New Jersey continues to lift restrictions as pandemic eases By MARK ROSMAN Managing Editor
J
une 22 will mark the next milestone date for New Jersey residents and business operators as the state continues to rebound from the 2020 coronavirus pandemic. Gov. Phil Murphy has taken action within the past week to begin lifting restrictions that have been in place since mid-March. Beginning June 22, barber shops, hair salons, nail salons and tattoo shops will be permitted to reopen, according to a press release from the governor’s office.. In the period to follow, New Jersey will work toward the gradual opening of personal care, gyms and health clubs at reduced capacities. All of these activities will be required to adhere to health and safety guidelines, according to the press release. Murphy’s restart and recovery plan has been dubbed “The Road Back: Restoring Economic Health Through Public Health.” He has empaneled a Restart and Recovery Commission to help guide the state’s reopening. “As we moved through Stage One of our strategic restart and recovery process, public health data continued to demonstrate our collective success in flattening the curve of COVID-19 cases and hospitalizations,” Murphy said. “It is with these favorable metrics, coupled with expanded testing capacity and contact tracing, that we can responsibly enter Stage Two of our multi-stage approach to recovery. “Our economic restart must instill confidence among our residents and visitors that their safety, and that of their families, is our No. 1 priority. “I encourage all New Jerseyans to continue their vigilance in keeping themselves and their communities safe by social dis-
tancing, wearing face coverings, washing hands frequently and limiting gatherings,” the governor said. Phased-in businesses and activities, with adherence to safeguarding and modification guidelines, for Stage Two include outdoor dining (June 15), limited in-person retail (June 15), hair salons, nail salons, barber shops and tattoo parlors (June 22), youth summer programs (July 6), in-person clinical research/labs, limited fitness/ gyms, limited in-person government services (i.e., Motor Vehicle Commission), and museums/libraries. Murphy has asked company executives to allow all workers who can work from home to continue to work from home, according to the press release. He has suggested that clinically high-risk individuals who can stay at home should continue to do so. The governor said New Jersey will move toward subsequent stages based on data that demonstrates improvements in public health and the capacity to safeguard the public. If public health indicators, safeguarding or compliance worsen on a sustained basis, New Jersey will be prepared to move back to more restrictive stages, according to the press release. “With more of our businesses reopening, we are no longer requiring New Jerseyans to stay at home, but we are asking you to continue to be responsible and safe,” Murphy said. “These actions will put us even more firmly on our road back and complement the steps we have already taken to begin our restart and recovery.” Effective immediately, indoor gatherings are limited to 25% of the capacity of the room, but regardless of the room’s capacity, the limit will never be less than 10 or more than 50 people. All attendees at the gathering must wear a face covering, unless for a medical reason or if the individual is under 2 years old; individuals must remain 6 feet apart

at all times; and physical items may not be shared by multiple attendees of the same gathering unless sanitized before and after uses, according to the press release. Outdoor gatherings are limited to 100 people and attendees are required to be 6 feet apart. Individuals should wear a face covering at all times where social distancing measures are difficult to maintain. Individuals who are in vehicles will not count toward the gathering limit. Available parking at state parks and
forests, and at county and municipal parks, may reopen to their full maximum capacity. Outdoor swimming pools can open effective at 6 a.m. June 22, provided they comply with standards and policies to be issued by the Department of Health. Red Bank joins U.S. cities rallying against police brutality

O
n June 9, Red Bank played host to a peaceful protest that saw hundreds of people make their feelings against racism and police brutality known. “Say Their Names” was organized by the Calvary Baptist Church and the organization Count the Children. The event followed the May 25 arrest of George Floyd, a 46-year-old black resident of Minneapolis, Minn. Video of the arrest shows a white police officer, Derek Chauvin, pressing his knee to Floyd’s neck for almost nine minutes. Floyd was handcuffed and was face down in the street during the time Chauvin was astride him. Floyd died during the incident and Chauvin has been charged with second degree murder. Three other officers who were at the scene have been charged with aiding and abetting second degree murder. “Say Their Names” was held on the day of Floyd’s funeral in his hometown of Houston. Participants gathered at Marine Park and walked to Count Basie Park, where Red Bank Mayor Pasquale Menna asked those in attendance to kneel in memory of people who died as a result of racism and police brutality. “In the stillness of that silence, while we were kneeling together, we remember not just one victim, who was so graphically displayed in our own living rooms on television, but we also recall the anonymous, the nameless, the unrecognized victims for 400 years. “All of you should be congratulated for your courage, for your activism, and for your spirit. “Look around you ... In the faces around you is the community of Red Bank. We are a diverse community and not only that, but [we are for] what should be diversity in all the communities in [Monmouth] County. “We hope you take that message home, that message to all communities in trying to accomplish changes, not just at the local level, the county level and the state, but also the nation. 400 years is a long time … but your activism and your spirit is encouraging because I see in the young faces that are with us today, the hope for real change in the people who can accomplish that change,” Menna said. During the event, participants chanted expressions and statements against racism and in favor of racial equality. They

REGIONAL INTEREST chanted the names of George Floyd, Breonna Taylor, Ahmaud Arbery and others who have died at the hands of police. At one point the march stopped, people took a knee and held a moment of silence for the lives lost. The event received support from the Red Bank Police Department, with officers guarding the route and some joining the march. Police Chief Darren McConnell previously spoke out against Floyd’s death on social media, stating, “We place great value on our relationship with the greater Red Bank community and look forward to continued collaboration with our community to strengthen those bonds and effect positive change.” The Rev. Kenneth McGhee, pastor of Calvary Baptist Church, thanked everyone for attending.

Referencing a Martin Luther King Jr. quote advocating for people to speak up about things that matter, McGhee said, “If you see something that’s going wrong, open your mouth. This is not the time to be silent. We refuse to keep silent any more. George Floyd has awakened America to the fact that we can no longer keep silent.” McGee read the names of individuals who died at the hands of police, announcing with the crowd that all of their lives mattered, before stating, “These are just a few names in a long list of our brothers and sisters. It doesn’t matter what color you are, you are my brother, you are my sister. … It must stop.” Robin McGhee, the pastor’s wife, asked all of the mothers present to raise their hands in solidarity and said, “I fear our sons and daughters won’t come home safely when they leave the house because racism is outside their front door. “I fear because our sons and daughters wear hoodies when they leave the house and somehow that’s threatening. I fear because some who are supposed to serve and protect have fear themselves, so brownskinned citizens are treated as hostile and met with pre-conceived notions and guns drawn. “I fear because while some wearing blue (police uniforms) use excessive force with brown-skinned citizens, their partners turn a blind eye and write false reports instead of doing the right thing and de-escalating the situation and putting a stop to the abuse of the power,” she said. “I fear because change has not yet come. I fear because our laws are not conducive to fairness and justice for all. I fear because those in positions to make a difference won’t. “I fear because the blood of our sons and daughters is shed on the streets and their bodies are disrespectfully left there for hours for the world to see. I fear because 45 (President Donald Trump) is hateful and incites racism. I fear because that could have been my son’s last eight minutes and 46 seconds. “Yet in spite of my fear, I pray for all of us. I pray for citizens of all colors and all nationalities. I pray for the police. I pray for leaders and politicians, and yes, I pray for 45. “I pray for healing and understanding for each of us and I pray for peace and unity. I pray for decency, humanity and love to prevail and abide in these United States of America and throughout the world,” McGhee said.

Middletown Arts Center seeks participants for virtual talent show By STEVEN BASSIN Staff Writer
MIDDLETOWN – The show must go on! With that in mind, the Middletown Arts Center (MAC) is being creative and giving people in the community a chance to express their love for the performing arts. On June 26, the MAC will present a virtual talent show that will be streamed through YouTube. Managing Director Jake Oliver said the MAC staff has worked hard to adapt to the restrictions associated with the 2020 coro-
navirus pandemic and are creating innovative solutions to spread the arts message to the community during this time. “This type of talent show is nothing quite like what we have ever done before,� he said. “It’s a new thing for us. It’s a way to see people and give them the opportunity to show their love for performing and the arts.� Individuals of all ages are eligible to participate in the talent show. Each person will be asked to submit a two- to threeminute video that shows their talent.

The individual who is selected as the winner of the virtual talent show will receive a $100 gift card from Whole Foods Market and a MAC gift card and T-shirt. To determine a winner, audience members will be able to cast anonymous votes through a portal set up by the MAC. Three finalists will be revealed. All proceeds and donations for the show will go to the Back To MAC fundraiser. Oliver said the MAC has seen an unprecedented loss of revenue because of the pandemic and needs support from the community to get back on track. “We need help from the community to contribute to our operating costs during this time until we can open,� he said. The uncertainty of holding summer camp programs is another hurdle the MAC is trying to overcome.
“Camps are a big part of our program and that will be hard to replace if we cannot hold any this year,� Oliver said. Gov. Phil Murphy announced on May 29 that day camps can open on July 6, but must follow certain guidelines. Oliver said camps are a developing situation and said the MAC is awaiting guidance to determine if camps will be offered this summer. He expressed optimism that some programs will be able to take place. The MAC staff is working with local and state officials to plan for camps, classes and performances. “The MAC is a state-of-the-art facility. We will do our best to sanitize our equipment and follow the guidelines step by step to hold programs for the community,� he said. Items to be considered in a potential reopening include the number of people who will be permitted to attend a show, spacing audience members and a barrier to separate performers and audience members. When the day comes for the MAC to reopen, Oliver said, he believes it will be a good thing for the staff to know the center can open its doors to the public and provide people with a safe environment in which to enjoy their love of the arts and performance.

High school athletic association adds sports task force

he New Jersey State Interscholastic Athletic Association (NJSIAA) has established the COVID-19 Sports Advisory Task Force, a group of athletic directors from across the state who will consider sport-specific proposals with a focus on implementing, executing and enforcing potential modifications. The announcement follows the NJSIAA’s formation of its COVID-19 Medical Advisory Task Force, which will implement general and sport-specific modifications, according to a press release. Both panels will make recommendations to NJSIAA leadership, which will then work within governmental and National Federation of High School Sport guidelines to manage the safe return of high school sports in New Jersey. The task force will also include athletic directors Denis Nelson, River Dell High
School; Kevin Murphy, Washington Township High School; Ryan Miller, Scotch Plains-Fanwood High School; Vito Chiaravalloti, Christian Brothers Academy; Dan Uszaki, Northern Burlington Regional High School; and Todd Ricker, Parsippany Hills High School. In other news, Murphy announced that the New Jersey Department of Education and the Office of the Secretary of Higher Education will issue updated guidance to allow school districts and colleges/universities to hold modified in-person graduation ceremonies beginning on July 6. The guidance will include requirements that ceremonies be held outdoors, adhere to social distancing protocols and observe capacity restrictions in order to protect the health of students and families celebrating these milestones amid the ongoing pandemic, according to a press release. “Despite the uncertainty of these times, our students deserve to have their hard work acknowledged and celebrate safely. We have reached a point where we feel confident moving forward and giving our graduates the send-off they have so rightly earned,” Murphy said. In-person graduation ceremonies must take place on or after July 6 and must take place outdoors. An in-person graduation must adhere to the relevant capacity limitation in place at the time of the ceremony. Since Murphy made the announcement regarding in-person graduations, administrators in some school districts have said they would proceed with plans to hold virtual graduation ceremonies during June and consider holding in-person graduations after July 6. As of June 14, the pandemic had claimed the lives of 12,625 residents of New Jersey, according to the governor’s office.

Hazlet officials introduce $21.3 million municipal budget for 2020 By MARK ROSMAN Managing Editor
HAZLET – The Hazlet Township Committee has introduced a $21.3 million budget to fund the operation of the municipality during 2020. The budget was introduced on May 19.

budget, according to the budget document that has been posted on the township’s website. Other revenues in the 2020 budget include the expected receipt of $1.88 million in state aid and the appropriation of $1.2 million from the township’s surplus fund (savings). Hazlet’s 2019 budget totaled $21.1 million and was supported by the collection of $14.26 million in local property taxes. State aid was $2.19 million and officials appropriated $2.45 million from the surplus fund. From 2019 to 2020, total appropriations have increased by $200,000 and the tax levy has increased by $470,000. In 2019, Hazlet’s municipal tax rate was 56.6 cents per $100 of assessed valuation. The average home in the township was assessed at $324,863. The owner of that home paid $1,838 in municipal taxes. In 2020, Hazlet’s municipal tax rate is projected to be 56.2 cents per $100 of assessed valuation. The average home in the township is now estimated to be assessed at $338,918. The owner of that home will pay $1,905 in municipal taxes. Municipal taxes are one item on a property owner’s tax bill, which also includes Hazlet Township Public Schools taxes and
Monmouth County taxes. An individual pays more or less in taxes depending on the assessed value of his home and/or property, and the tax rate that is set by each taxing entity. The largest single appropriation in the township’s 2020 budget is the salaries and wages that will be paid to Hazlet’s police officers, $5.22 million (approximately 24.5% of the budget). The budget includes a $370,535 appropriation for other police department expenses and a $252,048 appropriation for police dispatch 911 salaries and wages. Other appropriations include $2.38 million for employee group health insurance; $448,400 for workers compensation insurance; $712,000 for recycling salaries and wages; and $226,600 for recycling other expenses. During 2020, Hazlet officials will pay $1.18 million to the Police and Firemen’s Retirement System of New Jersey; $362,331 to the Public Employees Retirement System; and $610,000 to the Social Security System. Other appropriations include an $800,000 payment of bond anticipation notes and capital notes; and a $385,000 payment of bond principal.

Many clients ask me if they should have a trust. The client has heard of some person who has a trust, and they believe that a trust would be appropriate for them. A trust is a fiduciary relationship in which one person, called the trustee, is holding assets (cash, stocks, bonds, mutual funds, real estate) for another person, called the beneficiary. A fiduciary relationship is one in which the fiduciary has the utmost duty of care to handle the assets of another person. So, with a trust, the trustee is the fiduciary, holding the assets of the beneficiary with the utmost duty of care. The person who establishes the trust is called the grantor. The grantor places his assets into the trust. The trustee holds and invests the assets of the trust. And the beneficiary derives the benefits of the trust. With many trusts, the grantor establishes the trust for the benefit of himself with some other person, such as his children, as remainder beneficiaries after his death. In such cases, the grantor also serves as the initial trustee of the trust, with one of the children serving in the role of successor trustee after the grantor’s death. Because a trust is really just one person holding assets for another person, the trustee can invest the assets of the trust any way a person can invest assets. A trust could have its assets invested in multiple types of investments, just as a person could. For instance, you are probably “invested” in real estate in that you own your home. A trustee can invest in real estate by owning a home in the name of the trust for the benefit of the trust’s beneficiary. You probably have a checking account. A trustee could have a checking account in the name of the trust. You could invest in CDs, stocks, mutual funds, and annuities. A trustee could invest in CDs, stocks, mutual funds, and annuities. If Joseph Smith were invested in stocks, the stocks would simply be titled “Joseph Smith.” If Joseph Smith were the trustee of a trust for the benefit of his nephew, Mark Jones, then the stocks would be titled “Joseph Smith, Trustee, of the Mark Jones Trust.” Titling the stock in this manner would show that Joseph Smith is holding the stocks for the benefit of Mark Jones in a trust. If Joseph Smith wanted to invest the assets of the trust in real estate, mutual funds, annuities, bonds, etc., all of the accounts or assets in which the trusts was invested would be titled “Joseph Smith, Trustee, of the Mark Jones Trust.” The trust could invest in one asset or twenty assets, just as you could invest in one asset or twenty assets. The only limitation to the manner in which the assets are invested is that the trustee must always bear in mind his duty of care to the beneficiary. When it comes to investing, the trustee must be guided by the Prudent Investor Rule. The Prudent Investor Rule requires the trustee to invest the assets of the trust in a prudent—careful—manner. Whether a client needs a trust or would benefit from a trust is always a question of fact given the client’s particular set of circumstances. A trust is not the right choice for every client. Many trusts are revocable, meaning that the grantor of the trust can amend or completely revoke the trust any time the grantor chooses. Revocable trusts often come in handy for estate planning purposes when a client owns real estate in another state, for instance, in Florida. An irrevocable trust is a trust that cannot be amended or revoked by the grantor. The grantor could designated another person, such as the trustee or someone else, who could modify or terminate the trust, but in order to be irrevocable, the grantor cannot retain the power to modify or terminate the trust. Irrevocable trusts are often used to remove assets from the name of the grantor and gift those assets to other persons. Aberdeen officials make plans to approve outdoor dining areas By VASHTI HARRIS Staff Writer
ABERDEEN – The Township Council in Aberdeen Township will issue temporary use permits regarding outdoor dining as the 2020 coronavirus pandemic slows and restrictions are being lifted. A temporary use permit for outdoor dining may be issued to a restaurant with an active food handler’s license which does not have approved outdoor dining or wishes to expand an existing outdoor dining area, according to municipal officials. Outdoor dining will resume on June 15, according to Gov. Phil Murphy. Social distancing guidelines at outdoor dining areas
will be in place. The council has worked on the issue with the Aberdeen Economic Business Council (EBC). Permit holders will be required to comply with sanitation guidelines and infection control guidelines. The temporary permits will remain in effect until Oct. 31, unless extended by the township. “While many of our restaurants have done a brisk take-out business during the pandemic, others also want to offer their loyal patrons the option to safely eat out again,” Mayor Fred Tagliarini said. “The outdoor dining rules provide a good interim step in advance of any future move by the state to allow indoor seating. Our Building Department will do every-
thing possible to expedite the permit process for applicants,” he said. “The (Township Council) and the administration are to be applauded for being proactive and taking this important step to help get our restaurants back on their feet,” EBC Chairman Carmine Visone said. “We urge those restaurants that want to offer outdoor seating to file their applications with the Building Department as soon as possible,” Deputy Mayor Joseph Martucci said. “Those that are tenants must also be sure to consult with their landlord. The landlords have also been made aware of the rules.” Township Manager Bryan Russell said an outdoor seating area may not block traf-
fic, obstruct views of oncoming traffic, interfere with parking or hinder egress from any tenant of the building. “A number of our restaurant owners have told us they plan to move quickly on this, even though it will involve additional expenses,” Tagliarini said. “Those that rent their stores have been communicating with their landlord, some of whom have been very proactive. “For example, EBC member Jim Dolan is working with several of his tenants at Aberdeen Town Square to create a tented common outdoor dining area for those restaurants willing to participate. We look forward to being open for business this month,” the mayor said.
Holmdel Township Committee introduces $25 million budget By PETER ELACQUA Staff Writer
HOLMDEL – Members of the Township Committee have introduced a 2020 municipal budget that totals $25.08 million and will be supported by the collection of $14.63 million in taxes from Holmdel’s residential and commercial property owners. To support the budget, officials will appropriate $3.5 million from Holmdel’s surplus fund (savings) as revenue and expect to receive $1.99 million in state aid. Mayor Greg Buontempo, Deputy Mayor Cathy Weber, Committeeman Tom Critelli, Committeeman Rocco Pascucci and Committeeman Prakash Santhana voted “yes” on a motion to introduce the budget on May 26. A public hearing will be held on June 23, during which time members of the public may comment on the budget. The committee members may adopt the budget following public comment. Holmdel’s 2019 budget totaled $24.24 million and was supported in part by the
collection of $14.52 million in taxes from residential and commercial property owners. From 2019 to 2020, appropriations have increased by $840,000 and the local tax levy has increased by $110,000. In 2019, Holmdel’s municipal tax rate was 34 cents per $100 of assessed valuation. The average home was assessed at $676,993. The owner of that home paid $2,301 in municipal taxes. In 2020, the municipal tax rate is projected to remain at 34 cents per $100 of assessed valuation. The average home is now assessed at $686,578. The owner of that home will pay $2,334 in municipal taxes. Municipal taxes are one item on a property owner’s tax bill, which also includes Holmdel Township Schools taxes and Monmouth County taxes. The amount of taxes an individual pays is determined by the assessed value of his home and/or property, and the tax rate that is set by each taxing entity.
