Calder Casino & Race Course hosts 'Day at the Races' BY BARI AUERBACH "Racing into the Future" was the exciting theme when Calder Casino & Race Course, a Churchill Downs Company, recently hosted a "Day at the Races" for Aventura Marketing Council members. Calder has broken ground on an $85 million renovation, which will result in space for 1,225 slot machines, just a stone's throw from Land Shark Stadium in Miami Gardens, in time for next year's Pro Bowl and Super Bowl. A 30-table poker room is also scheduled to open this fall. AMC business and community leaders and special guests including Miami Gardens Mayor Shirley Gibson were welcomed to the exclusive Turf Club overlooking the legendary track by Calder president and general manager Tom O'Donnell. "I have the utmost confidence in Calder becoming the number one choice for South Florida adult gamers (slots, poker and racing) seeking 'winning experiences' on each and every visit," O'Donnell said. Calder reached an important milestone when the State of Florida granted the track its License for Slot Machine Operations. Now, a 104,000-square-foot, $85 million slots casino is slated to open just in time for the Pro Bowl and Super Bowl XLIV - plus the brand new "Studz Poker Club" is scheduled to open in late October, featuring 29 tables and offering Texas Hold'em, Omaha, and 7-Card Stud. Forest City announces slate of new Village at Gulfstream Park tenants BY LYNN CARROLL The Village at Gulfstream Park is filling to the brim. Developer Forest City Enterprises recently announced another 13 tenants for the $244 million, first-phase leisure, fashion and entertainment project adjacent to historic Gulfstream Park. The new shopping and dinning destination plans a grand opening Feb. 11th after Super Bowl XLIV, which will be played in nearby Dolphin Stadium, about nine miles due west of the complex. Forest City says five of The Village's tenant restaurants -- Cantina Laredo, Santanera, Greenhouse, Texas de Brazil and Cadillac Ranch -- will be open for Super Bowl Sunday. Meanwhile, Gulfstream Park's 2010 race meeting begins Sunday, Jan. 3rd. Including the second-phase residential component, which is to feature a movie theater, a hotel and condominiums, Forest City puts the cost of developing The Village at Gulfstream Park at $1.2 billion. Recently joining the roster are Bartini's, a martini lounge and live-entertainment venue; Paradis Latin Miami, fashioned after world-renowned, theatrical cabarets; and Ta-Zin, an authentic Moroccan restaurant. New retailers are Adrenalina, an extreme sports destination; the Apricot Lane women's fashion boutique; Aventura's Finest Hand Car Wash, for full-service
car washes and detailing, and Bobby Chan, a designer of men's clothing and accessories. Also added are Claudio and Claudio Shoes, high-end fashion and footwear boutiques from designer Claude Cohen; European women's fashion specialist Lilly McKay; and Roxstar, featuring men's and women's designer apparel and accessories. Attorney Mark Lynn sees hope in the housing market BY LYNN CARROLL Transactional attorney Mark J. Lynn says he's optimistic about the recovery of the local housing market. "I work on closings with a lot of Realtors and mortgage brokers," he says, "and I see that things are slowly moving forward. Deals are harder to do than they used to be, but they are happening." Federal programs to help homeowners refinance their loans and the $8,000 tax credit for first-time homebuyers are helping, Lynn says, and a new law that takes effect on the first of the year dramatically changes the way loan modifications are done, potentially ending the questionable practices that have plagued the market. Last year, Congress enacted the Secure and Fair Enforcement for Mortgage Licensing Act, or S.A.F.E. Act, imposing greater regulation on the mortgage industry, with a mandate to states to enact their own versions. The Florida S.A.F.E. Act recently signed by Gov. Crist does three things, Lynn says: First, it creates much more stringent qualifications for mortgage brokers, including credit reports and background
checks. Second, it creates the position of mortgage originator someone who is not a broker but is licensed to negotiate the terms of a mortgage or modification. Third, it more tightly regulates "mortgage rescue" companies, like loan modification companies and foreclosure rescue firms. "Loan-modification companies in the past could receive upfront fees under certain circumstances," Lynn says. "The S.A.F.E. Act does away with that. While attorneys still have the ability to receive certain up-front fees, loan modification companies cannot get paid unless and until the loan modification is complete and you obtain a substantially positive result for the borrower." These regulations, meant to protect the consumer from fraud, may threaten all but the most established loan modification companies, he says. Mark J. Historically Yours BY BOB DIAMOND SEGREGATION AND MISCEGENATION Despite the Civil War ending in 1865, ratification of the 13th Amendment ending slavery (1865) and the 14th Amendment (1868) which provided that no State shall deprive any person of life, liberty or property without due process of law nor deny the equal protection of the laws, twenty-three year old Davis Knight was indicted in 1948 in Mississippi for the crime of miscegenation - the mixing of racial blood. Knight, who looked and passed as white, after three years of service in the navy and receiving his honorable discharge in 1946, came home to marry his blond, blue-eyed eighteen-year-old June Lee Spradly. The police arrested him for “racially polluting a white woman against the law.” A Negro was defined under Mississippi law as “anyone with one-eighth or more African ancestry.” Since Knight’s grandfather Newton was admittedly white, the key issue for the prosecutor to prove was Knight’s grandmother Rachel, a former slave, who had
passed away some sixty years prior, had to be “of full African ancestry.” Defense attorney Quitman Ross fought hard to raise reasonable doubt as to Rachel’s racial classification, as prosecutor’s witnesses described her alleged Negro physical features. A defense witness testified that she had white features while another defense witness denied that she had any Negro blood whatsoever, stating she was Indian. The jury found Knight guilty. On November 14, 1949, the Mississippi Supreme Court totally avoided defense attorney Ross’s argument that the miscegenation statute was unconstitutional under the 14th Amendment, fearing that it “would invite federal interference in Mississippi’s segregation laws,” and overturned the conviction on “reasonable doubt” and “used as an excuse that it was impossible, sixty years after her death to establish her racial identity.” Only forty-two years ago (1967), the U.S. Supreme Court in Loving v. Virginia struck down all statutes banning miscegenation as violating the 14th Amendment. President Obama, whose parents wed in Hawaii, recently celebrated his 48th birthday. We have come far as a nation in 42 years!

PROVOCATIVE QUESTIONS FOR PROVOCATIVE PEOPLE LC: In Aventura's restaurant scene, Grill on the Alley is the new kid on the block. What's your specialty? JM: I characterize Grill on the Alley's menu as classic American grilled fare. We have a bigger menu than most fine-dining restaurants, including specialties such as our prime steaks, aged 28 days, and seafood that's fresh daily, as well as great chicken dishes and pasta dishes. We also have a very attractive lunch menu including seafood offerings, burgers and sandwiches, and entree salads. Lunch or dinner, we have something for everyone. The price of every entrĂŠe includes side items. Generous portions are what we're about, and it's all made from scratch. LC: What's your theme? JM: Our theme recreates the old saloons of the 1930s and '40s in New York, Chicago and San Francisco - dark wood, period music and art. The concept originated in 1984, when the first Grill on the Alley was opened in Beverly Hills. It just celebrated its 25th anniversary. LC: You're managing Grill on the Alley's first location east of Chicago. What makes Aventura the right choice? JM: One of the biggest reasons was that Aventura Mall, where we are located, is one of the top three malls in the country for tourism, and our corporate executives wanted to get us in a prime spot for our
first location in Florida. The local clientele plus international tourism made it a natural fit. LC: What's new at the restaurant? JM: We're participating in Miami Spice, which offers a threecourse meal for $22 for lunch and a three-course dinner for $35. Our Happy Hour is very popular because in addition to our drinks, we have smaller portions of our appetizers - such as Seared Ahi Tuna Sashimi, Chicken Pot Pie and Kobe Beef Side-Kicks - for only $3.95 and $4.95. LC: What is your background in the industry? JM: I've been in hospitality management for 16 years now, and spent most of my career in South Florida. I was most recently Director of Operations for a small independent Italian concept; prior to that I worked in corporate restaurants such as Grand Lux Cafe and Outback Steakhouse.

Short circuits BY PATRICIA C. FRANK, PSY.D., LMHC Do you often feel tired and totally out of energy and strength? Have you ever experienced a sudden drop in energy for no obvious reason? Is this scenario familiar, you awaken full of vim and vigor and you are gliding through your day, then at some point, you suddenly find yourself tired, really, really tired. What happened? Did someone criticize you, judge you, discourage you, belittle you, misunderstand you or fight with you? Did they say hurtful things? If you often find yourself thinking, feeling or saying “I’m so tired” someone in your life may be the cause. Certain people can wear you down and make you feel weary. Their negative comments zap you and sap your energy. They drain you. These people are circuit breakers. A circuit breaker interrupts the flow of current. They short circuit and interrupt your flow of energy, peace and joy. It is also possible for you to be a circuit breaker and to do this to yourself. You can short circuit your own peace and
joy. Worry, fear, self criticism, resentment and guilt create stress and can break up your flow of energy and short circuit your positive feelings. It is crucial for you to find a way to flip the switch and get the positive, happy current flowing again. You must find a way to restore yourself. Analyze the source of distress. Identify the circuit breakers. Become aware of the sequence. What happened just before you were short circuited? Avoid circuit breakers if possible. Remove yourself from their life if you can. Learn coping techniques to reverse the damage and prevent reoccurrences. Learn to breathe deeply, relax, visualize, meditate, and release all the negative thoughts and feelings that have been created by others or by yourself. Combine as many techniques as possible. Sometimes, however, you can be so depleted that only rest or sleep can restore your equilibrium. It is wisely said that “Sleep knits up the raveled sleeve of care” Try a mini nap and tell yourself that you will awaken refreshed, relaxed and full of energy. Eat This…Drink That… BY SHARI LYNN ROTHSTEIN-KRAMER Drink to Enjoy, Not to Impress When I was younger, my mom and dad always had White Zinfandel, Grenache, or Manischewitz in the refrigerator. My first memories were that wine was pink and/or sweet. And it was fine—until I moved to Manhattan. I remember when I first became really curious about wine. Since this was way before Entocas were popular in the states, I went out, got a subscription to Wine Spectator, read books (yes, including Wine for Dummies and yes, it did actually help) and began the journey. I remember thinking, “Nothing pink ever again. Serious wine drinkers only drink reds.” And with that I began tasting. Italian Cabernet Sauvignon, Barolo, Barbaresco, then French Cote du Rhone, Chataneauf du Pape, Bordeaux, any Pinot Noir from the Russian River and Willamette Vallies. I sipped and swirled and chewed and learned. I went to every local wine shop and asked questions for hours. I’d bring home bottle after bottle experimenting. I started investigating whites. I believe the first one I ever bought was Cloudy Bay Sauvignon Blanc. The apple, the pear… it was like heaven in my mouth. But were they really apples and pears I tasted? The problem was that I had no one to tell me whether I was doing it
right or wrong. Were the flavors I tasted correctly identified? What made this a good or bad bottle? Then I had an epiphany. There are no rules. I mean, sure there are rules, but they are more like guidelines, and what tastes good to you is good for you. And there’s no need for snobbery. That’s what scares so many people away. Fast Forward to 2008ish. Wine bars are dotting the streets of New York City. BY this year, they are taking over. Academia del Vino, Bar Boulud, Bar Stuzzichini, Wine & Roses. They began popping up everywhere. People were imbibing. Tasting. Learning. Not scary...but fun. In Florida, they are just catching on. We are lucky enough to have Bar Rosso right in our own backyard (in Aventura). It is a Vinoteca (their own take on Enoteca), and offer glasses, as well as piccolino and quartino pours of a large variety of lovely wines. There are some scattered around, but you really need to search them out. Try Bin 595 in Plantation, Harrison’s Wine Bar and VINO in Hollywood. They are close and cute. They can offer advice on various styles and can actually help you learn as long as you know what you like: dry, full, fruity, light, sparkling, tannic, acidic. If you can voice what you prefer, a sommelier can share his knowledge with you—painlessly. And that is how we learn. And even if you are not rushing out to a restaurant or bar, pick up a bottle of something you may have read about or tasted. Try it again and go from there. Enjoy and imbibe!

Wall Street fix worked, but we’re still waiting for ours
Al Sunshine 4 YOUR MONEY We recently passed a milestone: Wall Street had the best July gains in about two decades, and the nation’s gross domestic product (GDP) only shrank at 1 percent, which is better than expected. The recession is ending, but it’s not even close to being over. Though recovery is beginning, we cannot expect to see a quick turnaround. However, I think by this time in 2010, we’ll have a much better perspective of the significance of what we’re seeing today. Nationally, improvements will be spreading out over the next 24 months as the American industry gets back to the business of making, distributing and selling what consumers want and need. Here in South Florida, however, it’s going to take more time. We felt the effects of the recession later, and our overbuilt housing markets pulled us down more than expect-
ed. Residential construction here may be stalled another two to three years until the supply of available homes and condos gets bought up and demand grows strong enough for new ones to be planned and built. But that won’t happen until the unemployment problem gets fixed. People have to get back to work, and consumers need to feel comfortable spending again. And here’s another possible milestone we just passed. RealtyTrac is a national real estate tracking company that checks out local foreclosure rates nationwide. When I asked for the latest monthly foreclosure figures for Miami-Dade, Broward and Palm Beach counties, I found that after the recession’s deepest period in March, foreclosure numbers in South Florida actually declined. Teresa Kinney, who heads up the Realty Association of Greater Miami and the Beaches, says loan modification programs and foreclosure moratoriums are working, and that our foreclosure problem “has peaked.” Although we’ve passed a milestone, we still have a long way to go. Check out some of these misconceptions that could be causing you to miss hitting your ideal weight goals and/or maintaining optimal nutrition… Granola Most granola bars are simply candy bars in disguise, with very little fiber, lots of processed carbs, and a ton of sugar. You’re better off making your own healthier version from raw oats, chopped almonds, coconut flakes, raisins and a dollop of raw organic honey. Egg White Omelets No yolks in your omelettes – why not? The yolk contains lutein and zeaxanthin, which are crucial for eye health. Egg yolks are also an important source of phosphatidylcholine, a nutrient that boosts brain health. Worried about your cholesterol levels? Consider this: Half the fat in the yolk isn’t even saturated. Farm Raised Salmon You’d think eating penned salmon would be the healthier way to go, but the farm-raised fish are pumped full of antibiotics and are lower in nutritional value than their wild relatives. In addition, wild salmon get their red color from an antioxidant in their natural food source, krill. Farmed salmon get their color from dye. Supermarket Cereal Most supermarket cereals are fiber lightweights and are also loaded with sugar. The best cereals are oldfashioned oatmeal, and a few standouts like Fiber One and All-Bran. Frozen Yogurt The only thing fro-yo has in common with real yogurt (the plain, non-frozen kind) is that they’re both white. You’re better off with a serving of organic ice cream. Canola Oil Along with olive oil, canola oil seems like a healthy standout. But conventional canola oil goes through a caustic refining process that creates some trans fats. Unless it’s cold-pressed and organic, stay away. Apple Juice It’s sweet, refreshing and a favorite among kids. But most apple juice is nothing more than sugar water with apple flavoring. One cup of apple juice has no fiber, 117 calories and 27 grams of sugar. And most people consume way more than a cup at a time. Stick to fiber-rich apples and skip the juice. Whole Foods Just because you’re shopping at an organic market doesn’t mean everything in the store is great for your diet. Most take-out sections feature prepared foods that can be very high in fat and calories. You also can’t assume everything you’re buying is “organic.” Check the label…If it says “natural” that’s not the same as “organic.” Of course, you’ll definitely be able to tell by the higher price. For example, a jar of almond butter that says “natural” vs. a jar that says “organic” has as much as an eight dollar price difference!

Attempting to figure out who and what you can trust in today is a difficult project. We have seen so many things we thought we could trust in being exposed as corruption, fraud and deception. However, that is nothing new! From the very beginning of mankind, there has always been falsehood and distrust. Lucifer, also known as Satan, was at one time the leader of all the angels in heaven serving at Godâ&#x20AC;&#x2122;s side. Soon he began to mistrust God and planned to become â&#x20AC;&#x153;like God.â&#x20AC;? Immediately following his expulsion from heaven Satan focused all his attention on the world and those who live in it. His main emphasis is to replace our trust in God with a form of trust in other things and other people. The Scriptures very clearly show us many of those replacements and their failure to produce the desired results. The very first commandment given to Moses and Godâ&#x20AC;&#x2122;s people laid the foundation for trust in God alone. â&#x20AC;&#x153;You shall have no other gods before meâ&#x20AC;? is followed with more details: â&#x20AC;&#x153;Do not make any gods to be alongside me, gods of silver or gold.â&#x20AC;? (Exodus 20:3, 23) The result

Isaiah 42:17) Much of what we hear appears to be the truth yet it is a twisted distortion filled with deceptive words that cannot be trusted. God specifically said: â&#x20AC;&#x153;Do not trust in extortion or take pride in stolen goods. Since you trust in your deeds and riches, you too will be taken captive.â&#x20AC;? Not necessarily captive to another land but to those deceitful practices. We dare not trust in our military forces and weapons alone. God Said. â&#x20AC;&#x153;Woe to those who rely on their horses, who trust in the multitude of their chariots and in the great strength of their horsemen but do not look to The Holy One of Israel or seek help from the Lord God.â&#x20AC;? Isaiah 31:1) David, the King and the Psalmist provided the answer for us in Psalm 56: When I am afraid I will trust in God and I will not be afraid. Some trust in chariots and some in horses but we trust in the name of the Lord our God. They are brought to their knees but we (who trust in God) will rise up and stand firm. Many homeowners and condominium associations throughout South Florida are experiencing a cash crisis as a result of owners failing to pay their required maintenance assessments. Without this necessary income, the associations bills pile up quickly leaving important services such as insurance, lawn care, management, and maintenance unpaid for, with some vendors unwilling to provide further services. Severe cases can leave associations without enough money to maintain basic necessities such as fire and safety equipment, security gates, and even water and garbage services. To make matters worse, some lenders are refusing to issue loans on the units within these communities and condominiums due to the severe delinquency rates of the associations, essentially putting a freeze on the marketability of such units. Much of the problem can be attributed to investors, many of whom own multiple units in the same community or condominium, not paying their assessments (some of whom receive income from tenants living in their units but still refuse to pay their assessments).

An association’s best course of action is to find a competent, diligent and aggressive attorney. Legal incompetence (including not utilizing effective legal strategies for the current market), an attorney’s inability to communicate with the board and manager of the association, and/or the failure of an attorney to proceed aggressively and diligently on behalf of the association, can cause unnecessary delays and additional financial suffering. For instance, some attorneys advise their clients to follow the passive approach of not filing liens against delinquent units and not proceeding with association foreclosures, thinking that lenders will eventually foreclose their defaulted borrowers and pay the association its money. The reality is that in today’s market, lenders are stalling their foreclosures until they find buyers first, so the process can take an unreasonably long period of time. Meanwhile, if the first mortgage holder does finally take title to the unit through its foreclosure, it is then entitled by law to a sizeable write off of the prior owner's past due amounts, resulting in significant bad debt to the association. This bad debt is then absorbed by the association and eventually paid for by the responsible owners who are paying their assessments. To succeed in the current market, associations need an aggressive attorney who files liens against the delinquent unit owners quickly and, in applicable cases, files foreclosure complaints (lawsuits) against the delinquent unit owners to collect the amounts due to the association. There is also a new blanket receivership approach where, by law, associations can petition the court to appoint a single receiver to collect the rents from all tenants living in units that are under foreclosure by the association or which come under foreclosure in the future (which prohibits investors from collecting income from tenants while failing to pay their assessments). Aggressively applied legal pressure against the owner and/or their lender is especially necessary in this type of depressed real estate market and will undoubtedly bring in a lot more money to the association in a much faster time than simply waiting for the lender to come through.
