Firm proposing solid waste transfer site in Howell sues county By CHARLES DAYE Staff Writer

laiming its application to construct a solid waste transfer station in Howell has been pushed off for years, Resource Engineering has filed a legal complaint against the Monmouth County Board of Freeholders, the Monmouth County Solid Waste Advisory Council (SWAC) and the Monmouth County Department of Public Works. Resource Engineering is seeking to have its plan to establish a solid waste transfer station at 34 Randolph Road, near Route 547, Howell, included in the county’s Solid Waste Management Plan. The proposal has been at the county level for several years awaiting formal action. Previous reports indicated the proposed facility would accept 1,500 tons per day of cleanup debris and construction debris. The debris would be sorted and recyclable materials would be removed. The debris would then be transferred to other locations for final disposal. Resource Engineering filed the complaint against the county on Aug. 10. Monmouth County Attorney Michael D. Fitzgerald said outside counsel will handle the lawsuit. As of Sept. 23, the county’s legal representatives had not responded to the complaint. Howell’s Township Manager Brian Geoghegan said the township attorney would seek to intervene in the matter. “We will fight to prevent the construction of the transfer station in Howell,” Geoghegan said. According to the complaint, in 2015, Resource Engineering began the process of seeking approvals from Monmouth County to construct and operate a new solid waste transfer station in Howell. The complaint states that the “need for a new solid waste facility is indisputable; construction debris and other materials generated by the rapid expansion of residential housing in Lakewood and surrounding municipalities is currently being trucked through Ocean and Monmouth counties, which is causing pollution, stressing local and county roads, depriving Monmouth County of tax revenue and jobs.” According to the complaint, Monmouth County and Howell officials agreed that the need for the new solid waste facility is indisputable and it asserts that SWAC and Howell “both gave their blessing to the project; Howell by letter of support dated March 6, 2017, and SWAC by unanimous approval on May 18, 2017.” The freeholders were scheduled to vote on the matter on July 27, 2017, but that did not occur. According to the complaint, on the date of the meeting, Howell Mayor Theresa Berger, who was out of the country, “sent a (Continued on page 11)

Remediation of spoiled land will fulfill a dream for Liberty State Park
L
iberty State Park in Jersey City – the state’s most popular park, with more than five million annual visitors – has been called New Jersey’s Central Park. But it has something Central Park doesn’t have: spectacular views of the Statue of Liberty, Ellis Island, the Manhattan skyline, New York Harbor and the Verrazzano Narrows Bridge. This state we’re in got good news recently when the New Jersey Department of Environmental Protection (DEP) announced it will move ahead with long-discussed plans to improve Liberty State Park by cleaning up contaminated land in its interior section and opening it to the public. The restoration will expand the park’s usable acreage by 40%, with over 7 miles of new trails. Two of the plan’s most enthusiastic supporters are Sam Pesin, son of park founder Morris Pesin and president of the Friends of Liberty State Park; and Greg Remaud, head of the New York-New Jersey Baykeeper advocacy group. As the state prepares to introduce park restoration plans at a public meeting this fall, Sam and Greg spoke with the New Jersey Conservation Foundation about the park, its history, their hopes for its future and why New Jerseyans should support the restoration. Here are some highlights: Q: Why is Liberty State Park so important to all of New Jersey? Sam: Liberty State Park is priceless and sacred public land – a very scarce urban open space in a densely populated area. The park has been shown, especially during the pandemic, to be essential for emotional health, physical health, mental health and spiritual health. It’s so crucial to the quality of life of urban people, and it certainly uplifts the spirits of all who visit. Greg: Hudson County is among the most densely populated counties in the country and there’s not a lot of green spaces, especially large green spaces. You come to Liberty State Park and there are

A contemplation about life before death
I
n one of his public speeches recently, Vice President Mike Pence briefly touched on the subject of religion, where he proceeded to give his ecclesiastical opinion on the existence and rewards of a heavenly afterlife for the truly faithful. Since the beginning of civilization, people have watched other people die and in all that time there has been no empirical, factual evidence other than death is final. From my perspective, at least, there is no reason to think our end should be any different than the one faced by all other living creatures. There is nothing in the nature of things to suggest our species has been granted a celestial exemption from the rules governing the fate of all other living things. The fact is, back of life we cannot go, beyond death we cannot see. To this question no man or woman has ever lived, who know anymore about the existence of an
afterlife than another – that is to say, nothing! I do not say that man is not immortal, all I say is there is no proof that he is, despite all the Sunday promises and the Vice President’s assurances; better to honestly, hopefully hope, than to dishonestly affirm. All which reminds me of what one skeptic once said about the promise of heavenly rewards: “I will invest in no corporation that does not pay dividends until after you are dead.” Is there life after death? I do not deny, I do not know, but unlike the Vice President, I do not believe. What I believe in is – life before death! We are all part of the natural world to which, in time, we all shall return and in between, we garden.

New tax will address income inequality
P
resident John F. Kennedy said that “If a free society cannot help the many who are poor, it cannot save the few who are rich.” In keeping with JFK’s principle, Gov. Phil Murphy has provided New Jersey with a millionaires tax. The new tax will also attack the scourge
of income inequality by providing relief to middle and lower income families. Kudos also to the Democratic legislative leadership for supporting this needed reform in the age of COVID.

Officials honor former council president for service to Jackson By CHARLES DAYE Staff Writer
JACKSON – The members of the Jackson Township Council honored Barry Calogero, a former council president, during a recent meeting. Calogero resigned from the council on May 13 in his seventh year of service on the governing body. He said his job as the executive director for the U.S. Department of Agriculture Farm Service Agency in New Jersey and
his ongoing battle with Parkinson’s disease led to his decision to step down from the dais. On Aug. 25, council President Alex Sauickie said the members of Jackson’s governing body wanted to honor Calogero, but had not had the opportunity to do so with COVID-19 restrictions that were previously in place. Members of the public were permitted to attend the Aug. 25 meeting. Calogero was present at the municipal building.

Sauickie said Calogero “is Jackson’s adopted son from Queens, N.Y. He met the love of his life, Gina, when they were in Queens and thankfully moved to Jackson. Whether he realizes it or not, he really affected a lot of people’s lives, particularly inspiring several of us up here, myself included, to serve in public office.” “I had the honor of meeting Barry about six years ago. I got to watch what he was doing in town. He was nice enough to mentor me and to take me under his wing, and a few years later I am doing what I always wanted to do – serving this town. I certainly have had Barry as an example,” Sauickie said. The council members presented Calog-
ero with a plaque which noted his years of service, 2013-20, his time as council president, 2019-20, and as council vice president, 2014-19. The council members also presented Calogero with his parking space sign, his nameplate from his time on the dais and his mailbox from the municipal clerk’s office. “The last eight years have been a true honor to serve the people of Jackson. I left the township in great hands, you guys are doing a great job; continue doing it. And to the residents, don’t forget to vote for these gentleman in November,” Calogero said. Mayor Michael Reina said Calogero’s contributions left a footprint for others to follow.
Council approves door upgrades By CHARLES DAYE Staff Writer
JACKSON – Municipal officials will accept bids for a project to construct handicapped accessible entrances at certain public buildings in Jackson. During a meeting on Aug. 25, Township Council President Alex Sauickie, Vice President Andrew Kern, Councilman Ken Bressi and Councilman Martin Flemming authorized the acceptance of bids for the construction of handicapped accessible doors at the municipal building, the senior center, the Jackson Justice Complex and the Department of Public Works. “After a fall in June 2017, I almost lost my leg and after a very long and grueling recovery, I was left permanently handicapped,” Kern said. “That incident and every day of my life thereafter I have looked at the world differently.
“Seeing and experiencing physical obstacles and barriers that I may not have noticed in the past has given me insight into the challenges our senior community and the disabled residents of our community face every day,” he said. Kern thanked the Jackson School District Board of Education and Stephen Genco, the former superintendent of schools, for replacing such barriers at Jackson Liberty High School. Kern said curbing between the main parking lot and the school’s entrance was not wheelchair-friendly. “I would like to take this opportunity to thank the school district for completing the job in just a few weeks. While we cannot snap our fingers and make everything perfect for everyone, this council works with the administration every day to make this town a better place for all of our residents,” he said.

judge has ruled that a teenager who has been charged in the October 2019 death of a man whose body was found laying in a road in Howell will now face those charges in adult court, Monmouth County Prosecutor Christopher J. Gramiccioni announced on Sept. 15. State Superior Court Judge Richard W. English, sitting in Freehold, waived Alberto Rojas Hernandez, now 18, of Lakewood, from family court up to adult court to face charges of first degree conspiracy to commit murder, first degree murder, third degree possession of a weapon for an unlawful purpose and fourth degree unlawful possession of a weapon, Gramiccioni said. Rojas Hernandez is being held in the Middlesex County Youth Detention Center, North Brunswick. He has been held since his arrest in October. Rojas Hernandez is scheduled to have a first appearance and detention hearing on Sept. 17. If convicted of murder, Rojas Hernandez faces a minimum sentence of 30 years in a New Jersey state prison without parole and a maximum sentence of life imprisonment. Rojas Hernandez’s uncle, Juan Carlos Rivera Rojas (also known as Omar Rivera Rojas), 29, of Lakewood, was previously charged with first degree murder. NEWS BRIEFS The annual Howell Day and Green Fair community celebration has been cancelled for 2020, but is expected to return in 2021. The decision to cancel the event was announced on Aug. 20 as New Jersey’s residents and local officials continued to deal with the effects of the 2020 coronavirus pandemic. “Howell was hopeful the governor’s executive orders (related to the pandemic) would have been modified so we could have held Howell Day, hence our delay in making the call to cancel. “Unfortunately, we are now to the point that even if the restrictions are lifted we would not have sufficient time to plan the event properly. sponded to a 911 call at 3:46 a.m. Oct. 18, 2019, reporting an unconscious male laying in Hurley Pond Road just east of Route 547. Officers who arrived at the scene found a Hispanic male laying face down in the road. The incident was initially investigated as a fatal hit and run motor vehicle incident. However, upon the arrival of investigators from the Monmouth County Serious Collision Analysis Response Team, it was
determined the man’s death was not the result of a hit and run event, according to Gramiccioni. The man, identified as Domingo Merino Rafael, 33, of Lakewood, was deceased. An autopsy determined the cause of death was homicide. A joint investigation by the Monmouth County Prosecutor’s Office and the Howell Police Department determined Rojas Hernandez, Rivera Rojas and Merino Rafael traveled from Lakewood to Middlesex
County on the evening of Oct. 17, 2019. The men were returning to Lakewood in the early morning hours of Oct. 18, 2019, when they got into an argument that allegedly culminated with the murder of Merino Rafael, according to Gramiccioni. The Monmouth County Prosecutor’s Office and the Howell Police Department credited the Lakewood Police Department and the Ocean County Prosecutor’s Office for their assistance during the investigation.

Freeholders provide COVID-19, election and CARES Act funding updates The Monmouth County Board of Freeholders provided updates about COVID-19, the Nov. 3 general election and CARES Act funding during a press conference held on Sept. 24. “I know there has been a lot of talk about the recent uptick in COVID cases in Monmouth County and I would like to shed some light on these cases and the reasons they are occurring,� Freeholder Director Thomas A. Arnone said in a press release provided by the county. “The Monmouth County Health Department’s (MCHD) case investigations have determined the bulk of exposures are from youth athletic facilities, school sports practices and gatherings that occurred during Labor Day weekend and almost half of the new cases are young adults between the ages of 16 and 25. “It is also important to note the MCHD has conducted a thorough review of all the COVID-19 cases in the 29 towns they serve and no cases have been linked to restaurants or retail food establishments at this time,� Arnone said. Freeholder Deputy Director Susan M. Kiley offered updates about the Monmouth County COVID-19 testing program at locations in Asbury Park, Freehold Borough, Keansburg, Long Branch, Neptune and Red Bank. “The county has administered 2,749 tests to date and 57 of those tests have come back positive,â€? Kiley said. “These low positivity percentages can be attributed to wearing masks, practicing social distancing and getting tested for the virus.â€? The testing site locations, dates and hours of operation are posted on the county’s website at www.visitmonmouth.com Arnone spoke about the upcoming general election and what the county is doing in preparation for Nov. 3. “I want you to know Monmouth County is doing everything in our power to make this process as efďŹ cient, accessible and secure as possible,â€? Arnone said. “In an effort to assist with the counting of ballots from the nearly 500,000 registered votes in Monmouth County, we have purchased four additional ballot scanners and the
most robust and secure suite of integrated voting software solutions on the market, investing more than $230,000.â€? Dominion Voting Systems’ software will automatically and digitally route ballots for adjudication. This feature is a ďŹ rst in the industry and eliminates the manual duplicating of ballots. This also protects the ballot chain of custody and limits the handling of voter marked ballots, according to the press release. “Monmouth County has also hired 60 individuals to assist the Board of Elections with opening the ballots and placing them in the scanners,â€? Arnone said. Arnone also provided an update about the distribution of grant dollars through the Monmouth County CARES Economic Assistance Grant program and its use for the Monmouth County Vocational School District (MCVSD). “To date, we have received more than 2,200 applications and handled more than 3,400 phone calls regarding the program. 2021 Kia K5 EX
I
t’s September. Fall is upon us. Time for new beginnings, right? So, we here at On The Road have an all new car to review for you this week – our first 2021 model, as well. South Korean auto maker Kia – a fast growing brand in the United States – has introduced an all new model – the 2021 Kia K5, a mid-sized rather upscale sedan that replaces its former Optima model. I recently had the pleasure of driving this vehicle Peter Perrotta for one week and came away with an overall positive impression, although there are some things I will nitpick. The K5 model I drove for the week was the EX model that carries a base sticker price of $27,990. My tester added a $3,400 premium package and $995 for destination and delivery, bringing the grand total sticker price to $32,365. Included in the premium package is: navigation with a 10.25 inch screen; Bose premium sound system; power seats; heated steering wheel; and a lot of advanced safety equipment. The overall outside look of this newly designed vehicle is a winner. This sedan has an aggressive and sporty sculpted stance that is capable of turning heads. “Gorgeous, outside and in,” is what the editors at Car and Driver boasted about the new K5. I would have to agree. Powering the new K5 is a 1.6 liter turbo charged 4 cylinder engine that is coupled with a smooth shifting 8-speed automatic transmission. This engine produces an impressive 180 horsepower and 195 pound feet of torque. The K5 drives like a more expensive sleek European luxury car, without carrying the high price tag. It’s athletic-able to complete lane changes and passing maneuvers without a hitch. It has enough power to cruise nicely at the higher speeds on the

interstate. In fact, this mid-sized sedan sometimes is going a lot faster than the driver – namely me – realizes at times. Witness the one afternoon when I was hurrying back from lunch and got pulled over for doing 53 in a 35 mph speed zone. When I explained to the officer that I write car reviews, he let me go with just a warning. The interior of the K5 is well appointed with a lot of upscale and ergonomically friendly buttons and switches and a fairly responsive touch screen command system. However, I found the navigation system a bit troublesome. When you attempt to enter a destination address manually, it is very frustrating. There are very few addresses this navigation system seemed to be able to find easily. The best way around this glitch was for me to enter the general zip code of the destination I was headed to, rather than the exact address. Once I did that, I then was able to enter the exact address as a midway point along the route and the system was then able to find it. This is way too cumbersome and
time consuming. It probably can be corrected with a simple software upgrade. This Kia K5 is pretty miserly when it comes to drinking gas, too. It has an EPA fuel consumption rating of 31 miles per gallon overall – 27 in city driving and 37 on the highway. The EPA estimates that the K5 will cost about on average $1,300 a year for gas as it uses about 3.2 gallons of gas per every 100 miles driven. This 2021 K5 is too new and hasn’t been tested for the government’s 5 star safety crash test yet. The new K5 comes with a lot of impressive standard equipment, including: an 8 inch touchscreen with Android Auto and Apple Car play; rear view camera with dynamic guidelines; Sirius Satellite radio free for three months; leatherette seat trim; heated and ventilated front seats; and a whole lot more. As far as comfort and roominess go, the K5 passes the test. While it’s not an overly expansive mid-sized sedan it is designed well enough to get in and out of with ease even with its low stance to the ground.
The front and rear leg room is sufficient and the rear seat is fairly roomy as well. The first 2021 EX comes in front wheel drive only. A four wheel drive version is to be added later this year. Moreover, later this year, Kia will offer a significantly sportier GT version of the K5 featuring a more powerful engine, a panoramic sunroof and an added all wheel drive option. As is the case with all Kias, their standard warranty that comes with all of their models is one of the best available on the car market. The bumper to bumper limited warranty covers five years or 60,000 miles, whichever comes first. The powertrain warranty covers 10 years or 100,000 miles. While the mid-sized sedan market is fastly shrinking – consumers are more and more going for the crossover and SUV models – if you are in the market for a midsized sedan at a reasonable price, the K5 is one to consider.

scathing e-mail objecting to the proposed transfer station; an inexplicable repudiation of the township’s March 6, 2017 letter, upon which SWAC and other county officials had relied in moving forward with the project.” The complaint alleges that the county obstructed and hindered Resource Engineering’s proposal. “Instead of questioning the mayor’s about-face, taking testimony on the application and voting, the board (of freeholders) ran for cover; the meeting was canceled, and Resource Engineering’s application was improperly sent back to SWAC. “Thus began a now more than threeyear merry-go-round of defendants’ interference, stonewalling and red tape. (Resource Engineering believes) powerful political interests in Monmouth County and beyond coordinated with (the freeholders) and SWAC to improperly interfere with, obstruct and hinder Resource Engineering’s proposal,” according to the complaint. Resource Engineering wants Monmouth County to stop “endless studies” and claims it is entitled to recoup hundreds
of thousands of dollars. “Respectfully, the court should order SWAC and (the freeholders) to stop their endless ‘studies’ of plaintiff’s proposal and approve the application. “Resource Engineering is also entitled to recoup from defendants the hundreds of thousands of dollars it spent over the past three years on experts, lawyers and other professionals trying to satisfy defendants’ demands,” the complaint states. In September 2018, additional correspondence was sent to the freeholders from Howell which indicated that a traffic study commissioned by the county should account for other anticipated development in the area of Randolph Road and Route 547. On Jan. 17, Berger attended a SWAC meeting at which an update regarding a county traffic study that has been conducted in conjunction with the proposal for the solid waste transfer station was on the agenda. Berger subsequently reported that SWAC was not prepared to share the county’s preliminary report with the public. In March, members of the Howell Township Council said they wanted to conduct their own traffic study in regard to the proposed solid waste transfer station.

NEWS BRIEFS A development application which proposes the construction of 549 single-family and multi-family residences has been carried indefinitely by the Jackson Planning Board. The application for the south section of the Jackson Parke residential development involves a 129-acre tract off West Veterans Highway in the Cassville section of Jackson. The board’s professionals have said 100 of the proposed 549 units would be designated as affordable housing units. Affordable housing is defined as housing that is sold or rented at below market rates to individuals and families whose income meets certain guidelines. The Jackson Parke south section application was on the board’s Aug. 17 agenda under legal matters. No testimony regarding the proposal was heard and the board’s attorney, Sean Gertner, said the application has been carried indefinitely pursuant to a court order. The Jackson Parke south section is part of the larger Jackson Parke development. The Jackson Parke north section, which was proposed by EL at Jackson LLC, has been approved. Plans call for the construction of 551 residences on a 226-acre tract off Perrineville Road in the Cassville section of Jackson. R
acism. In itself, it’s a horrific term. Slavery by itself is a mind-numbing wrong. Combine the two in a modern-day film that feels ripped from the plantations of a Civil War-era Deep South, and you have a film whose very premise is horrific. Combine the overt racism of the past with the subtler racism of the present, and the horror of the new film Antebellum is more than just a garden variety excursion into the genre. Our story begins as Eden (Janelle Monáe) is surviving picking cotton in the fields for a ruthless master. The Confederate army has commandeered this plantation and will have their way with every person and thing at their disposal. Eden tries to motivate the rest of the slaves to keep them from going crazy in the unnatural environment in which they are residing, all while trying to engineer an escape to the North, and to safety. But the journey is filled with abuses and pain as she watches friends get beaten and lives get lost. Through it all she has kept her friends close and her enemies closer. Meanwhile, a parallel path of existence is plowing forward through the concrete
jungle. There, Veronica (also Monáe) is a successful author who uses her position to empower the Black women of today. While she is speaking at a conference, we are introduced to some of Veronica’s friends and family who are almost too good to believe. She seems to be a woman who has it all. But does she? The two worlds eventually collide as the story from the past and the story in the present shape the future of Veronica and her family and friends. Other than the deeper meaning that runs beneath the surface, just what is the connection that binds the two scenarios together? This is not a classic horror movie. The scares are subtle and lie beneath the everbubbling surface of discontent. Mental horrors that will make you think and generate conversation abound, despite a fairly weakly crafted end sequence. I found my heart pounding and racing throughout the film as I waited for the bow to be tied on this story. Although that bow is messy, the visuals and Monáe’s talent make Antebellum a worthy film to chill you at your core. Now, whether society is ready for a film like Antebellum and its underlying messages at this time — well, that’s a discussion for the rest of you.

Breen sweeps Sunday stakes to wrap up Monmouth training title OCEANPORT – Kelly Breen celebrated his return to the top of the Monmouth Park trainer standings after a 14-year absence by winning both stakes races during final day of the track’s 75th season on Sept. 27. The 51-year-old New Jersey native led the trainers’ race virtually from the start of the meet in claiming his third Monmouth Park training title. He was also the track’s leading trainer in 2005 and 2006, according to a press release. Paco Lopez was the leading rider for the seventh time, with Klaravich Stables finishing as the leading owner. The thoroughbred season in New Jersey will continue with the start of the nine-day Meadowlands at Monmouth Park meet beginning Oct. 3 (Preakness Day). After also racing on Oct. 4, the live racing schedule for the month will switch to the next three Wednesdays and Saturdays through Oct. 24. There will also be a holiday card on Oct. 12. The Meadowlands at Monmouth Park meet will feature a stakes race every live racing day, highlighted by the Grade 2 Monmouth Stakes at nine furlongs on the turf on Oct. 10, according to the press release. Breen, who put the finishing touches on
his title-winning season with a three-victory afternoon, saw promising 2-year-old Pickin’ Time surge late for a nose victory over Dalton in the $75,000 Smoke Glacken Stakes. That was followed by a half-length score in gate-to-wire fashion by Like What I See in the $75,000 Joey P. Handicap at five furlongs on the grass. Breen finished with 32 victories during the 36-day meet. That easily outdistanced runner-up Jose H. Delgado, who had 17 wins. “It means a lot,” said Breen. “To think back to when I last won the title 14 years ago to today, I lost both of my parents over that time and today would have been my mom’s birthday. So it’s special. I felt like I had a little angel on my shoulder this meet. “This is a prestigious meet. Monmouth Park is a high-end track and to be the leading trainer at a top tier track is a significant accomplishment. It means a lot to me, to my barn and to my assistants. We work hard for things like this.” Lopez, who won his first Monmouth Park riding title in 2010, has been the track’s dominant jockey for the past decade in terms of wins. He finished with 51 victories, nine more than co-runner-up Ferrin Peterson. Joe Bravo was third with 41 winners.
Kasha V wins Sire Stakes final this gelding, who won all three legs of the NJSS-SDF series, plus the Garden State Trot. Of his $78,000 in lifetime earnings, $60,500 have come in those four races. Kasha V is owned by Theologos Moutafis and trained by Tom Corelli. The Sept. 25 card at Freehold also featured several divisions of the NJSS-SDF for 2-year-old trotters. Ake Svanstedt swept both divisions of the first leg of the series for fillies, winning division one with Illuminata and division two with Wet My Whistle. Two divisions of the series for colts and geldings were held as well. The first division was held as a non-betting affair and was won by Torrey Pines, for trainer-driver Dan Daley. Division two went to Canadian invader Muscle Dynasty, for trainer Paula Wellwood and driver Jim Marohn Jr., according to the press release.

Watching Kasha V win has become a Friday tradition at Freehold Raceway. He continued his dominant streak on Sept. 25, completing a sweep of the New Jersey Sire Stakes – Standardbred Development Fund final for 3-year-old trotting colts and geldings. Austin Siegelman was aggressive with his drive, putting Kasha V on the lead just after the quarter, according to a press release. He controlled the pace most of the way and was clear at the top of the stretch. However, he had to hold off the surge of second choice Kyrie Deo, who was flying for Corey Callahan. Fortunately for Kasha V, the wire came just in time and he held on to win by a head as the 7/5 favorite. The final time was 1:58 for the mile. That was the fourth win in a row for
