County asks for volunteers, needed supplies

D

uring a press conference on March 25, Monmouth County officials requested donations for what they said are desperately needed supplies and announced a donation drop-off site. Officials also discussed county operations and the upcoming elections during the ongoing coronavirus outbreak.

“At the county, all of our employees have been instructed to practice social distancing and many are following alternative work plans,” said Freeholder Director Thomas A. Arnone. “With that said, it is also important to note the county is open and operational. While physical public access has been

restricted, there are several ways for the public to access the county. Phone calls and emails are being answered and steps have been taken, such as live-streaming, to make sure we are still reachable,” Arnone said. (Continued on page 7)

olmdel Mayor Greg Buontempo launched a mission to collect personal protective equipment for first responders and the Hackensack Meridian Bayshore Medical Center on March 24 as the coronavirus pandemic continued to spread through Monmouth County and New Jersey. The mayor asked Holmdel residents for assistance and so far, the community has responded in waves of great generosity. “Things have gone really well,” Buontempo said. “We have had a great turnout from the community. I’m really happy with the support in our town during this tough time.” Items being collected include surgical masks, N95 masks, nitrile gloves, face shields, disinfectant wipes, hospital gowns, chemical protective coveralls, safety glasses, 3M brand P100 disc filters, temporal thermometers, ear thermometers and hand sanitizer. Anyone who wishes to donate any of those items may contact the mayor through email at mayor@holmdeltownship.com Buontempo said the donated items would be picked up without contact. Individuals may select who they would like to receive the items: police officers, first aid squad members and/or firefighters. Financial donations are also welcome. For example, Buontempo said the Holmdel Police Department received a $1,000 donation from a foundation in town. The

Historical association gathers impressions of crisis

C

itizens of the world are facing what many believe is an unparalleled pandemic, forcing unprecedented changes in the day-to-day life of every individual. The Monmouth County Historical Association has initiated a program designed to gather first person impressions of this chapter in history from county residents, both adults and children, to be archived in the digital collection “Remembering COVID-19,” according to a press release from the association, which is based in Freehold Borough. “As the size and scope of the crisis became more and more apparent, MCHA saw the need to document the day-to-day experience in Monmouth County and also provide an avenue for people to stay connected in this time of ‘social distancing’ “, said Dana Howell, MCHA research librarian and archivist. Howell, along with Associate Curator Joe Zemla, formulated a survey, with a version for adults and one for children, allowing people to share their impressions and experiences dealing with the COVID-19 outbreak, according to the press release. A call to respond including the link to the surveys is posted through MCHA social media and on the association’s website. In addition, the same request with links was emailed to MCHA members and supporters. Participants are also welcome to share relevant photos documenting their perspectives. “In designing the questions, we tried

to think of what people would be curious to know about this time 100 years from now, focusing on the personal aspects of the event not typically recorded by media,” Howell said. “Our additional goal for the children’s version is to help instill confidence and a sense of satisfaction as well as offer an opportunity for creativity and even a little fun,” Howell said. In addition to creating the collection “Remembering COVID-19,” with permission from participants, submissions will be shared on MCHA’s social media platforms, according to the press release. “By sharing the thoughts and situations of our neighbors in Monmouth County, we are hoping to provide an avenue of personal connection in this time of necessary isolation,” said Meg Sharp Walton, MCHA executive director. “Plus, while adhering to social distancing guidelines, MCHA will be able to remotely continue to grow our recently inaugurated oral history project.” “I am proud MCHA is once again providing an innovative means to gather and share first person information from our county friends and neighbors, that began with the exhibit ‘Tracking Sandy,’ ” MCHA President Linda Bricker said. “The archive being created now will help generations to come understand the emotions, challenges and triumphs encompassed in this momentous event,” she said. he New Jersey Bankers Association said in a press release it is confident in the banking system and the resiliency of the economy. The association said New Jersey’s banks are safe and ready to help their customers during this trying time. According to a press release, customers faced with distress should contact their bank if they have concerns or are experiencing a financial hardship due to the health crisis caused by the coronavirus. Banks in New Jersey are working with their customers to develop solutions that best meet each individual’s needs, accord-

Aberdeen mayor updates residents on COVID-19 response ABERDEEN – In a letter distributed to residents and business operators, Aberdeen Township Mayor Fred Tagliarini has provided an update on municipal officials’ efforts to deal with the coronavirus (COVID-19) pandemic. “This trying week (of March 23) may be ending, but our stand against the coronavirus still goes on. All week the Township Council members, town manager and police chief have had countless meetings and conference calls with state and local officials with a single goal in mind, which is to bring (residents) the most compre-

hensive information we have,” Tagliarini wrote. He said police officers, municipal employees and public works employees are on the job providing services residents need. “The council, the town manager, Bryan Russell, our police chief, Rick Derechailo, and I are very proud of all of our employees for the outstanding job they are doing and for their commitment to Aberdeen Township,” Tagliarini wrote. He said officials are adhering to state and Monmouth County park policies by keeping the municipality’s parks open for

passive recreation. All playground structures are closed and all organized group activities, especially those involving 10 or more participants, are temporarily prohibited. “We have posted on the township website and the township Facebook page a list of websites and phone numbers to help all of our residents and businesses get through this difficult time,” Tagliarini said. “Please use any or all of the resources listed in order to keep informed on all updates regarding COVID-19.” “This is all unchartered water, not only

for Aberdeen Township, but for our country as a whole, but I promise we will get through this. … While on our website homepage, we urge our residents to sign up for Nixle and Code Red messages in order to get all alerts and updates. “As everyone knows, this is a challenging time, but we are up to the challenge. Make sure to follow all hygiene (guidelines) and adhere to all social distancing guidelines. Help us flatten the curve and stay safe,” Tagliarini said. VID-19 fraud schemes. The NCDF Hotline can receive and enter complaints into a centralized system that can be accessed by all U.S. Attorneys, as well as Justice Department litigating and law enforcement components, to identify, investigate and prosecute fraud schemes, according to information provided on March 21. The NCDF coordinates complaints with 16 additional federal law enforcement agencies, as well as state Attorneys General and local authorities. “Unfortunately, we have already seen examples in New Jersey of unscrupulous people trying to take advantage of this global pandemic to cheat frightened citizens and the government out of money,” Carpenito said in the statement. “Our mission to protect the public is as important now as ever, and we will investigate and prosecute these fraudsters with every resource we have.” Some examples of these schemes include: • Individuals and businesses selling fake cures for COVID-19 online and engaging in other forms of fraud. • Phishing emails from entities posing

as the World Health Organization or the Centers for Disease Control and Prevention. • Malicious websites and apps that appear to share COVID-19s-related information to gain and lock access to your devices until payment is received. • Seeking donations fraudulently for illegitimate or non-existent charitable organizations. • Medical providers obtaining patient information for COVID-19 testing and then using that information to fraudulently bill for other tests and procedures. In a memorandum to U.S. Attorneys issued March 19, Deputy Attorney General Jeffrey Rosen also directed each U.S. Attorney to appoint a Coronavirus Fraud Coordinator to serve as the legal counsel for the federal judicial district on matters relating to the COVID-19, direct the prosecution of COVID-19-related crimes, and to conduct outreach and awareness activities. Questions can be emailed to MonmouthCOVID19@visitmonmouth.com at any time and they will be answered during normal business hours, according to a press release from the county. The Monmouth County Health Department hotline, 732-845-2070, is open to answer general questions about COVID-19 weekdays from 9 a.m. to 8 p.m. “We are asking for help from nurses to volunteer with the Monmouth County Health Department to do case management or to help in any capacity. There is a lot of work to be done and we are asking for help from trained professionals who may be available to assist us in our efforts,” Arnone said. Nurses who are willing to volunteer may call 732-845-2070 or email MonmouthCOVID19@visitmonmouth.com “People who are overwhelmed with uncertainty and experiencing anxiety may feel uncomfortable calling the Monmouth County Health Department hotline because they do not want anyone to think they are in a crisis situation,” said Freeholder Susan M. Kiley. “Currently, Monmouth ACTS is working on a phone number for anyone who

needs emotional assistance to call to discuss this challenging time,” she said. Monmouth County Sheriff Shaun Golden said the county’s healthcare workers and first responders need personal protective equipment, which has become increasingly scarce due to the ongoing battle against COVID-19. “Healthcare professionals and first responders remain at the forefront when battling COVID-19 and are in dire need of this personal protective equipment to continue to respond to this unprecedented demand for services,” Golden said. “We invite you to assist us by donating items from the list of personal protective equipment, in order for those on the front lines to protect themselves while protecting the public,” he said. Personal Protective Equipment needed includes nitrile examination gloves, surgical or N95 masks, protective gowns, protective face shields, multi-function nocontact infrared thermometers, hand sanitizer and anti-bacterial wipes. Donations of these items are being accepted at Thompson Park, 805 Newman Springs Road (Route 520), Lincroft, beginning March 25, from 9 a.m. until 4 p.m. Monday through Friday. NJSIAA still holding out hope for a spring sports season By STEVEN BASSIN Staff Writer

T

he start of the New Jersey State Interscholastic Athletic Association high school spring sports season was scheduled to begin on March 25 with both boys and girls lacrosse action starting

things off. Baseball, softball, boys tennis, boys volleyball and boys and girls track and field would have began their respective regular season schedules on April 1. That has all been put on hold with all spring sports statewide being stopped for now due to the coronavirus pandemic.

This past week I received a very favorable result in a federal lawsuit that I filed against the state of New Jersey over a Medicaid issue. The result of this lawsuit is important for several reasons that I want to quickly discuss in this brief article. First, the decision is important because it provides full-throated support for an important issue concerning Medicaid planning. Second, and much more esoterically, the decision is important because it provides empirical evidence as to why a person should retain the services of an attorney to assist them with Medicaid applications and Medicaid planning as opposed to a non-attorney Medicaid consultant. First, I’ll discuss the direct implications of the decision. Medicaid is a federal-state health payment plan for needy individuals. There are various programs of Medicaid, but the program I work with helps pay for long-term care services, such as nursing home care. In order to qualify for Medicaid benefits, an individual must have a very limited amount of assets and insufficient income to pay for his care. When an individual who seeks to qualify for Medicaid benefits is married, his spouse can retain a certain amount of the assets (for instance, the house, a car, and some cash assets) and all of her income. One planning technique with which I have assisted clients involves the spouse who is home, called the “community spouse,” purchasing a Medicaid-complaint annuity in order to increase her income, which she can then retain. A Medicaid-complaint annuity is an annuity that is irrevocable, nonassignable, actuarially-sound, and names the state of New Jersey as first remainder beneficiary for any Medicaid benefits that the State pays to her spouse if she dies before the annuity pays her back in full. A plan might work as follows: Mr. Smith is a resident of a nursing home. He and his wife own a home, a car, and $240,000 in cash. Mrs. Smith is 75 years of age and has fixed monthly income of $800 from Social Security. Under basic Medicaid rules, Mrs. Smith would be permitted to retain the house, the car, and one-half the cash, or $120,000; she would also be permitted to retain all of her income of $800 per month. If Mrs. Smith came to see me, I might advise that she purchase a Medicaid-complaint annuity for $120,000. The annuity would be irrevocable and non-assignable. Mrs. Smith’s life expectancy given her age, 75, is 12.97 years, so as long as the annuity pays her back in 12.97 years or less, the annuity will be deemed to be actuarially sound. The annuity must also name the state of New Jersey as first remainder beneficiary if Mrs. Smith were to die before the annuity paid her back in full. So, I might advise her to purchase an annuity with a five-year term; over the next five years, the annuity will pay her back on a monthly basis the $120,000 plus interest. By purchasing this annuity, Mrs. Smith has converted the excess $120,000 into a stream of income that belongs to her and no longer counts against Mr. Smith’s eligibility for Medicaid. Mr. Smith qualifies for Medicaid right away. Mrs. Smith has income with which to live. In the recent case that I filed and won, the annuity contained language that permitted the president or secretary of the annuity company to modify an annuity contract that the company issued. The state claimed that this language made the annuity revocable and the annuity must be irrevocable. The federal court pointed out that the ability of the president of the annuity company to modify the annuity did not make the annuity revocable to Mrs. Smith. Mrs. Smith could not modify the annuity; Mrs. Smith could ask the president to modify the contract and the president could just say “no” to her request. Far from making the annuity revocable, the language actually demonstrates why the annuity is irrevocable from Mrs. Smith’s perspective. So why does this prove that you should use an attorney instead of a non-attorney to apply for Medicaid? Because Medicaid is a complex law. One of the most complex laws on the books. If you apply for Medicaid and are denied, you want a lawyer to advocate for you. In fact, only a lawyer can advocate for you. Non-attorneys cannot represent you in court. The NJSIAA still believes that there is a chance for a spring sports season. “NJSIAA staff is focused on participation opportunities that will be available to its student-athletes as soon as schools reopen,” NJSIAA members said in a statement. “All student-athletes will need an immediate sense of normalcy and providing even a semblance of a spring season will be essential to their physical and emotional health. It also will benefit the entire school community.” According to the statement, all NJSIAA staff are working remotely, outside the physical office. All directors can be contacted directly, either via email or their cell phone. All key meetings, such as those of the Executive Committee and its sub-committees, are being held as scheduled via the Cisco WebEx platform. Remote access to all meetings and other sessions necessary to continue the association’s business will continue, while non-essential meetings have been postponed until further notice. During the governor’s statewide shutdown of all schools, no NJSIAA member school, school district or coach may conduct practices, scrimmages or games, as this is a mandatory period of no in-person contact between coaches and their studentathletes. This includes any event organized by a parent, captain or other student-athlete. These restrictions relate to all sports, not just spring sports. Coaches may interact virtually with their student-athletes, including providing

workouts or training materials. However, such virtual contact – as well as any activity that may result from it – must strictly conform to all directives in effect related to the coronavirus outbreak and social distancing guidelines, according to the statement. In addition, any virtual contact and resultant activities must be entirely in keeping with all NJSIAA in- and off-season protocols. While the return-to-school date will play a significant role in determining the length of the regular season, NJSIAA staff will also discuss options with officers of each league and conference. Important factors in determining the potential length of the regular season will be feedback from these officers related to the status of various county or conference tournaments, as well as plans for abridged divisional and/ or inter-conference schedules, according to the statement. As soon as a return-to-school date is made official, NJSIAA staff will work directly with key tournament staff for each sport to structure championship tournaments, according to the statement. Finally, the NJSIAA Scholar Athlete Luncheon, originally scheduled for May 17, has been cancelled. NJSIAA is continuing to solicit nominations from each member school and will send each honoree a certificate and gift. Monetary scholarships, however, will not be awarded this year.
