RESOLUTION 2016-64 The Board of Trustees of Miami Township, Clermont County, Ohio met in regular session at the Miami Township Civic Building on September 20, 2016 with the following members present: Karl Schultz, Ken Tracy and Mary Makley Wolff. MR. TRACY made a motion to adopt the following Resolution: DESIGNATING AUTHORITY REGARDING THE DECLARATION OF A SNOW EMERGENCY AUTHORIZATION IN THE TOWNSHIP AND DISPENSING WITH A SECOND READING AND DECLARING AN EMERGENCY WHEREAS, Ohio Revised Code Section 505.17(A) provides the Board of Trustees of Miami Township (the “Board”) with the authority to make regulations and orders as are necessary to control all vehicle parking within the Township; and WHEREAS, Ohio Revised Code Section 505.17(A) provides the Board with the authority to adopt a general snow-emergency authorization, allowing the President of the Board, or some other person designated herein, to issue an order declaring a snow emergency, and limiting or prohibiting parking on any Township street or road during the snow emergency; and WHEREAS, Ohio Revised Code Section 505.17(A) provides that any snow emergency authorization shall specify the weather conditions under which a snow emergency may be declared; and WHEREAS, Ohio Revised Code Section 505.17(E) provides that any person who violates a regulation or order adopted in accordance with R.C. 505.17(A) is guilty of a minor misdemeanor; and WHEREAS, Ohio Revised Code Section505.17(D) provides the Board, or its designated agent, with the authority to order into storage any vehicle parking in violation of a regulation or order adopted in accordance with R.C. 505.17(A); and WHEREAS, the Board has determined that the decision to declare a snow emergency authorization in the Township is in the best interest of public safety and welfare and that it often needs to be made with little time to convene a meeting of the Board and is based on current and evolving weather conditions at that time which can rapidly change from forecasted projections; NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of Miami Township, Clermont County, Ohio by authority of Section 505.17 of the Ohio Revised Code, as follows: SECTION 1: The Board hereby authorizes the President of the Board to issue an order declaring a snow emergency and limiting or prohibiting parking on any Township street or road. SECTION 2: The Board further authorizes the Township Administrator, with the advice and consent of the Service Director, Police Chief and Fire Chief to declare a snow emergency in the Township when, the President of the Board is unavailable, or in their opinion, road and weather conditions warrant such a declaration being made to better allow for snow removal to occur in the Township. SECTION 3: This Resolution shall remain in effect from September 20, 2016 forward. SECTION 4: The weather conditions under which a snow emergency may be declared are as follows: Snow Emergency Classifications Level 1: Roadways are hazardous with blowing and drifting snow. Roads may also be icy. Motorists are urged to drive very cautiously. Level 2: Roadways are hazardous with blowing and drifting snow. Roads may also be very ice. Only those who feel it is necessary to drive should be out on the roads. Contact your employer to see if you should report to work. Motorists should use extreme caution. Level 3: All roadways are closed to non-emergency personnel. No one should be driving during these conditions unless it is absolutely necessary to travel or a personal emergency exists. All employees should contact their employer to see if they should report to work. Those traveling on the roads may subject themselves to arrest. SECTION 5: That parking shall be regulated on all Township streets or roads during a snow emergency; SECTION 6: Parking is prohibited on all Township roads and road right-of-ways during the snow level 1 emergency or greater. SECTION 7: Any order issued in accordance with this authorization shall become effective two (2) hours after an announcement is made to the local new media; and, SECTION 8: The fines levied and collected under this resolution shall be paid into the Township general revenue fund; and, SECTION 9: The Board hereby designates the Township Department Director to be its agent for the purposes of ordering into storage any vehicle parked in violation of this resolution; and, SECTION 10: The Township Fiscal Officer is hereby directed to publish the following: In accordance with Miami Township Board of Trustees Resolution 2015-60 adopted October 20, 2015, the President of the Board of Trustees, or their de-

signee, is authorized to issue an order declaring a snow emergency, and limiting or prohibiting parking on any township street or highway where permanent signs giving notice are properly posted.
