RESOLUTION: 2019-84 RESOLUTION OF BROWN COUNTY HEALTH DEPARTMENT POLICY ESTABLISHING A MINIMUM IN SITU SOIL THICKNESS WITHIN THE VERTICAL SEPARATION DISTANCE OF GREATER THAN ZERO AND LESS THAN EIGHT INCHES WHERE THE SEASONAL WATER TABLE IS PRESENT FOR PRETREATED EFFLUENT (<1,000 CFU/100ML). Whereas, the Board of Health has primary authority to enforce the provisions of section 3701.29 of the Administrative Code regarding the required minimum in situ soil within the vertical separation distance greater than zero inches and less than six inches where the seasonal water table is present and the sewage effluent is pretreated to less than one thousand fecal coliform CFU per one hundred milliliters; and Whereas, section 3701.29.15 (H) of the Administrative Code allows for the Board of Health to establish the required minimum vertical separation distance of greater than zero inches and less than six inches, and the required minimum in situ soil thickness within the vertical separation distance of greater than zero inches and less than six inches where the seasonal water table is present and the sewage effluent is pretreated to less than one thousand fecal coliform CFU per one hundred milliliters; and Whereas, the Board of Health specifically finds that this Policy is necessary for the protection of the health of the public; and Whereas, the Health Commissioner is the executive officer of the Board of Health and is authorized and required to carry out all orders of the Board, including the enforcement of all local regulations and policies adopted by the Board. Now Therefore, be it resolved by the Board of Health of the Brown County Health Department, State of Ohio, that: the Board of Health establishes a minimum in situ soil thickness within the vertical separation distance of greater than zero and less than eight inches where the seasonal water table is present for pretreated effluent (<1,000 CFU/100ml).
