Former fire chief served 73 years before his passing By JENNIFER AMATO Managing Editor
L
ife member, former Fire Chief, and South Brunswick Fire District No. 3 Commissioner Norman H. Luck, Sr. passed away April 13 at age 89. Luck was an active member of the Kingston Volunteer Fire Co. No. 1 for 73 years, having joined in 1947, according to information provided by Co. No. 1. In addition to serving as chief, he also served the department as the president and treasurer, along with many other offices
and served in numerous committees, according to the post. Luck was elected as a commissioner for South Brunswick Fire District No. 3 in 1980 and still served the board to his final days, according to the post. At the time of his passing, Luck was serving as the senior trustee of Fire Co. 1. He was also a founding and charter member of the Kingston First Aid and Rescue Squad. Luck was a lifelong resident of Kingston. (Continued on page 3)

cials announced during a virtual press conference on April 15. H. James Polos, the executive director of the MCIA, said WSP is “an invaluable world-class partner.” WSP is currently involved with New Jersey Transit and Amtrak on other projects, and worked on the first subway in New York City in 1870. South Brunswick officer claims retaliation by police chief; chief’s lawyer calls allegations ‘bogus’ By JENNIFER AMATO Managing Editor
A
South Brunswick police officer has filed a complaint against the township and Police Chief Raymond Hayducka alleging claims of retaliation. However, the chief’s lawyer denies the allegations. The lawsuit filed on Jan. 28 demands a jury trial and the designation of trial counsel, according to a document filed in state
Superior Court of New Jersey Civil Division for Middlesex County, by attorney Sebastian B. Ionno of Ionno & Higbee, of Pittman. Officer Ricardo Moreira has been employed by South Brunswick as a police officer since 2011. He claims that since then, Hayducka has asked officers to dismiss tickets that were issued to certain individuals, according to the lawsuit. Moreira said he was personally solicited by Hayducka on at least one occasion
to dismiss a ticket he wrote to an individual who parked in a handicap space without displaying the proper tag. The officer said the vehicle belonged to an individual who attended a Free Masons event with Hayducka, according to the lawsuit. Moreira claims this type of behavior continued through early 2020. In or around February 2020, Moreira said, he spoke with then-Township Manager Bernard Hvozdovic regarding the New Jersey Conscientious Employee Protection
Act (CEPA), and reported that Hayducka had allegedly “engaged in a pattern and practice of soliciting officers to dismiss tickets issued to friends and favored individuals,” according to the lawsuit. The report was referred to the Middlesex County Prosecutor’s Office. Moreira said he interviewed with prosecutors during the investigation. He also named other officers in the complaint who had allegedly been told by Hayducka to dismiss tickets. (Continued on page 7)

He was a member of the Reformed Church of Bound Brook and volunteered in the church soup kitchen every week for many years, according to his obituary from M.J. Murphy Funeral Home. He volunteered since 1998 with the South Brunswick Viking Marching Band and the South Brunswick Visual Ensemble, according to his obituary. He worked for 45 years in banking at First National Bank of Princeton. Luck was predeceased by his parents Leslie John Sr. and Catherine Theresa (Bruton) Luck; wife Doris R. Luck; daughter Betty Jane Adair, brothers George T. Luck Sr., Leslie J. Luck Jr., and Kenneth E. Luck Sr.; and granddaughter Emily Adair. He is survived by his daughters, Nancy M. Delgado and husband, Harry J. Delgado of Dayton, and Catherine T. Wolf and husband Richard C. Wolf of Kendall Park,

South Brunswick Library honors legacy of former mayor, library board member

The South Brunswick Public Library is now the Christopher J. Killmurray Building, named after a former mayor and library board member who passed away in 2018.

bout 100 people gathered distanced outside the South Brunswick Public Library on April 3 to honor former Mayor Christopher J. Killmurray. Members of the South Brunswick Police Department stood along Kingston Lane, flashing lights on police vehicles behind them, paying homage to the longtime councilman and library board member who passed away in April 2018. Among the guests who witnessed the dedication ceremony for the Christopher J. Killmurray Building were Killmurray’s
parents Francis and Marilyn, his widow Karen and his four children, Conor, Anna Rose, Bridget and Patrick. Several months ago, the Township Council and Library Board of Trustees voted unanimously to name the library in honor of Killmurray just as state funding was approved for multifaceted library building construction project. Completion is anticipated in 2023. The one-hour event was ushered in with bagpipes, the national anthem and the South Brunswick Honor Guard salute.

Public hearing for South Brunswick school budget set for April 29 By JENNIFER AMATO Managing Editor
SOUTH BRUNSWICK – The members of the South Brunswick School District Board of Education have introduced a $154.65 million budget to fund the operation of the school district during the 202122 academic year. A public hearing on the budget will be held on April 29 and at that time, residents may ask questions or make comments about the budget. The board may adopt the budget following the public hearing. The budget was introduced during the board’s March 11 meeting, which was conducted in person at Crossroads North Middle School and also broadcast live. Superintendent of Schools Scott Feder and Business Administrator David Pawlowski provided information regarding the tax impact of the budget on property owners. South Brunswick’s residential and commercial property owners will pay a local tax levy of $116.77 million to support the 2021-22 budget. During the current 2020-21 school year, the total budget amounted to $157.75 million and property owners paid a tax levy of $114.48 million to support the spending plan. South Brunswick’s state aid will decrease by $260,000 from 2020-21 to 202122, from $21.75 million to $21.49 million, according to figures on the New Jersey Department of Education website. In 2020-21, the school tax rate was $3.04 per $100 of assessed valuation. The average home in the township was assessed at $200,000 and the owner of that home paid about $6,040 in school taxes ($503 per month). In 2021-22, the school tax rate is projected to decrease to $3.02 per $100 of assessed valuation. The average home in the township was assessed at $200,000 and the owner of that home will pay about $5,960 in school taxes ($497 per month). An individual whose home was assessed at $300,000 in 2020-21 and is still assessed at $300,000 in 2021-22 will see his/her school tax bill decrease from about $9,060 ($755 per month) to about $8,934 ($745 per month). School taxes are one item on a property owner’s total tax bill. South Brunswick property owners also pay municipal taxes and Middlesex County taxes. The Role of S-2 In 2020, Feder addressed S-2, a 2018 state law which changed the distribution of funding for New Jersey public school districts. He said that three years prior to
the enactment of the law, South Brunswick received $24.5 million from the state to offset taxpayer costs. In 2019, district administrators received a schedule showing how much money the state would take away over the next six years. of a train station to be constructed on Main Street off Route 1 north in North Brunswick. Polos said the decision to hire for the $3.199 million Phase I and Phase II project was unanimous among MCIA members, as WSP was most consistent with the Request for Proposal in terms of project management plans, baseline schedule with monthly reports, and cost. The total project award is $3,199,272, which includes $2,907,272 (Phase 1 for $724,765 and Phase 2 for $2,182,507), plus $292,000 in allowances that are contingent upon the approval of the MCIA, according to information provided by county officials. Overall, the project will consist of four phases: conceptual engineering, preliminary engineering, final engineering, and finally construction assistance services. Middlesex County, through the MCIA, will serve as project manager through an agreement with NJ Transit for the design
and construction of the train station, which was announced on Oct. 30, 2019. This is the first time a county has been allowed to manage the construction of a crucial infrastructure project. WSP and five subconsultants were selected this week as the design and engineering partner, “a major leap forward for this project,” said Shanti Narra, Middlesex County commissioner, former North Brunswick councilwoman and current North Brunswick resident. “This is a critically needed transportation hub on the Northeast Corridor.” Polos said Phase I preliminary design and environmental review will take a few months. Phase II would take about 12 months. Thus, it will be at least 18 months until the project is at 30% completion, he said. Polos said after the design phase, officials can better determine an expected completion date for the project. Then, NJ Transit and Amtrak will work on new train schedules. “We want this project built sooner than later, but we are not going to sacrifice safety and quality,” Narra said. “This is a

regional project and the interest has been enormous.” “We are going to do the best job we can to meet your expectations and hopefully exceed your expectations,” said Andy Paluri, principal in charge at WSP, and a longtime Middlesex County resident. “We are looking forward to moving forward quickly.” The train station/transit village project began 15 years ago as a means to offer relief to one of the state’s busiest rail lines, provide quicker commutes, reduce traffic along Route 1, relieve congestion at the New Brunswick and Jersey Avenue train stations, bring revenue and ratables to the area, add construction and permanent jobs, and provide an environmentally safe alternative to driving. The former 212-acre Johnson & Johnson complex across from Commerce Boulevard on Route 1 in North Brunswick was converted to a transit-oriented development, which Narra said she had voted for, and is now part of Middlesex County’s Destination 2040 initiative as a future-forward growth strategy, she said. “Despite the challenges of the past year, the MCIA has continued to move this project forward,” Narra said. North Brunswick Mayor Francis “Mac” Womack had technical difficulties during the live press conference. Afterward, he said, “We thank Middlesex County, the MCIA, the New Jersey

Department of Transportation (DOT) and NJ Transit for their continued partnership in this much-needed train station that will bring so many benefits to our municipality. North Brunswick looks forward to continuing to work with these partners, now joined by WSP USA, to move this project forward in a swift fashion.” Diane Gutierrez-Scaccetti, DOT commissioner, said New Jersey is “built on the fabric of its communities” and “we are a state of neighborhoods.” “We recognize who our customers are and we recognize the importance of serving them,” she said. She said the area surrounding the North Brunswick train station, which includes residential, retail, restaurants and a hotel, is a “new neighborhood” which makes for a safe place to live, work and play, and the train station will reflect the community it serves. Kevin Corbett, president and CEO of NJ Transit, said this rail line is the “lifeblood” between New York and Philadelphia. He noted other ongoing NJ Transit projects, such as the Raritan bridge replacement, improvements to the County Yard operated by Delco on the North Brunswick-New Brunswick border, upgrades to the Perth Amboy station, new elevators and a renovated waiting room at the New Brunswick station, and increased stops at the Avenel station. “I hope the people of Middlesex are really seeing improvements to service,” he said. In regard to the North Brunswick train station, Michael O’Neill, project manager from WSP, said there will be many environmentally sensitive features, such as LED lighting, environmentally friendly cleaning supplies and eco-friendly materials. On Oct. 28, 2016, officials announced the receipt of $50 million from the state Transportation Trust Fund for the project. Middlesex County officials pledged $20 million to add a station stop at the former J&J site. Garden Homes Development, which has been developing the MainStreetNB project since 2006, began its vision for a transit village and associated train station in 2006. Currently, a Target, a Costco with a gas station, a drive-up Panera Bread, a Marriott and a Greene Turtle are on the property, along with condominium units. The second phase of the project was contingent upon the train station. Moreira claims those officers were targeted by Hayducka by intimidation; and that he has been retaliated against for engaging in conduct that is protected under CEPA. Moreira claims Hayducka fostered a culture of retaliation against employees who engaged in CEPA-protected conduct within the police department “and set a tone for his subordinates that such retaliation was appropriate and encouraged” according to the lawsuit. On June 1, 2020, Moreira states, he was advised the prosecutor’s office had completed its investigation and took no action against Hayducka. He said on or about June 23, he was instructed to report to Hayducka’s office, where his badge and gun were taken from him, and that without any examination by a medical professional he was told he was a “hazard” and “unfit for duty” and placed on immediate suspension, according to the lawsuit. He said he was referred back to the prosecutor’s office regarding allegations he had lied during a disciplinary hearing. On July 13, Moreira claims, while he was suspended, two lieutenants came to his residence and told him to speak with a captain, even though he said he had been ordered by Hayducka not to speak with anyone from the police department. He said he was served with notice of an Internal Affairs investigation for failure to answer his phone despite the warnings. Moreira claims this was another form of retaliation, according to the lawsuit. On July 30, during the police union’s quarterly meeting at Rowland Park in South Brunswick, Moreira said he attended the meeting to pick up a form for his pending disciplinary action, but alleged the PBA president publicly stated that no one from the union should speak to him or another patrolman because they were found guilty of lying. Moreira said the PBA president threatened that anyone who spoke with them would be indicted, arrested and/or suspended, according to reports. Moreira’s suspension ended on Sept. 11 after the prosecutor’s office declined to pursue the allegation of lying made against him, according to the document. Moreira said he was then placed on administrative

leave. Moreira said he made a formal report of retaliatory harassment and a hostile work environment to a captain on or about Oct. 13, against the township, Hayducka and the PBA president. He said he has been subjected to a bogus charge of a 30-day suspension without pay. There are other charges pending, he said in the lawsuit. Moreira returned to work on Jan. 25. He cited a memo from Hayducka which mandates the exact minute he is permitted to eat lunch and prohibits him from carrying his service weapon and badge. A copy of the reported memo from Hayducka was not available by press time. Moreira also claims his request to have a hearing conducted remotely because of the coronavirus pandemic was denied. He also claims he was denied on Jan. 25 to have an attorney present during the Internal Investigations interview. Jack Venturi, Hayducka’s lawyer, insisted the lawsuit is completely untrue. “This is a bogus lawsuit filed by a problem child police officer who has received numerous disciplines in the past,” Venturi said, calling Moreira “belligerent.” Venturi said the allegations against Hayducka were investigated by the Middlesex County Prosecutor’s Office, “and the results demonstrated that there was no criminal conduct or administrative violations. He was exonerated of these false accusations. We are confident there is no merit to the civil complaint and he looks forward to addressing them in court.” Venturi said Moreira knew he was going to be terminated, so he filed the lawsuit in advance. “This is a well-respected police chief throughout the state of New Jersey who has an impeccable record,” Venturi said. Venturi said Moreira has been going through incremental (graduated) discipline throughout his career, and although he has been given “numerous chances to improve” as well as additional training, “nothing has improved, and if anything, it’s gotten worse.” Venturi said the lawsuit is at its beginning stages, with only the pleadings (complaint and answers) filed so far. He said the next steps would be to acquire discovery, then depositions. There is no trial date set at this time.

a loss of $1.15 million in Fiscal Year (FY) 2020; a loss of $1.77 million in FY 21; a loss of $2.19 million in FY 22; a loss of $2 million in FY 23; a loss of $1.27 million in FY 24; and a loss of $403,000 in FY 25; for a total loss of $9 million over six years. S-2 has been “very, very problematic” for South Brunswick, Feder said. However, for 2021-22, according to administrators, because South Brunswick’s ratables have decreased by $700 million, the school district will see its state aid drop by $260,000 and not by $2.19 million as previously indicated in the S-2 schedule. Feder said despite any loss in state aid, administrators are tasked with ensuring that all programs run properly, that class size is maintained and that students do not feel the effects of any budget restraints. He said although the school district will lose less in state aid for 2021-22 than previously indicated, there is no way to know if South Brunswick will feel it worse in the 2022-23 and 2023-24 school budgets. “Imagine running a business with this information,” Feder said. “We are lucky this year. We could be lucky again next year or they could take $4 million next year.” Other expenses South Brunswick schools will receive $2.4 million for coronavirus pandemic relief. Feder said that money is not part of the budget yet, “but will help make up for any lost ground due to the pandemic” such as staffing, materials, impact on learning and impact on social emotional learning. Feder said that in January, Chapter 44 offered a new insurance plan that allows staff members to downgrade their health insurance for less money, but this causes a $450,000 loss to the district. In terms of revenues, the summer institute will be down because of fewer students, community education will be flat, facility rentals are non-existent because buildings are closed, and food service will break even at about $200,000. Another impact to the budget could be a legislative bill that would offer an extension for special education students until age 22; that could be a $700,000 to $900,000 expense, Feder said. The bill could also allow parents to keep their children in school for another year of education, which would have a “massive” impact on budgeting, Feder said. He rhetorically asked what would happen if a child is held back in kindergarten? Where is the space? Where is the staff? Feder said administrators need to assess the impact of the pandemic, review program efficiencies, assess enrollment, seek grant opportunities and review vendor relationships.
