and it was obvious that she was deeply affected by the young womans death. Sherry was the first one at the scene after receiving the call. “This is a really nice family,” Neu said. “Although I did not know the family before this, I have learned to love and appreciate what they are going though. My own daughter once played softball with Brittany. But the thing that touches me the most is that the Dodson’s have raised their family just like I raised my family, they are close knit, so I feel their pain and their loss. I was so glad to see such a great turnout for the vigil.” Following a prayer by Mary Dodson, a candle was lit which lifted a ‘wish balloon’ slowly into the air as everyone at the vigil looked on holding a small candle.
The crowd was silent as they watched the breeze slowly carry the wish balloon higher and higher and eventually out of sight. As the balloon drifted away, one man in the crowd began singing ‘Amazing Grace’ in a shaky voice as others joined in. At the end, Mary Dodson looked over the crowd and told everyone to love each other and their families because there is no guarantee each day that you will see them again. Brittany Stykes, who was 17 weeks pregnant at the time of her death, will be remembered in Brown County as the investigation of her murder continues. Brittany’s husband, Shane and their daughter Aubree were not in attendance of the vigil.
considered whether to allow an appeal of the case. Hawkins wrote in July that Kessler made two errors in his ruling. First, “The trial court erred by failing to determine that Coroner’s actions of taking personal effects from a home and giving them to (a) neighbor, probating an unauthenticated will, and posting a decedent’s (Adamson’s) social security number on her personal website constitute misconduct and grounds for removal.” Hawkins pointed out that the coroner was exercising power not granted to her by law. “As Coroner, Defendant/Appellee does not have the power or authority to give a deceased’s firearms and money to a neighbor. Even so, the Coroner’s deputy, acting as an agent of the Coroner thus making the Coroner responsible for her actions, took Roy Johnston’s firearms and money from his home and did exactly that. In doing so, the Coroner effectively committed a burglary...The Coroner testified that she knew Mr. Johnston did not die from a gunshot wound, yet she still took all of the firearms in his house. This is a burglary. The Coroner had no more right to take
his firearms than she had to take his microwave. During her testimony, she never once indicated that this was a mistake.” The second error Hawkins is claiming that Kessler made was “The trial court made a mistake of law by failing to determine that the Coroner’s repeated refusal to deliver firearms to law enforcement constitutes willful misconduct and is grounds for removal.” Eagle pointed out that Kessler found that “Plaintiffs have failed to prove by clear and convincing evidence that Coroner Varnau has committed violations sufficient to warrant removal” and that any failures by her “do not sufficiently make out clear and convincing evidence of gross neglect.” Eagle also pointed out a procedural argument, writing that state law requires that a removal complaint against an official must be signed by not less than 15 percent of those who cast a vote in the last gubernatorial election. In this case, that number was 2000 signatures. Hawkins gathered approximately 2300 signatures, but turned them in on attached petitions, rather than attaching the signatures to the complaint itself.
Brittany Stykes death marked at ceremony it, my husband doesn’t understand it, no one understands why my little girl was killed.” She continued, “We have no answers, yet we know there are people out there who do have answers, and they know what happened and I pray that some day we will have answers too, Aubree deserves answers.” Nearly all the members of the Russellville Fire and EMS Departments were in attendance of the candlelight vigil. They were the first on the scene a year ago when Brittany’s body was found. The EVAC helicopter pilot who transported Brittany and her daughter also attended the event arriving by helicopter. Sherry Neu, president of Russellville EMS, placed flowers at Brittany’s marker

son in court, said “We feel that the coroner’s conduct at Zach Adamson’s death scene and at other death scenes in Brown County was so outrageous that it warrants her removal from public office. This is an important issue in our community and we are so grateful to the thousands of Brown County residents who made it possible to file this case in the first place. Know that we will continue this fight. We are not backing down.” Varnau attorney Thomas Eagle said that he had not seen the decision of the court to hear the case and therefore could not make any comment. Manning said a ruling could be expected from the court in five to seven months. Hawkins will have thirty days to make her argument, Eagle will have thirty days to respond and Hawkins will have ten days to reply to Eagle’s response. At that point, oral arguments will be scheduled and the court will rule within sixty days of hearing those oral arguments. Both sides laid out some of their arguments in memorandums to the court as it
