Historically Yours BY BOB DIAMOND “REMEMBER THE LADIES” As I reflect on Aventura’s Elaine Adler and Heather Rohan, the more I believe that our nation’s Founding Fathers made a serious blunder by not paying attention to the March 31, 1776 letter from Abigail Adams to her husband John Adams, who was in Philadelphia helping to create our new nation. “I long to hear that you have declared an independency (from England),” Abigail wrote, “ and in the new Laws…I desire that you would remember the Ladies and be more generous and favorable to them than your ancestors. Do not put such unlimited powers in the hands of Husbands.” Abigail pressed for laws to give women a voice and representation in our new nation. Our Founding Fathers paid no attention to Abigail’s words and in fact, it took 144 years (1920) before women gained the right to vote. I think of what a greater nation we could have become with women such as Elaine and Heather in leadership roles. Heather, with her roots in nursing, is the
Chief Executive Officer of Aventura Hospital and Medical Center. Under her leadership, the hospital has become one of the leading medical facilities in South Florida, with a lengthy list of great accomplishments. She is responsible for the hospital having the number one emergency room facility in the 160 hospitals throughout the parent company, HCA. Perhaps her greatest personal legacy is the “sense of heart” that she has brought to the facility with a true sense of “caring for the patient.” She is emulated throughout every department of the hospital. Elaine took over the leadership of the newly formed Aventura Marketing Council in 1991 and changed it into a “grass roots” business organization. Starting with 12 businesses, under Elaine’s guidance it has grown to over 500 different companies with members throughout the entire South Florida area. Aventura’s business community, led by Elaine, has become becoming widely known and highly respected. She takes great pride in having helped small businesses to succeed and raising several million dollars for worthy charities. Thank you Elaine and Heather for enhancing Aventura’s reputation as the City of Excellence.

Victory Center sees 10th anniversary gala vital to raise funds BY LYNN CARROLL The 10th annual gala to benefit the Victory Center for Autism & Behavioral Challenges is more vital than ever, say organizers, as the slow economy and budget cuts are threatening the level of services the school can offer. The event is scheduled at 6:30 p.m. March 25 in Christine Lee's at Gulfstream Park, 901 S. Federal Hwy., Hallandale Beach. The fundraiser will feature a silent auction and dinner. Auction items will include shopping and vacation packages - including a trip to Asia, sportswear and memorabilia, says Victory Center's Executive Director Thalya G. Olmos. In addition to a special tribute paid to its past honorees, the event will honor Annie Isabella, Cindy Fraga and Jocelyn Rodriguez for their continual work within the autism community. "It is their work and dedication that has made The Victory Center a place where our children and families can come together as one," Olmos says. While community-based fundraisers throughout the school year are vital to the school's overall functioning, she says, "our 10th annual gala needs to raise more funds than ever in order to sustain our programs and services. Over the past year we have, as many other organizations, experienced serious budget cuts that make it more difficult to continue with the same level of programs and services." Victory Center is unique, she says, because it has a one-to-one ratio of staff to students. Tuitions cover only about a third of the center's operating costs. She stresses that Victory Center is open to everyone who needs it. "We do offer tuition assistance," Olmos says, "based on the income level of a family and other extenuating circumstances." In addition to ongoing operating expenses, she says the center is expanding outreach. "We haven't reached the whole autism community yet," Olmos says. "Our summer camp program is one example of how we can tap into the target population." She says that the Victory Center Summer Camp, now in its second year, involves The Children's Trust, one of m any alliances the autism school is creating with other organizations in Miami-Dade County. "Our aim is to help students become functional," Olmos says. "We've had some return to the public school system. For this, early intervention is critical." Life in the City BY BARI AUERBACH ‘Caught on Camera’ Cameras that catch red light runners have been creating some controversy – so if they ever have to be relocated, here are some ideas where they could go to help keep everyone on their best behavior at all times… “Bagel Cam”: If bagel shops around town installed cameras under all the tables, you can bet Splenda packets wouldn’t mysteriously disappear. (Fines could be doubled if packets were pocketed without ordering coffee!) “Publix Cam”: Were you the one with more than 10 items in the Express line? Was that you sampling the grapes?? If so, “Publix Cam” could prove it! And if the cameras were connected to Aventura cable TV channel 77, you could see if your significant other buys stuff they’re not supposed to be eating – like Twinkies hidden inside sock drawers and chocolate bars under the bed! “Gym Cam”: If gyms instituted training surveillance, you can bet there would be extra incentive for members to get in tip-
top shape! After all, if you knew you were being recorded while working out, you just might do that one extra rep; do a couple more crunches; and definitely not mess with the timer on the treadmill! “Condo Cam”: Odds are, even the most hot-tempered protestors at condo board meetings would calm down if they knew what they were ranting and raving about was being caught on camera without the curse words edited out! And if there was an “elevator cam” surely no one would push the close door button while their neighbor was yelling, “Hold it!!” “Beauty Cam”: Applying makeup or fixing your hair in the car could be considered a “pretty flagrant” violation - and if motorists happen to be talking on a cell at the same time - the fine should be even more than a salon bill! “Pet Cam”: Doggone it! Now pet owners won’t be able to sneak Fido in where there’s a no pets allowed policy or “forget” to use the pooper scooper! “Aventura Cam”: If the red light cameras were periodically turned to record the “City of Excellence,” it might really help the real estate market by promoting Aventura – where everyone always gets the green light to enjoy the highest quality of life!

Shelly Macin Buncher gives back to community BY LEE STEPHENS Realtor Shelly Macin Buncher of Rickenback Realty Inc. loves kids. She doesn’t have any of her own, so she has become a Guardian ad Litem. “A Guardian ad Litem is a responsible adult, appointed by the courts, to represent the best interests of a child,” Buncher says. “Often, what happens is a case takes one year, three years or more, and the case managers, therapists, foster homes, etc. change multiple times. Sometimes the Guardian ad Litem is the only stable person in the child’s life.” As a realtor who is a multi-million dollar producer, Buncher stays quite busy and has to be ready at the drop of a hat to meet a client. And she does so, except for two to three hours a month when she is in court on behalf of a child. “It has never interfered (with any work),” she says. “The second I am out of court I return my calls. I’ve always made a great effort to respond to my clients as quickly as possible.” Because she is passionate about advocating for children, she took time off from the program to earn her Master’s in Social Work. “I weighed the possibility of becoming a lawyer and advocating for children, against becoming a social worker and an advocate for children,” she says. She ultimately decided on pursuing her Master’s in Social Work to advocate for children and opted to continue in real estate. “I’m able to dedicate the necessary hours a week to being a realtor and still continue to monitor that the emotional, medical and educational needs of my Guardian ad Litem children are being met. Buncher started selling real estate in
Los Angeles in 1987, then moved back home to New York in 1990. She has been at Rickenback Realty, Inc. since moving to Aventura in 1993. She started working with the Guardian ad Litem program in 2000 and was immediately hooked. Her first case ran just over two years. It was achieving resolution when she took a leave of absence to begin studies for her MSW. “My current case is going on its fourth year. It doesn’t seem that it will resolve anytime soon,” she says. Her involvement doesn’t end when the case ends. She continues to follow the child’s situation to ensure that things are working in the best interests of the child. Because she works full time, Buncher usually takes on only one case at a time. Other Guardians ad Litem take on more. “You have to be aware of the time constraints,” she says. “There are reports to be done. Budget cuts have decreased our staff capabilities and as a result, we need volunteers, now more than ever. We are at 99% representation but with the current economy, cases of abuse and abandonment have been at an all time high, which is another factor leading to our increased need for volunteers.” The Guardian ad Litem group asks volunteers for a minimum time commitment of one year. The guidelines indicate that volunteers will spend between two and ten hours a week on the case. Usually the ten hours are at the beginning when the guardian isn’t as familiar with the proceedings. Buncher hopes more people will find the time to volunteer as Guardians ad Litem because there are numerous children in the system who need help.

Are you properly paying your employees? Causes of Liability Under the Fair Labor Standards Act BY JEFFREY GOODZ Last month we explored which employers are covered by the Fair Labor Standards Act (“FLSA”), which requires that certain employees be paid a minimum wage, and be paid time and one-half of their regular rate of pay (overtime compensation) for all hours worked in excess of 40 in a week. In this article we explore employer misconceptions which affect an employer’s obligation to pay overtime compensation, and an employer’s potential liability under the FLSA. The first misconception is that if an employee is made a manager, or is paid a salary, then the employee is not entitled to overtime compensation. An employee’s title and manner of pay are irrelevant. It is the employee’s job functions which are material. Although each situation is different, as a rule of thumb, the less autonomy, discretion, decisionmaking authority, and supervisory responsibility an employee has, the more likely he is entitled to overtime compensation regardless of how he is paid. A second misconception is that an employee can agree to forego overtime
compensation. An employee, however, cannot waive his rights to overtime compensation, even if he tells you he does not require overtime compensation. A third misconception on the part of employers is that if they designate workers as independent contractors, they will not be entitled to overtime compensation. While independent contractors are not covered by the FLSA, whether or not a worker is an independent contractor or employee does not depend on how he is designated, but rather on how he is treated. The factors considered are beyond the scope of this article, but as a general rule of thumb, the more control exercised over such things as the worker’s job functions, manner in which those functions are performed, hours of work, rate of pay, and promotional opportunities, the more likely he will be construed as an employee entitled to overtime compensation.

LET’S TALK CARS The Nissan Altima Coupe has been a hit with U.S. consumers since it was introduced three years ago. Its sporty styling, jackrabbit power and exceptional handling have made it especially popular with younger consumers who really have no need for four doors on a car and a roomy back seat. For 2010, the Altima Coupe gets new exterior styling, three new exterior colors, refined interior fabrics, a new available red leather-appointed interior color and revised option package content. The Coupe is available in four levels — a 2.5-liter inline four-cylinder engine and an equipped 2.5 S; a 3.5-liter V-6 engine (18/27), and an equipped 3.5 SR. Each level is offered with a choice of a six-speed manual transmission or Nissan’s advanced Xtronic CVT (Continuously Variable Transmission). The Coupe’s styling changes include a
revised hood, grille and front bumper, along with new projector beam headlights and standard 17-inch aluminum-alloy wheels. Altima 3.5 SR models have standard 18-inch aluminum-alloy wheels with Michelin P235/45R18 tires. The Coupe’s exterior design definitely stands out from other cars in its class. It is nicely proportioned and has a sensual, flowing design, with a shorter wheelbase, shorter overall length and lower height than its sibling Sedan. It’s smaller and lighter overall, which gives it a sportier driving feel, an important element for the more performance-oriented and youthful coupe buyers. The front-wheel drive Altima Coupe rides on Nissan’s advanced D platform and has a 105.3-inch wheelbase, four inches shorter than the Sedan. Overall length is 180.9 inches — 10 inches less than the Sedan — and it has a two-inch lower profile at 55.9 inches. The two cars share only a common hood, with all other panels, grille, headlights and rear combination lights unique to the Coupe. Twin chrome exhaust tips with unique taillights distinctively mark the rear. Inside, the 2010 Altima Coupe has revised interior fabrics and finishers, a new

red leather-appointed interior color and a revised blonde color choice. The gauge appearance has been changed to incorporate a new white illumination and the automatic transmission finisher has a revised design. The Coupe also includes a 60/40 split and flat fold-down rear seat. The instrument panel features a Fine Vision gauge display for better readability and the L-shaped flow of the instrument panel to the center console adds to the driver-oriented cockpit. The center console includes a
double front cup holder, one of many cup and bottle areas and storage compartments. Here are some tips about new credit card regulations
Al Sunshine 4 YOUR MONEY Following up on my column about new changes coming to credit card consumers, I have some other tips about what you need to know about the new government regulations affecting card issuers. For example, thanks to the Credit Card Act, visitors to national parks can carry licensed firearms effective Feb. 22. It is hard to believe that this unique provision was added to the revolutionary credit card bill passed by members of Congress last May. Most of the attention from the bill has been given to the restrictions on interest rate increases and over the limit fees. However, there are many other lesserknown regulations in the Act that could have far-reaching ramifications for consumers. IT’S SO HARD TO SAY GOODBYE Today, credit card customers have very few ways to react against the changes forced on them by their issuer. Closing an account and severing all ties feels good, but it could hurt your credit score. Closing the account also can raise the cost of getting a mortgage, car loan or even a new credit card. Before closing your account, consider your total available credit, your credit score and your borrowing plans.

RISING RATES ON CREDIT CARDS The LowCards.com Complete Credit Card Index showed that the advertised Annual Percentage Rates for credit cards was 13.46 percent, which was higher than 13.41 percent from the week before. Six months ago, the average was 12.11 percent. One year ago, the average was 11.51 percent. The LowCards.com credit card rate report is compiled weekly using data from 1,060 credit cards which are tracked on the LowCards.com website. WALLET WOES Not surprisingly, consumers spent more than they planned during the past holiday season. But the February Consumer Reports Index shows that this was not a return to past levels of consumption, and consumers already have closed their wallets. In fact, the Past 30-Day Retail Index for February, which reflects the purchases consumers made in January, is 10.9, a decline of 23 percent from the previous month. The Next 30-Day Retail Index dropped to 6.9 from 8.9 the prior month. This represents the number of appliances, electronics, and yard and garden equipment that consumers intend to buy during the next month. That’s the lowest level it has been since August 2009. CR’s Trouble Tracker shows that the hesitation to spend money is the result of the inability to afford medical bills or medications and a change in credit card terms that resulted in both increased interest rates and penalty fees. Freestyle Alligator Wrestling Competitions (FAWC) Media Day BY LEE STEPHENS A media day was held at the Seminole Okalee Indian Village in the Seminole Hard Rock Hotel & Casino on Tuesday, March 9th from 1 pm to 3 pm. This meet and greet showcased the Freestyle Alligator Wrestling Competitors who was highlighted at this year’s 2010 Seminole Tribal Fair, March 11th – 14th, as well as the FAWC founder James Holt (Seminole member, Panther clan). The wrestlers was compete in 10 minute timed sessions and be judged in six different categories: aggressiveness of the gator, difficulty of the move, style, appearance, showmanship and water wrangling. With stadium seating for 800 and a new under water video technology, visitors were able to be view never before seen angles and moves of the Alligator wrestlers. The competition is open to both tribal and non tribal members who have experience handling alligators and will begin Saturday March 13th at 6 pm; finals
will be held on Sunday March 14th at 2 pm. Wrestlers will be competing for $5,000 for first place, as well as cash prizes for the top five competitors. The FAWC was founded by James Holt in 2009 and is specifically designed for the sport of alligator wrestling. James offers classes to wrestlers before matches for both their safety as well as the alligators. FAWC requires competitors and officials to meet a certain standard of experience and expertise to ensure that the contest is held at the highest level for both safety and competition. FAWC advocates the humane treatment of all animals used in their competitions and rescues alligators from all over Florida whom would otherwise be euthanized.
