A statement from the Superintendent Pharmacist or Responsible Pharmacist is often provided. If a pharmacist is summonsed to attend the inquest, they must usually do so; there was a 2019 case of a care home employee who was sentenced to imprisonment for not attending an inquest.

The inquest is an inquisitorial process looking into four key questions. These are “who”, “when”, “where” and “how”. The coroner’s role is to fact find and they will not usually use judgemental language. Their role is not to make findings on criminal or civil liability.

It has been a busy week. Pharmacy clients have sought assistance from us variously on an interim order application at the GPhC, an appeal to NHS Resolution against the refusal of a market entry application and involvement in an inquest. Any one of the three gives rise to legal points that may be of interest to Pharmacy Show newsletter readers; possibly the least well known is what a pharmacist needs to think about if involved in an inquest. With that in mind, here is a summary of some key issues:-

The final point is not a legal point at all. An inquest is, of course, about the death of a patient who you and your staff may know well. The grieving family will usually be present and involved. All communication should be sensitive to the situation, and the inquest should not be an adversarial Weprocess.are happy to help if you become involved in an inquest, and you should also pick up the phone to your indemnity provider who may offer assistance.

The scope of the inquest

There is an obligation to disclose all relevant documents to the coroner. For pharmacists, the PMR will obviously be disclosable, but also think about ancillary documents such as SOPs, controlled drug registers and other material.

The coroner has powers to make directions for prevention of future deaths (PFD). If a pharmacy’s investigation reveals something that requires to be changed, it is advisable to take urgent steps to do that and tell the coroner about what has been done. If a PFD direction is made this will be a publicly available document.
