The Humane Society of Greater Miami Adopt-A-Pet celebrates Grand Opening of the Audrey Love Intake and Quarantine Pavilion Ground breaking for the Audrey Love Intake and Quarantine Pavilion recently took place at the Humane Society of Greater Miami Soffer and Fine Adoption Center in North Miami Beach. This state-of-the-art quarantine facility will be the first of its kind in South Florida and will allow the Humane Society of Greater Miami to save an average of 50 additional animals every two weeks due to the new extra space. The new Intake and Quarantine Pavilion separates incoming animals from those already living at the Soffer and Fine Adoption Center so there is zero chance of cross-contamination of disease. The new animals will be examined and monitored by a team of veterinarians, certified veterinary technicians and kennel associates to make sure that they are healthy and given the proper care needed before moving to the general shelter and adoption center. Just as is the protocol today, all animals will be healthy, fully vaccinated and spayed or neutered before being put on the adoption floor. Personnel at the new Pavilion must first put on disposable gowns, gloves and plastic boots before entering. Upon exiting, they place the disposable clothing in a bag so no contaminated material leaves that area. Why is quarantining new animals in the shelter so important? "Isolating animals allows us to protect all the animals that are currently under our care from any possible disease or illness that new animals may be harboring," says Emily Marquez-Dulin, executive director of the Humane Society of Greater Miami Adopt-A-Pet. "When adopting a pet from us," Dulin proudly adds," you are adopting an animal that is fully vaccinated to the extent that their age allows, spayed or neutered and healthy, to the best of our knowledge. No other animal welfare organization in South Florida follows such strict guidelines or goes to this extent to ensure the well-being of its animals." And now, with a state-of-the-art facility, the Humane Society of Greater Miami can do an even better job. The 1,600 square foot Intake and Quarantine Pavilion is entirely separate from the

LR: I have a very good team, and a lot of the credit goes to them. We are like a family. When we are very busy I help them in any way possible, and when they see the support from management they are more willing to work as a team and help out wherever help is needed. I like my team to have good discipline; I also try to treat everyone fairly. They know that if they do a good job I will praise them for it, and if there's something they need to improve, I will let them know about that, too. It is part of our work culture to celebrate successes.
LR: It's crucial, because if you don't have a reputation for cleanliness, you don't have a base business. According to surveys, our repeat business is a correlation of the way our hotel is kept up from a cleanliness level.
LC: As an all-suite hotel, Residence Inn by Marriott must require a lot of cleaning. How do you train team members?
LC: I'm curious: why did Marriott Hotels rate you at 99% instead of 100%?
LR: We have Marriott-approved training programs that cover everything from cleaning service to customer service. It's not just about cleanliness; their attitude and appearance need to be proper, too. We also try to come up with some creative "fun" training programs that engage the associate. We have 191 suites, and every day I personally inspect 30 to

VIEWPOINT Race is always getting in Bank fees are now outrageous the way BY DONALD KAUL Before the saga of Gatesgate (the arrest of Harvard professor Henry Louis Gates, Jr., by Boston police) disappears into the limbo reserved for mountains made of molehills, let me make one comment: That Boston police officer did not act “stupidly” in slapping cuffs on the renown black historian and hauling him off to jail. It was Gates who acted stupidly. I grew up in Detroit---not Grosse Pointe-Detroit or Bloomfield Hills, but Detroit, where the factories once were--and one thing we learned early on was this: Do not give a policeman an excuse to beat you up for he will often do it. And what's excuse enough for a beating? Well, giving him lip ranks high on the list. When I was a young reporter I remember a county attorney in Iowa telling me that every case of police brutality he had ever investigated began with the victim challenging the authority of the law officers. “It drives a lot of cops crazy,” the attorney said. And so it does. I remember my surprise at the 1968 Democratic convention in Chicago when the student protestors expressed outrage and astonishment that the Chicago police were beating the hell out of them. These kids were on the streets, calling the cops impolite names, impugning the virtue of their mothers, even throwing rocks at them, and they were surprised when the police responded by hitting them on the head with clubs? “Where did these kids grown up?” I asked a colleague from Philadelphia. “I don't know, but it wasn't Philadelphia,” he said. Do I think it's proper for police to beat people up simply because they're disrespectful? No I don't. I think all police should be saints. Saints with guns. But that's not the way of the world. Gates should consider himself lucky he didn't draw a mean, racist cop with an itchy nightstick. On the other hand, I am perfectly willing to cut Gates some slack. He's a middleaged man with a bad hip. On the night in question he'd just gotten off a plane after a 14-hour flight home from China, where he

His hip probably was killing him and, to top it all off, he'd had to break into his own house because of a jammed door. Add to that the fact that Gates' field of specialty is black history. He probably has as firm a grasp of this country's lamentable history of race relations as anyone alive. He lives with that history of the subjugation and oppression of African-Americans, the record of police brutality inflicted on blacks. He carries with him the rage inspired by those injustices. So when a cop showed up and hassled him in his own home---in his own home!--he snapped. Have you ever snapped? I've snapped, often with less provocation than Gates had, and always regretted it later. I just make sure I don't do it with cops. To me all cops are named “sir.” I would still argue that it was the police officer, ultimately, who should not have let things get out of hand. Gates is 58 years old. He weighs a wet 150 and he walks with a cane. He dresses like a Harvard professor. It should have been obvious to the officer that Gates presented no threat to society and that he was not a burglar. He was just a crotchety old man behaving like a jerk. That's not a criminal offense and it's not worth the time and effort it takes to arrest someone. The officer should have backed off. It would have been nice, also, if President Obama hadn't been so quick to condemn the Boston police from his bully pulpit. He got it about right the second time around, but, really, no one was at the top of their game here. How's this for gratitude? Wall Street bankers, whom we've propped up with a $12 trillion bailout, are quietly slipping offensive little notes into your and my monthly credit card bills and bank statements. The message is: "Gotcha again, suckers." Their “gotcha” is a rash of rate hikes and fee increases. In June, for example, Bank of America abruptly raised its fee for a basic checking account by 50 percent, and Citibank jacked up the interest rate on some of its credit cards to an outrageous 29.99 percent. My favorite fee hike, however, is for bounced checks. This has been a steadily rising moneymaker for the industry, producing about $32 billion for the banks last year. With the current economic collapse, though, folks are taking special care these days not to overdraw their accounts, because banks hit you with a fee of up to $35 for each overdraft. As a result, bankers are collecting less money from this charge. So, to make up for their revenue shortfall, banks have merrily cranked up their
bounced-check fees, which now run as high as $39 - thus socking it to some of their customers who're under the worst financial strain. Why have the big banks become such fee-grubbers? Because they've failed at the core business of banking, which is to make good loans. So they are inventing new ways to extract money from their existing customers without doing anything to earn it. Astonishingly, the fees they charge you and me now total 53 percent of the industry's annual income! The biggest banks charge the most, earning them the new slogan: "Fees R Us." Meanwhile, they are lobbying frantically in Washington to kill legislation that would protect consumers from their unbridled greed. The IRS’s Dirty Dozen: 12 Tax Scams to Avoid BY STEVEN N. KLITZNER April 15 has come and gone. You can check off one more line in the Death and Taxes column. But that doesn’t mean you should relax. With identity theft on the rise and scamsters preying on taxpayers looking for a break in these hard economic times, it can be a scary, scary taxpaying world. For that reason, the IRS is continuing in its annual tradition of releasing a “Dirty Dozen” list — the 12 most common tax scams that could put you in a world of financial hurt. Whether perusing your e-mail inbox or the local classifieds, beware of these 12 tax scams in 2009: 1. Phishing: Internet-based scam artists use phishing to trick victims into revealing personal or financial information for the purposes of identity theft. Phishing scams often take the form of an e-mail that appears to come from a legitimate company org government entity, such as the IRS. The IRS never initiates unsolicited email contact with taxpayers. 2. Hiding Income Offshore: This is a timehonored tax evasion scam. But don’t fall for it. Today, even Swiss banks are opening up records to the IRS. Using this scam could land you in prison. 3. Filing False or Misleading Forms: Some scam artists promote frivolous information
returns, such as Form 1099-Original Issue Discount (OID), claiming false withholding credits are used to legitimize erroneous refund claims. 4. Abuse of Charitable Organizations and Deductions: Watch out for people claiming you can shield income form taxes using taxexempt organizations. 5. Return Preparer Fraud: Be skeptical of tax return preparers who guarantee large refunds. They aren’t working magic; they’re cheating. 6. Frivolous Arguments: A number of taxshelter promoters nationwide use frivolous arguments that do not withstand court scrutiny. You can find a list of legal arguments taxpayers should avoid at www.irs.gov. 7. False Claims for Refund and Requests for Abatement: This scam involves a request for abatement of previously assessed taxes using Form 843, Claim for Refund and Request for Abatement. 8. Abusive Retirement Plans: Be wary of anyone encouraging you to shift large assets into IRAs or companies owned by IRAs. 9. Disguised Corporate Ownership: The IRS actively investigates the use of corporations to facilitate the underreporting of income. 10. Zero Wages: Some scam artists advocate simply filing your taxpayer income as $0. 11. Misuse of Trusts: Although there are legitimate uses of trusts, scam artists employ them as tax shelters.

Reality could be defined as something that actually exists or occurs. Something that is tangible, solid, and concrete, something authentic and not artificial. Reality is when you look at things in their true nature and deal with these things as if they are based on facts rather than ideals, wishes or opinions. There is an expression that is often heard, “It is what it is.” But is it? Reality can contradict the traditional definitions. Water is a liquid at 211 degrees. At 212 degrees it begins to boil and becomes steam. Below 32 degrees it can become snow. It can also freeze and become solid ice. Reality can change and still be honest and true. At each stage, and in each form, whether ice, snow, liquid or steam, the water is real and genuine. There is another element to reality not in the dictionary. And that is your reality. Your reality can be fixed or it can be flexible. You might not realize that. You might think that it is fixed and that is that. However, if you open your mind, and think about the water, you can see that the possibilities are endless.
If you do not like your reality, you have the power and ability to change it. There are many ways to do that but they all begin with you and with your mind and your thoughts. Certain thoughts and beliefs that you have may have been given to you and you have accepted them as real. These concepts may not be authentic or bona fide. You do not have to accept your present situation as your only reality. Just like water you can transform yourself. You can stay solid and frozen hard and immoveable in your life or you can change and heat up your efforts and generate increased energy and steam which has the power to move a whole train. This same power can be harnessed and used to change your reality. Begin by monitoring your feelings. Are you happy, sad, worried, anxious, fearful, angry, energized, or tired? Then figure out what thoughts you had just before the feeling occurred. Remember, that what you think about becomes your reality. Decide to change your thought instantly and substitute a new positive thought. You can be healthy, happy and harmonious. You can be prosperous. WHOLE E BODY SCAN Whole Body Scans are used for “screening” of heart disease and cancer. In medicine, “screening” means looking for a medical condition in a person showing no symptoms in the hope of identifying problems early; when treatment can be most effective. There are many screening tests that look for different abnormalities. For example, a very popular screening test for women is the mammogram. Most mammograms are done on women who do not have a lump in the breast or other evidence of breast cancer; it is done as a preventive measure in hopes of catching breast cancer at an early stage. CARDIAC C CALCIUM M SCORE Coronary artery calcium (CAC) has been shown to be highly specific for atherosclerosis, demonstrating that if there is coronary calcium present, there is plaque building up in the coronary arteries. There is ample evidence to now show that elevated coronary calcium scores (CCS) are predictive of future cardiovascular events, both independently of and incrementally to conventional cardiovascular risk factors. Based on current available data, patients with increased plaque burdens (increased CCS) are approximately ten times more likely to suffer a cardiac event over the next 3-5 years. Coronary calcium scores have outperformed conventional risk factors, highly sensitive C-reactive proteins (CRP) and carotid intima media thickness (IMT) as a predictor of cardiovascular events.

As experienced Tax Attorneys, we strive to focus on the IRS’ most current target of wrath and explain it to our readers in a straightforward manner, in an attempt to demystify the IRS’ current tax initiatives and simplify all associated tax issues. Recently the IRS's best efforts have focused on obtaining information about American citizens and residents who have overseas bank/securities accounts which are not memorialized on their tax returns. To fail to do this invites substantial penalties; felony jail time and a fine equal to 50% of the amount held in the foreign accounts. Commissioner Shulman has offered amnesty to anyone who would confess his sins to the Internal Revenue Service before September 23, 2009. Entering the “voluntary compliance program” gives the taxpayer's two major breaks; no criminal prosecution and a fixed penalty which is limited to 20-25% of each year's additional tax liability plus an additional fine equal to 20% of the highest amount in the overseas accounts. Generally the voluntary disclosures will require: 1. Payment of all taxes and interest for the previous six years. 2. Assessment of an accuracy penalty of (20%) or a delinquency penalty (25%) for all years and 3. An FBAR penalty of 20% of the highest account balance during the six year period. To give you a feel for the extent of the actual economic bite of these various disjunctive penalties, we can look to an example provided by the IRS of an individual who's had $1 million in a foreign account, which earned 5% a year ($50,000). The cost for this individual to make a voluntary disclosure for this unreported income from this foreign account would be $386,000 (38.6% of amount in the account), plus interest. Such a deal!

The green card test; if you are a non US citizen who holds a “green” card (actually, it's pink now), you are a U. S. resident for tax purposes. This means that you have “a lawful permanent residence” in the United States. Once you obtain this card and you physically enter the United States after its acquisition, you are, in essence, admitting to the Internal Revenue Service, that you are a United States resident, ergo subject to all the same tax laws which are applicable to American citizens. The substantial presence test; this relates to a mathematical test predicated on the number of days you spend in the United States over a threeyear period. The formula is: (number of days present in the United States in the current year) + (1/3 of the days present in the United States in the immediate preceding year) + (1/6 of the days present in the United States in the second preceding year). If the total exceeds 183 days in a three-year period, you are a United States resident for tax purposes. Generally speaking, if an individual spends more than four months a year in the US, then they will be a US resident. This is true even where an individual is physically present in the US illegally! Let's see how this works. Melvin, a Mexican citizen, has been spending substantial amounts of time in the United States during the last three years.
So who is potentially in trouble here? The United States is one of the three countries in the world to tax both its citizens and residents on their worldwide income. Most countries tax only people who are residents without regard to citizenship. Canadians, for instance, pay income tax only while they are resident in Canada. Once they leave Canada (changing residence), they are no longer responsible for Canadian income tax. This is the general rule followed by most countries in the civilized world. For American citizens, there is no reprieve. No matter where in the world you live, you are responsible for filing income tax returns and paying taxes to the United States. Magnanimously, if you live outside the United States, the IRS gives you an extra 60 days to file your tax return.
Conclusion: for tax purposes Melvin is a United States resident. He must pay United States income tax on all of his worldwide income. If he still has bank/securities accounts in Mexico which total in excess of $10,000, he must file the FBAR form. If he fails to do so, he is subject to criminal tax sanctions as well as a penalty of 50% of the total in all foreign bank or securities accounts. So long as he has signatory authority over a foreign account, he will be held responsible for paying all taxes on the income produced by this bank/securities accounts and criminal sanctions if he fails to file form TD F 90-22.1.
What is residence? This is a word which has a multiplicity of meetings depending on which government agency you are dealing with.

Immigration and Naturalization has its own definition of what is a U. S. resident. The IRS and the various states, for income tax, real estate laws, property tax exemptions, marriage and divorce law, have individual (and not always similar) definitions of residence. Our main concern for the purpose of this article is residency for United States income tax purposes. The Internal Revenue Service has two principal tests for residence; if you meet either test, you are a United States resident for income tax purposes and subject to taxation on your worldwide income.
The IRS feels that it is a good deal, that should be considered seriously by anyone who has undisclosed foreign income. An individual who does not come in voluntarily and is later discovered by the IRS, could be subject to an assessment of 231% in taxes, accuracy related penalties and FBAR penalties, in addition to facing possible Criminal Charges! This offer is only open to taxpayers who make voluntary disclosures by September 23, 2009.
The gray area of law concerns United States residents. Actually, the law is quite clear- if you are a U. S. resident, you have a tax responsibility identical to that of a US citizen. The issue that often arises between “resident” taxpayers and the Internal Revenue Service relates to who is a resident of the United States. Many foreign nationals spend a lot of time in the United States. If they exceed the “residency” thresholds, their worldwide income would become subject to United States income tax. In addition to this, if they maintained bank/securities accounts in their home countries and fail to file the required form (FBAR), they would be subject to the same 50% penalty and potential criminal prosecution as any other US taxpayer.

The Internal Revenue Service can and will check your passport and visa to count the exact number of days that you are in the United States during the period in question. This is really a trap for the unwary. You can be a United States citizen or a resident, inherit a substantial bank account or securities account in a foreign country, and still fall prey to this trap. If you have this type of potential problem, the soundest advice that I can give you is to review your situation with a knowledgeable tax attorney or accountant. Make certain that this person has knowledge in this particular area of the law because, as I stated previously, the punishment for failing to adhere to this area of the tax laws is confiscatory and potentially confining. LET’S TALK CARS You can’t see the biggest improvement to the Ford F-150, but you’ll certainly know it after a few minutes behind the wheel. Ford engineers have given the popular pickup truck a new highstrength, lighter-weight chassis that allows the 2009 F-150 to deliver more horsepower, better fuel economy, more towing and payload capacity, and even more safety features. The F-150 continues with a fully boxed frame constructed with hydro-formed and high strength steel side rails. The frame delivers 10 percent more torsional rigidity for increased durability and safety. The F150 also has such standard safety features as AdvanceTrac with RSC (Roll Stability Control) and Trailer Sway Control, plus available Rearview Camera Assist and Integrated Trailer Brake Controller. For power, Ford offers a choice from
three V-8 engines mated to either a fourspeed or a new fuel-efficient six-speed automatic transmission. The engines include a 5.4-liter, three-valve Triton V-8 that has been optimized for better performance and is capable of running on E85, regular unleaded gasoline or any blend in between; a 4.6-liter, three-valve V8, and a 4.6-liter, two-valve V-8, that delivers more horsepower with the same fuel economy performance as the discontinued V-6 engine. Diesel and EcoBoost gas turbo direct injection engines are planned for F-150 in 2010 as well. The interior of the F-150 SuperCrew has more usable space for moving more people and gear thanks to a six-inch stretch that improves rear seat legroom and cargo capacity. The second-row seat flips up and out of the way, and with the flat load floor the SuperCrew has 57.6 cubic feet of cargo space behind the front seats, and it can haul items up to 47.9 inches tall (such as a new flat-screen TV). The regular F-150’s pickup box has a cargo capacity of 65.5 cubic feet and Ford designers have made it easier to use, more flexible and accessible with such new features as Ford’s Tailgate and Box Side Steps, the Stowable Bed Extender and the

Study finds seniors vulnerable to foreclosure BY GAIL SHIVEL A study by the American Association of Retired Persons (AARP) Public Policy Institute shows people over 50 account for 28% of all those who were in foreclosure just in 2007, before the current crisis really hit the fan. Close to 700,000 people over 50 were behind on their mortgage payments by 30 to 180 days. This contradicts conventional wisdom, which has suggested that older people have been more likely to avoid trouble because of being in more traditional mortgages and having had more time to build equity. While that is true for many people, it is not true for all. The fact is financial difficulty can strike at any age; particularly for people who are no longer working and who are on a fixed income, all it takes is a medical problem or the desire to help a struggling child to decimate hardearned savings. Add to that the precipitous deflation in home values that wiped out equity—equity on which many people had borrowed—and the
decline in value of other investments, and seniors can find themselves in unanticipated financial trouble. Also, it is no surprise at all that older Americans who entered into subprime loan contracts are far more likely to be in trouble now: about eight times more likely to be delinquent, and 17 times more likely to be in foreclosure. AARP purchased the data for its study from the credit bureau Experian. While it may be surprising that a significant number of older people are in subprime loans, the AARP study also indicates that Americans over age 50 hold about 41 percent of all first-time mortgages. Having a mortgage loan amount greater than the value of the house is associated with higher foreclosure rates in general, but the impact is larger for older people, the study states. For people over 50, a loan-to-value ratio over 100% is associated with foreclosure at double the national rate. More seniors choose cosmetic procedures as bias fades BY GAIL SHIVEL In the quest to greet the years as gracefully as possible, more seniors choose cosmetic procedures than in the past, according to Dr. Adam Rubenstein, an Aventura plastic surgeon. From entry-level non-invasive treatments such as botulinum toxin (known commercially as Botox) to relax facial muscles to deeper, surgical procedures such as the traditional full face lift, the entire gamut of appearance-improving techniques is being embraced by an older set of patients. Dr. Rubenstein, who also is Chief of Plastic Surgery at Jackson North Medical Center, estimates that as many as 20 percent of his patients are in the over-60 category. “”Cosmetic surgery really came into its own beginning in the 1950s, so older patients who grew up before that may remember when there was a bias against it, when it wasn’t talked about,” Dr. Rubenstein said. “Certainly more people from an earlier generation have become more open to the idea.” Dr. Rubenstein describes three typical kinds of cosmetic surgery patients: those new to the scene, who at first dip a toe in the water with something noninvasive like Botox or laser treatments; those who have waited a lifetime to make a change to a feature, out of fear or surgery, bias against cosmetic surgery or financial barriers; and cosmetic surgery veterans. He notes that although a face lift is still a major surgery, new surgical techniques that manipulate tissue rather than just stretching skin have led to more pleasing, and long-lasting, results. Interestingly, Dr. Rubenstein has noted better results with surgery scars in older patients: “Facial surgery patients who are older often heal beautifully, possibly because of the slight immunosuppression we get as we age. The two ends of the age spectrum, younger and older, tend to have good scars.” Dr. Rubenstein’s practice recently installed a new device for nonsurgical fat reduction, which, along with a program of exercise, uses noninvasive laser therapy to reduce body fat. The procedure was featured recently on “The Doctors” television program. Dr.

Rubenstein’s practice also is among the first to use the new plasma knife for surgeries such as tummy tucks, which results in less scarring and wound drainage. According to data released by the American Society of Plastic Surgeons, patients over the age of 55 account for about two-thirds of facelifts, and about half of all eyelids surgeries and lip augmentations. Expenditure on cosmetic procedures declined about 9 percent in 2008 because of the economy, but Americans still spend more than $10 billion a year on face lifts, tummy tucks, liposuction, breast augmentation, leg vein lasering, microdermabrasion, Botox and other treatments. Older patients, Dr. Rubenstein said, tend to have fewer self-image issues than younger patients and to have a more realistic notion of what cosmetic procedures can accomplish. “I always say that a plastic surgeon is part psychologist,” he said. “Sometimes, a person comes in wanting something done soon after a major event like a divorce or the death of a spouse, because they’re planning on dating again. That is a good and stable reason for improving the appearance, but I will counsel people to wait a while after a major life event before making a decision about surgery. It’s the ethical thing to do when the emotional wounds are still fresh, so to speak.”

Annette Edwards shares a lifetime of lessons in theater BY GAIL SHIVEL Born in 1909, Annette Edwards will reach the 100-year mark in September. As a child she studied ballet with legendary masters such as Michael and Vera Fokine, and has spent a lifetime imparting knowledge of all forms of theater to several generations of students. “I was performing at age 16—I said I was 18, of course—and I didn’t realize it was special. I took myself for granted,” she said. “The great thing is that I was working with adults, world-famous masters in many cases.” She was a born teacher. “Eventually older people began to ask me for advice, in gentle ways, and I began to take notice of that.” Edwards opened a school in New York at age 28 as a teacher of interpretive ballet, a cutting-edge artistic endeavor in the 1930s. “All of my students were learning everything: acting, singing, dancing, presentation, principles of design, because all of those things go to make up theater. Whatever you do is a combination of several talents, because your entire being is involved.” This way of teaching was a brand new idea back then. “Back then we had musical comedy, not musical theater. This was the beginning of real theater and I was there, when theater began to become respectable. When I was starting out, there was no such thing as someone taking a college class in the performing arts, it just wasn’t done, and now of course you have college theater programs all over the country.” Edwards’ theater heritage stretches back into the nineteenth century; her mother was briefly in silent pictures and her grandmother took a keen interest in the world of the stage. Her daughter, Joanie Edwards, soaked up that atmosphere from infancy. Into the 1980s Annette and Joanie operated three theater schools in New York, in Brooklyn, Manhattan and the Bronx. After “retiring” to Florida 35 years ago, Annette began volunteering as a drama teacher in Boca Raton, eventually opening the Little Theatre School in Aventura. Today the Little Theatre School, run by Annette’s daughter Joanie, offers classes for students of all ages, from small children to adults. Little Theatre School students have won many competitions and appeared in television commercials and other venues. (To inquire call Joanie at 305-936-9795.) Annette Edwards brims with the insightful anecdotes and quick, accurate assessments that are the mark of a master teacher. “Talent means many things to many people,” she said. “You can meet one hundred children and all of a sudden you find one, one only, who you know is the tal-

Mr. Edwards is on the right. ented kid among them.” When she began teaching in 1928 Edwards established a scholarship at her school for the most deserving student; this always went to the student not necessarily with the most talent, but with the best combination of talent and focus, she said. The Little Theatre School carries on this tradition, with a $10,000 scholarship presented every year. “Many famous protegés have succeeded on account of it,” Edwards said. “Some have come from disadvantaged backgrounds, even were poverty-stricken, and are now very successful, performing or running their own schools.” What children understand naturally, and what parents have to learn, Annette believes, is that “fun” is not wasting time. “Activities that are enjoyable build confidence as children find out they are capable,” she said. “You never know where it’s going to come from, and often it’s a matter of if they have a gift, that they recognize it.
They will have that spark, and they need to learn how to control it.” In the late 1930s Edwards, or “Miss Annette” as her students called her, taught a nine-year-old boy who had a real but unquantifiable potential. “I told his mother: you son has no great single talent, but he has a quality, a magic quality in his face and eyes. It’s his personality, his real, truthful self. That’s what is there, unless someone squelches it, and I will try to prevent that if you’ll let me.” The child was Joseph Lichtman, now better known as Joe Layton, who went on to become a Tony- and Emmy-Award-winning director, choreographer, and producer of Annette Edwards with a student in her New York many acclaimed Broadway shows and televischool, about 1955. sion specials. Layton, who died in 1994, directed Carol Burnett in “Once Upon a Mattress” and enjoyed great success with a world tour of “Barnum”. Teaching children presents special challenges. Edwards can remember a time when professionals in all fields were respected for the knowledge and experience they had, and parents were more inclined to take advice; unfortunately, she said, today’s parents often need re-educating. “It’s disappointing to find kids who are extremely talented, as you sometimes do, and you just don’t want to handle them because of the parents. “You have to be very gentle about educating the parents about the realities of the business, because sometimes these kinds of parents can be extremely gullible and susceptible to scams.” One fairly typical practice today is the phony call-back as a lead-in to unscrupulous representation schemes. “These rampant auditions mislead people, because a kid will read one line and be asked to come back, and everyone gets their hopes up. We help people understand the Annette with a student in the 1980s. business of the business, the way things are really done.” Both mother and daughter have noticed a disturbing trend in recent years in which parents try to get children to do certain things too soon. “We are hearing about injuries in children studying ballet who are on point much too soon,” Annette Edwards said, similar to the increase lately in reports of sports injuries in growing children. “Because the child is still growing, this can be a lifelong injury. Parents come to you with all kinds of ideas, and I will listen, but that doesn’t mean I have to do it. “As teachers, and as managers of talent, we try to open parents’ minds to what their children are all about, “ instead of catering to their pre-conceived notions. It is difficult, in a highly commercialized environment, she said, to maintain standards. Sex therapist advises older couples BY GAIL SHIVEL Maturity can usher in a new period of sexual fulfillment for couples who are willing to discuss their needs with one another, according to clinical psychotherapist Coral Arvon, Ph.D., LMFT, LCSW. Dr. Arvon, a board-certified sex therapist, works with people who are experiencing changes in their sex lives and helps them cope. What is one of the most common issues Dr. Arvon encounters in her practice? “Women wanting more sex! Women age 30 on up come in with the chief complaint as lacking sexual desire,” Dr. Arvon said. “Many elderly women also.” Dr. Arvon notes that attitudes toward sex, and especially toward discussing sex, have changed greatly in the past couple of decades, largely due to a more open approach to sexual topics in the media and columnists such as Dr. Ruth Westheimer. “Both men and women want to verbally discuss sex together in my office,” she said. According to Dr. Arvon, about one in five couples over 80 don’t need extra help

Sometimes a change in technique is what is called for, and talking with a sex therapist can help people overcome long-held and sometimes damaging notions about what sex is “supposed” to be like. A different pace and a different expectation can bring greater satisfaction to both partners. Of course, this advice is for people who are partnered; many older people who had enjoyed long-term relationships will eventually find themselves alone because of the death of a spouse. Some, after grieving, begin dating again, but depending on the time of life when widowhood occurs circumstances may have changed considerably. Dr. Arvon relates a story, however, that shows that the sexual spark remains alive for many even in the last stages of life: A woman in an assisted living facility (ALF) had become very withdrawn; she was the oldest person there and she was also overmedicated. When her family corrected the problem by moving her to a different, more active ALF—where she was no longer the oldest resident but among the youngest—her outlook changed completely.
“She began making friends and quickly found a partner there so that in addition to being more active, she has a sex life again as well,” Dr. Arvon said. “It is a beautiful story.” That kind of positive experience is not unheard of, though unfortunately the happy outcome is more the exception than the rule. For those who must help choose assisted living facilities for relatives or friends, Dr. Arvon has this advice: “Make sure the ALF offers plenty of diversified activities available for both sexes,” she said. “There should be a mixed age range. The place needs to be progressive, with state-of-the-art electronics and courses that promote wellness and knowledge. The residents won’t give up, they will be excited and interested in life. That promotes enthusiasm, stimulates serotonin levels and creates bonding.” In addition to providing marriage and couples therapy, Dr. Arvon works with clients coping with anxiety, depression and addictions, using cognitive behavioral therapy. Disabled access advocate fights for ADA compliance BY GAIL SHIVEL Phyllis Resnick, a self-described activist, has spent decades advocating for causes she believes in. “I was brought up in the volunteer tradition,” she said, and today her volunteer spirit is helping disabled people who face unfair barriers in public areas. Resnick and her husband Edward S. Resnick, who died in 2003, formed Access Now, Inc., a not-for-profit devoted to improving access for disabled persons, in 1998. Mr. Resnick, an attorney, contracted polio in 1954 and spent 49 years as a full-time wheelchair user. Having grown up in South Miami Beach, Mr. Resnick witnessed the rebirth of the area in the 1990s only to be denied equitable access to its attractions. “Here were all these clubs, restaurants, shops and all kinds of happy things opening up, and Edward couldn’t get into any of them because of his wheelchair,” Resnick said. The Resnicks formed Access Now as a resource for people with any kind of disability who have had problems with buildings that do not have accessible wheelchair ramps, for example, or correct restroom facilities, or stores that have aisles too small to navigate. Access Now has grown into a nationwide organization, with the goal of encouraging compliance with the Americans with Disabilities Act of 1990 (ADA). Businesses and public buildings that do not comply with ADA guidelines for disabled access are liable, and Access Now helps people pursue litigation when appropriate. In addition to her service to Access Now, Resnick also is involved with the Little Theatre School in Aventura (see story, date or page); as a girl she dreamed of “life upon the wicked
stage”, though real life and love intervened. Her one big performance had been for a benefit concert, bringing down the house as a visibly pregnant 27year-old with “I’m Just a Girl Who Cain’t Say No” from Oklahoma. Today, she enjoys acting as a pastime and has performed in such classics as The Little Foxes and The Prime of Miss Jean Brodie. A Brooklyn native, she has lived in South Florida since 1950. “I was very active in the civil rights movement, peace marches and sit-ins,” Resnick said, and once came close to being arrested at a protest in downtown Miami. She currently serves on the R e s i d e n t Council of C l a s s i c Residences by Hyatt in Aventura. “The civil rights of no other minority are as systematically and freely violated as those of the disabled,” Mr. Resnick wrote in 2001. “Most of us have lived our lives quietly suffering the indignities foisted upon us. “ Resnick has carried on the work she and her husband began together, serving as Access Now’s president and helping ensure that disabled people are treated fairly. Access Now is directed entirely by non-paid volunteers, including Resnick, who work with law firms, consultants and inspectors to encourage compliance with the ADA. Access Now, with various individual plaintiffs, has filed many class actions against businesses that have not removed barriers to disabled people. So far, all of the cases the organization has brought have been settled successfully out of court. The organization’s website, www.adaaccessnow.org, has more information.
