VILLAGE OF ABERDEEN ORDINANCE #2019-05 AN ORDINANCE REQUIRING LANDLORDS TO PAY FOR ALL UTILITIES OWED TO THE VILLAGE OF ABERDEEN BEFORE RENTING PROPERTY TO A TENANT & DECLARING THE SAME AN EMERGENCY WHEREAS, the Council for the Village of Aberdeen has determined that it is in the best interest of the community and for reasons of safety and welfare of its residents that landlords be required to pay all utilities for their property. NOW THEREFORE, BE IT ORDAINED by the Council of the Village of Aberdeen, Brown County, Ohio, three-fourths or more of all members thereof concurring, that: Section 1. Each owner of rental property shall ensure that for each rental property all utilities furnished by the Village of Aberdeen or Brown County Rural Water Association or any other fees owed to the Village of Aberdeen or Brown County Rural Water Association for that property are paid in full before renting the property to a tenant. Section 2. Each owner of rental property shall not allow renters or tenants to remain in their properties once utilities have been shut off. Section 3. Rental property is defined as property from which the owner receives payment from the occupants or tenants. Section 4: Each separate violation of this ordinance shall be considered a minor misdemeanor and punishable by a fine of up to $150.00. Each day fees are owed to the Village of Aberdeen and a tenant remains in the property will be deemed a separate offense. Section 5: That this ordinance is hereby declared an emergency to be found in the best interest of the residents of the Village of Aberdeen, Ohio.
