Chicago’s native son Rep. Bobby Rush (D-IL 1st District), who joined the 103rd Congress in 1993, is an unapologetic advocate for the less celebrated and least included minorities in the country.

His first item of business as an elected U.S. Congressman centered on issues of importance to low-income and middle-income families and communities. That year he introduced a diverse spectrum of bills, from conflict resolution and mediation to public pensions and community development. Rush confesses that he is and has always been an advocate for minorities, in particular African Americans, and contends that there are those out there who have come after him for that reason and that reason alone. “It’s a witch hunt,” says the senior Congressman. The Chicago Defender sat down to talk with the Congressman to hear his side concerning allegations of ethics misconduct leveled on him stemming from a 2013 Chicago Sun-Times/Better Government Association (BGA) investigation. Rush began by shutting down any erroneous conjecture about his mishandling of any funds or donations. First he showed us a letter written on the stationery of the U.S. House Committee on Ethics. Rush said he received the letter from the Ethics Committee authorizing him to seek donations on behalf of his church, Beloved Community Christian Church, located at 6430 South Harvard Avenue. Then he read aloud from it. “It states,” Rush said, “‘Congressmen are allowed to solicit donations for their personal charities with advanced permission.” The House Ethics Committee can issue public letters of reproval or admonishment to members. The committee can also ask the full House to censure or, in extremely rare cases, expel a member. And the committee can also decline to take any disciplinary action. The Congressman possessed another letter dated January 15, 1998 sent to him from the Standing Committee on Standards and signed by then-chairman James V. Hanson. That letter explains what and who a member of the House can and cannot solicit for. This committee has jurisdiction over the House Code of Official Conduct and is assigned responsibility for administering the gift, outside earned income, and financial disclosure requirements established. Accordingly, the only exception is non-profits that are unrelated to a member of Congress’ work. They can solicit funds for unrelated gifts to go to non-for-profit organizations that are unrelated to their official work. Quickly, the Congressman pointed out that any solicitations and or donations he has received are within the legal purview established.

Bobby Rush A Witch Hunt?

So why was Cong. Bobby Rush attacked by the Better Government Association? Rush’s relationship to charitable groups, including his church, has been the focus of Chicago SunTimes/BGA investigations, as well as congressional inquiries. The “witch hunt” began Friday, December 13, 2013, when the Sun-Times printed and article titled “The Million-Dollar Question” by Sandy Bergo and Chuck Neubauer. It centered around the Rebirth of Englewood Community Development Corp., co-founded by

Rush. The organization received a generous donation of $1 million from SBC – now called AT&T – to go toward the creation of a “technology center” that would provide advanced computer training to residents and serve as a small-business incubator in a community with few other entrepreneurial opportunities. In addition, $175,000 of taxpayer money was also voted by Congress to buy and renovate a building near 68th and Halsted to house the facility, which was to be named the Bobby L. Rush Center for Community Technology, according to federal documents. See Bobby Rush, Next Page

That did not happen. So BGA probed the question of where did the $175,000 earmarked for the building go, and suggested ethical questions related to the Congressman’s dealings. Questions also centered around the use of the grant money, which Rush says in so many words is ludicrous. “Anyone who has received a grant knows how strenuous the evaluation process is,” he said. “The money granted is not given all at once. In this case, it was distributed over a three-year period. Each year the organization had to present pristine documentation of how the money was spent. Rebirth did that.” Steps were in place to make the center happen – architectural designs and schematics for the technology center were proposed and presented to then-Alderwoman Freddrena Lyle. Everything was in place, but the vision for the center still failed to culminate. The Congressman says that the project became cost prohibitive and therefore came to a halt. The building remained vacant and boarded up until 2009 when Rebirth sold it to Beloved Community Family Wellness Center, a health-oriented mission of the South Side church that Rush founded. (Rush is also an ordained Christian minister.) The Wellness Center continues to thrive today and serves thousands of people annually. BGA has issues with the results being other than what was originally projected for the community, especially because taxpayers’ dollars were involved. The BGA accused Rush of having transacted a sweetheart deal since the property sale was an exchange between two organizations of which he was affiliated. That may be the case, but some would argue that the transaction does not abuse any legal legislation. Both organizations are non-profits, which are unrelated to the Congressman’s official capacity and he did not benefit financially or otherwise.

Tarnishing His Associates

Next the BGA took on the matter of Congressman Rush’s associates, mainly Joe Stroud and Timothy and Everett Rand, basically accusing him of fraternizing. The BGA alleges that the Congressman has benefited directly from his association with the multi-millionaire businessmen. Again the Congressman says, “Wrong. I’ve never asked either Joe Stroud or the Rands for anything, money or otherwise, and they have never asked me. Both, however, advocate what I advocate – strong business in our communities – and so they make that connection.” As one of the co-founders of the Illinois Black Panther Party, Rush says, “I am a Black Panther member of Congress and so I always ask how does what we do affect the Black community? How will the community benefit? “I have been on top of the Federal Communications Commission to increase their viability to the Black community. I’ve posed the hard questions – how many Black-owned media outlets are you creating? I called the actions of the FCC a debacle because they failed to provide opportunities for Black ownership of media outlets. As a result we were able to have Comcast promise to deliver 10 minority-owned television stations. “The congressman continued, “They have taken my general positions and tried to destroy me. For instance, I advocate Black ownership and they say I’m trying to promote Joe Stroud.” The Congressman admits that Stroud is a friend but adds, “Then again, he is a friend to many and always supports candidates who he believes in. What’s wrong with that?” The BGA mentioned in an article dated September 27, 2015 that “businessman Joseph Stroud paid the electric bill – which was well past due, totaling $17,900 owed to ComEd – on behalf of Rush’s Beloved Community Christian Church, records show.” They also addressed the Stroud Foundation’s gift to Rush’s church of $79,165 in 2008 and $35,000 in 2009. www.chicagodefender.com

“I threaten their plans to exclude us, and on my watch that won’t happen.” What they failed to mention is that Stroud is a member of the church and as a member he paid the bill and made other contributions – which he can legally do. Congressman Rush said that he does not receive a salary from the church, and that, in fact, he has contributed much of his own resources to its success. “When I think of what these people are accusing me of, it agitates me because I’m doing what I’m supposed to do, being an advocate for the people I represent,” Rush said. “They are trying to discredit my advocacy by destroying/attacking what I advocate. I advocate for the advancement of Blacks in America. “Their intention is racist. They only attack me regarding my Black interests. They never talk about the work I do for US Celluar, Comcast, AT&T, the Catholic Church, and so on. The fact is that every telecommunications association comes to my office, so why would they single out Joe Stroud who has never asked me to advocate on his behalf?

“It is appalling that they have dragged such stellar businessmen of our community into their unsavory accusations of misconduct on my part.” In the case of Timothy Rand, the BGA accuses the campaign donor of covering the salary for the Congressman’s niece, who works for the church. Asked about the printed discrepancies in an article regarding Angelique Chatman’s salary, Rush painted a different picture than conveyed in the September Sun-Times story. BGA reported that they spoke to Rush, Chatman, Rush’s attorney, Timothy Rand, and his spokesperson Grayson Mitchell. BGA reported that Chatman refused to answer questions regarding her employment, which Rush said is her right as a private citizen. “She does not fall under the scrutiny of the federal government and did not wish at the advice of her attorney to expose her private affairs to the public,” Rush said. When asked about Chatman’s employment, he supported her wishes not to disclose of what is private and personal to her. BGA painted this as the two of them concealing information. Both Rand and Mitchell confirmed that Chatman has been employed and on the payroll of Midway Airport Concessionaires (Rand’s company) since 2011. The discrepancy creating doubt is convoluted by the distinct statements submitted by Rush’s attorney Scott Thomas and Mitchell. It was agreed that Chatman is in fact employed by Midway; however the arrangement with Beloved Community Christian Church is unclear. This became a matter to look into, however the committee has yet to bring the Congressman up on any charges of wrongdoing connected with it. The Congressman mentions the BGA’s second interview with him, which he agreed upon. They sent questions prior to the interview to address their concerns. However, once they arrived, the session turned into a hostile attack that Rush refused to participate in, according to the Congressman, and he directed them to leave. In an article, he was described as hostile and uncooperative at best.

A Sinister Plan?

The Congressman acknowledged, “That was one of the most difficult times of my life. My wife was fighting for her life at the University of Chicago Hospital dealing with multiple organ failure. I think that was one of the reasons I was so short with their line of questioning. I had so much on my mind. It was an obvious attack on my integrity. “Listen, it’s obvious to me that their intention is to drive me out of Congress – not only because I am an advocate for minorities and my people but because of my seniority influence, which positions me to sit on some of the more powerful committees. “This is not personal to me. They have a track record of doing this. They went after Charlie Rangel and Adam Clayton Powell before him. They went after Maxine Waters,” said the Congressman, very clear about what he was stating. Then he addressed the future, with energy being a major direction in which the world is headed – “investing in the research and development, focusing on green, and having climate control as the fastest growing industry, where we will see all the employment growth and opportunity in the near future.” “Since I am an advocate for minorities (Back, Brown, Native American, women) and their inclusion as owners, researchers, contractors, subcontractors, suppliers, etc., I know that it makes them uncomfortable because they don’t want to see us succeed and thrive in the energy field. “They are riding out the energy sources of today and in the meantime are preparing for the transition to future energy sources and making a place in it for their people. It is clear that Mayor Rahm Emanuel was not aware of the boiling caldron of discontent within the Black community regarding the Laquan McDonald execution. This discontent grew out of the fact that it took the action of a Cook County judge to have the video of the murder made public. Several freedom of information requests for the release of the tape had been filed by journalists and concerned citizens over the course of the 400 days since Laquan’s execution, but the city refused. After the judge’s order, Rahm announced that he had not seen the tape. He also said he thought the killing of Laquan was horrific. After the public release, Black activists – young and veteran, clergy, sororities, fraternities, civic, professional groups, and elected officials – were joined by White supporters on Black Friday in one of Chicago’s largest protest demonstrations. A conservative estimate is that there were well over 5,000 participants covering the streets and sidewalks of the Mag Mile from Wacker Drive to Water Tower Place and beyond. All east and west automotive traffic was blocked and not allowed to cross Michigan Avenue along the stretch of the demonstration for more than four hours. Stores big and small along this stretch of Chicago’s high-end shopping district were prevented from operating normally on the busiest shopping day of the year. These retailers lost millions of dollars. The Black Friday demonstrations, the continuing protests that have occurred every day since, the demands of the demonstrators and the international media attention on this case have all plagued Mayor Emanuel. The mayor might have initially thought that the demonstrations represented a small and controllable group within the Black community – i.e., “the usual suspects,” “outside agitators,” and “Mau Maus” – but he immediately found out that they were much broader-based and supported citywide.

ry McCarthy. The City Council Black Caucus called for his firing in October. Rainbow/PUSH, civic groups and youth groups joined the chorus. On Tuesday December 1, Rahm fired McCarthy. Rahm might have thought this concession would help modify some of the anger and discontent; however, demonstrators have since adopted the chant, “One Down and Two to Go!” as they demand that Emanuel and Anita Alvarez also resign. Black Youth Project 100 (BYP100) leader Charles Preston issued a statement that summed up the Black community’s reflections on the McCarthy firing and other resignations: “Mayor Emanuel’s decision to fire Supt. Garry McCarthy comes as a result of massive community organizing and direct confrontations between young Black organizers and the Chicago Police Department to expose the ongoing structural abuses of power Black people are subjected to everyday. “Now, Mayor Emanuel, Cook County State’s Attorney Anita Alvarez, and all top elected officials involved in the cover-up surrounding the execution of Laquan McDonald must make the right decision and resign immediately. They have demonstrated a deep ineptitude to exercise compassion and good judgment as leaders and should not be trusted to make decisions that impact our lives.” In addition to the resignations, the protestors are also demanding:

• The release of the videos of all the police shootings of Black people, including those of Ronald Johnson, Cedrick Chatman, and several others that authorities have classified as justified killings. Ron Johnson’s tape was released Monday and though it shows him being shot in the back while running from the police, Alvarez declined to bring charges against the officer who shot Johnson.

“This may put an end to Rahm’s ambitions to run for higher office or prevent his return to Washington in another administration.” • An explanation of the missing 86 minutes of Burger King video that would probably contradict the police version of the Laquan execution. • Exposure of the entire cover-up of the Laquan execution and of all the people involved. • A total overhaul of the Chicago Police Department and its culture of racism, including a U. S. Justice Department investigation of the Chicago

Police Department and all of its police training, assignments, and practices as they relate to the Black community. • The recruitment and promotion of more Black police officers to command positions. • A totally independent civilian police board to replace the existing one that is controlled by the mayor. • The appointment of an independent prosecutor to try policeman Van Dyke.

Rahm’s Move Mayor Emanuel has several choices to make between now and the beginning of 2016. Black Lives Matter, BYP100, NAACP, Rainbow/PUSH, One Chicago, The City Council Black Caucus and several other groups who have demonstrated and demanded change have vowed to continue the demonstrations and protests until some real change is made. This activity could continue throughout the winter and next spring. In the midst of the protests, these groups promise a vigorous voter registration campaign and increased voter turnout by Black voters, an invigorated Black Caucus in the City Council and a restless Black community. Emanuel will have to make some real changes or he will be unable to get anything done. Does Rahm want to have this kind of national rancor expressed in all of the national newspapers and electronic media that are calling for his resignation, which will put an end to his ambi-

tions to run for a higher elected office or prevent his return to Washington in another Democratic administration? Thus, his real choices are as follows: • Encourage Anita Alvarez to resign and endorse Kim Foxx for State’s Attorney. • Immediately begin a total overhaul of the Chicago Police Department, beginning with a new police union contract that allows for public control of the policemen. • Establish an independent civilian police board that will serve at the will of the citizens and is committed to fairness towards the Black community. • Declare that he will stand with the Black community in its demand that Chicago have an independent elected school board. • Hold a public truth session to explain the new city budget and what is in it for the Black community. • Submit to a City Council hearing arrangement as suggested by 17th Ward Ald. David Moore similar to the congressional oversight hearings. If Rahm doesn’t make these choices, then he will: • Be hampered in his ability to do anything in this city in 2016. He will then be faced with a Chi-Raq city hall. This could further negatively impact the city’s credit ratings. • Face the possibility of a vote of no confidence by the City Council. • Eventually be forced to resign from office. Chicago cannot afford to have its image and reputation degraded any further. We have not gotten over the Al Capone syndrome, the shoot to kill era, the dozens of political scandals, and Chi-Raq. Mayor Emanuel cannot afford to take this city into the abyss of another round of negatives. Black leaders say that Rahm Emanuel will be the biggest loser if he does not address the demands of the Black community. Lastly, we cannot forget that the Chicago City Council – and especially the Aldermanic Black Caucus – must be held accountable. According to council watcher Professor Dick Simpson of the University of Illinois at Chicago, the current city council members vote with the mayor 91 percent of the time without researching or investigating the proposals they are called to vote on! The Black community will look more critically at these councilmen and move to defeat some of them because of their dereliction of duty. The mayor and city council need to remember that accountability must be earned and not assigned. www.chicagodefender.com

She’s Gotta Go! Well, another day of reckoning came Monday and once again Cook County State’s Attorney Anita Alvarez disappointed. She unveiled the anxiously awaited video of 25-year-old Ronald Johnson being killed by Chicago policeman George Hernandez and announced that the officer would not face any charges. Hernandez shot and killed Johnson just eight days before Laquan McDonald was murdered by another police officer, Jason Van Dyke, on the city’s streets. Apparently, State’s Attorney Alvarez didn’t even think the Johnson case important enough to warrant an investigation. A press conference by her office on Monday presented a dog-and-pony show that spent a lot of time painting a picture meant to color our thinking and have us believe what she wants us to believe.

There was the playing of calls from various 911 callers reporting gunshots, but we can’t tell whether or not they had anything to do with the actual moment Hernandez shot Johnson in the back. There was the slowed down version of the video zooming in on Johnson and showing his extended arm supposedly holding a pointed weapon. The highlighted object is darkened in a very clear distinct black and stands out from the rest of the video, which is grainy and whose colors are muted, so it remains unclear.

Running For Survival What Alvarez didn’t take time to explain is why Black men run. Sure, the assumption is that they run because they’re guilty. Truth is, they run whether they are guilty or innocent because they know that it doesn’t matter. They know that the police can and oftentimes do take liberties with them that are not ethical and that can end up in the death of a Black man. Most urban Black youth in particular do not trust the police. Do you blame them considering the environment that they’ve grown up in? All around them, all over the country, they have witnessed Black men being murdered at the hands of police officers who got away with murder – and most times it was murder – because the police officer knows to say, “I feared for my life.” Those five magical words even got George Zimmerman off in the slaying of unarmed Trayvon Martin on February 12, 2012, and Zimmerman is not even a police officer. On July 13, 2013, a jury acquitted Zimmerman of the charges of

second-degree murder and manslaughter in the state of Florida.

flashes in the dark as Johnson runs out of view of the camera and collapses. That’s what we see. We do not see a gun in Johnson’s hand pointed at anyone. We do not see him aim a gun at officers. Hernandez reportedly told investigators Johnson was still breathing when he ran up and found a gun in his right hand, and that he took the gun out of Johnson’s hand and put it in his waistband because Johnson still posed a threat and an “angry crowd” was gathering. Oppenheimer noted that several officers who gave depositions in the wrongful death suit said they were allowed to watch the dashcam video back at the police station before any official reports were written. He also maintained that the gun “found” on the scene was planted by the police. After viewing the video and seeing that Johnson had never turned, detectives filed a case report stating that Hernandez feared Johnson could have turned and fired shots at any moment. Like I said earlier, what Hernandez claimed is not on the video, so his fellow officers, after seeing the video, fixed it. They corrected his statement to fit what they could get away with.

lvarez’s History With A Black Men The footage of Johnson’s October 2014 killing was released to the public Monday, short of two weeks after the dashcam video of Laquan McDonald’s execution was broadcast around the world. Their murders occurred just eight days apart and the two videos have noticeable similarities. Each depicts an officer opening fire within seconds of arriving at the scene and both mysteriously lack any audio to accompany the video. Though happy that Alvarez finally brought a first-degree murder charge

against Officer Jason Van Dyke in the McDonald case after 400 days, still the public took to the streets to protest. However, on Monday, December 7, Alvarez announced that no charges would be filed in Johnson’s shooting because the evidence, according to her, showed Johnson was carrying a gun when he was shot. Alvarez said she had to view what happened that night through the eyes of a “reasonable officer” who was trying to protect himself or others from harm when he opened fire. Alvarez is full of it! All we have to do is look at her record. She finds Black men guilty before proven guilty. She has a history of wrongfully convicting Black men. And she’s trying to do what she and cronies have gotten away with for years. But I tell you, enough is enough. Not happy was Oppenheimer, the attorney for Johnson’s family, who blasted Alvarez’ analysis, alleging the State’s Attorney’s Office had failed to interview any of the officers involved in the shooting, including Hernandez. Instead, Alvarez relied on a flawed investigation by the Independent Police Review Authority (IPRA). Johnson’s mother, Dorothy Holmes, told reporters she was upset with Alvarez’s decision and hoped a special prosecutor would be appointed to do a more thorough investigation. “I want (Hernandez) charged with murder,” Holmes said. And so Hernandez should be…and Alvarez should be forced to resign. She doesn’t deserve another run for office. Most likely she will be defeated in her March 15, 2016 re-election bid, but why give her such dignity when she has never respected or dignified the Black community? Instead, she has insulted the community by failing to hold police officers accountable for negligence time and time again. The McDonald murder has led to the resignations of Police Supt. Garry McCarthy and IPRA chief Scott Ando, and on Monday, U.S. Attorney General Loretta Lynch announced that the Justice Department was launching a wide-ranging civil rights probe into the use of force by Chicago police. Last week, the New York Times’ opinion pages stated, “There’s been a cover-up in Chicago.” In addition to holding hearings, investigating and perhaps prosecuting its leaders, the city of Chicago needs to restore trust. I have to confess that in light of the history of what has happened to African Americans, I am regularly shocked when I hear the voices of Black conservatives. I find myself asking, “How can they actually believe that?” An example is when I try listening to Dr. Ben Carson. The recent meeting between presidential candidate Donald Trump and over one hundred Black pastors raised this question to an even higher level. I asked myself, what is there to discuss with Trump? I meant that. In light of his various pronouncements, distortions and demagoguery, much of which is racially inflammatory, what is there to discuss? Yet, when I was watching CNN at a restaurant and seeing pictures of some of the participants in the meeting—and recognizing one—a www.chicagodefender.com

Bill Fletcher few thoughts clicked. I saw him only for a moment, but it was the face of a minister I met at least a decade ago. I had never actually known his political leanings until I ran into him at an airport a few years back. He began an energized attack on President Obama, sounding very much like a Tea Party Republican. He was homophobic, anti-immigrant, and anti-worker. I quickly realized that we shared little in common except our African heritage. Seeing that particular minister reminded me that in the recesses of Black America there are some very conservative individuals, some of whom claim religious inspiration. This hit me in the 1980s when

there was a right-wing, pro-Ronald Reagan, Black ministerial turnout in support of a United States tour of the notorious Angolan rebel leader, the late Jonas Savimbi. Savimbi, who allied himself with the racist Apartheid regime of pre1994 South Africa, carried out a murderous campaign against the internationally recognized government of Angola. Seemingly out of thin air, right-wing Black ministers came forward to give this butcher their endorsement and to support Reagan’s efforts to prop up this insurgent. In seeing the face of the pastor that I knew on CNN, I remembered this tendency. Nevertheless, I felt like someone needs to ask those who wish to speak with Donald Trump a few questions, such as: • Why? • What is there to discuss with someone who repeatedly propped up Birth allegations regarding the legitimacy of President Obama as a citizen of the U.S.? • What is there to say to someone who suggests that Mexican immigrants bring crime, but is silent on the criminal gangs long

The fallout from Laquan McDonald being murdered in the street by Chicago police officer Jason Van Dyke has triggered backlash against some of Chicago’s most high profile elected officials and leaders. Police Supt. Garry McCarthy was the first casualty, but even his firing has not stopped Chicagoans from calling for the heads of every elected official who was involved in what now looks like a cover-up. Specifically, there are continued calls for the resignations of Cook County State’s Attorney Anita Alvarez and Chicago Mayor Rahm Emanuel. There are also calls for the officers who were on the scene standing by watching Van Dyke kill McDonald to be prosecuted as well. Even the City Council aldermen who unanimously agreed to the $5 million dollar settlement to McDonald’s family before a lawsuit was even filed are facing the wrath of voters for their perceived participation in the cover-up.

But the city has paid out over $521 million dollars in police brutality settlements over the past 10 years with almost 500 cases still pending – that is just under the $588 million tax increase that the city council passed earlier this year, ironically to fund police and fire pensions.

$5 Million Or $100 Million? Council critics and supporters alike agree that had the case gone to a jury trial, the potential award could have been upwards of $50-$100 million, a cost that would have been passed on to taxpayers already facing the largest tax increase in the city’s history. For many aldermen, the situation was a no-brainer – pay $5 million now or $100 million later. When presented with those options, it was only logical the aldermen approved the $5 million settlement. But because of the horrific nature of the video, most Black Chicagoans have ignored what the direct financial implications of a jury verdict against the city would have been and a backlash against the aldermen has resulted. “Initially, the family’s attorney wanted $16 million, but after some negotiation and research of similar incidents, all parties agreed on the sum of $5 million,” says 21st Ward Ald. Howard Brookins. “While that is not the largest settlement we have made, it was no where near the bottom.”

Jason Ervin, 28th Ward Alderman, added, “There was an active criminal investigation, both at the state and federal levels. After seeing a draft of the lawsuit, we asked the Corporation Counsel were the allegations true and he said yes.” “We authorized the settlement with the estate of the family. No one in the legislative branch had any idea how long the investigation would take, but we wanted to make sure the family was treated fairly.” Other Black aldermen maintain that they did not see the tape until moments before it was released to the public. Outraged activists and community leaders balk at the aldermen who maintain that they had not seen the tape, but in a city that approves approximately $52 million dollars annually and $4.3 million monthly in police brutality settlements, it is easy to understand why a $5 million dollar settlement would not raise many eyebrows. According to 6th Ward Ald. Roderick Sawyer, current Chair of the City Council Black Caucus, “While I am new to the Finance Committee, I do know that we approve a variety of settlements of all types every month. This was one of them.”

All Good, According To Burke Consider the statements of Finance Committee Chairman Ed Burke, whose group has been responsible for recommending over $521 million in

settlements to the entire City Council. When asked about the Laquan McDonald shooting, Burke said, “There is no institutional problem in the Chicago Police Department. I personally think it’s the best-trained, most effective, most honest big-city police department in the nation.” Burke’s opinion is in stark contrast to members of the Chicago Aldermanic Black Caucus, who have demanded a federal investigation into CPD and its practices after seeing the video. “We have known that there are racist cops on the police force who have been shooting Black men. Now, with the advent of technology, we are finally able to prove it,” Sawyer said. “But we have got to keep our eyes on the prize, which is focusing on getting these racist officers disciplined, out of service, and eventually indicted. Then we must begin to fix the relationship between the Black community and the police department.” When questioned on the possibility of a cover-up, the aldermen maintained that the city’s Corporation Counsel, Steve Patton, did not attempt to hide or cover-up the facts surrounding the shooting of Laquan McDonald when discussing it with them. In fact, they say the settlement was an acknowledgement of the fact that Officer Van Dyke’s version of the story was false. Some aldermen have grumbled that as Corporation Counsel, Patton’s job is to protect the corporation (City) not the individual (Emanuel), as that is the issue in the allegations of a City Hall cover-up. Still, most aldermen feel they did the right thing by settling the McDonald case out of court. “The City of Chicago only has one way to acknowledge when we have wronged someone, and that is to pay them,” says 21st Ward Alderman Howard Brookins, who was Chairman of the Black Caucus at the time of the settlement and has been both an assistant public defender and assistant state’s attorney. “But we also have a responsibility to the taxpayers we represent who would have been forced to pay the jury settlement. It would not have been us as aldermen paying, but the taxpayers.” When asked whether he would support a call for Emanuel’s resignation, Sawyer was clear. “We don’t have a process to recall the Mayor, so I don’t want him nor Alvarez to step down,” Sawyer responded. “I think it is time for our community to mobilize and be prepared to take Alvarez’ office next year, and get ready to vote in 2019.” www.chicagodefender.com

There is some questionable math involved in the potential closing of a Black charter school in Chicago. The Barbara A. Sizemore Academy (BASA), which teaches kids in grades kindergarten through eight, has been put on a list of schools recommended for closure by the Chicago Public Schools, despite meeting evaluation criteria and performing better than over 80 other schools that have not been threatened to be shut down. Parents and students of the school want to know why. Established in 1998, the Betty Shabazz International Charter School (BSICS) is an African-centered network of charter schools comprised of four Chicago campuses: •Betty Shabazz International Charter School, located at 7822 South Dobson; •Betty Shabazz Academy (BSA, grades K-8) at 7823 South Ellis; •Barbara A. Sizemore Academy (BASA, grades K-8) at 6936 South Hermitage; and the •DuSable Leadership Academy (grades 9-12) at 4934 South Wabash.

Not only did BSICS achieve its goal, but it was recognized in 2013-14 by Chicago Mayor Rahm Emmanuel for achievements in math and is currently a finalist for a $375,000 New Schools for Chicago grant.

Why Close Barbara Sizemore Academy? “This model has consistently shown that by integrating African culture and values into our rigorous curriculum and in our hiring practices, by hiring loving, committed teachers, that the children develop the cultural self-confidence they need to excel academically.” The school and some of its students have achieved national and international acclaim amidst the backdrop of poverty and violence that has marred parts of Englewood for decades past.

What makes BSICS unique amongst educational institutions, especially in today’s academic climate where the emphasis is often corporate driven and not student-centric, is its holistic African-inspired curriculum.

So it would stand to reason that as such a beacon of success, BSICS-BASA would not only be welcomed, but also supported across the board. However, that seems not to be the case.

“Our school incorporates African cultural elements like language, the arts, tradition and history,” says Makita Kheperu, Director of Education for Shabazz. “Ceremony and values are used to instill in our students a sense of responsibility, accountability, extended family and community, and of course, pride.

Based on criteria established through the School Quality Rating Pol-

icy (SQRP), BASA had fallen to a rating of Level 3 and contractually was “failing to meet standards or make reasonable progress,” for school year 2014-15, according to Jack Elsey, then head of I&I. He further stated that “to be removed from the academic warning list and exit the ‘Revocation’ process, your school must not receive a Level 3 designation as measured on the SQRP based on SY2014-15 data, (which is) evaluated in SY2015-16.” According to documents obtained by the Chicago Defender, BASA submitted a remediation plan on January 5, 2015 to the office of I&I and met with representatives on January 20 to share progress. On February 9, BASA’s remediation plan was accepted by I&I and the end goal identified as “Not Being Rated Level 3,” was established. Throughout the remainder of the 2014-15 school year, BASA kept in contact with I&I representatives, continuing the updates on its progress. By October 23, BSICS-BASA was notified that their School Quality Rating had improved from a 3 to a 2.5.

However, celebration quickly turned to despair when three days later, according to Mekita Kheperu, “We received a phone call that we were put on the list of schools recommended for closure.”

Engineered to Fail The Administrator’s Alliance for Proven Policy and Legislation in Education (AAPPLE), a watchdog group consisting of principals, conducted an analysis that found that CPS altered school growth data used to assign SQRP ratings in an attempt to cover-up the different versions of the NWEA Map tests that were administered to Chicago Public Schools (Common Core test) and the charter schools (Illinois State Standards). To alleviate school concerns about “unfair appearances of more growth by some schools,” according to AAPPLE, CPS created “simulated scores” for all charter schools and a few non-charter schools. This was the cause of BSICS-BASA being put on the academic warning

CPS is still threatening the following Black charter schools with closure: BSICS-BASA, Amandla, Bronzeville Light House and CICS-Hawkins. However, there are 74 network elementary and 12 charter schools with SQRP scores lower than BSICS-BASA, none of which have received closure notices, even though some have been on warning lists for years. Elected officials including State Senator Donnie Trotter, Ald. Michelle Harris (8th Ward) and Ald. Raymond Lopez (15th Ward) have written letters to CPS voicing their opposition to this treatment of BSICS-BASA. Parent Zainabu Jones, whose daughter attends Sizemore, says, “I’m baffled as to CPS’ reasons for closing our school when my daughter and other students are on the honor roll. Other schools in the area are very unprofessional. If my daughter has to go to another school, I’m afraid that she’s going to be distracted.” Parent Simonae Murdock, who has a first-grader there, says, “Sizemore is special because teachers really take time to work with our children, help them learn more. I work way across town and don’t pick my son up from school until 6 p.m. A lot of other CPS schools don’t have after school programs.” The next meeting regarding the final status of the schools is scheduled for Wednesday, December 16 at the Chicago Board of Education, 42 West Madison Street. COMMENTARY Quinn Kareem Rallins Defender Contributing Writer This week, Illinois Attorney General Lisa Madigan requested a Justice Department investigation into the Chicago Police Department’s unlawful and excessive use of deadly force and lack of police accountability in such cases. Under federal law, the Justice Department may investigate police departments whenever they engage in a “pattern or practice of conduct” that deprives people of their constitutional rights. In many cases, such investigations result in a federal consent decree, where the Justice Department and the municipality decide how to address the police department’s wrongs and a federal judge oversees the implementation of those changes and appoints a monitor to handle the day-to-day aspects. Although federal investigations and consent decrees have been lauded as a significant step toward transforming police departments, the reality is that it is unlikely to significantly change Chicago’s deplorable police culture any time soon.

Madigan’s call for a federal investigation was spawned by the community protests from the release of the dashboard camera video of the Laquan McDonald shooting. In her letter to U.S. Attorney General Loretta Lynch, Madigan wrote that federal intervention could help foster a “fundamental re-direction of Chicago’s approach to law enforcement” and acknowledged “serious questions about the historic, systemic use” of unlawful and excessive force, and lack of police accountability. In the days since, a cadre of politicos have joined her rallying call. After initially calling the idea “misguided,” Mayor Rahm Emanuel quickly backpedaled and decided to “welcome the engagement of the Justice Department.” Others followed suit as well, including Cook County State’s Attorney Anita Alvarez, U.S. Senator Dick Durbin, and Democratic presidential front-runner Hillary Clinton. However, many Chicago-based community organizations have been largely unenthusiastic. Perhaps they recognize that throughout the country, such investigations and consent decrees have yielded sluggardly results.

Commentary: Why We Can’t Wait On The Justice Department Historically, the Justice Department began investigating police departments in response to the infamous Rodney King beating on March 3, 1991 in Los Angeles. The Los Angeles Police Department was inspected and was asked to implement dozens of major reforms. But despite the suggested reforms, the police union filed a motion to intervene, contending that reforms threatened

collective bargaining rights and labor contracts. In Portland, the police union filed a similar motion after the Justice Department investigated its police department in 2012 and determined that police often used excessive force. The Portland police union asserted that the consent decree somehow affected police officers’ working conditions, workload, safety-related training, disciplinary procedures, and an officer’s right to legal representation. Cincinnati is one of the most telling examples. In 2001, after a police shooting ignited three days of uprising and then federal oversight, the police department was so outraged with federal supervision that the appointed monitor was actually kicked out of police headquarters. Unfortunately, even if a consent decree is designed to overhaul a department’s use-of-force policy, justice may not roll down for individual cases. Consider Cleveland, where the Justice Department investigation concluded that the police department had a pattern or practice of unreasonable force, but a grand jury has yet to indict the police officer who shot and killed 12-year-old Tamir Rice in a park.

A similar report was given in Ferguson, but we know how quickly the grand jury decided there was insufficient probable cause to indict police officer Darren Wilson in the shooting death of Michael Brown, an unarmed 18-year-old. Waiting on the Justice Department to shift the police culture in Chicago will leave us at sea without a rudder, and at the mercy of the elements. We have drifted for the past 50 years or more, and found ourselves on the banks of unlawful and excessive force. Indeed, this pattern and practice is deeply rooted in Chicago, dating back to the early days of Black migration from the South, and increasing concern about crime in White, middle-class neighborhoods. Since then, police chiefs, inspectors, and captains in the Chicago Police Department have been directing their men to shoot-to-kill. The Justice Department investigation itself will not improve our condition, nor the policy of watchful waiting. We must strike out for ourselves, as we always have. Every Wednesday evening, fans of the hit television series Empire tune into the messy drama of the Lyon family. The Fox TV drama, created by Lee Daniels and Daniel Strong, is currently on hiatus with Season Two half-finished and viewers anticipating its return in January. Since the show’s debut in January of this year, Empire has earned TV’s number one broadcast rating and ended its first season with 17.3 million viewers. A highlight of the drama is its electrifying soundtrack and the show’s young co-stars. As the first season progressed and the storyline developed, the music became the centerpiece of the show under the supervision of platinum hit-maker, Timbaland. Jussie Smollett is a member of the all-star cast of Hollywood power hitters, which includes Terrence Howard, Taraji P. Henson, Marisa Tomei, Gabourey Sidibe – along with an impressive list of breakout stars. Smollett plays Jamal Lyon, son of record company mogul and musician Lucious Lyon (Howard) and mother Cookie Lyon (Henson) on the show. He is a talented singer and songwriter who stands up to his father and publicly comes out to the world as a gay man. The two worlds between Jussie Smollett and his character Jamal are similar but different. At 32, Smollett’s hectic schedule includes various live appearances, speaking engagements and live performances promoting Empire’s soundtrack on Columbia Records. He will eventually work towards releasing his own solo music project, but not now. Smollett said, “It’s not so difficult, but it’s not also easy, if that makes any sense? I’m concentrating on the music at hand at my number one job right now, which is Empire.

A Voice Beyond Empire “I’m writing songs constantly, but it’s a balancing act of having to get in there and do music and put all of yourself into the music of Empire. When I’m writing and recording for Empire, I’m still in the mindstate of myself as Jamal. There are some things that are different and there are so many things that are similar. “My music is coming, but my music is my private soul. It’s the one thing that is so interesting – it’s so funny how I’m not stressed about it – it’s the one thing that is mine. For my own music, it’s going to take time, and when it’s right, it’s going to be right. But there are so many things to do right

now. There’s no time to pee, let alone record a whole album,” he laughs.

No Plan B Growing up in Southern California, Smollett broke into the business as a child actor making appearances in The Mighty Ducks, North, the miniseries Queen and starring with his brothers and sisters in the sitcom, On Our Own in 1994. Before Empire, Smollett took on small acting roles while working on his music and he released an EP, Poisoned Hearts Club, in 2012. Creating music has always been the main fix-

ture in his life as a songwriter and musician. Being from a family of musicians and actors, Smollett constantly reminds young artists about the importance of having a solid work ethic in order to be successful in life. “Literally, it’s about working your butt off. I didn’t have a Plan B; I only had a Plan A. It’s not always the right plan for everybody, but I always held down a job,” he explains. “I always took care of myself. I always made sure I was responsible and I could look in the mirror and be proud of the man that I am.”

Smollett sits on the boards of the Black AIDS Institute and Artists for New South Africa, among other foundations that focus on social justice and civil rights initiatives. Currently, he is working closely with actor, activist and former UNICEF goodwill ambassador Harry Belafonte – along with the Justice League – on bringing awareness to racial profiling and police brutality. “It gets confusing because you see all of these hashtags and see all of these things out there and sometimes the people don’t know what to do,” Smollett says. “What if I can’t make it to the march? What can I do? So, it’s about making people aware of the different legislation that needs to be passed. All of this comes into play when it’s about getting out to vote. It’s also things that are part of the hashtag of #blacklivesmatter.” Smollett felt the impact of the Laquan McDonald murder by Chicago police. With the show moving into its second year of filming in Chicago, he feels close to the city and believes the problems affect everyone. “Empire makes a lot of money off of Chicago,” he says. “We have to help Chicago. Let’s do this. I live here; I’m a resident here. I’m not fully a Chicagoan, but I feel like I’m home when I’m here.” He elaborated, “I wrote the lyrics in Powerful: ‘Mothers who bury their child, how can you sit there and hide? Change comes when we all take a stand. Stand up!’ We all have to stand up for each other – Blacks, Latinos, gays, Asians, Whites – everybody must stand up.” www.chicagodefender.com

During a recent stop in Chicago, songwriter/singer Rico Love was the featured guest on the Music Choice Sound Check Sessions tour and spent some up close and personal time with invited fans. Having appeared as a featured artist on records with Usher, T.I., Jermaine Dupri, Jamie Foxx, Rich Boy and other notable names in the music world, Love is also one of the most in-demand songwriters. Hit records Love has written and produced include Usher’s There’s Goes My Baby, Nelly’s Just a Dream, Trey Songz’ Heart Attack, Kelly Rowland’s Motivation, featuring Lil’ Wayne, and Beyonce’s Sweet Dreams. His impressive repertoire of music credits comes from a non-stop work regimen and over 12 years of what he calls “hustle and grind.” On tour with R&B recording artist Monica, Love addressed an intimate group of aspiring songwriters and producers in the House of Blues Foundation Room for a candid industry chat about the music business.

The Art of Songwriting About his ability to write songs, Love said, “Songwriting is so natural to me on how I’m feeling. It’s like when I talk to my son. My son has a gift of telling me exactly how he feels: ‘Daddy, I don’t like this because of this or that.’ He’s only five and I think it’s a gift. People don’t value that kind of honesty.” Mary J. Blige is among the mega-stars who has worked with Love; he penned Mr. Wrong on her My Life II, The Journey Continues album. Love recalled a situation that occurred with the Grammy Award-winning singer in a London restaurant, where a lady came up to their table crying and thanking Blige. “Mary said, ‘It’s not because I’m famous; I figured out how to talk to her. But, that’s not why she’s crying – I figured out how to talk for her.’ So imagine how you’re feeling all of these things and there’s a muzzle on you?” Love explained to the audience. “This is what she means, this is what he means, this is how she feels, this is how he feels and fans are like, ‘thank you.’ Remember how you would send someone a song because this is how I’m feeling?” As the crowd nodded their head relating to Love’s example, he continued. “So, if you’re a songwriter or artist and your music doesn’t identify with people or who they are feeling, it doesn’t connect. When you connect with people emotionally, it’ll start to build fans because when people are connected to you the songs don’t have expiration dates.”

The Art of the Music Business His follow-up single, B*tches Be Like, was released in 2014 along with He Got Money, which took him on the road during the “Honest Tour” with headliner, Future. Each single released has built support through mixshow, club, digital broadcast and commercial airplay. In late spring, Turn The Lights On, Love’s debut album, was released on his own record label, Division 1, in partnership with Interscope Records. Although he’s had solid success compared to other artists battling for radio play, there is still a great divide for Black artists making good music, according to Love.

“Urban radio is the only place where they’ll tell us that love songs don’t work anymore with Black people. But, Adele didn’t come out with Hello and sell on purpose?” Love wondered. “The same program director that’ll tell a Black artist that they can’t fit this format and this song don’t work will play an Adele record a hundred miles an hour on Black stations. “They want Black kids to not know about love, or not recognize what being a man or being a real woman is about. These types of records are accessible on Top 40 rhythm radio.” That statement was welcomed by cheers and applause from the group of young millenni-

als. “I can’t blame a program director for it because they answer to their boss,” Love continued. “It’s the pressure on them to say, ‘This didn’t research well,’ or ‘That didn’t research well.’ You don’t know the people that they are researching to; they are researching records to people who don’t identify with these type of songs.” Love answered a couple of questions from the audience in regards to fighting for airplay when it comes down to the lack of traditional R&B records from artists such as Tyrese and Tank. He responded, “I’m not going to compromise my integrity for a radio spin, but when you listen to my music, it feels current. I don’t like being bunched in that group. My issue is if you make a record that could work in all formats and it’s not getting an opportunity because I’m Black – that’s a problem. This is something people don’t want to hear, but it’s an issue.”

Good Advice Raised between Milwaukee, Wisconsin with his mother and Harlem, New York with his father, Love admits that it was a rocky road breaking into the business – he often slept on the floors and couches of friends. But he doesn’t believe there’s a real formula of making it in the business. “I didn’t have a car, no money, no way to feed myself, but when I look back, it was some of the happiest times of my life,” Love said. “It wasn’t until I started making money that I started to see some of the highest levels of betrayal. So, you have to figure out your journey.” He continues on the 22-city “Code Red” tour with Monica, wrapping up in New York on December 13. As Love builds, sharing his knowledge of the music business, he is working on producing a music conference to help others develop their craft. “I saw up close and personal what the game was like from the highest level,” he says. “I would ask questions. When I was around anybody, I always introduced myself and told them what I did to make sure I built the relationship.”

Take Your Shot Eleana Elan Defender Contributing Writer California is known for its advant garde progressive attitude towards health and fitness and is a leader in setting trends in the health and healing arts. So it’s no surprise that it’s common for people to go get their Vitamin B12 shots. People suffer with vitamin B12 deficiencies and many people seek to prevent it by supplementing their diets with either shots or supplements. The question is which is the best way to go. Correcting a B12 deficiency is serious. Left alone or unattended to you can die of a B12 deficiency. The founder of a new website and lead co-author of Could it Be B12?: An Epidemic of Misdiagnoses, Sally Pacholok, RN says, “Many serious B12 deficiencies are undiagnosed, leading to unnecessary drug prescriptions and suffering.” Pacholok says that the possibility of B12 deficiency is not even considered in many situations, especially in cases of depression, and neurological problems. In other situations the inadequate tests often lead to a false conclusion that no deficiency exists although it does. So begin today to correct and prevent what may be a B12 deficiency in your body. First you need to know what B12 does. Simply put B12 plays an essential role in the conversion of carbohydrates into fuel, maintaining healthy nerve cells, making red blood cells, maintaining the body’s genetic material, utilizes iron, and produces compounds that affect the immune system and neurological function. In that context, symptoms of insufficient B12 can manifest as fatigue, weakness, unexpected weight loss, loss of appetite, numbness or tingling in the hands or feet, a sore mouth or tongue, and neurological symptoms such as poor balance, depression, poor memory, confusion, and dementia. In infants a B12 deficiency can be devastating, causing delayed development and movement disorders. In both children and adults, a deficiency can underlie megaloblastic anemia, a blood disorder.

Who is a Risk?

Americans are taught that animal foods are the main dietary source of B12. However, vegans and vegetarians should seek out foods fortified with the vitamin B12. They should be most mindful that there are reasons why the body may not absorb B12 adequately.

When my San Francisco neighbor compared my grandmother’s southern yeast bread to her grandmother’s brioche, our examination of each handwritten recipe showed the brioche pendulum swing off the chart when it came to butter and eggs. Her grandmother’s brioche contained six eggs to Granny’s two and she had been instructed to measured butter in sticks instead of tablespoons for her Grand-mère’s loaf. Granny had always enjoyed describing her loaf baked in a special covered pan as “Pullman style,” based on the necessity of storing as many loaves as possible in railroad dining car kitchens. She said she preferred these soft-topped,

straight edged loaves to crusty French bread because she wanted to highlight the delicate oyster flavor during peak oyster season with these amazing special occasion first-course treats. Last week, after discovering a great batch of tiny Chesapeake oysters, a buttery brioche loaf from the market bakery reminded me of two grandmothers long gone who took the time to teach granddaughters to appreciate delicious traditions.

It’s also possible that you have a generic polymorphism that prevents the bodies from transporting B12 through the blood stream. People 65 and over are at greater risk of atrophic gastritis, a condition that interferes with the absorption of B12. You should be reminded to never self diagnose, especially if you have a preexisting medical condition. Choosing whether or not to take shots or supplements is determined by your body. Vitamin B12 shots make you feel better instantly while supplements take a little time. You can also take a mixture taking both. If you take shots you can supplement in between the scheduled shots without fear of taking an excess. No adverse effects have been associated with excess vitamin B12 intake from food and supplements in healthy people. In some people too much vitamin B12 can trigger acne. Studies indicate that analysis of naturally present bacteria in their skin showed that B12 alters the way some bacteria behave, and in some cases, those changes result in an acne flare-up. The good news is it’s easily reversible. A simple decrease in dosage corrects the problem and your skin returns to normal.

RECIPE

1/2 stick butter, softened 1 bottle (32 ounces) peanut oil 1 cup each: finely ground saltine crackers, flour 2 teaspoons Creole or soul seasoning blend Peanut oil to fill a heavy pan or cast-iron skillet with 2 inches of oil

Heat the oven to 350 degrees. To create a hollowed-out bread box for the oyster loaf, cut a rectangle out of the center of the loaf, leaving a 1/2-inch border all around. Remove the inside of the loaf, for another use, such as drying out later to make bread crumbs. Slice and remove the top crust off the rectangle; set top crust aside. Drain the oysters and place the still very moist pieces on a large platter; set aside. Combine the flour, cracker meal and Creole seasoning in a food storage bag. Heat the oil in a large saucepan to 350 to 375 degrees. Place enough oysters to fry at one time in the cracker/flour mixture and shake gently, coating completely. Add the breaded oysters to the oil, cooking and turning as needed, until oysters are golden and float on top of the oil, about 3 to 4 minutes.

Transfer cooked oysters to a paper towelcovered plate to drain. Repeat with remaining oysters. When all of the oysters are fried, add the hot oysters to the buttered hollow loaf. (Reserve any extra oysters for serving.) Top the filled bread hollow with the cut-out insert. Wrap the loaf in foil. Heat until butter is melted into the oysters, about 12 minutes. Remove from oven and cut into slices to serve, adding extra oysters if available. Makes about 8 servings.
