Magazine of the National Gallery of Victoria Gallery magazine is the official magazine of the National Gallery of Victoria. It is published bi-monthly and provides feature articles written by curators and other experts about current exhibitions and activities at the NGV. Gallery also informs NGV Members of the extensive range of social and intellectual activities presented in a congenial atmosphere. Gallery aims to enhance readers’ appreciation of the National Gallery of Victoria and its collections exhibited at both NGV International on St Kilda Road and The Ian Potter Centre: NGV Australia at Federation Square, as well as the arts generally. Gallery also encourages readers’ personal artistic and cultural development. Gallery is audited by the Circulation Audit Bureau and has one of the highest readerships of any Australian arts magazine. TERMS AND CONDITIONS GENERAL CONDITIONS No responsibility will be accepted for any loss arising from the failure of an advertisement, or any part of an advertisement to appear, or from any error in an advertisement published. The publisher reserves the right to reject or omit from the publication any or part of an advertisement. When artwork is overdue the publisher reserves the right to repeat a previous advertisement or apply a late copy charge. Advertisers can collect used artwork immediately after their advertisement is published. No responsibility is accepted for: > advertising material left uncollected after three months. > late arrival of magazine due to circumstances beyond our control. OVER-RIDING CONDITIONS Neither the publisher nor any of its officers, employees or agents is liable for loss or damage howsoever caused in respect of advertisements altered, delayed or omitted, whether by negligence or otherwise. Any other liability of the publisher, its officers, employees or agents howsoever arising in respect of an advertisement or series of advertisements, is limited to a total of $50.00 for each advertisement or series. The publisher makes the stipulations contained in the preceding two sentences on behalf of each of its officers, employees and agents. In addition, the advertiser agrees with the publisher not to bring, be part of or assert any action, claim, counterclaim or set-off against any of them at variance from the protection sought to be extended to them by this condition. The rest of the card is to be read subject to this condition, which cannot be varied or waived. If the condition is waived or varied, the change must be put in writing and signed by an officer of the publisher. INDEMNITY Advertisements are accepted for publication on these conditions: > the Advertiser and the Accredited Advertising Agent must warrant to the publisher that no material, statement, information or matter contained in the advertisement constitutes a violation of any existing copyright, trademark or a breach of confidence. > they contain nothing obscene, indecent or libellous and their contents do not infringe the Trade Practices Act or any other statute, regulation or law. > the Advertiser and the Accredited Advertising Agent jointly and individually agree to indemnify and keep indemnified the publisher, its officers, employees and agents against all such claims, demands, damages, costs, penalties, suits, and liabilities of any nature howsoever caused whether by negligence or otherwise incurred by the publisher, its officers, employees, agents or which may be incurred by the publisher or its officers, employees or agents arising out of the publication of the advertisement.The publisher's acceptance of the advertisement for publication shall be deemed to be the consideration forgranting the aforesaid warranty and indemnity. The aforesaid warranty and indemnity shall be implied in each submission of an advertisement for publication, without executing any other document. ADVERTISING CONDITIONS The publisher reserves the right to reject any advertisement considered to be unsuitable for publication. Every endeavour will be made to publish an advertisement as instructed, but no liability will be accepted for any loss caused by omission or misplacement. All orders and advertisements are accepted subject to the rules and advertising codes of the Media Council of Australia. The positioning of an advertisement is entirely at the option of the publisher. > It is the responsibility of the advertiser to notify the magazine of any error as soon as it appears. The publisher will not be responsible for recurring errors. > Telephone instructions are taken on condition the advertiser accepts liability for any error or misunderstanding arising therefrom. > Reproduction quality is at the Advertiser's risk if the publisher's specifications are not met or material is received after closing date, even with an extension. > Material must be at the appropriate printing location by closing date. > Due to mechanical tolerances, the alignment of type or design or precision of folding from page to page cannot be guaranteed in all copies. Any condition on contracts, orders or copy instructions involving placement of advertising within an issue of the magazine (such as page location, competitive separation, or placement facing editorial copy) will be treated as a positioning request only. The publisher's inability or failure to comply with any such condition shall not relieve the agency and advertiser of the obligation to pay for the advertising. Advertisers may not cancel orders for advertising after closing dates
