AN ORDINANCE DECLARING STUDENTS WITH ABSENCES AND TARDINESS FROM ALL CLASSROOM, ORGANIZATION, COUNCIL, AND STUDENT GOVERNMENT ACTIVITIES DUE TO MENTAL HEALTH EMERGENCIES ARE GIVEN CONSIDERATIONS Proposed by: Nia Sara Marjael Masbad, Legislative Councilor 2019-2020 Adopted by: Marc Andre Genova and Kimberly Osteria WHEREAS, in order to strengthen the Mental Health Law of the Philippines Republic Act No. 11036 in the academic setting, the College of Liberal Arts and Communication Student Government (CLACSG) declares that students with absences and tardiness from all classroom, organization, council, and student government activities for the reason of mental health emergencies are given considerations; WHEREAS, this Ordinance also strengthens Section 4.8 of the Student Handbook which states that, “Absences due to family/medical emergencies, or sickness duly certified by a doctor, parent/guardian, college administrator concerned are not considered approved absences but may be given special consideration before giving the student a grade of 0.0.” Further, this Ordinance emphasizes that mental health emergencies are medical emergencies. Therefore, under Section 4.8 of the Student Handbook, CLAC students with absences due to mental health emergencies duly certified by their personal mental health professional may be given special consideration before giving the student a grade of 0.0. WHEREAS, this Ordinance proclaims that CLAC students with absences and tardiness for the reason of mental health emergencies shall be allowed to submit the missed activities and their equivalent without deductions; WHEREAS, the mental well-being of the students is as important as that of their physical well-being. Mental health emergencies are medical emergencies and shall be treated as such within the academic setting; WHEREAS, in view of the foregoing, the College of Liberal Arts and Communication Student Government Legislative Council deemed necessary to impose the Ordinance to consider the mental well-being of the students.


NOW, THEREFORE, BE IT ENACTED, as it is hereby enacted by the Legislative Council of the College of Liberal Arts and Communication, by virtue of the powers vested in it by law, in session duly assembled, THAT: SECTION 1. SHORT TITLE This Ordinance shall be known and cited as the Mental Health Ordinance. SECTION 2. PURPOSE The purpose of this Ordinance is to give importance to the mental well-being of the students. As such, this Ordinance intends to give emphasis to the fact that mental health emergencies are medical emergencies the same way that physical ailments are. Moreover, this strengthens the Philippine Mental Health Law and the Section 4.8 of the Student Handbook. SECTION 3. POLICY STATEMENT SUBSECTION 3.1. As prepared by the College Legislative Council, the nature of the Mental Health Ordinance is to declare that students with absences and tardiness from all classroom, organization, council, and student government activities for the reason of mental health emergencies are given considerations such as, but are not limited to: allowing the late submission of the missed activities without deductions, giving an extension to the deadline, and substituting missed activities like seatwork with other requirements. SUBSECTION 3.2. Students with absences and tardiness from all classrooms, organizations, councils, and student government activities for the reason of mental health emergencies shall be allowed to submit the missed activities and their equivalent without deductions. SUBSECTION 3.3. Students are responsible for their missed lessons and activities. They may seek their professors for consultation. SUBSECTION 3.4. Within the course of the Covid-19 pandemic, the extensions hereby shall follow the Implementing Rules and Regulation—Care Centered Model for Online Learning approved by the Office of the Vice Chancellor for Academics and Research, and must remain as such even after the distance learning model setup. SUBSECTION 3.5. Instructor(s) handling the subject/course ought to give students time depending on the task’s level of significance as per the IRR-Care Centered Model: Formative assessments such as, but are not limited to, pretest and exercises must be given three to four (3-4) weekdays to be passed; Enabling assessments such as, but not limited to, activities, quizzes, and creative/written outputs shall have one to three (1-3) weekdays to comply with; and Summative assessments such as, but not limited to, long quizzes and examinations shall be given one (1) weekday to be submitted. The schedule shall be determined by the instructor concerned.


SUBSECTION 3.6. Students must present a certification duly signed by their mental health professional(s) to their subject professor(s) and to the Guidance Counselor of the CLAC. SECTION 4. DEFINITION OF TERMS As used in this Ordinance, the following words and phrases shall mean: 1. Tardiness – refers to the arrival of a student after the class has started. 2. Absence – refers to the arrival of a student after 15 minutes of a one-hour class, 25 minutes of a one and a half-hour class, 30 minutes of a two-hour class, and 45 minutes of a three-hour class. (See Section 4.2 of the Student Handbook) 3. Mental Health Emergency – refers to any emergency related to mental health such as, but not limited to, panic attack, anxiety attack, symptoms—as clinically proven by the certificate presented—of bipolar disorders and of depression. 4. Considerations – refer to the chances given by a faculty member, dean or associate dean, and/or project head to a student. These considerations are, but not limited to, allowing the late submission of the missed activities without deductions, giving an extension to the deadline, and substituting missed activities like seatwork with other requirements. 5. Mental Health Professional – refers to any licensed professional who specializes in and attends to people’s mental health, such as, but not limited to, a Psychiatrist and Psychologist. 6. Distance learning mode – refers to a setup implemented by the Office of the Vice Chancellor for Academics and Research in light of the Covid-19 pandemic, which aims to continue Lasallian education through a home-based/online-learning mode. 7. Formative Assessments – refer to non-graded tasks, which are used to prepare students for doing enabling and summative assessments. 8. Enabling Assessments – refer to graded tasks per module that students need to complete. 9. Summative Assessments – refer to graded periodic tasks that evaluate the academic performance of students vis-á-vis the course and topic learning outcomes. SECTION 5. AUTHORIZATION The entire College of Liberal Arts and Communication Student Government is hereby authorized to execute Section 3 of this Ordinance by issuing a Legislative Order. SECTION 6. AMENDMENTS This Ordinance and its provision shall take effect unless revoked, changed, suspended, disarmed by the CLACSG Legislative Council itself. SECTION 7. REPEALING CLAUSE All ordinances, issuances, rules and regulations, or parts thereof which are inconsistent with or contrary to the provisions of this Ordinance are hereby repealed, amended or modified accordingly. SECTION 8. SEPARABILITY CLAUSE


If, for any reason, any section or provision of this Ordinance is declared illegal or unconstitutional, the other sections or provisions hereof which are not affected shall continue to be in full force or effect. SECTION 9 EFFECTIVITY CLAUSE SUBSECTION 9.1. The College of Liberal Arts and Communication Student Government shall send a memorandum along with the full text of this Ordinance to the Department Chairs through e-mail. The CLACSG shall also communicate with all Chief Executive Officers of the College Program Councils and all Block Representatives. Afterwards, the CLACSG and the CLACSG Advisor shall forward the Ordinance to the Office of the Student Services (OSS) and Student Wellness Center (SWC). SUBSECTION 9.2. This Ordinance shall take effect one month after its approval and the publication of the full text of this Ordinance in designated bulletin boards (or its equivalent) for the CLACSG; in the primary official social media accounts of the CLACSG; and in any of the official social media accounts of the official media in De La Salle University-Dasmariñas.
