Lexus of North Miami salutes Pro Bowl and Super Bowl Host Committee Ambassadors Super networking reception teams Aventura Marketing Council with North Dade Bar Association BY BARI AUERBACH
Craig and Martine Zinn of the Craig Zinn Automotive Group recently teamed up with the Aventura Marketing Council and North Dade Bar Association to salute Pro Bowl and Super Bowl Host Committee Ambassadors during a super networking reception hosted by Lexus of North Miami. The event "bowled over" 'a huge turnout of Host Committee volunteers, business and community leaders who enjoyed fabulous hors 'd'oeuvres served by The Grill on the Alley and had the opportunity to preview the allnew Lexus GX 460 plus sign up for test drives. Everyone was also invited to experience "The Lexus Lifestyle" highlighted by luxurious amenities and highly personalized service. Just as Pro Bowl and Super Bowl Host Committee volunteers went all out to welcome fans coming from all over the world to South Florida - Lexus of North Miami extends championship hospitality year-round. Leaders from UBS, FPL, Mount Sinai Medical Center and Coconut Grove Bank were especially impressed by the five-level, one million square foot Lexus of North Miami dealership one of the largest in the world with an inventory of up to 2,000 vehicles; an onsite service and parts facility with 117 service bays; and the unprecedented Club Lexus Lifestyle and Fitness Center. Colleagues from the Dental Care Group, Bnai Zion Foundation, the law firm of Eisinger, Brown, Lewis, Frankel, Chaiet & Krut and Wells Fargo Advisors agreed they had never seen a dealership where you could work out in a fitness center equipped with state-of-the-art cardio machines while waiting for your Lexus to be serviced. Busy professionals from Aventura Optical Shoppe, Florida International
University, Aventura Turnberry Jewish Center, Jet Printing and AFLAC cheered for the business center offering free WiFi, printers and individual work stations - while friends from MiamiDade College, Pre-Paid Legal Services and attorneys Barry Snyder and Ivan Schertzer relaxed in the meditation room before browsing in the onsite boutique displaying designer sportswear and accessories. Associates from Security Camera World, The Credit Council, Sawgrass Title & Escrow and the Aventura City of Excellence School marveled that a Lexus dealership with such beautiful cars could also make you look and feel more beautiful at a salon offering manicures, pedicures, haircuts and makeup consultations - and even a teeth whitening station. CPA Peter L. Fishel along with teams from ASAP Services, Bank Executive Chef Luis Padilla, The Grill on the Alley; Martine Zinn; Lexus North Miami General Manager Steve Friend; Leumi USA, Newport Beachside Hotel Craig Zinn; Russel Lazega and J.D. Underwood, North Dade Bar Association / Law Office of Russel Lazega & Resort, Plaza Health Network and American Friends of Magen David Adom were pleasantly surprised to see Lexus of North Miami also caters to families with a children's play area, library and cafĂŠ serving coffee and refreshments. Aventura Hospital expands cardiovascular and stroke care services with new Endovascular Lab and Structural Heart Intervention Program As part of Aventura Hospital's continued commitment to improving the quality of care for our stroke patients and vascular disease patients Aventura Hospital recently opened a new Endovascular Lab. Located within the Cardiac and Vascular Catheterization Laboratory, this new specialized room allows physicians to fight lifethreatening vascular disease using state-of-the-art treatment for non-cardiac vascular conditions such as clogged, the ceremonial blue ribbon (L-R) Aventura Hospital's Dr. Charles Shenker; Aventura collapsed or compressed blood Cutting Comm. Bob Diamond; Heather J. Rohan, CEO; Sunny Isles Beach Comm. Gerry vessels. Goodman; Dr. Floyd Osterman, Interventional Radiology; Rick Kennedy, COO; Leonard Chairman, Board of Trustees; Dr. Robert Cubeddu, Medical Director of Structural Endovascular Intervention Brenner, and Adult Congenital Heart Disease; Annette Watt, Director of Radiology Services is a minimally invasive procedure in which the physician inserts a catheter through the blood vessels and, using advanced imaging technology, guides the catheter through the blood vessel to the exact necessary location in order to clean and clear out the blocked vessel using stent implantation, balloon angioplasty, atherectomy, endografting, laser angioplasty, thrombolysis, and other specialized devises. The new endovascular lab is the fifth specialty room within the Cardiac and Vascular Catheterization Lab. Each room is adaptable for a variety of cases and designed like an operating room, providing the option to combine endovascular or cardiac intervention procedures together with open heart and vascular surgeries, when necessary. The increased capacity within the cath lab also allows for more patients to be treated at once. In addition to building a new Endovascular Lab, Aventura Hospital announces their new "Structural and Adult Congenital Heart Program". Spearheaded by Dr. Robert J. Cubeddu, expert interventionalist, the program uses minimally invasive catheter techniques to diagnose and treat a number of important heart conditions to avoid patients the need for open heart surgery. The procedure involves advancing small catheters through the major blood vessels, from the leg groin to the heart, after making a small 1cm incision with local anesthesia. This innovative treatment provides new options for patients who may otherwise be considered inoperable or too high-risk for conventional surgery. Additionally, many other heart conditions may now be treated with this novel transcatheter technology, including congenital heart defects and cardiac stroke-related problems. Taking steps toward a cure: National Psoriasis Foundation Walk to Cure Psoriasis Miami sportscaster and former Miami Dolphins tight end Joe Rose will emcee the annual National Psoriasis Foundation Walk to Cure Psoriasis on Sunday, March 7th at the Aventura Mall. Hosted by the Aventura Mall for four consecutive years, the walk begins at 8 a.m. and features a noncompetitive, family-friendly 1K or 5K route. The event raises money to help find a cure for psoriasis, a chronic, debilitating autoimmune disease that causes the skin to crack, itch and bleed. Up to 30 percent of people with psoriasis also develop psoriatic arthritis, which causes painful swelling and inflammation of the joints. Additionally, people with psoriasis are at an increased risk for other serious medical conditions such as heart disease, diabetes and obesity. As many as 7.5 million Americans live with psoriasis, the most prevalent autoimmune disease in the country. The National Psoriasis Foundation estimates that 417,000 adults in Florida live with psoriatic disease. "We are excited to kick off the 2010 walk season in Miami," said Nancy Henschel, Miami walk committee chair and longtime Aventura resident. "Our goal this year is to register 1,500 walkers and raise $202,000. We encourage the Miami community to join a walk team and help

us meet our goal." Funds from the walk will help support the National Psoriasis Victor Henschel BioBank, the world's largest collection of psoriasis and psoriatic arthritis genetic samples for use in research. Walk to Cure Psoriasis began in 2007 with walks in six U.S cities and an online "virtual" walk. Foundation-sponsored walks are now held in 19 cities across the country. To date, the program has raised more than $2 million for vital research and programs. The Miami walk will feature live music, food, "goody bags," vendor booths and T-shirts for participants. Aventura Heart Center: Prediction, Detection and Prevention A fifty year old man is walking down the street and smoking a cigarette. He is thirty to forty pounds overweight and starting to huff and puff as he goes up an incline. You can predict he is going to have heart disease now or in the near future. Conversation with this gentleman then reveals his father died suddenly in his fifties and his mother unfortunately had a stroke when she retired at age sixty-five. Everyone agrees he is a time bomb for heart trouble, a prediction not difficult to make in this situation. Predicting heart disease is easy if the person is obese, over forty, fatigued, sedentary, and a smoker. Predicting heart disease is more difficult in an avid tennis player or a slim jogger who still has his parents and never smoked a cigarette in his life. Detection in this individual requires bio-markers, blood pressure, and cardiac evaluations of anatomy and physiology. Elevated blood sugar and hemaglobin A1C detect diabetes, a prime risk factor for heart disease. Blood pressure not only is a number but a strong predictor of heart and kidney disease and strokes. C-Reactive Protein, or CR-P, is a simple blood test used to determine the risk of heart disease as well as the prognosis of heart disease. The Lipid Profile defines the cholesterol and the risk associated with high bad cholesterol or low good cholesterol, as well as an abnormal metabolic syndrome with high triglyceride. Stress testing and nuclear imaging techniques, along with echocardiography are used to evaluate
Dr. Robert Rasken and Dr. David Korn, directors, Aventura Heart Center
persons with cardiac risk factors and persons with symptoms suggestive of heart disease. More involved testing involves CT angiography and rapid 64-cut CT scanners, as well as standard cardiac catheterization and angiography, the gold standard of heart disease detection. Prevention is the key to not developing high blood pressure, diabetes, high cholesterol and subsequent heart disease. Diet and exercise along with appropriate body weight are the building blocks of successful prevention. Not all patients can control the risk factors with diet and exercise, so medications are used to lower the cholesterol to acceptable levels. Many anti-hyper-
tensive drugs are used to get the pressure below 130/80 or even to the ideal number of 120/80. Diabetes now has a multitude of different medications to work in combination to get the HgA1C to below 7. Angioplasties and heart surgeries can revascularize a patient suffering from angina or chest discomfort, to help the patient resume a normal life. Sometimes you can look at a person, man or woman, and predict heart trouble in his or her future. Most times patients need to see a cardiologist to detect cardiac risk factors and develop evidenced based prevention strategies to prevent heart attacks. February is Heart Month, a good time to see a cardiologist. Find out where you stand. Dr. David Korn and Dr. Robert Rasken are the directors of Aventura Heart Center. Aventura Heart Center provides the most comprehensive prevention and general cardiovascular services. It is a unique healthcare center offering state-of-the-art nuclear cardiac and stress thallium testing to effectively diagnose heart disease, ultrasound diagnostics and bone density testing in the office. Also offering complete lipid treatment, arrhythmia detection and pacer evaluation. Aventura Heart Center is located in the Mount Sinai Aventura Building (2845 Aventura Blvd. Suite 249). Office hours are Monday through Friday 9 a.m. to 5 p.m. For more information or to make an appointment, call 305-932-6061.

Life in the City BY BARI AUERBACH ‘Going Green’ On the cityofaventura.com website, businesses have posted ways to promote “green living” – but here are some other innovative ways residents can “go green”: * FPL suggests ways to use less electricity at home – but beyond using compact fluorescent light bulbs, if you’re interested in sparking some romance, try lighting candles. Installing dimmers can also help minimize the appearance of tiny lines and wrinkles – saving us all lots of money on cosmetic procedures! * Home Depot representatives explain the advantages of using energy efficient building materials – but odds are they didn’t mention anything about the idea to invest in hurricane shutters and keep them up yearround. This would eliminate the need to expend a lot of energy putting them up and down during unpredictable hurricane seasons – plus with the perpetual “shutter shade” you wouldn’t need to turn the a/c down so low! * Continental Management lists environ-
mentally-aware ways to maintain a building– but just think about how much power could be conserved if everyone expended a lot more energy promoting longevity by taking the stairs instead of the elevator! * Waste Management discusses recycling programs - but here’s a great idea they didn’t mention. Let’s all wait for some really good front page news to be printed and then ask the delivery guy to just keep bringing the same newspaper back every day! * Service America gives a presentation on how to conserve water – but we could all save gallons just by doing little things like taking all our laundry to the dry cleaners and waiting ‘til it rains to get a car wash. Of course, showering less often isn’t really an option – but if you happen to live in an Aventura community with one of those fancy fountains…well, you get the idea!! * Beyond being environmentally conscious, we can also do our part to stimulate the economy by spending a little more green at stores offering great bargains. If you need another good rationale – think about the fact that Aventura has the lowest property tax rate in all of Miami-Dade County…So with the money you’re saving - you can spend more time shopping!

Personal injuries bring clients in need to Robert Dixon BY LYNN CARROLL If you've suffered injuries from an accident and are wondering how to pay the bills, it's a good idea to speak with a personal injury attorney, says Robert Dixon, who has spent his entire career fighting for the rights of the injured. "An attorney may be able to find avenues to build a case that the aver- Robert Dixon age person doesn't know about," he says. The Law Offices of Robert Dixon handle only personal injury cases, which consist mainly of car accidents, slip and falls, and wrongful death cases - and his office is building a solid reputation for success. "Sometimes, legitimate claims may arise out of freak accidents that no one could have anticipated," says Dixon. He cites a case he handled in Palm Beach County where two playful tots slipped unnoticed into the garage. The child who resided in the home switched on a treadmill.
"My client got his hand stuck in the treadmill and suffered second- and third-degree burns," Dixon says. "He spent nine days in a burn unit. I was able to find insurance coverage, and we ended up with a six-figure settlement." Born in England, Dixon immigrated to Florida at the age of 18. After graduating from the University of Florida's Levin College of Law, he worked in a West Palm Beach firm before opening his own practice three years ago. The Law Offices of Robert Dixon provides a free case evaluation and consultation to injured accident victims throughout the State of Florida and is committed to ensuring that insurance companies treat his clients fairly. There's no fee until the case is settled. The Law Offices of Robert Dixon are located at 20801 Biscayne Blvd., Suite 403, Aventura. "There are other yacht services," says President Charles Ernst, "but they typically only specialize in only a few types of services for specific yachts. We can hook you up with everything from private chefs to towing services." Yacht owners with vessels docked in South Florida can rely on Dockside when storms threaten. "Hurricane preparation is one of first programs we put together," adds Charles. "We have a trained, professional staff ready to go at a moment's notice. We will tie down your vessel or move it to safe moorings, and also find interim housing in a safe location for the captain and crew if necessary." Dockside's member database holds boat locations and contact information, Doreen says, so no matter where the owner may be when a storm hits, "we can get in touch and find out what they want us to do." Charles says Dockside will also serve non-members in any emergency situations, but warns that space is at a premium and "they will need to contact us early." Sweetheart mValentine’s Day is named after Valentinus who was imprisoned in the third century for being a Christian. While he was in jail he fell in love with the jailer’s daughter. Just before his execution, he wrote her a note that expressed his love for her and he signed it, “From your Valentine.” So began the tradition that is still celebrated today. Valentine’s Day is a day designated to voice the feelings you have in your heart. It is a day to honor those you care about. It is also a day celebrating romantic love in its highest form. Cards that express sentimental feelings and presents like candy and chocolate hearts and flowers are exchanged. The earliest valentine still in existence was handwritten by a Frenchman Charles Duke of Orleans in 1415 He was captured at the battle of Agincourt and imprisoned in the Tower of London. He sent a card of Love on Feb 14 to his anxiously awaiting wife. His valentine can still be viewed at the British Museum in London. A Sweetheart is a term of endearment used to address and describe a loved one; a
MASTERS OF ORGANIZATION girlfriend, boyfriend or friend. It implies that the person is crazy about you, infatuated with you, devoted to you, fond of you, holds you dear and is enamored and in love with you. Regardless of your romantic status, you can be a Sweetheart to everyone. Unless you are a Grinch with a small heart, you can at least be genial. You can be warm and friendly. You can be thoughtful, gentle and considerate towards others. Do not expect anything in return because no matter how much you love others they cannot always love you in return. They do not know how. All you have to do when someone expresses love for you is to accept their love. You do not have to feel guilty if you cannot return their love. But, no matter what, do not scoff at their feelings. Regardless of whether or not your love is returned, you can still be nice and warm and amiable every day. You can be charming, endearing and loving. You can have a sweet heart and you can be a Sweetheart. When you love others you are full of inner harmony and joy. The ultimate experience in life is to love and be loved. “All the world loves a lover” is a truism. Patricia Frank is a Licensed Psychotherapist. She can be reached at 305788-4864, 212-308-0309.

VIEWPOINT Record Bank Profits and the The Kids are all Right American Dream Foreclosed BY JENNIFER DOAK
BY MIKE PROKOSCH JP Morgan Chase launched the 2010 Wall Street Bonus Sweepstakes last month. The bank is still losing money on consumer services, but wellheeled investors and financial traders more than made up the difference. The bank announced $11.7 billion in profits and $26.9 billion in compensation, including bonuses that will run in the multimillions for top executives. Then Goldman Sachs reported record profits of $13.4 billion. It's set to dole out a staggering $16.2 billion in compensation and bonuses, which could provide an average of nearly $500,000 per employee. And Morgan Stanley, even having sustained a loss last year, has set aside $14.4 billion for compensation and bonuses. Then there's Roberto Velasquez, a sobering reminder that the foreclosure crisis is still raging. Velasquez, a general contractor, bought a single-family home in Dedham, Massachusetts six years ago and took out a mortgage that turned out to be a predatory time-bomb. After a few affordable years, his adjustable interest rate ballooned and his payments hit $4,800 a month. He kept up, though, until the Wall Street crash knocked the stuffing out of the construction industry. Then he fell three months behind. Velasquez found jobs and came up with the three months' payments, but the bank wouldn't work with him. His home was foreclosed on in November. A local bank offered to buy the home and sell it back to him for its present market value-the most his bank would get for the house if they sold it at auction. Still no deal. "We did what they asked," Velasquez says, "but they don't want to work with anybody." That kind of arrogance will sink more than Velasquez, his wife, and their two kids. Foreclosures feed on themselves, depressing neighborhood property values and putting ever more people underwater. There were 3.4 million foreclosures in 2009. Experts tell us to expect more this year. Unless the foreclosures stop, the housing market will keep spiraling downward. It will take the building and mortgage industries with it, stalling economic recovery. All of us will be hurting for years
because Washington is refusing to make the banks eat the debt bubble they created. Instead, the bailed-out banks are walking away with record profits and fat bonuses. There's a way to avoid another decade of downturn. United for a Fair Economy's new report, State of the Dream 2010: Drained, outlines key proposals that can stem the massive loss of personal wealth and homes. States and the federal government should put an immediate hold on foreclosures when unemployment causes homeowners to default. Bankruptcy judges must be given the power to cut down mortgages to levels homeowners can afford, as they already can for other types of loans. These reforms would stabilize families and communities, especially communities of color that are seeing hard-earned wealth stripped from them at alarming rates. The government would also push the banks to accept realistic write-downs on the inflated property values their books still reflect, squeeze debt out of the economy, and hasten a recovery. And they might even keep the banks from doing this to us again. President Obama just proposed a "Financial Crisis Responsibility Fee" to be imposed on the Wall Street firms that caused the crash and soaked up most of the relief funds. While this is a good start, the fee is temporary. When it ends, the banks can return to their irresponsible ways. A permanent financial transactions tax would discourage speculative trading in home mortgages and the derivative pyramids that were piled on top of them. Serious financial re-regulation, like that outlined in the State of the Dream report, is also essential. In the end, recovery isn't enough. Banks whose irresponsible behavior led to the meltdown must accept part of the responsibility, or they'll do it again. At the same time, we must aid the hardest-hit communities, where joblessness and foreclosures are still wreaking havoc. That's the only route to a fair recovery and a healthy economy. -Mike Prokosch is a board member with United for a Fair Economy (UFE) and coauthor of UFE's new report, State of the Dream 2010: Drained-Jobless and Foreclosed in Communities of Color. When not volunteering with UFE, Prokosch works at Community Labor United in Boston. www.faireconomy.org

Being a young American today can be discouraging. Things don't look so good for us, even since Bush left office, leaving behind an awful lot of cleaning up for us "Millennials" to do. BusinessWeek dubbed us a "lost generation," because 18 percent of us can't find work. Those who can are paid less than our counterparts were in earlier decades, and many college grads among us are saddled with thousands of dollars in loans. If the Obama administration's proposal to federalize and reduce the student loan burden goes through (a big if), that's a start. But with more than $50,000 in college debt (and that's on the low end), I can confirm it will be a while before I have the cash to buy a home, invest in a retirement fund, or even start a family. Heck, I can barely afford to go home for Christmas. Our predecessors deregulated industry, thoughtfully ensuring that our food and water aren't as safe as they should be. Of course, in 2007, 13.2 million of us under 35 didn't have health care so there's little to be done if we get sick. Since the Baby Boomers and the oldest Generation Xers refused to seriously research alternative energy, we inherited a nasty oil addiction that led politicians to send thousands of my cohorts to fight an unwinnable war in Iraq. Meanwhile, it looks like those in charge are making more than ever, even in these pinched days. They also say we're not really mad, and that we'll go right on taking it like workers have for decades. They'll make a glib reference to Facebook or Twitter before lamenting how nobody today protests like they used to. Then they smugly destroy a few more acres of rain forest.
The derision isn't universal-after all, I'm talking about our parents, professors, and employers. A recent Wall Street Journal article observed that Baby Boomers encouraged us, their children, to negotiate, to achieve, to be conciliatory, and to think of ourselves as winners. But, perhaps unconsciously, the policies they shaped have us poised to lose. So guess what? We aren't taking it anymore. People under 35 are harnessing technology and willpower, just as previous generations did, to achieve amazing things. We're crowdsourcing, not outsourcing. We're creating open-source software and outreach programs to level the digital divide. We organize through social networks and text-message donations. Few of us have seen the movie Network, but we're still raising our virtual window-sashes and yelling to the whole world that we're mad as hell. The best part is that we're taking our upbringing to heart, but not in the way you think. We trend progressive-even the conservatives among us are easygoing when it comes to social issues like gay marriage and the environment. You older folks call us the "trophy generation" because you see us as entitled, but maybe we just want to make sure everybody wins. Millennials are starting to take charge, and we're acting together. This lost generation is finding itself, and when I see what my peers are accomplishing, I start thinking we'll be just fine. --

To convert or not to convert? nation required. So now that we have the facts on the table, what to do? Certainly, the younger you are, the better decision is to convert. Even though you have to pay the tax now, you have so many years of income and growth that will not be subject to any tax down the road. If you are over 59 ? and you plan to use the IRA to live off of, it is a harder decision. But the bottom line, making the conver-
sion, and paying the income tax from your personal assets generates a tremendous long-term income tax and estate tax benefit at any age. Wow, what an opportunity! For those of you who haven’t been reading the latest news on the ROTH IRA’s (ROTH), 2010 brings an exciting tax benefit. Many South Florida residents have never had the opportunity to contribute to a ROTH or make a ROTH conversion due to the income limitations. Up until 2010, anyone with more than $100,000 in annual income was generally excluded from the conversion. Starting in 2010, conversion of a traditional IRA to a ROTH is available at all income levels. Why is this so exciting? Simply put, we now have the opportunity to take our IRA dollars, which down the road will be subject to ordinary income tax, and convert the whole amount including all future earnings to nontaxable. But let’s discuss the basics. Generally a contribution to a traditional IRA is deductible and then when you take it out (after age 59 ?), income tax is paid on the full amount which includes all of the income earned over the years. A ROTH is
different. Contributions to a ROTH are not tax-deductible. However, when distributions are made from the ROTH (after 59 ?), no income tax is paid on the full amount including all of the earnings. So now 2010 ushers in the opportunity to convert. Naturally, since the contribution that went into the traditional IRA was deducted, there is a tax to pay on the conversion. However, there is a choice. The full amount of the tax can be paid in 2010 or an election can be made to pay the tax in 2011 and 2012, ? in each year. This is a significant consideration as many are speculating that the tax rates will increase in the later years. But remember, if you are under 59 ? and you use the IRA funds to pay the tax, you will be subject to the 10% early distribution penalty in addition to the income tax. So ideally, you should pay the income tax from personal funds. The IRS sweetened the conversion opportunity by allowing a conversion back to the traditional IRA for any reason. So if you are speculating that the market is going up or down, you may wish to time the date of the conversion. But the comfort is that regardless of what happens, the reversal of the conversion is a free opportunity with no expla-

Are you properly paying your employees? BY JEFFREY M. GOODZ Are You Covered Under the Fair Labor Standards Act? In 1938, Congress enacted the Fair Labor Standards Act (“FLSA”) to eliminate onerous labor conditions detrimental to the health, efficiency, and well-being of workers. The cornerstones of the FLSA were a requirement that employees be paid a minimum wage, and a prohibition against employees being required to work more than 40 hours in a workweek unless they are paid time and one-half of their regular rate of pay. The law applies to employees directly engaged in commerce or the production of goods for commerce, and employees working for companies grossing $500,000 per year, which are engaged in commerce or in the production of goods for commerce. Over the last ten years, we have seen a proliferation of overtime compensation claims by workers. During 2009, 546 such cases were filed in federal court in Palm Beach, Broward, and Miami-Dade counties alone. While defenses are available, employers often find themselves on the short end of such claims as a result of a number of misconceptions. One of the arguments raised by employers related to coverage under the FLSA is that neither they nor their employees are engaged in commerce or the production of goods for commerce. Commerce, fundamentally, is the conducting of business across state lines, or the handling or production of materials that have traveled or will travel across state lines. While an employer may purchase all of its goods and materials from vendors
within the State of Florida, those same goods and materials have likely traveled across state lines before reaching the employer. Furthermore, most companies and employees do business across state lines through simple things such as long distance phone calls, mail, payment to vendors, and emails to business associates out of state. The foregoing serves as commerce for coverage purposes. An employer not covered by the FLSA due to commerce reasons should be considered the exception rather than the rule. A second defense asserted by employers is that the employer does not have enough employees to be covered by the FLSA. It only takes one employee to be covered by the FLSA if the employee seeking recovery is himself directly engaged in commerce. If the employee at issue is not himself directly engaged in commerce, the employer will still be covered if it has 2 or more other employees who regularly engage in commerce or handle goods or materials that have moved in commerce. To err on the side of caution, or until employment law counsel is consulted, Employers with one or more employees should operate under the assumption that their businesses are in fact governed by the FLSA, and should therefore ensure that their employees are being properly compensated pursuant to the FLSA. Employers currently experiencing wage and hour issues, or any other employment-related issues, however, should not wait or hesitate to consult an employment lawyer. Jeffrey M. Goodz is an employment lawyer with the employment law firm of Remer & Georges-Pierre, PLLC located at Biscayne Centre, 11900 Biscayne Boulevard, Suite 288, North Miami, Florida 33181, (305) 416-5000.

Favorite celebrity workout tips BY BARI AUERBACH You don’t have to be a celebrity to look like one! Here are some favorite workout tips that can help you attain a famously fit physique: Olympic swimmer Dara Torres’ favorite butt exercise: “My behind needs a little extra attention, and I swear by this move,” Torres says. “Prop a small stability ball up against a wall. Lie on your back facing the ball with your butt against it, arms at sides, feet on ball, knees apart. Lift your butt, hold for a beat as your bring knees together and then lower to start. Do three sets of 15 reps.” How to get Michelle Obama’s arms: Celeb trainer Kacy Duke who’s sculpted the physiques of Julianne Moore, Bruce Willis, Denzel Washington and Iman to name a few, says, “The key is to use light weights (3-8 pounds) and keep your reps high (8-15). If you don’t have weights handy, you can fill two plastic or ecofriendly shopping bags with up to four 33.8-ounce bottles of water.” One of Duke’s favorite arm- and shoulder- sculpting moves is the Push, Pull, Kickback: 1. Assume a squat position with your legs bent about 45 degrees. Hold a light dumbbell in each hand, arms bent so the weights are positioned just in front of your chest, palms facing each other. 2. Extend your arms straight out in front of you, pushing the weights forward. 3. Then bend your elbows, squeeze your shoulder blades together, and pull the weights back to either side of your chest. 4. Finally straighten your arms out behind you. Do 3 Sets 8-12 Reps. Kate Hudson and Fergie’s favorite workouts: To prepare for their roles in the movie NINE, Hudson and Fergie included a diverse combination of Pilates, yoga, salsa dancing plus interval cardio and strength training workouts into their fitness regimens. Their routines included 45minute sessions on treadmills, ramping up the incline and walking at a fast pace. For strength, toning and definition, they trained
with weights, adding in body weight squats and lunges to help sculpt legs, hips and glutes. Abs like Jersey Shore’s Mike “The Situation” Sorrentino: To get a six-pack beyond the one that’s in the fridge, Sorrentino avoids sugary snacks and works out 5-6 days a week with weights, incorporating half-hour cardio sessions and exercises that directly target abs every other day. For a “camera ready core” try these movements on a stability ball: While lying on the ball, crunch up holding a dumbbell in one hand - after 1012 reps, switch dumbbell to other hand and repeat (instead of the dumbbell, you can also crunch up while holding a small medicine ball with both hands). Another very effective ab exercise on the stability ball is the “prone knee-up” movement. While lying face down on the ball, place hands on floor in front of you - then bring knees into your chest. Log on for star-studded fitness success: Now you can share the same workout advice as Jennifer Aniston, J.Lo, and dozens more celebs at podfitness.com, which offers “trainer in your ear” programs from more than 75 experts on everything from weight loss to walking.

Toyota takes unusual turn with wide recall

4 YOUR MONEY It’s happening around South Florida and all over the country. Some of the most popular Toyota cars and trucks are being pulled off showroom floors and taken off the market. There have been numerous complaints that some accelerator pedals can get stuck and prevent the vehicle from slowing down. A total of 2.3 million Toyotas — most of them built between 2009 and 2010 — are being recalled. But some earlier models are on the list too. Toyota’s recall includes its most popular vehicles, among them, some Camrys, Tundras and Rav-4s. Here is Toyota’s Official List: 2009-10 RAV4, 2009-10 Corolla, 2009-10 Matrix, 2005-10 Avalon, Certain 2007-10 Camry, 2010 Highlander except hybrid models, 2007-10 Tundra, and 2008-10 Sequoia. In fact, there have been dozens of reports of stuck Toyota accelerator pedals for several
years. The problem has reportedly caused several accidents and deaths. Toyota believes the stuck pedals come from some U.S.-made accelerator assemblies. Local dealers say customers should not check accelerator pedals themselves, but bring them back to their Toyota mechanics as soon as possible. “Customers cannot know on their own if they have a bad pedal or not,” Perez warned. “They need to come into their dealers to have them checked out. That’s what we’re here for, so you can bring your vehicles back to your dealers.” If your accelerator sticks and won’t slow down, shift into neutral, carefully apply your brakes and get to the side of the road as safely as possible. For more information, consumers are urged to contact Toyota at 1-800-331-4331 or the NHTSA hotline at 1-888-327-4236. Here’s a new year’s resolution: ditch your old spending habits and get out of debt. Low interest rates and uncertain financial markets make now an ideal, if not critical, time to review your finances and your financial relationships. Your borrowing and investments should be at the top of your review list. Below are five ideas to help you get a good start for 2010 – not just a new year, but the start of a new decade. 1) Save time with online banking. Using the Internet to interact with your financial institution can help simplify your financial affairs. Top reasons to consider online banking include: conveniently receive and pay your bills online, view your statements, account balances, transaction history and images of your checks. Mobile banking is also a great way to view account balances and transaction history, and with on-demand text message alerts you can receive a text message on your mobile phone with your account balance and last three transactions. 2) Track your expenses. It’s important to keep all of your expenses in order with a service like Great Florida Bank’s Personal FinanceWorks™, no charge for all GFB customers who have a checking account and are enrolled in Great Online Banking. Powered by Quicken®, America’s #1 personal finance software, Personal Finance Works allows you to create a complete overview of your finances and see
where you are spending money and how you spent it. It’s a great tool in these times when people are watching every dollar. 3) Enjoy the convenience of direct deposit of your paycheck. With Direct Deposit, you don’t spend time or effort cashing checks. It’s completely secure. The funds are deposited electronically – there’s no time wasted having the checks clear. There are no fees, and it avoids the possibility of theft or loss of checks. 4) Protect your credit record with overdraft protection on your checking account. Maintaining a solid credit history is an important part of managing your finances. A good credit record can make future borrowing easier and help you qualify for lower interest rates. 5) Plan to reward yourself. New Year’s resolutions usually don’t stick. Go on a diet, save money, don’t spend. We start the year like ascetic monks and by February we discover that the monastic life isn’t for us. Therefore, it’s important to have one resolution that is fun. For myself, it means saving up money for a special family trip later this year. If we keep the first four resolutions, we’ll reward ourselves for getting the new decade off to a good financial start. Edmundo Lacayo is the Pinecrest and Doral Market Lead for Great Florida Bank. Mercedes Benz SLK: Coupe to Roadster in 22 seconds Ron Beasley AUTOMOTIVE EDITOR
LET’S TALK CARS It’s tough to find something to dislike about the Mercedes Benz SLK 350; it’s just about the perfect two-seat small sports car and, with its retractable hardtop, it goes from a coupe to a roadster in just 22 seconds. The 2010 SLK line includes three models: SLK300 — powered by a 228-hp 3.0liter V-6 engine; SLK350 — with a 300-hp version of the popular 3.5-liter V-6, and SLK55 AMG — the high-performance model fitted with a 355-hp AMG V-8. All 2010 models come with a steering wheel covered in premium leather and a new monitoring system showing individual tire pressures. All three have new 17-inch twin five-spoke alloy wheels, and all have an innovative Direct-Steer system that involves variable-ratio rack gearing to provide an “on-center” steering feel with a higher responsiveness beyond the first five degrees of steering angle. Direct Steer min-
imizes steering effort during cornering and in low-speed maneuvers such as parking. Our test car for the week was the SLK350 (18/25 mpg) and it is an impressive car to drive with amazing acceleration. The V-6 has advanced engine technology that includes four valves per cylinder and variable valve timing. The 3.0-liter twincam engine develops more than 80 percent of its maximum torque at only 1,500 rpm. While variable valve timing gets much of the credit for the SLK300’s broad torque curve, a two-stage intake manifold plays a key role as well. Other high-tech engine features include tumble flaps that increase gas mileage by creating more turbulence in the intake passages at part throttle. With a higher-revving 7,200-rpm redline, the SLK350 engine has more horsepower and torque, thanks to its larger displacement as well as specially shaped pistons that produce a higher 11.7-to-1 compression ratio, a modified camshaft for higher valve lift, heavy-duty conical valve springs and lightweight valves made of high-temperature steel, and sodium-cooled exhaust valves. All models in the SLK Class can be ordered with a Sport package that includes AMG body styling, sport suspension, steer-

ing-wheel gearshift paddles and 18-inch AMG wheels. The Sport package includes AMG’s automatic “rev-matching” feature for smooth downshifting, which also improves braking. The SLK styling was freshened last year, so there is very little change for 2010. The latest SLK line has a front design strongly influenced by Formula 1 racing, and a rear apron with an air diffuser and trapezoidal exhaust outlets. Inside, all SLKs have chronometer-type gauges with aluminum accents, a three-
spoke sport steering wheel and an audio system with an in-dash six-disc CD/DVD changer, as well as a Bluetooth interface that allows a cellular phone to be operated through the car’s audio system. Base price on the 2010 Mercedes Benz SLK is $51,900.

‘Can we talk?’ — A restaurant review BY ERNIE SOCHIN Councilmember
I am not a professional restaurant reviewer as you probably know but here I go anyway. (Watch how I twist the story to get in what I really want to say.) I recently went to Joe’s Stone Crab on Miami Beach for my daughter’s birthday. I didn’t have to wait the normal two-and-ahalf hours because I have been going there for over 40 years and they kind of know me. I go there and spend all that money because I truly believe that their stone crabs are juicier and sweeter than any other place that I have tried. Their coleslaw salad is a mystery to me but it tastes fantastic and their “low fat” pies are the best. We had a great time even though my 4year-old granddaughter Natalie annoyed the heck out of the gentleman at the next table. He didn’t seem to mind too much, but I felt responsible. Now the twist — while enjoying our meal, I noticed another family nearby; a father, mother and pre-teen daughter I assume. What was unusual to me is that the young girl was totally involved with some sort of electronic game, the mother was “texting” someone on her Blackberry or whatever and dad was looking at something on his iPhone (or whatever). During the entire time I was there, they never spoke to one another and only raised their eyes when the food was served. I guess I really am OLD when I think that families dining together are supposed to talk. Gee what a weird idea from a weird old man. I grew up the old fashioned way where my mother prepared a meal every day and we all waited for “Pa” to come home from work so we could all eat and review what took place during the day. No more. I doubt that my grandkids ever eat at the kitchen table. Whenever I see them, they are camped out at a little table by themselves
or sitting on a sofa with one of those lap trays always focused on the TV. What used to be the kitchen or dining room table is now the storage place for today’s mail, the desk for one or two laptops and whatever else has no special place. I guess I have to accept that. Women now work and who feels like preparing a meal after working all day and fighting traffic to get home, and who says that dad is coming home at 6 p.m. like my father always did? We have no kids living at home anymore, but my housekeeper/cleaning lady/shopping companion and I have the same dialog every night. Me: “What did you make for dinner?” She: “Reservations.” Me: “I don’t really feel like going out.” She: “Then open the freezer and see what you like.” Me: “Aww shucks (or something similar).” I do admit that when we go shopping I walk by the freezer section and select several frozen meals just in case. The pictures on the carton look pretty appetizing but once you open the box…well you know what I mean. I like to think that things will change for the better, like going back to the old days when mom stayed home and dad went to work, and there seemed to be plenty of family time together. Of course, in those days you didn’t have car payments for two or more cars, cable TV bills of over $100, plasma TVs in every room and pre-schools that cost as much as Harvard University. Some states, hopefully ours included, are passing laws against cell phone use while driving. Perhaps the next step will require you to check your phone at the door in restaurants and leave the phone number of the restaurant with any emergency contacts you might have. Will this force people to begin talking directly to one another? I don’t know, but it is worth a try. Other articles of national importance can be viewed at Ernie’s website at <www.sochin.com>.

BY RICHARD H. MURRY
South Florida will be in full bloom when the South Florida Orchid Society presents the 64th Miami International Orchid Show, Feb. 26-28, at the Doubletree Miami Mart/Airport Hotel and Convention Center, 711 NW 72 Ave. (immediately south of Miami International Airport). Not to be confused with the numerous other orchid shows that proliferate each spring, the Miami International Orchid Show is the original, and now the largest orchid show and sale in the country. Each year, orchid professionals and hobbyists from across the globe exhibit an exquisite, tropical array of tens of thousands of orchids and orchid-related items for show and for sale. Show organizers anticipate more than 15,000 attendees this year. “The thing that sets the Miami International Orchid Show apart from the other orchid shows is the sheer size of the show, the number of items for sale, and the extraordinary design of the exhibits,” said show director Robert Fuchs. “The Miami International Orchid Show is a top-caliber, professionally produced show where guests get to see and buy the world’s finest orchids from the world’s top growers.” “Passport to Paradise” sets the theme for the 2010 show. In addition to extraordinary orchid displays, the show features a juried awards competition and thousands of orchids and related items for sale. New for 2010 will be an art exhibit and corresponding art contest spotlighting orchid imagery in three creative categories — art, sculpture and photography. The contest will be overseen by Terry Mulrooney from the
Homestead Art Club with ribbons and cash prizes to be awarded. Fuchs also noted that there is much more to do at the show than just stroll among the dramatic displays and purchase a vanda or cattleya. There also will be a series of informative talks by world-renowned growers, walking tours by knowledgeable Orchid Society members pointing out the highlights of the show, and sales of orchidrelated art and collectibles. Beginning this year’s show will be a special Premier Party on Thursday, Feb. 25, at 7:30 p.m. This highly anticipated event provides orchid lovers with a first glimpse at the show’s exhibits, first chance to buy the show’s best orchid plants, and it also will unveil the winners of the sought-after orchid trophies — including the Grand Champion trophy for best orchid in the Show. Ribbons and trophies will be presented to the winners of the photography and art contests. Regular hours for the 64th Miami International Orchid Show are Friday, Feb. 26, and Saturday, Feb. 27, 10 a.m.-8 p.m., and Sunday, Feb. 28, 10 a.m.-6 p.m. Daily show admission is $15 for adults, which includes a $5 merchandise discount coupon. South Florida Orchid Society members and children ages 12 and under are free. Tickets for the special Premier Party are $50 per person and must be ordered in advance through the South Florida Orchid Society office at 305-2553656. To inquire about South Florida Orchid Society membership, for additional information on the 64th Miami International Orchid Show, or to order advance or group tickets, call 305-255-3656 or visit online at <www.sforchid.com>.

There is a lot of energy flying about in your financial and investment sector, and there are a lot of opposing opinions. You need to listen to the voices that are the most experienced, knowledgeable, and who advocate the least risky options.
Gemini - The hot buttons fly around fast and furious this week and it may be simply irresistible to avoid pushing one or two. Avoid any "Oh YEAH? Well YOU ..." moments. You know what that looks like throwing back a partner or loved one's own failures in their face is not a prudent or effective way to defend your honour. Cancer - You will feel good in the week but starting in the middle of the week you may feel cranky without being sure why. If you can swing it, it might not be a bad idea to take off early so you can get some time alone to clear your mind before you get swamped with requests for help or assistance from family members.
Libra - You and your significant other need to get together this week, but it may not be the best week to work on those overdue chores. This is one week where procrastinating could be a good thing. You both need a break. If you are single, you may find yourself driving just for the fun of it this week.

Someone may have been hiding a pregnancy or an indiscretion that you would normally judge quite harshly, but things look differently this week. Capricorn - You may be a bit accidentprone this week, so be careful if you have to do any chores involving sharp objects or power tools. You need to take things slow and careful, because you are full of energy, and feel impatient and impulsive right now.
agreement with a friend or partner distract you from an opportunity to make new friends. You'll feel a lot more nervous energy this week than normal. People will seem overly dramatic and tense.
Aquarius - You'll have more luck with romance than with work this week. Unfortunately you may have to spend a good deal of time getting computers and telephones to hook together correctly. This is not a good week to install or purchase new electronics.
Virgo - Paperwork is challenging and communications devices may be problematic this week. Commuting to and from the workplace may be a bit challenging this week. You may have a disagreement or minor misunderstanding with an older coworker or a client in your business.
Pisces - Everyone in your extended family may seem grouchy and unreasonable right now, but there is no reason why you have to follow their lead. You have things to feel happy and grateful for, wallow in your good fortune a little - that mood may be catching.
Leo - Don't let a sudden argument or dis-
