or our children, but only with herself. I believe she was aware of her erratic behavior, but was unable to say what was wrong. We selected a living care center that would tend to Vinnie’s specific needs. My precious wife has long since forgotten my name, but knew who I was. Sometimes she had moments of clarity and would greet me with open arms and say “I love you.” Other times she would state clearly, “I have something to tell you,” but again couldn’t tell me what it was. Otherwise she spoke gibberish. It is heartbreaking when she cries and holds onto me when I must leave for my bus. I can’t sleep in my own bed without her in it. I get up nightly to sit in her favorite chair and read her poetry or speak to her portraits. Yes, and sometimes I cry. Perhaps the thing I miss most is sharing our memories together. When I lost my birth family, I missed sharing our memories with them. When I told this to Vinnie before her illness, she said, “That’s alright, we’ll make new memories together.” We did indeed over our 69 years together, but now I am alone to re-live them. No man has loved a woman more than I love my wife, not Romeo for Juliet, not Marc Antony for Cleopatra, nobody. I recently collaborated with Elizabeth Browning to tell Vinnie how much I love her. She can no longer read so I read this to her on her last birthday: “How do I love you? Let me count the ways. I love you to the depth and breadth and height my soul can reach. I love you to the level of every day’s heartache when I must leave you. I love you freely, in sickness and in health, as I vowed to you when we were wed. I love you purely, from your 19th birthday to this special day, your 91st birthday. I love you with the breadth,
smiles and tears of all of my life, and if God so chooses, I shall love you even more when he calls us home.” I don’t know when we will lose her for the second and final time so I am spending as much time with her as I can. I don’t know what I will do when she passes. I can’t live very long without her. I can’t live without my soul. When I told this to my doctor at the Veterans Administration, she put me on suicide watch and gave me depression medication. I told her that wasn’t necessary for my religion prohibits such behavior. I also have the children I love and I’ll probably die of a broken heart anyway. I already suffer from PTSD, thanks to the Japanese suicide planes attacking our ships in Admiral Halsey’s Third Fleet. I also suffer from asbestosis from my time on two battleships and a cruiser as a Petty Officer-Radarman in World War II. But I am resilient and almost immune to pain after seeing my shipmates die, after the mysterious death of my 42-year-old

noting the district in Jamesburg is looking for a new superintendent because the board did not extend their superintendent’s contract. Paluri said the lack of consistent leadership has impacted the district. “Providing consistency and providing stability in leadership is extremely important,” he said. Siegel said over Alvich’s tenure she has implemented a “whole child” approach through social, emotional learning and professional development for staff, which served as a model for other districts to follow and implemented unified inclusive programs in the district, which were recognized by the Special Olympics organization. Siegel noted Alvich has served as a mentor for most of the building principals in the district. Some members on the board and members of the public did not disagree on Alvich’s service in the district, but shared concerns about the timing of her renegotiated contract. It was noted the district teachers do not have a negotiated contract. Riback said the renegotiated contract extends Alvich’s contract from July 1, 2020, to June 30, 2024, but does not increase Alvich’s initial salary. Alvich will serve as superintendent through June 2024. Her annual salary will remain at $191,153 for the 2020-21 school year and the 2021-22 school year. It will increase to $195,454 for the 2022-2023 school year and $200,340 for the 20232024 school year.

East Brunswick approves resolution for potential ice rink designs By VASHTI HARRIS Staff Writer
EAST BRUNSWICK–The Township Council approved a resolution authorizing an agreement between DMR Associates and the municipality for architectural designs of proposed ice hockey rink. The council approved a resolution authorizing DMR Associates to perform architectural concept design for an ice hockey rink for the amount not to exceed $35,000 located at 110 Tices Lane during the council meeting on Sept. 14 via video
conference. In a letter addressed to Director of Planning and Engineering Keith Kipp, DMR wrote it is the company’s understanding that the township proposes to develop a new ice hockey rink facility which will include administration offices, locker rooms, pro shop and restrooms, along with the concession stand. At present, the proposed scope of services is based on an approximately 205 feet by 85 feet ice hockey rink. Per the township’s discussion with the company on Aug. 3, the township wishes to proceed
with the programming and concept design services only to establish the building footprint so the plan application for the New Jersey Department of Environmental Protection can be submitted, according to the letter. On June 27, 2019, the township’s 110 Tices Lane Redevelopment Project took a major step forward when demolition of the old Wonderbread Factory began. Last year, both Councilman James Wendell and Mayor Brad Cohen spoke about the possibility of building an ice hockey rink.

Wendell explained that the project will not only be something for the community, but the developer is donating 8 acres back to the township for recreational purposes, according to the council. “The town is going to use the 8 acres for a facility that is going to benefit the entire town,” Wendell said. “Right now we are thinking about an ice rink … and we’ll have some retail residential units, we’ll have some townhouses, we’ll have some apartments, all with smart development and improvements to Tices Lane and improvements to the infrastructure in the area.” When asked about the possibility of building an ice rink at the site, Cohen responded that, “Nothing is 100%, but that is overwhelmingly likely what we want to build. That is what most of the residents have indicated they would like to see as a municipal use.” The developer for the project is Garden Homes Development, Short Hills. Garden Homes Development principal Scott Loventhal estimated the cost of the project at $100 million, which could be a six-year project for the company. The resolution authorizes CME Associates to conduct environmental engineering services in the amount of $7,500. These days there is an Emmett’s Inn page on Facebook. Many people – those who performed there, those who worked there and those who loved and remember the nights they spent there – post pictures and memories. Garvey’s passing prompted many comments on the page. Here is some of what people had to say: • “RIP, Bob. You certainly had an impact on all lives you have crossed paths with and the lives who have crossed paths because of you. Your influence on the rock and roll scene will never be forgotten.” • “Thank you for giving so many of us fond memories of your establishment over the years.” • “Rock and Roll has lost one of the original Greatest Club Owners in NJ (sic).” • “Bob was an absolute legend. His contributions to all our lives can never be fully expressed. We are all better off for having Bob Garvey.” • “RIP Bob, had brought many people together for a lot of fun. Was always a great guy.” • “RIP Mr. Garvey … a great establishment … I met my husband there … thanks
for all the wonderful memories.” • “My heart hurts … this really is the end of an era. So many memories of Emmett’s Inn.” • “Blessed to have known him and raised a Chivas Regal with him on a few occasions. Emmett’s Inn was the place to be and Bob was the man. Glad to have played there back in the day. RIP Bob one of a kind!” Garvey was a longtime resident of Monroe Township, a local real estate developer, a parishioner of St. James the Less RC Church and a member of Knights of Columbus Council No. 6336, Jamesburg. He was pre-deceased by two sons, Robert E. Garvey III in 2015, and Michael E. Garvey in 2019, and his brother, Kenneth Garvey. He is survived by his wife of 60 years, Kathleen; two sons; three siblings; and seven grandchildren, according to an obituary posted online by the M. David DeMarco Funeral Home, Monroe Township. Memorial contributions may be made to the Alzheimer’s Association.

New Jersey to provide opioid overdose antidote for free
Gov. Phil Murphy and Human Services Commissioner Carole Johnson have announced New Jersey will offer the opioid overdose reversal drug naloxone (commonly called Narcan) for free to residents at participating pharmacies throughout the state from Sept. 24-26. According to a press release, New Jerseyans can visit participating pharmacies and anonymously obtain naloxone for free with no prescription and no appointment. Each naloxone pack contains two doses. The free naloxone will be available at 322 pharmacies, including locations of
Acme, CVS, Rite Aid, Sav-On, ShopRite, Stop & Shop, Walgreens, Walmart, Weis Markets and independent pharmacies. For participating pharmacies, visit nj.gov/humanservices/stopoverdoses In June 2019, Human Services oversaw a free naloxone distribution at pharmacies that led to residents receiving 32,000 doses of naloxone, according to the press release. “The ongoing opioid epidemic continues to devastate communities across our state,” said Murphy. “By expanding access to Naloxone, New Jerseyans will have this lifesaving medication readily available to
help those who may be suffering from an overdose.” “This is all about saving lives. We urge everyone to visit a participating pharmacy to get a free pack of this overdose reversal drug because, quite frankly, you never know when you are going to need it to save a life,” Johnson said. The naloxone will be distributed on a first-come, first-serve basis while supplies last, according to the press release. Naloxone can reverse overdoses from opioids by blocking the effects of opioids on the brain. Those who obtain naloxone
will also be given information regarding addiction treatment and recovery, according to the press release. Participating pharmacies have standing orders from the Department of Health for dispensing of naloxone. The distribution is a Human Services program approved by the New Jersey Board of Pharmacy. Human Services has also distributed 53,000 free doses of naloxone to police departments, 11,352 free doses to EMS teams, 1,200 free doses to shelters for individuals experiencing homelessness and 400 free doses to libraries.

A short-term rental property means a residential dwelling unit that is used as or advertised for rent as a short-term rental by transient occupants as guests. Dwelling units rented to the same occupant for more than 30 continuous days, bed-andbreakfast establishments, licensed rooming or boarding houses, hotels and motels will not be considered a short-term rental property, according to the council. The short-term rental of homes can provide a flexible housing stock that allows travelers a safe accommodation while contributing to the local economy, promoting travel, tourism and supporting the local tourism industry and business company, according to the council. The needs of long-term residents of the township should be balanced with the allowance of short-term rentals. The council recognizes that unregulated short-term rentals can create disproportionate impacts related to their size, excessive occupancy and lack of proper facilities, according to the council. Before the ordinance was adopted, residents who live on Diamond Court spoke about a house, which is located on their street, being used as a short-term rental by the owner. Resident Cathy Miller said the house has four bedrooms and two bathrooms and claimed the owner has had four tenants at a time in the house. “I spoke to the owner about three weeks or a month ago. [The owner] assured me she was only going to be doing 30-day rentals and nothing less than that. Since she said that to me, she has had three different residents that were there a week or less in the last three weeks,” Miller said. “Last week alone, the police were called twice. One was the resident calling on the other residents in the house and one resident’s car broke down and they left it in the middle of the road overnight.” Miller asked Baker how many tenants the owner is allowed to have in a four-bedroom, two-bathroom house. “Right now she’s allowed to have as many as she would like. Once the ordinance takes effect, she can rent no more than one room within the single-family house,” Baker said. “That will be our position; as I said earlier, the homeowner may object to that, there’s something in American law called ‘ex post facto’ laws but I’d rather not discuss litigation strategy.” For existing short-term rentals, the applicant must not have had more than two documented and verified instances where the township police have called to address complaints of any type attributable to the short-term rental with the last two years,

according to the council. For existing short-term rentals, the applicant must have no violations of the township’s noise ordinance within the last two years. A violation of the noise ordinance means a documented violation by the township’s municipal court, according to the council. Resident Paul Roth, who also lives on Diamond Court, said not only does the owner not reside at the house, but he and his wife have tried to contact the owner and never can get a hold of her, which given the past history is not acceptable. “The way this will work is, the property owner will have to register, will have to pay their annual, they will have to pay tax on anything that they earn there, and they will have to provide us their information as to where they live,” Baker said. If the owner does not live in that house, Baker said, the township will find out and will be able to take action if they don’t register or don’t supply the information. Then they cannot have short-term rental business running out of their house. A short-term rental permit will be submitted by the owner for renewal on an annual basis, based upon the anniversary of the original permit issuance, by submitting to the Department of Planning and Engineering, a Short-Term Rental Permit application, and a renewal registration fee of $250, according to the council. Baker said no more than one room

within a single-family residence can be used for short-term rental. “We’re not going to be setting up reconnaissance to watch who’s living in the house, but based on the information that the property owner is now going to be required to provide, we think that our code enforcement and our police department will be easily able to determine if [someone is] residing there,” Baker said. “We’re going to try to enforce it. As it relates to all aspects of the ordinance from the effective date onward, I would imagine the homeowner might object and we’ll deal with that as we need to. We will be taking the position that it is effective immediately for all properties within the town,” he said. For existing short-term rentals the applicant must not have had more than two documented and verified instances where the township police have called to address complaints of any type attributable to the short-term rental with the last two years, according to the council. Baker said this ordinance will address all short-term rental properties throughout the township. The Diamond Court property is the only one that he is aware of that has been problematic, but that doesn’t mean there aren’t others that exist that haven’t risen to this level. With a unanimous vote, the council approved and adopted the ordinance on Sept. 14 during the council via video conference. Baker said the ordinance will be fully
enforced 20-23 days after publication. A violation of any provision of this ordinance may have the short-term rental property owner and/or responsible party to fines assessed by the court that includes:
• The first offense will be a $250 per day for each day in violation. • The second offense will be a $1,000 per day or each day in violation and mandatory court appearance. • A subsequent offense will be a $2,000 per day for each day in violation and mandatory court appearance.
Council President Sterley Stanley said he wanted to thank the residents of Diamond Court who have reached out and made the council aware of the situation that’s going on. “I want to thank them for their vigilance and also their concerns and these concerns were passed on to us [more than] six months ago,” Baker said. “I want to thank both Baker and I want to thank Business Administrator Joe Criscuolo for working together with Airbnb, the state and local county officials to come up with this ordinance, [who] researched this fully for the benefit of our township and for the ease of mind of everyone there.” Contact Vashti Harris at vharris@newspapermediagroup.com.
