NUEVAS MEDIDAS PARA LOS ERTES NEW MEASURES IN PLACE FOR ERTE Después de varias semanas de negociaciones entre el Gobierno y los agentes sociales, se ha aprobado el Real Decreto-ley 24/2020 de 26 de junio, de medidas sociales de reactivación de empleo y protección del trabajo autónomo y de competitividad del sector industrial.
After several weeks of negotiations between the Government and unions, the Government has passed the Royal Decree-Law 24/2020 of 26 June on social measures to stimulate employment and protect self-employed individuals and the competitiveness of the industrial sector.
Con el nuevo Real Decreto-ley, tanto las medidas establecidas por los expedientes de regulación temporal de empleo por fuerza mayor, como los de causas económicas, técnicas, organizativas y productivas, quedan prorrogados hasta el próximo 30 de septiembre de 2020, así como las medidas de protección por desempleo.
The new Royal Decree-Law prolongs the measures adopted by the temporary employment regulation procedures due to force majeure, as well as those due to economic, technical, organisational and productive causes until 30 September 2020, as well as the unemployment protection measures.
Las mayores novedades se introducen a los procedimientos de suspensión y reducción de jornada por causas económicas, técnicas, organizativas y de producción, destacando la exoneración del abono de la aportación empresarial a la cotización a la Seguridad Social y por conceptos de recaudación conjunta que, con anterioridad, solo eran aplicables a los expedientes de fuerza mayor.
The main new developments concern the procedures involving suspension and reduction of the working day due to economic, technical, organisational and productive reasons. In particular, companies will be exempt from paying the company contribution to social security and for joint collection which previously only applied to cases of force majeure.
Además, la tramitación de estos expedientes podrá iniciarse mientras esté vigente un ERTE por fuerza mayor, y cuando se inicien tras la finalización de un expediente temporal de regulación de empleo basado en la causa prevista en el artículo 22 del RDL 8/2020 de 17 de marzo, aquel se retrotraerá a la fecha de finalización de este.
Additionally, the procedure may be initiated while an ERTE due to force majeure is in place. When it is initiated after the termination of an ERTE based on the provisions of article 22 of the RDL 8/2020 of 17 March, the date of effect will be backdated to the date of termination of the previous ERTE.

Las empresas que, a partir del 1 de julio, vieran impedido el desarrollo de su actividad por la adopción de nuevas restricciones o medidas de contención, tendrán una exoneración del 80% las empresas de menos de 50 trabajadores, y del 60 % las de más de 50 trabajadores, hasta el 30 de septiembre.
Companies which, as of 1 July are prevented from carrying out their activities, due to the implementation of new restrictions or containment measures, will have an 80% exemption for companies with less than 50 employees, and 60% for those with more than 50 employees, until 30 September.
