Middletown sets vote on increase in open space tax By MARK ROSMAN Managing Editor

oters in Middletown will have a chance on Nov. 3 to determine if they want to pay more money to preserve open space in the community. On July 20, Mayor Tony Perry, Deputy Mayor Anthony Fiore, Committeewoman Patricia Snell, Committeeman Kevin Settembrino and Committeeman Rick Hibell voted “yes” on a motion to authorize a voter proposition to increase the annual tax rate to support the Middletown Open Space, Recreation, Floodplain Protection, and Farmland and Historic Preservation Trust Fund. “This is a critically important ballot question,” Perry said. “Middletown has so much open land and we want to give voters a chance to be heard (on this issue). There is space around town we can look to preserve. “I want to thank the Township Committee for stepping up and putting this (referendum) to the voters,” the mayor said. According to a resolution, in 1998, voters approved the creation and funding of a local open space trust fund with a tax rate of 1 cent per $100 of equalized valuation. In 2002, voters supported an increase in the open space tax rate to 2 cents per $100 of equalized valuation, according to the resolution. On Election Day, municipal officials will ask voters to consider an increase in the open space tax rate to 3 cents per $100 of equalized valuation through a question on the ballot. Republicans’ objection to borrowing plan to be heard in court By MARK ROSMAN Managing Editor

T

he justices who sit on the New Jersey Supreme Court will hear oral arguments on Aug. 5 from attorneys representing Gov. Phil Murphy and the New Jersey Republican State Committee. The legal case arises from legislation Murphy signed into law on July 16. Murphy, a Democrat, signed the New Jersey COVID-19 Emergency Bond Act which authorizes the state to borrow up to $9.9

billion to address the fiscal crisis that has arisen as a consequence of the 2020 COVID-19 pandemic. “The passage of this legislation is an important step in New Jersey’s recovery from the economic ravages of the COVID-19 pandemic,” Murphy said upon signing the bill. “While this is by no means a silver bullet, the ability to responsibly borrow is essential to meeting our fiscal needs in the coming year.” The plaintiffs in the litigation are the

New Jersey Republican State Committee (also known as the NJGOP); state Sen. Declan O’Scanlon (R-Monmouth); state Assemblyman Hal Wirths (R-Morris, Sussex, Warren); and residents Lisa Natale-Contessa of Toms River and Ileana Schirmer of Hamilton Township. Murphy is the only named defendant in his official capacity as governor. The Republicans’ complaint states, among other claims, that Murphy “must be enjoined from enacting and enforcing (the

New Jersey COVID-19 Emergency Bond Act) as doing so would be a violation of the Debt Limitation Clause of the Constitution of the State of New Jersey.” O’Scanlon has called the bond act a “devastating scheme (that is) fiscally indefensible and unconstitutional. There is a legal opinion that says we cannot borrow without voter approval to fill a hole in our budget.”

MCSPCA rescues 61 dogs from ‘horrific conditions’ By MARK ROSMAN Managing Editor

ndividuals and business operators have responded by making more than $65,000 in donations and offering their services as groomers and foster dog parents after a call for help went out from the Monmouth County Society for the Prevention of Cruelty to Animals (MCSPCA). On July 20, the MCSPCA rescued 61 small dogs from a home in the Belford section of Middletown. According to the organization, the dogs were living in “horrific conditions.” By July 23, the organization was reporting that groomers had volunteered their time and skills to help clean the dogs and that many people had reached out to volunteer as foster parents for the pups. In an interview on July 24, Ross Licitra, the executive director and chief of humane law enforcement at the MCSPCA, said Marlene Sandford will face 61 counts of animal cruelty. “I will make certain this is charged criminally,” he said. Licitra said Sandford was caught in the same situation at the same location in 2009, but did not face criminal charges. He said a different administration pursued civil charges. Unlike some situations in which an individual may start out with good intentions about caring for puppies and eventually end up overwhelmed by dozens of dogs,

Licitra said, “This was a purely orchestrated situation driven by someone operating a puppy mill and having dogs for resale, but she let them go and neglected them.” Licitra said the MCSPCA was called by a person who is related to the owner of the dogs. He said staff members were on the scene within an hour of receiving the call. “We walked into a horrific scene,” he said, adding that the dogs were living by themselves. “Our staff is incredibly dedicated and shines in the face of adversity. They faced unimaginable conditions in the house, including an overwhelming smell of ammonia.”

In a Facebook post, the MCSPCA said several pregnant dogs were recovered, along with newborn puppies. “Many of these poor animals were so matted in their own urine and feces that they could barely walk in their small, excrement-filled kennels and were forced to drink out of filthy water bowls, if any water was accessible at all. “Our team spent hours inside the sweltering house, with ammonia so strong it burned their eyes, in full personal protective equipment, until every dog was safely recovered and brought back to our shelter,” the MCSPCA said in a statement. Licitra thanked the Middletown Police Department and Middletown Animal Control for providing assistance at the home. He commended the MCSPCA staff members who rescued the dogs and those who waited at the shelter in Eatontown to receive the dogs, perform triage and begin administering medical care. “I could not be any prouder of my staff. They shined once again. Today, it is amazing to have seen the transformation of these

dogs. They feel the pain (of the situation they were in) and they feel compassion and love when they know they are being cared for” at the shelter, Licitra said. He said within 24 hours of their arrival, some of the pups had started to play with toys, while others were seeking and accepting attention from the staff members who are caring for them. As the dogs become available, they will be posted on the organization’s website for adoption. As of July 23, nearly all of the dogs had been groomed after business operators reached out and volunteered their time. Holmdel school board making plans to reopen buildings

he Holmdel Township Board of Education has partnered with Spiezle Architectural Group, Greyhawk Construction Management and Consulting, and Schiller and Hersh Associates to conduct a district-wide reoccupancy assessment in response to the COVID-19 outbreak and reopening schools in September. At the same time, district administrators are preparing for school opening scenarios that could include student’s traditional return to school, a hybrid model of in-person and remote (virtual) learning, and full-time remote learning. The board will schedule a special meeting to approve the reopening plan for submission to the state on Aug. 12, according to a press release. In recent weeks, district administrators and representatives of the consulting team visited Holmdel High School, W.R. Satz Middle School, Indian Hill Elementary School, Village Elementary School and the district’s offices to assess the facilities and develop an outline of strategies for the process of reoccupying the facilities while maintaining the health, safety and welfare of the students, staff and general public, according to the press release.

The strategies include physical measures as well as policies and procedures which were developed under the regulations of Gov. Phil Murphy’s executive orders, the recommendations of the Centers for Disease Control and Prevention, and the New Jersey Department of Education’s Restart and Recovery Plan for Education, according to the press release. District administrators will be updating policies and procedures, and have made preparations to cover considerations including scheduling, athletics and food services at each school. The primary measures being addressed include implementing UV-C lighting for disinfecting after hours; installing bipolarionization filtration units in heating, ventilation and air conditioning systems; installing thermal temperature detection devices at entries; installing physical barriers (such as sneeze guards) at vestibules, in main offices and in nurse offices; installing antimicrobial coatings on commonly used surfaces; installing hand sanitizer dispensers in each classroom and key locations; and adjusting the spacing of classroom and

nurse office furniture for physical distancing. “We are doing everything we can to ensure the safety of our students, faculty and staff,” Interim Superintendent of Schools Lee Seitz said. “It is our hope that the strategies we are taking will reduce the risks of exposure and transmission of COVID-19.” In response to a question from the Independent, Seitz said district administrators “are preparing for several opening scenarios: traditional or regular school, hybrid, and full-time virtual.” Asked if district administrators are concerned about possible long-term effects on children’s education if they have to remain on remote education for an unspecified length of time, Seitz said, “Of course we are concerned. During a normal year, there is a certain degree of regression that occurs over the summer. That regression is only amplified when students are unable to return to school in the fall. “Additionally, when students are not in school there is a negative impact on their social and emotional development. Schools are essential to the development of our children and their absence will have a negative impact on them that will not be easily remedied.” Regarding changes in remote education that may be made from the way it was han) dled from March through June, Seitz said, “We are working with current and new technology models and our staff to refine our virtual program. “Essential to that refinement is a collaborative process with our entire staff and our students and their parents to identify what is effective and to identify opportunities for improvement. “Our professional development program will likely be expanded to provide our teachers with new knowledge and strategies to continually improve virtual and in-person instruction. “One of the unanticipated benefits of the rush during spring to go virtual is the knowledge our teachers gained in infusing technology into their virtual program. “I am confident that when we return to the traditional school setting, the newly gained knowledge and experience will be infused into the regular instructional program and improve student learning,” Seitz said. On July 20, Murphy, who had previously directed school district administrators to prepare buildings for the resumption of in-person instruction, reacted to parents who expressed concern about sending their children back to school during the ongoing health crisis. The governor said parents will be permitted to select a full-time remote educational option for their children as the 2020-21 school year begins. Additional guidelines are expected to be provided by the Department of Education.

Aberdeen earns Tree City USA status from Arbor Day Foundation

ABERDEEN – The township has earned the designation of Tree City USA for 2019 from the Arbor Day Foundation in honor of its commitment to effective urban forest management. The foundation’s mission is to inspire people to plant, nurture and celebrate trees, according to municipal officials. Aberdeen Township earned the designation by meeting the program’s four re-

quirements: having a tree board or department; having a tree care ordinance; having an annual community forestry budget of at least $2 per capita; and holding an Arbor Day observance and issuing a proclamation. “Tree City USA communities see the impact an urban forest has in a community firsthand,” Arbor Day Foundation President Dan Lambe said in a press release.

Many people come to me with the hope of avoiding probate. Quite frankly, I don’t think many people understand what “probate” is, but most people who have heard about it want to avoid it. In my opinion, avoiding probate is frequently unnecessary and may be imprudent. The process of submitting a last will and testament to probate in New Jersey is very simple. Wills are submitted to probate before the surrogate of the county in which the decedent died domiciled. The surrogate is an elected official who, among other things, is responsible for overseeing the admission of Wills to probate. The purpose of probating a Will is to prove its validity. In New Jersey, in the vast majority of cases, proving the validity of the Will simply involves reviewing the Will to ensure that it was signed with the proper formality. Most Wills signed after 1980 are self-proving. In 1980, New Jersey passed a law that permits Wills to be self-proving. A “self-proving Will” is a will that is signed by the testator and witnessed by two people, all of whose signatures are notarized. A self-proving Will also contains language that the testator was not under the influence of drugs or alcohol at the time he signed the Will and was, in the opinion of the witnesses, mentally competent and not laboring under undue influence. If a Will is self-proving, the executor does not have to find the witnesses to the Will, and the Will can be probated without any further evidence of its validity. Since most Wills are self-proving, proving the validity of the Will is very simple. In fact, probating a Will in New Jersey is so simple that it takes about fifteen minutes and a probate clerk at the surrogate’s office will do most of the work for you. By the way, how much does submitting a Will to probate in New Jersey cost? About $150. And it doesn’t matter if the decedent died with an estate worth $100,000 or $1,000,000. The cost is based upon the number of pages in the Will. The more pages the Will has, the higher the cost of probate. Now, with all of that said, in some states, not New Jersey, the process probating a Will is not simple and is expensive. In Florida, for instance, you almost have to hire an attorney and the cost of probating the Will is about 3% to 5% of the value of the estate. California also has a difficult and costly probate process. But does that mean you should avoid probate? Not unless you own real estate in Florida or California. If you don’t have real estate in another state, my general advice to my clients is, don’t worry about probate because it’s very simple and very inexpensive in New Jersey. If a client owns real estate in another state, my general advice is, you want to avoid probate in the foreign state. So, how do I help my clients who own real estate in another state avoid probate? Assume that Mr. Smith lives in Belmar but has a condo in Miami. I would suggest that Mr. Smith have a revocable living trust, which is essentially a Will that helps a person avoid the process of probate. I would have a Florida attorney (I’m not licensed in Florida) draft a new deed to his condo titling the condo into the trust. Now, when Mr. Smith dies, his estate will not have to be probated in Florida. It’s that simple. By have a revocable living trust, instead of a Will, Mr. Smith’s estate will likely avoid thousands of dollars of probate costs in Florida. For clients who do not own real estate in New Jersey, I typically suggest that they have a Will, with certain exceptions to complex to mention in this column, that the client permits the entirety of his estate to pass under the Will, meaning that the client avoids placing beneficiary designations or payable on death designations on all of his assets. By doing this, the client is permitting his Will to do what it was intended to do—pass his property to his intended beneficiaries in an orderly fashion. If the proposed increase is approved by voters, the Township Committee will hold a public hearing to determine the allocation of the increased proceeds generated by the open space tax to the open space trust fund (since renamed the Middletown Open Space, Recreation, Floodplain Protection, and Farmland and Historic Preservation Trust Fund). The open space tax is one item on a property owner’s tax bill, which also includes Middletown municipal taxes, Middletown Township Public Schools taxes and Monmouth County taxes. Speaking about the Nov. 3 ballot question, Fiore said Middletown’s open space tax “has been a great tool for many township committees. For the past four years, Mazzaccaro has taught world history and Advanced Placement U.S. History at CBA. He has also been an assistant cross country and track coach with the Colts. “It is a privilege and honor to be named the AD at CBA,” Mazzaccaro said. “As a student, teacher and coach at CBA, I have been blessed to work with the best administrators, teachers, coaches and students. I look forward to working with all of the members of our community to further our Lasallian mission through athletics.” Mazzaccaro remains one of the most prolific runners in the history of CBA cross country and track and field. He was a two-time Non-Public A cross country state champion and set the CBA course record at Holmdel Park, which still stands, according to the press release. On the national stage, Mazzaccaro finished 15th at the 2010 Nike Cross Country Nationals to help the Colts finish fifth as

a team. He followed that up by anchoring the CBA distance medley squad that won the 2011 Championship of America at the Penn Relays, according to the press release. “I learned some of life’s greatest lessons from the teachers and coaches who have surrounded me at CBA. “From teachers like Jeff Matson and Dave Duh who taught me that hard work can be enjoyable, to Karl Torchia, Tom Heath and Chris Bennett, who promoted a team-first approach that guided my entire athletic career, I hope to honor all of them by putting their lessons to work as AD,” Mazzaccaro said. His success at CBA earned him spots on the Princeton University cross country and track teams. During his senior year at Princeton, he was named an Academic AllAmerican and All-Ivy League second team for outdoor track. Since 2016, Mazzaccaro has helped coach the Colts to four straight Non-Public A state championships, three Meet of Champions titles, and four trips to
