he Hazlet Township Committee has adopted a $21.3 million budget to fund the operation of the municipality during 2020. The budget was adopted on June 23. Hazlet’s residential and commercial property owners will pay $14.73 million in a local tax levy to support the municipal budget, according to the budget document that has been posted on the township’s website. Other revenues in the 2020 budget include the expected receipt of $1.88 million in state aid and the appropriation of $1.2 million from the township’s surplus fund (savings). Hazlet’s 2019 budget totaled $21.1 million and was supported by the collection of $14.26 million in local property taxes. State aid was $2.19 million and officials appropriated $2.45 million from the surplus fund. From 2019 to 2020, total appropriations have increased by $200,000 and the tax levy has increased by $470,000. In a presentation of the budget, Hazlet officials said they would “address budgetary and operational challenges post-COVID-19 to maximize economic recovery by re-evaluating all 2020 expenses; applying for federal, state and county grants to maximize non-tax revenues; and evaluating

Middletown library receives National Endowment for the Arts grant

T

he Middletown Township Public Library has been named the recipient of a $5,000 grant to host the National Endowment for the Arts Big Read. An Arts Endowment initiative in partnership with Arts Midwest, the NEA Big Read broadens individuals’ understanding of the world, its communities and them-

selves through the joy of sharing a good book, according to a press release from the township. The Middletown Township Public Library is one of 84 nonprofit organizations selected to receive an NEA Big Read grant to support a community reading program between September 2020 and June 2021,

and the only public library in the country reading “In the Heart of the Sea,” according to the press release. The NEA Big Read in Middletown will focus on Nathaniel Philbrick’s “In the Heart of the Sea,” which was made into a motion picture in 2015. Activities will take place throughout April 2021.

“Our library is an epicenter of learning and exploration, and through grants like this the library can continue to provide programming that inspires our community members to broaden their horizons and connect with others through reading,”

T

he 58th graduating class of Christian Brothers Academy, Lincroft, will truly be one for the history books. The members of Class of 2020 will not only be remembered for their outstanding academic, athletic, service and extracurricular achievements, but also for their resilience, fortitude and unity to weather circumstances outside of their control, according to a press release from the school. The 203 graduates gathered for the 58th commencement exercises on the morning of July 7. Social distancing and social interaction guidelines were observed during the ongoing 2020 coronavirus pandemic that forced the closure of New Jersey’s schools in March. Each graduate was allotted two tickets for family members to attend, while the CBA Digital Network broadcast the ceremony live to the community. The students were gifted custom CBA

Colts facemasks to wear during the ceremony, according to the press release. “With all the uncertainty of the past four months, the Class of 2020 has been on my mind and in my prayers each day, but there was never a doubt you would handle the situation well,” CBA President Brother Frank Byrne said. Brother Frank and Principal Ross Fales conferred the diplomas to the newest CBA alumni, albeit with “elbow bumps” rather than handshakes, according to the press release. Amid the continued global pandemic, the members of the CBA Class of 2020 were celebrated for their accolades over their four years at the academy. The seniors reported receiving more than $22 million in merit-based scholarships to more than 175 colleges and universities across the country, according to the press release.

contingencies in the event of a reduction in state aid and local revenues.” Municipal officials’ goals for the year include proceeding with a township-wide road restoration project; beginning the renovation of Hazlet police headquarters; expanding the application of recently purchased technology such as CivicEngage and CivicReady to automate processes and obtain feedback on service and nonemergency related issues; completing the new Natco building project; acquiring

Spatial Data Logic municipal management software to improve the processing and tracking of construction, zoning and other permits, streamline staff workflow, and enable self-service access for residents; and renovating the Cullen Center and making improvements to Natco Park and Veterans Park. In 2019, Hazlet’s municipal tax rate was 56.6 cents per $100 of assessed valuation. The average home in the township was assessed at $324,863. The owner of that home paid $1,838 in municipal taxes. In 2020, Hazlet’s municipal tax rate is projected to be 56.2 cents per $100 of assessed valuation. The average home in the township is now estimated to be assessed

For decades now, I have been filing applications for Medicaid benefits on behalf of my clients. I would say that in almost every case in which the client lived in their home with the assistance of a home health aide, the client (or more accurately, the client’s family) has paid for all or some of the home health aides in cash, either literally by handing the aide cash for her services or by writing a check to cash to pay the aide for her services. I will only briefly mention that paying an aide in cash is problem for income tax purposes. At best, a home health aide is an independent contractor of mom who is benefitting from the aides services and who retained the aide to provide those services. As such, mom should issue a form 1099 to the aide at the end of the year to report the amounts of money that mom paid to the aide for the services that the aide rendered to mom. The aide would then be responsible for reporting these earnings to the Internal Revenue Service or IRS. Now, I can’t be 100% certain, but if a home health aide is asking to be paid in cash, I think it is a fairly reasonable assumption that the aide is not going to report those earning to the IRS and is not going to pay income taxes on those earnings. Whether the aide is here in this country legally or illegally from an immigration standpoint, she must still pay income taxes on her earnings and the failure to do so is tax evasion. If mom is failing to report those earnings, then mom is engaging in tax evasion with the aide, which is a crime. Do I think people do this frequently? I think people do this all the time. I think there is a billion-dollar industry happening in this country for the past twenty years, at least, in which this type of tax evasion has been occurring. Do I think the government is going to throw mom in jail? No. Do I think there is a probability that the IRS will fine mom for failure to report earnings? I think it is a remote possibility, but certainly not a probability. But, if you ask my opinion, being a lawyer, I would be obligated to tell you that it is illegal. Worse yet, the home health aide is more likely than not an employee of mom’s, not an independent contractor because the aide is not dictating the terms and manner of her services to mom. The rote duties that the aide is performing to mom do not involving independent judgment and skills. As such, mom is an employer and should be withholding employee-employer payroll taxes. More paid news for mom on the above tax evasion fronts but still something unlikely to cause mom to go to jail. There are also liability issues in paying an aide “under the table.” Being a home health aide is, quite literally, backbreaking work. What if the aide injures herself lifting mom or falls in mom’s house because of a hazard in the home. Many elderly individuals’ homes are filled with hazards, as “memories” collect over the years in the home and are not discarded. The aide could sue mom for her injuries. Would homeowner’s insurance cover these injuries? The answer to that question is beyond the scope of my practice, but a judge I know once told me that when she was engaged in the private practice of law she represented insurance companies and insurance companies look for ways not to pay out on their insurance policies. So, this is something to consider. With all of that said, the main point of this article is the effect on a person’s eligibility for Medicaid benefits when she has paid a home health aide in cash during the five years immediately preceding the date of her application for Medicaid benefits. A recent case of the New Jersey appellate division holds that the Medicaid office was correct in treating these payments as gifts that rendered the Medicaid applicant ineligible for Medicaid benefits. Since the applicant could not prove that she legitimately paid an aide in cash, the Medicaid office treated the payments as gifts that rendered her ineligible for Medicaid. Now, with no money and no Medicaid benefits, her nursing home bills will not be paid and the facility would be within its rights to discharge her from the facility. at $338,918. The owner of that home will pay $1,905 in municipal taxes. Municipal taxes are one item on a property owner’s tax bill, which also includes Hazlet Township Public Schools taxes and Monmouth County taxes. An individual pays more or less in taxes depending on the assessed value of his home and/or property, and the tax rate that is set by each taxing entity. The largest single appropriation in the 2020 budget is the salaries and wages that will be paid to Hazlet’s police officers, $5.22 million. The total amount to be paid in salaries and wages to municipal employees is $8.85 million. The budget includes a $370,535 appropriation for other police department

expenses and a $252,048 appropriation for police dispatch 911 salaries and wages. Other appropriations include $2.38 million for employee group health insurance; $448,400 for workers compensation insurance; $712,000 for recycling salaries and wages; and $226,600 for recycling other expenses. During 2020, Hazlet officials will pay $1.18 million to the Police and Firemen’s Retirement System of New Jersey; $362,331 to the Public Employees Retirement System; and $610,000 to the Social Security System. Other appropriations include an $800,000 payment of bond anticipation notes and capital notes; and a $385,000 payment of bond principal.

McLaughlin elected chair of Mater Dei Prep trustees MIDDLETOWN – Mater Dei Prep, a Catholic preparatory school in Middletown, has elected Kathryn A. McLaughlin as the new chair of its Board of Trustees. McLaughlin is a 1972 graduate of Mater Dei and one of the founding trustees of Mater Dei Prep during its successful 2015 transition to an independent Catholic school, according to a press release. She is a member of the school’s Hall of Fame and was an honoree at the school’s Seraph Strong Gala in February. McLaughlin is a practicing attorney and founding partner of her own law firm, where she has practiced law for the past 25 years. She has served as a member of several Mater Dei Prep committees, including Academic Affairs (as chair), Legal, Risk Management and Compliance, Human Resources, and Buildings and Grounds. She formed the Women’s Leadership Initiative, which has created programs and raised funds to support and promote young women in academics and athletics at Mater Dei Prep, according to the press release. McLaughlin succeeds Dr. Simon Bosco as chair.
