Welcome
Welcome to a community wellness hub which will support you to achieve a balanced, healthy and active lifestyle. Our passion is to see you get results, achieve your goals, improve your health and find a sense of wellbeing.
STARplex is a facility for everyone. We offer programs and services for babies right through to seniors and have a specific focus on catering for our families in the community. We do this by providing a variety of quality programs which give you a choice of activities appropriate to your age, personality and family circumstances. All STARplex services are delivered by friendly, qualified staff who share this passion. Many staff and members have been at STARplex since we started operations in the year 2000 and have helped to establish our reputation as a wellness hub. I am confident your experience will be enjoyable and your participation in the STARplex community will have a positive influence on those you meet and know. We look forward to your contribution in this regard. STARplex is keen to be part of the solution when it comes to addressing societal health problems such as chronic diseases like diabetes and cardiac disease. We have deliberately collocated health service providers such as doctors, physiotherapists, dietitians and exercise physiologists at STARplex to facilitate preventative health strategies for anyone identified by these providers as at risk of chronic disease. In partnership with health providers STARplex wants to ensure your level of physical activity is safe and the outcomes you are seeking are reasonable and achievable. To this end this handbook sets out the policies, procedures, codes and guidelines that underlie the STARplex culture and which make STARplex the safe and friendly place it is. Please refer to this handbook for information relating to participation in STARplex services.

STARplex...our story... The complex, which was opened in June 2000, is owned by Trinity College and operated as a not for profit community centre. With over 9,000 visitors every week the complex has something for everyone. Visitors enjoy a huge range of recreational services delivered by experienced, qualified staff. A key outcome for STARplex is personal and community health and wellbeing. This is being accomplished through an educational focus on junior sports development, fitness and lifestyle coaching and event and conference staging, all undertaken in friendly, modern facilities.

In 2006-07 STARplex won the South Australian Fitness Centre of the Year Award which recognised STARplex’s adoption of the Fitness Industry Code of Practice that promotes quality customer care, fair trading, excellence in staff training and community involvement. STARplex has a variety of retail shopping options for visitors that include the STARstore for gifts, sports and school-wear; Pec Deck Cafe, Evanston Park Surgery and Pharmacy, the Gawler Physiotherapy and Sports Injury Clinic and the STARplex Wellness and Rehabilitation Clinic. STARplex can help you look and feel healthy, so find time to make the STARplex experience part of your lifestyle. The name STARplex originated from our focus on Sports, Training, Arts & Recreation. To ensure that STARplex is able to provide a safe and comfortable environment for our members and staff, please assist us by ensuring that you comply with the following information. We advise you to only sign the Membership Application Form or Update Form if you have read and understood all following terms and conditions, declarations and your rights at STARplex. The information below can and will be used in the event of a discrepancy. If STARplex Terms and Conditions are not adhered to at any time, STARplex reserves the right to terminate any membership agreement at any time with limited to no notice being given. By signing your Membership Application Form or Update Form, you are agreeing to all information contained in this booklet. 1. ENTRY a. We can refuse you entry to the STARplex premises for inappropriate threatening or harassing behaviour, poor hygiene, damaging equipment or facilities or use of illegal or performance enhancing drugs in the centre. b. We can refuse you entry to the STARplex premises, cancel your membership and/or terminate your contract without warning or notice for inappropriate threatening or harassing behaviour, damaging equipment or facilities or use of illegal or performance enhancing drugs in the centre. c. By taking part in all STARplex Services, you are doing so at your own risk. 2. OPENING HOURS a. Standard opening hours of STARplex are available in this Members Handbook. STARplex opening hours are permitted to change at any time. STARplex will use its best endeavours to notify clients of closures due to circumstances outside our control such as power outages.

Children under the age of 14 must be accompanied by an adult at all times while within STARplex facilities. b. Responsibility remains with parents/guardians to supervise children when they are not participating in STARplex programs. 4. IN CASE OF AN EMERGENCY a. By signing the Membership Agreement Form or Update Form you give permission for the Applicant to be transported to hospital by ambulance and agree to be responsible for all costs associated with such a transportation and hospital admission. b. Please keep STARplex informed of any concerns, restraining orders or circumstances, so STARplex can do our best to support you and your family’s safety and wellbeing.

c. STARplex evacuate due to emergencies, such as power outages or alarms. Please refer to the evacuation areas on the site map. 5. MEMBERSHIPS a. STARplex offers both Ongoing Periodical Memberships and Fixed Term Agreements. Your Membership Application form will clearly outline which agreement you are on. i. An Ongoing Periodical Agreement is a direct debit setup where you receive services as per each supply period you pay for (supply period is 1 week). This agreement is an ongoing direct debit agreement which will not be cancelled until either you or STARplex terminate the agreement. See Terms and Conditions for more information. ii. A Fixed Term Agreement is a contract for a fixed term with a start and end date. You will pay upfront for services for this period only. If you would like to renew or extend your contract, an additional contract needs to be formed. b. Any memberships purchased, or any changes made after your first Membership Agreement will be outlined on our STARplex Update Form, with all changes, additions or cancellations clearly stated on this form. It is your own responsibility to declare any medical information on the medical update section of this form. At each 12 month anniversary from your commencement at STARplex a medical update will be required. c. By signing the Membership Application Form and STARplex Update form, you are agreeing to all Terms and Conditions, Rules and Guidelines that are outlined in this handbook including exercising and participating in all STARplex activities at your own risk.
d. All Periodical Ongoing Membership require one week’s notice to cancel out of the contract. There are no additional cancellation fees. All Fixed Term Agreements need to be fulfilled. No refunds are given for membership time not used. Please be mindful of this when you are joining a membership. e. Each member is entitled to 4 weeks suspension limit per annum. Any suspension time not used in your contract year is not rolled over to the following year. To apply for suspension, please fill in a suspension application form located at reception. Suspension is approved when you receive an email confirmation from STARplex with your suspension dates. Membership and payments are stopped for this period of advised time. Minimum suspension period is 2 weeks per suspension application. f. To apply for further suspension (exceeding your 4 weeks) you must have a medical certificate from your medical professional outlining the start and end date recommended for the membership suspension. Suspension is approved when you receive an email confirmation from STARplex with your suspension dates. Membership and payments are stopped for this period of advised time. Membership will recommence once a medical clearance has been supplied by the medical professional. Minimum suspension period is 2 weeks per suspension application. g. For the safety of our members, it is your own responsibility to update STARplex with any changes to your personal and medical details as soon as possible. This can be done by speaking to one of our friendly STARplex staff, calling us, or sending an email. Details can be found in the Contact Details section of this Members Handbook.
h. Couples and Family members must live at the same address to be eligible for the 10% loyalty membership discount off the STARmember price. If one member from the couple or family membership cancels, remaining members on the loyalty will revert to the current full price membership at their next anniversary. i. To receive the STARcorporate membership rate you must be; i. Trinity or Montessori parent, Trinity Old Scholar, Trinity Staff family, Emergency Services staff, or an organisation or association in partnership with STARplex, such as our direct sponsors and their staff. Proof of your affiliation with such associations must be presented to receive the discounted rate, such as a Trinity account, or Emergency Services ID card. j. Concession - You may be eligible for our STARconcession rate if you hold a concession card. Concessions include full or part time students, seniors or pensioners, DVA, or Health Care Card holders. Please ask STARplex staff for more information. k. Depending on your provider and level of cover, health rebates may be available with some STARplex programs. l. STARplex has the right to inform members 30 days prior to increases in program and membership prices. m. STARplex memberships and programs are not transferrable to other individuals. 6. DIRECT DEBITS a. If your membership or program payment rejects 3 consecutive times, upon the third direct debit rejection your membership or program will be cancelled. If this sequence occurs twice, your rejection fee is subject to increase.
7. COMMUNICATION a. STARplex may communicate to members by way of letter, email, text message, Facebook, electronic newsletters including STARgazer, School Holiday Booklet and telephone. b. Please be aware that text message character constraints require information to be brief and specific. 8. Emergency Procedures a. Follow instruction of STARplex staff when evacuations, lockdowns or any other emergency procedures are announced. 9. Other a. No photography and videography is permitted in any STARplex programs or classes. All photographers are authorised by STARplex Management. b. STARplex is a non-smoking site. There is a designated smoking area provided, which is located on the site map.

Departmental Rules and Information... 1. STARplex Fitness Centre is registered with Fitness Australia. 2. Membership Bands must be presented at Reception or scanned at the turnstile upon entry to STARplex. 3. Each member on an ongoing or 12 month membership (excludes 3 month memberships and students under 14) will receive one membership band upon commencement of your membership. If your band is faulty or breaks within 30 days, please bring it to STARplex reception, where it will be replaced. After 30 days, you will need to purchase a new band at $20. 4. If you commence a three month membership, you have the option to purchase a band for $20 or use a provided laminated card. 5. Students under 16 cannot purchase a band they must only use a provided laminated card. 6. If you cancel your membership, you are required to return your band; otherwise a $20 replacement fee will be issued. 7. Members are to bring a water bottle and hand towel to every workout. 8. Student membership rules are as follows: I. 10-13 YEAR OLDS a. Must be accompanied by a parent/guardian. b. Are not eligible to use cardio equipment unsupervised. c. Must complete Exercise & Physical Activity questionnaire at induction. d. Parent/Guardian must sign questionnaire on behalf of child. e. May participate in Group Fitness Classes and Supervised Cardio Activity within the Fitness Centre. f. Pool Access (must comply with pool rules, page 27).
II. 14-15 YEAR OLDS a. Not required to be accompanied by an adult. b. Must complete Exercise & Physical Activity questionnaire at induction. c. Parent/Guardian must sign questionnaire on behalf of child. d. May participate in Group Fitness Classes and Cardio Activity within the Fitness Centre. e. Pool Access (must comply with pool rules, page 27). III. 16 YEAR OLDS a. Not required to be accompanied by an adult. b. Must complete Exercise & Physical Activity questionnaire at induction. c. Parent/Guardian must sign questionnaire on behalf of child. d. May participate in all Group Fitness Classes, Cardio Activity and Weight Training within the Fitness Centre. e. Pool Access (must comply with pool rules, page 27). IV. WITH GROUP FITNESS MEMBERSHIP a. 10-13 Years olds can participate in the following Group Fitness classes while their parent/guardian remains in the gym area i.e. they can be in the class alone under the instruction of the Group Fitness Instructor. 14-15 Years old can participate in the following Group Fitness Classes: BODY STEP

c. 16 Years old can participate in all Group Fitness Classes contained in the current timetable V. STARplex reserves the right to refuse entry and membership at any time VI. STARplex staff can ask a member to leave the centre at any time if the student guidelines are not adhered to VII. For the safety of our younger members, students between the ages of 10-15 only have access to cardio and bodyweight exercises. No weight bearing exercises are permitted. No access is allowed in the free weights area, pin loaded equipment or any other strength training equipment. No access to Body Pump, Boxfit or Pilates Group Fitness Classes VIII. Students between the ages of 14-18 must demonstrate mature and responsible behaviour when using STARplex facilities otherwise a suspension or cancellation of membership will be applied. This includes but is not limited to; a. using equipment only in the way it is recommended b. only participating in classes and equipment advised within your age group as outlined above c. using STARplex Fitness Centre facilities only for the
intended exercising purpose, not for social gatherings d. always follow group fitness instructors directions when participating in classes e. always follow gym instructors directions when on the gym floor f. always store bags in lockers provided, not on the floor as this is a safety hazard g. always bring a towel and drink bottle h. water taps provided are for filling up drink bottles only, not to drink directly out of 9. Group Fitness class tickets can be collected from Reception or at the Fitness Centre kiosk and must be given to your class instructor prior to commencing the class. Late arrivals for group fitness classes will not be allowed entry. 10. All STARmember holders are required to take an initial gym induction at the commencement of your membership, along with two additional program updates throughout the first twelve months. If you chose to waiver the initial gym induction, you are not eligible for the two complimentary program updates in the remaining 12 months. These complimentary program updates will not roll over to the following year. Upon your 12 month membership anniversary, you will be required to attend your anniversary program review and update your medical and personal details with our Fitness Centre staff. This is so we can help keep you on track to achieve your wellness goals. If you require additional program updates, you can purchase these for $30 per session. See Fitness Centre staff for more details.
11. If your answers on the Membership Application form or Update Form require you to seek a written medical clearance, you must not enter the Fitness Centre until the medical clearance has been handed to appropriate STARplex staff. 12. It is your responsibility to notify STARplex staff of any changes to your personal and medical information. 13. Members are to wear clean workout attire (no jeans) and enclosed sporting footwear. 14. Each member is entitled to 4 weeks suspension limit per annum. Any suspension time not used in your contract year is not rolled over to the following year. To apply for a suspension, please fill in a suspension application form located at Reception. Suspension is approved when you receive an email confirmation from STARplex with your suspension dates. Membership and payments are stopped for this period of advised time. Minimum suspension period is 2 weeks per suspension application. 15. To apply for further suspension (exceeding your 4 weeks) you must have a medical certificate from your medical professional outlining the start and end date recommended for the membership suspension. Suspension is approved when you receive an email confirmation from STARplex with your suspension dates. Membership and payments are stopped for this period of advised time. 16. Personal Training Rules I. Once you have booked a Personal Training session with your Personal Trainer, you must give at least 24 hours’ notice if you are cancelling your session. If less than 24 hours’ notice is given, you will be charged for your session. Notice can be given via phone call, face to face or SMS to your Personal Trainer, email is not permitted. II. All 3 packs of Personal Training have an expiry date of 6 weeks. Expiry dates cannot be extended. III. Each member is only entitled to one 3 pack of Personal Training. IV. All 10 packs of Personal Training have an expiry of 20 weeks Expiry dates cannot be extended. V. If you are unable to use your Personal Training sessions within 20 weeks, due to medical reasons, a medical certificate must be supplied to receive an extension. VI. All 10 packs of Team Training have an expiry of 10 weeks. You must use your Team Training sessions within the allocated 10 week period. To register a team for any court sports, there is a compulsory nomination fee that must be paid in full before your team application is processed. Please see Reception or the Courts Department for any further details. If your team forfeits their game, there is a forfeit fee that must be paid in full prior to your next game. If your team withdraws from the current competition, there is a withdrawal fee that must be paid in full upon withdrawing. If your team fails to pay the withdrawal fee, each member of that team will be classed as an un-financial player and will not be permitted to take to the court as part of any team until their portion of the unpaid withdrawal fine has been paid. The team contact person is responsible for the collection and payment of all monies and is the liaison person between STARplex and the team. They will be the person to receive any mail outs or verbal communication from the courts. Team Nomination fee, plus player registration fee must accompany your team nomination form for your team to be included into the competition. Teams must pay a team payment prior to the beginning of their match to reception. The team coordinator must produce receipt to umpires to validate payment. The Courts Manager reserves the right to replace or withdraw any team that causes disharmony during the season. If you receive two Technical Fouls in any basketball game, you will be immediately removed from the court for the rest of the game, receive 1 week’s suspension and further penalties may apply.
10. All person/s playing/using the STARplex stadium do so at their own risk. 11. Courts games are to be played in the spirit of good sportsmanship and within the spirit of the game. 12. When bleeding occurs, play must stop immediately. The player concerned must leave the court and the wound securely covered and must not return to the court until the bleeding has stopped and contaminated clothing has been changed. The replaced clothing may be of any colour. The player may then be substituted onto the court. 13. Players, spectators and officials of the team will be removed from the court and stadium area for: I. Abusive, threatening, racial or foul language towards umpires’/referees’, players or spectators. II. Continual questioning of umpires’/referees’ decisions III. Dissent towards umpires’/referees’ IV. Unduly rough play or continued rough play V. Intimidating gestures or actions towards umpires/referees, players or spectators VI. Any action not in the spirit of the game VII. Equipment abuse VIII. A player will be removed from the court for the entire game for any misdemeanour and receive a 1 match suspension which will apply for all sports played at STARplex, plus further penalties may apply. IX. If any hitting, striking, fighting or kicking of a player, umpire or spectator occurs, the player will be removed from the court for the entire game and receive a 5 game suspension which will apply for all sports played at STARplex, plus further penalties may apply.

14. Teams are to supply own bibs. Bibs are available from reception for hire at a cost of $5.00 per set each time used. The bibs must be returned to reception in good condition. Failure to return bibs, may incur a fine. 15. A player must be either a minimum of 14 years old to be eligible to play in any senior netball competition or minimum of 15 years old to be eligible to play in any senior basketball competition. 16. All teams and players are to be in correct, conforming uniform (as stated on your team’s membership application form) within three weeks of joining any competition. All players in a team must have their top colour to be consistent, not different shades of the same colour. Basketball players, in the one team, are to have a different number on the front and back of each basketball singlet. No masking tape is to be used for numbers. 17. Where a colour clash occurs with uniforms, the first named team on the program is responsible to wear bibs. 18. Approved non-marking footwear must be worn. 19. No jewellery is to be worn; this includes nose and eyebrow jewellery. No band aids are permitted to cover jewellery, with the exception of wedding rings but they must be taped. 20. Medical emergency bracelets must be worn, but must be appropriately covered or taped. Written notification to STARplex court staff must be presented disclaiming injury for permanent jewellery. 21. Nails must not be taped. 22. Sports gloves are permitted. These will be checked to ensure that the ends are not worn through. 23. Score cards must be filled out correctly 24. A player may only play for their registered team during the season’s competition.
25. Forfeit fines are to be paid strictly within 7 days of the forfeit. Loss of points will result if fine is not paid within the outlined timeframe. 26. If you submit a team nomination after the pre-season drawer there will be a waiting period of three to four weeks before your team is included in the relevant competition. 27. All courts sports players must accept full responsibility for their actions and for the collection and payment of all monies. 28. STARplex is governed by Netball SA and Basketball SA. Specific STARplex games rules are to be adhered to at all times. 29. It is each player’s individual responsibility to keep STARplex informed of any medical details or injuries that may make it dangerous to participate in STARplex courts sports. It is also all players’ responsibility to update STARplex with any change to medical circumstances. 30. All players must fill in a Membership Application form or Update form once per year to ensure STARplex has accurate details for each player. 31. Ladies netball and Mixed netball By Laws, team Information & requirements: I. Mixed Netball teams to have a maximum of 3 male players on court at any one time. If you only have 5 players, only 2 males are permitted to play II. Players will be required to play 5 or more games to qualify for finals. In Preliminary and Grand finals time will be held for injuries. If the game is drawn, 2 x 5 minutes will be played and if the game is still drawn, the team that reaches a 2 goal advantage will be declared the winner.
III. Trophies and prizes will only be given to qualified players who take the court in the grand final game, a maximum of 8 per team. Teams may purchase trophies for other players IV. Game Time rules are as follows: a. 4 x 10 minute quarters b. If half of game has been played and game cannot continue, scores will stand and there will be no refund to teams. c. Time will not be held for injury or any other reason during minor rounds. d. Time will be held in Preliminary and Grand finals V. Game Rules - S.A.N.A Rules apply on court: a. NO Stepping – (to keep one foot still when in possession of the ball) b. NO Contact - (shoving, pushing, knocking an opponent) c. NO Obstruction – (to be 1 metre away from a player who has the ball when you have your hands raised in a defending motion). d. To release the ball within 3 seconds VI. Team Requirements a. Players must not interchange between teams in the same division, once you are registered in one team, you must stay in that team. b. Players must not be younger than 14 years old to take the court VII. Misconduct a. Misconduct will result in the removal from the court for the duration of the game. The penalty will be at least 1 match. Further penalties will apply if removal from the stadium.
VIII. Uniforms: a. Teams must be in correct uniforms by the 3rd game of the season, including players filling in. b. Skirts or body suits must be worn, no shorts, leggings or long pants for ladies netball. c. All players in the team must have their top colour to be consistent not different shades of the same colour. If body suits are different colours, a designated colour T-shirt must be worn. d. Mixed netball players may wear shorts with no pockets; ladies may wear skirts if they wish. No long pants, bike pants, board shorts, or leggings are to be worn, even when filling in. If these items of clothing are worn, the player will be taken off the court. e. The person from the first team on the scoresheet is the time scorer; the person from the following team is sheet scorer. First and last names need to be written legibly. No nicknames are permitted. Substitution players must be put on scorecard only when playing. f. Long hair must be tied back and not to swing freely. IX. There must be 1 capable scorer supplied for each team. If no scorer is available, a 5 goal penalty will be given to the opposition team at the start of the game. If both teams do not have scorers, one player from each team must come off court. There is no scoring to be done by players on court, or umpires. X. Teams are to be ready at courtside 5 minutes prior to game with bibs on.

XI. The clock will continually run. There will be a 1 minute break between 1st and 3rd quarters (each quarter for mixed netball), and 2 minutes at half time. Umpires will blow the whistle 30 seconds before game is about to start for each quarter. XII. A goal will be given to opposing team for each minute the team is late onto court. The game will be classed as a forfeit once the first quarter time has elapsed. XIII. Please see nomination fees, forfeit fines and team withdrawal fines in the table below. XIV. XVII. Sharp adornments, items of jewellery, included beads in hair, or fingernails protruding above the tops of the fingers are not permitted. If unable to remove eye brow jewellery, it must be securely taped and a covering letter given to STARplex stating that there is no liability to STARplex for any damage. XIX.Long hair must be tied back and not to swing freely. XX. Matches will not be delayed to allow any of the above to be rectified XXI. Trophy/ prizes will be only awarded to qualified players who play in the Grand Final game. XXII. Timing Conditions: a. The games shall consist of two halves of twenty minutes with a 1 minute half time. b. All teams should be present and ready to play at least five minutes before the scheduled starting time. c. The time clock shall be started on the scheduled starting time of the match, as determined by the stadium clock. d. For finals the clock shall be stopped for every stoppage of play and team foul shooting in the last two minutes of the second half. e. Only two time-outs per team are permitted in each half. During extra periods, one time out per team is applicable. f. Where half of the game has been played scores and player recording will be recorded as if the game was completed. Both teams are required to pay the standard match fee
XXIII. Scoresheets: a. It is your team’s responsibility to ensure that the first and last names of players present and ready to play in the match are written legibly on the official scoresheet, with no nicknames. XXIV. If a team does not have four players on court ready to play and a scorer within ten minutes of the scheduled starting time the match shall be declared an un-notified forfeit, payable within 7 days. XXV. Late arrivals: a. When a team has a scorer and four players the match may start and will proceed as a normal game. b. During all final’s matches a team must field a minimum of five players. The game must commence with four players and a fifth player MUST arrive before the ten minute mark of the first half, otherwise a forfeit shall be declared. XXVI. Mixed Basketball: a. Male players cannot reject or defend (i.e. take the ball from) female players once in control of the ball b. Two players of each gender are required, with the 3rd player optional. c. People of the same gender shall take jump balls. XXVII. Premiership Points: a. Win 3 points b. Loss 1 point c. Draw 2 points d. Forfeit 0 point (20 points given to team receiving the forfeit) e. COURTS Programs BADGE Junior Training (Basketball, Netball, Soccer): To encourage children to try different sports, STARplex offers a Junior Development Program during school terms for netball and soccer (5 to 12 years) and basketball (8 to12 years). Skills and drills are taught with the accent on having fun while learning how to play the game. ELITE 8 (Basketball & Netball): Advanced clinics that help players improve their abilities and prepare for entry to higher levels of basketball or netball. STARplex Swim Centre is registered with Swim Australia. In order to maintain our high level of water quality, it is important for our customers to know that the pools may be shut down on any given day without prior warning. This will only occur if the pools are not operating within the parameters set out by the Guidelines of Safe Pool Operations of the Royal Life Saving Society of Australia. For example, if STARplex experiences power failure for more than one hour, the pool will be closed for at least 8 hours. We appreciate your understanding should this occur. We will use our best endeavour to notify clients of pool closures due to circumstances outside our control, such as power outages. Our pools are disinfected using a combination of ultra violet light and liquid chlorine. The technology of ultra violet light reduces the amount of chloramines therefore providing a high quality of water and air conditions for our clients. In order to maintain our high quality of water we ask that clients do not wear cotton t-shirts in the pool. We recommend rash tops which are available from the STARstore. T-shirts are permitted for parent and baby classes only. Children under 5 years of age must be accompanied by a responsible adult in the water within arms’ reach to ensure their safety. There is no eating permitted in the pool or directly around the pool. Diving in the shallow end of the large pool 0.9 meter is very unsafe. No diving is permitted in the learners’ pool.
9. Children up to 10 years old must be under adult supervision whilst in the pool area. 10. If a child needs to wear flotation aides, they should only swim as far from you as you can safely reach. 11. As we like our pool area to always look neat and presentable, we ask that if you have any rubbish to please use the bins which are provided around the pool area. 12. Eating in the pool, directly around the pool or in the change rooms is not permitted. 13. There is a Lifeguard on duty at all times the pool is open. 14. Children aged 8 years and older must only use gender specific change rooms. STARplex Swim School 15. Swim School has a minimum enrolment period of 6 continuous months. If you cancel before the end of the 6 month period a resignation fee of $50 per student will apply. If you present medical documentation from your health professional and cancel in person by completing a cancellation form, the $50 resignation fee will not apply. 16. STARplex Swim School runs in accordance with DECS School Terms, with 4 Terms per year. 17. Swim School paid as a direct debit will receive the following benefits: I. 1 free holiday program per child, conditions apply II. Free public swimming, conditions apply 18. Debits occur every Friday for the entire year and are paid 1 week in advance. 19. Where a Public Holiday falls on a Friday, the debits will occur the next business day (generally the Monday after).

20. It is the responsibility of the client: I. to ensure the funds are available on the day and 1 to 2 business days after the day of the debit. Some financial institutions may not withdraw the amount on the same day (may be withdrawn over the weekend – this is out of our control). II. to ensure that bank account/credit card details given are correct and clearly written. III. to ensure that you inform us, as soon as possible, if your bank account/credit card details change. 21. Rejected payments will incur a $15 rejection fee (see below for process). I. This $15 is the STARplex rejection fee – your financial institution may also charge a fee/interest for a rejected payment from your bank account/credit card. 22. Cancellations occurring within the 6 month minimum period will incur a $50 cancellation fee which will be debited upon your next direct debit. 23. A medical certificate will be required for any time stop/ cancellation requests. 24. A direct debit cancellation form (available in the Swim Centre office) must be completed by the Responsible Person for cancellation to take effect – 2 weeks’ notice must be given. 25. Direct debit clients are not eligible for the early payment discount. 26. STARplex may make changes to these terms and conditions at anytime by giving you at least 2 weeks written notice. 27. If you believe there has been an error in debiting your account/ credit card, contact STARplex on phone number (08) 8522 0622 and ask to speak with the Direct Debit Officer or the Swim Centre Manager as soon as possible.
28. Refunds will only occur if the error is the fault of STARplex. 29. STARplex gets charged by the bank for rejections therefore costs need to be on-charged. The process of following up rejected fees is quite time consuming and our Administration costs need to be covered. PLEASE ENSURE FUNDS ARE AVAILABLE EACH FRIDAY and this charge will not affect you. The STARplex Direct Debit Officer and Swim Centre Management will deal with Swim School Direct Debit queries. Any contact to clients regarding rejections will be done so via SMS or Email or, in more urgent situations a direct phone call will be made. A mobile phone number and email address are required to ensure both time and cost efficient methods of contact.
The actual rejection process is as follows: 1. Credit Card rejections are identified on the day of the direct debit. Bank Account rejections are identified 2 Business days after the debit (generally Tuesdays) 2. Upon your direct debit being rejected, you will be contacted via SMS or Email. You will be informed that a rejection has occurred and that the outstanding amount, plus the rejection fee ($15) will be automatically deducted on the next direct debit run in addition to the standard debit amount (example $14.20+$15.00+$14.20 =$43.40 to be taken) 3. This procedure will be repeated if there is a 2nd consecutive rejection 4. Upon the 3rd consecutive rejection, you will be contacted by SMS or Email, requesting urgent attention to amend the problem. 5. If we do not receive a reply before the next debit day, the swimming lessons will be cancelled. You will receive a letter informing you of this cancellation, including details of the amount owing. This amount must be paid, in full, prior to entering into any other Swim Centre program at STARplex.

The crèche provides a high quality, safe, caring and fun environment, giving children the opportunity to play and learn with age appropriate toys, activities and to interact with other children. STARplex Crèche provides quality care for children between three months to 5 years. We are a FREE service offering support to parents/guardians who are members of STARplex. Care is provided for children, for a maximum of two hours per session. Bookings are essential. The STARplex Crèche is a FREE service for parents or guardians who are participating in the areas of either the: • Fitness Centre • Courts • Pool • Theatre • Wellness & Rehabilitation 1. 2. 3.
Children between the ages of three months to 5 years are welcome to utilise the STARplex Crèche. School aged children are welcome to use the Trinity College Out of School Hours Care. During the school holidays we also offer a Kids Club service for all school aged children. STARplex Crèche booking time is 2 hours maximum per session. Crèche Arrival and Departure Guidelines 1. Parents/Guardians are to remain within STARplex whilst their children are in the STARplex Crèche. Parents need to complete Membership Application Form on their child’s first visit. Families with more than one child need to complete a Membership Application Form for each individual child. At the beginning of each year an Update Form is to be completed. Please advise staff of any changes to this information as soon as it occurs. 2. Please ensure that you advise staff if your child has any medical conditions i.e. allergies/asthma on each visit. 3. All children need to be signed in on arrival and out when departing. This is to ensure that all children are accounted for in the event of an emergency fire/evacuation procedure. 4. Please write your child’s full name and complete all details, when either signing in or booking your child into the STARplex Crèche. This will be helpful in identifying children who share the same first name and also if we need to contact you by telephone when we have any queries. 5. For the safety of the children, all children need to be collected by the same person who signed them into care. Unless prior arrangement has been made with a staff member and it is written on the arrival and departure form, no child will be released to another person. Staff will always check photo Identification (current driver’s licence) if any authorized/ nominated person unknown to them has come to collect your child. If STARplex Crèche staff are unsure on whether the person has authorization to collect your child, they will notify you to confirm authorization.

In order for staff to provide a balanced ratio of children to staff, children need to be booked in to our service in advance. Bookings can be made in the STARplex Crèche during opening hours or at STARplex Reception. If the STARplex Crèche is full and you would like to book in for that day/time, your booking will be placed on a waiting list. This is to ensure the STARplex Crèche remains a safe environment for all children. Please ensure that you cancel your booking if you no longer require care, this will enable us to provide a place for families on the waiting list. If you are placed on waiting list, please ensure that you complete your contact details on the form provided, this way our staff can contact you promptly if a place becomes available. The STARplex Crèche opening times may change from term to term. Please ensure that you keep up to date with any changes before booking into the crèche. Please feel free to approach staff or obtain a copy of our current opening times at the entrance to STARplex.
Belongings and Clothing 1. All children need to arrive in the STARplex Crèche with a bag, change of clothing, appropriate snack and water bottle which are all fully labelled. 2. Babies/toddlers/children who are not toilet trained need to arrive in a clean dry nappy and also provide a spare nappy in their bag in case they require a nappy change. Disposable nappies are available for $1.00 each from STARplex Crèche if needed. If your child is toilet training, please let staff know and we can support you in assisting and reminding your child to use the toilet.
3. The STARplex Crèche provides play experiences throughout the day which include activities such as play dough, gluing, textas and painting. Please ensure your child’s clothing is suitable so they can be involved with the group. 4. Please do not leave any personal belongings i.e. purses, watches etc. in your child’s bag. The STARplex Crèche will not be held responsible if any personal items go missing. Lockers are provided in the Fitness Centre which are secure and are free to members. 5. Please do not leave any medication in your child’s bag. 6. We encourage the older children who use our service to be independent and be responsible for their own belongings where appropriate. Could you please check your child’s bag before each session to ensure that there are no small items, toys, lollies etc., which can be a hazard to smaller inquisitive children. Settling your child into the STARplex Crèche 1. We encourage you to visit the STARplex Crèche with your child/ren prior to their commencement (if possible). 2. Some children will settle immediately and others will take a little longer. Depending on your child’s needs, these first visits should be short and frequent (15-30 minutes approximately). If you or your child, are becoming anxious about you leaving, it may be a good idea to leave straight away and then come back after a short period of time to spend some time playing with your child when you return. Whatever way you decide to settle your child into care, it is always a good idea to tell your child/ren when you are leaving as it is important that they know you will be

coming back to pick them up soon. The STARplex Crèche staff will support you and your child whilst you are settling in to this routine. When your child becomes comfortable and safe in the STARplex Crèche, the time can be extended. This will help you and your child/ren establish a trusting relationship with the staff that will be caring for your child as well as providing them with the opportunity to explore their new environment and interact with staff and children. The staff will notify you if your child is not settling on any given day. Please feel free to approach staff with any questions, comments or concerns about your child’s settling in period.
Illness Guidelines 1. Please ensure for the health and safety of our children and staff that your child is well enough to attend the STARplex Crèche. 2. Your child will not be accepted into the STARplex Crèche if: I. Your child is not feeling well II. Has the common cold (with a nasal secretion which is discoloured, thick and greenish) III. Has a temperature of 37.6C or higher IV. Infectious Diseases (Please refer to the next page for a list) VI. Does not have up to date vaccinations

Allergies / Medical 1. We have had an increase in the number of children attending the STARplex Crèche who have various food allergies or medical conditions. Certain allergies/medical conditions pose a life threatening risk to these children. In an emergency situation, these children may require certain medication to be administered. 2. Staff in the STARplex Crèche cannot accept responsibility to administer medication to your child (with the exception of Anaphylaxis/Asthma reliever medication). Staff will promptly notify you if any medication is required in an emergency. 3. The STARplex Crèche team have an Action Plan for Anaphylaxis (life threatening conditions), which will enable staff to provide a safe environment for children with allergic/medical conditions whilst in the STARplex Crèche. It will contain up to date information about your child together with parent/guardian information. 4. Action Plans will also include steps which staff will follow in a life threatening emergency situation. Due to the large influx of children and families that utilise our service on a casual basis it is important that the parent/guardian hand medication and action plans to staff on arrival so that it can be stored in the medication box. This will ensure that staff can find medication quickly in an emergency. 5. In an emergency situation, staff will follow STARplex policies. Should a child require medical attention, staff will first meet the child’s immediate needs, i.e. call an ambulance, then make contact with parents/guardians. 6. Please feel free to approach STARplex Crèche staff if you need to fill out an Action Plan or with any questions or feedback.
Infectious Diseases Guidelines 1. It is recommended that children using the STARplex crèche are up to date with their vaccines. 2. Children with visible signs of a contagious illness will be excluded from the STARplex Crèche until the child is free from infection. 3. A medical clearance must be obtained from your doctor before your child attends the STARplex Crèche again. 4. The STARplex Crèche must be notified if a child develops any contagious diseases whilst they have been in the service, so staff can notify other parents with an information notice which is displayed on the wall, above the sign-in- sheet detailing the type of illness, date and number of cases etc. (all other details remain confidential) 5. Exclusion times are an important factor in limiting the spread of infectious diseases, they are: Chicken Pox Incubation period 14-21 days. Exclude until blisters are crusted and dry. Conjunctivitis
Exclude until discharge from eyes has ceased.

STARplex Crèche Food Policy STARplex Crèche is committed to providing a safe and healthy environment for staff and children. Our policy reflects the importance of healthy eating, dental health and a safe environment for those children with allergies to food and drink. We also need to consider that children are only in the crèche for a maximum of two hours per session time. It is important that your child/ren’s main meals, i.e: breakfast, lunch & dinner, are to be given to your child/ren before or after their time in the STARplex Crèche.
Food that is suitable to bring into the STARplex Crèche: • Fruit - fresh (apple and other hard fruits to be pureed or cooked) grapes to be cut in half, pureed, dried (cut into small pieces), tinned fruit • Crackers – plain, rice or savoury (includes shapes, vegemite dips) • Plain Sweet Biscuits - (no chocolate/chip/coated, cream, iced or jam) • Plain Cake/Muffin - (no chocolate/chip/coated, cream, iced or jam) • Sandwiches - (no sweet fillings, butter, cheese or nut products) suggested fillings vegemite, ham, fritz, tuna, salad • Fruit Bars - (no chocolate coating) • Fruit Twist Type Bars - (no nut products) • Drink - water only is to be brought in for children except for babies whom have a milk formula bottle. • Baby bottle milk – plain, formula or breast PLEASE REMEMBER NO DAIRY; NO NUTS OR EGG PRODUCTS ARE TO BE BROUGHT INTO THE CRECHE. For the safety of our Children 1. Please ensure all bags, lunchboxes, bottles and prams are labelled with your child’s full name. Any lunchboxes, food items or bottles not labelled will not be given to your child by staff. 2. The staff aim to develop a positive self-concept in all children in our care. The guidance of your child’s behaviour will be positive, supportive and consistent with their age, expectations and individuality. Any child/children behaving in an aggressive and unsafe manner will be requested by staff to be collected immediately by their parents. 3. Please ensure your child’s fingernails are cut short to ensure the safety of your child and other children in the crèche in case of any scratching accidents. 4. Small items need to be kept at home. Please check your children’s pockets, bags, etc. for any such items before leaving your child. 5. Please ensure toys are kept at home. Toys brought into the Crèche create conflict between the children and there is a risk of losing your well-loved toys. The STARplex Crèche provides a large range of toys suitable for different age levels. 6. Please ensure small hairclips are not in your child’s hair, they may fall out and be a choking hazard to a baby. 7. No medication is to be kept in your child’s bag. 8. Parents please be aware when rushing out the door, that the gate and door are closed behind you. 9. Please check lost property boxes for any of your lost items. Reminder: If your child requires a milk bottle or food which needs to be warmed up please ensure it is warmed up before you bring your child in. The STARplex Crèche has no microwave and staff may not have the opportunity to leave the room to warm them
up. It is acceptable to bring in warm boiled water in a bottle and a measured amount of formula, so staff can then make up the bottle if your child requires it. This is a healthier option and will not destroy the nutrients in the milk like microwaving or reheating. Emergency Evacuation Procedures: 1. STARplex Crèche in conjunction with STARplex have a detailed emergency evacuation procedure, so if the need ever arises, we are effective in evacuating the centre as quickly and safely as possible. 2. It is important that all the children and staff are accounted for if we evacuate the building and this is why we have all children/staff signed in and out for each session. To ensure that we are not hindered in an evacuation, it will not be possible for us to release a child when transporting children to the STARplex assembly point. If you make your way to the STARplex Crèche in an emergency evacuation, stay with the group until we are able to account for all the children. We may then call on you to assist, otherwise follow the directions from STARplex staff to the nearest exit. 3. Once we have called the attendance list and notified the Fire Warden that all children are out of the building and the Fire Warden has advised that it is safe to leave, you can then sign out your child and leave STARplex. 4. Detailed copies of our Fire/Emergency Evacuation Procedure are clearly displayed in the crèche. The STARplex Crèche newsletter is published every three months with updated, current and important information for the parents/guardians utilising the STARplex Crèche.

STARfun Holiday Program This program is available most school holidays and dates are available during week five of each school term. The children really enjoy the program and have the opportunity to try basketball, boot camp, netball, soccer, tennis, gymnastics, craft activities and finish each day with some swimming.
Kids Club at STARplex IN THE SCHOOL HOLIDAYS for 5-12 year olds for three fun hours! Time: 9.00am-12.00pm Days: Monday-Friday (closed Public Holidays) Kids Club is only available to parents/guardians who are using the complex while their children are being cared for. A 10 visit pass is also available for purchase from STARplex Reception for the cost of $60.00. Before and after Kids Club opening times, children need to be signed in at the STARplex Crèche. This is a great opportunity for children to experience several different sporting activities before they commit to a team sport. These activities are organized and supervised by both qualified instructors and children services STARplex staff. Keeping the children busy and active in the holidays can be a real challenge. The activities offered during these days are not only fun, they improve fitness, hand/eye co-ordination and are a good social outlet for the children whilst giving parents the opportunity to have full days of care at an affordable price. The cost of the program is $50 per day with lunch and morning tea provided. Discounts are available for families with three or more children booked into the program. Children are signed in/out at the Hewitson Theatre STARplex at 8:45am and 4:00pm. Limited places are available. STARplex...Terms and Conditions... 1.
Terms STARplex referred to herein as ‘STARplex’, “we”, “us”, “our” and derivatives. Applicant referred to herein as “you”, “your” and derivatives.
2. Cooling off Period You may, by giving us written notice, cancel this Contract during the period commencing on the date that we accept your membership application and ending 48 hours after that date (“Cooling off Period”). If you cancel this Contract in this way we will refund to you, within 7 days of receiving your written notice of cancellation, an amount equal to the Membership Fee and any additional amounts you have paid to us, less the Administration Fee and the cost of any fitness services we have already supplied to you. If you want to terminate this Contract after the Cooling off Period, different conditions will apply. The following termination clauses outline your right to terminate this Contract and any fees payable in such circumstances.

Termination within the Fixed Term You may terminate this Contract without additional fees prior to the expiry of the Fixed Term with immediate effect by providing us with written notice if: a) we make changes to this Contract which adversely affect you (please refer to clause 7); b) we breach our obligations to you (please refer to clause 8); c) you become subject to medical incapacity (please refer to clause 9); or d) you otherwise become entitled to do so under consumer laws. Cancellation of Membership To cancel your STARplex Ongoing Periodic Direct Debit Membership, you need to notify STARplex of your request to cancel and make an appointment to see a Membership Services Consultant. Please note that no other STARplex staff have the authority to approve a cancellation. The cancellation will take effect 7 days from completing and signing the cancellation paperwork. The following week’s membership payment is required upfront at the time of completing the cancellation paperwork. Cancellations are not accepted verbally. In the event of your membership being a Fixed Term upfront pre-paid membership, STARplex do not issue refunds for the cancellation of any up front Fixed Term memberships. If you do not return your membership band upon cancelling you membership, you will be required to pay a $20 band replacement fee.

Term You are entitled to receive the Services specified in your Membership Application for the Fixed Term for which you have paid Membership Fees in advance, or if your membership agreement is an Ongoing Periodic Agreement, for each supply period in which you have paid for, on an ongoing basis. There is no minimum term for the ongoing periodic agreements. If you have elected to pay Membership Fees by instalments and you fail to pay an instalment by the due date for payment, we reserve the right to immediately suspend your membership, cease providing services to you and refuse you entry to the STARplex Premises until all outstanding amounts have been paid. In this circumstance fees and charges will continue to accrue in accordance with this Contract; notwithstanding the fact that your membership is suspended.

Supply Period For ongoing periodic membership agreements, the supply period is one week. This means that each payment you make is for one week of STARplex services. You will pay for your supply period in advance. For example, the direct debit that occurs on Friday is for the following supply period, this being Friday-Thursday.

Termination when changes made to Terms and Conditions You are entitled to terminate this Contract with immediate effect at any time by providing us with written notice if: a) we make alterations to these Terms and Conditions as contemplated by clause 34 and you do not continue to use the STARplex; or b) higher Membership Fees applicable to your membership are introduced. No fees will be applicable for terminating in accordance with this clause apart from the Administration Fee, and Membership Fees for the time you have been a member calculated on a pro rata basis and any additional fees for Services already supplied to you.

Termination where we Breach our Obligations You may terminate this Contract at any time by written notice to us if we breach any of our obligations under this Contract and we have not remedied that breach within a reasonable time after you have given us written notice requiring the breach to be remedied. No fees will be applicable for cancelling in accordance with this clause apart from, to the extent not impacted by our breach, the Administration Fee, Membership Fees for the time you have been a member calculated on a pro rata basis and any additional fees for Services already supplied to you.

Termination for Medical Reasons You may terminate this Contract at any time by written notice to us if you are no longer able to utilise the Services by reason of an illness or permanent physical incapacity which is verified by a certificate provided by a medical practitioner approved by us. In that event, you will only be charged the Administration Fee, Membership Fees for the time you have been a member calculated on a pro rata basis and any additional fees for Services already supplied to you.
10. STARplex Rules You must ensure you read, understand and abide by the Rules which are notified to you through signage, hand-outs our website. STARplex reserves the right to terminate your membership agreement at any time if STARplex rules are not adhered to. By signing the Membership Application form or STARplex Update form you are agreeing to all rules, terms and conditions contained in this STARplex Handbook. 11. Right of Exclusion We can refuse you entry to the STARplex Premises, cancel your membership and/or terminate this Contract without warning or notice for inappropriate threatening or harassing behaviour, damaging equipment or facilities, STARplex rules being abused or use of illegal or performance enhancing drugs in the STARplex Centre. 12. Payment of Fees Payment: Membership Fees must be paid in the following manner: a) if you have chosen the ongoing periodic direct debit billing option, by equal periodic instalments in advance as stipulated in the Membership Details that accompanied your application for membership; or b) if you have chosen the Fixed Term upfront pre-payment option, the full amount on the Application Date. All Membership Fees may be recovered from your nominated credit/debit account (as provided from time to time). Any bank fees charged to us because of a rejection when collecting your Membership Fees may be charged directly to you by us or the Direct Debit Service Provider. If a Membership Fee instalment remains outstanding, you agree that, unless we are in breach of our obligations under this Contract, we or the Direct Debit Service Provider may continue to debit the nominated credit/debit account for the total amount due without notice to you. Direct Debit Day: The standard day that your STARplex membership direct debit occurs for a periodic billing contract is every Friday. On the occasion where Friday is a public Holiday, direct debits will automatically occur the very next business day without notice to you. Direct Debit Service Provider: You acknowledge that, if you choose
the periodic billing option, payment of the Membership Fees must be made in advance via the direct debit service provided by STARplex. You acknowledge that you have been provided with a copy of the Direct Debit Service terms and conditions. You acknowledge that STARplex may amend those terms and conditions from time to time by giving 30 days’ notice by communicating an updated version on the STARplex website. You may at any time contact the Direct Debit Officer at STARplex if you have any queries or to verify your direct debit authorisation details. Direct Debit Service Provider Fees: Membership Fees may include a fee payable for the service provided by STARplex. By signing the Membership Application form or STARplex Casual or Update form you agree to pay any individual or team nomination fees, forfeit fees, and team withdrawal fees that are applicable to your STARplex team or individual registration as stated in STARplex Rules. If the applicable fees are not paid in a timely matter (refer to STARplex Rules) your individual or team registration will be withdrawn with no notice to you. 13. Refunds No refunds will be made unless special circumstances prevail and STARplex approves. This is at the discretion of the General Manager. 14. Direct Debit Service Provider You acknowledge that the Direct Debit Service Provider may either be us (if we are authorised) or a third party whose only role is to provide direct debit services. You may have separate rights against a third party Direct Debit Service Provider pursuant to the Direct Debit Service Provider terms and conditions, although they are not a party to this Contract. If however, we are the Direct Debit Service Provider, the applicable terms and conditions will form part of this Contract. You otherwise agree not to hold the third party Direct Debit Service Provider liable for any actions, suits, proceedings, claims, demands, losses, damages, penalties, fines, costs and expenses arising from or in connection with your involvement in fitness activities in the STARplex Business or otherwise in connection with this Contract. 15. Administration Fee The Administration Fee is a fee to cover our costs involved in setting up a new membership. The Administration Fee is not refundable if you cancel this Contract during your Cooling off Period in accordance with clause 2. 16. Membership and Program Fee Increase Subject to your rights in clause 7, we reserve the right at any time to increase the Membership and Program Fee to be charged. If we increase Membership Fees we will provide at least two weeks prior notice of the increase by post or email to the addresses provided by you in your

continued... application for membership (unless you have advised us in writing of a change of details as required under clause 28). Following such notice, you authorise us to increase any direct debits to your credit card or bank account which you have authorised upon joining. We will not use this right to vary the terms of any special offer which applies to you.

17. Suspension You may suspend your membership in accordance with this clause 17 provided that all amounts payable for your membership are paid up to date. You may apply to us in writing to suspend your membership for either of the following reasons: a) Medical Suspension - you are unable to utilise the services for more than 2 consecutive weeks by reason of an illness or temporary physical incapacity which is verified by a certificate provided by a medical practitioner approved by us. The medical certificate must have a start and end date of recommended suspension time for STARplex to accept the certificate and apply suspension. b) Suspension - you are unable to utilise services for more than 2 consecutive weeks for any other reason permitted by the Rules. Without medical documentation, maximum time stop is 4 weeks per annum. You must apply for a suspension in writing as soon as reasonably practicable after you become aware of the circumstances giving rise to the request for suspension. The application must include satisfactory supporting documentation. We are entitled to charge you a reasonable fee for processing your suspension application (Suspension Fee). You agree to provide us with any documents reasonably requested by us to support your application. We will suspend your membership for the period requested if we are satisfied, acting reasonably, that your application for suspension meets the requirements of this clause 17, and you have paid to us the Suspension Fee if applicable. We are not obliged to suspend your membership during a fixed term on more than two occasions. We are not obliged to suspend you membership on more than two occasions per year. If your application to suspend is approved and you are on a periodic billing by direct debit contract, your direct debits will cease for the approved suspension duration. If your application to suspend is approved and you are on an upfront pre-paid contract, STARplex will provide services to you for the extension period without charging membership fees for the extension period. Suspension will not be granted if your account is in arrears. 18. Liability and Waiver Australian Consumer Law: The Australian Consumer Law (ACL) is contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth) (CCA) and contains certain guarantees in favour of consumers in relation to the supply of goods and services in trade or commerce. In relation to the supply of services, these guarantees (ACL services
guarantees) are contained in sections 60, 61 and 62 of the ACL (see the section “Your Rights” in the ACL Exclusion Form). A person who supplies services in trade or commerce may only exclude the application of an ACL services guarantee in limited circumstances. 19.
No Unlawful Exclusions: Nothing in this Contract excludes, restricts or modifies any term, condition, warranty, guarantee, right or remedy (including under an ACL services guarantee) which cannot lawfully be excluded, restricted or modified.

Lawful Exclusion of ACL Services Guarantees: Section 139A of the CCA and section 42 of the Fair Trading Act 1987 (SA) permit a term of a contract for the supply by a person of recreational services to a consumer to exclude, restrict or modify the application of all or any of the ACL services guarantees to that supply, the exercise of a right conferred on the consumer by the ACL services guarantees, and the liability of the person for a failure to comply with an ACL services guarantee that applies to that supply.

Exclusion of ACL Services Guarantees: To the extent permitted by section 139A of the CCA, you acknowledge and agree that the STARplex excludes all liability to you in connection with the supply of recreational services for: a) death; b) physical or mental injury (including the aggravation, acceleration or recurrence of such an injury); c) the contraction, aggravation or acceleration of a disease; d) the coming into existence, the aggravation, acceleration or recurrence of any condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs in relation to you that is or may be harmful or disadvantageous to you or community, or that may result in harm or disadvantage to you or community, resulting from a failure of the STARplex to comply with an ACL services guarantee.

Exclusion does not Apply to Reckless Conduct: Neither the above exclusion of liability nor the exclusion of liability contained in the ACL Exclusion Form apply if you have suffered any significant personal injury that is caused by the reckless conduct of the STARplex. The STARplex’s conduct is reckless conduct if the STARplex is aware, or should reasonably have been aware, of a significant risk that the conduct could result in personal injury to another person, and the STARplex engages in the conduct despite the risk and without adequate justification. For the purposes of this provision personal injury includes prenatal injury; impairment of a person’s physical or mental condition.
23.
Other Lawful Exclusions: Except as expressly included in this Contract, all implied terms, conditions, warranties, rights or other additional obligations that can be lawfully excluded are excluded from this Contract.

General Exclusion: To the maximum extent permitted by law, our liability to you in connection with this Contract including as a result of breach of contract or negligence (but to avoid doubt excluding reckless conduct as described above) is limited to the amount of fees paid by you in the previous 12 months.
25. Risk Management To mitigate risk and ensure that you correctly operate or use any of our facilities, services, products or equipment, including the adjustments of levels or settings on any equipment, you are required to undertake an induction with a member of our staff before use. You acknowledge that you use our facilities at your own risk and that use may involve risk of injury, whether caused by you or another party. To the extent permitted by law, STARplex, its servants or agents will not take responsibility for any loss, damage, death, illness or personal injury howsoever caused, arising out of, or incidental to, you and/or your child’s participation in any STARplex program. By accepting this Agreement you agree that STARplex, its servants or agents will not be liable for any loss, damage, death, illness or personal injury at or from using our facilities or equipment. This release does not apply if your loss, damage, death or personal injury results from reckless conduct/ gross negligence on our part. 26. Responsibility for Damage You are solely responsible for any damage which you may cause to the STARplex, the STARplex Premises, its facilities, services, products or equipment, if such damage is caused by your wilful act and/or negligence. 27. Disclosure of your Physical Condition Provision of a safe and effective exercise program is dependent upon accurate health and fitness profiling. It is therefore essential that you, agree to, disclose to us all relevant personal health and fitness information both prior to and during engagement in any exercise program, Service (which includes any health risk assessment, and any initial and periodic fitness assessment) or facility we provide to you, as a part of your membership. You warrant and represent that all information you disclose to us will be true and accurate in all respects and not misleading in any respect. You further warrant and represent that you will not use the STARplex or any of our facilities, Services or products whilst you are suffering from any infections or contagious illness, disease or other ailment or whilst you are suffering from any
physical ailment such as open cuts or sores or minor infections where there is a risk, however small, to other members and guests. 28. Change of Details You must keep us promptly informed of any change of address, phone contact numbers, email address, bank account and credit card details for payment, medical details and any other personal information that is relevant to your membership with us. 29. Franchisees and Other Professionals We may appoint franchisees and authorise other persons (together referred to as authorised providers) to provide certain services (excluding the Services) from the STARplex Premises. If you engage an authorised provider you must pay fees for the services they provide to you direct to them. We are not liable for the fees payable by you to authorised providers. You hereby agree not to hold us liable and you agree to indemnify us and keep us indemnified for any claims suffered by you as a result of an act or omission by an authorised provider. 30. Assignment You must not assign any rights or benefits under this Contract unless you have obtained our prior written consent. We may assign or transfer any rights or benefits under this Contract at any time without notice to you but in doing so will procure that the assignee agrees to comply with the obligations of the STARplex under this Contract. 31. Intellectual Property This Contract does not give you any intellectual property rights in the STARplex, or in our facilities, services or products. 32. Privacy Statement and Acknowledgement During the process of entering into this Contract with you and during the term of this Contract we will obtain access to certain types of your personal information, such as information relating to your health and financial position. We will only use and the Direct Debit Service Provider will only use, disclose or deal with such information in accordance with our Privacy Statement. A full copy of our Privacy Statement is shown on our website. As a member, if you require rehabilitation services, your details may be provided to a third party, for some, but not limited to the following reasons: Example A You are a STARmember i You play football at your local Football Club i

33. Governing Law This Contract is governed by the law of South Australia. We and you agree to submit to the non-exclusive jurisdiction of the courts of South Australia and the Federal Court of Australia. 34. Variation We may, subject to your rights in clause 7, alter this Contract or the Rules at any time upon 30 days written notice. All use of our STARplex, the STARplex Premises and our facilities, Services and products after the date specified in such notice will be subject to this Contract or Rules as altered. If you continue to use the STARplex and its facilities, Services and products after the date these alterations become effective or otherwise demonstrate by your conduct that you agree to this Contract or Rules as altered, you will be deemed to have agreed to the alterations. 35. Your Obligations You acknowledge that the Consumer Credit Code does not apply to this Contract. If, at any time: a) you believe that you may not or may be unable to perform or comply with your obligations under this Contract; b) you are unable to pay your Membership Fees, including any instalment of Membership Fees, as they fall due for payment;
c) a cheque received from you is dishonoured; d) you are or become bankrupt; or e) your Membership Fees are overdue and are not paid in accordance with this Contract in circumstances where we have not breached our obligations under this Contract, you agree that: i. you will immediately notify us that one or more of the above notifiable events has occurred and you will keep us notified on a monthly basis until such notifiable event no longer exists; ii. we have no obligation and will cease to allow you to use any of our Services or products available to you under your membership while a notifiable event exists; iii. we may terminate this Contract by written notice to you if your failure to carry out any obligation under this Contract is capable of remedy and you do not remedy the failure within a reasonable time of us giving you written notice requiring the failure to be remedied; iv. we may terminate this Contract by written notice to you if the notifiable event is your bankruptcy; v. we may request payment in advance for the remainder of the term of your membership; and vi. we have no obligation to respond to any offer you make to extend or renew your membership while a notifiable event exists. 36. Unexpected Events We are not liable for any failure to provide the Services under this Contract if that failure or delay is due to anything beyond our reasonable control. If that failure or delay exceeds 30 days, either you or we may terminate this Contract with immediate effect by giving written notice to the other. 37. Severability If any part of any term of this Contract is or becomes illegal, void or unenforceable that part is severed and this does not invalidate the rest of this Contract. 38. Minors-Under 18 years old a) As a Responsible Person I give my permission for the participant to take part in STARplex activities. I agree to delegate my authority to supervising teachers/coaches and instructors. Supervising teachers/coaches and instructors may take action they deem necessary to ensure the safety, wellbeing and successful conduct of the students, as a group and individually.
b) Fitness Centre Members between the ages of 10 and 13 must be directly supervised by a full fee-paying parent or guardian who is over the age of 18. It is the parent or guardian’s responsibility to ensure the student is practising safe gym activities, and abiding by the STARplex rules located in this handbook. 39. Hewitson Theatre Terms and Conditions a) Some ticketed shows are sold by STARplex as an agent for and on behalf of the Production Company or group, their management and/or promoter (‘the seller’) responsible for the show or performance for which it is sold. All complaints or claims are the responsibility of the seller and not STARplex in this instance. Further conditions of entry to these shows (external promoter) may apply – please check with promoter and/or agent responsible for the show. b) All tickets purchased to any show will either be emailed to the purchaser (if booked on TryBooking.com) or kept at STARplex Reception for collection (if booked over the phone) anytime up until and including, the show or event day. Tickets will not be posted. c) Hewitson Theatre STARplex collects your individual information in case of an event cancellation or change, and also to include you on our newsletter database (bi-monthly e-news) - you may opt out of these at any time. If you fail to supply sufficient and appropriate contact information, STARplex is not responsible for failure to contact you. d) Proof of concession entitlement will be required at time of counter sales and on entry to Hewitson Theatre STARplex. STARplex has the right to evict a ticket holder if they can’t provide proof of their concession entitlement. e) STARplex has the right to evict a ticket holder if he or she refuses to surrender any prohibited object or article that is not permitted to be brought into STARplex; including but not limited to photographic or recording equipment; food or alcohol, that is not permitted to be brought into or used in that venue; or any item that could be considered a weapon, a flammable substance, or an open flame. f) If the ticket holder is behaving in a manner which may cause property damage or threatens the safety of performers, other ticket holders or that reasonably interferes with other ticket holder’s enjoyment of the performance, or if a ticket holder refuses to remain in the area designated on their ticket, he or she may be evicted from STARplex. g) No refunds or exchanges will be available except as provided in the seller’s conditions (these are available on request). The seller is not required to give a refund where a ticket holder
is unable or chooses not to attend. Refunds are at the discretion of the seller. If a refund is available, STARplex will only provide this in person at STARplex Reception. If a refund is available due to a cancellation for which there is no rescheduled date, it will then only be made if the ticket holder surrenders the valid ticket(s) to STARplex within 28 days of the cancellation of the show. h) All prices are subject to change without prior notice. i) Lost tickets: STARplex reserves the right not to replace tickets where seating is not allocated (general admission). When allocated (reserved) seating tickets are lost or stolen the customer must be able to produce proof of their original purchase. Replacement of lost tickets is at the discretion of the seller, and promoters of the event in question. j) It is a condition of entry to performances that a search of person or possessions may be required at the time of entry to the Hewitson Theatre. If concerned, please consult Hewitson Theatre STARplex Management. k) Ticket holders attending the event do so at their own risk and absolve the Hewitson Theatre STARplex of any public liability arising from their attendance. l) By purchasing tickets to and attending an event at the Hewitson Theatre STARplex, you agree to accept and adhere to the terms and conditions of the venue and the organisation, management and/or promoter (‘the seller’). m)Beware: If you obtain a counterfeit, forged or stolen ticket you may be liable to be prosecuted. 40. Declaration, Waiver and Indemnity By signing the Membership Application form you agree to all Declaration, Waiver and Indemnity information. In consideration of accepting this membership application and allowing me to participate in a STARplex Program (Program), I the undersigned (for myself, my heirs, executors and administrators) agree with STARplex and each Program Sponsor* that: a) I waive, release and discharge Trinity College Gawler Inc trading as STARplex and Program Sponsors including but not limited to Swimming SA, Basketball SA, Gymnastics SA, Recreation SA, Fitness Australia, Central Districts Basketball Club Inc., STARplex swim Club Inc. and Futsal as Program Sponsors and each of their respective officers, employees, contractors, volunteers or agents involved in the program from all claims or causes of action I may have (including for negligence) arising from any injury, loss or damage of any kind suffered by me including personal injury, illness or death and/or loss or damage to any property (in so far as this does not breach the provisions of the relevant Australian

Consumer Law) arising either directly or indirectly out of my attendance at or participation in the Program except to the extent that an act or omission of STARplex or a Program Sponsor contributed to the injury, loss or damage. b) I indemnify and will keep indemnified STARplex and each Program Sponsor against all costs, losses or damages arising from or in relation to my attendance at or participation in the Program. c) I declare that I am physically fit, have disclosed to STARplex any underlying or pre-existing health issues and have trained sufficiently to participate in and undertake the Program. d) I agree to obey and accept the Program rules** and instructions from Program staff (whether announced or otherwise made available).

e)
I agree that should the Program be cancelled or if I do not participate in the Program for any reason, my enrolment fee (payable pursuant to the STARplex Membership Application form or Update form) or membership application fee (payable pursuant to the Membership Application form or Update form) will not be refunded and no liability will be attached to STARplex or the Program Sponsors in relation to these fees. Any ongoing fees payable pursuant to STARplex Membership Application form or Update form will be subject to the provisions of those forms.
f)
I consent to receive and agree to pay for any medical treatment (including transport by ambulance) which is considered in the reasonable opinion of the Program staff to be advisable, before, during or after the Program.
g) I understand that the Program enrolment or membership may include the cost of affiliation with relevant Program Sponsors*. h) I attend and participate in the Program exclusively at my own risk and at all times I have the option of not participating in or withdrawing from the Program at any time. i)
I hereby acknowledge that I have read, understood and accept these terms and conditions and agree to be bound by them in relation to my attendance at and participation in the Program.
Waiver and Indemnity in Respect of Minors: For children under the age of 3 and enrolees under the age of 18 years on the day of enrolment or membership application, this section must be agreed to and this is represented by the ‘Membership Application’ being signed by the parent or guardian of the applicant.
I confirm that the Minor has my consent to participate in the Program. In consideration of accepting the Minor’s application and allowing the Minor to participate in the Program I hereby agree (for myself, my heirs, executors and administrators) with STARplex and each of the Program Sponsors: a) to give the same waiver, release, discharge and indemnity as set out in clauses 1 and 2 above in respect of the Minor; and b)
(in addition to clauses 1 and 2 above) that I have read, understood and accept the terms and conditions set out in clauses 3 to 9 above and agree to be bound by them in relation to the Minor’s attendance and participation in the Program.
Definitions *Program Sponsor A Program Sponsor is an organisation which assists in the operation, development or promotion of a STARplex Program and includes State and Regional sporting organisations and associations and includes but is not limited to Swimming SA, Basketball SA, Gymnastics SA, Recreation SA, Fitness Australia, Central Districts Basketball Club Inc., STARplex swim Club Inc. and Futsal. **Program Rules Program Rules are the rules and requirements set by STARplex for the safe and proper participation in STARplex Programs. They may be amended from time to time. They can be viewed in STARplex Program material handed out to participants by STARplex Program staff or as displayed in STARplex. They also are available at www.starplex.com.au Privacy Statement: STARplex as a not for profit organisation offers this Program to benefit the health and wellbeing of the community. STARplex collects personal information from all enrolees and membership applicants (including information on the STARplex enrolment or membership application form) for the purpose of providing the Program and for reasonably incidental purposes. You should be aware that STARplex has agreed to provide this information to the relevant Program Sponsors as a condition of your entry into the Program. STARplex makes no other disclosure of enrolee’s or membership applicant’s personal information. If you do not provide all the information requested, STARplex is not obliged to accept your enrolment application or membership application and may not register you to participate in the Program. You may obtain access to your personal information by contacting STARplex via the details appearing on the Membership Application Form.
