Residents and young children recently united to plant the first ever butterfly garden at Classic Residence by Hyatt in Aventura. This intergenerational event brought together nearly 20 residents who worked alongside the children with the common goal of creating a beautiful sanctuary where residents can enjoy quiet meditation and relaxation near the poolside at the luxury community. The event coordinated by Lifestyle Director Paula Demello was a wonderful success. "Together children and seniors were able to share their talents, learn about nature and
enjoy the opportunity to serve the community," she says. "It was a day where the young together with mature adults found wisdom and inspiration in each other." Upon the placement and mulching of the final plant, resident John Pagliaro spotted a butterfly in the garden immediately and commented that it must be a good sign. Crystal Rouhani named Aventura Mall Tourism Director Aventura Mall, South Florida's largest super regional shopping center, has named Crystal Rouhani as tourism director. In this position, she will spearhead the mall's tourism outreach and initiatives, including the center's First Class Shopping Savings Program. Most recently, Rouhani served as director of marketing for Destin Commons, where she handled all aspects of the center's branding, strategic planning and marketing initiatives. She has also held the position of corporate marketing manager for Turnberry Associates' Retail Division, working on various marketing projects for the company's retail portfolio. Life in the City BY BARI AUERBACH What did you eat today? If you took the time to write down everything you had to eat today would you be able to put it on a “recommended diet plan” or would you be more likely to want to hide the list from a professional nutritionist or personal trainer? If the latter is true, here are some suggestions that could help turn a day of “eating and cheating” into a more “euphoric less caloric” feeling of fitness accomplishment: Breakfast: It’s not always about what you eat - but what you didn’t eat can be just as detrimental. For example, if you didn’t have breakfast this morning, you missed out on the opportunity to start the day by kickstarting your metabolism. Even if you’re not hungry or running late, it’s important to make time to eat something – but definitely not anything akin to a Denny’s Grand Slam artery clogging combo. An ideal breakfast could be comprised of egg whites for protein, a low-glycemic carb like oatmeal and a high-antioxidant fruit like blueberries. If you take a metabolic typing test and find out you’re a protein type that functions optimally with less carbs, you can replace the oatmeal with some avocado slices and enjoy the energy surge you’ll feel at least until it’s time for a mid-day snack. Lunch: If you had a cheeseburger and fries for lunch yesterday and don’t feel like doing an hour of cardio to make up for it today, here’s how you could have modified your menu: Instead of a
cheeseburger, a veggie burger, turkey burger or grilled chicken sandwich on a wholegrain bun would have been a better choice, accompanied by a sweet potato or brown rice and side order of vegetables or a salad (hold the croutons and fattening dressing). Dinner: Didn’t take the time to cook and ordered take-out instead? Even if you dinner is going to be delivered, there’s still a way to order to make the last meal of the day one of the most healthful. If you’re getting Chinese – the key word is “steamed”; if you’re getting Italian, “sauce on the side” and “grilled not breaded” can help save countless calories; and if you absolutely must have the pizza, just eat one slice and by all means don’t wake up in the middle of the night and eat what’s left in the box - cold! Snacks: If chips and dip, cookies, ice cream and candy bars were the snacks around the office or house that you indulged in, dump all that’s left into a big box and put it outside in the “junk” pile. Then, fill your desk drawers, cabinets and fridge with healthful replacements like fruits, organic nutbutter, multigrain crackers, low fat yogurt or string cheese and protein powder for making onthe-go shakes. Beverages: Forget the frappucinos! Although it’s ok to indulge in high-caloric beverage treats every now and then, many people don’t realize how insidious beverage calories can be and how quickly they add up to added inches. So instead of soda teaming with sugar, opt for green tea and in lieu of beer, an acai berry flavored water could really help you get that six-pack you’ve always wanted!

Obama administration goes after tax cheats BY STEVEN N. KLITZNER Just months into office, President Barack Obama has publicly announced the targets of his administrations. Among President Obama high-value targets are tax cheats who hide money in overseas bank accounts. On May 4, at the White House Grand Foyer, President Obama laid out his new measures to go after tax cheats, no matter where they stash their cash. “One of these measures would let the IRS know how much income Americans are generating in overseas accounts by requiring overseas banks to provide 1099s for their American clients, just like Americans have to do for their bank accounts here in this country,” Obama said. “If financial institutions won't cooperate with us, we will assume that they are sheltering money in tax havens, and act accordingly. And to ensure that the IRS has the tools it needs to enforce our laws, we’re seeking to hire nearly 800 more IRS agents to detect and pursue American tax evaders abroad.” Now, that’s big news in the world of tax
compliance. Not only does the Obama administration want to force overseas banks to disclose the holdings of U.S. customers, but it also plans to hire 800 new agents to sniff out tax cheats living on American soil. For those who thought Obama would be easier on tax compliance than President George W. Bush — who made a name for himself as an advocate for aggressive tax compliance — they received a rude awakening in May. In fact, Obama has positioned himself to be even more aggressive on tax cheats than his predecessor. So if ever the U.S. government sounded a warning to tax cheats, it came in May, when Obama declared a sort of war on those who refuse to pay their fair share. So what is the best choice when it comes to renting or buying? It used to be a harder decision, but our current economic problems are making the dream of buying a home or condo just too expensive. USA Today reports the latest research shows home ownership is dropping from a recent household high of 70 percent just five years ago to a projected 63.5 percent over the next decade. Ester Achee is a Miami renter who says she can’t afford a home’s extra monthly payments because, as she says, “I really can’t afford all the costs... so for me it’s cheaper.” So why exactly is renting getting to be a better option? One reason may be that because families are getting smaller, they’re not tied down trying to resell
their home and rentals are becoming easier to find. But Sandra Gonzalez is still happy with her home. “I bought it four years ago and it’s a good buy,” she said. “Everyone wants to live in Miami.” So what’s best for you? Financial Planner Matt McGrath says it depends on how long you want to stay where you’re living. “Think five years,” he suggested. “If it’s less than that you should consider renting, but if it’s over five years, seriously consider buying.” Before you make any decision, it’s also a good idea to check with your own financial planner or tax accountant to see what impact a purchase or rental could have on your next tax return. In fact, these studies already are having an impact across the America. Residential construction is beginning again in many parts of the country. Multi-family apartments are leading the way with new home construction expected to lag behind. Builders and developers are betting that rentals remain hot properties for a long time to come. “Do not go gentle into that good night, Old age should burn and rave at close of day; Rage, rage against the dying of the light.” There are different interpretations for this poem. One interpretation might be offering encouragement to people to live their life to the fullest right up until the very last moment. So many people stop living before the end. They allow their world to become narrow and restricted. They give up. They think it’s over long before it is over. Another interpretation of the poem might be encouraging individuals to fight to the end and to resist death. It suggests that they do everything to continue to live. It suggests that they take advantage of new medicines and new procedures to survive as long as they can. “They should rage against the dying of the light.” That rage seems to be a positive rage. There is, however, another kind of rage that can occur in the later years. There are certain people who become angry as they age. They are not just cranky, they are angry. They seem to be constantly in a rage against everyone and everything. They do
not like the changes that take place as they age. Instead of just raging at the decline, they rage at everyone and everything. They even find that they are angry and annoyed with their family, friends and caregivers. They resent the fact that they have lost some of their independence. They are angry that they have to rely on others. They have difficulty adjusting to the lack of respect and lack of dignity that the world may show them. They are angry that they have to go and others may continue to live and be well. They are angry because they may not be ready to go. They may feel that they have not experienced everything that they wanted to enjoy. They may feel that they have not accomplished their goals. These individuals make others feel uncomfortable with their anger. They are not grateful for the good things that have happened in their lives. They only see the negatives. If you mention anything positive they will definitely get angry with you. There is not much you can do to change their mind. The only thing you can do is to make a resolution that you will not be like them. Decide now to change whatever is necessary to avoid becoming and angry person raging at the world. 2009 GMC Sierra Hybrid delivers better fuel economy Ron Beasley AUTOMOTIVE EDITOR
LET’S TALK CARS The GMC Sierra Hybrid is a good-looking full-size pickup with all the power and performance needed in a big truck; it also gets excellent gas mileage. Credit the power and performance to the big 6.0-liter gas V-8 engine under the hood, but chalk up the efficiency to pairing that engine with GM’s patented twomode hybrid system. For the record, the Sierra Hybrid delivers 21 mpg in the city and 22 mpg on the highway for both the 2WD and 4WD models, and the 26-gallon fuel tank allows a cruising range of more than 500 miles. That’s a 40 percent increase in gas mileage for city driving (25 percent overall) over non-hybrid models. Yet, the Sierra Hybrid still has the capability of a full-size pickup, including towing a 6,100-pound load (5,900 pounds for 4WD models). The Sierra Hybrid is available in the
Crew Cab body style on both 2WD and 4WD models and comes standard with StabiliTrak electronic stability control, a locking rear axle and a trailering package. Dual-stage frontal air bags and head curtain side air bags are also standard. The Sierra Hybrid’s fuel-saving performance is derived from GM’s advanced Electrically Variable Transmission (EVT) and 300-volt nickel-metal hydride Energy Storage System (ESS), which work with the standard 6.0-liter V-8 gasoline engine with Active Fuel Management (AFM) and late intake valve closing (LIVC) technology. GM’s hybrid system not only enables the Sierra to launch and drive up to 30 mph on electricity alone, it allows the Vortec V-8 to operate in the more economical V-4 mode for longer periods. As part of the vehicle’s emission control system, the ESS is warranted for eight years/100,000 miles. In the Sierra Hybrid, the hybrid system itself generates the electricity used to propel the vehicle. When the brakes are applied or the vehicle is coasting, the electric motors within the hybrid system create electricity that is stored in the 300volt battery pack beneath the rear seat. It’s Not Too Early to Start Planning Your Estate
BY CURT HAGEDORN When you say Estate Planning, it causes a variety of reactions. Some people think it doesn’t really apply to them because they don’t have “a lot of money” or property. Others don’t want to think about what’s going to happen after they die, and still others think it’s something to start thinking about after retirement. Like most financial matters these day, however, estate planning is something to get into early, learn as much as you can about and revise and refine as you go along. Life is nothing if not full of random occurrences, and though you may be in your 30s with a new home, two new kids, a great career and a long life ahead of you, not anticipating what may be around the next corner is a gamble you and your family really shouldn’t take. Estate planning encompasses a number of things. • Investments. If you want to make sure your family is taken care of when you’re gone, you need to begin investing in their future now. From real estate and mutual funds to items like art, antiques and collectibles, think about your estate as a litmus test for purchasing things that will maintain or increase their current value – of thought and wisdom rather than
impulse. Even something as simple as driving safely and maintaining your car is in some sense an exercise in estate planning – avoiding risk and maximizing value, be it financial or strictly utilitarian. In any case, estate planning is a matter of making longterm investments, of buying low and selling high to a certain extent, and of maintaining the value of your investments, whether they’re mutual funds or real estate. • Insurance. In general, the younger you are when you begin paying into an insurance plan, the better the rate. So begin looking into insurance now – you’ll be surprised how much more your monthly bill for the same coverage will be ten years hence. Types of insurance to look into include, of course, homeowners, personal property and life insurance, as well as various types of disability and long term care insurance should you become incapacitat-
ed and unable to work. Make sure you understand the terms of your insurance – while more expensive, insurance policies that increase in value over time may be a better investment than those which, for example, expire when you’re 85. If, however, you’re starting late at getting insurance, such “term life” policies may be worth a gamble. • Lawyers, accountants, investment planners. Finding a good lawyer, a good accounting and a good financial advisor in whatever combination can be worth its weight in gold, and it’s a good idea to start young. Checking your college alumni association, asking friends and colleagues and reading financial publications, particularly local financial news, are all good ways of identifying potential professional help. Find people and companies you can trust and stay with them – these are, next to your immediate family and work, the most important rela-

Again, the earlier you make these arrangements the more protected and secure you, your family and your assets will be. Though there are often a lot of emotional issues around creating a will and contemplating your own or others mortality, try thinking of these things as constantly changeable documents – and treat them that way based upon changes in your own life, from buying property to getting a divorce to having another child. Making sure your will and other documents are up to date for you, your spouse, and your family is perhaps the simplest and least time consuming of all Estate Planning chores, and can greatly increase the sense of security that both you and your family have against unforeseen events. • Exercise common sense. Planning your Estate is basically about caring for your loved ones, don’t complicate it by trying to use your Estate to resolve relationship conflicts or settle old scores – be fair and take the long view.

WHOLE E BODY SCAN Whole Body Scans are used for “screening” of heart disease and cancer. In medicine, “screening” means looking for a medical condition in a person showing no symptoms in the hope of identifying problems early; when treatment can be most effective. CARDIAC C CALCIUM M SCORE Coronary artery calcium (CAC) has been shown to be highly specific for atherosclerosis, demonstrating that if there is coronary calcium present, there is plaque building up in the coronary arteries. There is ample evidence to now show that elevated coronary calcium scores (CCS) are predictive of future cardiovascular events, both independently of and incrementally to conventional cardiovascular risk factors. Based on current available data, patients with increased plaque burdens (increased CCS) are approximately ten times more likely to suffer a cardiac event over the next 3-5 years. Coronary calcium scores have outperformed conventional risk factors, highly sensitive C-reactive proteins (CRP) and carotid intima media thickness (IMT) as a predictor of cardiovascular events.

Finding Part Time Work to Supplement Your Income BY AMANDA KNOLES In years past it was common to work at one company for an entire career and spend the retirement years traveling, playing golf, or pursuing hobbies. Today with increasing financial demands and changes in social security laws raising the retirement age above 65, many Baby Boomers expect to work at least part time during their retirement years. After decades of being on the fast track in the working world, some people find it hard to stop working abruptly at retirement and prefer to keep busy in another job at least part time. A skills-based resume is an effective way to highlight your experience and accomplishments without calling attention to your age. Try to list skills that can apply to a variety of positions such as supervising others, customer service, making sales calls, organizing databases, research, budget management, etc. Don't forget to list any volunteer or management experience you may have even if it was in unpaid positions. When you begin your search for a part time job it's a good idea to approach smaller businesses and nonprofit organi-
zations that have a tendency to be more flexible in hiring older workers. If you enjoy working with kids, consider applying to work as a teacher's assistant. There is a huge demand in private and public schools and many school systems allow onthe-job training. You may be able to transfer your business skills into a consultant position. Talk with past work contacts and associations within your industry for leads on part time financial, marketing, project management and other opportunities. Many mature workers who have spent years in office jobs enjoy expressing their creativity in a part time job related to a favorite hobby. If you love antiques, you might consider working at an antique shop or helping a local dealer acquire and appraise new inventory. Gardening enthusiasts might work for a florist, a home and garden shop, or for a landscape designer. Even if you aren't skilled at floral or garden design, many florists and nurseries need people to work part time making deliveries and taking orders especially during busy seasons like Valentine's Day, Mother's Day and Christmas. If you enjoy working with people, talk with your local bank about becoming a
new accounts representative, teller or financial consultant. Museums, amusement parks, casinos, resorts and restaurants are always in need of friendly people to work as tour guides, ticket takers, servers, etc. Avid readers or music fans are a natural for working in bookstores and music shops. Or put your knowledge as a movie buff to work at a video rental store. Many hotels, retail stores, apartment complexes and businesses hire seniors to work as security personnel or as information agents for a front lobby. Those with a background in security or police work may find part time work as a security screener at the airport. Contact the Transportation Security Administration for more information or check with your local airport authority for details on positions that may be available. Travel enthusiasts may want to look into tour guide opportunities or even teaching English abroad. Many airlines also employ mature workers to work as airport reservationists, food preparation staff, baggage handlers, or to staff reservation call centers. If you worked for years in a construction job and no longer want to wield a hammer and saw, you may be able to transfer your years of experience on job
sites to a new position involving project management or supervising inventory. It is important to convey how your years of experience in other industries can benefit a new company. Talk about transferable skills that relate to the job at hand. Be convincing about your ability to adapt to new situations and use your time in an interview to demonstrate your pleasant personality and willingness to work with others. Don't forget to mention hobbies, interests and volunteer experience. For example raising funds for a charity is relevant if you are applying for a sales job. Be prepared to address employer comments that you are overqualified for a position. You might explain that you are looking to expand your knowledge by exploring a different field. It is against the law for employers to discriminate because of age but you may have to address subtle references to it. Let the employer know that you are enthusiastic, computer literate (if applicable) and open to learning new things. Be honest about explaining any gaps in your employment. If you took time off to care for a spouse, or you were laid off, explain the circumstances and emphasize that you are ready to return to work.

Insuring Good Health for Retirees BY SARAH KOCH While there are a number of good things about getting older, obtaining adequate health insurance isn't one of them. According to the Employee Benefit Research Institute (ERBI), only about 37 per cent of those retiring before age 65 will continue to have now former-employerbased health coverage, and only 27 per cent of those who retire at 65 or older will do so. Even if you're thinking that retirement for you is a long way off, just know that, according to experts, Medicare will run out about 2030. Even if you fall into one of the above minorities, you'll probably be required to pay full premiums, which can be a shocker. Still, though, you'll be paying a group rate, not individual, and you'll likely be getting broader coverage than you would with an individual policy. Even if you're told that your -- and your dependents' -- coverage will end on your last day with the firm, check to see if the federally based COBRA law applies. Under COBRA, certain businesses must offer their former employees insurance coverage, even if at full premium. Excuse me, but haven't you ever heard of Medicare? Indeed I have, Smarty-pants. But Medicare, on the average, covers less than 50% of a senior's health costs. And that fact brings us to Medigap (Medicare Supplemental) that can be used to fill in some of the cracks. In order to get it with a minimum of fuss (i.e., no physical exam, or questions about your health) be sure to apply for it within six months following your 65th birthday. Medigap offers ten individual and varied plans, each with the same minimum benefits. If you think it's likely you may need longterm health care (whether in-home or in a nursing home), be aware that Medicare covers only about 10% of such expenses in the US. That's when you might turn to Medicaid. To qualify for this, though, you have to fall below the poverty line, which measurement varies from state to state. OK, grim though that this all may sound, buck up, Sparky! It's not like there aren't options. Options, did you say? Yep. To begin with, you could try putting aside enough to cover those possible health/long-term care expenses. Per the ERBI again, that would mean saving up about one million dollars to cover such potential costs over the remainder of your life following retirement. This amount, of course, doesn't include what you'd need for your everyday expenses. Yes, I know – yipes! Well, thank heavens, that’s not the only choice. So, if your former employer drops you altogether, you can look into private insurance policies (expensive) or a group insur-
ance package, which would prove more economical. Then again, there may be more options. Such as: How do you feel about further education? You might be able to acquire health coverage by returning to school. Many junior colleges and universities offer relatively inexpensive insurance for their students, and you may only have to take a couple of courses a semester to qualify, just as long as you're building towards a degree. Have you wanted to move? I ask because health insurance costs vary from state to state. (This is true for auto and home insurance as well.) The bright side here is that this is true, even for people who are already suffering from ill health. At that, there are countries in both Latin America and Europe with socialized health care, though there could be either a period of residency that must be met, or you may have to marry a native. Then again, that may not be such a sacrifice. Travel is so broadening . . . and would make you eligible for traveler's health insurance. Then again, for those of you in the military, check out TRICARE. Also, have a thorough physical before your retirement date, and fully document any injury you received while serving, however minor. (What's trivial seeming now could develop into something more serious in the future.) In addition, to protect your chances of a successful later claim, also note any preexisting conditions that became aggravated during this period. If you don't have such evidence, then you may be unable to make a successful claim later on. Even if you eventually pick up insurance from another employer, as a veteran, you may be qualified for special benefits, so investigate fully. At that, for those who retire too early to qualify for Medicare, there may be the possibility of "interim" insurance. In fact, depending on your given profession, and the state where you live, there may be special options open to you, so don't fail to ask questions! A few last words . . .Before beginning your search for the most appropriate coverage, ask yourself the tough questions. " What kind of health coverage might I need?" (There's no need to pay for what you won't likely use.) "What's my family history like?" If heart problems, say, run in the family, then it would be smart to plan for that eventuality. As for advice, you're not in this alone. Contact a trusted insurance agent, scour your Yellow Pages for a local agent, or call the American Association of Retired Persons, also listed in your phone book. Any of these folks can help steer you in the right direction, answering your questions, and even helping you to decide what questions to ask.

One of the more popular ways for individuals to arrange for the disposition of their assets after death is the establishment of a “revocable living trust.” In the simples possible terms, this is the creation of a separate entity – My Living Trust, for example – which assumes titular ownership of all of your assets during your lifetime and which is under your control as Trustee. Anyone whom you wish to benefit equally in the distribution of the assets is listed as a subsidiary Trustee and, upon your death, Trust assets automatically devolve to these individuals (or other entities) without being required to go through probate. Though this is the simplest way of understanding how a Trust works, remember that, depending upon your assets and financial/personal situation, there may also be other avenues of estate planning of benefit to you and your family, and that it is best to get the advice of a reputable estate planner and/or lawyer before proceeding with any legal actions concerning your estate. Here are a few things to keep in mind about Trusts: • The words Revocable Living Trust describe exactly why they have become so popular – it is a way of retaining control over all your assets while your are still living, can be revoked by you at any time, and yet basically places your entire estate or any part of it you decide to include in “Trust” for your beneficiaries after death. If your wishes for the distribution of your estate are more complicated than that, you will need to consult your lawyer about other options. • Many assets, including bank accounts, your home and your car, can be designated as POD or “Payable On Death” to one or more individuals, thus also avoiding probate and perhaps obviating the need for a Living Trust. These rules vary from state to state, and you should check with your lawyer to make sure that these options can be exercised and if the consequences vary from establishing a trust. • Normally, the establishment of a Revocable Living Trust also requires the establishment of a successor Trustee/Trustees (which in many cases is the beneficiary, for example, in the case
of a spouse when there are non-marital assets) as well as a Power of Attorney, Living Will and Last Will and Testament. These documents together basically seek to deal with any contingencies – a Power of Attorney designates a person or entity to be in charge of your assets should you become incapacitated and unable to handle your own affairs, a Living Will allows you to exercise your right to refuse extraordinary resuscitation measures and often designates an individual responsible for “pulling the plug” should you be on extended life support and of course, your Last Will is not only your final opportunity to communicate with your loved ones regarding your wishes concerning your assets but also can designate your wishes for disposal of any property not covered by the Trust, Again, this is the simplest way of understanding these documents, and they can contain many variations and contingencies which should be determined with the help of a qualified legal representative. • Remember that a Revocable Living Trust is different from a Trust Account – a Trust Account being a specific financial account set up to hold monies or assets in trust for a variety of reasons. For example, lawyers often have a number of Trust Accounts set up to receive retainers and other fees from clients for work that has not yet been performed, or to receive settlements, which then will be disbursed to clients. • Whatever type of retirement planning you decide to do, do not procrastinate. It is better for both you and your loved ones to have these matters clearly delineated with no confusion whether you’re starting out or anticipating the end of your life. • In today’s complicated financial world, the same thing applies to your finances as applies to your health – get a second opinion. If you do not understand some element of your estate planning, consult another professional. Also, don’t forget that your local bookstore, library or college and university has information and classes that can help you get a foundation of knowledge about estate planning.

Quick response time by neurosurgeon reverses patientâ&#x20AC;&#x2122;s paralysis after stroke BY LEE STEPHENS Nora Olarte felt like her head was going to explode. Her body became numb, and she was fearful of having a stroke. Olarte had reason to worry: stroke is the leading cause of long-term disability and the third leading cause of death according to the National Institutes of Health. She was rushed to Aventura Hospitalâ&#x20AC;&#x2122;s emergency room. Neurosurgeon Santiago Figuereo, M.D., who takes Emergency Department on-call duty at Aventura Hospital, knew he had to act quickly. Dr. Figuereo is specially trained to quickly diagnose and treat patients who are brought to the Emergency Department where he performs unique, state-of-the-art minimally invasive surgeries of spine and brain disorders not currently available in South Florida. Dr. Figuereo was notified immediately and was even able to view Olarteâ&#x20AC;&#x2122;s MRI scan from his computer at home. Upon review of the scan, he diagnosed bleeding in Olarteâ&#x20AC;&#x2122;s brain and had her prepped for emergency surgery to repair the blood vessel in her brain. â&#x20AC;&#x153;With emergencies involving the brain and spine â&#x20AC;&#x201C; such as strokes or aneurysms â&#x20AC;&#x201C; it is essential that we respond quickly,â&#x20AC;? said Dr. Figuereo. â&#x20AC;&#x153;Response time can mark the difference when cutting the risk of death or permanent disability. Tips For Saving Money on Health Care BY AMANDA KNOLES Health care costs are climbing at an alarming rate but there are many things you can do to save money. You can't change your age to lower the cost of your insurance premiums but you can lose weight and stop smoking. Being a nonsmoker could reduce your premium by 25-30 percent. And losing 10-20 pounds could also lower your rate. Where you live can also make a difference in your insurance premium. Check out the different prices in nearby cities and you could see a difference of six percent or more. Most insurance companies set rates based on how many claims are filed within a region. A local insurance agent can help you access the rates for different zones. Group coverage is always a better deal than individual insurance. If you no longer have employer-sponsored insurance or you are working part time for an employer who doesn't provide insurance, check to see if joining a local or national organization might help you qualify for group insurance rates. The annual fee you pay in membership may be well worth the savings you receive in health insur-
ance premiums. AARP offers a couple of insurance programs to help those under 65 who don't yet qualify for Medicare as well as supplemental plans for those who seek additional coverage. It is a bad idea to put your medical bills on a credit card. With high interest rate cards you will end up paying much more than if you work out an interest-free arrangement with the doctor's office and pay in small monthly installments. Some clinics and hospitals allow people to pay on a sliding scale based on income. Check with your city's health department, nearby hospitals and pharmacies for information on free health screenings and other services that may be available at various times throughout the year. Many senior centers are also served by local doctors, dentists and optometrists who offer low cost services. Many people save money on insurance by buying catastrophic coverage. This means taking out an indemnity policy with a very high deductible ($2250 or more). Choosing such a policy can trim your premium by as much as 50 percent. When comparing health plans study the benefits, costs and restrictions as well as the premium costs. Make a list of services
you and your spouse use and compare whether those services are covered 100 percent, 80 percent, or not covered, and the amount of deductible costs you will need to pay. You should compare plans until you find the best price for the benefits you are most likely to use. Generally you will pay lower premiums if you agree to use a designated network of doctors, hospitals, labs and specialists. Plans that offer the freedom to choose any doctor you like usually cost considerably more. If you are laid off from your job you can continue your health insurance through COBRA. At the end of the COBRA period, you may be able to convert to an individual or family policy depending on the insurance carrier. COBRA premiums are usually lower than if you took out a new individual insurance policy. The U.S. government and several insurance companies are promoting the idea of combining high deductible health insurance policies with tax-free medical savings accounts (MSAs). With an MSA the government offers you a tax deduction to save money in an account reserved for medical expenses. For example an individual could set aside $1400 as a taxdeductible contribution per year. If you
don't spend all of the money on medical expenses in one year it can be rolled over into the next year. The money can be used at any time to pay for medical expenses and it remains tax-free. (There is a limit to how much you can contribute to an MSA each year based on whether the contributions are made by your employer, as an individual or as a family.) Qualifying medical expenses can include everything from acupuncture to laser eye surgery, teeth implants, and eyeglasses expenses that might not be covered under a traditional indemnity plan. (Be aware that if you withdraw money from an MSA to pay for something non-medical it becomes taxable and you will also be assessed a 15 percent penalty.) Always ask your doctor if a generic version of a prescription drug is available, which will save you money. Several major pharmaceutical companies participate in patient assistance programs that offer prescription drugs to people who cannot afford to pay the full cost. What did you eat today?

If you took the time to write down everything you had to eat today would you be able to put it on a “recommended diet plan” or would you be more likely to want to hide the list from a professional nutritionist or personal trainer? If the latter is true, here are some suggestions that could help turn a day of “eating and cheating” into a more “euphoric less caloric” feeling of fitness accomplishment: Breakfast: It’s not always about what you eat - but what you didn’t eat can be just as detrimental. For example, if you didn’t have breakfast this morning, you missed out on the opportunity to start the day by kickstarting your metabolism. Even if you’re not hungry or running late, it’s important to make time to eat something – but definitely not anything akin to a Denny’s Grand Slam artery clogging combo. An ideal breakfast could be comprised of egg whites for protein, a low-glycemic carb like oatmeal and a high-antioxidant fruit like blueberries. Lunch: If you had a cheeseburger and fries for lunch yesterday and don’t feel like doing an hour of cardio to make up for it today, here’s how you could have modified your menu: Instead of a cheeseburger, a veggie burger, turkey burger or grilled chicken sandwich on a
wholegrain bun would have been a better choice, accompanied by a sweet potato or brown rice and side order of vegetables or a salad (hold the croutons and fattening dressing). Dinner: Didn’t take the time to cook and ordered take-out instead? Even if you dinner is going to be delivered, there’s still a way to order to make the last meal of the day one of the most healthful. If you’re getting Chinese – the key word is “steamed”; if you’re getting Italian, “sauce on the side” and “grilled not breaded” can help save countless calories; and if you absolutely must have the pizza, just eat one slice and by all means don’t wake up in the middle of the night and eat what’s left in the box - cold! Snacks: If chips and dip, cookies, ice cream and candy bars were the snacks around the office or house that you indulged in, dump all that’s left into a big box and put it outside in the “junk” pile. Then, fill your desk drawers, cabinets and fridge with healthful replacements like fruits, organic nutbutter, multigrain crackers, low fat yogurt or string cheese and protein powder for making on-the-go shakes. Beverages: Forget the frappucinos! Although it’s ok to indulge in highcaloric beverage treats every now and then, many people don’t realize how insidious beverage calories can be and how quickly they add up to added inches. So instead of soda teaming with sugar, opt for green tea and in lieu of beer, an acai berry flavored water could really help you get that six-pack you’ve always wanted!

As experienced Tax Attorneys, we strive to focus on the IRS’ most current target of wrath and explain it to our readers in a straightforward manner, in an attempt to demystify the IRS’ current tax initiatives and simplify all associated tax issues. Recently the IRS's best efforts have focused on obtaining information about American citizens and residents who have overseas bank/securities accounts which are not memorialized on their tax returns. To fail to do this invites substantial penalties; felony jail time and a fine equal to 50% of the amount held in the foreign accounts. Commissioner Shulman has offered amnesty to anyone who would confess his sins to the Internal Revenue Service before September 23, 2009. Entering the “voluntary compliance program” gives the taxpayer's two major breaks; no criminal prosecution and a fixed penalty which is limited to 20-25% of each year's additional tax liability plus an additional fine equal to 20% of the highest amount in the overseas accounts. Generally the voluntary disclosures will require: 1. Payment of all taxes and interest for the previous six years. 2. Assessment of an accuracy penalty of (20%) or a delinquency penalty (25%) for all years and 3. An FBAR penalty of 20% of the highest account balance during the six year period. To give you a feel for the extent of the actual economic bite of these various disjunctive penalties, we can look to an example provided by the IRS of an individual who's had $1 million in a foreign account, which earned 5% a year ($50,000). The cost for this individual to make a voluntary disclosure for this unreported income from this foreign account would be $386,000 (38.6% of amount in the account), plus interest. Such a deal!
Immigration and Naturalization has its own definition of what is a U. S. resident. The IRS and the various states, for income tax, real estate laws, property tax exemptions, marriage and divorce law, have individual (and not always similar) definitions of residence. Our main concern for the purpose of this article is residency for United States income tax purposes. The Internal Revenue Service has two principal tests for residence; if you meet either test, you are a United States resident for income tax purposes and subject to taxation on your worldwide income. The green card test; if you are a non US citizen who holds a “green” card (actually, it's pink now), you are a U. S. resident for tax purposes. This means that you have “a lawful permanent residence” in the United States. Once you obtain this card and you physically enter the United States after its acquisition, you are, in essence, admitting to the Internal Revenue Service, that you are a United States resident, ergo subject to all the same tax laws which are applicable to American citizens.
The substantial presence test; this relates to a mathematical test predicated on the number of days you spend in the United States over a threeyear period. The formula is: (number of days present in the United States in the current year) + (1/3 of the days present in the United States in the immediate preceding year) + (1/6 of the days present in the United States in the second preceding year). If the total exceeds 183 days in a three-year period, you are a United States resident for tax purposes. Generally speaking, if an individual spends more than four months a year in the US, then they will be a US resident. This is true even where an individual is physically present in the US illegally!
The IRS feels that it is a good deal, that should be considered seriously by anyone who has undisclosed foreign income. An individual who does not come in voluntarily and is later discovered by the IRS, could be subject to an assessment of 231% in taxes, accuracy related penalties and FBAR penalties, in addition to facing possible Criminal Charges! This offer is only open to taxpayers who make voluntary disclosures by September 23, 2009.
Let's see how this works. Melvin, a Mexican citizen, has been spending substantial amounts of time in the United States during the last three years.
So who is potentially in trouble here? The United States is one of the three countries in the world to tax both its citizens and residents on their worldwide income. Most countries tax only people who are residents without regard to citizenship. Canadians, for instance, pay income tax only while they are resident in Canada. Once they leave Canada (changing residence), they are no longer responsible for Canadian income tax. This is the general rule followed by most countries in the civilized world. For American citizens, there is no reprieve. No matter where in the world you live, you are responsible for filing income tax returns and paying taxes to the United States. Magnanimously, if you live outside the United States, the IRS gives you an extra 60 days to file your tax return.
Conclusion: for tax purposes Melvin is a United States resident. He must pay United States income tax on all of his worldwide income. If he still has bank/securities accounts in Mexico which total in excess of $10,000, he must file the FBAR form. If he fails to do so, he is subject to criminal tax sanctions as well as a penalty of 50% of the total in all foreign bank or securities accounts. So long as he has signatory authority over a foreign account, he will be held responsible for paying all taxes on the income produced by this bank/securities accounts and criminal sanctions if he fails to file form TD F 90-22.1.
The gray area of law concerns United States residents. Actually, the law is quite clear- if you are a U. S. resident, you have a tax responsibility identical to that of a US citizen. The issue that often arises between “resident” taxpayers and the Internal Revenue Service relates to who is a resident of the United States. Many foreign nationals spend a lot of time in the United States. If they exceed the “residency” thresholds, their worldwide income would become subject to United States income tax. In addition to this, if they maintained bank/securities accounts in their home countries and fail to file the required form (FBAR), they would be subject to the same 50% penalty and potential criminal prosecution as any other US taxpayer. What is residence? This is a word which has a multiplicity of meetings depending on which government agency you are dealing with.

The Internal Revenue Service can and will check your passport and visa to count the exact number of days that you are in the United States during the period in question. This is really a trap for the unwary. You can be a United States citizen or a resident, inherit a substantial bank account or securities account in a foreign country, and still fall prey to this trap. If you have this type of potential problem, the soundest advice that I can give you is to review your situation with a knowledgeable tax attorney or accountant. Make certain that this person has knowledge in this particular area of the law because, as I stated previously, the punishment for failing to adhere to this area of the tax laws is confiscatory and potentially confining. HOA and Condominium Associations in Cash Crisis BY: BEN SOLOMON, ESQ.
Many homeowners and condominium associations throughout South Florida are experiencing a cash crisis as a result of owners failing to pay their required maintenance assessments. Without this necessary income, the associations bills pile up quickly leaving important services such as insurance, lawn care, management, and maintenance unpaid for, with some vendors unwilling to provide further services. Severe cases can leave associations without enough money to maintain basic necessities such as fire and safety equipment, security gates, and even water and garbage services. To make matters worse, some lenders are refusing to issue loans on the units within these communities and condominiums due to the severe delinquency rates of the associations, essentially putting a freeze on the marketability of such units. Much of the problem can be attributed to investors, many of whom own multiple units in the same community or condominium, not paying their assessments (some of whom receive income from tenants living in their units but still refuse to pay their assessments). An association’s best course of action is to find a competent, diligent and aggressive attorney. Legal incompetence (including not utilizing effective legal strategies for the current market), an attorney’s inability to communicate with the board and manager of the association, and/or the failure of an attorney to proceed aggressively and diligently on behalf of the association, can cause unnecessary delays and additional financial suffering. For instance, some attorneys advise their clients to follow the passive approach of not filing liens against delinquent units and not proceeding with association foreclosures, thinking that lenders will eventually foreclose their defaulted borrowers and pay the association its money. The reality is that in today’s market, lenders are stalling their foreclosures until they find buyers first, so the process can take an unreasonably long period of time. Meanwhile, if the first mortgage holder does finally take title to the unit through its foreclosure, it is then entitled by law to a sizeable write off of the prior owner's past due amounts, resulting in significant bad debt to the association. This bad debt is then absorbed by the association and eventually paid for by the responsible owners who are paying their assessments.

To succeed in the current market, associations need an aggressive attorney who files liens against the delinquent unit owners quickly and, in applicable cases, files foreclosure complaints (lawsuits) against the delinquent unit owners to collect the amounts due to the association. There is also a new blanket receivership approach where, by law, associations can petition the court to appoint a single receiver to collect the rents from all tenants living in units that are under foreclosure by the association or which come under foreclosure in the future (which prohibits investors from collecting income from tenants while failing to pay their assessments). Aggressively applied legal pressure against the owner and/or their lender is especially necessary in this type of depressed real estate market and will undoubtedly bring in a lot more money to the association in a much faster time than simply waiting for the lender to come through.
