Strides for Safety Green 5K Race, Walk to benefit The William Lehman Injury Research Center at The University of Miami Miller School of Medicine BY LYNN CARROLL It's time to walk away from injuries by helping to sponsor their prevention. That's the idea behind the Strides for Safety Green 5K Race and One Mile Walk event scheduled for September 13th beginning at 7 a.m. in the parking lot at the Aventura Mall. Proceeds from the event, organized by the University Of Miami Miller School Of Medicine, will benefit injuryprevention research programs at the William Lehman Injury Research Center. The William Lehman Injury Research Center is the research arm of the Ryder Trauma Center, one of the world's leading facilities of its kind, says Dr. Jeffrey Augenstein., MD, PhD, a Trauma Surgeon and the Director of the Injury Research Center. "The center excels in every aspect of trauma care, saving thousands of lives each year," he says. "Because trauma is preventable, educating our children, teenagers and adults about the need for safety is an ongoing concern of the William Lehman Injury Research Center team." The Aventura CIRCLE: A hospital-wide charitable effort The Aventura Circle is a hospital-wide charitable effort on the part of the Aventura Hospital staff to help those less fortunate in our community. The title CIRCLE serves as an acronym for the team's motto: Community Involvement Requires Concerned Loving Employees. Each month, the Aventura Circle donates supplies and raises funds for local not-for-profit organizations that benefit the poor, needy and homeless throughout Dade and Broward Counties. This important mission began in June, when the staff at Aventura Hospital donated more than 50 bags of clothing to the Safe Space Foundation. Supported by the Miami-Dade County Advocates for Victims Program, Safe Space provides social and support services and relocation assistance for women and children who are victims of abuse. "We are immensely grateful to the staff at Aventura Hospital for helping us take a stand against domestic violence," said Cassandra Armstrong, Social Worker for Safe Space, "Each donation symbolizes another life saved." The Aventura Circle's charitable initiatives have continued throughout the summer months, with a food drive in July for Stop Hunger, an organization that has been feeding the homeless families and children of Miami-Dade County for more than 29 years, and a drive in August to donate school supplies to Kids In Distress, a community-supported agency providing services for the prevention and treatment of child abuse in South Florida. "The caring staff members at Aventura Hospital are dedicated not just to improving the lives of our patients but also to improving our community," said CEO Heather J. Rohan. "The Aventura Circle was established as a way for us to give back to our community." Tatyana Kats, vice president of Stop Hunger, remarked, "It is through concerned and caring individuals like them that we have been able to provide the much needed services that we have been giving to the poor, needy and homeless." Jewish Community Services' Milk & Honey Campaign kicks off the New Year Jewish Community Services of South Florida thinks everyone -- especially homebound frail elderly who are struggling to put food on the table -- should start the New Year off on the right foot. Historically Yours BY BOB DIAMOND Thomas Kennedy and the “Jew Bill” Despite the adoption of the Bill of Rights in 1791 that ensured freedom of religion to all American citizens, the voters of Maryland adopted a state Constitution that required the holder of any public office to “declare his belief in the Christian religion.” Although there were only about 150 Jews in Maryland at the time, Baltimore community leaders Solomon Etting and Jacob Cohen petitioned the state Legislature in 1797 to “place Jews on the same footing as other good citizens.” Maryland’s Legislature, however, controlled by conservative, anti-immigrant Federalists, denied the Jewish petition because of their religion. Jews found their hero in Thomas Kennedy, a Maryland state representative of Scottish Presbyterian origin from Hagerstown, who, although he never met a Jew, was outraged “by the injustice of excluding an entire group of people because of their religious beliefs.” To Kennedy, religion was a matter “between man and his creator alone.” In 1822, Kennedy proposed
legislation that became commonly known as the “Jew Bill,” which extended to Jews the same rights as Christians. The bill was not only defeated, but Kennedy, viciously attacked as an “enemy of Christianity,” lost his seat in the Legislature. His opponent spoke strongly against the “Jew Bill.” Although out of office, Kennedy declared, “I shall continue to battle for the matter, aye, until my last drop of blood.” Re-elected in 1825 as an independent, Kennedy resumed his fight for religious equality, and presented a practical argument; “failure to pass this bill would drive Jews out of the state, to the detriment of the local community.” In 1826, the Maryland Legislature finally adopted a bill allowing Jews to hold office but imposed an unusual condition they must declare their belief in an afterlife. A few months later, two Jews were elected to the Baltimore City Council. The unusual requirement about the afterlife was not dropped until the present Maryland Constitution was adopted in 1867. In 1918, grateful Jewish residents of Maryland erected a monument in Hagerstown in honor of Thomas Kennedy in recognition of his dedicated services to religious liberty, inscribed: “One who loved his fellow man.”

JD: We spent the first 10 months of our tenure together watching the market and doing a very sober analysis of where the industry was. From there, the company has grown very quickly. What we've done is created a paradigmatic shift in the industry.
ES: We have taken an industry that has been primarily Mom and Pop and focused on being more cost-effective and efficient. When we are engaged with any business entity, we view ourselves as a partner, not just a vendor. We try to help in any way we can.
LC: How did the company get started? JD: It's an interesting story. I've been in the credit card processing business since 2003, and I developed a very large clientele on my own. Edward Steinberg, whom my family has known for 35 years, was retired from a different industry after being bought out by a New York Stock Exchange company in 1997. When I started my business in 2003, we began having dinner together every month. He became my mentor.
ES: Jeff graduated from the University of Florida with an MA in Computer Sciences with honors, and was immediately recruited by Intel. He's an intellectual savant and a walking encyclopedia when it comes to credit card processing.

Is South Florida recovery just around the corner?

It sounds like something out of Mission Impossible because it shares the same initials: IMF. But in this case, IMF stands for the International Monetary Fund. It’s an international financial think tank that guides and coordinates international monetary policy. Of course, that sounds like pretty esoteric stuff. So when I just saw their latest headlines, it really made me read the fine print. The IMF reports, “The global recession is over and a recovery has begun,” reports Olivier Blanchard, the groups’ top economist. He goes on to caution that the global turnaround will not be simple because, “The crisis has left deep scars, which will affect both supply and demand for many years to come.”
The group predicts unemployment will continue and that there still will be some very major issues to be resolved both globally and by individual countries. So what does this mean to us here in South Florida? Is our recovery just around the corner? As we enter the height of the third quarter, with Labor Day getting closer every day, there are some signs that the recession is easing. Many economists predicted we would see improvements by the Third Quarter and they are starting to be seen more clearly almost weekly. Our real estate markets are showing new strength in both the condo and single-family home sales as prices may be bottoming out. Unemployment may be bottoming out, but there is no new rush to rehire former workers. Foreclosures around South Florida are slowing, but most experts predict the problem is far from over. Even more families are expected to lose their homes through the fall. Wall Street is recovering slowly, although we still are seeing too much volatility to encourage more smallinvestor money invested in the markets

many foreign investors buying up local homes and condos. The global recovery still is in its infancy. It will take awhile to be felt in South Florida because of how deeply we still are feeling our stalled local construction industry. We’re still being asked to wait for the full impact of Washington’s Economic Stimulus Plan to be felt. But some money-crunchers at the Palm Beach Post recently found Florida ranks dead last in the country for per-capita spending of Federal Economic Stimulus Funds. What’s more, until we start seeing a lot more new jobs, it may still be a while before anyone feels comfortable enough to say, “South Florida’s recession is over.” Still, the light at the end of the tunnel may be a little brighter now than a few weeks ago. Unfortunately, the tunnel is turning out to be a lot longer than anyone expected.

at this time. Our 401Ks are regaining some of their lost value, but nobody is really comfortable yet increasing their contributions because they’ve lost so much of their money the past year. Our banks seem stable, but just recently Colonial Bank was seized by the Office of Thrift Supervision in the year’s most expensive FDIC takeover. Expected banking failures recently led the Feds to open a new “Regional Satellite Office” in Jacksonville to handle the glut of bank seizures forecast for around the Southeastern United States. All mixed signs of the “deep scars” will remain as global reminders of just how deep this recession is and how long it may take lead us to finally say, “It’s history.” So is the recession over for us? I don’t think so. If global markets start improving, South Florida’s international trade and international tourism will start improving too. That will help to get local businesses hiring again. I think we already are seeing some very positive signs of improving investment in the real estate markets, with

He must not be defensive Q: I’m 38 years old and my wife is 31. We’ve been together for six years. We’re both educated and have no kids. I love my wife dearly and don’t want to lose her. She says she loves me also and wants to try to work things out, but she can’t promise me anything. Although we spend a great deal of time w ith each other, romance and affection were lacking. I made her feel more like my buddy/best friend than my wife. In addition, I made it difficult for my wife to communicate with me because I get easily offended and tend to criticize back. As a result, she has withheld her inner feelings for three years. Now she says she is not sure if she can get those old feelings back for me. She recently told me she doesn’t feel affection

for me anymore. I am willing to make the necessary changes for the sake of our mar riage. I also wonder if unrealistic expectations about marriage are involved here, since we both have solid core values. Do you have any advice? A: The best advice should come from this counselor you mention, as he or she will have a lot m ore information to go on than I do. The one thing I can say to you, based on what you’ve put down in your letter, is that you should go to this counselor with an open mind. You say that you love each other and that you treated your wife as a best friend, and yet she is quite upset. Your impressions of how you treated her and how she felt might be very different from hers, and if I’m right, this is going to come out as a result of the sessions with the counselor. If you get defensive, then this counseling is not going to have much effect. Since you admit you have this tendency, really try to listen to what the counselor has to say. Your wife will undoubtedly have some private sessions, and she will be telling this counselor some of her feelings that she has not been able to communicate to you. It’s only by acknowledging those feelings that you can patch this marriage, and the only way you can do that is if you listen carefully without prejudice.

Unhappy about your property taxes? BY ROMAN PAVLIK We are all getting our estimated property tax notices right now and more often than not they are full of surprises. I have received many phone calls in the last week from homeowners confused about the way the taxes are calculated. The most common question is “why are my taxes based on one value when the recent sales have been much less?”. The confusion is with the way the property taxes are calculated. Here is why: Our property taxes are paid in arrears every year and due in November. The tax bill is based on the value as of January 1 of the tax year which is 2009 this year. The county uses values from no later than December 31,2008 to calculate your assessment. The problem in today’s declining market is that it appears to be unfair because values now are less than they were January 1, 2009 and in some cases there are certain neighborhoods where values are as much as 50% less than they were earlier in the year. So what can you do to
lower your taxes? You can get a one on one interview with the property appraisers office. Bring your comparable closed sales from 2008 and if they make sense, usually it is not a problem to get them reduced. Living in Aventura, I expect to be able to step out of my front door, hop into my car, and find the best of every type of cuisine within mere miles of my home. I am not talking about chain restaurants. Sure, we have plenty of chains that are “fine”. PF Chang’s, Houstons, Morton’s the Steakhouse, The Cheesecake Factory…I’ll even throw in the Ale House for those of us who like a little sports with our burgers. These places are consistent and they never seem to disappoint. You always know what you are going to get – and that is why people go there. I personally do not like chains. I think they are too safe. Too predictable. Where’s the adventure in dining if you are not going to truly experience new cuisine? Now, don’t get me wrong. I understand in an economy that is less than stellar, everyone wants to make sure that they will go out, eat well, and be able to say, “Money well spent. Belly full. ” But come on. Where did the spirit of adventure go? Where did the artistry of gastronomy go? What happened to the chef/owner who absolutely loves what he/she does and creates his/her cuisine with passion and conviction? On the flip side, where is the public’s desire to taste, to try new things, to discover a hidden gem of a neighborhood place that you’ll quickly be able to call your “Cheers?” I went on a hunt recently to see if I could stay as far away from the typical suspects as possible and still eat well and affordably. I kept my radius focused: Aventura, Sunny Isles, North Miami Beach, and as far north as Hallandale. Heading into Hollywood opens a whole other can of worms, but I do think that Fulvio’s 1900 and Sage, both on Harrison Street, are worth mentioning.) I started with my tried-and-true eateries; the ones I love the most including Timo (which hands down could be one of the best restaurants anywhere), Bar Rosso (where the food is delicious and the wine bar concept is cool), Il Miglore (nice Italian food), Pilar (for fresh and reasonable seafood), and naturally, Chef Allen’s, who has reinvented itself after years and years of leading the culinary regime locally.
I went to Racks, Flamma, Calafate Grill, Rice, Siam Oishi, Sushi House, Oishi Thai, and learned about Joe’s on the Water (in Hemispheres in Hallandale Beach). All kinds of cuisine: from Brazilian Steakhouses and Japanese to Thai and Tapas. Not one is a chain. Sometimes I will make an exception: Grill on the Alley does have seven restaurants, the only one based in Florida resides in the Aventura mall. It is close to home, the happy hour is great, and I adore the GM, so I go. But the point is, there are so many “little guys” out there trying to make it – and they are just as good if not better then “safe” and “predictable” restaurants. Restaurants come and go, but when something is great, we, the locals, need to support it. Being a restaurateur is always tough, but in these times, it is darn scary. So, give them a shot, you just might be pleasantly surprised. HOA and Condominium Associations in Cash Crisis BY: BEN SOLOMON, ESQ.
Many homeowners and condominium associations throughout South Florida are experiencing a cash crisis as a result of owners failing to pay their required maintenance assessments. Without this necessary income, the associations bills pile up quickly leaving important services such as insurance, lawn care, management, and maintenance unpaid for, with some vendors unwilling to provide further services. Severe cases can leave associations without enough money to maintain basic necessities such as fire and safety equipment, security gates, and even water and garbage services. To make matters worse, some lenders are refusing to issue loans on the units within these communities and condominiums due to the severe delinquency rates of the associations, essentially putting a freeze on the marketability of such units. Much of the problem can be attributed to investors, many of whom own multiple units in the same community or condominium, not paying their assessments (some of whom receive income from tenants living in their units but still refuse to pay their assessments). An association’s best course of action is to find a competent, diligent and aggressive attorney. Legal incompetence (including not utilizing effective legal strategies for the current market), an attorney’s inability to communicate with the board and manager of the association, and/or the failure of an attorney to proceed aggressively and diligently on behalf of the association, can cause unnecessary delays and additional financial suffering. For instance, some attorneys advise their clients to follow the passive approach of not filing liens against delinquent units and not proceeding with association foreclosures, thinking that lenders will eventually foreclose their defaulted borrowers and pay the association its money. The reality is that in today’s market, lenders are stalling their foreclosures until they find buyers first, so the process can take an unreasonably long period of time. Meanwhile, if the first mortgage holder does finally take title to the unit through its foreclosure, it is then entitled by law to a sizeable write off of the prior owner's past due amounts, resulting in significant bad debt to the association. This bad debt is then absorbed by the association and eventually paid for by the responsible owners who are paying their assessments.

To succeed in the current market, associations need an aggressive attorney who files liens against the delinquent unit owners quickly and, in applicable cases, files foreclosure complaints (lawsuits) against the delinquent unit owners to collect the amounts due to the association. There is also a new blanket receivership approach where, by law, associations can petition the court to appoint a single receiver to collect the rents from all tenants living in units that are under foreclosure by the association or which come under foreclosure in the future (which prohibits investors from collecting income from tenants while failing to pay their assessments). Aggressively applied legal pressure against the owner and/or their lender is especially necessary in this type of depressed real estate market and will undoubtedly bring in a lot more money to the association in a much faster time than simply waiting for the lender to come through.
