Hero medic receives second Silver Star for actions in Vietnam

V

ietnam War combat Army medic and Monmouth County resident Bart Fabian has been presented with his second Silver Star medal for actions he took on April 13, 1969. The medal was recently presented to Fabian by U.S Rep. Chris Smith (R-NJ). Fabian was a resident of Freehold Township from 1990 to 2019, before he moved to Aberdeen Township. This is the second Silver Star awarded to Fabian. He received his first Silver Star for his heroism during an ambush by the North Vietnamese on Jan. 11, 1969, according to a press release from Smith’s office. Fabian had previously been awarded two Bronze Stars, two Purple Hearts and an Army Commendation Medal with Valor. “Bart ‘Doc’ Fabian is a hero for all ages, earning the Silver Star not once, but twice. He routinely went above and beyond the call, protecting injured soldiers who were under attack,” Smith said. “Mr. Fabian’s actions on April 13, 1969, which account for the second Silver Star, are truly courageous, heroic and the mark of a natural leader.” Smith added, “How does a man under gunfire find that kind of grit to do something absolutely astonishing? We are talking about a man who put his own life at risk, repeatedly, to defend injured soldiers who were being targeted by the enemy. “The record shows he saved 10 U.S. soldiers and stopped two enemy soldiers who were trying to kill wounded GIs. In an era when people admire fictional superheroes and Hollywood stars portraying heroes, Doc Fabian is a genuine uncontested hero.” After more than two years of Smith working with the Army, Secretary of the Army Ryan D. McCarthy ordered Fabian to be recognized “For gallantry in action against an armed enemy of the United States” while serving in his outfit, Troop A, 1st Squadron, 11th Armored Calvary Regiment, II Field Force Vietnam. Recounting that April day, Fabian said the battle raged on for 90 minutes. He lost six from his troop, including one of his closest buddies, and 19 in total, including the other medic. “We got beat up pretty bad that day,”

Fabian said. “It was a bad day for the good guys.” The day after the battle, Fabian’s commander said he would be recommended for the Silver Star, but it never came, according to the press release. “I decided to forget about it,” Fabian said. “I didn’t want to promote myself. It was a bad day. The next day we were right back in it.” That changed in 2018 at a reunion with fellow veterans who urged him to seek the medal, according to the press release. A family member contacted Smith and asked the congressman to help look into the matter. Smith helped coordinate eye-

witness statements from Sgt. John J. Sorich III, Sgt. Joseph L. Coopet Jr. and Lt. Col. Richard A. Belcher, according to the press release. The Silver Star is awarded to a person who, while serving in the U.S. Army, is cited for gallantry in action against an enemy of the United States while engaged in military operations involving conflict with an opposing foreign force. The required gallantry must have been performed with marked distinction, according to the press release. Members of the awards board unanimously recommended approval, with some making handwritten notations of Fabian’s

actions. Wrote Lt. Gen. John W. Woodmansee Jr., who also saw combat in Vietnam, ” ‘Doc’ Fabian joins the illustrious list of medics who risk their lives saving others. … The award of the Silver Star is certainly deserved. … On 13 April 1969 he saved numerous lives in the middle of a battle … an incredible display of courage and competence. When we sing the National Anthem, we are singing about those ‘Doc’ Fabians in our ranks.” Brig. Gen John W. Nicholson (ret.) said, “He treated more than 10 wounded

Explore the wilds of the Jersey shore during the summer

or most folks, globe-trotting vacations and cross-country road trips are out this year due to travel restrictions and quarantines. Instead, “staycations” within the Garden State seem to be the new fad. If you haven’t explored New Jersey from top to bottom, now’s the time to discover the treasures of this small, but diverse state. Have you really seen the Jersey shore? Of course, every self-respecting New Jerseyan knows about the state’s 130 miles of ocean beaches stretching from Sandy Hook to Cape May, and probably has a favorite spot for swimming and catching rays. But most haven’t ventured into the shore’s quiet places – maritime forests, marshes, wetlands and bays – where nature reigns. Natural land at the highly developed Jersey shore is rare, which makes those locations all the more important for birds, wildlife and native plants, and all the more special for human visitors. But you don’t have to be an expert birder to appreciate the beauty of the landscape. The 8-mile auto loop through the main section of this 47,000-acre refuge in Oceanville, Atlantic County, is one of the prettiest drives in New Jersey, with views of maritime forests and seemingly endless marshland. There are many places to pull off the road for a closer view, so bring binoculars. • Wetlands Institute – To learn why it’s important to preserve brackish marshes – those with a mix of salt and fresh water – drop by the Wetlands Institute in Stone Harbor. There are plenty of observation opportunities from the boardwalk over the marsh; treat yourself to an eco-tour of the marshes and back bays aboard The Skimmer, the Institute’s pontoon boat. • Cape May – A visit to the Cape May peninsula is a must for birders and nature lovers. The peninsula has extensive preserved lands, including Cape May Point State Park and the adjacent South Cape May Meadows, a Nature Conservancy preserve. There is an impressive trail system with great wildlife viewing, natural beaches and the Cape May lighthouse. Around the corner is Sunset Beach, where you can watch the sun drop over the waters of the Delaware Bay.

Volunteers needed to support victims of domestic violence Domestic violence does not stop during times of crisis. In fact, when stressors increase, violence and abuse can quickly escalate. For many victims, staying at home means being isolated with someone who is harming them, according to a press release from 180 Turning Lives Around.

For 44 years, 180, a private, nonprofit organization in Monmouth County, has provided confidential support and advocacy to victims of domestic violence with the assistance of its dedicated response team volunteers at police headquarters throughout Monmouth County, according to the press release.

CBA moves forward with plan to fully reopen in September

S

tudents who attend Christian Brothers Academy, Lincroft, will be in school five days a week beginning in September, according to a plan released by the private school. According to a press release, “Taking CBA’s Lasallian mission and approach to education into account, the administration will be moving forward with this plan, understanding that conditions could change in the coming weeks and months. The academy used an end-of-year parent survey as well as a faculty committee to aid in its plans to reopen.” Under the plan put forth by CBA, all students would have been required to wear a mask when they were not able to maintain 6 feet of social distance. However, on Aug. 3, Gov. Phil Murphy announced that students will have to wear at all times when they are in school. Desks at CBA will be placed at least 3 feet apart as recommended by the American Academy of Pediatrics, according to the press release from the school.

Students will remain 6 feet apart during lunch periods, which will be spread out in different locations on campus. There will be a number of additional safety modifications put in place, such as daily health screenings, the elimination of homeroom and locker usage, and plexiglass. The academy has invested in bipolar ionization, which is an air purification system installed in every heating, ventilation and air conditioning unit that deactivates harmful substances like bacteria, mold, allergens and viruses, according to the press release. The administration has developed a plan in the event that students and teachers must return to full-time virtual learning. CBA will accommodate students who choose to learn virtually for some time, according to the press release. Student orientation days have been planned for sophomores and juniors on Sept. 9 and for freshmen and seniors on Sept. 10. The first full day of classes will be on Sept. 11.

Trinity Hall students are back to school this fall

T

rinity Hall, an independent, all-girls college preparatory school located in Tinton Falls, is prepared to welcome students back to campus this fall. Eight years ago, the school opened with 30 ninthgrade students, and will welcome more than 300 students in grades 9-12 for the 2020-21 school year. JAR of Hope will raffle off iconic American sports car

JAR of Hope Foundation and All American Ford, Old Bridge, are raffling off a 2020 Mustang “Premium” convertible as a fundraiser for the foundation. The $41,865 sports car can be won by purchasing a $100 raffle ticket, according to a press release from the foundation. JAR of Hope raises funds to research a cure for Duchenne Muscular Dystrophy, a very rare, muscle-wasting disease with which children are born (1 in every 3,500 live births, mostly boys), according to the press release. JAR of Hope was started by Jim and Karen Raffone in 2013 after their then-4-year-old son James was diagnosed

with Duchenne. There is no cure for the disease, but when doctors told the Raffones to “just take him home and love him,” they decided to find one. So they started a foundation to give these children a chance to become adults, according to the press release. All American Ford is sponsoring a special raffle to raise funds for that cure. The prize is a special Mustang called a ” ’69,” honoring one of the brand’s most memorable models. Raffle tickets cost $100 each. All taxes and fees on the vehicle will be paid by JAR of Hope, according to the press release.

I recently saw a question on a social media service. The person was asking if anyone knew a good estate planning attorney and what the cost of a Will should be. One of the people responding said that she had used an on-line, do-it-yourself Will service. She did not provide the cost of her do-it-yourself Will, but my guess would be that the cost was somewhere between $100 and $300. So, what are my thoughts, you might be asking. (You probably weren’t asking that question until I posed the scenario, but I thought I’d answer the questions anyway.) A good, local estate planning attorney, in my humble opinion, is me. I have drafted tens of thousands of last wills and testaments, advanced health care directives, and financial powers of attorney over the course of my twenty years of concentrating my practice in the field of elder law. I have reviewed thousands of these documents that other attorneys have drafted, so I have a point of comparison. In the course of my long, concentrated career, I have never seen a Will, health care directive, or power of attorney, I have never seen one of these basic estate planning documents that another attorney drafted that made me think, Oh, boy, have I been doing it wrong for the past twenty years. Over the course of my career, I have seen sections in other attorneys’ documents that I have incorporated into my documents because I believed the sections to be helpful to my clients. But never have I thought on whole that another attorney’s documents were substantially better than mine. On the other hand, I have seen numerous instances of attorneys who have drafted estate planning documents that range from inadequate to meet the client’s needs to just plain problematic. Now, I don’t think I’m the only good estate planning attorney in the area. There are a number of very good attorneys. So, what should you look for in an attorney who will draft your estate planning documents? First, you should look for an attorney. The do-it-yourself Will companies that advertise on television and the radio are not attorneys. I just heard a radio commercial from what of these companies and the spokesperson literally said “We are not attorneys.” When you use one of those services, make no mistake about it, you are drafting your own Will. A “company” is not a lawyer and cannot legally practice law. A lawyer is an individual who is licensed to practice law by the Supreme Court of New Jersey. A company is not a lawyer because a company cannot be licensed to practice law. Do I think you should draft your own Will? I think you can. I also think you can operate on yourself. I think you can be an electrician around your house. I think you can be your own car mechanic. Do I think you should do any of these tasks if you have no knowledge as to what you are doing, no, I don’t. But you are certainly free to do any of these things on yourself or your property if you want to. The problem with drafting your own Will or your own health care directive or your own financial is, you won’t know if the documents have an issue until it’s too late. Your executor won’t be acting on your Will until after you die. It’s too late for you to fix it at that time. Your power of attorney agent won’t be using your power of attorney until after your mental incapacitated. It’s too late to fix then as you have to have mental capacity to draft a new power of attorney. I think you should use an estate planning attorney who concentrates his/her practice in the area of estate planning, for instance, a certified elder law attorney or an attorney who through the associations to which he/she belongs demonstrates a concentration in the area of estate planning. How much should estate planning documents cost? For an estate planning package (Will, living will, power of attorney), I charge about $600 for a single client and about $850 for a couple. Some of the attorneys who concentrate their practices in estate planning charge anywhere from $1,500 to $5,000. I think my documents are just as good. New Jersey’s schools were ordered to close in mid-March by Gov. Phil Murphy at the start of the 2020 coronavirus pandemic. For the remainder of the school year, students received a remote (virtual) education at their homes. Several weeks ago, Murphy directed school administrators to develop, in collaboration with community stakeholders, a plan to reopen schools in September in a manner that best fits a district’s local needs. Murphy later directed school district administrators to provide an all-remote educational option for parents who do not want to send their children into a school. Superintendent of Schools William O. George described the plan and said Phase I will start in the first week of September with teachers attending professional development courses. Phase II will begin the following week and will center around teachers conducting re-entry meetings with their students either in-person or virtually. Administrators said the purpose of the meetings will be for teachers to connect with each student and discuss the child’s academic and emotional needs. The first day of school on Sept. 14 will begin Phase III. “Everything we do is based on the guidelines that have been handed down by

the New Jersey Board of Education and the governor,” George said. “We are doing the best we can to provide our students with five days of learning instruction.” George said administrators sent a survey to staff members, parents and students to obtain input regarding the reopening plan. Administrators will send out another survey to determine how many parents will select the all-remote education option and how many parents will select the hybrid model of in-person and remote learning for their children. Students will be divided into two groups based on their last name (Group A – last names A-K and Group B – last names L-Z). Group A will attend in-person classes on Monday and Tuesday, while Group B will have in-person instruction on Thursday and Friday. In-person instruction will be four hours each day. Grab-and-go meals will be available for students when they are in school and the district will make sure that students who require a reduced price lunch or a free lunch will have those services available to them, George said. Wednesday will be a remote learning day for all students. Students will have online instruction on the other two days of the week when they are not receiving inperson instruction. Teachers will be required to be in school all five days of the week, George said. The school district will provide in-person instruction all five days for English as a Second Language students and for students

who require special education services. George said because class sizes are expected to be small, the district can follow social distancing guidelines and provide those students with the in-person instruction resources they need to learn. Switching to online learning during the spring when schools closed was a smooth transition for Middletown, the superintendent said. All of the schools in the district earned a silver level certification from the Future Ready Schools New Jersey Certification Program in 2018. The program is part of the New Jersey Department of Education and is designed to provide students with the digital tools they need to succeed with online learning. Innovative learning is a primary part of the district’s curriculum, George said, and Middletown has continued to find ways to help students learn through different forms of technology and digital learning. Middletown is a Google-based learning district, using platforms such as Google Meet, Google Hangouts and Google Classroom for online learning. In addition to those digital learning tools, George said administrators are planning to use other platforms such as Zoom and Flipgrid moving forward because of the success some teachers and students had with those platforms during the spring. “Our students are prepared for a virtual learning model,” George said. “We have multiple forms of data for each grade level and use it to put rigorous learning models in place to help our students be successful.” All students will have access to an elec-

tronic device. He said administrators made sure each student had a laptop device of some sort before they started learning remotely in March. George said the district purchased personal hotspots to make sure every student had internet access. Students and staff members will be required to wear a face mask at all times when inside a building. If students ride a bus to school, they must wear a face mask. The district will not provide any type of health screening for students before the children enter a school. George said it is up to parents to make certain their children are well enough to attend school. “If students are sick, they need to stay home,” he said. If Phase III proceeds without any issues, the plan states the district will start Phase IV around Oct. 12, with class sizes increasing and the number of hours of inperson classes being extended. In-person classes will be extended to four days a week with parents having the option for their children to attend on all four days or to continue attending school two days a week. Phase V will follow the same format with students who have been receiving only online instruction having the choice to return for in-person classes. The final phase of the plan, if the state eases social distancing guidelines, will allow all students to have the choice to attend school in-person five days a week. The goal date for Phase VI is around Dec. 14, according to the reopening plan.

Face coverings will be required to be worn by all staff members and students at all times. Students are expected to come to school with a face covering. Transportation will be provided to students. Face coverings must be worn by students on the bus at all times, including entering and exiting the vehicle, and at the bus stop.

“Parents will have the opportunity to waive (district-provided) transportation and the district will make accommodations at our schools to allow for a large number of caregiver drop-off and pick-up of students,” Majka said. For pre-kindergarten, the superintendent said administrators are committed to providing high quality instruction to the greatest extent possible and he said those children will attend school five days a week. “We are exploring the ability to provide in-person instruction to our tuition-based preschool students, however, given the requirements of class size and social distancing, the district will be determining if offering a program for tuition-based students is feasible,” Majka said.
