Judge dismisses challenge of 2019 mayoral election in Sayreville By MATTHEW SOCKOL Staff Writer
A
New Jersey Superior Court judge has dismissed a candidate’s verified petition contesting the results of last year’s mayoral election in Sayreville. The petition from Arthur Rittenhouse, the Republican candidate for mayor in 2019, was dismissed by state Superior Court Judge Arthur Bergman on Oct. 26. A subsequent motion from Rittenhouse’s legal team to reconsider was denied by Superior Court Judge Thomas McCloskey on Dec. 4. Rittenhouse’s legal team filed the petition in late 2019 against Middlesex County Clerk Elaine Flynn; the Middlesex County Board of Elections; an unidentified Middlesex County official who was responsible for part of the election; and Victoria
Kilpatrick, the Democratic candidate for mayor. In that year’s race for mayor, Kilpatrick was initially declared the winner over Rittenhouse by a margin of three votes. After Rittenhouse sought a recount of the election results, Kilpatrick was again declared the winner by a margin of six votes. She was sworn in as mayor in January. The petition on the behalf of Rittenhouse alleged provisional and mail-in ballots that could have changed the outcome of the election were improperly rejected. According to the petition, 46 provisional ballots from the election were not counted; 35 were allegedly not properly locked in the official bag and five were allegedly not placed in the official bag. It was also alleged by the petition that it was unclear whether the total mail-in ballots were accurate due to difficulties with the scanning
machine. The 35 provisional ballots were recounted in May, which increased Kilpatrick’s margin of victory to 18 votes. However, a letter sent to Bergman from Rittenhouse’s legal team in August noted that 11 provisional ballots were not recounted and three mail-in-ballots appeared to be rejected on discretionary grounds, leaving 14 ballots contested. With the number of known contested votes being close to a margin of victory four votes apart, Rittenhouse’s legal team argued that there was substantial uncertainty in the outcome of the election, warranting a special election to be held. Rittenhouse’s legal team also alleged that there were numerous errors and irregularities during the election process capable of changing the outcome of the election. (Continued on page 7)
much-needed traffic light at the intersection of Route 34, a state highway, and Amboy Road is expected to be installed next summer. Councilwoman Debbie Walker read a letter during a council meeting on Dec. 14 that Township Engineer Nicole Shapiro wrote to township officials announcing the traffic light, which has been almost 40 years in the making. Township officials and professionals met with the New Jersey Department of Transportation (DOT) in October requesting the traffic signal. For DOT to move forward, it needed a commitment from the township, by resolution, to pay 25% of the construction costs. DOT estimated the construction costs of the traffic signal at $225,000. The council unanimously approved a resolution to commit 25%, or $56,250, for the traffic signal at the meeting. Walker said she has advocated for a traffic signal at the intersection for many years with Council President Mary Sohor even before she was on council. “There have been a lot of accidents [in the area],” she said, noting there was an accident last week at Lambertson and Amboy roads. “Hopefully when the light comes in we can readdress the Disbrow [Road] situation and make [the whole area] safer.” In July, officials proposed to essentially make Disbrow Road a dead-end street for people traveling from Lambertson Road crossing Amboy Road. Over the years, attempts to slow down traffic on Route 34, Disbrow and Amboy roads has included the installation of solar stop signs, signage and police enforcement patrol.

Retiring SWMHS math teacher a true ‘Bomber’ By MATTHEW SOCKOL Staff Writer
SAYREVILLE – A longtime mathematics teacher at Sayreville War Memorial High School (SWMHS) will be retiring from the Sayreville School District next year. During a recent meeting, members of the Board of Education approved the retirement of high school mathematics teacher Richard Nemshick. His retirement will become effective on Jan. 1, 2021. “This one’s probably going to hurt for me because I’ve established such a great friendship with this person,” Superintendent of Schools Richard Labbe said. “He’s a person that I met when I first came in.”
Noting the hazing incident involving the SWMHS football team that occurred shortly after becoming superintendent, Labbe described how he met Nemshick through the matter. “This is a person who I had a chance to work with to some degree in that matter as he was representing some of our teachers and so forth,” he said. “I got to know real quick that this was a man of great integrity and a man with a great sense of caring for the human beings in this industry, not only the students, but the adults too, and someone who I admire greatly for those attributes.” The superintendent described Nemshick as an integral part of the high school teaching staff and a role model to many of
his students who always put his students first and made sure they learn in a variety of ways. He also described Nemshick as energetic, enthusiastic and honest. “One of the things that I admire most about Mr. Nemshick is his candor,” Labbe said. “He has been an inspiration for all students and staff, especially me. He has left many memories behind in SWMHS. We are going to miss you very much, Mr. Nemshick, especially everything you have done to support the high school staff over the many years. It’s hard to believe that the time has come to say goodbye.” Labbe concluded his comments by calling Nemshick the definition of a Bomber, the nickname for those associated with SWMHS.
“If you ever spent 10 minutes with Rick Nemshick, you would know what a Bomber is,” he said. “He exemplifies what a Bomber is. When the pandemic wasn’t here, he was at every football game, every activity. One the most special moments of last year was when we were doing Operation B Strong and delivering lunches, Mr. Nemshick would come out of his apartment waving a Bomber flag every time we went by. That is Richard Nemshick. “He is an amazing person who I am going to miss dearly,” the superintendent continued. “Mr. Nemshick, we thank you so much for all you have done for your students, first and foremost, and, of course for this district and this entire community.”

Reformed Church Home adds air filtration system as COVID-19 preventative measure OLD BRIDGE - Reformed Church Home (RCH), a long-term care community offering nursing home, rehabilitation, and assisted living services to the elderly, has announced the addition of a Needlepoint Bipolar Ionization (NPBI) system from Global Plasma Solutions (GPS) to improve air quality. The installation helps improve ventilation in all common areas, alcoves and corridors throughout the home, located on Route 18 in Old Bridge, by deactivating harmful pathogens. NPBI is an air cleaning system that uses ions to disrupt surface proteins of viruses and bacteria with which they come in contact, rendering them inactive and unable
to spread. This in turn reduces the volume of infectious pathogens in the air and improves the efficiency of air filtration, without introducing ozone or harmful byproducts into the ventilation system, according to information provided by RCH. Independent tests have determined the GPS NPBI system reduces many types of harmful pathogens in the air, including COVID-19, and the company is actively undertaking additional research, development and testing in the fight against the novel coronavirus, according to the statement. Company literature reinforces that all applicable federal, state, and local health guidelines as well as official guidance
from the Centers for Disease Control and Prevention must be followed when NPBI is in use, according to the statement. This includes but is not limited to social distancing, hand hygiene, cough etiquette, and the use of face masks. “We felt it was important to make this investment and do everything possible to reduce exposure to COVID-19 in our building. Earlier this year, our Building Services Department began applying a clean surface mist product called GR-AD Pro in resident rooms and common areas, so the addition of GPS’ bipolar ionization product was one more important step in mitigating risks to our air quality and living environment,” Kate Shepard, executive

Middlesex County awards additional $4.2M in funding to small businesses

With millions still available in the SBRG grant to be distributed to small businesses in the county, those eligible to apply for grants are encouraged to do so at the new CARES Act Small Business Relief Grants Portal. ith Middlesex County’s latest disbursement of $4,246,819 in grant funding to small businesses, the total amount awarded through the Small Business Relief Grant (SBRG) program is $10,859,415 to a total of 421 businesses. The SBRG program, which utilizes federal CARES Act funding, serves to reimburse costs and loss of revenue associated with adapting business operations in a COVID-19 environment. The deadline to apply for funding from the SBRG program is Dec. 30. In the latest round of funding awarded on Nov. 30, businesses received payments ranging from $1,018 to the maximum $30,000, with an average grant payment of $26,030, according to information provided by Middlesex County. “As the head of the county’s Economic and Business Development office, I work every day with small business owners. From contacting them and encouraging them to apply, to working with them step by step to complete the application, I witness firsthand the impact this pandemic has had on our small business community,” Carla Cefalo, division head, Middlesex County Economic and Business Development, said in the statement. “The county is putting its small business owners first, offering them relief during this difficult economic downturn, and I am proud to play a role in that process.” Recipients of this round of federal funding include restaurants, hair and nail salons; retail facilities; healthcare offices; manufacturing; construction; educational services; transportation companies; and fitness studios. “The grant the Ad Cafe received basically gave our company financial room to breathe. It gave us the opportunity to pay our vendors in the timely manner which they were always accustomed to. It also gave us the opportunity to restart and redirect our marketing efforts that were cut short by the pandemic,” SBRG recipient, Kevin Berta, owner and president of Ad Cafe in Edison, said in the statement. Berta also said he is encouraging people around the county to shop local to support small businesses in any way possible, according to the statement. In October, Middlesex County announced its first round of SBRG funding, awarded to 123 businesses in 22 municipalities, totaling over $3 million. In November, 140 businesses received a collective $3,572,882 in the second and third rounds of funding. “I would like to thank all of our small

The allegations were it was unclear how many provisional ballots went missing because a number of them were misplaced, Sayreville Business Administrator Dan Frankel did not recuse himself as a Board of Elections commissioner for the race, the original vote tally of mail-in ballots was erased and it was unclear if the total mail-in ballots were accurate due to machine jams. “These errors and irregularities imperiled the entire election,” attorney Ruby Khallouf wrote on the behalf of Rittenhouse. “In light of all of these errors and irregularities, it is impossible to quantify the true number of contested votes at issue.” Emphasizing the alleged errors and irregularities, Rittenhouse’s legal team stated that the court must declare the results of the mayoral election null and void and order a special election to be held. In response to the allegations of errors and irregularities, Bergman said that not a single ballot has been found that fits the description of a provisional ballot that went missing and no evidence was provided to seek Frankel’s recusal. According to Berg-
man, all votes by the four-member board, which has two Democratic and two Republican members, were unanimous. Bergman also stated that there is nothing in the record to indicate that the final count is not accurate, and there is nothing in the record to support any conclusion other than the recount is accurate. The judge made note of the recount being performed in the presence of everyone interested in the outcome to ensure the results were correct. “This court is of the opinion that it has undertaken all the efforts necessary to determine that the final ballot count is one that all voters can have confidence in,” Bergman wrote. Ordering the petition to be dismissed, Bergman also noted that the 14 uncounted votes would not be enough to change the outcome of the election and Rittenhouse’s legal team conceded that they were unaware of the exact number or the exact nature of alleged errors and irregularities unless and until the parties engage in discovering them. “What plaintiffs seek is something that I have routinely pointed out is not granted by the Court, but by the Department of Environmental Protection,” he wrote. “They are seeking a fishing license.”
